Abstract:
Mental health law in Colombia has evolved over the past 50 years, in concert with worldwide recognition and prioritisation of mental healthcare. Laws and policies have become increasingly sophisticated to accommodate the ongoing transformations throughout Colombia's healthcare system and improvements in mental health screening, treatment and supportive care. Mental health law and policy development have been informed by epidemiological data on patterns of mental disorders in Colombia. Colombia is distinguished by the fact that its mental health laws and policies have been formulated during a 60-year period of continuous armed conflict. The mental health of Colombian citizens has been affected by population-wide exposure to violence and, accordingly, the mental health laws that have been enacted reflect this feature of the Colombian experience.

In August 2016, in Havana, Cuba, the Colombian Government signed a peace agreement with theFuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo, FARC-EP, after four years of negotiations. The agreement provided a window of hope that Colombia's fifty-year armed struggle, the longest-running conflict in Latin America, would finally come to a close. One actor in these negotiations, whose considerable influence has been underappreciated, is the Office of the Prosecutor (OTP) of the International Criminal Court (ICC). Colombia has been under preliminary examination by the OTP since 2004. In addition to discharging its investigatory function, the ICC prosecutor has actively influenced the negotiation of two peace processes: first, the 2005 peace process with the paramilitaries; and more recently, the tumultuous negotiations with the FARC. This Comment explores the specific pathways of the OTP's influence in the Colombian peace process, and the broader lessons this episode holds for the ICC's work and for the continuing negotiations in Colombia.

The “internationalization” of the guerrilla war in Colombia signals a different course for resolving the 40-year-old conflict. Upon close scrutiny, it may actually prolong the war. This is the case since both groups, Colombian publicists and US policy-makers, who stand in the position of stewards to an international approach, oppose substantial political negotiation. The bulk of this Article examines the positions of international law taken by Colombian publicists. The author focuses on two issues which have been the subject of much recent debate. The first is the status of Colombia's guerrilla forces. The second issue concerns the rules of conduct of non-international war. The last portion of this Article examines the meaning of US-led internationalization of the Colombian conflict. This article analyze some of the important macroeconomic indicators in Colombia,such as the Consumer Price Index (CPI), the Gross Domestic Product (GDP), the Representative Market Rate (TRM), the Oil Price (BRENT and WIT) and COLCAP. The objective is to study Colombia's economic.The analysis were obtained with artificial neural networks on Colombian indicators data for the period 2001 to 2018 of the National Administrative Department of Statistics (DANE) and Bloomberg. Concluding, for Colombia, the last two cases are highly favorable for the economy, because they will generate a greater influx of dollars, allowing positive effects on the domestic product and the consumer price index.

On 11 September 1941, U..S. President Franklin D. Roosevelt took to the airwaves to warn his country that “Hitler's advance guards” were readying “footholds, bridgeheads in the New World, to be used as soon as he has gained control of the oceans.” The most recent sign that the Nazis were coming, the president told his rapt national audience, was the discovery of “secret airlanding fields in Colombia, within easy range of the Panama Canal.”In Bogotá, the response was pandemonium. U.S. ambassador Spruille Braden, astonished that “the President has gone out on a limb with this statement,” sent his staff scrambling across German-owned farms and rice fields to try to produce evidence for the assertion ex post facto. Colombian President Eduardo Santos scoffed at Roosevelt's claim, telling Braden, “in the final analysis all of Colombia is a great potential airport.” A resentful Colombian Senate voted unanimously that no such airfields existed (that Colombia had fulfilled its responsibility to defend against the Axis menace). In Washington, Secretary of State Cordell Hull was forced to call in Colombia's Ambassador Gabriel Turbay to express “the very deep regret of the President, of myself and of our Government” for the “unintentional reference.”

