Chez la chienne, la période périovulatoire est caractérisée par la lutéinisation des follicules préovulatoires, entraînant une augmentation importante du taux de la progestérone (P4) dans le sang, le fluide folliculaire, et probablement le fluide oviductal. De plus, à l'ovulation, les ovocytes sont libérés à un stade immature et des événements clés tels que la reprise de méiose des ovocytes, la fécondation et le développement embryonnaire précoce ont lieu dans les oviductes. L'objectif de cette thèse était de mieux comprendre les cibles et les rôles de la P4 en période périovulatoire chez la chienne. Dans un premier temps, l'expression des récepteurs nucléaires (PR) et membranaires (PGRMC1, PGRMC2, mPRa, mPRβ, mPRy) de la P4 a été étudiée dans l'oviducte et les complexes ovocyte-cumulus autour de l'ovulation. Les résultats mettent en évidence une expression de ces récepteurs dans l'oviducte et les cellules du cumulus, qui varie en fonction du tissu et du stade. Certaines de ces variations coïncident notamment avec la reprise de méiose des ovocytes et la fécondation. Dans un deuxième temps, l’aglépristone, un antagoniste du récepteur nucléaire de la P4, a été administré pour étudier les rôles de la P4 pendant la période périovulatoire chez la chienne. L'aglépristone ne modifie pas le taux plasmatique de la P4 ni le taux d'ovulation. Cependant, il retarde considérablement la reprise de méiose et perturbe la migration des spermatozoïdes dans l'oviducte, empêchant la fécondation. Ces résultats mettent en avant d'importants rôles joués par la P4 autour de l'ovulation chez la chienne. Les mécanismes d'action de la P4 sur ces processus restent à préciserIn the bitch, the periovulatory period is characterized by the luteinization of preovulatory follicles, causing a significant increase in progesterone (P4) concentrations in the blood, the follicular fluid and probably the oviductal fluid. Moreover, at ovulation, the oocytes are released at an immature stage and the key events such as oocyte meiotic resumption, fertilization and early embryonic development take place within the oviducts. The aim of this PhD work was to improve our understanding of the targets and roles of P4 during the periovulatory period in the bitch. At first, the expression of nuclear (PR) and membrane (PGRMC1, PGRMC2, mPRa, mPRβ, mPRy) P4 receptors was studied in the oviduct and oocyte cumulus complexes around ovulation. The results demonstrated a tissue- and stage-dependant variation in the expression of these receptors in the canine oviduct and cumulus cells. Interestingly, some of these variations coincide with the oocyte meiotic resumption and fertilization. In the second study, aglepristone, a nuclear receptor antagonist, was administered to study the roles of P4 during the periovulatory period in the bitch. Aglepristone neither affected plasma P4 levels nor the ovulation rate. However, it severely delayed oocyte meiotic resumption and impaired sperm progression toward the oviduct, preventing fertilization. These results points to the important roles played by P4 around ovulation in the bitch. The mechanisms of P4 action in these processes remain to be explored

La cinétique de la locomotion du chien repose sur la mesure des forces générées lors de l’appui. Cette technique constitue un véritable test fonctionnel de l’appareil locomoteur. Elle permet l’analyse dynamique des boiteries. L’efficacité clinique de traitements médicaux ou chirurgicaux peut être quantifiée. L’utilisation d’un tapis roulant instrumenté représente une approche originale. La locomotion sur tapis roulant est différente de la locomotion au sol, mais elle autorise l’analyse biomécanique. L’objectif de cette étude est de valider un test cinétique permettant l’évaluation des boiteries. La faisabilité et la répétabilité ont été établies à l’aide de 10 chiens analysés sur 3 jours consécutifs. La nécessité d’effectuer une séance d’accoutumance avant l’analyse a été démontrée à l’aide de 28 chiens sains d’une part et de 12 chiens malades d’autre part, étudiés une fois par semaine pendant 4 semaines consécutives. Le nombre de sujets nécessaire pour détecter l’influence d’un traitement a été estimé. Une diminution de l’appui a été décelée pour le membre boiteux. L’acuité du calcul de la symétrie pour l’identification des boiteries a été évaluée à l’aide de 36 chiens sains et de 13 chiens atteints d’une boiterie du train arrière. Une sensibilité et une spécificité élevée ont été obtenues par la combinaison de plusieurs variables. Ce test a permis d’établir de manière fiable l’intégrité ou la déficience de la fonction locomotrice. En comparaison avec les protocoles sur plate forme classique, la répétabilité supérieure, l’enregistrement rapide et facile des données, et la fiabilité de l’évaluation des boiteries confirment l’intérêt de ce test cinétique sur tapis roulantKinetics of dog locomotion is based on the measure of forces generated during stance. This is a real functional test for the locomotor system. It enables the dynamic analysis of lameness. The clinical efficacy of medical or surgical treatment might be quantified. Using an instrumented treadmill is an original approach. Locomotion on treadmill is different from locomotion on ground, but biomechanical analysis is possible. The aim of this study is to validate a kinetic test for lameness assessment. The feasibility and repeatability have been established with 10 dogs analysed on 3 consecutives days. Before performing analysis, a single training session was demonstrated to be necessary with 28 sound dogs then 12 lame dogs, studied once a week, 4 weeks in succession. The needed sample size to detect a treatment effect has been estimated. Load decrease has been observed for the lame limb. The accuracy of symmetry calculation to identify lame subject has been assessed with 36 sound dogs and 13 hind limb-lame dogs. High sensitivity and specificity were provided with a multivariate combination. This test made it possible to reliably establish the soundness of the locomotor system. Compared to classic protocols with in-ground force plates, the higher repeatability, the fast and easy data collection, the reliability of lameness assessment confirm the value of this kinetic test on a treadmill

