Abstract:

In many of the developing countries the working conditions are poor and unfair. Many of the clothes are bought from these countries where murder, violence and arresting of the workers are common. Neither the employers nor the employees know the laws of their countries entirely and therefore have no knowledge of fundamental rights.

The purpose of the dissertation has been to study the inspections and the compliances of the codes of conduct. Companies use codes of conduct to improve the working environment at the supplier. Furthermore, it is a contract from the company to the supplier, containing what to be expected of the supplier. The dissertation also describes what the differences are between being a member or not of the organization Business Social Compliance Initiative (BSCI).

The research questions were answered through interviews. The contacted companies were Swedish textile companies with suppliers in developing countries.

No noticeable differences between being a member of BSCI or not were found. Therefore, we added the last research question that contained the relationship between the selected companies and their suppliers.

A conclusion regarding the relationship can be drawn from our empirical material. A satisfactory relationship with the supplier is vital when inspecting a code of conduct. The suppliers should be an active part in the work with codes of conduct to improve them in the future.

Abstract:

Gay, James Ronald. "A code of conduct for computer forensic investigators." Thesis, University of East London, 2012. http://roar.uel.ac.uk/1787/.

Full text
Abstract:
The amount of electronic data that is held about individuals and their activities is staggering. Tools enabling data recovery, believed deleted, vary in consistency and reliability of result. Data under review can be fed into investigative tools which also vary immensely in reliability, consistency, quality and indeed price. Conclusions and inferences drawn from the use of these tools can be morally, socially and commercially damaging for the individuals or entities being investigated. Often not purely because of the lack of experience of the investigator, but also because of the simplistic operation of the toolsets. Whilst prescriptive guidelines exist in the public sector for the proper handling, analysis and reporting of computer evidence, little commercially independent professional guidance exists in the private sector. This lack of guidance has led to a position whereby actors in the field of data forensics have few challenges as to their expertise or experience. Recent cases of incompetence and crossing ethical and professional boundaries provide strong support for a National, preferably International certification and training scheme for data forensic analysts, supported by clear ethical codes. This research in light of the above challenges, provides examples of failures in extrapolation, operator understanding and tool use; argues a proposal for a code of conduct to ensure correct and repeatable process is followed; along with a suggested outline for the creation of the supervision of conformity to that code in the private sector. The current forensics community and academic research body of knowledge, supported by the extensive experience of the researcher have been the major inputs to the work. The outputs of this work are intended to form a solid base for the furtherance of the Computer Forensics profession, and as such will represent a significant contribution to the advancement and knowledge base of that profession.

Abstract:

Abstract:

KEHLER, BERIT, and KAJSA RYDEHED. "Sustainable development in codes of conduct for suppliers." Thesis, Högskolan i Borås, Institutionen Textilhögskolan, 2014. http://urn.kb.se/resolve?urn=urn:nbn:se:hb:diva-18041.

Full text
Abstract:
The concept sustainable development is defined as meeting the needs of the existing global population without compromising the opportunities for future generations to also meet their needs. Therefore, in order to work towards sustainable development, active sustainable choices need to be made in a company’s business activities. This thesis has a qualitative approach that aims to study five different Swedish textile companies and how they work towards sustainable development in their code of conduct for suppliers. Theories are collected from literature, articles and web sources, which include sustainable development, social, environmental and economic sustainability and codes of conduct. The main target is to identify different sustainable approaches towards sustainable development in the code of conduct for suppliers focusing on the social, environmental and economic sustainability. The empirical data is collected from five personal interviews with representatives in charge of sustainable activities from the selected companies. The result of the study confirms that all companies to different extents are working towards sustainable development in their code of conduct for suppliers. Sustainable approaches in these codes are agreements with suppliers including following the country’s laws and regulations of the suppliers. The companies also collaborate with third-party industrial research institutes to reduce water and chemical supply in the production. Moreover, the study shows that the concept sustainable development seems to be less embedded in the code of conduct for suppliers. Companies rather work with sustainable activities in forms of running projects and establishing agreements beyond having a code of conduct.

Pentz, Janos. "Relating school codes of conduct to learner behaviour." Diss., University of Pretoria, 2010. http://hdl.handle.net/2263/24527.

Full text
Abstract:
Schools and other educational institutions mirror the violence and moral decay in South African society. Maintaining discipline therefore in schools these days is a difficult task. There are many factors influencing learner behavior and in this study we investigate to see what impact a code of conduct has on learner behavior in selected schools. I adopted a qualitative approach to answer the research questions that sought to explore whether or not intent of the codes of conduct in sampled schools is primarily moral or administrative, whether the learners in the public secondary schools selected are generally well-behaved, whether or not there is a relationship between learner behaviour and the codes of conduct at the selected schools and whether or not the infusion of values into codes of conduct in general might affect learner behaviour. A case study involving three high schools was conducted. Data was collected through document analysis, interviews and questionnaires. It has emerged in the findings that, with regard to learner behavior, there is a clear link between learner behaviour and the culture of the school concerned as well as between the culture of the school and the culture of the community that is served by the schools. Regarding the impact that existing codes of conduct have on learner behavior, it seems that the impact that a code can have is related to its development and implementation process. Due to these findings, it seems clear that values need to be considered in the development of a code of conduct. This may lead to a positive relationship between learner behavior and codes of conducts for learners. The study hopes to contribute to the existing body of knowledge and will be useful to school governing bodies, principals and educators by enabling them to see the benefits that a code of conduct could have on learner behaviour when values are included in the developmental and implementation process.

