Abstract:
The administrative code of the Republic of Moldova was approved by the Parliament on July 19, 2018 (entered into force on April 1, 2019). One year later, on July 3, 2019, by the Government Emergency Ordinance, no. 57/2019, the Administrative Code of Romania was approved, which entered into force on the date of publication in the Official Gazette of Romania. However, the Administrative Codes of Romania and the Republic of Moldova, although with identical titles, have a different content or object of regulation and are different in their structure. The opinions on administrative codification set out in the Romanian and Moldovan literature are examined in this article. In particular, the issue of the content (object of regulation) of the Administrative Code and the Code of Administrative Procedure is investigated. The article also addresses issues such as the issue of Code priority, the issue of distinguishing between substantial administrative law and the law of administrative procedure. In the author’s opinion, in the administrative field, the object and perimeter of a code can be established starting from the determination of the difference between the material / substantial administrative law and the law of the administrative procedure

Abstract:
The article analyzes the changes made to the Civil Procedure Code of the Russian Federation, the Arbitration Procedure Code of the Russian Federation and the Administrative Code of the Russian Federation by the Federal Law of 26 July 2019 No. 197-FZ, related to the regulation of conciliation procedures. The question is raised as to whether the civil procedural codes should regulate relations on reconciliation and to what extent. Agreement is expressed with those authors who believe that, by their nature, the relations that develop in conciliation procedures between its participants (including in cases where the conciliation procedure is directed by a judge) are not procedural and are not part of the subject of civil procedural law. The non-procedural nature of the relationship between the judicial conciliator and the court in the procedure of judicial conciliation under the Civil Procedure Code of the Russian Federation, the Arbitration Procedure Code of the Russian Federation and the Administrative code of the Russian Federation is substantiated. It is concluded that due to the qualitatively different nature of reconciliation relations from civil procedural relations, as well as their lack of connection with the resolution of a civil case in a certain system of guarantees (civil procedural form), there is no place for articles on individual conciliation procedures among procedural norms. In this regard, it is proposed to either exclude them, or, as an option, transfer them to the appendix to the Civil Procedure Code of the Russian Federation, the Arbitration Procedure Code of the Russian Federation, the Administrative code of the Russian Federation (just as in the Civil Procedure Code of 1964 there was an appendix, in particular, about the arbitration court).

Abstract:
This article presents the problems of administrative fines in the Code of Administrative Procedure. These solutions were introduced to this act in 2017. The amendment to the Code of Administrative Procedure provided for the introduction of a new section (Section VIa), the provisions of which lay down the rules for imposing administrative penalties, ie penalties, cases justifying waiving the imposition of a penalty and granting the public administration authority the prescription, limitation of the imposition and enforcement of the penalty, and also the rules of postponement, payment in installments and cancellation of penalties. This article presents only selected issues of the regulation of imposing administrative fines in the Code of Administrative Procedure.

Abstract:
The article deals with the problem of understanding the administrative process in modern Russia. Discussion about its essence has not stopped in the science of administrative law for many years. There are two main points of view. The administrative process is understood in a narrow sense as a jurisdictional activity and in a broad sense as a set of administrative procedures, administrative jurisdiction and administrative justice. The opinion is expressed that the understanding of the administrative process should be based on the understanding of the subject of administrative law. After the adoption of the Code of Administrative Proceedings of the Russian Federation in our country, a real legal basis appeared for the creation of administrative justice, which resolves disputes between a citizen and the state. The legal nature of administrative justice and administrative jurisdiction is not the same. They belong to various subbranches of administrative law. The situation should be preserved when one part of cases of administrative offenses is considered by courts, and the other - by other bodies of administrative jurisdiction. The proposal to consider cases of administrative offenses in accordance with the norms of the Code of Administrative Proceedings is critically assessed. An attempt to create administrative courts in the Russian Federation is analyzed and evaluated. The experience of creating administrative courts in France and Germany is presented. The reasons why the administrative courts were never created are indicated. Administrative cases are considered by courts of general jurisdiction. An attempt to adopt the Administrative and Administrative Procedure Codes of the Russian Federation is analyzed. The Code of Administrative Proceedings of 2015, on the basis of which administrative cases are considered, is, in fact, the Administrative Procedure Code. The proposal to develop and adopt the Federal Law “On Administrative Procedures” is critically assessed. It is concluded that the administrative process is a judicial procedure for considering cases arising from public legal relations according to the norms of the Code of Administrative Proceedings of the Russian Federation, as well as the activities of bodies of administrative jurisdiction, including the court, to consider cases of administrative offenses in the manner established by the Code of the Russian Federation on Administrative Offenses.

