Abstract:
Introduction: Basic purpose of health claims is consumers' benefit by providing information about healthy eating habits. It is necessary for health claims to be scientifically substantiated and truthful. Health claims should not attribute to food the property of preventing, treating or curing a human disease. Use of health claims should be followed by a statement indicating the importance of a varied and balanced diet and a healthy lifestyle. The objective of this research was to examine the compliance of health claims made on multivitamin and mineral dietary supplements' labels on the Serbian market with national regulation concerning health safety of dietary products.Methods: An assessment of labels of MVMs was done in two privately owned pharmacies in Novi Sad, Serbia in August 2010.Results: In total, 48 MVMs were sampled and 22 health claims were detected. Seven out of 22 health claims were in compliance with the national regulation. The main reason for health claims on foreign MVMs not to be compliant with the regulation in Serbia was inadequate or nonexistent translation of original labels.Conclusion: Detected use of terms such as "prevention", "treatment" and "indications" on vitamin and mineral dietary supplements' labels is both forbidden and misleading to consumers. Coupled with inadequate or nonexistent translation of the labels, it leads to a low level of protection of Serbian consumers. It is necessary to establish an effective monitoring system for dietary supplements' labeling on a national scale in order toprotect consumers and their wellbeing.

Abstract:
This article discusses the question of territorial jurisdiction over claims made against public-legal institutions (Russian Federation, constituent entities of the Russian Federation, municipal formations). The subject of this research is the current procedural norms regulating the questions of jurisdiction, and the established law enforcement practice. Attention is turned to the existence of gaps in legal regulation of the question of jurisdiction over claims made against public-legal institutions in the Civil Procedure Code of the Russian Federation and Arbitration Procedure Code of the Russian Federation. The authors analyze the established approaches in law enforcement practice towards solution of the aforementioned problem. Methodological framework includes the comparative-legal method and such formal-logical methods, as analysis, synthesis and induction. The relevance and practical importance are substantiated by the subject of research – the law enforcement practice formed by the Russian judicial authorities over the recent years. The conclusion is made on the need for elimination of the existing gap in the normative-legal regulation by amending the current procedural legislation.

La presente investigación tiene como objetivo principal considerar la ilegalidad y efectos negativos de las cláusulas “Claim Made” incorporadas en algunos contratos de seguro de responsabilidad civil, para lo cual y a través de doctrina nacional e internacional, jurisprudencia y pólizas depositadas en la Superintendencia de Valores y Seguros se advertirá lo atentatorio que significa su establecimiento en este tipo de seguros. Otro punto importante que pretendo analizar en esta investigación, son las diferentes discusiones doctrinales en el mundo sobre temas tales como desde cuándo se produce el daño, la acción directa del tercero perjudicado y los siniestros de cola larga. Para ello, se explicará inicialmente la institución del contrato seguro, en cuanto al concepto, características, tipos de contratos, formas de convenirlo, principios que lo inspiran, obligaciones de las partes y demás interesados, entre otros temas relacionados. Luego se tratará el contrato de seguro de responsabilidad civil en particular, su historia, concepto, características, la acción directa, el hecho dañoso, entre otras materias y se finalizará este trabajo con en análisis de las cláusulas “Claim Made”.

In order to assess the veracity of a green claim made by CNW marketing research Inc., I created a green baloney detection kit. It will serve as a guiding post by which anyone can assess the potential environmental impact of any action taken on the basis of the claims made by CNW in their dust to dust report. In their report they state that after doing an extensive life cycle analysis of several cars sold in the United States in 2005, they found that high fuel economy did not necessarily correlate to a smaller environmental impact, but rather the biggest contribution to the environmental impact of automobiles is in their end-of-life disposal. My green baloney detection kit will be an adaptation of Carl Sagan's original baloney detection kit, which is a series of probes which serve as a pillar for detecting fallacious arguments or claims. My enquiries show that the Dust to Dust report does not pass the green baloney detection kit and with it nontechnical environmentally conscious automotive consumers can determine that the claims made by CNW are not scientifically sound and so their decisions should be based on those claims.