Le chien présente un plasticité inégalée chez les mammifères. Malgré une origine lupique commune les races sont multiples et phénotypiquement très différentes. Cette diversité n’est pas sans implication en médecine vétérinaire : les nombreuses prédispositions et particularités raciales ne peuvent être omises par le praticien. Bon nombre des affections reconnues comme héréditaires ont des bases génétiques encore indéterminées. C’est dans l’objectif d’élucider les mécanismes à l’origine de ces affections que des outils génétiques tels que les cartes et de la séquence du génome canin ont vu le jour au cours des dernières années. L’utilisation de ces outils a permis l’identification des bases moléculaires de certaines affections comme la narcolepsie chez le Doberman et le Labrador, l’hépatite cuprique chez le Bedlington TerrierDog bears a plasticity that can’t be matched up by the other mammals. Despite a commun wolf origin canine breeds very diverse and different as far as phenotype is concerned. This diversity has a lot of veterinary medicine consequences : the many racial predispositions and particularities must be taken into account by the practitioner. Many of the diseases acknowledged as hereditary are yet genetically unknown. It’s to explore those affections mecanisms that genetic such as maps and dog genome sequence have rised this last years. Those tools allowed molecular bases identification of many affections such as narcolepsia in Doberman and in labrador, copper toxicosis in Bedlington Terrier

La première partie de la thèse présente des nouvelles méthodes statistiques pour détecter les motifs de fréquence exceptionnelle dans un génome. La principale contribution de ce travail est de proposer une mesure de l'exceptionnalité d'un motif qui tient compte d'une certaine hétérogénéité dans la séquence. Pour cela, nous établissons plusieurs approximations de Poisson composée pour la loi du comptage d'un motif râre lorsque la séquence suit un modèle markovien hétérogène, avec une hétérogénéité fixe ou aléatoire. Nous proposons aussi des procédures permettant de tester simultanément l'exceptionnalité de plusieurs motifs, ce qui introduit la thématique de la seconde partie de la thèse. Cette dernière est consacrée au problème statistique général consistant à tester simultanément un ensemble d'hypothèses nulles. Nous proposons notamment un nouvel éclairage sur les mathématiques mises en jeu dans les résultats classiques du contrôle du taux moyen de fausses découvertes (FDR), ainsi que de nouvelles procédures par rééchantillonnage pour contrôler non-asymptotiquement la probabilité d'avoir fait au moins une fausse découverte (FWER)The first part of the thesis presents new statistical methods to find words with unexpected frequencies in DNA sequences. The main contribution of this work is to take the sequence heterogeneity into account when assessing the exceptionality of a word. For this, we propose several compound poisson approximations for the count of a rare word in a Markovian heterogeneous model, with a fixed or a random heterogeneity. We also propose methods to test simultaneously the exceptionality of several motifs. This leads to the second part of the thesis, in which we consider the general statistical problem of testing simultaneously a given set of null hypotheses. First, we introduce a "set-ouput" point of view on multiple testing procedures, which gives short proofs for existing false discovery rate (FDR) control results. Second, new procedures are investigated, as adaptive procedures or resampling-based procedures. The latter are derived from general confidence regions and provide a non-asymptotic control of the family-wise error rate (FWER)

L’objectif de cette thèse est d’analyser une vaste collection de textes rituels taoïstes, le Guangcheng yizhi, qui a été compilé dans la province du Sichuan au 18e siècle. Cette collection est le fondement d’une tradition liturgique locale toujours vivante. La thèse aborde cette collection à la fois par une approche historique, en donnant le contexte social et religieux et en retraçant le processus de la compilation, de l’impression et de la diffusion, et par une approche de travail sur le terrain pour comprendre sa mise en pratique. Les deux premiers chapitres introduisent l’histoire du taoïsme au Sichuan depuis la dynastie des Qing jusqu’aujourd’hui, et plus précisément l’histoire textuelle du Guangcheng yizhi. Les chapitres suivants développent l’analyse de la tradition Guangcheng en développant la notion de "taoïste Guangcheng", et en explorant la typologie et la structure de ses rituels. Il s’intéresse à la construction d’un grand rituel par la combinaison de rites indépendants, et ce que ce processus nous apprend de la carte mentale que les taoïstes Guangcheng ont du répertoire de leur tradition. Enfin, le chapitre 6 développe le cas des rituels de repaiement de la dette de vie (huanshousheng) dans la tradition GuangchengThe basic theme of this dissertation is to understand a large collection of Taoist ritual texts from Sichuan, Guangcheng yizhi, first compiled in the 18th century and forming the basis of a living local ritual tradition. The dissertation uses both the historical approach (looking at the history of compiling, printing and using the collection) and fieldwork. The first two chapters introduce the history of Taoism in Sichuan since the Qing dynasty, and of the Guangcheng texts in particular. Then it explores the Guangcheng tradition developing notions such as “Guangcheng Taoist”, and the structure and typology of rituals. It analyses the building of a grand ritual and its “rundown” made of many smaller rites; this sheds light on the mental map of Taoists as they appropriate the shared ritual repertoire of their tradition. Finally chapter 6 analyses the ritual of repayment of life debt (huanshousheng) in the Guangcheng tradition

La caractérisation de l'activité enzymatique des (phospho)lipases requiert des tests enzymatiques spécifiques, continus, utilisant des substrats lipidiques et adaptés au criblage à haut débit des activités et/ou des inhibiteurs de (phospho)lipases. Afin de développer de tels tests, la synthèse de glycérophosphatidylcholine (PC) estérifiée en position sn-1 et/ou sn-2 par l'acide alpha-éléostéarique (acide 9Z, 11E, 13E, octadécatriénoïque) a été effectuée. La triple insaturation conjuguée présente au sein de cet acide gras constitue un chromophore intrinsèque qui confère une forte absorption dans le domaine de l'ultra-violet à cet acide gras et aux lipides le contenant. Les PC contenant l'acide alpha-éléostéarique ont été adsorbées par « coating » au fond des puits d'une microplaque de titration. L'hydrolyse du substrat lipidique par une phospholipase A1 (PLA1) ou phospholipase A2 (PLA2), injectée dans le milieu réactionnel, est suivie en continu par l'augmentation de l'absorbance à 272 nm, due à la transition de l'acide alpha-éléostéarique de la phase adsorbée à la phase aqueuse. Des PC hétérogènes ont été synthétisées à partir de rac-glycidol pour effectuer un marquage sélectif de la PC par l'acide alpha-éléostéarique sur la position sn-1 (EOPC) ou sn-2 (OEPC). Pour empêcher la migration de la chaîne acyle, un lien éther non hydrolysable par les PLA1 ou PLA2 a été introduit sur l'autre position sn de la PC avec une chaîne alkyl (C18). Ces PC chimiquement définies ont permis d'élaborer une méthode de dosage en continu de l'activité enzymatique et discriminant les activités PLA1 ou PLA2, ce qui représente un caractère innovant par rapport à toutes les méthodes existantesThe characterization of the catalytic activity of (phospho)lipases requires specific assays, that are continuous, sensitive, use lipidic substrates and could be applied to high throughput screening. In order to perform these tests, several tailor-made alpha-eleostearic (9Z, 11E, 13E-octadecatrienoic acid) containing glycerophosphatidylcholines (PC) have been synthetized with the alpha-eleostearic acid at the position sn-1 and/or sn-2. The conjugated triene present in this fatty acid constitutes an intrinsic chromophore and, consequently, confers strong UV absorption properties of the fatty acid and the lipids harboring it. PC substrates were coated onto a microplate well and the phospholipase A1 (PLA1) or phospholipase A2 (PLA2) activity was measured continuously by the increase in absorbance, at 272 nm, due to the transition of alpha-eleostearic acid from the adsorbed to the soluble state. Moreover, two structured analogues of PC labeled at the sn-1 (EOPC) or sn-2 (OEPC) position with the alpha-eleostearic acid have been synthetized from rac-glycidol. A non-absorbing and non-hydrolysable by PLA1 and PLA2 O-ether alkyl(C18) was introduced at the other sn position to prevent intramolecular acyl chain migration during the synthesis and the lipolysis. These structured PC were coated onto a microplate and used in a continuous assay, to discriminate, with excellent accuracy, between PLA1 or PLA2 activities. The development of a sensitive enzymatic method using coated substrates analogues to natural lipid is a relevant improvement from current assays for measuring continuously (phosphor)lipases activities and/or their inhibitors due to the alpha-eleostearic acid UV spectroscopic properties