AbstractThe multiple crises of Colombian‐Venezuelan borderland geopolitics, which include a rise in Venezuelan refugees entering Colombia, mounting armed conflict from illegal armed groups throughout Colombia and the mixed efficacy of policy responses by the government, are converging to drive an evolution in Colombia's security concerns. This convergence of crises rivals the security conditions of the early 2000's. As before, the government faces prolific armed conflict, loss of legitimacy over sovereign territory to a host of illegal armed groups, unchecked coca cultivation‐trafficking and illicit economies, and an overwhelming loss of confidence in the central government's abilities to govern and counter these threats. This paper argues that the cumulative effect of the nascent convergence of crises is the subsequent rise of mounting Colombian insecurity and threats to stability that now permeates throughout the country – spanning and linking rural, urban and borderland areas in unprecedented ways while driving Venezuelan xenophobia and social unrest.

We have revised all the specimens of Araneidae from the Colombian Amazon Region in the Arachnological Collection of the Instituto de Ciencias Naturales at the Universidad Nacional de Colombia (ICN), in addition to the specimens collected between 2000 and 2004 by the authors in the lower Caquetá and Apaporis rivers (Amazonas and Vaupés, Colombia). A total of 77 new records for Araneidae in the Colombian Amazon are reported; 26 of these species are new records for the country and the region in addition to 15 more species known for Colombia but newly recorded in the region, the distribution of the remaining 36 species is expanded within the region. The genera Encyosaccus Simon 1865 (E. sexmaculatus Simon 1895), Hingstepeira Levi 1995 (H. folisecens Hingston 1932) and Micrepeira Schenkel 1953 (M. fowleri Levi 1995 and M. tubulofasciens Hingston 1932) are recorded for the first time in Colombia. From this revision, it is evident the great amount of new information available in museum collections. Due to the strategic geographic position of Colombia, species inventories in different localities of the Colombian Amazon Region are important to fill distributional gaps of many species in South America. This work contributes to the knowledge of geographic distribution patterns of orb-weaving species in Colombia and in the entire Amazon Region.

AbstractForced migration is an increasingly common feature in international relations, and the mass migration of Venezuelans to Colombia provides an opportunity to analyze how strategic narratives can support a welcoming migration and integration policy. Because Colombia is a country with no history of immigration and no established anti‐immigrant group, its experience provides unique insight into the impact and limitations of positive migration narratives. While Colombia's migration policy and humanitarian narrative have garnered praise internationally, this praise has not been matched by a sense of urgency for action, attention, or funding. Domestically, the policy response to mass Venezuelan migration has met international standards. Moreover, the country has experienced relatively little unrest compared to other host countries in Latin America. There is, however, ample evidence that Colombian perceptions of increased Venezuelan migration are negative and that tension and scapegoating are on the rise. Given these contradictions, this article reviews and discusses how and why Colombia's positive, humanitarian narratives have succeeded, as well as these narratives' limitations and need for adjustments. Together, these insights can help other host nations craft more effective and truthful migration strategic narratives.

Background Following the signing of the “Final Agreement for the Termination of the Conflict” in Colombia, an unprecedented boost for tourism is observed, promoting rural development and environmental protection. In the academic realm, Colombian universities offer tourism training programs to develop professionals with skills in management, sustainability, and technology. Methods Information is gathered from the Scopus database on tourism trends and from the National Information System for Higher Education (SNIES) on academic programs in tourism in Colombia until 2022. Geographical maps are employed to visualize the global scope of publications in Scopus and the locations of programs in Colombia. Text mining is used on Scopus abstracts and profiles of Colombian programs, generating word density graphs, frequency tables, and word clustering graphs. Results 707 articles from Scopus originating from 86 countries are selected, and 46 profiles of Colombian universities with tourism programs in 19 regions are compiled. Maps and tables demonstrate the geographical location of article density globally and of universities in Colombia. Word clouds, frequency tables, and dendrograms are generated using the abstracts and profiles. Conclusions Text mining analysis reveals similarities and differences between research and education in tourism in Colombia. There is convergence in management and development, reflecting aligned interests in both datasets. Words like ethics and sustainability indicate a shared commitment to a responsible perspective in the sector. Scopus emphasizes research, while Colombian universities prioritize practical training, especially in tourism management. This difference raises questions about the impact on graduates’ preparedness and their contribution to tourism development in Colombia. The geographical location of programs in Colombia shows a clear connection between academia and the tourism sector, facilitating synergies and continuous improvements.

