Abstract:
This thesis demonstrates that the cohabitation rule in UK law rests on questionable assumptions about financial support and on an unreliable adjudication procedure. It is out-of-step with private law constructions of the obligations of cohabitants and with modern relationship aspirations. It continues to discriminate against women with children, forcing many of them into financial dependence on a male breadwinner who may or may not be willing or able to provide the financial support they need. It is hoped that the thesis will reignite a debate which seemed to fizzle out in the 1970s, by re-examining the underlying assumptions which support arguments for retaining the rule. The thesis includes an empirical exploration of the contexts in which couples cohabit and sometimes lie about their relationships. This empirical evidence challenges assumptions about cohabitation and its concomitant obligations which underlie arguments used to defend the rule. The insights it generates undermine the basis of cohabitation rule fraud; suggest a different understanding of the value of lone parent status from that favoured by governments and raise serious questions about conflicting and inappropriate constructions of child support obligations. The thesis seeks to investigate three research questions: How can cohabitants’ attitudes and behaviour in relation to money, be understood? How should ‘cohabitation’ be understood? Does the retention of the cohabitation rule in UK social security law have any social costs? Answers to these questions are based on interviews with 20 participants in the UK, who were or had been affected by the cohabitation rule, and 8 participants in Denmark, who were or had been affected by the reelt enlig or really single rule. The small comparative element of the study provides a different lens through which to view the cohabitation rule. The comparison enables me to argue for a different approach to social security for families which respects the rights of individual family members and reflects the value of parenting rather than breadwinner status. The thesis discusses the wider implications of the study for family policy and concludes that there are significant problems with any form of non-contractual regulation of personal obligations.

Abstract:
This thesis examines the insights which may be gained from analysis of the potential for establishing a normative regime in English law for cohabitants, who now form a substantial constituency as an established alternative family unit, headed by apparently committed cohabiting couples, who are neither married nor in registered civil partnerships. The thesis critically analyses the 2006-7 work of the Law Commission in London, the apparent government reluctance to take this further despite Scottish implementation of a similar relationship generated compensation scheme on breakdown of such relationships, and the experience of other jurisdictions which have provided dedicated legislation for such families. The thesis also includes the results of some empirical fieldwork in qualitative studies with practitioners in a small number of key jurisdictions, including some comparative analysis of these experiences, and presents a theory which addresses the practical adverse impact of the lack of such a normative scheme in England and Wales. The thesis makes an original contribution to the debate on this area of English Family Law by providing a theoretical basis for legislation likely to be acceptable within the current modernisation of Family Justice in the recently established Family Court. It aims to meet both the drivers of that modernisation and most of the historic arguments against formally recognising (and discretely addressing the needs of) the substantial and continually growing cohabitant community. It makes further original contribution in analysing experience in the key jurisdictions which have introduced cohabitant legislation, both within our own geographical neighbourhood of the UK and EU and within the common law states of the Commonwealth, which were originally British settlements importing English law with them. Another original contribution is provided by an analysis of how such legislation could fit within the English legal system to provide a pragmatic solution to the escalating numbers of such families who now form a significant group expecting to find clarity in legal provision for their circumstances.