Abstract:
The purpose of this thesis is to investigate the phenomenon of feminist artistic collectives. It explores the reasons that led to feminist art as a collective activity, especially from the second wave of feminism. The thesis confronts the typical modalities of male presence in the art world, the myth of the exceptional individual and the solitary approach to the artistic work . My perspective focuses on critical reviews that thematize artistic work as a collective activity, case study’s analysis and interview. The first chapter analyzes the figure of the “genius” artist and its conception in the Western tradition of Art History. It discusses how social systems disadvantage women artists, discussing the sociological theory of Howard S. Becker and the sociological perspective of Natalie Heinich. The second chapter investigates how Feminism theorized the arts, their idea of the professional artist and the collective as a way to escape the professional and cultural isolation where they have been relegated for decades. The third chapter analyzes Feminist Art History from its beginning in the late Sixties/early Seventies, referring to feminist artistic collective actions and artworks. It reviews some of the actions of the pioneering feminist artists who began to theorize and spread feminism in the art field. The fourth chapter eventually examines the case studies of the feminist artistic collective Claire Fontaine and its relation with Carla Lonzi, one of the pioneering Italian feminist theorists and art critics.

A compreensão da influência que as alegações têm na decisão de compra dos consumidores, constitui uma oportunidade para as marcas de produtos alimentares, que poderão, através dessa informação, criar valor para o consumidor e assim ganhar vantagem competitiva no mercado. A revisão de literatura existente sobre o impacto das alegações no consumidor tem evidenciado que as mulheres são um dos grupos com atitude mais favorável em relação às alegações. Existem também evidências que a geração Millennials preocupa-se mais com os benefícios que os produtos têm por questões de saúde e bem-estar, investindo assim na compra de alimentos com alegações. Face ao exposto, foram realizados dois focus groups com o objetivo de explorar melhor as diferenças existentes entre géneros, da geração Millennials, no que toca à atitude face às alegações presentes nas embalagens de produtos alimentares. Através dos resultados dos focus groups concluiu-se que as participantes femininas da presente investigação têm maior conhecimento e maior perceção sobre as alegações nutricionais e de saúde, assim como uma atitude mais favorável em relação a produtos com alegações e ainda uma maior perceção sobre a compra destes produtos, comparativamente com os homens. O que vem confirmar algumas das conclusões alcançadas em revisões de literatura anteriores sobre o tema e dar resposta às questões de pesquisa da presente investigação. Por outro lado, embora existam todas estas diferenças entre géneros, podemos afirmar que ambos os géneros têm maior intenção de compra por produtos com alegações nutricionais, quando confrontados com o mesmo produto sem a alegação.
Understanding the influence that nutrition and health claims have on consumers purchasing decisions is an opportunity for food brands, which through this information, they can create consumer value and gain competitive advantage in the market. A review of the existing literature regarding the impact of claims on consumers has shown that women are one of the most supportive attitude groups regarding the nutritional and health claims. Also, there is evidence that the Millennials generation is getting more concerned regarding the health benefits of products and, because of that, they are increasingly purchasing more food with claims. In the light of the above, two focus groups were held to better explore the existing gender differences of the Millennials generation, regarding the attitude towards the health and nutritional claims on the packaging. Through the results of the focus groups, it was concluded that the female participants of the present research have a better knowledge and perception about the nutritional and health claims, as well as a more favorable attitude towards products with claims and even a greater perception about the purchase of them, compared to men, which confirms some of the conclusions reached in previous literature revisions on the subject and answers the research questions of the present investigation. On the other hand, while there are differences, we can accurate argue that both genders have higher purchase intention for products with nutritional claims, when confronted to the same product without the claim.

