Coalition agreements are resolutions which come into existence for a legislative period fixed by the agreement of two or more political parties. These parties are part of a ‘parliament’, which by a majority vote decides to form and support a government. Such practice, however, can be carried out only by a ‘hung parliament’ consisting of several political parties, each enjoying less than an evident absolute majority, and thus unable to form a government membered by a single political party.Once in existence, the coalition stands as agreed by the parties forming the government. The party members are obliged to co-operate in order to promote the interests of the government of the ‘multi-party-state’, in accordance with the constitution.

Abstract This paper describes the gender system of the Ubangi language Mba, which can be characterized by the co-existence of two different classification systems. The ‘formal agreement’ system is tightly bound with the nominal deriflection system, while the ‘semantic agreement’ system, by contrast, emanates from a tripartite distinction in the language made between masculine humans, other animates, and inanimates. Whereas formal agreement is manifested on different elements that modify the head noun, the semantic agreement system operates in the pronominal domain, mostly outside the noun phrase.

Abstract:
Legal relation between user and provider, that occurs during the process of signing the agreement on the procurement of goods and services until the process of terminating the agreement, is called civil law relation which is specified as contractual relation. In the process of user and service user agreement, the government is represented by Budget User or Proxy or Commitment Officer (CO) or Procurement Official as an individual. Regarding this matter, the research problem is on how the legal standing of work order by the existence the public procurement agreement and on how the contractual relation between the Commitment Officer (CO) and the procurement of goods and services for the procurement of public goods at the Education Office of Padang City. This research employs empirical juridical approach. Based on the result of the research, it is found that the legal standing of work order, in addition to part of the contract, is also the decision of state administration in carrying out public authority in the form of procurement of goods and services which is violated through the state finance. In the meantime, the contractual relation of the parties is basically the same as the contract or agreement in general; the contract is binding on the parties such as laws in a lawful relationship and obligations.

Abstract. During the ARK XXV 1+2 expedition in the Arctic Ocean carried out in June–July 2010 aboard the R/V Polarstern, we measured carbon monoxide (CO), non-methane hydrocarbons (NMHC) and phytoplankton pigments at the sea surface and down to a depth of 100 m. The CO and NMHC sea-surface concentrations were highly variable; CO, propene and isoprene levels ranged from 0.6 to 17.5 nmol l−1, 1 to 322 pmol l−1 and 1 to 541 pmol l−1, respectively. The CO and alkene concentrations were enhanced in polar waters off of Greenland, which were more stratified because of ice melting and richer in chromophoric dissolved organic matter (CDOM) than typical North Atlantic waters. The spatial distribution of the surface concentrations of CO was consistent with our current understanding of CO-induced UV photo-production in the sea. The vertical distributions of the CO and alkenes followed the trend of light penetration, with the concentrations displaying a relatively regular exponential decrease down to non-measurable values below 50 m. However, no diurnal variations of CO or alkene concentrations were observed in the stratified and irradiated surface layers. This finding suggests that the production and removal processes of CO and alkenes were tightly coupled. We tentatively determined a first-order rate constant for the microbial consumption of CO of 0.5 d−1, which is in agreement with previous studies. On several occasions, we observed the existence of subsurface CO maxima at the level of the deep chlorophyll maximum. This finding represents field evidence for the existence of a non-photochemical CO production pathway, most likely of phytoplanktonic origin. The corresponding production rates normalized to the chlorophyll content were in the range of those estimated from laboratory experiments. In general, the vertical distributions of isoprene followed that of the phytoplankton biomass. Hence, oceanic data support the existence of biological production of CO and isoprene in the Arctic Ocean.

