Abstract:
The aim of the research is to analyse the connections between agreements under Company law and the study of legal consequences of such bonds. The research is organized in three main sections. The first part is dedicated to reconstruct the theories of linked contracts and economic operations. It emerges the tendency of the legislator to legislate hypothesis of linked contracts in Business Law in order to achieve more certainty in business transactions. The second section is concentrated over hypothesis of linked contracts in Company Law provided by the legislature. It is therefore analysed the relationship between Company’s Agreements and Shareholders' Agreements, the relationship between Cooperative’s Agreement and Agreements with its own shareholders, the leveraged buy-out operations, the regulation of funding in relation to a specific transaction and the payment for share capital secured in Limited Liability Partnerships (In Italian Company's Law defined as «società a responsabilità limitata»). The third part concentrates on the analysis of a series of court judgements regarding hypothesis of linked contracts created pursuant to the power of autonomy of the parties: the connection between a Company’s Agreement and the agreement to sell a property to the same company; the connection between a Company’s Agreement and a contract between the company and his own shareholder; the connection between a Company’s Agreement and the stipulation of a shared property agreement with a shareholder. The analysis proceeds by focusing on three situations in which the connection is set up in a way to circumvent the law: in the first it is violated the rule to protect the integrity of the share capital, in the second the proper fulfilment of taxes and in the third one the pre-emption clause. The conclusions point out the characteristics of linked contracts in Company Law.

Abstract:
Nel primo decennio del 2000 nella normativa bancaria italiana si è superato, tanto “a monte”, quanto “a valle”, il principio di separatezza tra banca e impresa, che per lungo tempo ha caratterizzato il nostro ordinamento giuridico. Il legislatore italiano, infatti, ha ritenuto che le nuove disposizioni in materia di soggetti collegati potessero costituire un presidio più efficiente della tradizionale separatezza al fine di evitare che la vicinanza di alcuni soggetti ai centri direzionali della banca ne influenzino la gestione, compromettendola. Peraltro, la materia era già regolamentata in vario modo nel nostro ordinamento, in particolar modo dall’art. 136 t.u.b. riguardante le obbligazioni degli esponenti aziendali e dal Regolamento Consob del 2010 in materia di parti correlate. Tuttavia, si è ritenuto che tali previsioni non potessero costituire una disciplina sufficiente a fronteggiare i molteplici rischi cui è sottoposta l’attività bancaria, in primis quello di conflitti di interesse. Perciò Banca d’Italia, in conformità alla deliberazione del Cicr 29 luglio 2008, n. 277, in data 12 dicembre 2011 ha emanato il 9° aggiornamento della Circolare n. 263 del 27 dicembre 2006, “Nuove disposizioni di vigilanza prudenziale per le banche”, che ha previsto – in particolare – l’introduzione del nuovo capitolo relativo alle “Attività di rischio e conflitti di interesse nei confronti di soggetti collegati”, Titolo V, Capitolo 5. Tale disciplina, che stabilisce determinati limiti prudenziali di natura quantitativa e apposite procedure deliberative per l’assunzione di operazioni con soggetti collegati, alle quali si aggiungono specifiche indicazioni in materia di assetti organizzativi e controlli interni, è volta ad assicurare, ancora una volta, la “sana e prudente gestione bancaria”.

