Abstract:
This thesis examines the interpretation and application of the Criminal Justice Act 2003 (UK), Part 11 Chapter 1, which came into force on 15 December 2004. Part 11 Chapter 1 concerns evidence of bad character, a concept approximately comparable with common law similar fact evidence, in relation to all parties who may be connected with a criminal trial. The admission and use of similar fact evidence has often been the subject of controversy, and the significant changes made by the CJA 2003 have attracted their own body of support and criticism. The nine chapters of this thesis attempt an in-depth study into the impact of the legislation on the robustness and effectiveness of the criminal trial, and consider whether the criminal trial is suited to the level of exposure of bad character now facilitated by the CJA. In particular, the thesis focuses upon the key provisions governing the uses of bad character evidence of the defendant: the seven gateways set out in s 101 of the CJA. The operation of those gateways and their accompanying explanatory provisions is examined through a combination of engagement with the Law Commission’s Report 273 (which preceded the enactment of the legislation), the range of Court of Appeal cases dealing with the legislation, and academic commentary. It was foreshadowed by commentators and early case law that the new provisions might not be easy to interpret or apply, and subsequent cases have borne out this prediction. An analysis of the bad character provisions suggests that, even though the CJA was intended to provide clarity in regulation, it has itself led to confusion in some important respects. Certain central terms lack definition, and some provisions have unintended consequences. The case law reflects this in its frequent, often brief, and sometimes inconsistent analysis of the specific parts of the legislation, which can make it difficult to determine the defendant’s guilt or innocence in a precise and scrupulous manner.

The current study aims to a) identify the history aspects of personal life, the phases of the evolutional development, and the familiar and affective relations of women serving time in closed incarceration, with the intention of collecting significant and contributory elements for the comprehension of the criminal female vulnerability; b) perform a systematic analysis of character, according to the Wilhelm Reichs approach, from the clinical speech content of these women. For such, three cases were studied regarding female prisoners in closed incarceration at the Resocialization Female Center, in the city of São José do Rio Preto, who are responding for Articles 33 and 35 of Law 11343.06, which refers to illicit drug trafficking and the association with the crime, and Article 157 of the Brazilian Penal Code, which relates to theft. The content of the interviews conducted indicated serious difficulties in growth and development caused by unfavorable environmental and psycho-emotional distress or unsatisfactory relationships. It was equally found in the cases studied, according to a Reichian analysis, an indication of oral fixation, in other words, unsatisfactory oral traits related to early childhood, indicating little identificatory reference that offers them the basis to defend themselves from reality. It was understood that such developmental failures may indicate vulnerability to criminal actions as a defense against anguish, causing them to act more immediately or impulsively in pursuit of satisfaction.
O presente estudo teve por objetivos a) identificar aspectos da história de vida pessoal, das etapas de desenvolvimento evolutivo e das relações familiares e afetivas de mulheres que cumprem pena em regime fechado, com o intuito de colher elementos significativos e contributivos para a compreensão da vulnerabilidade criminal feminina; b) realizar uma análise sistematizada do caráter, segundo abordagem de Wilhelm Reich, a partir do conteúdo do discurso clínico dessas mulheres. Para tal foram estudados três casos de mulheres reclusas em regime fechado no Centro de Ressocialização Feminino, na cidade de São José do Rio Preto, que respondem pelos artigos 33 e 35 da Lei 11343/06, que refere-se ao tráfico de drogas ilícitas e a associação para o crime, e artigo 157 do Código Penal Brasileiro, que refere-se a roubo. O conteúdo das entrevistas realizadas indicou graves dificuldades no crescimento e desenvolvimento por ambiente desfavorável e por relações psico-afetivas empobrecidas ou insatisfatórias. Encontrou-se em comum nos casos estudados, segundo uma análise reichiana, indicativos de fixação na oralidade, ou seja, traços orais insatisfatórios relacionados à primeira infância, indicando pouca referência identificatória que lhes oferecesse base para defenderem-se da realidade. Entendeu-se que tais falhas desenvolvimentais podem indicar vulnerabilidade para ações criminais como forma de defesa contra angústia, fazendo com que atuem de forma mais imediata ou impulsiva na busca de satisfação.

Нинішній стан розвитку України та її прагнення до інтеграції в єдиний європейський простір вимагає фундаментальних та комплексних змін в багатьох сферах життєдіяльності держави. Безумовно, однією із таких сфер є кримінально-правова політика. Однією із ключових категорії кримінального права є саме кримінальна відповідальність. Проблематика кримінальної відповідальності здається на перший погляд винятково теоретичною проблемою, вирішення проблемних аспектів якої не викликає труднощів ні в законодавця, ні в науці кримінального права, оскільки різноманітні проблемні питання інституту кримінальної відповідальності вже багато років дискутуються в науці. Проте, незважаючи на це, інститут кримінальної відповідальності має пряме та безпосереднє відношення до правозастосовної діяльності правоохоронних органів держави та суду, які забезпечують реалізацію кримінальної відповідальності, а тому з цього випливає, що кримінальна відповідальність є одним із основоположних інститутів кримінального права. Метою дослідження є вивчення особливостей інституту кримінальної відповідальності як самостійного інституту кримінального права. Об’єктом дослідження виступають суспільні відносини, що виникають та розвиваються при застосуванні кримінальної відповідальності. Предметом дослідження є кримінальна відповідальність як самостійний інститут кримінального права.
The current state of Ukraine's development and its desire to integrate into the single European space requires fundamental and comprehensive changes in many spheres of state life. Undoubtedly, one of such spheres is criminal law policy. One of the key categories of criminal law is criminal liability. At first glance, the issue of criminal liability seems to be a purely theoretical problem, the solution of problematic aspects of which does not cause difficulties for either the legislator or the science of criminal law, as various issues of the institution of criminal liability have been discussed in science for many years. However, despite this, the institution of criminal liability is directly and indirectly related to the law enforcement activities of state and court law enforcement agencies, which ensure the implementation of criminal liability, and therefore it follows that criminal liability is one of the fundamental institutions of criminal law. The purpose of the study is to study the features of the institution of criminal liability as an independent institution of criminal law. The object of research is the social relations that arise and develop in the application of criminal liability. The subject of the study is criminal liability as an independent institution of criminal law.