Banking products are inseparable from the existence of an agreement between the Bank and the customer, as stipulated in Article 1338 paragraph (3) of the Civil Code, one of the requirements that must be met in applying the principle of freedom of contract is the good faith of the party making the agreement. Good faith in the implementation stage of the agreement is propriety, where the principle applies equally to both conventional and Sharia banking systems, one of the concrete forms of which is to provide clear information to customers. In this case, it turns out that the Bank Aceh product, namely the Bank Aceh Co-Brand Bank Mandiri credit card, does not provide clear information to customers that the products they use use conventional principles and have a time period. So that the legal problem is how the legal protection for customers who hold Sharia Card. The research was carried out using the empirical juridical research method using a statute approach. The results of the research show that for 3 years according to the time period agreed by the parties in the agreement of the Bank Aceh Co-Brand Credit Card, Bank Mandiri did not explain conversion problems, including ownership of databases, documents and rights, legal ownership of Bank Aceh data also gave to the Bank. Mandiri, as referred to in Article 5 paragraph (5.1.) Number 1 states that, "Bank Aceh is the legal owner of the Bank Aceh customer database provided to Bank Mandiri in connection with the cooperation as stipulated in this Agreement" this should be and is related to changes to the system of conventional to be shari'ah must be informed to the customer.

The key for the existence of magnetic induced reorientation is strong magnetocrystalline anisotropy, i.e., the coupling between ferroelastic and ferromagnetic ordering. To increase the transformation temperatures and thus functionality, various elemental alloying in Ni-Mn-Ga is tried. We analyzed more than twenty polycrystalline alloys alloyed by small amount (up to 5atom%) of transitional metals Co, Fe, Ni, and Cu for the value of magnetic anisotropy in search of general trends with alloying. In agreement with previous reports, we found that maximum anisotropy occurs at stoichiometric Ni2MnGa and any alloying decreases its value. The strongest decrease of the anisotropy is observed in the case where the alloyed elements substitute Ga.

We report experimental and theoretical studies of spin dynamics in lattice structures of permalloy (Ni80Fe20) nano-ellipses, with four different types of networks including honeycomb and square lattices. The lattices are patterned at the center line of the co-planar wave guide and consist of non-contacting or contacting ellipses. Micromagnetic simulations show excellent agreement with the broadband ferromagnetic resonance (FMR) experimental results. We find the existence of a spin-wave mode localized in the vertex region of the contacting nano-ellipse network. Our finding has important implications when designing an artificial spin ice (ASI) network for functional magnonics.

AbstractGeographical indications are a kind of intellectual property required to be protected under the TRIPS Agreement of the WTO. In order to fulfil its WTO obligations, China started to protect geographical indications even before it was formally admitted to the WTO. At present, geographical indications can be protected in Chinese law through one or both of the following ways: trademark registration pursuant to the Trademark Law, and the registration of special labels bearing geographical indications. However, internal problems exist within both of these systems, and the co-existence of the systems also creates conflicts. This article analyses these problems and proposes ways of resolving them.

