Abstract:
The UN has placed rhetorical emphasis on the prevention of armed conflict before it starts and has taken selective action toward that end. What determines where the UN gets involved? We examine UN preventive actions by focusing on UN Security Council (UNSC) resolutions in self-determination (SD) disputes. We argue that UN decisionmakers consider at least three factors when deciding where to target preventive action: the dispute’s conflict history, the potential for regional contagion, and the characteristics of the dispute. We further argue that the political dynamics of UNSC decisionmaking constrain the UN’s ability to pay attention to the third factor (the characteristics of the dispute). We test this argument using data on all UNSC resolutions comprising the authorization of diplomatic engagement, condemnation, the authorization of sanctions, and the deployment of force targeted toward SD disputes from 1960 to 2005. We find that the UN is much more likely to act in nonviolent disputes that have a history of violence and in disputes with a potential for regional contagion. The analysis shows that, while political barriers likely restrict the ability for the UNSC to act when dispute-level characteristics suggest armed conflict is more likely, the UN does act proactively to prevent violence, rather than just reactively responding to existing violence.

Abstract:
The inheritance and the division of inheritance that is felt to be unfair is often a source of dispute. The disputes that occur can sometimes be resolved by making a peace agreement between the disputing parties. The peace desired by the parties is, of course, expected to end disputes/conflict and to provide legal certainty among those in dispute. However, sometimes peace agreements that have been made between those in dispute are disputed again in court. This study aims to examine the settlement of Balinese traditional inheritance disputes through a binding peace agreement between the parties make it. The method used in this study is a normative legal research, using a statute approach and a case approach. The result of this study showed that the settlement of Balinese indigenous inheritance disputes through a binding peace agreement of the parties that make it if the peace agreement is made based on the validity of the agreement as stipulated in article 1320 of the Civil Code, based on good faith as the principles in the law of the agreement, and must be made in the form of a notary deed is in accordance with the provisions for conciliation in book III of the Civil Code.

The concept of legal conflict is General (cross-sectoral) and at the same time basic in private and public legal mechanisms for the protection of civil rights, along with the issues of choosing the appropriate method of protection, jurisdiction of the dispute, and compliance with the officially established order (procedure). In the context of legal conflict, it is practically significant to study the causes of the conflict, the dynamics of development and the possibility of conflict management. The author assumes that legal conflicts based on legal and individual (contractual, local, judicial) regulation are considered in two forms (types) as unregulated (consensual, non-confrontational) and qualified (law enforcement, confrontational), reflecting the development of legal relations from erroneous actions to tort. Conflicts aimed at restoring the violated (disputed) right allow resolving disputes about the law, the legality of (unfair) actions (inaction), and overcoming the shortcomings of legislation. In this regard, civil-legal and administrative-legal disputes are crucial.

In this article, the author considers alternative ways to resolve disputes, that is, the use of conciliation procedures to resolve conflict situations in civil proceedings. The traditional way of resolving disputes has been and remains the judicial procedure, which is enshrined in the legislation of most states and is a guarantee of respect for human and civil rights. But the author considers conciliation procedures for resolving a dispute in a civil process by concluding a settlement agreement. Also, special attention is paid to resolving the dispute through mediation. The previously existing types of alternative dispute resolution procedures have been supplemented by participatory procedure and judicial mediation.