Sebisha, Modishane Frank. "The implementation of a code of conduct in rural primary schools in Limpopo." Diss., University of Pretoria, 2015. http://hdl.handle.net/2263/52967.

Full text
Abstract:
One of the key challenges facing school governing bodies in South Africa is how to maintain school discipline and create an atmosphere which is conducive to effective learning and teaching. It is anticipated that adopting a code of conduct for learners may facilitate the attainment of this goal. The aim of this study was to investigate the implementation of a code of conduct for learners in rural primary schools in Limpopo province. The investigation involved a case study of two primary schools in the Sekhukhune District. The data collection methods used included interviews and document analyses. The participants in the study comprised members of the school management teams (SMTs) as well as the principal and parent component of the school governing bodies (SGBs). The findings revealed that, when properly implemented, such a code of conduct is an effective tool in managing the majority of learner behaviour, although it has a limited effect on serious misconduct. The study highlighted a number of challenges involved in the drafting of a code of conduct. These challenges arose primarily as a result of a lack of legislative knowledge on the part of the SGB members, as well as a lack of parental support. Parents are often away working in urban areas while children are cared for by illiterate grandparents and other family members. Additional challenges regarding the implementation of the code of conduct were mainly as a result of the lack of timely departmental support in the case of serious misconduct, peer pressure and socioeconomic factors. The study recommended that the government should equip parents, SMTs and SGBs with the necessary skills and knowledge relating to educational law through workshops and the establishment of accessible, effective adult basic education centres. When policies are drafted, English should be used in conjunction with the other languages that are spoken by the majority of people in the area concerned, in order to ensure a better understanding of such policies than would otherwise be the case. There has to be better handling of disciplinary hearings and consistency in the implementation of the code of conduct. Teaching and learning should also be improved to minimise the necessity for learner discipline in schools.

Abstract:
Oral Biology
M.S.
The American Association of Orthodontists(AAO) adopted its Code of Ethics and Code of Professional Conduct in May of 1994. This document is meant to provide guidelines for ethical behavior amongst orthodontic professionals. Its main purpose is to protect the public from ethically unsound actions that could be committed by members of the AAO. All members of the AAO agree to abide by the Code, as stated within its preamble: "By accepting membership, all members assume an obligation of self-discipline above and beyond the requirements of laws and regulations, in accordance with these Principles." This study represents a critique of the AAO Code. As the field of medical ethics evolves, so must the documents that govern ethical behavior. The last revision took place in May of 2009 and the wording of the current document can be misinterpreted or abused. The current code leans heavily towards an Agent/Commercial model of practice, where the Orthodontist's role is influenced greatly by patient request and business ambitions. The purpose of this study was to utilize accepted schools of thought in ethical literature to do the following: (1) Point out ethical flaws and weak points in the AAO Code. (2) Present corrections for the Code in order to clarify potential points of contention. These corrections will articulate rules that promote a partnership between practitioner and patient. To accomplish these goals, the Code will be analyzed, line by line, for redundancies, faults, or potential misinterpretations. Principles and Advisory Opinions which can be improved upon will be labeled as "weak." All weak statements will be reformed in a manner where the weak aspects no longer play a role in the Code. The reformed statements will promote the Partnership model of practice in favor of Agent and Commercial models. The Conclusions of the study are as follows: (1) Principle I can be improved by changing it to the following phrase: Members shall be dedicated to providing the highest possible quality orthodontic care to his/her patients within standards commensurate with the accepted science and techniques of orthodontics, the clinical aspects of the patient's condition, and with due consideration being given to the needs and desires of the doctor and patient within a relationship based on partnership. (2)Advisory Opinion IE. should be changed to the following: A second opinion should include a diagnosis and treatment plan recommended to the patient. It must be honest and focus on the facts presented. It is unethical to propound a specific technique, philosophy, training or ability as superior without presenting scientific literature, at least summarized or simplified, to the patient to support claims made. A second opinion must disclose to the patient any conflict of interest of the member providing the opinion. (3) The phrasing of Advisory Opinion IF. is made stronger with the following wording: Patients should be informed of their oral health status without disparaging comments about the patient's prior treatment.(4) The phrasing of Advisory Opinion IG. is made stronger with the following wording: Members should inform their patients of their prognosis, any proposed treatment, and any reasonable alternatives, so that the patient understands their treatment decisions.

Botha, Paparouzkja. "Study of the implementation of the Code of Conduct and Ethical Standards in the South African Quantity Surveying Industry." Diss., University of Pretoria, 2020. http://hdl.handle.net/2263/73462.

