Full textEveryone is free to dispose of their assets as they wish, in compliance with public order. Then they are free to give all or part of their assets. It is traditionally and widely accepted that a legal action follows the substantial subjective right to which it is linked, as a satellite. It may be complex to apprehend the interest of a transfer of legal action without the substantial subjective right to which it is linked, as it may be difficult to understand the use of a satellite with no planet to orbit around. Legal actions are not considered an asset, which makes the understanding of its transfer without the substantial subjective right to which it is linked, more difficult to apprehend. Even though it is complex to understand, this transfer may be of interest. The one who gives their legal action will not have to bear the costs of a trial. This is of interest to them especially if they are not entitled to legal aid or if they don't have legal expenses insurance. As third-party funding in Common law countries, the one who receives the legal action may charge its remuneration on a percentage taken on the result of the trial. Then the giver will avoid the costs of going to court.A review of current substantive law forces us to recognize the existence of cases of transfer of legal actions, with or without the substantive subjective right to which it is linked, with or without the consent of its holder. This present study aims to present a critical view of these cases of transfer of legal actions and to highlight specific constraints of the transfer of legal action without the substantial subjective right to which it is linked
Öcalan, Özel Sila. "University-industry interactions : understanding university licensing strategies and beyond." Thesis, Strasbourg, 2018. http://www.theses.fr/2018STRAB009/document.
Full textThis thesis primarily focuses on university licensing. To understand the social impact of the university licensing strategies, we examine the link between the degree of exclusivity of licenses and the various characteristics of the licensed inventions. The theoretical and empirical findings of our research suggest that the practices of university technology transfer offices (TTOs) may not always be optimal, underlying the fact that there may still be room for the improvement. We also suggest that, when the innovations are sequential, universities might introduce alternative open source licensing (OSL) strategies. Furthermore, we expand our study by examining the dynamic interactions between various formal and informal channels of transfer. Our longitudinal qualitative methodology suggests that, dynamic interaction creates a strong cumulative effect with respect to the research valorization activity and reinforces the collective dimension of valorization

Full textThe WAEMU countries, long hostile to foreign direct investment, under the combined effect of the globalization of the economy and the pressure of the institutions of Brettons Woods, have in the one hand, favored an internal access to International financial flows and on the other hand, offered tax incentives to multinationals. Thanks to financial liberalization and the prevailing economic ideology, the multinationals, by various subterfuges and taking advantage also of the institutional and organizational handicaps of the respective tax administrations of the member countries of the UEMOA space, escape their fiscal responsibilities towards these states. In order to reduce the harmful effects of tax evasion by multinationals, WAEMU countries must place particular emphasis on the modernization of their tax administrations on the one hand, and on the other hand, to include in all their agreements tax rules, anti-abuse clauses. Finally, these states must strengthen the fight against tax evasion by concerted action based on tax cooperation in the context of administrative assistance
Chen, Victor. "Synthèse et évaluations biologiques de strigolactones, nouvelle classe d'hormones végétales." Thesis, Paris 11, 2011. http://www.theses.fr/2011PA112117/document.
Full textThis Ph.D. work has been centred on the elaboration of a new synthetic strategy in goal to obtain analogues of natural strigolactones, apocarotenoids with various biological activities of agronomic interests: chemical mediators implicated in the endomycorrhizal symbiosis and a new class of plant hormone controlling the plant architecture. The synthetic strategy is based on the sequence of two key reactions, which are ring closing metathesis (RCM) and atom transfer radical cyclisation (ATRC). First, a rapid and efficient access to the synthetic precursors has been developed and after optimisation of the RCM / ATRC sequence, several analogues functionnalised at the C4 position were obtained after judicious steps. Other bioisoters were obtained with variations on the C ring. On the basis of the elaborated synthetic pathway, the first asymmetric synthesis of Solanacol was successfully achieved conducting to the determination of the relative stereochemistry at C2’ position and its absolute configuration. The biological evaluations of the synthesized molecules in the different models were also described