South Africa has come a long way from the rigid family structures which existed in the past. This is demonstrated by the recognition afforded to couples in same-sex relationships as well as those in customary marriages. Proposals have also been set forth regarding law reform to protect the rights and interests of those involved in domestic partnerships. The Domestic Partnership Bill was promulgated in 2008 but to date has not been passed into law. The ensuing consequence is that cohabitation relationships are therefore self-regulated. This relationship has no legal status as a union in South Africa. The court have, however, recognised that a universal partnership could be established if certain criteria are met. Furthermore, heterosexual couples are now also recognised as a "dependant" in actions against the Road Accident Fund for loss of support as a result of death of the breadwinner. Unlike South Africa, cohabitation in Sweden is regulated by a dedicated law called the Cohabitees Act 2003. The Act provides comprehensive protection than that afforded to cohabitants in South Africa. It offers a clear definition of cohabitation and criteria in order to qualify as a cohabitee. The Act, further, regulates the proprietary consequences of entering into such a relationship and the effects of termination. Cohabitation has status as a legal union in Sweden. My research will deal with non-formalised cohabitation and a comparison shall be made between the current systems in South Africa and Sweden. My work will suggest that the statutory model of regulation in Sweden may provide a solution for South Africa. In South Africa, cohabiting couples are not afforded the same rights as married couples. In contrast, married couples are afforded rights automatically as a result of the institution. Unmarried partners have no automatic duty of support, to acquire an interest each other's separate property and a cohabitee may not inherit intestate from the estate in the event of death of one of the partners. In Sweden, intimate relationships are treated similarly to married relationships, with the law applying the principle of "neutrality" with regard to its family laws. Several cases have emerged recently in South Africa which will provide a clearer understanding of the current state of the law. The reason for undertaking this study is to illustrate the changing mores of society and the necessity of the law to keep up with these values. As South Africa has not yet passed its domestic partnership law it may be useful to compare it to Sweden in order provide South Africa with a possibly better approach. Sweden has passed laws on cohabitation and these have been in place for years. Thus we might still learn from them prior to our law being passed. Legislative and judicial activity have soared recently and it may be beneficial to look at another jurisdiction more carefully. These observations will be undertaken more comprehensively in the body of the thesis.

Abstract:
Currently, a great schism exists in the way that the law of financial provision treats cohabiting and married couples on relationship breakdown. Given that research consistently demonstrates that women are predominantly responsible for carrying out homemaking activities regardless of employment status, at the heart of this divide is the way that the law attributes value to this traditionally female role. In the married context, on divorce, breadwinning and homemaking contributions have equal value, yet in the cohabitation context only financial contributions are recognised, with homemaking having no value attributed to it. This polarised approach has received extensive criticism from the courts, the legal profession and the academic community, both for overvaluing domestic contributions in the married context and for ignoring or at best undervaluing them in the cohabitation context. Yet, despite the agreement over the inadequacies in this area, there is a lack of consensus over the direction that reform should take, and so far attempts have been slow and have often come to nothing, especially in the cohabitation context. Furthermore, feminist opinion is divided about whether financial recognition of domestic contributions in family law poses a threat to the financial autonomy of women, encouraging patriarchal financial dependence; or whether such developments redress a glaring inequality inherent in gendered roles freely chosen within the family. Consequently, this project uses the two very differing feminist positions of Ruth Deech and Martha Fineman who embody this divide as the lens through which to explore this dichotomous tension underlying the law in this area. To test out these two feminist stances, this project uses a range of doctrinal, feminist and empirical methodology, namely interviews with legal practitioners, to compare the approaches in New Zealand, Scotland and Queensland, Australia alongside England and Wales, where each jurisdiction differentially reflects a point on a spectrum between Deech and Fineman’s contrasting positions. This project also uses focus groups with members of the public in England and Wales to ascertain the affected communities’ views on these models of financial provision. Drawing on these results, this thesis shall consider how the law of financial provision in England and Wales should divide assets on relationship breakdown in the marriage, civil partnership and the same- and different-sex cohabiting context. Should it promote financial autonomy or should it offer greater protection to those who lead gendered lives in the private sphere?

Abstract:
   1 January 2010 was a milestone for the survivors and victims of same-sex domestic violence in Hong Kong. After a hard fought legislative battle, the Domestic and Cohabitation Relationships Violence Ordinance (DCRVO) was extended to cover cohabitation relationships irrespective of sexual orientation.    With the inclusion of same-sex cohabitants in the legislation, gay survivors are provided the same legal protection as different sex couples. It is believed that equality has been achieved for gay victims, in theory at least. Indeed, the topic of same-sex domestic violence seemed to vanish from the public sphere as soon as the Ordinance was enacted. Nevertheless, considering the cultural and social obstacles experienced by gay victims of domestic violence, e.g. social perception of homosexuality and the fear of being ‘outed’ by reporting the incidents, coupled with a lack of supplementary support services available to people with alternative sexual orientations, it is uncertain how effective this amendment will be to Hong Kong sexual minorities in practice. Therefore, the primary research question for this thesis is to what extent the DCRVO is effective in protecting in practice.    This research question will be answered by a combination of qualitative and quantitative empirical research methods. This paper focuses on three areas particularly - the awareness amongst the gay community in Hong Kong of the legislation; the availability of same-sex domestic violence support services; and the subsequent complementary policies provided by the government. This study argues that without adequate complementary policies, the DCRVO will always remain to be a piece of work in progress, and not the ultimate solution for gay victims in Hong Kong.