Abstract:
Over the past few years there is an increase in globalization and construction industry companies are becoming more aware of the environmental and social aspects in construction projects. Companies have to make a profit and carry out an obligation towards the community. The reason for introducing codes of conduct is to ensure that companies and persons within the construction industry become more socially responsible and adopt it into their daily businesses due to community pressures. It is essential to enforce codes of conduct throughout the construction industry professions, including all stakeholders and team members within the construction industry. This study has sought to determine the main reasons why some quantity surveyors might not always apply the code of conduct in an ethical and professional manner, as well as to identify possible ways how the code of conduct can be improved, be upheld and implemented more successfully in South Africa. Questionnaires were used to collect data from some quantity surveyors in South Africa. The aim of the questionnaire was to identify how some quantity surveyors implement the code of conduct, where the possible gaps in the code of conduct are and how the current code of conduct can be improved. The data determined that the code of conduct needs to be regularly improved in order to stay up to date with current ethical situations that quantity surveyors face daily in South Africa, as well as that some quantity surveyors have a lack of education and proper understanding of the codes of conduct, lack of keeping up to date with the Code and the guidance in which they serve.

Abstract:
Companies adopt codes of conduct to set minimum standards on ethical issues, minimums that suppliers must keep. Problems has been found by other researchers regarding suppliers motivation to comply to the code. This study develops a conceptual model for how motivation can be adjusted to different countries, depending on economic situation, politic stability and culture of the country.   Country-Adjusted Motivation is made  by shaping motivating in relation to the human need that dominates in the country and by using the national culture to colour motivation. The model is applied in the context of how to motivate suppliers to a code of conduct in different countries. The model Country-Adjusted Motivation could as well be applied to other multinational contexts, where strong motivation is needed.

Ashpole, Lynne. "Ministerial Advisers: How Ministers Shape Their Conduct – A Study of Ministers and Advisers in the Rudd Government." Thesis, Department of Government and International Relations, 2012. http://hdl.handle.net/2123/9047.

Abstract:
Ministerial advisers have become part of the standard advisory arrangements in Westminster governments, yet there is disagreement about their roles and behaviour. In Australia, some academic work has considered their involvement in scandals like the 2001 children overboard affair and the 1993 sports rorts controversy. However, the focus on exceptional events means advisers’ everyday roles and conduct have not been given sufficient weight and those conclusions are therefore distorted. This paper finds that ministers exert a dominant influence over their advisers’ behaviour and that advisers continue to see themselves as agents of their ministers. Based on interviews with four Rudd government ministers and their advisers, the research shows advisers have strong norms of behaviour and that formal and informal accountability mechanisms operate to constrain their conduct. Advisers are not ‘out of control’ or operating in a ‘black hole of accountability’ as often claimed

Abstract:
Thesis (S.M.)--Harvard-MIT Division of Health Sciences and Technology, 2010.
Cataloged from PDF version of thesis.
Includes bibliographical references (p. 99-102).
The Massachusetts Pharmaceutical and Medical Device Manufacturer Code of Conduct (PCOC) or 105 CMR 970.000 was enacted by the Massachusetts state legislature and adopted by the Department of Public Health (DPH) in July 2009 under Chapter 305 of the Acts of 2008, An Act To Promote Cost Containment, Transparency and Efficiency in the Delivery of Quality Health Care. The state law requires pharmaceutical and medical device manufacturers to comply with a marketing code of conduct, obey specific compliance activities, and disclose payments to Massachusetts-licensed healthcare providers with a value of $50 or more in connection with sales and marketing activities. This thesis qualitatively assessed the impact of 105 CMR 970.000 on physician-industry collaboration related to technology development and physician education in the Massachusetts medical device industry, as depicted by academic physicians and representatives of medical device companies during the first quarter of calendar year 2010. A pilot study comprising interviews and surveys of stakeholders in the Massachusetts medical device industry was conducted to summarize the initial impressions of the impact of 105 CMR 970.000 on medical device physician-industry collaboration, with the intention of creating a roadmap for future analysis. Informal interviews (36) included individuals at medical device manufacturers, distributors, academic medical centers, venture capital firms, law firms, consulting firms, MassMedic, and the DPH. Formal surveys (40) included academic physicians and medical device company representatives selling to Massachusetts licensed physicians. The hypothesis was confirmed that 105 CMR 970.000 has impaired medical device physician-industry collaboration related to technology development and physician education in Massachusetts. Our results may have state and federal regulatory implications for the medical device industry and can serve as a guide for future analysis.

Abstract:
CSR is about corporate social responsibility in the community they serve. As a step to take responsibility, a company establishes a Code of Conduct that aims to convey how it takes responsibility and actions in different situations. One industry that has significantly increased its CSR work is the banking industry.Banks must follow the laws and rules from the authority, therefore, they establish a Code of Conduct. The purpose of this study is to see the effects of what a code of conduct can provide to a bank in addition to following the directive given by the au-thority e.g. One of the motives of a bank is to establish a code of conduct. This study will also contribute to a deeper understanding of the Codes of Conduct. To see their motives, we selected the four major banks in Sweden as subjects of the study as well as looking through their respective Codes of Conduct as basis for this investigation. The study concludes that there are several motives behind having a Code of Conduct. Foremost, companies are required by the authority to have a Code of Conduct. Also, companies gain several advantages in having a Code of Conduct. The study provides external and internal advantages for a company in drawing a Code of Conduct