Full textUp until the order of 23 March 2006 on security rights, a creditor aiming at realizing his surety had to resort to the procedures of execution available to any creditor in order to implement his general right of pledge. The effects of the real surety would manifest only after the execution sale of the encumbered property, through the preferential satisfaction of the creditor during the proceedings of the price distribution. The 2006 reform of the law of security rights has altered this situation by generalizing the judicial attribution and by legalizing the conventional attribution of the encumbered property. These modes of realization are deemed to be simpler and faster than the traditional enforcement proceedings, but also more efficient to shut out the other competing secured creditors. From now on, the creditor benefiting from a real surety is favoured as soon as he exercises his rights against the defaulting debtor. In order to exercise his power of constraint, he may rely on all the enforcement proceedings that are specific to the real surety. The legislator has carefully provided guidelines to use these attribution techniques to protect the interests of the debtor. However, the legal framework applicable to these modes of realization deserves to be adjusted in order to improve their legal certainty, their efficiency, and therefore their attractiveness. The effects of these modes of realization against the competing secured creditors of the recipient are not completely clear. Attribution is often presented as a technique that ensures the plaintiff an exclusive satisfaction, while the competing creditors’ claims are redirected on a hypothetical consigned remainder. Although the other creditors cannot take part in the procedure, nothing justifies that their rights be undermined. It is therefore important to determine how to reconcile the optional attribution of the encumbered property and the rights of the competing secured creditors

Full textExperimental studies were conducted with high-intermediate and advanced learners of Japanese (15 English speakers and 18 Korean speakers). Tests examined the learners' knowledge of the two grammatical properties in Japanese---namely, the lack of wh-movement and the presence of pro. Korean is different from English but similar to Japanese with respect to the parameters in question. Following FTFA, it is hypothesized that English-speaking learners initially transfer their L1 values, and that eventually they are able to switch parameters to the L2 values by accessing UG. The results of several tasks (including interpretation tasks and judgment tasks) confirm this hypothesis; while Korean speakers generally performed well irrespective of proficiency levels, English-speaking intermediate learners transferred their L1 values, failing to accept grammatical Japanese sentences that are not possible in English. English-speaking advanced learners, on the other hand, performed better than intermediate learners, and exhibited evidence that they had acquired the two properties of Japanese, supporting FTFA.

Full textThis research is aimed at the specification of the knowledge of a cognitive remediation method (workshop of logic reasoning, in French: A. R. L. ) in different subjects, taught in the 1st form, to pupils having difficulty with mastering intellectual operations. The study was carried out on an experimental group of a hundred pupils (g. E. ) and with a pilot group of a hundred pupils, paired according to the results obtained at the pre-test e. C. D. L. (collective scale of logic development). The two groups took the e. C. D. L. Pre and post test, as well as disciplinary tests. The exercises, in the different subjects, were intended to measure the transfer immediately after cognition (coaching transfer) of each intellectual operation. The results are based on several levels and types of transfer, established according to the closeness of the exercises in relation to those already studied during the A. R. L. ; ranging from the type of intellectual operation to their level and the disciplinary knowledge necessary. A questionnaire, intended for the teachers, indicated their opinions of the method and their willingness to transfer its principles in day-to-day teaching. Another questionnaire, given to the pupils, was intended to demonstrate their experience of the cognition and their eventual awareness of a learning transfer linked to the A. R. L. In the subjects