The consumer’s penal protection is an essential stake, even more so following the last legislative reforms that occurred in the matter. The consumer’s consent’s protection represents the very essence of criminal law’s intervention in the consumerist sphere. Abstract:
This study examines how criminals are portrayed in Martin Widmark’s series of children’s detective stories, JerryMaya’s Detective Agency. The aim of the study is to find out what patterns and norms are communicated through this popular series for children aged seven to nine. Fourteen books in the JerryMaya series were selected and analysed to see how the criminal is portrayed, what motives are presented and what are the consequences of the criminal act. The study shows that several of the crimes in the JerryMaya series concern morality and legislation, and that there is often a moral criminal alongside a criminal who breaks the law. In eight of the fourteen books the crimes are some form of theft, and in five of them the consequence is an arrest. Only three books contain crimes that are not theft, and in these cases the books are about subjects such as revenge, attempted escape and cheating. For example, a person who steals money is punished according to law while a person who takes revenge for being bullied as a child is given the task of lecturing about anti-bullying. The consequences of the crimes thus often depend on the situation and the criminal’s motives.

Ungdomsbrottslighet är ett utbrett problem i världen och inte minst i Sverige. I denna studie undersöktes förekomsten av ungdomsbrottslighet och i vilken grad personlighet (Cloningers biopsykosociala modell för unga), familjeförhållanden och vänners brottsliga beteende relaterar till detta. Vidare studerades i vilken grad brottsligheten skiljer sig åt beroende på kön och bostadsområde. Studien genomfördes på ett urval om 1461 ungdomar i årskurs 7 och 8 som en del i projektet LoRDIA. Resultaten beskriver ett tydligt positivt samband mellan ungdomars brottsliga beteende och personlighetsdraget Novelty Seeking (sensationssökande, d.v.s. att individen är impulsiv, utforskande och spänningssökande). Vidare återfanns ett negativt samband mellan brottslighet och familjesammanhållning och ett positivt samband mellan brottslighet och vänners brottsliga beteende vilket tyder på att en god sammanhållning inom familjen verkar som en skyddande effekt mot brottslighet medan umgänge med kriminella vänner ökar risken för brottsligt beteende. Studien visade vidare att det finns tydliga könsskillnader i ungdomars brottsmönster. Förutom att killar begår fler brott än tjejer visade det sig att personlighetsdraget Novelty Seeking, som har ett generellt statistiskt signifikant samband med brottslighet, inte gav ett signifikant samband för killar boende i ett sämre socioekonomiskt område. Studien framhåller att både individuella karaktäristika och sociala band är viktiga för förståelsen av förekomsten av ungdomsbrottslighet.
Juvenile delinquency is a widespread problem in the world and not least in Sweden. This study examined juvenile delinquency and the extent to which personality (the Cloningers biopsychosocial model for the young), family relationships and friends' criminal behavior relate to this. Furthermore, the extent to which crime differs depends on gender and residential area. The study was conducted on a selection of 1461 adolescents in 7th and 8th grade as a part of the LoRDIA project. The results describe a pronounced positive relationship between youngster's criminal behavior and the personality trait Novelty Seeking (i.e. the individual is impulsive, exploratory and sensational seeking). Furthermore, there was a negative correlation between crime and family cohesion and a positive correlation between crime and friends' criminal behavior, which suggests that good cohesion within the family seems to be a protective effect against crime while dealing with criminal friends increases the risk of criminal behavior. The study further showed that there are pronounced gender differences in youth patterns of crime. In addition to boys committing more crimes than girls, it appeared that the personality trait Novelty Seeking has not a generally statistically significant relationship with crime for boys living in a worse socioeconomic area. The study emphasizes that both individual characteristics and social ties are important for understanding the existence of juvenile delinquency.

S’il est une rêverie poursuivie par de nombreux écrivains au XIXe siècle, c’est bien celle d’une femme criminelle dont la beauté, l’énergie et la violence séduiraient l’homme, s’empareraient de lui pour l’enfermer dans les rets d’une féminité toute-puissante et dangereuse. Les romans du XIXe siècle se signalent par une étonnante et foisonnante galerie de criminelles sublimes ou monstrueuses. De 1789 jusqu’au début du XXe siècle, le personnage de la criminelle concentre des craintes, des fantasmes, des projections, qui diffèrent d’un mouvement littéraire à l’autre. Parce qu’elle a transgressé l’image de donneuse de vie, de porteuse de paix et d’épouse fidèle que les hommes lui ont attribuée, la femme criminelle suscite une curiosité. Sujet complexe, relevant de champs aussi divers que la justice, la médecine et la philosophie, le crime féminin déroute. Cette recherche se propose de comprendre les raisons de ce phénomène littéraire à travers quatre axes. C’est l’inscription du personnage de la criminelle dans le cours de l’Histoire qui dans un premier temps nous intéresse. Les grandes criminelles de la mythologie, de la Bible, de l’Histoire et des journaux de l’époque sont une source d’inspiration pour les romanciers. C’est cette intertextualité que nous sonderons avant de voir que la figure de la criminelle est un oxymore poétique : ange de douceur, elle est capable de violence meurtrière. Face à cette dualité se pose le problème de sa représentabilité. Nos écrivains optent pour une représentation du personnage soumise à l’influence du discours scientifique, sécuritaire et médical. If there is one reverie pursued by a lot of 19th century writers, it’s the one of a female criminal whose beauty, energy and violence would seduce men, in order to catch them in the toils of an omnipotent and dangerous femininity. 19th century novels distinguish themselves by the portrayal of an astonishing and rich collection of sublime or monstrous female criminals. From 1789 until the beginning of the 20th century, the character of the female criminal concentrates fears, fantasies and projections which differ from one literary movement to another. Because she has transgressed the image of a life-giver, peace-bearer and faithful wife that men have credited her with, the female criminal has aroused curiosity. A complex subject, coming within areas as diverse as justice, medicine and philosophy, crime perpetrated by women is puzzling. This research is aimed at studying the reasons of this literary phenomenon in four main lines. First of all, we will focus on the character of the female criminal in the course of History. The great female criminals of mythology, the Bible, History and newspapers of that time have been a source of inspiration for novelists. We will analyse this intertextuality before arguing that the figure of the female criminal is a poetical oxymoron: a sweet angel, she is also capable of criminal violence. Facing this duality the problem of her representation is posed. Our writers opted for a representation of the character under the influence of the scientific, security and medical discourse. The questions of ethics and aesthetics will be examined in the last section