Gli accordi di coesistenza sono strumenti molto diffusi per la composizione di controversie attuali o potenziali. Presentano tuttavia ancora molti interrogativi irrisolti. Il lavoro analizza alcune tematiche chiave che hanno interessato o che tuttora interessano gli accordi di coesistenza, considerando in primo luogo il punto di vista dell’ordinamento italiano, facendo anche ricorso alla comparazione con l’esperienza e le soluzioni offerte dagli ordinamenti di altri paesi. Viene in primo luogo analizzato il tema della validità degli accordi di coesistenza: un tempo considerati nulli, sono stati successivamente riconosciuti validi sia dalla dottrina che dalla giurisprudenza, con prospettazioni poi assecondate anche dal legislatore. Viene inoltre analizzato il contenuto tipico degli accordi di coesistenza, con una rassegna delle principali obbligazioni (limitazioni merceologiche, spartizioni territoriali, modifiche all’aspetto grafico o denominativo del segno, etc.), e sono individuati i profili critici sui quali più frequentemente le parti possono trovarsi successivamente a discutere. È infatti noto l’adagio secondo cui gli accordi di coesistenza sarebbero i sistemi più diffusi per risolvere controversie attuali, rinviando la lite a controversie future. Il lavoro approfondisce inoltre il tema della rilevanza degli accordi di coesistenza rispetto ai terzi, e i problemi che possono scaturire dalla qualificazione giuridica degli accordi di coesistenza quali i contratti aventi efficacia meramente obbligatoria, e quindi vincolanti solo per le parti che lo hanno sottoscritto. Infine, viene esaminato l’atteggiamento dell’EUIPO e dell’UIBM rispetto agli accordi di coesistenza, nello specifico nell’ambito delle procedure di opposizione. Nell’ordinamento italiano il tema è ancora pressoché inesplorato, e risulta solo un caso portato all’attenzione dell’UIBM che ha avuto esiti opposti nei due gradi di giudizio davanti alla Divisione di Opposizione e alla Commissione Ricorsi.
Trademark co-existence agreements are very popular tools to avoid/settle trademark disputes. However, many questions concerning these agreements remain unanswered. This thesis explores some of the most relevant issues from an Italian legal standpoint and the solutions offered by other countries. The thesis starts by analysing the issue of the validity of co-existence agreements (they were once considered void, were then accepted as valid by some courts and then finally also by the legislator). The thesis then analyses the typical content of co-existence agreements, with an overview of the main provisions (limitation to products and services, territorial divisions, modifications to the signs, etc.), with a focus on some wording that the parties may have further discussions on. Also examined is the relationship between co-existence agreements and third parties and the issues that can arise from the legal qualification of co-existence agreements as being binding only on the parties to it. The thesis closes with an analysis of the impact of co-existence agreements in opposition proceedings by examining the European and Italian trademark offices’ main caselaw.

This chapter explains: (1) Locke’s definition of knowledge as idea-agreement; (2) his four species of knowledge— identity/diversity, relation, co-existence/necessary connection, real existence; (3) his three degrees of knowledge—intuitive, demonstrative, sensitive; (4) his view of the extent of knowledge for each species; and (5) his view about the reality of knowledge. It notes that the first three species of knowledge cover mostly generalizations, whereas the last species covers existence claims. It discusses the extent of knowledge in each of the first three species. It explains why Locke thinks that knowledge of co-existence (which is knowledge of substances’ properties) is “very small,” leaving sensitive knowledge for the last two chapters. It argues that although Locke’s discussion of the reality of knowledge accommodates mathematical and possibly moral generalizations well enough, it does not fit laws of science, and misleadingly invites us to think of them as a priori truths rather than empirical truths.

Value creation and agreement with others create the central core of social life. It is the main feature of how we manage to co-exist and somehow tame that selfish beast lying in all of us. We know how to create comfort zones with selected others, which can quickly turn into affective cliques, the exclusive social bubbles where comfort zones are shared. The central questions are, Why and who are those selected to share comfort zones, and who are those accepted within a particular exclusive bubble? Inversely, who are those who are rejected? Those are perennial psychological questions that need to be addressed if we want to understand our morals, in particular, our moral acrobatics. Universally, we strive toward the co-construction of shared comfort zones, what we might refer to as harmonious co-existence with some, possibly the largest possible number of people, yet always by the necessary exclusion of others—those subjectively deemed incapable or not willing to share with the in-group.

Abstract This chapter addresses the relationship between intellectual property rights (IPRs) and trade through the lens of the international, and controversial, protection of geographical indications (GIs). This methodological choice—focusing on a specific IP topic instead of multiple rights—is not only due to the wording limitations of the chapter, but also to the fact that the international regulation of GIs well illustrates the changes, successes and challenges of the international IP system, at the multilateral, regional and bilateral levels. In particular, this chapter recounts how the international system of GI protection developed across several periods. At first, GIs were protected at the multilateral level, but only by a small number of countries. Then, in the 1990s, the TRIPS Agreement included GIs into the global IP agenda. At the turn of the century, however, GI negotiations shifted—even more than other IPRs—to regional and bilateral FTAs. Still, multilateralism showed its resilience precisely with the revisions of a GI agreement, the Geneva Act of the Lisbon Agreement, in 2015. Ultimately, this chapter supports that the main take away of the journey across international GI protection is that the international IP landscape has become more complex and multilayered and the ‘new normal’ relationship between IPRs and trade is the co-existence and combination of multilateralism, bilateralism and regionalism.

