Abstract:
This chapter argues that the conventional approach to the management and resolution of external financial crises in emerging economies is inefficient and inequitable and needs to be reformed. Such reforms need to account for increased complexities arising from deepened integration, notably the difficulties in differentiating between external and domestic debt in terms of their holders, currency denomination, and governing laws. Effective debt resolution mechanisms would be needed to bail-in creditors whether the crisis is one of liquidity or solvency, or due to private or sovereign debt, or locally or internationally issued external debt, particularly since crises caused by excessive private borrowing lead to large increases in public debt. Debt workouts should include temporary standstills, protection against creditor litigation, lending into arrears and debt restructuring and combine statutory and voluntary elements, including collective action clauses, duly reformed to avoid the kind of predicaments encountered during the Argentinian restructuring.

Gil, Nuno. A Collective-Action Perspective on the Planning of Megaprojects. Edited by Bent Flyvbjerg. Oxford University Press, 2017. http://dx.doi.org/10.1093/oxfordhb/9780198732242.013.28.

Full text
Abstract:
This chapter adopts a collective action perspective to study the planning of large infrastructure developments: so-called “megaprojects.” The research is grounded on the analysis of make-or-break issues that beset four megaprojects in the UK. First it is argued that megaprojects are organizational networks that at the core create large arenas of consensus-oriented collective action. The analysis shows how the conflation of resource scarcity, conflicting interests, and concerns with legitimacy complicates local searches for mutually consensual solutions and brings to the fore bargaining and political activity. The central contribution is a model that proposes a combination of four high-order coordination mechanisms for management to carry the actors along openly: relaxing performance targets, building organizational slack, espousing flexible designs, and creating a structure of umpires to settle disputes that could not be self-resolved. Implications for the megaproject performance debate are discussed.

Hilty, Reto M. Intellectual Property and Private Ordering. Edited by Rochelle Dreyfuss and Justine Pila. Oxford University Press, 2017. http://dx.doi.org/10.1093/oxfordhb/9780198758457.013.38.

Full text
Abstract:
This chapter considers the law’s response to the challenge posed by the use of contract and technological protection measures (TPMs) as private ordering mechanisms in intellectual property. It considers the three (factual, legal, and contractual) levels of exclusivity on which private ordering may apply, and the different tools for intervening in private ordering that currently exist. It also highlights the inability of these tools to impose effective limits on private ordering by use of TPMs particularly, and considers the desirability and feasibility of new regulatory approaches based on the laws of consumer protection, IP, and unfair competition. The inflexibility and other shortcomings of such traditional regulatory mechanisms leads to a discussion of the possibility of alternative, self-regulatory mechanisms emerging, including the conditions required to that end, drawing on the experience of standard essential patents and collective rights management in copyright.

Abstract:
Weeds have great plasticity to adapt to any environmental condition, resource level or management practices when repeatedly exposed to these conditions for long periods. The plasticity of weeds is due to their diverse evolutionary genetic variability, responsible for the mechanisms of survival and adaptation of these plants. In order to understand the plasticity of weeds, it is necessary to study in more depth the various mechanisms of adaptation of weeds, such as reproduction, dispersion and dormancy. However, this will help you understand weed dominance as well as help you choose the best control strategies. However, there are still few studies focused on weed adaptation mechanisms. This book consists of a collection of chapters on the mechanisms of weed survival within the field of study of biology and ecophysiology. The book includes academic contributions from several graduate students relevant to Weed Science. Each contribution comes as a separate and complete chapter, but directly related to the topics and objectives of the book.

Barandiaran, Xabier, and Javier Lezaun. The Mondragón Experience. Edited by Jonathan Michie, Joseph R. Blasi, and Carlo Borzaga. Oxford University Press, 2017. http://dx.doi.org/10.1093/oxfordhb/9780199684977.013.19.

Abstract:
The town of Mondragón in the Basque Country is home to one of the largest and most significant experiences of co-operative organization and workers’ self-management anywhere in the world. The Mondragón co-operative movement, born in the 1950s around the local technical training college and a handful of small industrial firms, encompasses today more than one hundred co-operative firms operating in ninety-seven countries and generating an aggregate revenue of €12bn. In this chapter we review the historical origins of the Mondragón experience and the goals that guided the first co-operative projects. After describing the key organizational principles and governance mechanisms of individual co-operatives and of the Mondragón group as a whole, we will examine the rapid expansion and internationalization of some of the most emblematic Mondragón firms—a process that has led to a difficult balance between the maintenance of the original co-operative principles at home and an increasing reliance on capitalist forms of ownership and production abroad. We conclude by discussing the impact of the recent economic downturn on the Mondragón group and its system of inter-co-operative solidarity, and by reflecting on the future prospects for this far-reaching experiment in collective ownership and democratic governance.