L’amitié en droit privé est un sujet qui peut surprendre, par sa teinte oxymorique. L’amitié, situation de fait et relation informelle, semble très peu juridique. Elle peut désigner des formes d’intimité différentes, qui représentent des degrés d’amitié, pouvant soulever des problèmes juridiques différents. Cette nature polysémique, conjuguée à la difficulté d’identification d’un phénomène factuel et fugace rendent toute tentative de définition de l’amitié stérile. De ce fait, toute approche notionnelle comme normative est inaccessible. Pourtant, le droit n’ignore pas l’amitié. Il la redoute mais la protège également. L’intérêt de l’étude est de démontrer comment le droit s’accommode de l’absence de définition de ce phénomène pour lui offrir une place. Une approche fractionnée, en fonction des enjeux soulevés, permet au droit d’appréhender l’amitié dans chacune de ses formes, de l’amitié utilitariste à l’amitié durable et stable, sans avoir besoin d’une définition générale et abstraite. Cette approche téléologique permet également de laisser à l’amitié un domaine de liberté car l’appréhension de l’amitié nécessite de prendre en considération le libre choix qui la caractérise. Elle ne peut donc être saisie uniquement par une norme impérative. L’appréhension juridique de l’amitié contourne l’écueil de sa définition par un subtil équilibre entre norme, contrat et juge. Le droit privé dépasse tout ce qui semblait être rédhibitoire à première vue et qui rendait cette interaction presque inconcevable. C’est là sans doute la réelle originalité de cette interaction : au-delà du dépassement de la nécessité d’une définition juridique, l’amitié a sa place en droit privé
Friendship is one of the most important social institutions : it binds society together. Yet, we could wonder what the law has to do with it. It seems impossible to define friendship, and the law needs a definition to identify a relationship. However, private law does not ignore friendship. The law copes with it about partiality, about conflicts of interests and about several misdeneanors. Law fears friendship as it may change the balance of interests protected by law. It also happens in Contract law, when friendship is the reason of binding. On the other side, law has to protect friendship, as it is important for the personal development. Friendship is included in protection of privacy by the European Court of Human Right. Friendship is also protected because it can be useful to take care for individual interests, especially when family collapses. Thus, a friend can give an organ to save his friend, he can relay his friend’s will when he is unabled. Friendship do matter in Private Law, even if it cannot be precisely defined. It could even have more legal attention in the future. The real point of the study is to show how the law can deal with this lack of legal definition, and manage to apprehend friendship

L’influence libérale en droit de la famille et l’essor de l’idéologie individualiste ont provoqué un pluralisme des formes de conjugalité et ont considérablement accru la diversité des règles et des méthodes applicables aux couples en droit international privé contemporain.L’analyse des couples en droit international privé nous a alors conduit à repenser le droit international privé du couple. La déconstruction de la matière met en lumière l’inadaptation actuelle de la méthode conflictuelle classique et l’insuffisance de la méthode de la reconnaissance. En effet, l’actuel droit international privé du couple ne permet pas de garantir la continuité internationale du lien conjugal, pas plus qu’elle ne permet d’assurer un traitement juridique cohérent des problèmes auxquels sont confrontés les couples internationaux. Une réflexion quant à une possible évolution méthodologique de la matière était donc nécessaire. Cette étude vise à démontrer qu’une adaptation de la méthode conflictuelle classique à l’aune des objectifs de la méthode de la reconnaissance et fondée sur un raisonnement en termes de conflit d’autorités est possible. Elle apporterait aux règles de droit international privé du couple une meilleure cohérence tout en assurant aux rapports conjugaux internationaux une réelle stabilité
The liberal influence in Family Law and the rise of individualist ideology have led to a multiplication of conjugal life forms and considerably increased the diversity of laws and methods applicable to couples in International Private Law. To analyse couples under International Private Law leads us to rethink the International Private Law of the Couple. Deconstructing this subject brings to light the current non-adaptation of the classic conflict of laws method and the insufficiency of the recognition approach. In fact, current International Private Law as it pertains to couples neither guarantees the international recognition of theconjugal bond nor ensures a coherent legal treatment of legal problems faced by international couples. It is therefore necessary to examine a possible methodological evolution of thesubject. This study aims to demonstrate that it is possible to adapt the classic conflict of lawsmethod by taking into account the objectives of the recognition approach whilst founding iton the lex auctoritas rule. This would not only bring better coherence to International Private Law of the Couple but it would also assure a real legal stability for international conjugal relationships