A participação materna e da família junto ao filho prematuro internado, assume importância fundamental na perspectiva do cuidado humanizado em unidades neonatais. Neste contexto, o presente estudo tem como objetivos identificar e analizar os significados atribuídos pela equipe de saúde acerca da participação das mães/pais no cuidado ao filho hospitalizado e analisar as possibilidades que a equipe aponta para transformar a prática assistencial para favorecer essa participação. Trata-se de estudo com delineamento na abordagem qualitativa. O estudo foi realizado na unidade neonatal do Hospital Central “Dr. Ignacio Morones Prieto”, na cidade de San Luis Potosí, México. A coleta de dados foi realizada por meio de entrevistas gravadas com 23 profissionais que aceitaram participar do estudo, sendo direcionada por três questões norteadoras. As falas foram submetidas à análise de conteúdo, modalidade da análise temática. A coleta foi realizada no período de setembro de 2003 a setembro de 2004. Da análise das entrevistas emergiram seis núcleos de sentido: A presença das mães/pais favorece a estabilidade clínica do prematuro e o seu processo de crescimento e desenvolvimento; A participação possibilita a interação mãe-filho e o estabelecimento do vínculo afetivo; A mãe é treinada para a alta do filho; A mãe ajuda a enfermagem nos cuidados do filho hospitalizado; A presença das mães/pais modifica o ambiente da unidade neonatal; Favorecendo a participação das mães/pais: obstáculos e sugestões. Concluiu-se que a equipe de saúde considera importante esta participação, mas há barreiras decorrentes da inexistência de uma filosofia institucional, de postura, de preparo dos profissionais, assim como, deficiências de infra-estrutura física e de recursos humanos. Torna-se fundamental implementar estratégias visando viabilizar a maior participação da mãe e família no cuidado ao prematuro em unidade neonatal, rumo à assistência integral e humanizada.
La participación materna y de la familia junto a su hijo prematuro internado, asume importancia fundamental en la perspectiva del cuidado humanizado en unidades neonatales. En este contexto, el presente estudio tiene como objetivos identificar y analizar los significados atribuidos por el equipo de salud acerca de la participación de las madres/padres en el cuidado a su hijo hospitalizado y analizar las posibilidades que el equipo apunta para transformar la práctica asistencial en el sentido de favorecer esa participación en un hospital de la ciudad de San Luis Potosí, México. Se trata de un estudio delineado en el abordaje cualitativo. El estudio fue realizado en la unidad neonatal (UN) del Hospital Central “Dr. Ignacio Morones Prieto”, en la ciudad de San Luis Potosí, México. La recolección de datos fue realizada por medio de entrevistas grabadas con 23 profesionales que aceptaron participar del estudio, se direccionaron por tres preguntas norteadoras. Los relatos fueron sometidos al análisis de contenido, modalidad de análisis temático. La recolección fue realizada en el período de septiembre de 2003 a septiembre de 2004. Del análisis de las entrevistas emergieron seis núcleos de sentido: La presencia de la madre/padres favorece la estabilidad clínica del prematuro y su proceso de crecimiento y desarrollo; La participación posibilita la interacción madre-hijo y el establecimiento del vínculo afectivo; La madre es entrenada para el alta del hijo; La madre ayuda a enfermería en los cuidados del hijo hospitalizado; La presencia materna/de los padres modifica el ambiente de la unidad neonatal; Favoreciendo la participación de las madres/padres: obstáculos/sugerencias. Se concluyó que el equipo de salud considera importante esta participación, sin embargo, hay barreras derivadas de la falta de una filosofía institucional, de la postura y falta de preparación de los profesionales, de las deficiencias de infraestructura física y de recursos humanos. Se vuelve fundamental implementar estrategias con la visión de viabilizar la mayor participación de la madre y la familia en el cuidado al prematuro en la unidad neonatal, rumbo a la asistencia integral y humanizada.

Due to high economic and social inflation, as well as increases in claim frequency, loss trends for many liability lines increased dramatically. The industry introduced claims-made coverage to reduce the pricing risk inherent in long-tailed liability. In this study we describe in depth the claims-made concept itself: how it differs from traditional occurrence coverage, what its special features are illustrated by examples and provide more detail as to how pricing risk is reduced. Finally, we propose an approach for rating claims-made coverage and provide examples to illustrate the approach under simple assumptions.