Abstract:
Marte e Mercurio rappresentano due pianeti chiave per l'attuale e futura esplorazione del Sistema Solar. Mentre il pianeta rosso è estremamente interessante dal punto di vista astrobiologico della sua futura esplorazione umana, l'esplorazione di Mercurio è fondamentale per rispondere a molteplici aspetti non ancora chiari sulla formazione ed evoluzione dei pianeti rocciosi e sull'origine di alcune strutture geologiche. Per rispondere a questi quesiti, sin dall'inizio di questo progetto di tesi, cinque missioni spaziali hanno iniziato la loro attività scientifica su Marte, sia orbita che in situ, e una nuova missione è stata lanciata alla volta di Mercurio, la terza dopo le missioni Mariner 10 negli anni 70 e MESSENGER nel 2011 lanciata de parte della NASA. Il lavoro scientifico presentato in questa tesi è stato portato avanti nel contesto di due delle missioni sopra citate. La missione ExoMars/Trace Gas Orbiter (TGO), attualmente in orbita marziana, e la missione BepiColombo, attualmente in fase di crociera verso Mercurio. Entrambe le missioni sono supportate dall' Agenzia Spaziale Europea (ESA). Nello specifico, vengono analizzate strutture geologiche non ancora ben comprese sulle superfici di Marte e Mercurio, che potrebbero essere collegate al potenziale rilascio di composti volatili dalla superficie, con lo scopo di comprenderne meglio l'origine e il meccanismo di formazione. Questo lavoro di tesi concerne due corpi planetari caratterizzati da specifici dataset e tecniche di analisi; di conseguenza, è presentato in due parti: la prima riguardante Marte, e la seconda riguardante Mercurio. Su Marte viene studiato il problema dell'origine e della formazione delle Recurring Slope Lineae (RSL). Sin dal 2010, le RSL rappresentano uno dei topic scientifici più dibattuti per quanto concerne i processi superficiali in atto su Marte al tempo attuale. Diversi studi concludono che le RSL potrebbero essere dovute al rilascio di acqua liquida dalla superficie di Marte, mentre altri lavori sostengono che esse siano meglio spiegate da flussi di materiale granulare secco. Il meccanismo di formazione è stato caratterizzato con più precisione solamente di recente. Ciò è stato possibile anche grazie alle prime osservazioni delle RSL effettuate dallo strumento CaSSIS a bordo della missione ESA ExoMars/TGO, in coordinazione con osservazioni effettuate dalla camera HiRISE a bordo della missione MRO della NASA. Queste osservazioni e la loro analisi rappresentano gran parte del lavoro presentato in questa tesi circa il pianeta Marte. Oltre a ciò, attraverso una nuova tecnica per l'analisi delle immagini a colori della superficie di Marte, è stato possibile ottenere dei vincoli circa la nature e la formazione delle RSL. La seconda parte di questa tesi riguarda il pianeta Mercurio, dove vengono studiati gli hollows, enigmatiche strutture geologiche superficiali identificate dalla missione MESSENGER. La natura e il meccanismo di formazione degli hollows sono ancora poco compresi, e saranno uno dei topic scientifici più importanti che la missione ESA/BepiColombo affronterà tramite lo strumento SIMBIO-SYS. Combinando una camera ad alta risoluzione, uno spettrometro e una stereocamera, questo strumento permetterà di osservare la superficie di Mercurio e studiarne la composizione e topografia ad alta risoluzione, fornendo dati di qualità scientifica senza precedenti. In prospettiva delle future analisi effettuate tramite SIMBIO-SYS, è stata effettuata una caratterizzazione spettrofotometrica di due regioni ricche di hollows, basata su dati MESSENGER, con l'obiettivo di comprenderne meglio la natura e il meccanismo di formazione.
Planets Mars and Mercury represent two keystones for the current and future exploration of the Solar System. While the Red planet is an extremely interesting body for both its astrobiological and future human exploration potential, the exploration of Mercury is a promising path for answering many unresolved science questions about the formation and evolution of rocky planets and the occurrence of puzzling geological surface features. To investigate these topics, at the time of writing of this thesis, five new space missions begun their scientific activity at Mars, both from orbit and in-situ, and a new mission has been launched to Mercury, the third-one since the NASA’s Mariner10 probe in the 70s and the NASA’s MESSENGER mission in 2011. The scientific work presented in this thesis has been carried out in the framework of two of the above missions, the ExoMars/Trace Gas Orbiter (TGO) spacecraft currently orbiting Mars and the BepiColombo probe, currently en-route to Mercury, both supported by the European Space Agency (ESA). In particular, we investigate currently not well understood landforms on Mars and Mercury, possibly related to the release of volatiles materials from the surface, with the aim of getting insights on their nature and characterise the formation mechanism. This body of work encompasses two planetary bodies each having his own, dataset and analytical techniques, and it is therefore presented in two parts: the first one concerning Mars, and the second one about Mercury. On Mars, we specifically investigate the nature and formation mechanisms of martian Recurring Slope Lineae (RSL). Since 2010, RSL represented one of the major science questions concerning present-day Mars surface processes. Many studies brought up evidence that they could be related to the release of liquid water at the surface of Mars, while other reported that RSL could be best interpreted as dry processes. Their formation mechanism has been more tightly constrained only very recently. This was possible also thanks to the first observations of RSL performed by the CaSSIS instrument on board the ESA’s ExoMars/TGO, together with coordinated images from the HiRISE camera on board the NASA/MRO mission. Such observations and their analysis represent the core of the research work here presented on Mars. In addition, we could constrain the RSL nature and formation mechanism thanks to a novel methodology for the analysis of colour images of the surface of Mars, also presented in this thesis. The second part of focuses on Mercury, where we investigate the nature and formation mechanism of hollows, puzzling surface features identified by the NASA’s MESSENGER mission. The nature and formation mechanism of these features is still an open question, and it will be one of the major science topics that the ESA/BepiColombo mission will investigate through the SIMBIO-SYS suite of instruments. By combining a high-resolution camera, spectrometer and stereo-camera, this instrument will allow to investigate the geomorphological, spectrophotometrical and 3D properties of hollows at high resolution, providing unprecedented datasets to analyse and interpret. In preparation for these unique datasets, we present a spectrophotometric characterisation of selected hollows sites based on data from the MESSENGER mission and we discuss its implication on their nature and formation mechanisms.