Abstract:
In the article, the author examines the Polish model of administrative procedure, its nature, structure, taking as a basis the work of Javier Barnes in which the scientist identifies three generations of administrative procedure with the elements: (1) procedure for adjudication, (2) rule-making procedure, (3) collaborative – making public policy and implementing procedure.) The model of administrative procedure in Poland is normative as it is enshrined in the Code of Administrative Procedure. After analyzing its provisions, the author came to the conclusion that the Polish model of administrative procedure has a pronounced jurisdictional character, which is indicated by the principles of administrative proceedings, the structure of administrative proceedings. The jurisdictional model of administrative procedure in Poland remains dominant; it is characterized by a clear polarization of roles, with a "powerful sovereign" on the one hand and a subordinate citizen on the other. However, the Code reflects the provisions that indicate the partial appearance in the classical model of the administrative procedure of the elements of the third generation, which is associated with convergence and globalization. Poland's membership in the European Union prompted the legislator to introduce new, additional provisions in the Code of Administrative Procedure, concerning, for example, Administrative European Cooperation Section 8a, the principle of the peaceful settlement of Art. 13, the use of mediation in administrative proceedings Art. 96a. The presence of these elements is aimed at overcoming this division, creating a relationship between the parties, according to the principle of horizontal communication. The nature of the jurisdictional model of the administrative procedure is changing towards the regulation of a wide range of activities of bodies in the public sphere. Establishing a permanent system of communication between bodies, and between bodies and citizens "becomes the goal of the administrative procedure. Such changes are in line with the requirements of European Union legislation and the principles enshrined in the Code of Administrative Procedure.

<p class="Default">The Programme for the Reduction of Bureaucracy launched by the Hungarian government in 2015 has several directions, such as rethinking of the system of administrative organs, reshaping of civil service, simplification of administrative procedures, and fight against administrative silence, as well. New codes on the administrative procedure and on the judicial review of the administrative decisions were passed in 2016 and 2017, and the sectoral regulation has been transformed, as well. The most important change of the sectoral procedural rules was the replacement of procedures for permissions to a simple duty of notification. The authors investigate, if these institutions really help to reduce the burdens citizens and companies have in connection with bureaucracy: whether they are efficient tools against administrative silence and really are improving the situation of the parties <em>vis-à-vis</em> the administration and fostering good administration. They also take a closer look on the newly established action for failure to Act I of 2017 on the Code of Administrative Court Procedure (in force since 2018) intended as an additional tool, as well as its other new institutions addressing the problem of silence of administration.</p>