Introduction. The right to protection is one of the main powers of subjects of civil legal relations. The definition of jurisdiction in the law is aimed at eliminating the violation of the law and the influence of the subject of civil legal relations on ensuring the real exercise of civil rights. The purpose of the paper is to study the problems of applying the system of forms and methods of out-of-court settlement of civil legal disputes (conflicts) by conducting an analysis of theoretical and practical aspects. Results. The non-judicial form of protection of civil rights is determined by the possibility of choosing among the indicated methods of protection of private rights among several non-judicial (non-jurisdictional) methods of dispute resolution. This method of out-of-court settlement of a dispute (conflict), such as self-defense, is an effective way of protecting private law, but it is limited in time of application. In order to restore the trust of each of the parties, preserve relations and business reputation, the parties can use such an extrajudicial method of resolving the dispute (conflict) as negotiations. Although negotiations are defined as an effective method of out-of-court settlement of disputes with the protection of the rights and interests of citizens, there remains a risk of non-implementation or incomplete implementation of the agreements reached, which, in turn, may lead to delays in the process of timely protection of the violated right. Mediation is a relatively new out-of-court way of protecting private rights by resolving civil disputes (conflicts). When using the mediation procedure, the parties can reach a consensus, but the resolution of the dispute may go beyond the subject of the violated right. Conclusion. Out-of-court methods of protecting private rights provide an opportunity not only to resolve disputed issues outside the court, but also to save time, financial resources, preserve friendly or partnership relations, and also to go beyond the boundaries of a contentious legal dispute. relations and receive additional bonuses when defending an infringed, unrecognized or contested right.

The alternative dispute resolution family has experienced a number of changes over the last century. Litigation, the great grandfather of modern day dispute resolution, has been the procedure chosen by the majority of people to resolve their problems for literally thousands of years-primarily because it was the only legal choice available to most parties. Litigation has been tweaked by lawmakers and courts, but it is basically conducted in the same manner that it was conducted before the Pilgrims landed at Plymouth Rock. The only other institutions that have survived with little change over the centuries are religions. Litigation may appear to have become just as important as religion for some lawyers, because it has allowed them to earn extraordinary income and exercise an enormous amount of control over their clients' affairs; however, that situation is changing. The public has begun looking for alternative ways to achieve the resolution of disputes in order to give individuals and companies more control over the dispute resolution process as well as a greater voice in the final outcome of their disputes.

The paper examines the concept of a public service dispute as a type of a legal conflict, as a protective legal relationship and a juridical procedural activity. The author analyzes the modern terminology of a public service dispute enshrined in the legislation regulating public service, identifies the shortcomings of legal definitions. The author establishes and describes the mechanisms for the consideration of public service disputes provided for by the legislation.The main approaches to the definition of a public service dispute are analyzed. The author has highlighted its features as a complex protective legal relationship. The author shows the erroneous identification by some researchers of labor and public service relations and approaches to their determination of the legal nature of public service disputes, including the legality of the application of disciplinary sanctions. It has been substantiated that the legal nature of public service disputes in the civil service system is primarily determined by the content of the relations that underlie their occurrence—public service legal relations—and not by the forms of their consideration, which allows the possibility of applying labor and civil procedural legislation to disputed legal relations.The author defines a public service dispute and an official conflict, describes the signs of a public service dispute on the legality of the imposition of a disciplinary sanction, qualifies the subject matter of the dispute under consideration—substantive legal requirements (disagreements) of the parties that act as an element of the connection between the substantive legal relationship between the parties to the dispute and the procedure applied for the dispute consideration. It has been substantiated that the public service dispute consideration concerning the legality of imposing a disciplinary sanction, termination of a public service contract constitutes a type of law enforcement procedural activity that has its own basis, subject matter, goals, elements, procedural forms and stages, types of decisions, which makes it possible to single out such disputes as one of the administrative proceedings included in the administrative process structure.

This paper studies the incentives underlying the relations between foreign countries and rival domestic groups. It models the interaction in a infinitely-repeated game between these three players. The domestic groups bargain for a split of the domestic surplus and may engage in violent dispute for power and in unilateral mass killing processes. The foreign country may choose to support one of these groups in exchange for monetary transfers. The paper characterizes the parametric set in which strategies leading to no violent disputes nor mass killings are Subgame Perfect Nash Equilibra in the presence of foreign support, but not in its absence.