Nell’ultimo decennio, la politica dell’Unione Europea per una economia circolare, ha incoraggiato un rapido incremento degli impianti di digestione anaerobica della Frazione Organica dei Rifiuti Solidi Urbani (FORSU) per la produzione di ammendanti destinati all’agricoltura. Nonostante l’importanza della materia organica (sia di origine vegetale che animale) per il ciclo globale del carbonio, rimangono ancora aperte diverse questioni riguardo alla sua formazione, conservazione e l’eventuale contaminazione da sostanze indesiderate. Lo studio di alcune classi di composti organici che compongono la materia organica, tra i quali gli n-alcani, permette di ottenere maggiori informazioni sulla natura degli idrocarburi presenti, evitando sovrastime della concentrazione di idrocarburi di origine petrogenica con i metodi analitici generalmente utilizzati. Il presente lavoro ha permesso di verificare l’applicabilità di alcuni indici diagnostici, quali il Carbon Preference Index (CPI) e il Low Molecular Weight/High Molecular Weight (LMW/HMW), nel discriminare e dimostrare l’origine biogenica degli idrocarburi presenti in campioni provenienti dal processo di digestione anaerobica della FORSU.

La materia delle polizze assicurative collegate ai contratti di mutuo affonda le proprie radici nel più ampio fenomeno della “bancassicurazione”. Il contratto assicurativo collegato al contratto di finanziamento è utilizzato in funzione di protezione contro i rischi della concessione del credito: il creditore si assicura contro il dannoal patrimonio che potrebbe subire e l'assicuratore si obbliga ad indennizzare il creditore della perdita totale o parziale del credito.Le polizze assicurative collegate ai contratti di mutuo sono state analizzate secondo il seguentemetodo di ricerca.Nel primo capitolo della tesi è stata esaminata la fattispecie delle polizze assicurative abbinate ai contratti di finanziamento. In particolare la fattispecie è stata analizzata dalla prospettiva del collegamento negoziale che si instaura tra il contratto assicurativo e il contratto di mutuo. Sono state esaminate in un primo momento le categorie generali del collegamento negoziale e successivamente la categoria del collegamento negoziale è stata contestualizzata in base al tema di ricerca. Nel secondo capitolo è stata esaminata la regolamentazione introdotta dal legislatore e dall'Ivass volta ad introdurre limiti esterni alla volontà contrattuale prevedendo l’inibizione ai privati delle pattuizioni e dei comportamenti potenzialmente forieri di maggiori effetti di distorsione del mercato. Nel terzo capitolo è stata esaminata la regolamentazione volta ad introdurre alcuni obblighi di condotta positivi giustificati da finalità di interesse generale di salvaguardia delle dinamiche di mercato, che finiscono con l’incidere, in diversa misura, sull’agire dei soggetti privati. Infine nel quarto capitolo è stato esaminato il fenomento delle polizze assicurative abbinate ai finanziamenti nell'ordinamento inglese e come il Legislatore e il regolatore inglese hanno tentato di risolvere le criticità presenti su tale mercato.

The basis of this project was to dig deeper into the major controversy surrounding college athletes and whether or not they should receive some sort of stipend while playing their respective sports. To gain further insight into this debate, interviews and surveys were used to collect data from varying target markets such as Athletic Directors, former collegiate athletes, current collegiate athletes, and other non-athletic students. This will provide various perspectives of the issue at hand. This study provided me with an in-depth look from each standpoint and addressed the benefits and problems of each side. After examining the results, I came to the conclusion that collegiate athletes, do indeed, deserve to receive some sort of compensation while they are involved in collegiate athletics.