Abstract:
Sustainability has become a strategic and high priority focus area in today’s society. Responsible Business is an important part of the work towards a sustainable society, and Telia Company is one of the companies that actively works to take that responsibility. What is important when it comes to sustainability work in organizations is to look at a longer perspective than just the internal organization. Telia Company has a complex network of suppliers that extend around the world and influencing their sustainabilitywork is therefore critical in order to be able to take that responsibility. This qualitative study was carried out in collaboration with Telia Company with theaim of investigating how the company’s sustainability work in the supply chain can be developed with a code of conduct for suppliers. Today, Telia Company has a process for responsible sourcing where one of the cornerstones is their Supplier Code of Conduct document with requirements agreed and signed by suppliers and followed up by Telia Company continuously. The study’s questions were answered by performing mainly two analyzes. The first analysis is an Industry Peer Benchmarking. Based on the analysis of their sustainability processes within the supply chain, the results show that Telia Company in comparison has good and responsible sustainability work in place in its operations to manage risks in the supply chain. In the second part, an analysis is performed on a selection of Telia Company’s customers to examine how the company meets their set sustainability requirements. The results show that the company meets customers’ requirements in an overall way and that requirements are also in place to pass on these expectations to subcontractors. Previous research and studies also show a paradigm shift where digitalization and new trends are growing in society and affecting customers’ awareness. Accordingly, the measures that is proposed to Telia Company for further development of its supplier requirements are to perform trend analysis and market analysis continuously to meet the stakeholders’ requirements both today and inthe future.

Abstract:
Jane Austen provides moral guidance in her nocels, showing her readers what is wrong with her society. Novels such as Pride & Prejudice and Sense & Sensibility contain studies of human character and lack of morals. She guides her readers towards a clearer moral vision by including characters such as George Wickham and John Willoughby, and warns her readers about trusting first impressions. The essay focuses on the moral aspects of these scoundrels. It analyses and compares the characters based on the first impressions from others, the events in the novels where their true colors emerge and how they are judged by the characters and the author in the novel. The essay argues that Austen's way of developing the scoundrels enables her to prove a point of morality to her readers, showing us the danger of trusting first impressions and appearances, warning us against the deceptive evil which presents itself disguised in charm and respectability. Thus she guides her readers towards a clearer vision of true worth and good morals - such as honesty and consideration for others - in a way that may be discussed and appreciated by young people of today. In addition, a didactic approach is included, showing how the findings in the esay can be used and interpreted in an English class in Swedish upper-secondary school. It provides a lesson plan based on the findings, and are justified by answering the question "why should we study literature" and "why should we study Jane Austen?". The goal is to form activities that students find both entertaining and motivating. It will show that both scoundrels are well-behaved, handsome and are well-liked by the majority of the characters in the beginning. However, they are also dishonest, selfish and driven by economival and sexual motives. This shows the danger of trusting fist impressions and justifies the reason why they are scoundrels. However, there are differences that differentiate them: Wickham is not able to love or feel remorse, while Willoughby is.

Abstract Title: To adapt, or not to adapt, that is the question – How Swedish companies view cultural differences in Asia and adapt if necessary Authors: Felix Norgren and Markus Bodbacka Supervisor: Selcen Öztürkcan Examiner: Susanne Sandberg Course: 19VT-2FE51E Business Administration III Degree Project with specialization in International Business Problem discussion: The problem regarding this research-subject is that there is not as much recent research as one might think regarding this specific area. The problem is access to recent research made on how Swedish companies adapt to Asian business cultures. Research Question: How do Swedish companies view cultural differences in Asia and adapt if necessary? Purpose:  The main purpose of this study is to identify how companies view cultural differences and adapt if necessary. The purpose is also to provide such good material that companies could benefit from reading it in order to prepare themselves to work in different Asian cultures. Methodology: This is a qualitative study, which is using interviews as the source to collect primary data. The study is done with an inductive approach and based on a case study design. Conclusion: The conclusion is that before having meetings with other cultures, it is always favourable to read and learn as much about the customers culture as possible and if necessary, take a course on how to interact with other cultures. However, interacting with individuals from other cultures face to face is always the best way to learn and it is favourable to travel as much as possible to other cultures in order to learn about them.     Key Words: Culture, relationship, code of conduct, cross-cultural learning.

Abstract:

Analysförfarandet delades upp i två steg.

Abstract:
Thesis (MPhil (Journalism))--University of Stellenbosch, 2008.
With the advent of new communication technologies, traditional journalism has continually had to adjust to new contexts. In 2006, the Western Cape daily newspaper Die Burger established a blogging section as part of its website. Presently j-bloggers (journalists who are bloggers) still work according to Die Burger’s current ethical code of conduct. Yet the establishment of j-blogs at Die Burger has raised a number of questions regarding the ethical conduct of journalists in this medium. This study attempts to show that the mainstream ethical concepts of accuracy, fairness and the use of anonymous sources may be interpreted differently in the medium of blogging and explores the feasibility of a code of conduct for j-bloggers at Die Burger. Die Burger’s code of conduct is compared with various bloggers’ codes of conduct. The study argues that Die Burger’s code of conduct offers more comprehensive guidelines for journalists than most bloggers’ codes. These guidelines include protecting the newspaper’s reading public from harm. However, it was also found that the different interpretations of ethical concepts on blogs need to be considered in a code of conduct for j-bloggers. In this study, the composition of a code of conduct for j-bloggers was discussed with j-bloggers, print journalists and several other stakeholders at Die Burger. The participants in this study argued that a code of conduct for j-bloggers may be feasible but that it should operate in addition to Die Burger’s current code of conduct. Furthermore, this study argues two normative theories of the press – the social responsibility and democratic-participant theories – intersect in a discussion of ethical codes for j-bloggers. Using this theoretical framework, the study aims to describe specific guidelines for the ethical conduct of j-bloggers at Die Burger.

