Chapter 4 will examine the influence of Grotius’ ‘Erastianism’ (broadly defined here as the theory of the subordination of church and religion to the civil power)—expounded particularly in De Imperio and the Annotationes and based largely on a specific interpretation of the Jewish Sanhedrin as a court of civil justice—both on English monarchical and Episcopal writing from the Great Tew Circle to early Enlightenment, and in post-Restoration literature of Nonconformism, which invoked the power of the civil magistrate (in particular during the reign of Charles II) over church (as against Anglican uniformity) in support of toleration toward Presbyterian (Baxter) and congregated (Humfrey) churches. The chapter will also examine the (critical) reception of Grotius’ vision of the relation between civil power and religion, that is, the power of the magistrate to intervene on aspects related to theological aspects and cult.

Abstract:
Much nineteenth-century political theory was preoccupied with relations between state and Church. This chapter examines some of the leading European theories of Church and state many of which influenced and reflected broader public debates and institutional developments. In response to the French Revolution and to a series of liberal and democratic reforms various attempts were made to renew the Church by emphasizing its role as the spiritual embodiment of the nation. While in some contexts such as France this would provoke a secular reaction and ultimately a separation of Church and state, elsewhere increasing religious pluralization would generate pluralist state forms and corresponding theories of the plural state. The central themes covered include: ultramontanism to liberal Catholicism in France; the Hegelian theory of the state; liberal Anglicanism and the Broad Church movement; and theories of the plural state from the 1890s to the First World War.

Abstract:
Chapter 3’s discussion of kingdoms and orders in the context of political life leads naturally into the topic of this chapter: the church, the state, and their relationship. The present chapter locates the state (or, better, political authority in general) in relationship to Chapter 3’s categories by presenting it as one of the orders by which God’s structures the world. It is an important actor in the temporal kingdom, where God has ordained it to preserve the world through law. The church in its essence is an agent of the spiritual kingdom, bearing God’s redemptive word to the world. The themes of preservation and redemption, the kingdoms, and the orders find many of their concrete expressions in themes of the church, the state, and their relationship.

Abstract:
This thoroughly annotated document collection gives students and researchers an authoritative source for understanding the evolving political and legal relationship between church and state from colonial times to the present day. The First Amendment to the Constitution of the United States declares that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." The Establishment Clause, meanwhile, declares a position of neutrality not only between differing religions, but between religious and nonreligious beliefs. The terms of the Free Exercise Clause, however, provide special protections to religious belief and practice. Thus the provisions of the two clauses can clash. In fact, differing political and legal interpretations of these clauses have resulted in some of the most hard-fought and contentious philosophical battles in American history. This book provides readers with convenient access to pertinent documents and court cases that enables a deeper understanding of the past and current balance between church and state and its political implications in the 21st century. The expert commentary that accompanies these key documents serves to elucidate how interpretation of the U.S. Constitution affects issues such as whether public funds or other public support should go to religious-based schools or hospitals; how to safeguard individuals' rights to religious expression while also considering how individuals should not be forced to participate in mandatory religious expressions in public institutions; and how the language regarding "separation of church and state" came about, when this phrase does not appear anywhere in the Constitution.
