Abstract:
The monograph gives the concept of "innovative activity" and reveals its connection with related categories, characterizes public relations in the field of innovation, and also presents a range of norms aimed at criminal law protection of relations in the field of innovation. Special attention is paid to the characteristics of modern trends in criminal policy in the field of protection of innovative public relations, retrospective and comparative analysis of responsibility for socially dangerous encroachments on relations in the field of innovation. On the basis of the classification carried out, the features of the types of innovative activities in criminal law are revealed. The proposals on the use of individual components of legislative technology in the norms on crimes in the field of innovation are formulated, the set of means of differentiating responsibility for crimes in the noted field of activity is critically evaluated and clarified. It is addressed to everyone who is interested in the issues of criminal law protection of public relations in the field of innovation, practitioners who are faced with the qualification of crimes in this area, as well as teachers, students and cadets of educational organizations of a legal profile.

Abstract:
Comparative law plays a key role in the harmonisation of commercial law. This chapter outlines the history of comparative law and the classification of legal systems and goes on to examine the aims of comparative law, with particular reference to the enhancement of an understanding of one's own legal system, the development of transnational commercial law and the role of comparative law in transnational practice. A key part of the chapter is devoted to the purpose and methodology of comparative law. Is the objective to find common solutions or best solutions? Should the approach be formal or functional? The chapter concludes with a discussion of the problems confronting the comparative lawyer: the pitfalls of comparison, the effectivess or otherwise of legal transplants and the extent to which all those engaged in the work of harmonisation can realistically be expected to to be fully equipped as comparative lawyers.

Abstract:
For decades, academic scholars and multinational organisations have been assessing how ready governments are to meet the various political and socioeconomic challenges they face. These benchmarks of good governance have led to the creation of well-known composite indices such as the Human Development Index and the Rule of Law Index. Today, there are dozens of different governance indices, but few attempts have been made to properly classify them. We still know surprisingly little about what different kinds of indicators the indices contain and how much impact they have had. This chapter introduces and classifies thirty-seven governance indices and analyses their impact on academic research, the news media, and policy-making. The results provide new insights for the comparative analysis of composite indices and offer a useful resource for index creators.

The aim of this article is to give an account of legal families as a comparative law approach and as a classification of legal systems. The text discusses especially the future of legal families. The article begins with a short review of macro-comparative law’s basic approaches and concepts. It then considers the past and present of the basic notions of macro-comparative law, focusing on the classification of legal families and the recent critique of them. Finally, this article examines the new roles of legal families and, in particular, it addresses the possible future utility of legal family as a basic notion and as an approach in macro-comparative law.

This translation of Rechtsvergleichung offers a critical introduction to the central tenets of comparative legal scholarship. The first part of the book is dedicated to general aspects of comparative law. The controversial question of methods, in particular, is addressed by explaining and discussing different approaches, and by developing a contextual approach that seeks to engage with real-world issues and give a practitioner’s angle on contemporary comparative legal scholarship. The second part of the book offers a detailed treatment of the major legal contexts across the globe, including common law, civil law systems (based on Germany and France as well as case studies of Eastern Europe, Scandinavia, and Latin America, among others), the African context (with an emphasis on customary law), Asian jurisdictions, Islamic law and law in Islamic countries (plus a brief treatment of Jewish law and canon law), and transnational contexts (public international law, European Union law, and lex mercatoria). The book offers a coherent treatment of global legal systems that aims not only to describe their varying norms and legal institutions but to propose a better way of seeking to understand how the overall context of legal systems influences legal thinking and legal practice.