Abstract:

The master's degree thesis contains the analysis of conduct codes: their place and meaning in regulation of illegal and harmful information disseminating in computerized networks. In Lithuania Republic, the problem of self-regulation of conduct codes and their place and meaning in regulation of illegal and harmful information disseminating in computerized networks became of interest comparatively not long ago, but in the countries more experienced in wide Internet usage this problem is nor new and raises quite many discussions. Most countries regulate the contents of information published in computerized networks in one or another way: by means of common regulatory provisions governing public information release or by means of specifically computerized networks-tailored conduct codes. In Lithuania Republic, contrary to legal regulations existing in the European Union, release of illegal and harmful information to computerized networks is regulated so strictly with a little space left for self-regulation by conduct codes.

Abstract:
The Municipal Manager is responsible for the overall financial management of the municipality as requirement of MFMA. However, section 79(1) of the MFMA makes a provision for the municipal manager to delegate the financial management to the senior manager. The legislative requires that all municipalities should appoint a Chief Financial Officer (CFO) who must be a member of the Senior Management of the municipality. The act, furthermore, requires the municipality to establish the budget and treasury office to be headed by the CFO. In 2007, the Minister of Finance released guidelines for the minimum competency requirement regulation of CFOs implemented on the first day of July 2007. According to the literature review, the CFO should move away from being number crunchers to become more visible in strategic and leadership management. Generally, according to the literature review, financial management within local municipalities in Gauteng is not properly managed. This was revealed in the general report on the audit outcomes of local government for the financial year ended 30 June 2003, 2004 and 2005. The summary of these reports shows that the Auditor-General expressed disclaimer of opinion to 50% of the financial statements and 13.1% adverse opinion of the municipalities. The reports further revealed that most of the municipalities do not have effective internal risk management or internal audit departments, late submission of financial statements is rife, and failure to implement newly enacted legislation prevails. Therefore, the municipalities' overall financial management is not well managed. The data gathered from the municipalities by administering questionnaires show that the local municipalities' finances are properly managed and they have effective systems of internal control. The municipalities have internal audit or risk management departments, they have functional audit committees and lastly, they implement recommendations from the Auditor-General's office and internal audit diligently. Information from the Auditor-General's office contradicts the information received from municipalities. The researcher is biased towards accepting the Auditor-General's point of view since the Auditor-General has no reason to paint a good or bad picture about the municipalities. The problem presented is that the municipalities do not have welt-established governance structures in place, in the first place; secondly, the contradiction highlights the perceptions of the people involved with the day-to-day financial management about its effectiveness and the Auditor-General's opinion of it. To overcome the problems, municipalities are advised to include competency assessment in their job selection processes, develop their staff members, establish and implement succession planning, and adhere to the legislation and submission timeframes. It is further recommended that the municipalities should adhere to the policy framework and develop strategies that support enhanced service delivery, as well as to instill energy and thought to overcome loss of skill and expertise due to high staff turnover.

Abstract:
Doctor Legum - LLD
At the heart of this thesis is the notion of Corporate Social Responsibility (CSR), an innovative concept deep-rooted in the globalisation phenomenon. The notion of CSR entails the much-debated duty of businesses, not only to comply with international and local standards in terms of, inter alia, labour rights and working conditions, human rights and environmental protection, but also to be at the forefront of voluntary and uplifting actions geared toward addressing societal issues and concerns. For corporations, it is about moving from the traditional approach of business as an activity with the sole purpose of realising profit towards acknowledging the need to integrate societal and environmental issues and concerns into their business purposes. The thesis examines selected multinational corporations’ (MNC) approaches to CSR as contained in their codes of conduct, in an effort to reach a comprehensive understanding of the purpose, interest and practices of businesses engaging in CSR activities. Particular attention is given to the analysis of labour orientated measures implemented by selected MNCs as they undertake to voluntarily act as proponents of the theory of the necessity of socially responsible businesses. The aim is to comparatively assess the legal dimension and the relevance, in different countries, of these MNC CSR commitments. The first part of the thesis is theoretical and has the purpose to present a comprehensive analysis of CSR against the current legal framework, at a global scale and within the context of selected countries. The thesis will explore the notion of CSR in order to present its definition and characteristics, briefly retrace its history, differentiate it from related and/or similar concepts, and finally assess the extent of its introduction and adaptation into various national and international institutional frameworks. Even though initially addressing the issue of CSR in the current legal framework as a whole, the scope of the thesis will ultimately be reduced to focus only on labour-related aspects of CSR. The aim of the thesis is to assess MNC’s CSR commitments, and subsequently highlight the interaction between CSR, labour and employment legal frameworks (at national and international level) and the effective implementation of labour rights and working conditions as observed in the context of different countries. More importantly, the thesis will also include a comparative analysis of CSR principles included in selected MNC codes of conduct, in order to assess the extent of their compliance with national labour legislation, international labour standards, as well as the standards and principles set by national and international CSR instruments and institutions. The purpose of such an exercise is to thoroughly assess the impact of a national context - in terms of national legal, economic, social and industrial framework - on the legal dimension, and the relevance of MNCs CSR commitments. A crucial argument developed in the thesis refers to the fact that MNC codes of conduct may have the potential to impact on labour rights and working conditions of a MNC across the different countries into which the MNC operates. Finally, considering the fact that as a topic CSR is a potentially controversial subject, it is necessary to point out, from the onset, that the thesis engages with the subject from a critical perspective. The approach therefore entails critically analysing and discussing MNC commitments and practices as observed in different countries, so as to be able to ascertain and comprehend the impact of a national context on the content, the relevance and the legal dimension of MNC codes of conducts.

