Mevorach, Irit. The Debiasing Role of the Cross-Border Insolvency System. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198782896.003.0002.

Full text
Abstract:
This chapter explores what the reasons for deviating from modified universalism in practice may be. To do so, it draws on behavioural international law and economics. The chapter argues that certain decision-making biases may play a role in cross-border insolvency and can explain both negative inclinations and instances of lack of cooperation, as well as the relative success of modified universalism. The key argument here is that instead of yielding to territorial inclinations, cross-border insolvency law has a debiasing role to play. It should attempt to align choices with optimal solutions, overcoming biases, and should also close gaps in the cross-border insolvency system in line with modified universalism.

Full text
Abstract:
Integrity or moral wholeness is the foundation of moral resilience. Integrity arises when intentions, words, thoughts, and actions align and there is fidelity in adherence to ethical commitments, norms, and conscience. It includes a robust notion of moral agency that includes considerations of the congruence of intentions, character, choices, behavior, and actions as well as responsibility for them. It requires a well-honed conscience; moral sensitivity, perception, and imagination; self-regulatory capacities; ongoing reflection to evaluate one’s intentions, motivations, and actions; cognitive judgment; the ability to devise reasonable solutions to internal conflicts; and steadfast commitment to responsibly enact considered decisions. Clinicians have dual obligations to those they serve and to themselves. Personal and relational integrity are fundamental considerations for clinicians. This dynamic interplay requires attunement to the issues of personal and relational integrity that are at play in clinical practice, including relationships with patients, families, colleagues, leaders, organizations, and the broader society.

Abstract:
The intertextuality of John Rolland’s Court of Venus, announced in its opening quotation and subsequent displays of scholarship and poetic skill, is central to the poet-narrator’s self-construction as a man improved by studying literature. However, the extent of Rolland’s reading is obscured by his unacknowledged use of key sources, including dictionaries, to populate his poem with Classical figures and cultivate a learned diction. While this might be read as pretension to a literary elite Rolland associates with the bygone court of David Lyndsay, the moral vision of his poem is greatly enlarged by its attempt to align such bookish learning with knowledge gained through experience—foregrounded by allusion to Chaucer’s Wife of Bath. In this way The Court of Venus models an urbane, knowing morality working towards wisdom and self-governance while recognizing the diversity, and disruptive desire, of human nature.

Selby, Christine L. B. Who Am I? ABC-CLIO, LLC, 2021. http://dx.doi.org/10.5040/9798216035374.

Full text
Abstract:
This book explores what identity is, what factors contribute to it, how it develops, and the impacts that a strong or weak sense of self can have on a person's health, happiness, and future. Many teens grapple with the seemingly simple question, "Who am I?" and struggle to integrate their experiences at school, at home, and with friends into their burgeoning sense of identity. How teens see themselves can influence the friends they choose, the decisions they make, and their mental and physical well-being. Having a strong sense of self can help them resist peer pressure, avoid risky behaviors, and make choices and plans that align with their values and interests. Yet research shows that such factors as heavy social media use can have a strongly negative effect on healthy identity formation for today's teens. Who Am I? Understanding Identity and the Many Ways We Define Ourselves examines the subjects of identity and identity formation across the lifespan, with special emphasis on the teenage years. Beyond simply discussing relevant psychological theories, the book focuses on how identity formation happens in the real world and how it affects the daily lives of teens. It also includes a collection of fictional case studies that provide concrete, relatable illustrations of concepts discussed in the book.

Abstract:
This chapter traces the co-production of knowledge on the global migrations of biota—humans, plants, and animals—by exploring a brief biography of life in the United States over the past decade. It also emphasizes the human influence on the natural world by calling this contemporary epoch the Anthropocene, an era driven primarily by the impact of human actions. Thus, with refusing the unproductive choices of a nostalgic past or an anarchic future, this chapter turns to a naturecultural vision of responsible and ethical living with our cohabitants, a vision that is always politically astute and reflexive of the complex histories of gender, race, class, sexuality, and nation that have shaped our ideas of nature and the natural.

Letherer, Jen. Remote Virtue. ABC-CLIO, LLC, 2015. http://dx.doi.org/10.5040/9798216007548.