Bien des couples, aujourd’hui, passent du concubinage au pacs, puis du pacs au mariage, qui sont les trois conjugalités que propose le droit contemporain. À chacune correspond un statut patrimonial spécifique (prévoyant une répartition des biens et des dettes, instituant des effets sociaux et fiscaux, etc.). Or ces statuts sont en pleine mutation : aujourd’hui, on ne compte plus les transformations légales et jurisprudentielles qui s’accomplissent. Quelles sont ces évolutions ? Jusqu’où doivent-elles se poursuivre ? Tel est l’objet de cette étude. Elle relativise l’idée qu’un droit commun du couple serait appelé à émerger : elle constate que, même si un phénomène de convergence est à l’œuvre, d’autres évolutions tendent à accroître certaines différences entre les conjugalités. Elle démontre alors que le droit positif se structure sur le modèle d’une gradation. Plus un couple choisit une conjugalité stable et engagée, plus son statut patrimonial devient exorbitant, communautaire et protecteur. Les amants sont ainsi incités à s’engager sur un chemin jalonné d’étapes prédéterminées (couple sentimental, emménagement, pacs, mariage) que l’on peut appeler iter copulae ; ce modèle est en phase non seulement avec le droit positif, mais aussi avec la réalité sociologique moderne.Ainsi, l’étude synthétise les évolutions en cours. Elle suggère de les approfondir où elles sont inachevées, de les tempérer où elles sont excessives, de les consacrer où elles sont prétoriennes ; le propos est parsemé de propositions de réformes, toutes destinées à asseoir le droit positif sur des bases durables, car plus en phase avec les aspirations modernes
Many French couples today move from cohabitation to civil partnership, then from civil partnership to marriage, which are the three forms of conjugality offered by contemporary law. Each has its own specific property status (providing for the division of assets and debts, establishing social and tax effects, etc.). But these statuses are in a state of flux,with countless legal and case law changes being made. What are these changes ? How far should they continue ? That is the purpose of this study. It sets itself apart by putting into perspective the idea that a common law governing couples will emerge : it notes that, even if a phenomenon of convergence is at work, other developments are tending to increase certain differences between conjugal relationships. It then shows that positive law is structured on the model of a gradation. The more a couple chooses a stable and committed conjugal relationship, the more their property status becomes exorbitant, communal and protective. Lovers are thus encouraged to embark on a path marked out by predetermined stages (romantic relationship, moving in, civil partnership, marriage) that can be called iter copulae ; thismodel is in line not only with positive law, but also with modern sociological reality. The study summarises current developments. It suggests deepening them where they are incomplete, tempering them where they are excessive, and enshrining them where they are praetorian. The study is interspersed with proposals for reform, all designed to put positive law on a sustainable footing, since it is more in tune with modern aspirations