Abstract:
This examination describes the perceptions of faculty, student affairs professionals and students in regard to what students should learn as a result of college and what means are important for collegiate student learning. Some similarities and significant differences are found between groups as well as within groups in relation to what students should learn and how they learn. All three groups were found to place importance on the acquisition of critical thinking and communication skills as an outcome of college attendance. Faculty were found to place more-importance on in class skills and competencies when compared to student affairs professionals or students. All three groups identify traditional in class means of learning as significantly more important than out of class learning within the college environment.

Abstract:
Athletes appear healthy according to weight for height and body fat standards. Though athletes appear to be healthy, little is known about their diets. Research states there is a connection between athletic performance and nutrition. The objective of this study was to determine the diet quality of 138 collegiate athletes. Data were collected in a laboratory. Demographics were collected via survey. Anthropometrics were assessed using a free standing stadiometer and the BodPod® for body fat assessment. Block 2005 Food Frequency Questionnaire© was used to assess diets. The Healthy Eating Index (HEI) 2005 was used to calculate diet quality scores. The average BMI was 23.2 (2.3) kg/m2 and the average body fat was17.8 % (6.5). The average HEI score was 51.2 (8.8). Higher HEI scores were correlated with higher body fat percentage in this sample. Diets were adequate in: calcium, iron, and vitamin C. Diets were inadequate in: fiber, fruits and vegetables intakes. The athletes had excessive intakes of sodium and total percent fats. These findings demonstrate the need for nutrition education for collegiate athletes.

Abstract:
American football is one of the most popular sports in the United States. However, in comparison to other mainstream sports such as soccer and rugby, there is limited literature using scientific principles and theory to examine the most appropriate ways to monitor the sport. This serves as a barrier to American football practitioners in their development and implementation of evidence-based sport preparation programs. Therefore, the primary aim of this line of research (i.e., dissertation) is to illustrate the efficacy of commonly used athlete monitoring tools within the sport of American collegiate football, while proposing a systematic framework to guide the development of an athlete monitoring program. This aim was achieved through a series of studies with the following objectives: 1) to quantify the physical demands of American collegiate football practice by creating physiological movement profiles through the use of integrated microtechnology metrics and heart rate indices, 2) to determine the positional differences in the physical practice demands of American collegiate football athletes, 3) to examine which integrated microtechnology metrics might be used to most efficiently monitor the training load of American collegiate football athletes, 4) to demonstrate the suitability of using the countermovement jump (CMJ) to assess training adaptations in American collegiate football athletes through examining weekly changes in CMJ performance over the course of two 4-week periodized training blocks (8 weeks total), and 5) to examine the effect of acute fatigue on CMJ performance in American football athletes. The first study from this line of research quantified the physical demands of American collegiate football by position groups and found significant differences in both running based and non-running based training load metrics. In addition, the first study utilized a principal component analysis to determine 5 'principal' components that explain approximately 81% of the variance within the data. The second study utilized a univariate analysis and found significant changes in CMJ performance due the effect of time with significant improvements in CMJ 'strategy' variables over the training period. Finally, the third study used effects sizes to illustrate a larger magnitude of change in CMJ 'strategy' variables than CMJ 'output' variables due to effect of acute fatigue. Results from studies 2 and 3 suggest the importance of monitoring CMJ strategy variables when monitoring training adaptations and fatigue in American collegiate football athletes. This line of research provides practitioners with a systematic framework through which they can develop and implement evidence-based sport preparation programs within their own organizational context. In addition, this line of research provides practitioners with recommendations for which metrics to monitor when tracking training load in American collegiate football using integrated microtechnology. Finally, this line of research demonstrates how to assess training adaptations and fatigue using the CMJ within the sport of American collegiate football, while providing an empirical base through which the selection of CMJ variables can take place. Collectively, this line of research uses scientific principles and theory to extend the current literature in American collegiate football, while providing practitioners with a guide to athlete monitoring within the sport.
Doctor of Philosophy
American football is one the most popular sports in the United States. Despite its popularity, there is limited research using scientific principles and theories to examine ways to most effectively monitor the sport. Broadly, athlete monitoring refers to the process of providing informational feedback from the athlete to practitioners. This allows practitioners to make decisions informed by data. Therefore, this line of research (i.e. dissertation) aimed to use a variety of commonly used athlete monitoring tools to monitor American collegiate football athletes, while proposing a framework to guide in the development of an athlete monitoring program. This line of research consisted of a series of 3 studies. In study #1, it was found that integrated microtechnology units and heart rate sensors could be used to determine the physical demands of American collegiate football practice, as well as differences in the physical demands of practice by position group. In addition, a set of 5 training load constructs were found through which training load in American collegiate football athletes may be appropriately monitored. In study #2, it was found that countermovement jump (CMJ) strategy variables indicating how the jump occurred may provide more insight into strength and power training adaptations than CMJ output variables that indicate what occurred as a result of the jump in this highly trained athletic population. Finally, in study #3, it was found that CMJ strategy variables may be more sensitive to acute fatigue from a football-specific training session than CMJ output variables in American collegiate football athletes. Collectively, this research suggest that integrated microtechnology units, heart rate sensors, and the CMJ using a force testing platform may be used to monitor American collegiate football athletes. Moreover, this research suggests which variables to utilize when monitoring this population using these tools through the proposed athlete monitoring framework.