Abstract:
Among the top Fortune 100 U.S. companies, 97% claim to be global business citizens, primarily based on self-evaluated qualitative criteria. The purpose of this quantitative cross-sectional survey design study was to develop a self-administered survey and apply it to calculate a composite index rating that assesses the maturity level a company has attained toward becoming a global business citizen. The theoretical framework underpinning the research was based on the theory of global business citizenship (GBC) and accompanying four-step implementation process. The GBC theory was utilized to develop the research survey consisting of 1 qualifying question and 22 Likert-type questions. The survey was administered to a qualified random sample of business executives in the United States with 172 usable responses received. These survey questions were then rationalized via exploratory factor analysis (EFA). EFA identified ten key questions with strong eigenvalues and grouped the interrelated items into three factors. Subsequently, the EFA-computed eigenvalues were used to develop a composite index formula. The key findings revealed that only three factors explained 70% of the variance and were named VALUE, IMPLEMENT, and LEARN, as proposed in the GBC theory itself. Questions related to the ANALY step of the GBC theory were not significant. Social change benefits include providing business leaders with a quantitative tool to help communicate to their stakeholders the steps they have achieved toward becoming a global business citizen.

Abstract:
Vietnam has experienced a rapid economic growth during the last decades. However, this rapidgrowth is not only positive. Working conditions in many factories are poor and insufficient wagesare very common. As a response to this and the increased external pressure from stakeholdersregarding Corporate Social Responsibility (CSR), many multinational companies (MNCs) haveconstructed codes of conduct which acts as guidelines for the suppliers. The purpose of this studyis to explain and contribute to an increased understanding of how complying with a code ofconduct set up by an MNC affects a Vietnamese shoe supplier’s view of committing to CSR as away of increasing its profitability. This multiple case study was conducted using a qualitativeresearch approach and is based on data that was gathered from mainly semi-structured interviews. As a way of getting access to Vietnamese suppliers we cooperated with a MNC that had theirproduction outsourced to producers in Vietnam. By using the information in the theoreticalframework we analyzed the empirical findings and found that a collaborative partnership betweensuppliers and MNCs when implementing CSR practices deriving from a code of conduct iscrucial if the supplier don’t have any prior knowledge of such implementation. Benefits thatsuppliers have reaped from committing to CSR are decreased employee turnover, morecommitted workers and improved reputation. We also found that when experiencing thesebenefits gained from committing to CSR the commitment increases even more. The suppliers arealso aware of the importance of CSR practices to achieve long term profitability. In the future,Vietnam may only attract customers that order high quality products. To be able to handle thesenew demands commitment to CSR and new technology are of grave importance. This thesis will continue to be in English.

Results show that attaining a sociallysustainable workplace is complicated, time consuming and requires constant reevaluation ofprogress and processes. The results also reveal differences in opinions between managementand personnel regarding the perceived success and effectiveness of current strategies in use.We would like to continue and expand our research to other organizations in order to createmore effective implementation strategies for promotion long-term social sustainabilitywithin the workplace.

Romby, Helena, and Therese Lindström.

Abstract:
Previous research has examined the effects of ethical leadership in accounting decisions and the general impact of codes of conduct. However, we lack research about the variables combined influences on accounting decisions, which is the aim of this work. This work examines what impact ethical leadership and codes of conduct have when an accounting consultant is confronted with a complex accounting issue. The variables is examined both alone and together. A survey was conducted among authorized accounting consultants in Sweden and 142 respondents participated. The study suggests that ethical leadership and codes of conduct has a mutual influence on ethically charges accounting decisions. Accounting consultants seem to be less likely to record a cost without documentation when there is a weak ethical leadership and they are reminded of the codes of conduct, compared to all other combination of the variables. The effect of codes of conduct have proved to be higher in a weak ethical leadership compared to a strong ethical leadership. Further research could use this study's results concerning the ethical guidelines and focus on why the codes of conduct impact accounting consultants in a non expected way.

Abstract:
The role of brain dominance in the maintenance of learner discipline Recent research in especially Education Law has shown that maintaining discipline in South African schools constitutes a problem for many educators. Research over the last few decades has also indicated a strong link between brain dominance and behaviour. The aim of this research was to establish to what extent the brain dominance of learners and educators influence their attitude towards and perceptions of the implementation of schools' codes of conduct and their resulting behaviour in class. Educators' response to indiscipline was studied against the backdrop of the Constitution, and more specifically the Bill of Rights, as well as other legislation pertaining to learner discipline. The findings revealed a strong link between brain dominance and the behaviour and attitudes of learners and. educators regarding school discipline. It is therefore suggested that the code of conduct should be developed with input from learners and educators from all four quadrants of the brain. Where possible, a measure of flexibility should be included in these documents in the form of incentives for good behaviour and by using discretion when implementing the code of conduct. The insight of educators and learners into the implications of brain dominance was also found to be crucial.