Cette thèse vise à appréhender la condition juridique des couples non mariés, à travers près de cinq siècles. Le droit canonique du mariage relégua le concubinage à un état permanent de péché, et, au XVIe siècle, le concile de Trente prescrivit des sanctions sévères à l'encontre des concubinaires. Les pères du concile édictèrent des règles encadrant la célébration du mariage. Puis, l'autorité séculière s'arrogea peu à peu la compétence en matière matrimoniale, par les lois et par la jurisprudence. La frontière entre mariage et concubinage était dorénavant strictement établie. Si l'ancien droit ne regarda pas le concubinage comme un délit, il fustigea les bâtards en les soumettant à un statut d'infériorité. Sous la Révolution, la sécularisation du mariage ne remit pas en cause la forme traditionnelle de l'union conjugale, toutefois, les législateurs accordèrent des droits aux enfants naturels reconnus. En 1804, le Code civil ignora absolument le concubinage. Le fondement de la famille était le mariage ; et, les enfants naturels furent, de nouveau, les victimes de la prééminence de l'union légitime. Dés le milieu du XIXe siècle, la rigueur du Code envers la famille naturelle fut atténuée grâce à un courant d'idées progressistes. Puis, au début du XXe siècle, la reconnaissance officielle du concubinage fut opérée par une série de mesures législatives lui conférant des effets juridiques, et la voie vers un pluralisme juridique des modèles familiaux se trouva ouverte.

DIE LEGALISIERUNG DER INTIMITÄT IN MEXIKO von Manuel Castillo Diese Dissertation wurde zur Erlangung des akademischen Grades Doctor iuris (Dr. iur.) an der Juristischen Fakultät der Humboldt-Universität zu Berlin in Deutschland vorgelegt. Das Hauptthema der Forschung ist die Legalisierung der Intimität, am Fallbeispiel des mexikanischen Rechts. Mit der Prämisse, dass das Recht auf Intimität sich aus dem Recht auf Privatsphäre ergibt, bespricht diese Forschungsarbeit die grundlegenden Menschenrechte, die einen Rahmen für die Legalisierung der Intimität ermöglichen. Die Einführung, der Sphären und Strukturen der Intimität, liefert eine Vorgehensweise zur Analyse dieses Themas. Es erfolgt eine Betrachtung der Frage der Geschlechter in ihrer Beziehung mit dem Recht und der Intimität. Aus einer „queer“ Perspektive hinterfragt diese Dissertation die Gleichstellung von Ehe und gleichgeschlechtlicher Ehe, mit dem Argument, ob eine neue Form der Legalisierung der Intimität für alle notwendig ist. Darüber hinaus, liefert diese Arbeit eine vergleichende Bewertung der mexikanischen Rechtsvorschriften im Rahmen des Völkerrechts. Am Ende der Dissertation, wird ein Vorschlag zur Legalisierung der Intimität im einundzwanzigsten Jahrhundert dargeboten.
THE LEGALIZATION OF INTIMACY IN MEXICO by Manuel Castillo This dissertation has been submitted in partial fulfillment of the requirements for the degree of Doctor iuris (Dr. iur.) at the Faculty of Law, of the Humboldt-Universität zu Berlin in Germany. The main scope of the research is the legalization of intimacy, using Mexican law as a case study. Considering that the right to intimacy arises from the right to privacy, this research discusses the fundamental human rights that constitute a framework for the legalization of intimacy. The research provides an approach to the analysis of this subject that includes what has been introduced as the Spheres of Intimacy and the Structures of Intimacy. The issue of gender is discussed in its relationship with the law and intimacy. From a queer perspective, this dissertation questions the equality of marriage and same-sex marriage, arguing that a new form of legalization of intimacy for all is needed. Furthermore, this study provides a comparative review of Mexican legislations within the framework of international law. At the end, this dissertation offers a proposal for the legalization of intimacy in the twenty-first century.