Cette étude consiste à démontrer que les procédures administratives d’urgence ont entraîné une modification de la conception du rôle du juge administratif : d’une part, par rapport aux libertés fondamentales dont le juge administratif a dû déterminer et encadrer la notion ; d’autre part, par rapport à l’autorité administrative vis-à-vis de laquelle le juge administratif a retiré un pouvoir accru qui lui donne la vigueur d’un juge administrateur. Cette étude est présenté en deux parties on s’attacher, dans une première partie, à montrer comment les procédures d’urgence, mises à sa disposition par la loi du 30 juin 2000, permettent au juge administratif de faire cesser les atteintes aux libertés fondamentales. Dans une deuxième partie, on tentera de mettre en lumière l’évolution du rôle du juge administratif dans ses relations avec l’administration. Les procédures d’urgence ont conduit à l’élargissement de ses pouvoirs, ce qui a entraîné un renforcement de l’autorité du juge administratif par rapport l’administration
This study is aims to demonstrate that the administrative procedures of urgency has led to a redefinition of the role of administrative judge: first, in relation to the fundamental libertie whose the administrative judge had a duty to determine this concept. Secondly, in relation to administrative authority vis-à-vis which the administrative judge withdrew an increased power that gives it the force of a administration judge. This study is presented in two parts: in the first part, we show how the urgency procedures provided by the law N° 2000-597 of 30 June 2000, allows the administrative judge to stop violations of fundamental liberties. In The second part we attempt to highlight the changing role of the administrative judge in its relations with the administration. The urgency procedures have led to the expansion of its powers, which led to a strengthening of the authority of the administrative judge against the administration

The system of precedents established by the Civil Procedure Code bases on the need for integrity and stability of the legal system, as well as on the imperative guarantee of the uniqueness of the decisions set by the courts that have the competence to standardize the jurisprudence. The objective is to ensure that equal cases are treated in the same way, thus fulfilling the fundamental right of equality laid down in the Federal Constitution. That is, to apply precedents is to exercise the jurisdictional activity guided on the coherence of judgments, based on the arguments already established by the high courts, but above all is to bring rationality to the legal system and to the courts avoiding that these decisions be discarded, ignored or disrespected without any plausible reasoning, or reasons for it. Therefore, all those who have the power to judge, even if in an administrative jurisdiction, should adhere to and respect precedents established by the major courts, since they are bound to them by the constitutional principle of efficiency. This principle mandates that the Public Administration achieve the same purpose with the use of fewer resources, that is, applying this principle in judicial activity, the administrative judge must adhere to established precedents, considered public goods, avoiding that a thesis already judged and pacified is ignored or discarded without its due overruling. The present paper aims to demonstrate that the Tax Administrative Courts must follow precedents, because they are bound by Civil Procedure Code, but, above all, by a duty of efficiency, ordered by such principle, which dictates public agents and obliges them to act with rationality in administrative functions and activities, including here the judicial exercise of such courts
A sistemática de precedentes trazida pelo Código de Processo Civil fundamenta-se na necessidade de integridade e de estabilidade do sistema jurídico, bem como na imperiosa garantia de unicidade dos entendimentos firmados pelos tribunais que têm por competência uniformizar a jurisprudência, garantindo-se, assim, que casos iguais sejam tratados da mesma forma, concretizando, por conseguinte, o direito fundamental de igualdade previsto na Constituição Federal. Ou seja, aplicar precedentes é exercer a atividade jurisdicional pautado na coerência dos julgamentos, baseando-se nas teses já firmadas pelos tribunais de competência superior, mas, sobretudo, é trazer racionalidade ao sistema jurídico e aos órgãos judicantes, evitando-se que esses entendimentos pacificados sejam descartados, ignorados ou desrespeitados sem que haja fundamentação plausível ou motivos determinantes para tanto. Logo, todos aqueles que tem o poder-dever de julgar, mesmo que em sede administrativa, devem se pautar e respeitar os precedentes firmados pelas cortes maiores, visto que se encontram vinculados a eles pelo princípio constitucional da eficiência. Tal princípio ordena que a Administração Pública atinja o mesmo fim com a utilização de menos recursos, ou seja, trazendo à atividade jurisdicional, deve o julgador administrativo, por este princípio, aplicar os precedentes firmados, como bens públicos que são, evitando-se que uma tese já julgada e pacificada seja ignorada ou descartada sem a sua devida superação. O presente trabalho objetiva, portanto, demonstrar que os Tribunais Administrativos Tributários devem seguir precedentes, por estarem vinculados à sistemática do Código de Processo Civil, mas, acima de tudo, por um dever de eficiência, ordenado por tal princípio, que pauta os agentes públicos e os obriga a agir com racionalidade no trato das funções e das atividades administrativas, incluindo-se, aqui, o exercício jurisdicional desses tribunais