A trajetória de Silvino Jacques e o contexto histórico do qual fez parte são a razão deste estudo. Da Fronteira Oeste no Estado do Rio Grande do Sul, onde começou a agir como proscrito, à sua atuação na Fronteira Oeste na parte Sul de Mato Grosso, Jacques, eliminado em 1939, incorporou mundos controversos nos quais se inserem sua conduta legalista no combate ao Movimento Constitucionalista de 1932, seus contatos com os revolucionários do movimento comunista de 1935 e suas práticas fora dos parâmetros legais do Estado Nacional. A abordagem considera aspectos fundiários, coronelismo, campesinato e suas vertentes política, social e econômica à época em que o governo federal visava centralizar a violência no combate a bandidos, bandoleiros e revolucionários. O período estudado, 1929-1939, corresponde a um Brasil que caminhava entre os mundos pré-capitalista e capitalista, com adequações e alterações, num ambiente que até então se caracterizava pela fragilidade das instituições e pelo mandonismo dos chefes paroquiais. Sobre a análise da estrutura fundiária do Sul do antigo Mato Grosso na década de 1930, Edward Palmer Thompson foi uma valiosa referência neste estudo. A teoria do bandido social criada por Eric J. Hobsbawm é aqui explicada de acordo com posicionamentos de pesquisadores que fizeram inserção crítica a partir daquela formulação hobsbawmiana. Enfocamos as rebeldias pré-organização política que se configuraram como os primeiros movimentos de contestação do poder estabelecido a serviço de interesses hegemônicos. Fizemos análise diferencial do comportamento considerado banditista na Fronteira Oeste em relação a outras partes do país, o cangaço no Sertão nordestino, por exemplo. Ressaltamos os propósitos do cangaço no Nordeste brasileiro em comparação com o banditismo na Fronteira Oeste.The trajectory of Silvino Jacques and his historical context of which he made part are reason for this study. Outcast of the West Border, in the State of Rio Grande do Sul, where he started acting like an outlaw man for his role in West Border in the southern part of Mato Grosso, Jacques, eliminated in 1939, incorporated controversial worlds, in which inserts his conduct in the legalistic combat Constitutionalist Movement and practices outside the legal parameters of the Nation State. The approach considers aspects of land, political chiefs, peasantry and the political, social and economic practices, to the time when the federal government sought to centralize the violence in fighting bandits, brigands and revolutionaries. The study period is 1929-1939, corresponding to a Brazil which walked between the precapitalist and capitalist worlds, with adjustments and changes in an environment that until then was characterized by weak institutions and parish heads. On the analysis of the agrarian structure of the old South Mato Grosso in the 1930s, Edward Palmer Thompson was a valuable reference in this study. The theory of the social bandit, created by Eric J. Hobsbawm, was explained according to researchers who have made placements critical insertion from that hobsbawmiana formulation. We focus on the rebellions pre-political organization that constitute the first movements of contestation of the established power in the service of hegemonic interests. We analyzed the differential behavior in the practices attributed to the bandits in the West Border in relation to other parts of the country, banditry in the Northeast, for example. We emphasize the purposes of banditry in the Northeast of Brazil compared to banditry in the West Frontier.

O objetivo deste estudo é examinar como os Modelos Mentais Compartilhados entre o principal executivo de informática e os demais executivos da alta direção influenciam o alinhamento estratégico de sistemas de informação nas organizações, bem como examinar os fatores que contribuem para a formação de um Modelo Mental Compartilhado. Alinhamento estratégico de sistemas de informação é definido como a congruência entre as estratégias do negócio e de sistemas de informação na organização. Modelo Mental Compartilhado é visto como um constructo multidimensional, composto de uma linguagem comum entre o executivo de informática e os demais executivos da organização e de um entendimento comum sobre o papel de sistemas de informação na organização. A coleta de dados foi feita por meio de uma pesquisa de campo aplicada em organizações atuantes no Brasil. A análise dos dados mostrou que o entendimento compartilhado entre o executivo de informativa e os demais executivos da alta direção sobre o papel de sistemas de informação pode influenciar positivamente o alinhamento estratégico de sistemas de informação nas organizações. Também foi mostrado que a existência de uma linguagem compartilhada entre o executivo de informática e os demais executivos, sistemas de conhecimento estruturais e os mecanismos de educação são precedentes de um entendimento compartilhado entre o executivo de informática e os demais executivos da organização. A similaridade demográfica e a similaridade de experiências passadas entre o executivo de informática e os demais executivos podem aumentar a interação informal entre o executivo de informática e os demais executivos da alta direção e promover sistemas de conhecimento sociais.The objective of this study is to examine how Shared Mental Models between the main information systems executive and the executives of the top management team influence the information systems strategic alignment within the organization as well as to examine the factors that contribute to the formation of a Shared Mental Model. Information systems strategic alignment is defined as the congruence between the business strategy and the information systems strategy within the organization. Shared Mental Models are seen as a multidimensional construct including a common language between the information systems executive and the top executives of an organization and of a common understanding about the role of information systems in the organization. The data were collected by field research with organizations acting in Brazil. The data analyses showed that the common understanding between the information systems executive and the top management team about the role of information systems can positively influence the information systems strategic alignment in organizations. It also showed that the presence of a common language between the information systems executive and the top management team, structural knowledge systems and education devices are precedents of a common understanding about the role of information systems in the organization. Demographic similarity and similarity of past experiences between the information systems executive and the top management team can increase the formal interaction between the information executive and the top management team and promote social knowledge systems.