Au centre de ce travail, la cohabitation de neuf ans entre la communauté paysanne de Fuerabamba et une compagnie minière (2005-2014) révèle depuis l’échelle locale les relations de pouvoir produites par le projet ainsi que les transformations sociales et politiques que celuici induit. Ce travail met en lumière les interactions et les frictions à l’œuvre entre les habitants de la communauté et la compagnie minière, mais également entre les habitants, eux-mêmes. Ainsi, alors qu’un ordre social « minier » se dessine avec l’arrivée du projet, l’entreprise se greffe dans un territoire marginalisé par l’État, et à ses dynamiques politiques et historiques. L’ethnographie de la cohabitation révèle un pouvoir complexe exercé par l’entreprise, dans lequel s’articulent les modes opératoires du secteur minier international avec d’anciennes traditions sociales de pouvoir à l’œuvre dans les zones grises de l’État. L’étude de cette cohabitation s’articule avec un certain nombre de processus ; des héritages historiques et de conséquences futures, qui permettent d’appréhender les résonnances de ce cas particulier dans un contexte plus large. Finalement, cette situation apparaît comme une relation de forces inégales où l’emprise, le paternalisme et la promesse de bénéfices futurs pour les familles permettent à l’entreprise d’arriver à ses fins. This study questions the forms of power at stake in the hearth of a mining project in Peru. This work focuses over nine years of coexisting between the peasant community of Fuerabamba and a mining company (2005-2014). From a local scale, this work reveals the relationships of power and the social and political transformations that the project induces. This study highlights the interactions and frictions taking place between the inhabitants of this community ant the mining company, but also between inhabitants themselves. The company is grafted onto a territory marginalized by the State and to its political and historical dynamics. A new “mining social order” seems to be established with the arrival of the project. The ethnography of the coexistence reveals the company’s complex power. It articulates international mining operational models and social power traditions in this State’s grey zones. The study of this coexistence can be broken down to a certain number of processes. Historical heritage and future consequences allow to understand the echoes of this particular case in a broader context. Finally, this situation appears to be an asymmetric power balance. Its grip, the paternalism and the promise of future benefits for families allows the company to fulfil its objectives. To quiet the opposition, relocate the community and operate the mine

D'origine essentiellement religieuse, la répudiation est la rupture unilatérale et discrétionnaire du mariage décidée par l'époux. En droit musulman, elle permet au mari de mettre un terme à la relation maritale sans avoir à se justifier. En France, cette institution est critiquée et même rejetée tant elle paraît étrangère à la civilisation européenne. Pourtant, à y regarder de plus près, la rupture unilatérale et discrétionnaire du couple existe en droit français sous l'appellation de " divorce pour altération définitive du lien conjugal " pour le mariage, mais encore de "rupture unilatérale " s'agissant du pacte civil de solidarité et du concubinage. La différence tient au titulaire de l'exercice de ce droit, alors que la répudiation ne peut être mise en oeuvre que par l'homme, la rupture unilatérale et discrétionnaire du mariage, du PACS et du concubinage peut être décidée par l'homme ou la femme. Toutefois, fondamentalement, les effets sont les mêmes : l'un décide, l'autre subit. Que la rupture soit judiciaire ou non judiciaire, ce mode de dissolution laisse perplexe quant à l'attitude du juge et du législateur français face à la répudiation. Le premier refuse, depuis le 17 février 2004, de reconnaître des effets aux répudiations musulmanes en France sous couvert de la violation du principe d'égalité entre époux. Le second, cautionne la rupture unilatérale et discrétionnaire au sein du couple.

Same-sex issues have been paid more and more attention in recent years. Generally, western countries took steps to protect the rights of same-sex couples by developing registered partnerships before recognizing same-sex marriage. However, there is still no any relevant law in our country. When it comes to cases concerning foreign inter-ests, lacking of legislation could cause some difficulties to same-sex couples. In the area of plural jurisdictions like European union, To harmonize the conflict law of countries, EU adopt measures in many sphere. From property law to family matters, especially the new regulation apply to matters of the property consequences of regis-tered partnerships. Analyzing the harmonization of EU private may provide as our country’s legislation reference. This article will briefly introduce the history of European Union and the harmoni-zation of EU private international law. Roughly divided EU’s Regulation into Prop-erty law and Family matters, this article will also discuss them separately. In the same time, compares the difference of registered partnerships in Germany, France and the United States. Based on the experience of those western countries, hope to provide legislative proposals on future development and protection of same-sex cohabitation.