Abstract:
Business schools have been under scrutiny over the last few years with regard to the type of manager leaders that they produce. This is because the business sector has suffered significantly, both financially and in terms of global reputation due to the unethical conduct of those in management and leadership of the organisations. The scandals that rocked the world in recent times, from business entities such as Enron and Tiger Brands provide examples of the unethical behaviour in the day–to–day running of business and further bring forth the essential need for an in–depth study in the behaviour of the manager–leaders. These manager–leaders are said to be graduates from business schools around the world. Researchers and business schools have started to put emphasis on the importance of ethical behaviour in manager–leaders. Business schools in particular have introduced and included business law and ethics as one of the modules in the curriculum of the MBA program so as to inculcate the ethical conduct in the present and emerging manager–leaders in organisations. Therefore, this study is based on the evaluation of the ethical behaviour of the MBA students at a selected business school in South Africa. The subjects of this study (MBA students) were subjected to questionnaires that prompted their convictions with regard to ethical behaviour at personal (individual) level and on company level as well. The results of the study indicated that the MBA students at this selected business school are ethical in behaviour at both individual and company levels, hence complied with principles that are guidelines in the renowned King reports. However, a comparative study with other business schools will be necessary so as to measure the relative ethical behaviour of the MBA students at other business schools.

Ojamäe, Elise, and Linnea Strand.

Full text
Abstract:
Background: Since the end of the 1990’s, code of conducts has become a well-known tool for managing CSR in Swedish companies, and the most common way to ensure compliance is through monitoring. Although, studies have shown that monitoring is mostly raising the issues without providing any sustainable solutions. Companies tend to be reactive, especially the purchasing department. For that reason, there is an ongoing discussion suggesting that companies should focus on the root causes instead, leave the monitoring behind and use greater commitment, incentives and socially responsible actions from the purchasing department. Aim: The purpose of this thesis is to analyze how our chosen companies are working with the compliance of their code of conduct for suppliers, explain which elements that directly and indirectly affect the compliance and compile a guideline for how companies in Sweden can work with their code of conducts in the future. Methodology: This study has a qualitative research approach and a realistic perspective. It is a comparative multiple case study where we through semi-structured interviews with four companies have collected empirical data which we analyzed and compared using our theoretical analysis model. Conclusion: The strategy that focus on durable collaborations, education, training and incentives that is recommended in order to achieve a successful outcome of the code of conduct is found in a very small scale among the case companies. Companies are still mostly using requisites and controls, but there is a small tendency towards the recommended strategy.

The object: The main purpose with this essay is to investigate how sports associations create trust for it´s organization and if they think that a code of conduct can create trust for them. Joint-stock companies use a code for corporate governance to create trust. We want to investigate if the thoughts behind that code can be applied on a code of conduct for sports associations.

Moore, Gregory Allison Business Law &amp Taxation Australian School of Business UNSW. "A theory-based description of Australian franchising regulation." Publisher:University of New South Wales. Business Law & Taxation, 2008. http://handle.unsw.edu.au/1959.4/41223.

Full text
Abstract:
This paper examines franchising regulation in Australia as a case study for the analysis of regulation based on established regulatory theory. A literature review is conducted to establish and critique the theory of regulation based on the four main areas of established theory; regulatory purpose, regulatory strategies, rulemaking and enforcement. Case study data is drawn from primary source material and academic commentary on franchising regulation and presented according to the eras of franchising regulation in Australia, moving from the first proposals for legislation in the 1970s to the prescribed mandatory Franchising Code of Conduct model adopted in 1998 and refinements made to that scheme up to 2006. An analysis is then conducted on each major aspect of Australian franchising regulation using the established theoretical principles and analytical constructs available in the literature. The study concludes that the Franchising Code of Conduct regime, as a culmination of the experience gained and study undertaken in the preceding eras, is characterised by the availability of a broad range of enforcement options from harsh deterrence-oriented measures to more gentle and cooperative compliance-oriented options constituting an effective regulatory pyramid. The effectiveness of the regime is further bolstered by the presence of a credible regulatory strategy pyramid which emphasises the real possibility of escalated intervention, coupled with skilful deployment by the Australian Competition and Consumer Commission as enforcement agency. The principal weakness of the scheme is identified as unnecessarily ambiguous drafting in some areas, which compromises the quality of the otherwise highly transparent ruleset. It is suggested that the choice of regulatory strategy, often a focus of superficial examinations of regulation, is largely irrelevant to the nature of the regulation, with other features such as enforcement strategy, legitimacy, and availability of credible sanctions proving much more important. A proposal for an analytical framework based on the established theory is developed based on the experience of applying that theory to the case study. While this outlined framework assists in broadening focus across the entire regulatory regime to encourage assessment of the component parts, a lack of cohesion and linkage amongst the components highlights a shortcoming in the development of regulatory theory and an opportunity for further research.

Thesis, Paris 2, 2017. http://www.theses.fr/2017PA020031.