Дисертацію присвячено дослідженню міжнародно-правових аспектів співробітництва держав у боротьбі з фальшивомонетництвом. Визначено соціальну і політико-правову обумовленість формування міжнародно-правового механізму протидії злочину. Проаналізовано ряд міжнародно-правових документів, національне законодавство України і зарубіжних держав у цій галузі. Досліджено діяльність Інтерполу та Європолу у сфері міжнародного співробітництва в боротьбі з фальшивомонетництвом, а також види і форми відповідальності за скоєння даного злочину. Проведено критичний аналіз сучасного стану міжнародного співробітництва держав у боротьбі з фальшивомонетництвом. Сформульовані пропозиції щодо вдосконалення існуючого міжнародно-правового механізму і національного законодавства, спрямовані на підвищення ефективності протидії злочину.
The thesis is devoted to international and legal aspects research which regulate states’ cooperation in struggle against counterfeiting. Social, political and legal conditions of international and legal mechanism of counteraction to the above mentioned crime which has international character is defined. A number of international and legal documents, national legislation of Ukraine and foreign states in the specified sphere is analysed. The activity Interpol and Еuropol in the field of states’ international cooperation in struggle against counterfeiting is investigated. Regimes and grounds of responsibility for the mentioned given crime of international character are also investigated. Critical analysis of modern state of international cooperation in struggle against counterfeiting is accomplished. Recommendations of international and legal mechanism and national legislation directed on increasing the effectiveness of counteraction to the mentioned crime are formulated.
В диссертации исследованы международно-правовые аспекты сотрудничества государств в борьбе с фальшивомонетничеством, сущность и современные проблемы такого сотрудничества. Изложенная история развития фальшивомонетничества определила социальную и политико-правовую обусловленность процесса формирования международно-правового механизма противодействия преступлению и необходимость международного сотрудничества в этой сфере. Анализ единственного универсального соглашения в сфере международного сотрудничества в борьбе с фальшивомонетничеством - Международной конвенции по борьбе с подделкой денежных знаков 1929 года - указывает, что в современных условиях, ряд ее положений устарел и требует значительных изменений и дополнений. Прежде всего, это касается расширения сферы действия конвенции на борьбу с преступлениями, связанными с поделкой ценных бумаг и платежных карточек. С учетом всех изменений и дополнений к данной конвенции представлен проект Конвенции о борьбе с подделкой денежных знаков, ценных бумаг и платежных карточек. Значительное внимание уделено исследованию деятельности Международной организации уголовной полиции (Интерполу) как центру международного сотрудничества в борьбе с фальшивомонетничеством и Европейскому полицейскому ведомству (Европолу), которое приобретает все большее значение в области координации взаимодействия национальных правоохранительных органов стран-членов ЕС в борьбе с данным преступлением. Указывается, что фальшивомонетничество может совершаться как индивидами, так и государствами. Поэтому исследованы виды и формы ответственности индивидов и государств, причастных к данному преступлению. Проведен критический анализ действующих международно-правовых документов, в том числе принятых у рамках СНГ, национальное законодательство Украины и зарубежных стран в области борьбы с фальшивомонетничеством и наказания за него. В диссертации представлены рекомендации для усовершенствования международно-правового механизма и национального законодательства, направленные на повышение эффективности противодействия фальшивомонетничеству.

A process that has been based on four different approaches: Theory - Critic - History - Image working together to find aspects that have shaped the area for over a 100 years of industrial development. Characteristics that should be acknowledged as an inherent part of Lövholmen and a new development that becomes part of the spatial context that already exists.

First, this work proposes a study of the origin, elements and application of the Compliance Program or, also named, Regulatory Compliance Program. The aforementioned program is understood as an internal device that corporations use not only to comply with the current legislation but also to prevent and detect legal violations they could be found in or as part of the activities they carry out.Second, it tries to explain and develop the connection between, on one hand, the new risks in the financial and technological development and, on the other hand, Criminal Law as a protective body of important legal assets for society. The aim is to analyze Criminal Compliance to get the corporationto manage its activities under current legislation, especially Criminal Law.In this regard, it enlarges the sectoral developments based on the Peruvian Government’s implementation of the the Compliance Program in the legal framework.Finally, it analyzes the impact of Criminal Compliance in the criminal legal framework. For that end, it refers to the criminal liability system in Peru and in what way it impacts on the application of Criminal Compliance.
El trabajo propone, en primer lugar, un estudio del origen, los elementos y la aplicación del Compliance Program o, también llamado, Programa de Cumplimiento Normativo, entendido como un dispositivo interno que las empresas implementan para cumplir con la normatividad vigente, así como para prevenir y detectar las infracciones legales que se produzcan dentro de las mismas o como parte de las actividades que estas realizan. Asimismo, se intenta explicar y desarrollar la relación entre los nuevos riesgos, debido al desarrollo económico y tecnológico, y el derecho penal como ente protector de bienes jurídicos de importancia para la sociedad. Esto último tiene como finalidad analizar el Criminal Compliance, destinado a que la empresa ordene su actividad conforme a la normativa aplicable, en especial la ley penal. En tal sentido, se desarrolla la aplicación que el Estado peruano ha realizado del referido Programa de Cumplimiento Normativo en el ordenamiento jurídico, en concreto los avances sectoriales. Finalmente, se analiza el impacto del Criminal Compliance en el ordenamiento jurídico penal. Para ello, se hace una referencia al sistema de responsabilidad penal adoptado en el Perú y de qué manera esto impacta en la aplicación del Criminal Compliance.