Sports-related mild traumatic brain injuries (mTBIs) have become an increasingly popular topic. Cognitive and physical rest are the mainstays of management, but effective evidence-based therapies do not exist. Very few studies report mean recovery times from mTBI and even less for intercollegiate athletes. The primary aim is to retrospectively compare the recovery time in athletes from a large Division I University that suffered a sports-related mTBI during 2010 - 2012 to published data for quality assessment and improvement. Since the institution's concussion management follows current guidelines, no significant difference was expected. Secondary aims included comparing recovery times between gender, sport, and league. As reported in current literature, no significant gender differences were expected. 53 athletes with sports-related mTBI (27 male and 26 female) showed a mean recovery time of 10.11 days (95 % confidence interval [CI] = 8.58 - 11.65 days), statistically different than the time reported in 1 study of 7 days, but not in another of 7 - 10 days. Mean recovery time in males and females was 9.74 days (95 % CI = 7.38 - 12.1 days) and 10.5 days (95 % CI = 8.4 - 12.6 days), respectively. Mean recovery time in National Collegiate Athletic Association (NCAA) and non-NCAA (club) athletes was 9.91 days (95 % CI = 8.27 - 11.55) and 11.25 days (95 % CI = 5.87 - 16.63), respectively. A nonparametric Wilcoxon rank-sum test showed no significant variation between genders and between NCAA and non-NCAA athletes. Subgroup statistics of 13 sports were inconclusive due to inadequate power. However, the subgroup of male football athletes showed a mean recovery time of 6.5 days (95 % CI = 4.86 - 8.14 days), which was not significantly different than published rates. Multiple confounding variables were not well controlled for including: sport, gender, concussion severity, multiple concussions, etc. However, this study did highlight areas for quality improvement in the institution's concussion management plan. Further investigation with increased power and confounding variable control is indicated for a more definitive mean time to recovery. This study is the first to detail the mean time to recovery from sports-related mTBI in an intercollegiate athletic program. Similar studies should be done at other institutions for quality assessment and improvement of 4 concussion management. Such data will be useful in establishing a baseline for measure of efficacy in future investigations of therapeutic interventions.

The problem of this study was an analysis of major spelling deficiencies among collegiate business students. The purposes were as follows: (1) to develop a diagnostic instrument that will measure spelling deficiencies; and (2) to make recommendations regarding the preparation of materials that will assist students in overcoming these deficiencies. Written assignments prepared by collegiate Business Communication students were examined for spelling errors. Errors were then classified into the following categories: (1) words with "ie" and "ei" ; (2) final "e"; (3) final consonant rule; (4) final "y"; (5) confusion over vowel sounds; (6) pronunciation problems; (7) sound-alikes; (8) plurals; (9) apostrophes; (10) omissions; (11) additions and repetitions; (12) substitutions; (13) demons; and (14) miscellaneous. Percentages of total errors served as a guideline for preparation of a Table of Specifications, and a Spelling Diagnostic Test was developed. Validity of the instrument was determined by a panel of experts. The test was then administered to 214 collegiate business students, and a reliability coefficient of .83 was determined using the split-half method.