Les textes littéraires dans l’enseignement du français, langue étrangère nous montrent l’emploi du lexique et de la morphosyntaxe dans un contexte linguistique, socioculturel et communicatif authentique. Ils motivent en outre les apprenants par un « plaisir de lecture ». Les textes illustrés ou les bandes dessinées renforceront ces objectifs et ils faciliteront encore mieux pour nos étudiants l’accès à la lecture grâce à la complémentarité du texte et de l’image. Astérix en sera le corpus principal, combinant le texte et l’image, la langue, la culture et des connaissances diverses. En comparant les interprétations variées des lecteurs chinois et des lecteurs français sur Astérix chez les Bretons, nous mettons en évidence l’interculturalité franco-chinoise, ce qui facilitera la compréhension de la langue et de la culture françaises. Le public visé est celui des étudiants de 3e année de licence des universités chinoises. Nous exploiterons ainsi la valeur pédagogique d’Astérix, tout en contribuant à la recherche sur l’emploi des textes illustrés et des bandes dessinées dans l’enseignement du FLE en ChineLiterary texts in teaching French as a foreign language show us the use of an authentic lexicon and morphosyntax, in a linguistic, socio-cultural and communicative context. By comparing the various interpretations of Chinese and French readers of Astérix in Great Britain, we bring to the fore Franco-Chinese interculturality, which will facilitate understanding of French language and culture. Chinese students in the third year of university curriculum are our targeted public. We will thus take advantage of the educational value of Astérix, while contributing to research on the use of illustrated texts and comics in teaching French as a foreign language in China

A partir desta obra, pretende-se espelhar o processo de relações estabelecido entre portugueses e chineses, tomando a narrativa como registro histórico que constrói a imagem da China no século XVI.This study encompasses the analysis of the book Tratado das Coisas da China by Friar Gaspar da Cruz, as an attempt to understand the addition of travel literature in the 16th century\'s mundialization process, which was undertaken by the Iberian maritime exploration led by Portugal during the Age of Discovery. Taking Gaspar da Cruz\'s work as basis, the study aims to mirror the Portuguese-Chinese relations established at the time, understanding travel narrative as a historical record that substantiates such relations, providing for an intercultural process with interlaced views.

This doctoral thesis approaches literary tourism initially from an historical perspective in order to define the phenomenon through a review of the existing academic literature in the field. The forms of literary tourism are analysed to provide a typology and from this the value of literary tourism is explained both from the visitor's point of view and the destination manager's. Current theories underpinning the existing literature on literary tourism, including Bourdieu's concept of cultural capital are reviewed. To extend the current state of research and to answer the research questions a case study of successful urban literary tourism is identified, in this case in Brittany, France. The uses of French literature in literary tourism are reviewed to provide a sound basis on which to examine French texts and tourist destinations. Novel methods of field research are developed to formalise and to make reproducible the methodology for this study and for future work drawing on, and seeking to combine both literary theory and ethnography. Following a pilot study on the French Riviera the full discovery instruments are designed and applied in fieldwork on the case destination, Concarneau, using the detective novel, The Yellow Dog, which is set in Concarneau. Analysis of the findings from this provide a new contribution to the field of literary theory, in the area of reader interpellation, and answer the research questions in the form of a new set of recommendations for DMOs and tourism stakeholders. From the empirical study that used Web 2.0 social media, only available since 2013, an analysis of which novels do stimulate literary tourism is presented for the first time. Out of the research process new methods have been evolved, and are presented in the conclusion, for the DMO to synthesise and leverage digital resources. This provides DMOs with interpretation processes for its managed heritage to use with its local stakeholders in hotels and in tourism businesses. Finally, an innovative conceptualisation of what constitutes tourism knowledge is proposed.

Le premier chapitre propose deux tests du multiplicateur de Lagrange de constance des corrélations conditionnelles dans les modèles GARCH multivariés. Si l'hypothèse nulle repose sur des corrélations conditionnelles constantes, l'hypothèse alternative propose une première spécification basée sur des réseaux de neurones artificiels et une seconde représentée par une forme fonctionnelle inconnue qui est linéarisée à l'aide d'un développement de Taylor.Dans le deuxième chapitre, un nouveau modèle est introduit dans le but de tester la non-linéarité des (co)variances conditionnelles. Si l'hypothèse nulle repose sur une fonction linéaire des innovations retardées au carré et des (co)variances conditionnelles, l'hypothèse alternative se caractérise quant à elle par une fonction de transition non-linéaire : exponentielle ou logistique ; une configuration avec effets de levier est également proposée. Whether the null hypothesis is based on constant conditional correlations, the alternative hypothesis proposes a first specification based on artificial neural networks, and a second specification based on an unknown functional form linearised by a Taylor expansion.In the second chapter, a new model is introduced in order to test for nonlinearity in conditional (co)variances. Whether the null hypothesis is based on a linear function of the lagged squared innovations and the conditional (co)variances, the alternative hypothesis is characterised by a nonlinear exponential or logistic transition function; a configuration with leverage effects is also proposed.In the two first chapters, simulation experiments and empirical illustrations show the good performances of our misspecification tests.The last chapter studies daytime and overnight information transmission in terms of returns and volatilities between China, America and Europe. commercialization managers of 62 CRCs. The survey items are categorized under four themes: relationships with collaborators, project management; design and implementation of agreements; and specific licensing issues. An analysis of the data, using a series of independent samples t-tests, repeated measures t-tests, chi-square tests for independence or relatedness and goodness of fit, shows a range of results. There are significant differences between executive directors and commercialization
managers on a number of issues. There are particular emphases or trends about certain issues for the whole sample of managers.
These findings are compared with text analyses of 23 CRC strategic planning documents. This is done in order to explore any similarity, difference or nuance between what the managers say in response to the survey items, compared with what is stated in the codified policies of the CRCs. While there is a high degree of
consistency among certain themes between the two sets of findings, the overall analysis points to the need for the CRCs to have a better understanding and practice of commercialization opportunities, especially through the involvement of third party commercial interests. It is argued that accommodating third party commercialization interests involves the application of an important knowledge economy principle that has an important bearing on the future economic viability and competitiveness of the CRCs.