Full textAminoacyl-tRNA synthetases are a family of enzymes essential for translation. AARSs catalyse the attachment of aminoacids to their cognate tRNAs. For the aminoacylation reaction, they use aminoacids, tRNA and ATP. Furthermore, AARSs are ubiquitous in all kingdoms and are a good witness of the complexity of evolution. In this work, we report two structural studies of two class I AARSs: ArgRS from E. Coli and LeuRS from A. Aeolicus. ArgRS is an AARS which can discriminate 4 cognate isoacceptor tRNAs in E. Coli. Unless ArgRS form yeast, this enzyme need to bind properly the strong identity element A20 of tRNA. After a global view of evolution of ArgRSs in 140 organisms, we present here first crystals for free form and enzyme bound to the major tRNA of E. Coli. LeuRS from A. Aeolicus is a particular LeuRS. In all others organism, this enzyme is a monomer. In this thermopile bacteria, LeuRS is split in two parts, a and ß, and the heterodimer aß is functionally similar to a canonical monomer. Also, we have shown two oligomeric active forms for this enzyme aß et (aß)2. Now, we have obtain well diffracting crystals of the free form and we hope to get phases in a soon future

Full textThis thesis is developed in the framework of the symbolic analysis of security protocols. The contributions are represented by decidability and transfer results in the following directions which are major topics in protocol verification: - treatment of the cryptographic primitives: CBC encryption, blind signatures; - security properties: strong secrecy, existence of key cycles; - approaches for protocol security: construction of the secure protocols. Thus, we showed the decidability (on the one hand) of the existence of key cycles for a bounded number of sessions using a generalized constraint system approach, and (on the other hand) of secrecy for protocols using the CBC encryption or blind signatures for an unbounded number of sessions by using a refined resolution strategy on a new fragment of Horn clauses. We also transferred protocol security from a weak framework towards a stronger framework in the following directions. On the one hand, we showed that a weak property of secrecy (i.e. reachability-based secrecy) implies under certain well-motivated assumptions a stronger secrecy property (i.e. equivalence-based secrecy). On the other hand, we built protocols secure against active adversaries considering an unbounded number of sessions, by transforming protocols which are secure in a non-adversarial setting

Full textThis thesis investigates the theoretical and numerical analysis of coupled radiative conductive heat transfer in a semi-transparent, gray and non-scattering 2D medium. This two heat transfer modes are described by the radiative transfer equation (RTE) and the nonlinear heat equation (NHE). We proved the existence and uniqueness of the solution of coupled systems with homogeneous Dirichlet boundary conditions using the fixed-point theorem. Moreover, we developed a useful algorithm to simulate the temperature in the medium. We used the quadrature $S_{N}$ for the angular discretization of the RTE. The spatial discretization of RTE was made by the discontinuous Galerkin method (DG) and the finite element method for the non-linear heat equation. We have shown the convergence and the stability of the coupled numerical scheme using the discrete fixed point. The discrète model obtained after an approximation allowed us to do the analysis and synthesis of state estimators and feedback control design for stabilization of the system. Thanks to the special structure of the model and using the Differential Mean Value Theorem (DMVT), we proposed a reduced order observer and we construct a gain matrix, which ensures the exponential stability of the proposed observer and guarantees the boundedness of the estimate vector. An extension to $\mathcal{H}_{\infty}$ filtering is also provided. We have extended the reduced order approach in the case of the observer-based controller and we proved the exponential stability under the control feedback law. Similarly, an extension to $\mathcal{H}_{\infty}$ filtering is also provided. The obtained results were validated through several numerical simulations

Full textAntigen-presenting cells (APCs) are central in the processes of T cell immunization or T cell tolerance but the consequences of transducing this heterogenous population of cells have remained insufficiently explored. My PhD work consisted of studying in mice how gene transfer can be specifically directed to the various populations of MHC-F APCs in vivo. Lentiviral vector permitting cell-specific entry targeting or transcriptional regulation were used to target and distinguish various types of APCs. Intravenous injections of lentiviral vectors targeting MHC-II+ cells in mice showed preferential DC targeting followed by the initiation of a robust immunization. However, we also found that this vector also targeted non-hematopoietic MHC-II+ APCs, recently described as tolerogenic cells. When the transgene is only expressed in these non-hematopoietic MHC-II+ APCs cells through the use of regulatory sequences, we observed transgene-specific immunomodulation leading to impaired functionality of effector CD8 T cells. Thus, targeting gene transfer into specific APC is feasible and can result in opposite immune responses, with potential applications in vaccination or tolerance induction