Involvement in resistance or high-impact sports is a known contributor to bone health in young athletes. However, no study to date has examined the sport of cheerleading and its potential impact on bone mineral density (BMD) and lean body mass. The purpose of this study was to assess BMD of the lumbar spine and the proximal femur in male cheerleaders. A secondary purpose was to examine measures of body composition. Twelve male collegiate-level cheerleaders and 12 age, height and weight matched recreationally active males (CON) volunteered for the study. The cheerleaders' appendicular lean mass and total lean mass were significantly greater (33.56 plus/minus 3.37 and 72.22 plus/minus 6.56 kg) compared to CON (29.57 plus/minus 2.73 and 66.19 plus/minus 5.09), P<0.05. The cheerleaders also had a lower percentage of body fat and total fat mass (13.1 plus/minus 4.48% and 11.66 plus/minus 5.10kg) compared to CON (18.92 plus/minus 4.53% and 16.30 plus/minus 4.66kg), P<0.05. Although there were no statistically significant differences in any of the BMD variables between groups, the average Z-scores at clinically significant sites ranged from 0.3 to 1.3 standard deviations above the age and ethnicity-related population norm, as defined by the World Health Organization. These data suggest that cheerleading has a positive influence on bone health and measures of body composition.

The purpose of this study was to determine whether career patterns of collegiate administrators could be explained in terms of existing organizational models of academic institutions.;The study involved a secondary analysis of data collected in the summer of 1981 in a statewide survey of collegiate administrators. The target population consisted of all the middle level administrators (N = 617) at the director level or above from thirty-three state-supported and independent colleges and universities from the Commonwealth of Virginia. A strict adherence to the Dillman "total design method" resulted in a response rate of 76.5 percent.;Previous studies which had employed the narrow concept of career ladder had generally found career patterns in collegiate administration to be less defined than in industry or the military. to address the inadequacy of the career ladder concept, a broader concept, "career field" was introduced in this study. Three organizational models were chosen and the subdivisions of each were defined as career fields. Administrator titles were assigned to each career field of each of the three models by a panel of experts employing a Q-Sort technique.;The results of this research show that, when all career positions are included, positions held by respondents prior to entering collegiate administration tend to mask existent career patterns.;For academic administrators, most of their pre-administrator positions had been in teaching faculty or higher education related roles. The study confirmed that the academic administrator career field continues to be quite different due to its inextricable link to professorial career patterns. The study also found that among non-academic administrators, patterns of pre-administrator positions varied by the career fields of each model.;Among academic and non-academic administrators alike, there was little evidence of people leaving administration and then returning.;A significant but unexpected finding of the study was that many administrators carry on other career pursuits concomitantly. Previous career research may have been distorted by concomitant positions as well as pre-administrator positions. This finding points to the need for better definitions and stricter composition of career research instruments.

Few activities have the power to bring people together as sports; victory is contagious, defeat unifies, and the concept of a team can create common goals and unbreakable bonds among teammates, communities, and even an entire nation. In a sense, sport has the power to change lives. The lessons that athletics can teach—preparation, competitiveness, overcoming obstacles, persistence, mental and physical health, problem solving, and setting life goals—seem particularly apt for American Indian youth today. Athletics can serve as a pathway to college for American Indian students who participate in individual or team sports. Access to higher education, in turn, offers the opportunity for larger income and greater economic opportunities. The American Indian students’ college experience, including statistics on enrollment, retention and drop-out rates, is prevalent in both quantitative and qualitative research. Moreover, research concerning the roles athletes and athletics have within higher education institutions is historically rich. The intersection of these two topics however, has received little to no attention. This dissertation will explore the impact of sports on American Indian collegiate athletes to determine the factors that both inspired and inhibited them from the pursuit of athletics in college. It will provide the first in-depth look at several American Indian collegiate athletes who can document how sports helped or failed to help them reach their educational aspirations.

There is little research specifically examining fast-pitch softball pitchers. However of the few studies completed, pitchers have been reported to exhibit a high incidence of injury. How and why these pitchers are suffering from injuries has not been elucidated.The purpose of this study was to investigate the injuries occurring to collegiate softball pitchers and factors that may influence these injuries such as demographic, pitching, training, and injury information.A cross-sectional survey of collegiate softball pitchers from Divisions I, II, and III was conducted using InQsit, a web-based survey system. Instructions on how to complete a web-based survey was sent and completed over a two-week period, by 181 Division I, II, and III collegiate softball pitchers. The survey was composed of questions addressing: 1) demographic information, 2) pitching and game data, 3) training program information, and 4) injury reporting.The results showed that demographic information, pitching and game data, and training were not statistically significant (p<0.05) in relation to injury. Among the 131 reported injuries, 36 were acute, 92 chronic, and 3 unspecified. Of the 92 chronic/overuse injuries, 10 were Grade I, 30 Grade II, 39 Grade III, and 13 Grade IV. Of the total injuries, 80 were a direct result from pitching, with 36 relating to the shoulder and 17 to the lower back. Among the injured pitchers, 109 took Non-Steroidal AntiInflammatory Drugs, 140 used modalities, 11 received surgeries, and 95 saw additional specialists. This study revealed that a high percentage (72.8%) of collegiate pitchers are suffering injuries across the nation and more research focused on this area is needed. In addition, coaches need to continue to be informed of ways they can improve the health and training programs of their pitchers.