The construction industry is a unique and complex industry in which numerous different participants depend directly on each other in order to fulfil their separate functions and obligations. Recent years have seen an increase in conflicts and disputes within the industry, such that conflict and dispute are now considered endemic to an adversarial industry. This increase in conflict and dispute, together with the dissatisfaction with the traditional methods of resolving disputes, namely litigation and arbitration, have led to an increase in the growth of alternative dispute resolution (ADR) processes within the industry. The dispute resolution process most frequently referred to in literature on ADR is mediation. The process of mediation, while being flexible and informal, is underpinned by definite principles and objectives. In principle, mediation is a voluntary, non-binding and confidential process involving a neutral third party who assists the disputing parties in reaching a settlement. There are different approaches to mediation, each determined by the degree of intervention into the dispute by the third party. However, no matter the approach taken by the mediator, the main objective of mediation remains for the mediator to assist the parties in reaching an outcome on which they can mutually agree. Mediation has been used in the South African construction industry for settling disputes for the past couple of decades. However, no certainty exists as to the nature of the actual practice of mediation. This research, therefore, seeks to determine whether the practice of mediation in the South African construction industry is consistent with the principles of the mediation process. The hypothesis that is tested by the research is that the practice of mediation in the South African construction industry is not consistent with the generally accepted principles of the mediation process. In order to test such a broad and complex hypothesis, three sub-hypotheses were developed. The first being, that, construction industry mediators do not assist the disputing parties in determining their own settlement. The second, that the main stages that characterise the mediation procedure are the collection of information on the dispute by the mediator and the formulation of a solution by the mediator. The third, that the knowledge and utilization of specific mediation process skills and techniques are limited amongst construction industry mediators. Primary data were collected by way of 63 questionnaires received from the 206 posted to mediators recognised nationally by the South African Institution of Civil Engineers and the South African Association of Consulting Engineers, as well from mediators listed by the Western Cape Branch of the Association of Arbitrators of Southern Africa. The questionnaire responses were analysed using basic descriptive statistics, and these results were used to assist with the interpretation of the responses. The research reports on the occurrence of the practice wherein parties to mediation undertake, prior to the commencement of the mediation, to be bound by the mediator's decision, and concludes that this practice cannot constitute mediation. The research reveals mediation in the construction industry to be a mediator-owned process rather than a party-owned process, and concludes that this tendency is promoted by the terms of certain contract documents and published guidelines. It was also found that the mediators perceive their role as being to resolve the dispute using their own technical knowledge and expertise, rather than using specific mediation skills and techniques. Finally, it was concluded that the practice of mediation in the South African construction industry is not consistent with the generally accepted principles of the mediation process, as, the mediators do not generally assist the parties with determining their own settlement, instead the mediation activities centre mainly on the collection of information on the dispute by the mediator and the formulation of a solution by the mediator. The research showed that the mediators' knowledge and utilization of specific mediation process skills and techniques were limited.

The World Bank produces sample bidding documents for use by its member countries to prepare tender forms and contract conditions for Bankfinanced civil engineering construction contracts. The contract conditions provide for arbitration of disputes and parties to a contract may choose to submit to the International Centre for Settlement of Investment Disputes (ICSID) which was established by members of the World Bank for the settlement of investment disputes between states and nationals of other states. The objectives of the Thesis are to (i) examine the legality of generally submitting disputes in international civil engineering contracts to ICSID arbitration, (ii) provide an analysis of ICSID as an international arbitral institution and (iii) discuss the legal aspects of submission of disputes to ICSID arbitration in breach of the Convention that established ICSID. Chapters One, Two and Three are devoted to describing the importance of civil engineering works to economic growth and arbitration as a method of resolution of disputes. An analysis is made of the fundamentals and complexity of the arbitral process and the interfacing between legal systems, national laws and international law in international arbitrations. Chapter Four traces the genesis of ICSID and Chapter Five examines critically the salient features of ICSID arbitration, which according to the Thesis are not all exclusive to ICSID arbitration. Chapters Six and Seven analyse in depth ICSID jurisdiction ratione personae and ratione materiae. Chapter Eight argues that disputes in freestanding international civil engineering contracts are not investment disputes and that submission to ICSID is in breach of the Convention. Chapters Nine and Ten discuss the legitimate role of ICSID in developing rules of international economic law and conclude by recommending that ICSID should not detract from that role by becoming just another arbitral institution in. the business of arbitration.