Abstract:
The total character of a finite group G is the sum of the irreducible characters of G. When the total character of a finite group can be written as a monic polynomial with integer coefficients in an irreducible character of G, we say that G is a total character group. In this thesis we examine the total character of the dicyclic group of order 4n, the non-abelian groups of order p^3, and the symmetric group on n elements for all n ≥ 1. The dicyclic group of order 4n is a total character group precisely when n is congruent to 2 or 3 mod 4, and the associated polynomial is a sum of Chebyshev polynomials of the second kind. The irreducible characters paired with these polynomials are exactly the faithful characters of the dicyclic group. In contrast, the non-abelian groups of order p^3 and the symmetric group on n elements with n ≥ 4 are not total character groups. Finally, we examine the special case when G is a total character group and the polynomial is of degree 2. In this case, we say that G is a quadratic total character group. We classify groups which are both quadratic total character groups and p-groups.

Abstract:
In the age of big data, character becomes a newly foregrounded object – and product – of scrutiny. New credit scoring methods, which draw on big data analytics, claim to paint rich, nuanced pictures of prospective borrowers’ “true characters.” Micro-entrepreneurs, such as hosts on Airbnb, trade in reputation-images, seeking the best possible ratings and reviews in an online marketplace built on highly visible metrics. Surveillance apparatuses (both governmental and corporate) place ever more emphasis on propensity, analyzing not what a person has done so much as what she might do in future. In doing this, such apparatuses construct, enforce and enact new ways to hold people accountable for their represented, future selves – and to the characters understood to link their present selves to those futures. How might artists best respond to new social and economic pressures placed on character (as a concept governing representations of particularity and propensity) in the age of big data? What can be learned from contemporary art about the new economies of character, given art’s long-standing, privileged relationship to the production and circulation of its artists’ and subjects’ (perceived and represented) “characters”? Examining a wide range of artworks – including some recent works that respond directly to big data, but also many more that, more broadly, anticipate its perceptual politics – I argue that a significant response to such problems can be found in works that disturb the distinction between embedded, first person perspectives and so-called objective, external viewpoints on their subjects. Representations that trouble the distinction between shared and first-person perspectives enact the tension between privacy and sharing that has become increasingly vital to speculative market logics linking character to finance. The shared/private space of the disturbed first-person view lends perceptual logic to the personalization of prediction afforded by big data, and stages contemporary conflicts between privacy and sharing, quantities of data and qualitative perception.

Este trabalho busca entender se crimes no estado de Santa Catarina apresentam um comportamento racional. Foram analisados somente crimes que apresentam fins monetários, em uma medição utilitarista na comparação entre rendas provindas do trabalho e crime. As bases dedados acessadas focam o período de 2011. Investigam-se duas hipóteses: os crimes analisados não possuem um retorno positivo e que a renda esperada representa um importante papel nas escolhas entre trabalho e crime. A abordagem econométrica, linear multivariada OLS, foi aplicada nos determinantes da renda, enquanto que os dados criminais receberam uma análise descritiva e probabilística. Os resultados indicam suportar as hipóteses.

Abstract : This paper tries to understand whether crimes in the state of Santa Catarina behave rationally. Only crimes that have monetary purposes, in a utilitarian measure in comparingrents stemmed from work and crime, were analyzed. The databases accessed focused on the period of 2011. Two hypotheses were investigated: that the crimes analyzed didnot have a positive return and that the expected in come has an important role in the choice between work and crime.The econometric approach, multivariate linear OLS wasapplied in determining the income, while the criminal data received a descriptive and probabilistic analysis. The results indicate that the hypotheses are supported.

Tratar de tema tão relevante como a dimensão constitucional do tribunal do júri, com o fito de, em última instância, mostrar a razão por que se enquadra dentre os direitos fundamentais não é tarefa das mais singelas. É cediço que os direitos fundamentais decorrem de conquistas históricas que devem ser bem compreendidas e valoradas. São características principais dos direitos fundamentais a historicidade, a inalienabilidade, a indisponibilidade, a indivisibilidade e a imprescritibilidade. Não por outra razão, os direitos fundamentais são reputados os direitos básicos de uma sociedade que viva sob a égide do Estado Democrático de Direito, como, à guisa de exemplo, os direitos à vida, à liberdade, à propriedade, ao meio ambiente, à saúde, à educação, à cultura. Neste viés, busca-se, nesta dissertação, resgatar a evolução histórica do tribunal do júri até seu estádio atual, inserido na Constituição Federal de 1988 — a Carta Cidadã —, onde se encontra inserido como garantia fundamental do cidadão. Sem embargo das críticas lançadas contra os julgamentos populares, por decorrência do influxo da cultura positivista-normativa, é certo afirmar que essa instituição resistiu a todos os regimes ditatoriais e subsiste até os dias atuais, sendo o maior exemplo de arena na qual os princípios da ampla defesa e contraditório e da amplitude de defesa são exercitados à exaustão.
Addressing a topic as relevant as the dimension of the constitutional jury trial, aiming, as final instance to show the reason why it falls among the fundamental rights is not the simplest task. It s evident that fundamental rights are the result of historical achievements that must be understood and valued. Its historicity, inalienability, non-availability, indivisibility and imprescriptibility, are the main features of fundamental rights. For no other reason, fundamental rights are deemed basic rights of a society living under the aegis of a democratic state, as, by way of example, the rights to life, liberty, property, environment, health, education, culture. In this way, we seek to, in this work, to rescue the historical evolution of the jury to its current stage, inserted in the Constitution of 1988 - the Citizen Charter - where it is included as a fundamental guarantee of the citizen. Notwithstanding from the criticisms launched against the popular judgments, due to the influence of the positivist-normative culture, it is right to say that this institution has resisted all dictatorial regimes and continues until the present day, being the greatest example of arena in which the principles of contradictory and full defense and range of protection are exercised to exhaustion.