There is great controversy regarding the methods in attenuating the epidemic of being overweight and obese among our population. For years, low-fat diets have been prescribed as the best approach to solving this problem, however, low-carbohydrate diets have become increasingly popular despite the widespread opinion that they result in large reductions in muscle tissue and function. The purpose of this study was to compare the effects of a Step-I and carbohydrate-restricted (ketogenic) diet on changes in body mass (BM), fat mass (FM), lean body mass (LBM), and resting metabolic rate (RMR). Eight overweight men (>25% body fat) consumed Step-I (<30% fat) and ketogenic (<10% carbohydrate) diets for 6 weeks in a randomized cross-over design. Body composition (dual energy X-ray absorptiometry) and RMR were examined before and after each diet. Energy intake was significantly reduced during the Step-I (1506 kcal/day) and ketogenic (1766 kcaL'day) diets compared to habitual dietary intake (2443 kcal/day). The following changes in body composition were observed during the Step-I and ketogenic diets, respectively: BM -4.1 and -5.9 kg, FM -3.5 and -4.4kg, LBM +0.1 and -1.7kg. The changes in RMR for the Step-I and ketogenic diets respectively were -155 and -26 kcal/day, relative RMR -0.68 and +0.81 kcal/kg BM. Although changes in BM, LBM, and FM tended to be greater during the ketogenic diet and changes in both absolute and relative RMR tended to be greater during the Step-I diet, no significant differences were noted between diets. These data indicate that hypoenergetic diets greatly differing in macronutrient distribution result in similar changes in body composition and that very low-carbohydrate diets do not result in significant losses in LBM and metabolic rate.

The NCAA, in order to preserve fair and equal competition in intercollegiate athletics, created a drug testing program. In 1987 and again in 1988, student-athletes at two separate universities challenged the NCAA’s drug testing program in a court of law. As a result, constitutional questions pertaining to a student-athlete’s individual rights have surfaced. The purpose of the research was to create a collegiate level drug testing policy to be utilized during the regular season by NCAA Division I member institutions. A drug testing program, based upon individual reasonable suspicion, was created through the analysis of the NCAA’s 1987-988 drug testing rules and drug testing program, legal issues surrounding drug testing, litigation involving the NCAA, and NCAA Division I member institution’s drug testing programs.

This qualitative research study was designed to gain a deeper, more profound understanding of the lived experiences of collegiate male dancers. Through three phases of research, this study uncovered societal and familial obstacles collegiate male dancers often endure during their dance journeys, and describes how males navigate and transcend them. Extensive interviewing offers detailed glimpses into the lives of 9 male students who participate in collegiate dance programs. The study reveals participants’ dance experiences prior to and during college; recognizes and questions common factors that influence collegiate male participation in dance; and identifies how male dancers feel supported and/or unsupported by their program. An experiential workshop series applied and explored existing pedagogical suggestions offered by other scholars. Subsequently, a rehearsal and performance experience physically investigated emergent themes. Recommendations are offered on how to better encourage, cultivate, and support collegiate male dance populations through enhanced pedagogies and program improvements.

Abstract:
The purpose of this dissertation was to examine the collegiate way of living; how it began, how it developed and changed, and why institutions have adhered to it. Communal dining was emphasized in an attempt to determine why colleges have believed it to be important enough to require it of differing student populations, under widely varying circumstances, over a period of at least four hundred years.;The College of William and Mary in Virginia was selected as a case study for this project. One of America's earliest colleges, William and Mary was founded on the British (Oxbridge) model, and has required its students to live collegially throughout its history.;official rationale for an emphasis on collegial living is contrasted with the available evidence (or non-official rationale). An attempt was made to learn how or if the rationale changed with the evolution of society in general and higher education in particular.;It was concluded that while official rationale has evolved somewhat, it consistently has emphasized the development of the whole person. That official rationale is accompanied, however, by unofficial supporting evidence suggesting that collegial living was financially attractive and that viable alternatives often were limited.;Additional institutional case studies would be useful, as would studies which concentrate on different components of collegial living. Examination of commuter versus residential college experience also would be of value in considering this topic.