La investigación aborda un problema clásico en la teoría constitucional relativo a los principios que estructuran los Estados contemporáneos. Si bien este asunto ha estado monopolizado por el principio de separación de poderes, nuestra investigación versa sobre el deber de colaboración que debe existir entre las distintas ramas y órganos del aparato estatal para el logro de sus cometidos. En la Constitución colombiana se prevé expresamente dicho deber, sin embargo, aún no existe claridad sobre su significado y alcance. A partir de ello, se propone en este escrito un marco teórico, un rastreo histórico, un estudio comparado y un recuento de las interpretaciones hechas para plantear una propuesta interpretativa del mandato de colaboración armónica para el sistema constitucional colombiano. Esta propuesta supone concebir a la colaboración armónica como un principio de rango constitucional, de naturaleza institucional y estructural que se torna indispensable para el desarrollo de una constitución con pretensiones transformadoras y aspiraciones como la colombiana.
This dissertation addresses a classical topic of constitutional theory; the structural principles of the contemporary state. Although this topic has been primarily studied in terms of the principle of separation of powers, this research argues that there is a duty of collaboration that must exist between the different branches and organs of the state in order to achieve their tasks. This duty is expressly provided for by the Colombian constitution. Despite this, there is a lack of clarity on its meaning and scope. To fill this void, this dissertation provides a theoretical framework, conducts a historical review, undertakes a comparative study, analyzes existing interpretations and proposes an interpretation of a harmonious collaboration mandate for the Colombian constitutional system. In conclusion, such a mandate implies a principle of constitutional status, which is of an institutional and structural nature, that becomes indispensable for the development of a constitution with transformative and aspirational aims, such as that of Colombia.

Les conflits juridiques autour du multiculturalisme et de la justice ethnique sont aujourd’hui au centre des débats juridiques et philosophiques Dans ce contexte la Colombie et ses conflits ethniques sont particulièrement représentatifs de ces débats. Ce pays est défini par la Constitution de 1991 comme un État multiethnique et pluriculturel. Les peuples autochtones ont été également reconnus et des droits au regard de leur différence culturelle ont été inscrits dans ce texte normatif. Dans ce cadre politique et juridique, la Cour Constitutionnelle du pays a joué un rôle fondamental dans l’interprétation et la définition de ces nouveaux droits. Pour l’analyse de la jurisprudence et de ce que nous appelons ici le paradigme de la justice interculturelle, nous nous appuierons sur la distinction faite par la philosophe Nancy Fraser à propos de la justice sociale en tant que reconnaissance et redistribution. Cette distinction marquera donc l’analyse que nous portons sur la question, et nous aidera en même temps à essayer de combler un vide dans les études concernant cette population. Cette grille de lecture de la question autochtone nous autorisera à mettre en évidence les limites de la reconnaissance de la diversité culturelle quand il s’agit de la question économique, de l’intérêt général ou de la raison étatique. Cela nous permettra aussi d’évaluer la cohérence du paradigme de la justice interculturelle et de sa philosophie implicite. Cette approche de la décision du juge implique que l’on considère que la jurisprudence peut comporter un fort composant de philosophie politique, ou en d’autres termes, que la jurisprudence contient une ou plusieurs philosophies implicites. C’est donc cette philosophie implicite qui nous intéresse ici tout particulièrement de mettre en évidence
The legal disputes around the multiculturalism and around the ethnic justice are at the heartof the legal and philosophic debates. In this matter Colombia today and its current ethnicconflicts are particularly significant of these debates. This country is ruled through the 1991Constitution as a multiethnic and multicultural State. Indigenous peoples have been alsorecognized as well and the rights tied to their cultural difference have been registered in thisnormative text. In this political and legal context, the Constitutional court of the countryplayed a fundamental role in the interpretation and the definition of these new rights. As faras the analysis of the jurisprudence and what we call here paradigm of the interculturaljustice are concerned, we shall rely on the distinction made by the philosopher Nancy Fraserabout the social justice as a redistribution and a recognition. This distinction will thus lead theanalysis which we develop about that subject, and will at the same time help us tryto complement in the studies concerning this population. This framework of interpretationof the autochthonous question will authorize us to highlight the limits of the recognition of thecultural diversity when it comes to the economic question, the general interest or the statereason. It will also allow us to estimate the consistency of the paradigm of the interculturaljustice and its implicit philosophy. This approach of the judge’s decision involves that weconsider that the jurisprudence can contain a strong bitof political philosophy, or in otherwords, that the jurisprudence contains one or several implicit philosophies. We are thusparticularly interested here in highlighting this implicit philosophy