O panorama de nossos dias, onde a criminalidade atingiu índices elevadíssimos, gera uma enorme preocupação na população mundial ante a proliferação de organizações criminosas especializadas em práticas de crimes graves que atingem bem jurídicos e direitos fundamentais como a vida, a paz pública, a liberdade em todas as suas esferas, o meio-ambiente, a saúde pública, a ordem econômica, a probidade administrativa, o voto direto, entre outros direitos. Diante dos ataques a bens jurídicos relevantes, o Estado, como tem se tornado costume, busca uma lei emergencial que possa criar tipos penais para solucionar e acabar com as ações criminosas destas organizações de maneira imediata. Ocorre que, tais normas não tem o poderio para enfraquecer o crime organizado no que diz respeito à sua estrutura financeira e ações delitivas. Com isso, tenta-se incutir nas sociedades a falsa idéia de combate às organizações criminosas de maneira efetiva. É dentro desta realidade que o trabalho inicia-se tratando da origem do crime organizado no Brasil bem como faz a análise das principais organizações criminosas brasileiras. Em seguida, estuda-se a legislação comparada sobre o tema e as diversas leis pátrias que tratam de associações criminosas, em especial a Lei 9.034/95 – Lei do Crime Organizado. A seguir, são realizados estudos de alguns projetos de leis em andamento no Congresso Nacional sobre o tema e uma sugestão de lei de combate ao crime organizado. Por fim, passa-se às considerações finais a cerca do tema a partir de um estudo científico e casuístico da matéria.
The overview of present days, where the criminality reached very high levels, creates a huge preoccupation on the world’s population front of the increase of specialized criminal organizations practicing felonies that reach legal rights and fundamental rights as life. Public peace, freedom in all levels, environment, public health, economical order, administrative integrity, the direct vote and many others are among these rights. Front of the attack on legal significant rights, the State, as it has been usual, searches for an emergency law that may create penal types to solve and end the criminal actions of these organizations in an immediate way. It occurs that such rules do not have the power to weaken the organized crime in its financial structure and outlaw actions. So, it has been tried to infuse in the societies the false idea of combat to the criminal organizations in an effective way. It is inside of this reality that begins the work treating with the origin of organized crime in Brazil as well analyzes the main Brazilian criminal organizations. Right after, it is studied the legislation compared the theme and the many laws that treat the criminal associations, especially Law 9.03495 – Law of Organized Crime. It has also been realized studies of some projects of laws in course in the National Congress about the theme and a suggestion of law to combat the organized crime. At last, final considerations about the theme whereof a scientific and casuistic study of the subject.

This thesis discusses Ben Jonson's innovative concept of character as an effect of interactions in dramatic, political and literary spheres. The Introduction observes how the early modern understanding of ‘character' was built on classical rhetorical theory, and argues its relevance to Jonson's rhetorical and performative representations of characters. Chapter 1 looks into the bridge between epigrams and character writing, and examines the rhetorical influence of the grammar-school exercises of Progymnasmata on Jonson's representation of characters in his Epigrams. Chapter 2 examines character as legal ethos in Catiline, analysing the discourse of law that constitutes Cicero's struggle to issue senatus consultum ultimum and examining the way Catiline represents character and mischief to address the problematic issues of power and authority in King James' monarchical republic. Chapter 3 explores Jonson's challenge in his integration of the emblematic characters of Opinion and Truth in Hymenaei, and argues that the underlining contemporary medico-legal discourses help the masque to accommodate conflicting characters. Chapter 4 discusses the problematic characterization of news and rumours in Volpone, The Staple of News and the later masques, and considers the way Jonsonian characters strive to find trustworthy and legible signs of others in their exchanges of information. In Conclusion, the thesis confirms the need to re-acknowledge Jonson's writings in terms of character as rhetorical effect of these imagined interactions.

The thesis reconstructs Hume’s conception of character. Character is not just an ethical concern in Hume’s philosophy: Hume emphasises the importance of character in his ethics, aesthetics and history. The reconstruction therefore pays attention to Hume’s usage of the concept of character in his clearly philosophical works, the Treatise of Human Nature and the two Enquiries, as well as his less obviously philosophical works, the Essays, Moral, Political and Literary and the History of England. The first main thesis is that Hume’s conception of character includes multiple heterogeneous elements. These include passions, habits, natural abilities and possibly general rules. These elements are combined to form a coherent character through social organisation and conventions. The elements underpin character attributions, but it is argued that Hume is not concerned with identifying elements with character traits, as he is interested in characters as a whole rather than individual traits. The second main thesis is that the character of judges is central to Hume’s philosophy. Hume’s most sustained character of a judge is to be found in the essay ‘Of the Standard of Taste’. Close examination of this essay with particular attention to the character of the true judge reveals that such judges should not be conceived of as ideal, as some commentators on the essay have supposed. It is further argued that the true judge can be used, with some modifications, as a template for the moral judge, which Hume requires for his moral philosophy but never fully articulates. The two theses are mutually supporting in that the judges examined in accord with the second thesis are conceived of in terms of the first thesis, i.e. they are conceived of by Hume as characters constituted by heterogeneous elements. The first thesis receives support from the second thesis, as the reality of the elements supposed in the first thesis is undermined by a failure to appreciate the importance of judges as characters in Hume’s philosophy.