Abstract:
The purpose of this dissertation was to explore the physical and technical demands of the women’s college soccer game through a case study approach. With advancements in technology, motion analysis has become commonplace in most professional environments. However, the literature on amateur soccer is quite scarce and warrants more attention. The aims of this dissertation were: 1) to describe the physical demands of each position for a women’s college soccer player as they relate to total distance covered, efforts, and distance covered in high-speed velocity bands, 2) explore the variation in physical performance during a competitive season, and 3) compare the physical and technical performance of college soccer players to see if there are correlates in performance between variables. Eleven female collegiate soccer players from a single National Collegiate Athletic Association (NCAA) institution were tracked with Global Position System devices during a competitive season. Physical variables and technical variables were analyzed to gain further insight into the specific events that occur during a women’s college soccer match. Significant differences exist between positions for total distance covered during a match, with the forward and central defensive midfielder position covering the greatest distance during a match on average. The central defender position covered a significantly less amount of distance during a match than the other five positional subcategories. Outside players (forward, outside midfielder, and fullback) covered the greatest distance at high-speed velocity bands and perform the highest volume of high-speed efforts. The only significantly different technical variable found was the pass completion percentage of the central defensive midfielder compared with other positions. The current investigation highlights the unique characteristics of female collegiate soccer players when separated and analyzed by the positional subcategories. With uniqueness present in a once thought to be homogenous population the demand for individualized training protocols becomes paramount to increase chance of optimal performance while simultaneously decreasing risk of injury.

Abstract:
This descriptive/correlational study analyzed the perception of recent graduates regarding the effectiveness of the college environment at Milligan College in influencing adult fitness habits. Graduates were divided into five activity level groups through a self-report of physical activity. The purposes of the research were to determine if significant differences existed between the dependent variable, activity level, and the independent variables such as: (a) participation in specific college activities, (b) preferences for types of exercise, (c) social influence, (d) influence of a required freshman fitness course, and (e) environmental barriers. A profile of the student most likely to exercise after graduation was compiled from the data collected. A formula for activity level prediction was calculated from the data analysis. Data were collected from 211 graduates of Milligan College. Data analyses were conducted by calculating measures of central tendency, ANOVA, and multiple linear regression. Major findings revealed statistically significant differences between activity level based on male gender, exercise self-efficacy, intensity level, participation in team sports, participation in fitness activities and health beliefs. The four factors that were revealed to be predictors of activity level by multiple linear regression were habit, self-efficacy, high intensity level, and participation in fitness activities while at Milligan. Recommendations to Milligan College from the study include investing in improved facilities and equipment, implementing more intramural programs at varying ability levels, offering more formal or informal exercise groups on campus, offering more training sessions in use of exercise equipment, and reevaluating the present Fitness for Life course.

Abstract:
Competitive swimmers frequently injure their shoulders. The risk factors for shoulder injuries in competitive swimmers have not been clearly identified. The primary purposes of this study were to describe the characteristics of female collegiate swimmers at the onset of a swim season, identify the risk factors of shoulder injury in female collegiate swimmers, characterize the swim volume of female collegiate swimmers, and determine if swim volume is a predictor of shoulder injury. A prospective longitudinal cohort multi-center design was utilized. Female collegiate swimmers [n=53, mean age=19.3+/– 1.2] from four NCAA Division II universities were recruited to participate in this study. Preseason screening data that included demographics and sport history, swimming characteristics, and a musculoskeletal assessment was collected on 106 shoulders. Participants completed a weekly survey to track exposure data over the course of the season. Shoulder injury data was also collected. A shoulder injury was defined as swimming-related shoulder pain that resulted in one or more limited or modified athletic practices or competitions. Female swimmers reported a history of shoulder pain in 18/106 (17.0%) shoulders, and 14/106 (13.2%) of swimmers presented with obvious scapular dyskinesis at preseason. No differences in shoulder characteristics were found between swimmers with a history of shoulder pain and those without and those with obvious dyskinesis compared to those with normal scapular motion. There was a positive correlation between anterior glenohumeral laxity and shoulder external rotation range of motion (r=0.37, p Previous injury was the sole predictor of new shoulder injury in the group studied. Further research into the predictors of shoulder injury in female collegiate swimmers is warranted.