The purpose of this thesis is to analyze the way in which religious beliefs and practices are instrumentalized by a Muslim community in order to strengthen Afro-Colombian ethnic identity, in an urban context of social exclusion. The study aims to examine the relationship between ethnicity and religion, and the role they play in the process of identity construction, particularly the way in which religious concepts and behaviors can be used to fortify ethnic identity. Another aim of this research is to describe and understand the processes of social change in an ethnic-religious minority and, as a final goal, to analyze the history of the Afro-Colombian Muslim community of Buenaventura. The thesis is based on fieldwork, which includes observation activities and interviews with members of the Muslim community in Buenaventura. A total of 21 participants between the ages of 18 and 72 are included in this study, all of them of Afro-Colombian origin. It is clear that the religious conversion of Afro-Colombians to Islam took place within the complex socio-political context of the Colombian conflict. To be sure, the adoption of this new religious perspective did not evolve in an isolated manner, rather, it transformed the identity of the community by strengthening the value of ethnic differences in a place of segregation. In this way, this thesis analyzes the role of religion as an important element in the construction of ethnic identity. Departing from this paradigm, we will look into some theological concepts, such as the Islamic jurisprudence and rituals, which have been reworked, in order to accommodate local aspirations for social mobility and ethnic differentiation. It is important to keep in mind, however, that this cultural negotiation happens at the margins of the dominant society, which negatively views Afro-Colombian minorities, or simply ignores them. Other findings include the identification of key moments of the historical development of the community; the analysis of the processes of conversion to Islam in this population; and the description of the organization, institutionalization, and hierarchy in the community in accordance with the changes from the Islamic perspective they have developed through its five-decade history.

Motivated by the environment of their country, Colombia, the co-authors present in this paper a research and analysis about the Manufacturing Industry (MI) and its relation to the growth of the economy in the different sectors of their country. Industrial innovation is key to competitiveness and development of economies; therefore, Corporate Entrepreneurship (CE) is seen by the co-authors as an answer for the Manufacturing Industry in order to keep on bringing value to the society and its related sectors. To have an approach to this CE analysis, theoretical framework used in the research is based in the Four Models of CE presented by Wolcott and Lippitz (Wolcott, 2010). Within the paper, it will be introduced the Opportunist, Enable, Advocate and Producer Model as conceived by them. No surprises were found when looking to the actual state of the companies in the MI, those with more budgets are the ones that invest more in innovation and the small ones are more conservatives in the topic. As part of the response to the research question, the co-authors established the path for the different company types in order for them to have an easy way to build CE.