Abstract:
This thesis argues that Kant has a viable, intellectualist account of moral character that is much richer and more interesting than has often been thought. This account is consistent with his broader practical philosophy, in particular, his account of moral worth. Chapter one establishes that Kant has a theory of education on which a child's inclinations are to be trained in preparation for her to grasp the moral law and acquire full moral agency. It argues that his account of habit is complex, recognizing a kind of moral value that is broader than his definition of moral worth. Chapter two argues that sympathy is, for Kant, a primarily cognitive disposition of special importance; this is because it provides knowledge of how the moral law applies in particular circumstances, therefore enabling an agent to fulfill her duties toward others. This chapter also resolves a puzzle concerning Kant's dual concept of character (as both intelligible and empirical) by drawing an analogy with one account of weakness of will. Chapter three develops an account of moral worth that incorporates these more palatable elements of Kant's account of moral character with the seemingly more austere elements familiar from the Groundwork. This theory allows for positive, participating inclinations alongside ascriptions of moral worth. Further, it introduces a distinction between full and mitigated moral worth, to account for agents who, for example, act rightly but for confused reasons as in the case of Twain's Huckleberry Finn. Chapter four responds to two objections to Kant on the basis of moral demandingness, one concerning psychological integration and personal relationships, the other concerning the value of non-moral goods more broadly. It then responds to some objections to his account of the highest good, or the idea of a world in which happiness is distributed in proportion to virtue.

This thesis addresses Ontario's current state of transition into mandated character development education that began with the onset of the Character Development Initiative at the beginning of the 2007/2008 school-year. The history of moral and character development educational efforts in Ontario, and in the broader North American context, is presented with specific attention paid to the development of pedagogies for character development and moral growth. By examining the pedagogical approaches suggested in three readily available resources published in the recent past and in use by teachers in Ontario data on what kinds of pedagogical approaches pre-date the Initiative was gathered. Data was collected from the introductions of each resource initially in order to establish the suggested or intended pedagogical approach by assessing statements of philosophical positioning. This was followed by a careful reading of the activities presented in the resource for teacher directives. The concept of pedagogical continuity was central to the analysis of these documents, and this extended to consistency of the resource's treatment of critical engagement. Commonalities were observed in the techniques and strategies suggested in the resources, especially where cooperative education is concerned. The common use of cooperative education in the documents was observed with a high level of internal continuity in the documents, and external continuity with the expectations of the Character Development Initiative was also seen. Levels of critical engagement in the resources varied, yet no document singled out that characteristic as being of high importance. This research adds to the knowledge base on pedagogy in the Ontario context as it relates to character development and opens the door for further studies of this nature.

This thesis will go through how to create good topology for a humanoid character that will be animated for a game.   First, I will go through some things to keep in mind and why they are important. I will then create two different models, one when I’m following the principles i have gone through in the thesis and one when I don’t do that and then compare the results to anatomy references.   The two models will have the same weight paints as far as possible and will play the same animation.   The purpose is to be able to use this thesis as a help with that your supposed to think about when you create your characters topology and how to avoid simple mistakes.
Denna rapport kommer gå igenom hur man skapar bra topologi för en humanoid karaktär som ska animeras för ett spel.   Först kommer jag ta upp lite olika saker man ska tänka på och varför det är viktigt. Jag kommer sedan skapa två olika modeller, en när jag mer följer det som jag har gått igenom och en när jag inte gör det och sedan jämföra dem med anatomi referenser.   De två karaktärerna kommer ha så lika weight paints som möjligt och köra samma animation.   Syftet är att man ska kunna ha den här rapporten som hjälp med vad man ska tänka på när man skapar sin karaktärtopologi och hur man kan undvika simpla misstag.

The crisis affecting the Brazilian criminal justice system is often attributed to the inefficiency of the Judiciary Police and the ineffectiveness of the police investigation as a means of investigation of criminal acts. However, the problem takes another relevance when we analyze the criminal investigation in depth in accordance with the democratic principles and constitutional values. We pass, then, to realize that the shortcomings of the investigation procedures are not structural in nature but rather due to interpretive paradigms built under the aegis of political exception regimes. This reveals the need to put in place a contemporary criminal procedure hermeneutics, in which proper criminal investigation, constitutional and legally produced, is regarded as fundamental rights protection instrument, unfolding as real tool for promoting human dignity. Grounded on these assumptions should follow the doctrinal and jurisprudential construction and legislative reforms aiming to improve the extra-judicial phase of the criminal prosecution, consolidating the police investigation as true procedural criminal procedure of a garantista nature, aimed at achieving the constitutional ideal of due process, a principle of the Democratic State of Law
A crise que acomete o sistema de Justiça Criminal brasileiro muitas vezes é imputada à ineficiência da Polícia Judiciária e à ineficácia do inquérito policial como meio de apuração de fatos delituosos. Contudo, a problemática toma outro relevo quando analisamos a fundo a investigação criminal à luz dos princípios e valores constitucionais democráticos. Passamos, então, a perceber que as deficiências do procedimento investigatório não são de cunho estrutural, mas sim decorrentes de paradigmas interpretativos edificados sob a égide de regimes políticos de exceção. Isso nos revela a necessidade de colocar em prática uma hermenêutica processual penal contemporânea, em que a devida investigação criminal, constitucional e legalmente produzida, seja encarada como instrumento de proteção de direitos fundamentais, desvelando-se como verdadeira ferramenta de promoção da dignidade humana. Alicerçadas nessas premissas devem seguir as construções doutrinárias e jurisprudenciais e as reformas legislativas que visem aprimorar a fase extrajudicial da persecução criminal, consolidando o inquérito policial como verdadeiro procedimento processual penal de cunho garantista, voltado a concretizar o ideal constitucional de processo justo, princípio este basilar do Estado Democrático de Direito