Les traditions culturelles et l’histoire commune des états membres de l’UEMOA ont été des facteurs clé de leur rapprochement dans divers domaines. En effet, la monnaie commune de ces différents pays a permis d’instaurer les fondements d’un droit commun des investissements, et une zone de coopération fondée sur une profonde solidarité . Ceci devait se faire, à travers la reconnaissance de la liberté de circulation des capitaux dans le traité du 12 mai 1962 instituant l’UMOA qu’ils s’étaient engagés à transformer en Union Économique et Monétaire Ouest-Africaine . Au fil du temps, le développement du droit communautaire en Afrique de l’Ouest a évolué et couvert un large champ qui s’étend désormais aux investissements . Les enjeux du Droit International des Investissements, en raison des exigences de la mondialisation des économies, ont contraint les États de l’espace UEMOA, importateurs de capitaux, à faire converger leur réglementation des investissements afin de favoriser leur attractivité et d’en tirer le meilleur parti . La difficulté d’un tel objectif réside d’une part, dans la nécessité d’arriver à̀ concilier leurs intérêts avec ceux des investisseurs ; qui ne sont pas toujours convergents et d’autre part, soulèvent certaines questions concernant le choix des juridictions compétentes et du droit applicable aux conventions d’investissements. L’Union n’a pas dérogé aux standards internationaux de protection des investissements qui existent pour les garanties procédurales . Elle a reconnu la pertinence de l’arbitrage comme principal mode de règlement des différends tout en réaffirmant le principe de la compétence des juridictions nationales et communautaires. Dès lors, pour débattre « de la cohabitation des juridictions encadrant la résolution des conflits issus des investissements internationaux dans l’UEMOA » thème de l’étude que nous avons menée, nous avons suivi la démarche ci-après : Au Chapitre I, nous avons présenté l’UEMOA dans toute sa composante. Dans le Chapitre II, nous avons présenté les différents investissements au sein de l’UEMOA. Quant au Chapitre III, il a porté des éclairages sur l’arbitrage au sein de l’UEMOA, l’un des principaux modes de résolution des conflits issus des investissements internationaux et traite de certaines sentences arbitrales sur des cas de conflits entre États membres de l’Union et des investisseurs. Par ailleurs, le chapitre IV propose quelques analyses critiques sur la gestion des conflits. Enfin, le Chapitre V, fait état de nos analyses critiques et recommandations à l’effet d’apporter notre contribution pour l’amélioration de cette pratique importante et délicate pour l’Union.
The cultural traditions and the common history of the UEMOA member states have been key factors in bringing them together in various fields. Indeed, the common currency of these different countries has made it possible to establish the foundations of a common investment law, and an area of cooperation based on deep solidarity. This was to be done, through the recognition of the freedom of movement of capital in the treaty of May 12, 1962 establishing the UEMOA which they had undertaken to transform into the West African Economic and Monetary Union. Over time, the development of community law in West Africa has evolved and covered a large field which now extends to and covered to investment. The challenges of International Investment Law, due to the requirements of the globalization of economies, have forced the WAEMU States, importers of capital, to converge their investment regulations in order to promote their attractiveness and draw better. The difficulty of such an objective lies, on the one hand, in the need to manage to reconcile their interests with those of investors ; which are not always convergent and on the other hand, raise certain questions concerning the choice of competent courts and the law applicable to investment agreements. The Union has not departed from the international investment protection standards that exist for procedural guarantees. It recognized the relevance of arbitration as a means of settling disputes while reaffirming the principle of the jurisdiction of national and Community courts. Therefore, to debate "the cohabitation of the jurisdictions framing the arbitration of conflicts arising from international investments in the UEMOA" theme of the study that we conducted, we followed the following approach : vi In Chapter I, we presented UEMOA in its entire component. In Chapter II, we presented the various investments within the UEMOA. As for Chapter III, it shed light on arbitration within the UEMOA and deals with certain arbitral awards on cases of conflicts between Member States of the Union and investors. In addition, Chapter IV offers some critical analyzes on conflict management. Finally, Chapter V presents our critical analyzes and recommendations to make our contribution to the improvement of this important and delicate practice for the Union.