Afin de produire des champs magnétiques intenses (100 T), les fils conducteurs utilisés dans les bobines pulsées doivent présenter une contrainte à la rupture élevée et une très faible résistivité électrique. Le LNCMI et l'équipe NNC du CIRIMAT explorent des solutions originales basées sur l'élaboration de fils de cuivre nanostructuré et de fils nanocomposites nanotube de carbone - cuivre (NTC-Cu) par la combinaison originale du spark plasma sintering (SPS) et de l'étirage à température ambiante. Des barreaux de cuivre ont été élaborés par SPS à partir de poudres commerciales micrométriques. La croissance cristalline est très faible et la taille des grains de cuivre est 10 fois plus petite que celle des précurseurs de fils classiques. Les barreaux ont été étirés, sans rupture, sous forme de fils de diamètre décroissant (jusqu'à 0,198 mm) et de plusieurs mètres de long. Les grains ultrafins de Cu sont fortement allongés dans la direction de l'étirage. Aucune macle n'a été observée. Tous nos fils de cuivre présentent une résistance à la rupture en traction (à 293K et 77K) supérieure à celle des fils préparés à partir d'un précurseur de cuivre OFHC classique, ce qui pourrait résulter de la combinaison de l'écrouissage et des mécanismes d'Orowan. La résistivité électrique des fils est environ 12% plus élevée que celle des fils de cuivre OFHC. Pour les composites NTC-Cu, une adaptation de la méthode de mélange (fonctionnalisation des NTC biparois et à huit parois, mélange, cryogénisation, lyophilisation, réduction sous H2) a permis de produire des lots de poudre de 14 g en ayant une dispersion homogène des NTC. Du fait de la très faible teneur en carbone (= 1%), la préparation des barreaux puis des fils par les méthodes employées pour le cuivre pur est possible sans modification. La contrainte maximale à la rupture des fils NTC-Cu est supérieure (10-25%) à celle des fils de cuivre correspondants. Les NTC ont peu d'influence sur la microstructure du cuivre et leur probable alignement permet de bénéficier de leur grande résistance en traction. La résistivité est légèrement supérieure à celle des fils de cuivre correspondants (environ 12% à 77K). Le dernier chapitre est consacré à la préparation d'éprouvettes " os-de-chien " (Cu et NTC-Cu) directement par SPS " near-net-shape ". Nous avons mis en évidence l'influence de la nature du matériau dans lequel est usinée la matrice (graphite ou WC-Co) sur la microstructure, la microdureté et la contrainte à la rupture, pour un même cycle de frittageIn order to produce high magnetic fields (100 T), the conducting wires used in pulsed coils must show both a high tensile strength and very low electrical resistivity. The LNCMI and NNC team of CIRIMAT explore creative solutions based on the development of nanostructured copper wires and carbon nanotube - copper (CNT-Cu) nanocomposite wires by the original combination of spark plasma sintering (SPS) and room-temperature wire-drawing (WD). Copper cylinders were prepared by SPS of micrometric commercial powders. Crystal growth is very low and the copper grains size is 10 times lower than for conventional wire precursors. The cylinders were wire-drawn, without breaking, into wires of decreasing diameter (down to 0.198 mm) and several meters long. The ultrafine Cu grains are highly elongated in the WD direction. No twinning was observed. Our copper wires show an ultimate tensile strength (UTS) at 293K and 77K higher than those for wires prepared from conventional OFHC copper, which could result from the combination of strain hardening and Orowan mechanisms. The electrical resistivity is about 12% higher than those for the OFHC wires. For the CNT-Cu nanocomposites, an adaptation of preparation route (functionalization of double-walled and eight-walled CNTs, mixing, freeze-drying, H2 reduction) resulted in the production of 14 g powder batches with a homogeneous dispersion of the CNTs. Due to the very low carbon content (= 1%), the preparation of the cylinders and wires by the methods used for pure copper is possible without modification. The UTS of the CNT-Cu wirers is 10-25% higher than for the corresponding copper wires. The CNTs have little influence on the Cu microstructure and their probable alignment allows one to benefit from their high tensile strength. The electrical resistivity is only moderately higher than for the corresponding copper wires (about 12% at 77K). The last chapter was devoted to the preparation of "dog-bone" Cu and CNT-Cu test samples by "near-net-shape" SPS. We have brought to the fore the influence of the nature of the die (graphite or WC-Co) on the microstructure, microhardness and tensile strength, for the same sintering cycle