Full text
Abstract:
This introduction to media literacy from a Christian perspective provides the tools to find and assess the beneficial―or harmful―ideologies depicted in notable films, programs, and trends. Television and movies shape popular culture, with audiences often unaware of how media messages influence the way they think, act, and view the world. In this enlightening guide, author Jen Letherer interprets film and television shows from a Christian standpoint, revealing how beliefs and values portrayed on the big and small screens often impact the moral conduct of daily viewers. This book provides the tools for Christians to discern the implicit and explicit messages found within this medium, and shows how motion pictures can improve or erode religious principles and a spiritual way of life. In a conversational tone, the work combines classic film theory, an assessment of story structure, and faith-based film criticism to delve into meaning and interpretations of popular movies and shows. Highlighted television programs include Top Chef, Modern Family, Downton Abbey, and The Walking Dead. The book also features films like Citizen Kane, Thelma and Louise, Star Wars, Inception, and The Hunger Games. This fascinating critique prompts media consumers to analyze the messages that their favorite broadcast programs send, consider if those messages are in line with their own values, and align their viewing choices with their personal beliefs.

Dority, G. Kim. Rethinking Information Work. 2nd ed. ABC-CLIO, LLC, 2016. http://dx.doi.org/10.5040/9798216008217.

Full text
Abstract:
A state-of-the-art guide to the world of library and information science that gives readers valuable insights into the field and practical tools to succeed in it. As the field of information science continues to evolve, professional-level opportunities in traditional librarianship―especially in school and public libraries―have stalled and contracted, while at the same time information-related opportunities in non-library settings continue to expand. These two coinciding trends are opening up many new job opportunities for LIS professionals, but the challenge lies in helping them (and LIS students) understand how to align their skills and mindsets with these new opportunities. The new edition of G. Kim Dority's Rethinking Information Work: A Career Guide for Librarians and Other Information Professionals gives readers helpful information on self-development, including learning to thrive on change, using key career skills like professional networking and brand-building, and how to make wise professional choices. Taking readers through a planning process that starts with self-examination and ends in creating an actionable career path, the book presents an expansive approach that considers all LIS career possibilities and introduces readers to new opportunities. This guide is appropriate for those embarking on careers in library and information science as well as those looking to make a change, providing career design strategies that can be used to build a lifetime of career opportunity.

Guiney, Thomas. Getting Out. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198803683.001.0001.

Full text
Abstract:
Getting Out explores the evolution of early release in England and Wales between 1960 and 1995. In the past three decades crime has become a highly contested political issue with implications for the humanity, fairness, and effectiveness of the criminal justice system. This book seeks to turn current crime debate on its head and examine the circumstances in which politicians and policy-makers have found it desirable to reduce the custodial element of a prison sentence and encourage the rehabilitation offenders in the community. Drawing upon a period of detailed archival research this book considers three critical moments of reform which have helped to shape the historical evolution of this secretive and little understood area of public policy. It argues that early release has always been bound up with prevailing societal justifications for punishment and the appropriate use of imprisonment within our liberal democratic system. It draws attention to the uneasy constitutional balance of power between the judiciary and the executive, and reflects upon the administrative task of governing large captive populations where the hopes and expectations of inmates do not always align with the interests of prison authorities or the community at large. This book challenges widespread assumptions about policy change and shows how the historical evolution of parole in England and Wales was shaped, to a significant degree, by the legacy of past political choices and the fluid balance of power within government.

Full text
Abstract:
Missionaries and Indian elites cooperated in translating the gospel message into the indigenous languages. They faced an inevitable trade-off between fidelity to Christian orthodoxy and intelligibility within the alien Mesoamerican culture. The result was either a deficit of meaning for the neophytes or a surplus of meaning created by attaching alien indigenous connotations to the Christian discourse. Zapotec and other indigenous doctrinal texts reveal a range of choices: at one extreme, terms deemed untranslatable, like “God” and “soul,” were imported as loan words; at another extreme, difficult terms were given elaborate explanatory glosses (periphrasis) in the target language, which elucidated meaning but at the expense of economy and fluency of expression.

Abstract:
The Roman Empire systematically recognised alien polities in provincial landscapes and allowed them local powers of jurisdiction and legislation. It also created conditions of heightened human mobility and regularly endowed aliens with Roman citizenship. This chapter explores the procedural and theoretical resources developed by Roman authorities to deal with the conflicts of law that resulted from these processes. It explores principles governing choice of law, to wit, those of personality and territoriality. It also investigates procedural mechanisms that temporarily bracketed distinctions that rendered actions non-justiciable, for example, the legal fiction that assimilated aliens to citizens for the purposes of dispute resolution.