Abstract:

Local government is arguably the most significant sphere of government to lay citizens, as it is the point of contact of citizens with their government. Local government enables a direct link between the general public and the basic services that they are entitled to by means of their constitutional and legislatively entrenched rights. It is the only sphere of government that allows and encourages face-to-face engagement between citizens and their governors, providing the necessary platform for interaction, contact and communication. It is imperative therefore that this tier of government operate optimally and competently, as it represents a reflection of the operation of government wholly. Research unfortunately illustrates that public perceptions of local government are negative, with levels of trust in local government being substantially lower than those in provincial and national governments. The responsibility for failure to perform would lie squarely on the shoulders of those individuals leading any institution. The leading incumbents driving a municipality are the political and administrative heads, i.e. executive mayor and municipal manager.

Abstract:
This thesis discusses the notion of tax evasion in Rwanda. It looks at the role of tax administration and fiscal codes in Rwanda in the implementation of tax anti-evasion measures in the country. The tax administration and fiscal codes provide opportunities for the Rwandan people to realize a tax evasion free society not only because of the tax administration departments in place to curb tax evasion, the types of taxes, the measures of collection, but also the reasonable fiscal procedure process in tax payment and also in allowing the taxpayer participation in the tax assessment process, an essential component of co-operative taxpayer attitudes for potential tax revenue collections to thrive.
However, this thesis scrutinizes the reality in Rwanda for the extent to which tax administration and tax laws have gone to achieve the goal of curbing tax evasion.
Tax administration measures and fiscal code provisions in place, can not be said to be perfect as at times it is foreign ideas imported into Rwanda, which must be adopted often as a conditionality to that much needed development assistance. This in light of the persistent institutionalized corruption existing in Rwanda, and the reality of public participation in the tax assessment process given the Rwandan culture of evading taxes, makes the anti-evasion process inadequate in Rwanda, thus further "watering down" the sufficiency of the tax law and tax administration as a previously perceived usable strategy for curbing tax evasion. The thesis argues therefore that the tax administration and fiscal codes in curbing tax evasion are limited by existence of these realities unless modifications are made in the implementation of measures against tax evasion in Rwanda.

AbstractThis chapter presents the provisions of Chapter 14 (“Provisions regarding monetary penalties”) of NCSA containing provisions directed at implementing the provisions of Art. 21 of the NIS which obliging Member States to lay down sanctions applicable to infringements of the national provisions adopted pursuant to the NIS Directive and to take all necessary measures to ensure their implementation.Pursuant to the above provision of the NIS Directive, the Polish legislator adopted an appropriate provisions providing for administrative liability for three groups of entities: operators of essential services, digital service providers and (additionally) managers of operators of essential services.To the penalties imposed on the basis of the NCSA, the provisions of the Code of Administrative Procedure apply, which results directly from the content of art. 189a Code of Administrative Procedure.In this case, provisions of NCSA are ‘lex specialis’ and take precedence over codex regulations. On the other hand, however, it is difficult to consider the statutory regulation as complete (in Chapter 14, in principle, only provisions regulating the types of violations and the amount of administrative penalties are provided), hence the need to apply the provisions of the Code of Administrative Procedure.