Parmi les phlébovirus (famille des Bunyaviridae, genre Phlebovirus), ceux qui sont transmis par les phlébotomes de l'Ancien Monde sont largement distribués dans le bassin méditerranéen. Les infections humaines causées certains de ces phlébovirus sont connues depuis longtemps, mais elles restent tout de même négligées en médecine en raison de l'absence de données épidémiologiques solides (problème des réactions croisées) et d'outils de diagnostic rapides et fiables.La première partie de cette thèse a été consacrée à l'optimisation d'un test de neutralisation du virus pour étudier la séroprévalence de 5 virus, et leur capacité respective à infecter les humains et les animaux.La deuxième partie visait à mesurer la séroprévalence de phlébovirus appartenant aux 3 complexes antigéniques transmis par les phlébotomes dans le bassin méditerranéen (Sandfly fever Naples, Sandfly fever Sicilian et Salehabad). Ces études ont été menées sur des sérums de chiens et de chats en Tunisie, Portugal, Grèce/Chypre.La troisième partie a montré la capacité de virus récemment découverts dans le serocomplexe Salehabad (Adana et Medjerda valley virus) à infecter l'homme et les animaux traduisant un potentiel pathogène à explorer par des études spécifiques.La dernière partie a démontré la présence du virus Toscana en Kabylie (Algérie du Nord), et l'exposition extrêmement élevée des populations humaines vivant dans la région, avec des prévalence 10 fois plus élevées que dans les régions les plus à risque du sud-est de la FranceSandfly-borne phleboviruses, transmitted by phlebotomine sandflies and belonging to the genus Phlebovirus within the Bunyaviridae family are widely distributed in Mediterranean basin. Human diseases caused by infection with phleboviruses are known for a long time, but they are still neglected due to the lack of epidemiological knowledge and of diagnostic tools.The first part of this thesis was dedicated to optimize a comparative virus neutralisation test to study the seroprevalence of selected phleboviruses and to assess the capacity of each virus to infect humans and animals. The second part aimed to estimate the epidemiology of phlebovirus serocomplexes (Naples, Sicilian and Salehabad) in Mediterranean basin. In order to update the presence of these viruses and their capacity to infect animals, several serologic studies were carried out on animal blood samples in Tunisia, Portugal, Greece and Cyprus. The results demonstrated that the phleboviruses belonging to 3 distinct groups are widely circulating and capable to infect non human vertebrate at different rates in studied countries.The third part showed the capacity of newly discovered viruses (Adana and Medjerda valley viruses) belonging to Salehabad serocomplex to infect human and animal at low and high rates, respectively. These findings suggest the medical and veterinary importance of these viruses. The last part of this thesis, confirm the circulation of Toscana virus by seroprevelance study which was carried out in local population in north Algeria where Toscana virus was isolated recently. The high rate of circulate suggests that Toscana virus is heavily affecting sandfly-exposed people in Algeria

Early in the ship design process, naval architects must often evaluate and compare multiple hull forms for a specific set of requirements. Analytical tools are useful for quick comparisons, but they usually specialize in a specific hull type and are therefore not adequate for comparing dissimilar hull types. Scale model hydrodynamic testing is the traditional evaluation method, and is applicable to most hull forms. Scale model tests are usually performed on the largest model possible in order to achieve the most accurate performance predictions. However, such testing is very resource intensive, and is therefore not a cost effective method of evaluating multiple hull forms. This thesis explores the testing of small scale models. It is hypothesized that although the data acquired by these tests will not be accurate enough for performance predictions, they will be accurate enough to rank the performance of the multiple hull forms being evaluated.

Cette thèse se concentre sur quelques sujets de probabilités et statistique liés à la génomique comparative. Dans la première partie nous présentons une approximation de Poisson composée pour calculer des probabilités impliquées dans des tests statistiques pour la significativité des régions génomiques conservées trouvées par une approche de type région de référence.Un aspect important de notre démarche est le fait de prendre en compte l'existence des familles multigéniques. Dans la deuxième partie nous proposons trois mesures, basées sur la distance de transposition dans le groupe symétrique, pour quantifier l'exceptionalité de l'ordre des gènes dans des régions génomiques conservées. Nous avons obtenu des expressions analytiques pour leur distribution dans le cas d'une permutation aléatoire. Dans la troisième partie nous avons étudié la distribution du nombre de cycles dans le graphe des points de rupture d'une permutation signée aléatoire. Nous avons utilisé la technique ``Markov chain imbedding'' pour obtenir cette distribution en terme d'un produit de matrices de transition d'une certaine chaîne de Markov finie. La connaissance de cette
distribution fournit par la suite une très bonne approximation pour la distribution de la distance d'inversion.

Notre recherche porte sur l’analyse d’un processus spécifique d’apprentissage par le concept d’ingegno du philosophe napolitain Giambattista Vico : La pratique du débat de l’Ecole Gelugpa du bouddhisme tibétain. Dans une première partie, à travers une anthropologie de son geste et de son imaginaire, nous présentons le déploiement de l’ingegno et la dimension transdisciplinaire de cette pratique traditionnelle de formation. Dans une deuxième partie, nous utilisons l’outil AT9 pour faire une lecture herméneutique de l’imaginaire de moines tibétains pratiquant le débat. A travers les projections de soi que constituent les AT9 réalisés, nous cherchons les traces des projections des apprentissages et leur dimension transdisciplinaire. Nous concluons ou plutôt offrons aux praticiens transdisciplinaires, la mise en débat d’un outil transdisciplinaire transformateur des pratiques de formation telles que les nôtres se sont métamorphosées au long cours de notre apprentissage de chercheurOur research focuses on the analysis of a specific process of learning: The concept of ingegno by the Neapolitan philosopher Giambattista Vico: The practice of the debate of the Gelugpa School of Tibetan Buddhism. It is concluded, or rather offered to the transdisciplinary practitioners, the debate of a transforming tool of the transdisciplinary training practices, such as ours have been transformed during the course of our learning researcher

