Full textThe thesis concerns collective redundancies and focuses on the limits that the law and the collective bargaining put to the employer's powers, with specific regard to employer's discretionary during the redundancy procedure, in order to verify whether the law 92/2012 (known as Fornero Reform), affected the judge's control and the trade union. In the first chapter we can find the reasons investigating if the judgemental control over the substantive fairness of collective dismissals, which was already due following the law n. 223/1991, still remains essential in the Fornero reform. In the second chapter it is clarified why, although the reform seems to enhance the role of the trade union in the procedure, in fact it reduces the possibilities of collective bargaining and, as a consequence it weakens the trade union control. The third and last chapter analyzes the most relevant aspects of the criteria to select employees for redundancy from both sides either either judicial and from the trade union side. In the end it is considered that only though a double vision, judicial and union, it is possible to grant a fair protection to the workers as planned from the legislator of 1991.

Full textThe thesis examines concurring collective labor agreements in the private sector, in particular it analyzes the question of the conflict arising between two collective labor agreements of different levels. The research moves from a reflection about the nature and the role of company collective agreement to identify a conflict resolution criterion. In the first part of the work, intersectoral and sectoral collective agreements are studied in order to identify models for the relationship between collective labor agreements defined by trade unions and employers' associations. The research also focus on the nature (normative or not) of provisions of collective labor agreements with the scope to understand if the conflict arising between two different levels can be solved pursuant to these provisions. The negative answer leads to analyze external conflict resolution criteria identified by jurisprudence and by doctrine. Among these criteria, a particular reflection is carried out on the one expressed by the latin terms “lex specialis derogat lex generalis”. More precisely, the latter is considered as a general principle of Italian law which is applicable not only in case of conflict arising between two laws, but also in case of conflict arising between two collective labor agreements of different levels. Moving on from this thesis, in the third chapter concurring collective labor agreements is reconstructed, pointing out the phenomenon of separate collective bargaining and the collective bargaining developed on legal provisions. In the end, the research deals with L. 14 september 2011, n. 148, art. 8 , investigating its effects on the question of conflict between two collective agreements.

Full textThe search starts with the reconstruction of socio-economic processes. Moving from these reflections, it's possible to see that today's companies take advantage of increasingly self-employed coordinated and continuous and, after d.lgs. 276/2003 “lavoratori a progetto”. These employees are, therefore, subject to a power (contractual) coordination of the customer that, at times, it adds up to a state of economic dependence by the same. It then creates an internal differentiation into autonomy area that does not seem properly valued by the ordinary legislator, but that seems to involve trade unions. Given that in reality there are different representations, we move to circumscribe the scope of applicability of the Arts. 39 and 40 Const. The absence of a genuine interest and genuine self activities suggest that employees "strong" and its associations can only benefit from the protections posed by Arts. 2, 18 and 41 Const. At the end tackling the problems so that the reconstruction turn raises, namely how to ensure the effectiveness of the safeguards recognized unionism collaborators "weak" and reconcile the associations of employees "strong" with the antitrust law.

Full textThis research focuses on the study of common spaces conceived after the European events of 1989: those public places of common interest (shopping malls, cultural centres, multiplexes), now more than ever before important elements in the urban project. The new common spaces in Europe, multithematic projects of the hypertext city integrate pure trade with public life, raising the question of the concept of public space according to European tradition. The progress in structural and installation technique (intelligent building) that has turned the construction into a controlled, enclosed space, has brought into discussion the privatisation and interiorisation of the public space. The comparison between urban and architectural multithematic projects in Europe-public spaces conceived or built in Rome, Paris and Berlin-will contribute to the notion of public spaces. That will give rise to reflections on the influence of the European city on the character of the public space in the future

The thesis outlines the guidelines for a possible regulatory intervention, focusing on the functions of workplace representatives, trade union rights, collective bargaining coverage, no-strike clauses and the relationship between decentralised and sectoral collective bargaining agreements.

Full textIn the present paper are examinated the forms used by the collective agreement to make uncertain the economic treatment of employees. First we deal with the limit of the wage’s "flexibility" that is identified in the "sufficient compensation" (art. 36 of the Constitution), qualified as an essential element of the contract. Second we focus attention on the remuneration of productivity and profitability of private sector workers and the treatment of accessory privatized public employees. Abstractly these forms of remuneration have an incentive function, specifically they are unable to have this function: in the private work because of the egalitarian political followed by union and the way of setting goals; in the public sector because this part of the salary has been traditionally delivered "to rain". In the third chapter we consider the disputes that may arise if, during the period of time ranging from setting goals as you should verify their achievement, the employer introduce organizational changes that can affect the worker’s ability to achieve the results. In order to answer that question, at the close of the second chapter, the clause regarding variable pay has been classified as a condition because it is subjected to the achievement of productivity and profitability targets which are uncertain and future events. This qualification is designed to enable the application of article. 1359 of the Civil Code disputes: if the workers do not achieve their results because of changes that the employer has introduced in the organization, the workers can pretend that the event (which did not occur for conduct attributable to the employer) has occurred and, therefore, received the salary of results.

Full textThe paper, moving from the consideration of the recent reforms that have regarded the labor market, the social security system, and the socioeconomic context of reference, means to stress the attention on the persistent lack of a reform of the system of the unemployment benefits, underling, the critical state of the present uneployment laws situation that requires an urgent reform. Therefor, after to have characterized a sufficiently punctual notion of “unemployment benefit”, also with reference to necessary integration with the policies of the European Union and with the fedral reform of the Italian Constitution, the paper examines the traditional system of protection against unemployment, stressing those that would have to be the aspects to correct during reform of the system. Then it is examinated the plans of reform of the unemployment benefits from the end of Ninetys, with specific reguard to the Libro Bianco, to the A.S n. 848-bis of the Berlusconi’s Government, and to the last bill A.C n. 2484 of 2006. Finally the analisys allows to draw the reform lines which should inform the future system of uneploymenty benefits.