Abstract:
Accurate determination of the place of preliminary investigation indicates adherence to the principle of legality in criminal proceedings and the achievement of goals on the protection of rights and lawful interests of the affected parties, as well as on protection of individual from wrongful and unfounded accusations and restrictions of their rights and freedoms. Science addresses the general questions pertaining to determination of the place of preliminary investigation, but does not give due attention to realization of discretionary powers of the higher investigating authority to determination of the place of preliminary investigation. The article reveals the essential conditions for application of such power by the investigating authority, and analyzes case law for compliance with these conditions. The conclusion is made that legislation does not contain clear and specific rules for determination of the place of preliminary investigation, including the territorial jurisdiction of advocating for the election or extension of pre-trial detention. The author describes the flaws in legal regulation associated with the possibility of determination of jurisdiction of a case in administrative proceedings, by means of law enforcement decision prior to the emergence of legal situation (for example, before submission of a request for the election or extension of pre-trial detention) by lowering the rank of investigating authority, for example to district level. From the practical perspective, elimination of such flaws should facilitate the proper application of the corresponding legal norm, as well as accurate determination of the place of preliminary investigation.

ASME Section III has been the most important Code for the design and construction of nuclear components for over 30 years in Korea. During that time, some difficulties have been recognized in compliance with the Code due to the differences in industrial practices and regulatory system between Korea and the U.S. In case of NCA (General Requirements for Division 1 and 2), the administrative and procedural requirements have been applied as modified to suit domestic industry practices. For technical aspects, supplemental requirements have been added to ASME Code in order to satisfy regulatory guides. Preheating and PWHT requirements of ASME Section III are slightly different from those of ASME B 31.1. The differences are discussed in this presentation. With the issuance of MOST (Ministry of Science & Technology) notice 96-32 in 1996 regarding KEPIC (Korea Electric Power Industry Code) application, KEPIC MN has been used in selected documents instead of ASME Sec. III. Ulchin 5&6 is the first project that applied to KEPIC. The application of KEPIC - MN has been gradually expanding to the subsequent nuclear projects. For consistent use of KEPIC, some measures for foreign vendors’ application of KEPIC should be considered.

Fluor, a large Engineering, Procurement and Construction contractor, recently renewed its ASME certifications for the construction of nuclear power plants. In preparation for a resurgence of commercial nuclear power plant construction, Fluor Nuclear Power (FNP) Construction Welding Engineers have prepared an electronic field welding program, to be used in conjunction with an automated system for the generation, control and documentation of work packages. The prior generation of nuclear power plants constructed in the US utilized a manual process for controlling field welding activities. The “manual” way of doing business required a relatively large, on-site staff (both technical and administrative) to create, issue, track, and document this work. In addition, the manual process was prone to human error. In an effort to improve this key construction activity and reduce construction costs, the FNP Construction Welding group has prepared an electronic welding program that automatically performs the majority of the work package preparation/documentation tasks previously performed manually. The electronic welding system has been designed to access engineering and construction code information related to welding, process the data through a series of logic-based spreadsheets and automatically populate the work package with welding requirements — preheat, post-weld heat treatment (PWHT), Welding Procedure Specification (WPS), etc. The spreadsheets analyze the engineering data (i.e., base material type, thickness, applicable code, joint design, etc.), in conjunction with construction code rules and Fluor welding practices, to determine appropriate welding requirements. System generated requirements are then automatically entered into the work package. This paper describes the design of the electronic welding program, it’s scope, development and qualification. In addition, preparation and qualification of the spreadsheet logic, that effectively translates specified code welding criteria into work package requirements, will be reviewed. It is believed that this type of system will be needed to successfully construct the next generation of US nuclear power plants.