This dissertation studies how postmodern texts respond to the issue of identity crisis and give suggestions for constructing networked identity in the postmodern society. The features of spatilization in postmodern and globalizing cultures－plurality, decentralization, heterogeneity, and fragmentation, as well as their “space of flows,” have induced identity crisis of different kinds in postmodern society. Therefore, the possible methods by which to construct identity within postmodern context becomes a subject worthy of investigation. This thesis explores the issue of identity construction in postmodern spatialized texts. Through theorizing, modeling and text analysis, it is found that in postmodern spatialized texts there exists a so-called ”Chinese garden”text which provides mechanisms for constructing identity. This type of text forms a locale and facilitates identity construction with the mechanisms of “disjunction-articulation-networking” and “un/concealing the path of scenic imagery, or the author’s subject position” . These mechanisms are not only embedded in the forms of the texts, but also embodied in the content, to represent the way characters construct their identities. The mechanisms are furthermore used to stimulate the readers to construct their own identities as well. This study bases itself on S. Hall’s understanding of postmodern subjectivity as an intersection of fluctuating subject positions determined by language, culture, and social structures. It also draws upon J. Lyotard’s viewpoint of paralogy to expound Hall’s idea of articulation in creating coexistence of differences. Then, with the theories of E. Laclau and M. Castells, the thesis explains that the “articulation” mechanism can also instigate communication and negotiation among individuals and entities on different levels in the society, to induce respect and recognition between them, forming a society that functions through “networking” practice. From these theories it can be conceived that although there is no meta-narrative to support identity, the“disjunction-articulation-networking”mechanism will be a viable strategy to create identity in a globalized and information society. Furthermore, the thesis uses Borges’novel“Garden of Forking Paths”and Chinese literati garden to create a“ ‘Chinese garden’ text”model. This model supports the “disjunction-articulation-networking” identity construction mechanism, and also poses another mechanism for identity construction, “un/concealing the path of scenic imagery”. In the construction of a Chinese garden, the creator not only sets many view-points and builds an intricate set of routes for journeyers to connect out their own paths, but also guides them through a suggestive scenic imagery. This mechanism can be a way to provide suggestive meanings in a networked locale. The thesis then uses the constructed model to analyze two “Chinese garden” texts, Chen Yinke and Liu Rushi and Califia , as a way of illustrating how the model is found both in the form and content of the texts. Although the analyzed texts are of different genres and countries of origin – one being a Chinese post-modern play/novel, and the other an American digitalized hypertext, both works reflect the model mechanisms proposed by this thesis. By pluralizing the history of Chinese intellectuals since Ming Dynasty while retaining and re-interpreting its emotional idealism, Chen Yinke and Liu Rushi suggests a way to form networked cultural identity for contemporary China. Califia, on the other hand, constructs collective identity for Los Angels or California through its digitalized and networked history. Both texts, then, show that fragmentation and openness for re-articulation as essential for forming “networking identity” in a globalized and information society. With these studies, this dissertation elaborates on the following arguments. The way to construct “networked identity”in postmodern society is through creating a locale. This locale first provides multiple autonomous subject positions, and enable these subject positions of same level be articulated through mutual recognition and respect. Secondly, within the locale linkages are formed between different level of individuals and entities, creating connections between the subject and the past, forming a networked history. Lastly, the locale provides suggestive guidance for the subjects/actors to have chance to connect with the culture of a specific context, or the postmodern spirits of a place, while allowing the subjects/actors to choose their own fluctuating path of identity.

Due to the fast development of 3C products in recent three decades, people live in a more convenient life with the equipment of integrated system. When we enjoy the benefits brought by high technologies, however, it lead to that the environment is full of electromagnetic noise that might cause chronic injury to human health. In hence, European Union enforced Electromagnetic Compatibility (EMC) Directives, stipulating all electrical products must be conducted all examination about electromagnetic interference (EMI), quality of electronic transmission, and tolerance to verify whether the designs of EMC conform to the regulations, furthermore, only the products with CE symbol which means the products pass the EMC authentication are allowed to sale in the EU market. Since the international safety regulation is getting more and more strict, all domestic electronic and electrical manufacturers make efforts on fitting in with the ECM directive for import and export, and therefore, the EMC test labs are growing rapidly. In Taiwan, except for the SPORTON INTERNATIONAL INC., the only one scaled listed company at over-the-counter market in the ECM test industry, the others are all small and medium labs. The most important issues for the operators of small and medium labs are how to survive in the competitive environment with limited source and with what kind of strategies to improve and grow steadily. This study will focus on the area of EMC test industry, taking small and medium labs, Chiun-Ying Technology, as case study, collecting the related information published by professional institutions at home and abroad, journals, and public information of EMC test companies, and do further research with materials above. The purpose of the study is to provide recommendation of business operation strategy to new entry small and medium EMC test labs and existed labs.

This paper engages its research object to Pey-Chwen Lin’s work series “Antithesis and Intertext” to probes into the dialectics and intertext of works in female consciousness of subjectivity. The “Antithesis and Intertext” series one of is the most important works in Lin’s period of so called “deconstruct of Patriarchy” which was first exhibited at Taipei Fine Arts Museum in 1995. Although this series that belonging to the early period is very significant in her transformation of creation, which has postmodern features as well as multi-textual expression of “Inter-texts” and “dialectics”, along with a distinct subject of female consciousness that also influences her later period works style. This study has certain aspects as following: firstly, to explores Pey-Chwen Lin's life with her artistic cultivate background at the creation narration, through an interview in-depth with the artist; to understand the evolution and concepts of her creation career in concerning about certain issues and interrelationship with relevant course of her life expansion; moreover, to compare her with Mary Kelly conceptual work of “Post Partum Document”, in addition, to try to explore Pey-Chwen Lin's inspiration for creation from those ideas, also to survey the evolution of style development. Since the custom of women’s “foot-binding” in the oriental tradition is an important symbol in shaping of Lin’s “Antithesis and Intertext” from which the issue was orientated itself into her conception, so I have to explore the creative motives in the exhibition to depict its derivation of sign foot-binding, and with this genealogy we can review their form and content in a post-modern aspect. Furthermore, based on the analytic theory of semiotics and hermeneutics, this paper takes on surveying the multiple textual and dialectics in Lin’s work as well as elucidating the invisibility and implication within the text-interpretation in hermeneutic perspectives. And finally, in the bodily performance of “female Consciousness of subjectivity” and “anti-mythic” into de-embodiment, this paper is required to respond to the social reality and it critique through mutual dialectics. In addition to reflection of the female arts and relevant arts criticism, and following the trace of western feminist art and the development of Taiwan female arts, as well as reviewing of arts evaluation on “Antithesis and Intertext” namely in a historical point of view, we do examine how the influential and development of female consciousness of subjectivity was formed in Pey-Chwen Lin’s works. The conclusion, showing in the internalizing process of explicit awareness of female consciousness, we can see a boundless enthusiasm and dedication to art in Pey-Chwen Lin devoting to the inheritance of art education, her increasing to establish more influence and consequence endowment in Taiwan art, then to end with this paper we try to give some suggestions with future study to a whole review of her outstanding works.