Full textThis doctoral research work is embedded in the field of language didactics and is equally based on the linguistics and cognitive theoretical fields. Its main goal is to study the introduction of pluralistic approaches based on unknown languages (PAUL) within the English class, at lower secondary school. It seeks to understand the effects of such a change of knowledge on the actors of the pedagogical relationship (student and teacher). A quasi-experiment was conducted in 2011-2012 in five year 7 and four year 9 forms. Students, in groups of four, were successively confronted to three unknown languages (Dutch, Italian and Finnish). They were asked to solve metasemantic, metasyntactic or metaphonological problems in turn, for each of these languages. This doctoral work first explores the institutional and theoretical framework. Then, it presents the methodological framework so as to be able to analyze the effects of the change of the knowledge parameter which has become multilingual, both on the students and the teachers. When looking into the effects of PAUL on the Knowledge-Teacher relationship, we observe that it enables teachers to better apprehend concepts such as problem-solving, conceptualisation, learning strategies and competence. The didactic transposition is hence modified: teachers have gradually been led to develop teaching sequences with higher standards giving more space to the student. The study of the Teacher-Student relationship highlights a change in practice, mainly due to the implementation of group work. The role of the teacher is then revised: he becomes a facilitator of the collaborative learning. Finally, the analysis of the Knowledge-Student relationship underlines the necessary awareness that leads to the development of multilingual competences through the implementation of learning strategies which appear to be transferable to the study of L2

The present work describes the solution of a class of elliptical-parabolic diffusiveconvective problems, on unconventional geometries, employing the Generalized Integral Transform Technique (GITT). In order to facilitate the analytical treatment and the application of the boundary conditions, a Conformal Transform (CT) is used to change the domain into a more suitable coordinate system, just before GITT is to be applied. First of all, using this procedure, the hydrodynamic problem of fully developed Newtonian laminar flow inside ducts is analyzed. In order to obtain the velocity field, GITT is applied on the momentum equation. Interesting hydrodynamic parameters, such as: maximum and minimum velocity values, Fanning friction and Hagenbach factors, Poiseuille number, hydrodynamic entry length, as well as pressure loss, are evaluated for several geometries. Following that, diffusive-convective problems are studied in relationship to the heat transfer in hydrodynamically fully developed and thermally non-developed Newtonian laminar flow inside ducts under Dirichlet boundary conditions, considering uniform temperature entrance profile. In order to obtain the temperature field, GITT is applied on the energy equation, evaluating the relevant parameters: bulk mean temperature, average and local Nusselt numbers and thermal entry length. The results are compared, as much as possible, with the parameter values available in the literature.

Full textAcquired class C b-lactamases (AmpC) are responsible for the resistance to third-generation cephalosporins in Enterobacteriaceae. Among the six clusters of acquired cephalosporinases reported in the world, three are emerging in the Paris area, mostly in Klebsiella pneumoniae and in Escherichia coli : the enzymes DHA-1 originating from Morganella morganii, ACC-1 originating from Hafnia alvei and CMY originating from Citrobacter freundii. Acquired cephalosporinases are encoded by ampC gene, mostly plasmid-mediated. Several genetic elements are involved in the mobilization of blaDHA-1, blaACC-1 and blaCMY : insertions sequences ISCR1 associated to a complex integron, or ISEcp1. Then, different genetic rearrangements around ampC may explain the variability of ampC organization : insertion sequence IS26, notably, could have been involved in the stabilization of ampC on a mobile genetic element