The “Eurasian” project of integration is observed in its transformation from being based on the post-Soviet memory toward economically beneficial cooperation. Still the Eurasian Economic Union is seen as vague in its goals and instruments, relying on the approach to economic integration with the reference to the common past, memories and identity.

In this paper we study a fractional order model for malaria transmission. It is considered the integer order model proposed by Chitnis et al [1] and we generalize it up to become a fractional model. The new model is simulated for distinct values of the fractional order. Are considered two initial conditions and a set of parameter values satisfying a value of the reproduction number, R0, less than one, for the integer model. In this case, there is co-existence of a stable disease free equilibrium and an endemic equilibrium. The results are in agreement with the integer order model and reveal that we can extend the dynamical evolution up to new types of transients. Future work will focus on analytically prove some of the results obtained.

Prediction of the flow in the cavity between a rotating cone and an outer stationary cone with and without throughflow is considered. A momentum-integral method and a finite difference method for solution of the Reynolds-averaged Navier-Stokes equations with a mixing-length model of turbulence are applied. These two methods have previously been validated for flow between co-rotating and rotor-stator disc systems, but have not been properly tested for conical systems. Both methods have been evaluated by comparing predictions with the experimental measurements of other workers. There is good agreement for cone half angles greater than or equal to 60’ but discrepancies are evident for smaller angles. ‘Taylor-type’ vortices, the existence of which has been postulated by other workers and which are not captured by the present steady, axisymmetric models, may contribute to these discrepancies.

Abstract Previous analytical studies of Centrifugal Pendulum Vibration Absorber (CPVA) systems have focused on the dynamics of either a single absorber mass or multiple absorber masses moving along very special paths. In this paper, an approach is taken that allows one to investigate the dynamics of multi-absorber systems that have quite general paths for the absorber masses, including those used in practice. Of particular interest here are the existence and stability of certain classes of non-unison responses, including those in which the amplitude of a sub-group of absorbers is larger than the expected unison response. It is shown via the method of averaging that these steady state responses may exist and be stable for certain types of paths, including the commonly-used mistuned circular path. Furthermore, it is shown that these responses can co-exist with a stable unison response, even for very small torque levels. The analytical results are compared with numerical simulations and good agreement is found.

Abstract:
Sydney/Sandia bluff-body flame series [1] has been world-widely studied based on a simple-geometry bluff-body. This study focuses on a turbulent piloted non-premixed methane jet flame with circular-disc which is used in a humid-air combustion chamber without a swirler. Large eddy simulation has been performed to investigate the flow features. Meanwhile, in order to validate the simulation results, an experimental study is also conducted, where the instantaneous velocity and temperature fields are measured using PIV and high temperature thermocouples, respectively. Compared to Sydney/Sandia flame series, the enlarged simulation area effectively eliminates the boundary effects on flow field. Comparisons with experimental data also show that for high resolution of grids, comparatively good agreement is obtained for the flow field. Unlike Sydney/Sandia flame series, central jet tends to break up early in this case because of the existence of the circular disc. It has also been found that the shear layer between the co-flow and the bluff-body wake is captured by LES as well as by PIV. Because of the difference in geometry between Sydney/Sandia and circular-disc bluff-bodies, it needs to be further studied how to apply the conclusions based on the former to the latter. However, current and future LES and experimental study can help to illustrate the tradeoffs among the degree of swirl and the choice of bluff-body shapes in devices such as industrial burners and gas turbines.