As the British were preparing their imminent withdrawal from Hong Kong on the eve of the 1997 Handover, the city officials begin enacting a series of reforms related democratization and representational governance. Beijing’s newly established office of Chief Executive was mandated to report directly to the central government. Granted a wide range of powers, the Chief Executive became Hong Kong’s primary administrative entity. The purpose of this arrangement was to allow Hong Kong to retain the essential features of its original administrative structure while simultaneously enabling the central government to fully lead and supervise the governance of the city. To put it succinctly, since the Handover, the growth and development of Hong Kong’s system of governance, especially in regards to democratization, has been curtailed by Beijing at every turn. In this flashpoint of contradiction between new and old systems of administration, the social ideals held by powerful political communities and those of ordinary citizens have come into sharp conflict. Both sides hold incompatible understandings regarding the relationship between community and citizen as well as on the nature of citizenship itself. The political communities undertake a top-down approach promoting the liberal citizenship tradition. Regular citizens, on the other hand, take a bottom-up approach when putting their ideals into practice. This type anti-traditional liberal methodology seeks to redefine the concepts of and relationship between political community and citizenship, consummating in the gradual creation of a corporate citizenship. What are the causes and cures of Hong Kong’s incessant social conflicts? In this paper it is argued that “ripping apart” is actually the beginning stage of “communication.” Although Beijing has not formally disassembled its “one country, two systems” framework, the central government is nonetheless in direct control of policy in Hong Kong. This fact was evidenced in both the quantitative and qualitative changes of the Umbrella Movement. The people currently have no means of expanding their influence in the government, despite the use of elections and various other measures—authoritarian governments do not make reforms on their own accord. This paper takes the relationship between state and society as its starting point and examines research on the production of social movements and development mechanisms from the three-fold perspective of change, structure and discourse. This paper studies the scale of Hong Kong’s reoccurring social movements utilizing a concrete analysis of events set against the backdrop of a society in transition. Entailed in this analysis is an observation the structural elements associated with Hong Kong’s social, economic and political transformation. An attempt will be made to construct a structural analysis of the current discourse (e.g., social norms and arrangements, self-identity, legality) as well as to present an explanation model that combines the three elements of change, structure and discourse. This research indicates that problem resolution should involve rationalizing the relationship between nation and society, which would result in Hong Kong and the central government becoming equal participants in the discourse of self-identity along with an increased consensus regarding the legality of the Hong Kong government’s policy initiatives. Future social movements could be promoted with a greater degree of efficiency, resting as they would on the basis of more robust social institutions. The continual fomenting of frustration among the lower strata of society is a reflection of the Hong Kong citizenry’s unwillingness to submit to the conditions imposed on them by Beijing in order to survive. This discontent has already spread to sections of the middle class. Unresolved political issues such as this can only lead to continued civic unrest. How could dissenters, confronting the powerful Chinese Communist Party, hope to gain universal suffrage without the use of protests? Would no universal suffrage and no democracy change this situation for the better? Hong Kong’s democratic movement thus faces a three-pronged predicament: (1) the central government, applying pressure on all sides, has shattered city’s hopes of democracy; (2) the failure of democratic reforms has left the problem of governance unresolved; (3) the deep social rift that emerged in the aftermath of the Umbrella Movement.

O segundo objectivo passa por obter um modelo com correlação total, depois de deduzir o teorema fundamental onde se obtém a função característica conjunta de um número finito de time-changed Lévy processes sob a medida de alavancagem neutra. Posteriormente, obtivémos a função característica exacta para o preço de um activo com volatilidade estocástica, taxas de juros estocásticas, saltos e correlação total. Tanto quanto sabemos, foi a primeira vez que se obteve a função característica exacta de um modelo com volatilidade estocástica, taxas de juros estocásticas, saltos e correlação total.
This thesis focuses on applying the time-changed Lévy processes technique firstly presented by Carr and Wu (2004) in order to deduce the Bakshi et al. (1997) model with a general jump size distribution. The second goal is reach a full correlation scheme, after reaching the fundamental theorem, where we show how to compute the joint characteristic function of a finite number of time-changed Lévy processes under the leverage-neutral measure, we obtain an exact characteristic function for an asset price with stochastic volatility, stochastic interest rates, jumps and a full correlation scheme. As far as we know this is the first time that the exact characteristic function of an model that take into account stochastic volatility, stochastic interest rates, jumps and a full correlation scheme is achieved.

This thesis argues that the ‘rule of law’ was not followed in
colonial and post-federation Australia in relation to a
fundamental principle of the common law. According to the rule in
Calvin’s Case (1608), no person born as a ‘subject’ in any
part of the King’s dominions could be an ‘alien’. This was
the legal position in Australia from the reception of English law
until well after federation.
In colonial and post-federation Australia the racial meaning of
‘alien’ was consistently used in political and legal contexts
instead of its proper legal meaning. In legislation and
parliamentary debates, cases and prosecutions, inter-colonial
conferences and conventions it was employed to refer not merely
to those who were ‘aliens’ under the common law but also to
people regarded as ‘aliens’ in the broader or racial sense of
the word, especially those of non-European background. Chinese
and Indian settlers, Pacific islanders and even indigenous
Australians were treated as ‘aliens’ in Australia even if
under British law they were actually ‘subjects’ of the Crown
and not ‘aliens’ at all in the accepted legal sense.
In the 1820s and 1830s the New South Wales Supreme Court thought
it inconceivable that ‘barbarous’ indigenous inhabitants
could ‘owe fealty’ or allegiance to the British Crown,
considering their legal position analogous to that of
‘foreigners’ or ‘strangers’. In debates on exclusionary
legislation in the 1870s and 1880s, parliamentarians in the
Australian colonies portrayed all Chinese settlers as
‘aliens’, despite acknowledging that many came from Hong
Kong, the Straits Settlements or other British possessions.
Immigrants from British India were generally treated the same
way. Delegates to Australia’s constitutional conventions in the
1890s, including prominent legal figures, repeated this mistake.
And in the 1900s Pacific islanders born in Australia as British
subjects were deported as ‘aliens’ with the approval of the
Australian High Court. The misuse of ‘alien’ in this case
contributed to a defective judgment still cited today in support
of the Commonwealth’s claims to extensive exclusionary power.
Between federation and the Second World War, Queensland’s
dictation test legislation and industrial awards regulating
various occupations provide many examples of the misuse and
manipulation of the term ‘alien’ in a legal context. In
prosecutions under these laws the word was used as a weapon
against non-Europeans whether they were ‘aliens’ under the
law or not.
Commentators both in the early years of federation and in more
recent times have failed to identify the misuse of ‘alien’–
and have made the same error themselves. This mistake is critical
because of the continued force of the term in Australian law. The
Commonwealth’s sweeping power to define who shall be citizens
of Australia and to exclude, detain indefinitely without trial
and deport ‘aliens’ is still justified by reference to
colonial and post-federation cases and constitutional convention
debates where ‘alien’ was incorrectly used in its racial
sense contrary to the rule of law.

American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law.
These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism.
In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method.
This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior.
The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent.
The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will.
Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