This study, drawing mainly on the Qing law and Baodi case records during nineteenth century, supplemented by reference to collections of magistrate's decisions and handbooks, aims to describe the civil procedure of the last dynasty of imperial China, the Qing in terms of the performance of the magistrate's court in solving land and debt cases. It argues that the establishment of the relevant laws on both procedural and substantive issues was systemized in the Qing logic in the sense that magistrates were enabled to solve land and debt disputes and petitioners were enabled to seek help from legal institutions. In some aspects, the law was either drafted too widely, such as in the case of physical injury, or too ideally, such as in the case of false accusation. As a result allegations of physical injury and untrue accusation were very often found in land and debt cases. As for solving land and debt cases, the magistrate in the first place followed the letter of the law when there was an applicable statutory provision. However, the magistrates' purpose in hearing a case was to distinguish right and wrong. (fenbian quzhi) and deliver justice (pingyun) to the parties; so the facts (qing) and the law (fa) were both completely considered (qing fa liang jin). When there was a gulf between the law and the case, which was sometimes unavoidable, the real meaning or principle of the law was applied. In this sense, the magistrate enjoyed a large discretion by taking into account the specific circumstances before making a decision (zhun qing zhuo li). Zhun qing zhuo li expresses a principle governing the application of the law. It is not a flexible tool allowing the magistrate to decide as he wished. In most circumstances the letter of the law was not lacking. Decisions turning on zhun qing zhuo li were very rare. In any event several limitations were established on the magistrates' discretion.

ENGLISH ABSTRACT: In an otherwise broad literature on civil conflict little attention has so far been paid to actual conflict violence and variation in severity. Existing work is also hampered by a reliance on a ‘closed polity’ model of the state, leading to disregard of the transnational dimensions of internal conflict, and by a dependence on over‐aggregated data. The present inquiry expands on the existing explanatory framework for variation in civil conflict severity by including transnational factors and characteristics of sub‐national actors. Data on conflict battle deaths are combined with recently available data on transnational ethnic linkages, transnational support and neighbouring conflict as well as other actor and country characteristics. Results from ordinary least squares regression analysis indicate that support for rebel groups from external non‐state actors increase conflict severity, while rebel presence in other states is associated with less severe conflicts. In addition, severity increases with duration but with a diminishing marginal return. Internal armed conflicts are less severe in democratic and ethnically polarised countries but rebel territorial control increases the level of violence.
AFRIKAANSE OPSOMMING: In die andersins omvangryke literatuur oor burgerlike konflik is daar tot op hede min aandag geskenk aan werklike konflikgeweld en variasie in felheid (vernietigende omvang). Bestaande werk word ook belemmer omdat dit staat maak op ’n model van die staat as ‘geslote regering’, wat lei tot verontagsaming van die transnasionale dimensies van interne konflik, en staat maak op oor‐geaggregeerde data. Hierdie ondersoek brei uit op die bestaande verklarende raamwerk vir variasie in felheid van burgerlike konflik deur transnasionale faktore en eienskappe van subnasionale deelnemers in te sluit. Data oor konflikgevegsterftes is gekombineer met onlangse data oor transnasionale etniese koppelings, transnasionale steun en naburige konflik, sowel as ander deelnemer‐ en landeienskappe. Resultate van gewone kleinstekwadrate‐regressie‐analise dui daarop dat steun aan rebellegroepe deur eksterne nie‐staatsdeelnemers konflikfelheid laat toeneem, terwyl rebelleteenwoordigheid in ander lande geassosieer word met minder fel konflikte. Felheid neem ook toe saam met duur maar met ’n afnemende marginale opbrengs. Interne gewapende konflikte is minder fel in demokratiese en etnies gepolariseerde lande, maar rebellebeheer oor grondgebied verhoog die vlak van geweld.