Korea Electric Power Industry Code (KEPIC), a set of integrated standards applicable to the design, construction and operation of electric power facilities including nuclear power plants, has been developed on the basis of referring to the prevailing U.S. codes and standards which had been applied to the electric power facilities in Korea. KEPIC has been applied to the construction of Ulchin Nuclear Units 5&6 since 1997 as per the endorsement of Ministry of Education, Science and Technology (MEST), and is being completely applied to the construction of Shin-Kori and Shin-Wolsung Nuclear Power Plants (NPPs) in Korea. Although the technical requirements of KEPIC related to design and inspections for pressure vessels have been developed on the basis of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (BPVC), Korea Electric Association (KEA) that is KEPIC maintenance organization is trying to find and improve unreasonable requirements based on the acquired experiences for the continuous construction and operation of NPPs. In the administrative requirements, KEPIC, unlike ASME, adopted not only mechanical field but also electrical field related to NPPs. Furthermore, the qualifying system for services such as Nondestructive Examination, Heat Treatment, Design and Equipment Qualification Organization was adopted to improve safety and reliability for NPPs. In the technical requirements, KEA has been performing betterment study such as pressures for system hydrostatic test, temperatures for Post-Weld Heat Treatment (PWHT) of P-No. 4 materials, counterbore for Pre-Service Inspection (PSI) of elbows in piping systems. The construction method of Steel Plate Concrete (SC) structure studied by Korea Hydro & Nuclear Power Co., Ltd. (KHNP), has been adopted to KEPIC, recently. In the case of inservice NPPs, KEA is trying to establish the equivalent material tables for ASME unassigned materials to solve problems of material during the Repair & Replacement step. KEA is performing development study for Standard Welding Procedure Specification (SWPS) which can be used for production weld without any specific procedure qualification test performed by manufacturers in order to improve reliability and reduce costs. The SWPS will be adopted in KEPIC-MQW Appendix. KEA hopes to collaborate and grow with other Standard Development Organizations (SDOs) through the above efforts.

In the current context information technologies including Internet technologies are the most important factor in providing sustainable social and economic development of the nation. Taking part in implementing government functions they represent a new form of citizens public authorities communication within the bounds of e-government. Offices of State Tax Administration of Ukraine are part of public electronic space and are actively employing Internet technologies in administering their functions. They are represented by hardware and software for information collection, processing, transfer and storage, and also serve as active communication medium with taxpayers. Official website of tax administration of Ukraine has 20 sections, 163 sub-sections and more than 400 heads in Ukrainian, Russian and English languages. In conditions of taxation system reforming it provides on-line access to live information and is efficient tool in forming optimal ties with taxpayers providing feedback in discussing topical taxation questions. Introduction into effect of the Tax Code has made fundamental changes in tax procedure and administration methods. Procedure of submitting tax accounts in electronic form through Internet has been improved. It enables to aggregate taxpayers review data and tax offices accounting data into unified technological process. The paper gives analysis of the influence of IT on improving efficiency of tax administration in the current context and assessment of the prospects for its further improvement.

This paper presents a mooring design procedure of a floating offshore wind turbine. The offshore environment data of Jeju south sea collected from Korea Hydrographic and Oceanographic Administration (KHOA) are used as environmental conditions for hydrodynamic analysis. A semi-submersible floating wind turbine system is considered based on Offshore Code Comparison Collaborative Continuation (OC4) DeepCWind platform and the National Renewable Energy Laboratory (NREL) 5MW class wind turbine. Catenary mooring with studless chain is chosen as the mooring system. Important design decisions such as how large the nominal sizes are, how long the mooring lines are, how far the anchor points are located, are demonstrated in detail. Considering ultimate limit state and fatigue limit state based on 100-year return period and 50 year design life, respectively, long-term predictions of breaking strength and fatigue are performed.

Employing numerical prediction models can be a powerful tool for forecasting air quality and visibility hazards related to dust events. However, these numerical models are sensitive to surface conditions. Roughness features (e.g., rocks, vegetation, furrows, etc.) that shelter or attenuate wind flow over the soil surface affect the magnitude and spatial distribution of dust emission. To aide in simulating the emission phase of dust transport, we used a previously published albedo-based drag partition parameterization to better represent the component of wind friction speed affecting the immediate soil sur-face. This report serves as a guide for integrating this parameterization into the Weather Research and Forecasting with Chemistry (WRF-Chem) model. We include the procedure for preprocessing the required input data, as well as the code modifications for the Air Force Weather Agency (AFWA) dust emission module. In addition, we provide an example demonstration of output data from a simulation of a dust event that occurred in the Southwestern United States, which incorporates use of the drag partition.