Full textAs part of the project "Transfers of Learning", the data and methodology of which we have used, this thesis proposes to analyze the contribution of language awareness activities and metalinguistic awareness in classroom activities of Songhay-French bilingual schools. In its development, it has relied on theories of bilingualism, teaching-learning and discourse analysis to emphasize the analysis of video shows of twelve course sequences on the conditions and learning processes in four important disciplines: grammar, reading, calculation and science observations. This thesis has issued proposals for educational contributions for teachers to improve the meta-linguistic treatment of L1 and L2 and student’s learning. These proposals concern the assessment of student’s epilinguistic behavior, the comparison of L1 and L2 through the metalinguistic activities, the didactic reformulations in both languages, the use of the mixed method of reading and the assessment of student’s culture

Full textWith the rise of shareholder activism, the investor duty of disclosure on the capital market is called to play a central role in addition to the one it already has in shareholder dialogue and the prevention of creeping takeovers. Although this obligation has been considerably strengthened, attempts to circumvent it call the effectiveness of both its declaration and sanction mechanisms into question. An analysis of these mechanisms shows that the development of the dismemberment of capital rights and the use of financial derivatives coupled with the increasingly inventive strategies of the practice weighs real risks of circumvention. Besides, the sanctions of these obligations are difficult to implement. While market abuse sanctions have largely been reinvigorated since 2016, specific offenses linked to the breaches of these obligations are essentially obsolete. Finally, civil liability mechanisms remain very difficult to implement. The establishment of a coherent and comprehensive information mechanism involves fillings gaps in the investor’s duty of disclosure and considering how to ensure the effective application of the sanctions as well as the criminal and civil liability mechanisms

Full textStudies have demonstrated that avoidance function can be transferred via equivalence classes with matching-to-sample procedure. It is not yet clear which parameters of this procedure are responsible for this transfer effect. The present study investigated whether transfer of avoidance functions can be established after the establishment of equivalence classes using the go/no-go with compound stimuli. The Experiment I consisted of six phases. In Phase 1, three participants were trained to establish equivalence classes using a go/no-go procedure (A1, B1, C1 and D1; and A2, B2, C2 and D2). In Phase 2, B1 (S+) was paired with an aversive tone, and B2 (S-) was established as a neutral stimulus. In Phase 3, the same stimuli were presented but the tone could be avoided by pressing a specific key. All stimuli were then presented successively on screen, in Phase 4, to test for transfer of avoidance evoking function. In Phases 5 and 6 emergent relations - symmetry, transitivity and equivalence - were tested. Only one participant exhibited equivalence classes and none of them showed transfer of avoidance functions. In a second experiment conducted with four participants the tests for the emergent relations were performed after training Phase 1. Three participants exhibited equivalence classes and two of them also showed transfer of avoidance functions. The results suggest that go/no-go with compound stimuli can produce transfer of avoidance functions through the establishment equivalence classes

Full textSince 2003, more than 400 popular districts categorized as sensitive urban zones and 4 million inhabitants have become part of a program initiated by the Framework Act on Town Planning and Urban Renewal (so-called “Borloo law”). In order to achieve district transformation and social diversity, the program has led to demolition/rebuilding operations, the refurbishment of existing dwellings and the redefinition of public urban areas (street network and green spaces, etc.)The municipalities of Clichy-Sous-Bois and Montfermeil in the Seine-Saint-Denis region were part of this program. Whilst being the largest program in France (in terms of allocated budget and demolished dwellings), it also had the singularity to involve the destruction of dilapidated privately-owned buildings such as Les Bosquets in Montfermeil and La Forestière in Clichy-sous-Bois. All the new buildings reconstructed there are under social housing management. All re-housed inhabitants consequently moved from the status of owner-occupiers or private housing tenants to that of social housing tenants. In addition to their change in status, this situation implies regular interactions between these ‘displaced’people and the professionals (of the city, of nonprofit organizations, social landlords who operate in the area, in these buildings within the frame of pre- and post-rehousing accompaniment.Based on an analysis supported by interviews, observations and archives, this thesis aims at understanding the genesis of this policy as much as the effects of the will for district transformation through generalizing social housing, on professional practices and the trajectories of the re-housed inhabitants. To this end, archives and interviews help understanding that the degradation of the former co-ownership properties was attributable primarily to their conditions of marketing, construction and management. Yet, all the measures of public action, up to the signature of the urban renewal program, systematically present the inhabitants and their features (popular classes or migrants) as solely responsible for this deterioration. The ethnography of professional practices then shows how in the new homes the professionals use the interactions with the inhabitants to regulate the way they live there. This work is done with a view to avoiding new damage to the buildings.Eventually the interviews with the inhabitants (made before and after re-housing) illustrate how re-housing and the interactions with professionals destabilize them within their individual anchorages and shake the sense of hierarchies within this social group. While former owners made up the upper class in their previous housing, they now feel the most downgraded. Conversely, tenants who were the most dominated are today the most rehabilitated.Beyond empirical results, this analytical approach rates the issues of the thesis on sevral scales. First, this work illustrates how, in a constructivist perspective, these co-ownership properties and their inhabitants have been built as a problem and a category of public action. Then, starting from the practices of professionals, this thesis discloses how within the frame of urban policy, some forms of regulation and domination over certain targeted publics (here working classes and migrants) are still exerted. Finally this thesis is consistent with a sociology of popular classes who are attentive to their internal differences as much as to the various ways a measure of public action can be perceived