Over the past few decades, globalisation, international trade, cross-border investments, travel, and economic and personal relationships between citizens of different countries have had a profound impact on law. An increase in international relationships is inevitably followed by a growth in international and cross-border litigation. Therefore, several initiatives have been launched with the aim of unifying, harmonising, and internationalising civil procedure. Today, the international harmonisation of civil procedure is mainly achieved through soft law instruments, such as the numerous Hague Conventions dedicated to this legal field and the ALI/UNIDROIT Principles of Transnational Civil Procedure. Moreover, in the European Union, harmonisation of civil procedure has reached even more advanced levels across member states. Any party who becomes involved in an international or cross-border dispute naturally needs to understand what is happening around them. Hence, translation is attributed a major role in international civil procedure. This paper will look at translation in civil proceedings, with particular regard to international and transnational disputes which fall under the Italian jurisdiction¬. Its purpose is twofold: 1) the first aim is to propose a potential resource which could facilitate translation in Italian civil proceedings, i.e. multilingual civil court document templates; 2) the second aim is to raise awareness on the importance of translation in international and cross-border disputes and highlight the peculiarities which characterise this particular type of translation and differentiate it from other areas of both general and legal translation. Chapter 1 offers an overview of Italian civil proceedings. Chapter 2 is dedicated to legal translation. Chapter 3 focuses on Italian civil court documents and the use of templates in Italian proceedings. Finally, Chapter 4 presents the German and English translations of six Italian sample templates.

Construction projects experience claims and disputes due to increased complexity of contract documentation, which subsequently affects the cost performance of projects. Majority of the previous studies on disputes and cost overrun have mainly focused on finding the causes of cost overrun or disputes in the industry. Identification of dispute prone areas and the associated range of cost overrun due to the disputes are less explored. Previous research findings indicate that the various factors resulting in cost overrun itself are the causes of disputes. It is necessary to understand, assess and take appropriate actions for increasing the predictability of claims and disputes in order to improve the cost performance of construction projects. In this study, an attempt is made to identify and prioritize the dispute prone areas in Indian construction projects by analytical hierarchy process (AHP).

The construction industry is an industry where multiple parties are involved in the completion of a project. Risks in the construction industry include both threats to and opportunities in a project. The majority of construction works in India are modeled on General Conditions of Contract (GCC) formulated by the Central Public Works Department (CPWD). Public Works Contracts have many limitations and are prone to disputes. This paper analyses clause 2, 5, and 25 of CPWD GCC 2020. They are clauses on compensation for the delay, time and extension for the delay, and settlement of disputes and arbitration. This paper aims to study the remedy for delay and disruption according to clauses in CPWD GCC and to make recommendations for optimal and effective contract management from the data collected through the survey. A questionnaire is prepared on these 3 clauses and the responses are analyzed and recommendations are made based on the responses collected.

There is overlap in the principles and goals of peacebuilding and mediation; many organisations conduct both practices, intermingling them. Local, regional, national and international actors have applied mediation and peacebuilding to many different types of conflict in the past decade in Tunisia, involving varied parties. The case studies included in this rapid review cover conflicts relating to labour and the economy, the environment, basic services, constitutional/political disputes, and women’s rights. They involve local communities, the unemployed national and regional trade unions, civil society organisations (CSOs), national utility and mineral companies, and political parties.

This paper discusses the religious dimension of the public debate concerning the public health measures adopted by the Romanian authorities during the pandemic and focuses on the role played by the Romanian Orthodox Church within this context. It delineates the different camps that were formed within the Church in this regard and traces their evolution throughout the pandemic. It contextualizes the position of the Church in order to better understand it, placing it within the broader context of the Romanian society during the pandemic and integrating it within the longer history of post-communist relations between the Romanian Orthodox Church, the Romanian state and the Romanian civil society. It analyses the political impact of the public health measures and the role of the Church in shaping this impact. Finally, starting from the Romanian experience of the pandemic and from the ideological, theological and political disputes that it has generated within the Romanian public sphere, it develops some general conclusions regarding the relation between faith, science and politics whose relevance, if proven valid, surpasses the Romanian context and thus contributes to a more ecumenical discussion regarding the theological, pastoral and political lessons that can be learned from an otherwise tragic experience.