The written text, and approaches to reading it, serves well as an analogy for the classroom space as a “text” that teachers are able to compose; and students are able to read, interpret meaning(s) of, and make responses to and about (Rosenblatt, 1988). Researchers point to ways in which the classroom can be conceptualized as a text to be evoked, experienced, and read (Freire & Macedo, 1987; Powell, 2009; Rosenblatt, 1988; Spears-Bunton & Powell, 2009). The present study analyzed secondary data including: 10 transcripts of teacher talks and six self-reports retrieved from the program evaluation archives of DOR Foundation. The data described six teachers’ classroom experiences subsequent to professional development centered on Goma character education curriculum that was used during a summer youth program located in South Georgia. Goma, an acronym that stands for Goal, Objective, Method, and Attitude, is a character education paradigm derived from The Inclusive Community Building Ellison Model, the theoretical framework used for this study. The Model identifies conflict resolution as one of its five foci (Hunt, Howard, & Rice, 1998). Hunt (2006) conceived Goma as part of a 7-Step unitary process, also named the 7-Step pathway, to demonstrate how conflict resolution is accomplished within a variety of contexts. Analysis of the data involved: (a) a priori coding of teacher talks transcripts using the components of the Goma 7-Step pathway as coding categories, (b) emergent coding of teacher talks transcripts for the types of experiences teachers evidenced, and (c) emergent coding of teachers’ self-reports for categories of teachers’ instructional activities. Results of the study showed positive influence of Goma curriculum on participating teachers and their instructional practices. Teachers were shown to have had cognitive, instructional, emotional, and social experiences that were most evident when they reported changes in their attitudes toward their students, themselves, and their instructional practices. The present study provided implications for classroom teachers wherein all aspects of teachers’ instructional practices can be guided by principles of positive character; and can be used to help compose the kinds of “texts” that may likely contribute to a classroom character culture.

Expanded thesis statement: The two styles differ from start to finish in a variety of ways. I believe that semi-realistic characters require more source material when drawing and modeling; however stylized characters require a different level of creativity and artistic ability in creation. Modeling semi-realistic characters will be more dependent on source images while stylized characters may require special attention with non-standard texture, style, etc. Rendering techniques will also differ when it goes to presenting the final polished versions with the stylized character focusing on rendering styles that flatten the character while the semi realistic character will require rendering techniques that make it seem more real visually.

As a result of the expansion and development of international law and the proliferation of international courts and tribunals, judges working in different institutions are increasingly coming to encounter similar issues of law and fact. Consequently, new opportunities have arisen for judicial cross-referencing at the international level, raising the question of when and how judges should use the decisions of other institutions in the course of their decision-making. This thesis examines the use of judicial decisions at the International Criminal Court (lCC). The Court operates as part of a wide institutional framework which responds to the commission of mass atrocity. Many of the issues that arise before the Court will already have been considered by other judicial institutions at the international, regional and domestic levels. The thesis sets out the parameters for judicial crossreferencing at the ICC, taking into consideration developments within the international legal order regarding the sources of international law, treaty interpretation and international fact-finding, and the benefits and risks associated with judicial interaction in the international criminal context. It looks at how judicial decisions should be· used in the identification of international law at the ICC, the interpretation of the Rome Statute and the establishment of the facts underlying the charges. It then turns to consider the approach that has been taken to judicial cross-referencing in the early years of the Court's operation through the use of two empirical methods: interviews with judges and legal officers of the ICC and content analysis of the decisions of the Court in the case of Prosecutor v. Thomas Lubanga Oyi/o. Drawing upon Hart's idea of primary and secondary rules, the research also reflects upon the extent to which the secondary rules of international law - rules which determine how international law's primary obligations are identified, adjudicated and changed over time - accommodate the practice of judicial crossreferencing at the ICC. It is argued that judicial decisions have a strong role to play in the interpretation of the Rome Statute and the identification of international law beyond its provisions. Judicial decisions offer a source of inspiration and guidance for judges as they encounter gaps and ambiguities in the law. By interacting with other courts and tribunals, judges at the ICC can enhance the certainty and stability of international law and support its coherence as similar rules and principles come to be applied by a range of different judicial institutions. It is argued that greater caution should be exercised when cross-referencing in matters of fact due to the attendant risks for the rights of the accused in the international criminal context. The results of the empirical study show that judicial decisions have been referred to frequently in the early years of the Court's operation. In practice, judicial decisions have a far greater significance than they have been attributed in the ICC's secondary rules of international law. It is concluded that there is need for a more elaborate body of secondary rules of international law which accurately reflects the important role that judicial decisions have come to play within the international legal order. ii

This thesis develops a theoretical account of the basis and justification for the doctrine of Joint Criminal Enterptise in international criminal law by examining principles governing the ascription of criminal responsibility in English and German criminal law. The first part consists of a comprehensive review of the development of the JCE doctrine, including its historical antecedents, its initial formulation by the ICTY, its subsequent explication by tribunals and academics, and recent alternatives doctrines proposed by the ICC and by commentators. It identifies the main loopholes and contradictions in the construction of these theories, and presents factual scenarios for which these theories, particularly JCE, either have no answers, or problematic ones. The second part examines whether any of the variants of JCE can be justified as principal responsibility. It first identifies elements that distinguish international crimes from their domestic counterparts, and which are pertinent in developing an account of criminal responsibility for international crimes. It also examines the concept of perpetration responsibility in English and German criminal law and theory. It then combines the insights gleaned from these analyses to conclude that only JCE I can be appropriately considered as perpetrator responsibility and proposes a modified version of the doctrine of Organisationsherrschaft in German criminal law as a more accurate characterisation of the role and function of high level participants in mass atrocity. The final part focuses on the concept of accomplice responsibility in German and English criminal law and doctrine to address whether JCE II and JCE III can be justified as modes of secondary criminal responsibility. It concludes that JCE II and JCE III can be retained as distinct modes of accomplice liability using expressive and risk justifications, provided their operation is limited in ways that correspond to principles of secondary responsibility in domestic jurisdictions.