Full textThis work presents a set of methods for protecting and monitoring power transformers based on intelligent systems and the application of Clarke and Wavelet transforms. The intelligent approach allowed us to analyze the operating condition of power transformers and it discriminates between an internal fault and different operating conditions, as energization, sympathetic inrush, saturation of current transformers and overexcitation. Decision making is performed by fuzzy logic after the preprocessing of the input signals through various methods, varying according to which algorithm is running. It is important to point out that in the simulations using ATP many different power system equipment had been modeled, including a synchronous generator with speed regulation, transmission lines with variation in frequency, power transformers with their saturation curves, potential transformers and current transformers. The objective of these tests was to generate data for distinct situations for the verification and the analysis of the proposed methodologies. The results of the research show the applicability of the algorithms considered in protection and monitoring of power transformers, even in adverse conditions, such as saturation of current transformers, since the input signals are distorted by CT saturation corrected by artificial neural network. The results are compared to the ones presented by a commercial percentage differential relay.

Full textIn this thesis we study the boundedness of Riesz transforms associated to Schrödinger operators with potentials having negative parts. First we consider the boundednesson Lp(RN, dx), then on Lp(M, dx) where M is a Riemannian manifold of homogeneous type. Finally we treat the boundedness of Riesz transforms on Lp(RN,wdx). As we consider, on the weighted spaces, the boundedness of the associated holomorphicfunctional calculus and the boundedness of the negative powers of the Schrödinger operator

The bilingual approach, adopted for educating deaf people in Brazil, regards the Brazilian Sign Language (Libras) as the first language and the written Portuguese Language as the instrumental language. The acquisition of the written language may be more difficult than the acquisition of the sign language due to the differences between their ordinal grammatical structures. The ordinal grammatical structure of the written Portuguese consists in a subject verb preposition complement order, whereas the structure of the Sign Language allows not only this order, but also different combinations of the elements. Such differences usually result, for the deaf people, in a writing repertoire of the Portuguese Language that has a different grammatical order than that one used by the verbal community in which they are inserted. This study investigated variables that control the transfer of ordinal functions through classes of equivalent stimuli. The experimental stimuli used were 32 printed words divided into four stimuli categories (A1A2A3A4; B1B2B3B4; C1C2C3C4 e D1D2D3D4), corresponding to subject, verb, preposition/article and complement, respectively. The categories were taught through matching-to-sample (MTS) tasks, while the sequences were taught through constructed-response matching-to-sample (CRMTS). All participants showed the formation of four stimulus classes, and learned one sequence (A1A2A3A4). After that, they showed the transference of ordinal functions to untaught sequences. In summary, results showed the transference of ordinal functions through equivalence classes.