Full text
Abstract:
From the seventies, a small group of scientific in NASA convinced American authorities of the dangerousness of orbital debris. At that time already, they warned against the antisatellite weapons tests which exacerbate the phenomenon. These researchers disseminated their knowledge beyond the American borders and beyond the scientific community. In their struggle of recognition, they are helped by the global awareness on sustainable development. As a result, today, almost no citizen in the world ignores the problem of debris in outer space. Thus, an epistemic community made of scientifics, engineers, servicemen, diplomats, academics, students, and citizen arose. Scholars and laymen all together. Thanks to that global awareness, the need for a standard seems to be necessary in order to regulate and secure the space activities. Although it has existed since the conquest of space in a latent way, this norm has never been the object of a consensus between the States allowing reaching a regime. However, from 2007 to 2016, States renew their interest for this norm. But because they don’t agree with each other, the debate creates schematically two opposing camps. This dissertation aims at questioning the American superiority in the 21st century, the role of the international organizations to mitigate the conflicts between States, but also the influence of the latter facing the non-States actors. Similarly, the dissertation tries to assess the role and the influence of the epistemic communities on States and conversely

Abstract:
This dissertation questions whether the current system of journalistic self-regulation in Australia can give effect to ethical journalism given the conceptual paradigms that have informed its understanding of journalism and journalism ethics. It argues the ideological focus of journalistic self-regulation has constrained the current system's ability to encourage ethical journalism. By taking a grounded theory approach to developing an alternative theory of journalism, this study attempts to fill a void in the reform of journalistic self-regulation in Australia by first highlighting the shortfall in recent reviews. It then argues reform must address the ideological focus of the journalism industry. This means looking at the ideologies espoused in the industry codes. It also means looking at the ideologies that frame how values reflected in the codes are interpreted. In summary, my aim in this dissertation is to articulate a praxis-driven theory of journalism by which to examine the suitability of the Australian self-regulatory environment to give effect to ethical journalism. This will be done by: mapping the current system of journalistic self-regulation; distilling the ideological foci of contemporary interpretations of journalism and journalism ethics; postulating an alternative theory of journalism as practice; evaluating the current system of self-regulation in light of the theory of journalism as practice; and recommending an alternative model of self-regulation that takes account of the theory of journalism as practice. The grounded theory approach to this study involves a textual analysis of a representative sample of self-regulatory codes to identify deficiencies in the way philosophical understandings of identity and ethics have been applied to journalism. By highlighting the gaps in the conceptual paradigm that frames the current theories of journalism and journalism ethics, I offer insights into key problems facing industry self-regulation. Given its grounding in substantive data analysis, the theory developed in this study is able to offer significant insights into ways of improving journalistic self-regulation to encourage ethical journalism. By categorising the self-regulatory codes according to ideology, I aim to explain how core journalistic values can be marginalized. Thus, this study aims to reveal problems with the way in which journalism self-regulation has been conceptualised and operationalised. In this way, it uses the tools of meta-ethics and normative ethics to analyse an ethical problem. Thus the grounded theory emerging from this study falls into the conceptual category of applied ethics. This approach offers a flexible methodology that allows the development of an emergent theory based on raw data derived from the various codes that operate within the journalistic self-regulatory environment. The research problem starts broadly, looking at the ability of the current system of journalistic self-regulation to encourage ethical journalism. The focus of the study is on organizational ideology and conceptions of journalism, rather than individual values of journalists. Through a process of constant comparison I will focus the research problem, constructing a theoretical framework to evaluate whether the current system of journalistic self-regulation can encourage ethical journalism. To achieve these objectives, the study will canvass both process (the ability of self-regulation to give effect to ethical journalism) and action (building a theoretical framework for conceptualising reform). A grounded theory approach offers a way of categorising conceptions of journalism and self-regulation allowing me to develop an alternative theory of journalism that promotes a holistic approach to journalism ethics. This study does not purport to offer final solutions to the ethical problems within Australian journalism. It does, however, aim to present an alternative pathway towards reform of journalistic self-regulation in Australia that focuses on encouraging ethical journalism and expanding the theoretical paradigms that shape current approaches to ethics.

Abstract:
In the last years, we are witnessing an increasingly intense process of creating instruments on labor management in the transnational scope by the multinational companies, aimed at confronting from its autonomy to the very diverse needs generated by its integrated functioning at the global scale. Currently, the physiognomy of these instruments is not yet sufficiently defined; there are notable differences between one another, depending on the company that promotes them and function that assigns them. The present paper carries out a systematization of the criteria that have been presiding its construction, as well as the lines of evolution that are drawn through them.

Abstract:
The main task of my master's thesis is to identify the function of the code of conduct in multinational corporations, it's real gain in the proces of solving various situations and the measure of it's implementation into the supply chain. Through the comparison of two codes of conduct of multinational corporations is shown the measure of involvement and efficiency of standards stated in these codes applicable in real business environment. Theoretical part is an introduction needed to gain an overall knowledge about this theme. Main part is dedicated to code of conduct, it's content, categories and meaning in business. Also the business ethics is involved and the demand for implementation it's principals into business practices of multinational corporations. Practical part uses the knowledge gained from my bachelor's thesis about influence of globalisation on multinational corporation Nike, Inc, which are extended by up-to-date information. The choice of european corporation IKEA has the contribution to comparison and evaluation of codes of conduct of two different companies in wide range of aspects. The main effort is according to the collected information and their further analysis to evaluate the purpose and efficiency of code of conduct in everyday use of companies.