Die definisie van 'n huwelik tref 'n onderskeid tussen heteroseksuele en homoseksuele lewensmetgeselle ten opsigte van die bevoegdheid om te trou. Hierdie onderskeid op grond van seksuele georiënteerdheid mag moontlik ongrondwetlik wees. Voorts is daar 'n menigte regte en verpligtinge wat outomaties uit huweliksluiting spruit, maar nie outomaties op lewensverhoudings van toepassing is nie. Hierdie onderskeid op grond van huwelikstaat mag eweneens moontlik teen die bepalings van die Grondwet van die Republiek van Suid-Afrika, 1996 indruis. Hierdie studie is gevolglik daarop toegespits om ondersoek in te stel na die grondwetlikheid van hierdie twee onderskeide. Die ondersoek word geloods met verwysing na relevante wetgewing en regspraak. 'n Bondige oorsig van fundamentele regte word as agtergrond verskaf. Na afhandeling van die ondersoek word daar aandag geskenk aan die huidige en voorgestelde toekomstige erkenning en regulering van lewensverhoudings in die Suid-Afrikaanse reg, waarna die bevindings saamgevat en krities beoordeel word. SUMMARY The definition of marriage differentiates between heterosexual and homosexual life partners with regard to the capacity to marry. This differentiation on account of sexual orientation may possibly be unconstitutional. Furthermore there are a multitude of rights and obligations that automatically flow from marriage, which are not automatically applicable to life partnerships. This differentiation on account of marital status may also violate the provisions of the Constitution of the Republic of South Africa, 1996. Accordingly this study is aimed at investigating the constitutionality of these two differentiations. The investigation is conducted with reference to relevant legislation and case law. A concise overview of fundamental rights is provided as background. In conclusion of the investigation, attention is paid to the present recognition and regulation of domestic partnerships in South African law, after which the findings are summarised and evaluated critically.

Le Québec est la seule province canadienne à ne pas imposer d'obligation légale quant aux rapports interpersonnels entre les membres de couples non mariés. Pourtant, leur nombre augmente considérablement et, en 2001, il y avait 1 158 410 couples en union libre au Canada, dont 508 525 vivaient au Québec. Les conjoints de fait des autres provinces canadiennes ont revendiqué un statut juridique d'égalité de droits avec les couples mariés, ce qui a donné lieu à plusieurs décisions de la Cour suprême du Canada et à la mise en vigueur de lois visant l'encadrement juridique de la rupture de ces conjoints de fait. C'est ainsi que toutes les provinces canadiennes, sauf le Québec, imposent une obligation alimentaire entre conjoints de fait à la rupture. La présente étude utilise les méthodologies d'analyse proposées par les théories légales féministes pour aborder la situation juridique de la famille québécoise dans un contexte historique et social afin de suggérer la mise en place d'un cadre légal des rapports interpersonnels des conjoints de fait. Afin de favoriser une plus grande égalité et une solidarité familiale, l'auteur propose l'établissement d'une obligation alimentaire compensatoire entre les membres des couples québécois non-mariés, avec enfants.
Quebec is the only Canadian province that does not impose legal obligations regarding interpersonal relations between the members of unmarried couples. In 2001, there was 1 158 410 unmarried couples in Canada, of which 508 525 were living in the province of Ouebec. Common law spouses from other provinces have claimed equal legal status with married couples, which lead to many decisions from the Supreme Court of Canada and to provincial legislations regarding their separation. Thus, ail Canadian provinces except Ouebec impose alimentary support on common law spouses at separation. This study uses the methodology of feminist legal theories to approach the legal situation of Quebec families in a historical and sociological context to propose a legislation regarding interpersonal relations within unmarried couples. According to the author, there should be a compensatory obligation of support between the members of unmarried couples with children to favor equality and familial solidarity.

The legal status of the parties to a de facto marriage is investigated, taking into consideration the present South African position, legal comparison, the moral argument, and the influence of the Constitution of South Africa. The different forms of the de facto marriage in its wide interpretation are reviewed and the following relationships are discussed: cohabitation relationships; customary marriages; marriages resulting from religious traditions; and homosexual relationships. It is found that the present South African legal position is very unsatisfactory. Several suggestions for amendments are made, and the unique characteristics of the South African situation to be taken into consideration in forming a new approach, are highlighted. It is pleaded that the legal profession accept the challenge to create, with innovation, a new system for South African law which will be flexible, but, will at the same time ensure certainty in law.