Liability insurance is one of the most potential lines in the future. Insurance companies are creating all kinds of liability insurance. But current liability insurance is different from the old design which was only written on the occurrence basis. More and more liability insurances, especially professional liability insurances, are written on a claims-made basis. Currently, the practical use of claims-made policies is not mature in the domestic insurance market. In addition, there is some confusion over the definitions of claims-made basis which at times are still not clear enough. Because of the complication of claims-made basis policies, it is easy to have quarrels between the insurer and the insured. In order to reduce the issues, we should have more understanding of the claims-made basis. Researching the relevant laws and referring to foreign experiences will improve the design of a claims-made policy to protect the two parties of the insurance contract. This article mainly focuses on the followings: (1) the differences between occurrence basis and claims-made basis; (2) the whole system of Claims-made basis policies; (3) the differences between claims-made basis and claims-made and reported basis, with the relevant legal basis for claims made basis; and (4) the problems resulting from claims-made basis using in Taiwan insurance market and the suggestions for solving the problems.

<p>The paper deals with the design and production of a segmented prestressed bridge made of Ultra High Performance Fiber Reinforced Concrete (UHPFRC) The footbridge is installed in the town of Příbor in Czech Republic. The UHPFRC or UHPC material in the Czech Republic gradually finds its way to interesting and unique design applications. The paper presents the design and production of a segmented bridge of the first type in the Czech Republic, designed as a simple beam of 35 meters total length of 36 meters, which is created by the closure of five double-chamber segments 2,5 m wide and 0,8 m height. The UHPFRC class C110 / 130 was chosen as a structural material with a dispersed steel reinforcement developed by Klokner Institute CTU in Prague.</p>

Abstract This paper describes an engineering education attempt in a synthesis class during the 4th year. Since the Kochi University of Technology was inaugurated in April, 1997, engineering education trials had been conducted in the past 4 years. In 1997, 3 student teams participated in an eco-power race held in Kochi, Japan, with hand-made ecological vehicles. In the summer, 1998, three teams participated in the Shikoku Electric Vehicle Rally using light weight vehicles converted into electric cars. The synthesis class was performed based on such past engineering activities out of class. In order to provide an active learning opportunity, a synthetic learning environment is needed rather than just teaching in classes. Manufacturing is also considered to be of great importance for mechanical engineering as well as the basic sciences such as mathematics and physics. As a capstone learning course, a team of four students in the laboratory tried to design and manufacture a hand-made small-sized electric vehicle.

The Armenian emigrated to the Caucasus in XIX century always made unreasonable territorial claims and provoked conflicts in the region. Investigations based on the facts and arguments make it possible to determine specific features of some problems and processes and understand the essence. Unreasonable territory claims by Armenia caused the loss of 20% of Azerbaijan territory and the war with Azerbaijan in 90`s of last century. Azerbaijan army freed its territory occupated by Armenia despite of Armenian`s new territory claims and millitary retreats.

Tutorials are a great way to capture students' attention in science classes. Particularly in the teaching of Physics, the students need to have a good focus and clear explanations when they engage in applied projects, such as the assembling of an Arduino robot. The tutorials provide, with great clarity and accuracy, step-by-step instructions on how to perform such projects, enabling the students to replay, stop or move forward to certain video sequences whenever needed. When posted online, it becomes a widely accesible resource that the students can access at any time and integrate in their learning process. This article aims to show how, together with some of my students, I have designed, filmed and edited tutorials for the Physics class which we later uploaded on an online platform, thus making them available for all the other students. This student-made online data base of tutorials was meant to provide a link between the field of physics, information technology and electronics which the students could incorporate into their projects. Some tutorials were concerned with the applied physics projects showing, for example, how to create a solar panel, a water-pressure activated rocket or how to build a weather station for school. Others were meant to help students operate with data acquisition devices and with programming environments such as LabVIEW, which is extremely useful for virtual physics experiments. Moreover, a tutorial about the use of an ARDUINO platform was needed in order to show how students could create simple robotic devices. Last, but not least, some tutorials were used as learning materials in class, illustrating the way theory is applied in concrete science projects.