This dissertation defines and defends the concept of ‘criminal oppression.’ Criminal oppression occurs when people are excluded from full participation in important social and political institutions because they are perceived to have violated certain community norms. Oppression is primarily a structural phenomenon, in which practices of formal and informal institutions unjustly harm people based on group membership. In structural oppression, there is rarely an individual who can be said to be responsible for the oppression, but I argue that at times, individuals may also be agents of oppression when they create, perpetuate, or exacerbate structural oppression. Applying this theory of oppression, the criminal justice system in the United States is an oppressive structure that unjustly harms those considered to be ‘criminals’ through a variety of practices. There are three categories of unjust practices: policing, adjudication and punishment, and collateral effects of arrest and conviction. These three categories of practices create the social group ‘criminals’ by subjecting certain people to these kinds of treatments. I use the word ‘criminal’ to describe those who are treated as criminals by police, the courts, and even private individuals like employers. To be a ‘criminal,’ it is not necessary that one has committed a crime or been convicted of a crime. Racial and criminal oppression deeply related historically and conceptually. Nevertheless, they are distinct kinds of oppression. In the United States, those who are not racially oppressed but are ‘criminals’ face many of the same unjust obstacles as those who are racially oppressed in addition to being ‘criminals.’ Some may argue that ‘criminals’ duly convicted of crimes deserve to be socially and politically excluded. But, I argue that the criminal justice system is not properly conceived of as an apolitical institution that can assess moral blameworthiness. Nor should it be able to offer punishments that amount to social and political exclusion. Instead, the criminal justice system is one political institution amongst many, and it ought to be governed by the same principles of liberty and equality that govern other political institutions. Criminal law’s proper function is to facilitate government as a system social cooperation. Therefore, it ought to respond to criminal acts with actions designed to promote inclusion rather than exclusion. Moreover, even if someone has committed a crime, that does not mean that they ought to be subject to violence or permanent second-class status. Finally, I address specific, feminism-driven arguments for using the criminal justice system to fight violence against women. Some feminists argue that the expressivist function of punishment—the ability of punishment to express disapproval and disavowal—makes it a perfect tool for fighting the normalization of violence against women. The problem, they contend, is that this violence is under-punished in the United States, and the solution to ending violence against women is to increase prosecutions and advocate for harsher punishments because punishment will change the social norms and make violence against women rarer. To this, I argue that those who create laws or mete out punishments do not have control over the social meaning of punishment with precision. The historical and present-day oppressive features of criminal law and punishment interfere with the ability of prosecution and punishment to condemn certain types of acts without also condemning people. Thus, feminists who try to use the criminal justice system to fight gender-based violence will find it to be ineffective and potentially harmful to the already oppressed group of ‘criminals.” Chapter 1argues that ‘criminals’ are oppressed using a structural model of oppression that focuses on how collections of institutional policies and practices can create and maintain unjust power relations between groups of people. I will also use an externalist theory of group identity to argue that being arrested or convicted of a crime is not necessary or sufficient for membership in the social group ‘criminal.’ Chapter 2 explains the relationship between racial oppression and the oppression of ‘criminals,’ noting the historical development of the modern prison system. Chapter 3 argues that the proper role of criminal law is to support systems of social cooperation, not to punish pre-political wrongs. I will suggest that criminal law is in essence part of the social contract, not a separate sphere of justice to which distinctive, retributive principles apply. Instead, the criminal law cannot determine moral blameworthiness and is only justified in sanctioning rule violations for the sake of supporting social cooperation in a society whose institutions are worth supporting. In Chapter 4, I propose a feminist, expressivist defense of the use of prosecution and harsh punishment as a response to rape and domestic violence that takes the structural nature of violence against women into account. Chapter 5, however, demonstrates why even this theory cannot justify incarceration in the non-ideal sphere because of the oppressive history and practice of the American criminal justice system

A production pipeline of different game companies is explored with the idea of creating characters specifically designed for games. A character was created following the different components of a real game studio which produced a low poly count character that could be implemented into a game from a technical and aesthetic point of view. An aim of this research paper was to obtain a better understanding of how the idea of a game character is developed and also why industry professionals utilize some techniques and not others. A finished game character model was created from the design process concept stage to the final product for an online game contest.

New Horizon is an online computer game which is created by the swedish company Lypson Intelligent Systems. The aim in this project was to create a PHP-based character creation page in order to make people enjoy the game New Horizon because of the fact that creating the character was not easy in the game before and that was causing the players to be so much bored. In the PHP-based web page, while certain areas are filled out manually by the player, the other areas consist of drop-down lists which are connected to some specific tables in a database. HTML, CSS, PHP, MySQL, JavaScript, Apache Server are used in this project according to the project requirements. As a result, the player doesn't need to make the whole calculations to create a character and doesn't need to read the whole character creation guide so as to know how to make the calculations, such means the online game works in a better and effective way if we just compare it with how it was before.

In this thesis, we investigate two expressions for symmetric group characters: Kerov?s universal character polynomials and Stanley?s character polynomials. We give a new explicit form for Kerov?s polynomials, which exactly evaluate the characters of the symmetric group scaled by degree and a constant. We use this explicit expression to obtain specific information about Kerov polynomials, including partial answers to positivity questions. We then use the expression obtained for Kerov?s polynomials to obtain results about Stanley?s character polynomials.