Since 1999 Colombia has experienced dramatic increases in emigration, particularly the emigration of women towards the U.S. as fiancées of U.S. citizens or residents. Parallel to this trend is the increased number of websites facilitating these Colombian-American matches. This dissertation investigates the agency of Colombian women and American men who pursue romantic courtship through the services of International Marriage Brokers (IMBs) from the “Gendered Geographies of Power” (GGP) framework of analysis. It examines how both groups’ social locations, their positioning in multiple axes of differentiation including gender, nationality and social class, affects how and why they exert their agency across and within different geographic scales. Most importantly, it investigates the role the imagination plays (imagination work) in both men and women’s agency, an aspect of the GGP framework that has been under-researched and theorized to date. The research also finds that this imagination work is promoted and cultivated in deeply gendered ways by IMBs seeking to profit off this transnational courtship. Employing data collected via interviews and content analysis of IMBs’ websites, the dissertation analyzes comparatively the expectations each group (women, men and IMBs) bring to their imagination work and experiences of the courtship marketplace. A central question posed and answered in the dissertation is “What do women and men courting each other in cyberspace seek and do they find it?” The dissertation finds that the men seek “traditional” women and the women seek “liberated” less “macho” men. Ironically, the men find Colombian women who are among the most “liberated” women in their homeland but who downplay this aspect of themselves in order to strategically find a more modern man and migrate abroad where they expect to find greater personal and professional opportunities.

AbstractThe vital role of Roman Catholicism in establishing the social, political, institutional, and religious status quo in Colombia is plainly evident and well-documented. Since the Middle Ages, no other country has enforced such a complete integration of church and state (ideal medieval Christendom), as reflected in Colombia’s Concordat. In Colombia, liberal attempts failed repeatedly and resulted in violent conflicts in which the Roman Catholic Church-State closed ranks with conservatives and imposed a corporatist medieval-like state. The largely successful project pursued by the Roman Church-State in Colombia (so-called Christilandia) consists of three pillars: (1) political (a confessional state); (2) economic (a corporatist state); and (3) cultural (a Catholic and conservative “Hispanicism”).In the 1991 Constitution, Protestantism allied itself with liberal forces. This alliance made it possible to finally introduce religious freedom, among others, by removing most of the contentious articles from the Concordat (nevertheless, the Concordat remains valid, as does institutional corporatism). In spite of these reforms, the Colombian government is still required to pay a fee to the Roman See. Religious instruction in public schools according to the Roman Church Magisterium for Catholics also remains firmly in place. Colombia remains one of the most inequitable and dangerous countries in the world.

The article presents a study of the seven most common images of nature phenomena in folklore (the sun, the moon, the stars, the day, the night, the wind, the rain) in Colombian riddles. The riddle is one of the oldest genres of oral folk art, a means of preserving cultural memory, educating ingenuity and creative thinking. The article reflects the stages of the development of Colombian riddles from the appearance of the enigmatic genre in Europe, the popularization of the riddle in Spanish, its export to the New World to the acquisition of national-specific Colombian features that accumulated the features of European, Indigenous and African cultures. The material of the article was about 300 Colombian riddles, most of which were taken from collections of traditional riddles of the departments of Colombia; riddles posted in Colombian Internet sources. The article also presents the results of a linguistic experiment conducted among Russian and Colombian youth to solve Colombian riddles in Spanish. The main research methods are semantic, interpretative, linguoculturological analysis, cultural commentary. The main objective of the article is to analyze the ethnolinguistic features of the figurative representation of nature in the Colombian linguoculture, as well as to find out how modern youth understands the metaphorical description of natural phenomena in riddles. The article finds that the Colombian riddles combine traditional Spanish cryptic texts and the realities of everyday life, cultural and religious associations peculiar to Colombia. Refs 8.

This working paper focuses on four issues: (i) the rules of allocation of fiscal resources to different localities; (ii) the rules concerning how localities can spend fiscal transfers from the center; (iii) the rules concerning the balance of local governments' budgets; and (iv) issues concerning incentives for local politicians. This working paper is organized as follows: Section 2 describes the current situation and problems related to fiscal decentralization in Colombia. Section 3 discusses the policy issues related to fiscal federalism with an 'eye' focused on those more relevant for Colombia. Section 4 illustrates our proposal for reforms.