<p>The reliability of the railway superstructure depends, among other things, on the actual fastening of the rail to the sleepers. This structure is extremely dynamically loaded. In the paper, the attention is paid to the flexible Vossloh W14 fastening system with the use of SKL14 tension clamps. These clamps are often damaged by fatigue failures, especially in curves of small radii (R &lt; 400 m). Within the research, fracture areas were identified and a fractographic analysis was performed. The analysis proved fatigue failure and, therefore, an estimation of the service life of the clamps was made. The evaluation was focused on a selected area of railway track where the fatigue-damaged clamps were found. The strain gauges were placed directly on the clamps at critical points and the obtained values were confronted with the experimentally obtained fatigue curve. Based on the presented findings, the service life of the clamps in the selected track was identified.</p>

The value of yerba mate (Ilex paraguariensis) exports from Paraguay has recently increased dramatically. Much of this growth is due to positioning of the good within the universe of products where consumption growth is driven by perceptions of sustainable production and health benefits to consumers--that is, credence attributes creating a new dimension of demand. Credence claims for yerba mate's benefits to indigenous producing communities, environmental sustainability under certain production processes, healthful alternatives to energy drinks, are now widely known, but the growth of this awareness came via a new entrepreneurial strategy of a single firm. This case study explores the determinants of growth of credence-based exports of yerba mate from Paraguay, potential for increased growth, and the fragility of the credence-based model.

With intensifying emphasis on episodes of care and bundled payments for surgical admissions, anesthesia expenditures are increasingly important in assessing variation in expenditures for surgical episodes. When comparing anesthesia expenditures across surgical settings, adjustment for anesthesia case complexity and duration of anesthesia services, also known as anesthesia service intensity, is desirable. A single anesthesia intensity measure allows researchers to make more direct comparisons between anesthesia outcomes across settings and services. We describe a process for creating a claims-based anesthesia intensity measure using Medicare claims. We create the measure using two fields: base units associated with American Medical Association Current Procedural Terminology codes on the anesthesia claim and time units associated with the service. We rescaled the time component of the anesthesia intensity measure to equally represent base units and time units. For illustration, we applied the measure to Medicare anesthesia expenditures stratified by rural/urban location. We found that adjustments for intensity were greater in urban settings because the level of intensity is greater. Compared with rural settings, unadjusted expenditures in urban settings are roughly 26 percent higher, whereas adjusted expenditures in urban settings are only 20 percent higher. Even absent longitudinal data, researchers can adjust anesthesia outcomes for intensity using our cross-sectional claims-based intensity method.

Poor and marginalised citizens rarely engage directly with the state to solve their governance issues in fragile, conflict and violence-affected settings, as these settings are characterised by the confrontational nature of state–citizen relations. Instead, citizens engage with, and make claims to, intermediaries some of them public authorities in their own right. What are these intermediaries’ roles, and which strategies and practices do they use to broker state–citizen engagement? We argue that in Pakistan intermediaries make themselves essential by: (1) being able to speak the language of public authorities; (2) constantly creating and sustaining networks outside their communities; and (3) building collectivising power by maintaining reciprocity relations with their communities. In doing so, households and intermediaries engage in what we are calling ‘accountability bargains’: strategies and practices intermediaries and poor and marginalised households employ in order to gain a greater degree of security and autonomy within the bounds of class, religious, and ethnic oppression.

Evaluating and using evidence to support a claim and providing reasoning to demonstrate why the evidence supports a claim can be a challenging practice for students to learn. In the context of an inquiry task across a science unit, we tested an evidence-sorter tool that helps students to organize and reason with evidence to support their selected claim in a unit culminating argument essay. We found that the number of evidence-reasoning pairings that students provided on their evidence-sorter tool significantly positively predicted the number of evidence-reasoning pairs in the final essay. These results suggest that helping students make more evidence-reasoning connections in the evidence-sorter tool should lead to an increased use of reasoning in the final essay.
