This chapter discusses insolvency. Insolvency is significant in the law of assignment in a number of respects. In the first place, individual bankruptcy—although not the insolvency of companies—causes the bankrupt to be divested of his property, which automatically becomes vested in his trustee in bankruptcy upon the latter's appointment. So far as choses in action are concerned, this involves what can be termed a statutory assignment. The onset of insolvency—both individual and corporate—also causes the rules regarding assignments generally to change in certain respects. Thus, with the onset of insolvency: the rules regarding the assignability of present rights enforceable in the future change; the rules of champerty and maintenance change; and the rules of set-off change.

This commentary analyses Article 9.1.8 of the UNIDROIT Principles of International Commercial Contracts (PICC). According to Art 9.1.8, the obligor has a right to be compensated by the assignor or the assignee for any additional costs caused by the assignment. The additional costs for which the obligor claims compensation must be caused by the assignment of a right; that is, they must be a direct consequence of it. In particular, additional costs may be caused by the fact that performance has to be rendered at a different place or to more than one obligee in the case of a partial assignment. This commentary discusses additional costs relating to change of place of performance and partial assignments, as well as the obligor's right to choose to claim compensation from either the assignor or the assignee.

This commentary analyses Article 9.3.3 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the obligee's consent as a requirement for the assignment of contracts. As the assignment of a contract involves the transfer of obligations, it is necessary for the other party, the obligee of these obligations, to give its consent. The rationale for this rule is that the change of obligor may considerably affect the obligee's position. Therefore, the change may not be imposed on the other party. The other party must give its consent to the transfer of the contract. Furthermore, the obligee must also give its consent that the transfer occurs with reference to the application of the PICC. Lack of consent by the other party, whether because it has been refused or not solicited, makes the transfer of contract ineffective. Until the other party has given its consent or refused it, the agreement between the assignor and the assignee is not fully effective and can be said to be ‘in suspense’ or ‘in abeyance’.

This chapter examines the fiscal aspects of federalism as enshrined in the Indian Constitution. It gives an overview of the original structures of fiscal federalism in India, including assignments of spending and revenue and mechanisms and institutions for making transfers across different government levels. It reviews constitutional amendments that have occurred since the adoption of the Constitution, from changes in expenditure and revenue authorities to the creation of a tier of local governments. Complex adaptive systems (CAS) are composed of elements, called agents, that learn or adapt in response to interactions with other agents. ‘Complex adaptive systems’ shows that all CAS exhibit lever points, points where a small directed action causes large predictable changes in aggregate behaviour. All CAS agents have three levels of activity: performance (moment-by-moment capabilities), credit-assignment (rating the usefulness of available capabilities), and rule-discovery (generating new capabilities). The behaviour of a CAS is always generated by the adaptive interactions of its components; and the hierarchical structure characteristic of CAS is also generated—particular combinations of agents at one level become agents at the next higher level.

This chapter challenges the nearly universal reliance upon standard mathematical probability for mathematical modeling of chance and uncertain phenomena, and offers four alternatives. In standard practice, precise assignments are made inappropriately, even to the occurrences of events that may be unobservable in principle. Four familiar examples of chance or uncertain phenomena are discussed, about which this is true. The theory of measurement provides an understanding of the relationship between the accuracy of information and the precision with which the phenomenon under examination should be modeled mathematically. The model of modal or classificatory probability offers the least precision. Comparative probability, plausibility/belief functions and upper/lower probabilities are carefully considered. The selectable precision of these alternative mathematical models of chance and uncertainty makes for an improved range of levels of accuracy in modeling the empirical domain phenomena of chance, uncertainty, and indeterminacy. Knowledge of such models encourages further thought in this direction.

Medulloblastoma is the most common malignant brain tumor in pediatric patients. Patients are presently stratified to either standard or high-risk groups based on clinical and pathologic criteria. Approximately 80% of patients with standard risk disease are cured of their primary disease. High-risk and recurrent disease groups have a poorer outcome; 5-year progression-free survival is only 65% with high-risk disease. Disease control after recurrence is very poor. Treatment is multimodal and also aims to limit short- and long-term toxicities. Recent identification of four molecular subtypes of medulloblastoma may change risk assignment and therapy. Addressing the medical and psychosocial issues of survivors continues to improve the quality of life for these patients beyond the disease’s treatment.

Enhancement and AI create moral dilemmas not envisaged in standard ethical theories. Some of this stems from the increased malleability of personal identity that this technology affords: an artificial being can instantly alter its memory, preferences, and moral character. If a self can, at will, jettison essential identity-giving characteristics, how are we to rely upon, befriend, or judge it? Moral problems will stem from the fact that such beings are para-persons: they meet all the standard requirements of personhood (self-awareness, agency, intentional states, second-order desires, etc.) but have an additional ability—the capacity for instant change—that disqualifies them from ordinary personal identity. In order to rescue some responsibility assignments for para-persons, a fine-grained analysis of responsibility-bearing parts of selves and the persistence conditions of these parts is proposed and recommended also for standard persons who undergo extreme change.

Swedish politics can still be characterized as deliberative, rationalistic, open, and consensual but only if these four concepts are reinterpreted. Sweden has changed from a long-term “sounding-out” style of policy-making to a short-term and iterative trial-and-error method. Whereas commissions of inquiry in the 1960s were expected to carry out thoroughgoing investigations of policy alternatives and their possible consequences, since the 1980s they have been ordered to finish their assignments in less time and deliver shorter reports. Political decisions today are taken on a much less solid factual ground. The political process has moved from a consensus-seeking system based on selected access for a few major interests to a competitive and open-ended system.

One of the central complaints about Bayesian probability is that it places no constraints on individual subjectivity in one’s initial probability assignments. Those sympathetic to Bayesian methods have responded by adding restrictions motivated by broader epistemic concerns about the possibility of changing one’s mind. This chapter explores some cases where, intuitively, a straightforward Bayesian model yields unreasonable results. Problems arise in these cases not because there is something wrong with the Bayesian formalism per se but because standard textbook illustrations teach us to represent our inferences in simplified ways that break down in extreme cases. It also explores some interesting limitations on the extent to which successive items of evidence ought to induce us to change our minds when certain screening conditions obtain.

This chapter reconstructs how Nalca, a Mek language of the Trans-New Guinea phylum, has acquired gender markers and describes the non-canonical properties of this highly unusual gender system. Gender in Nalca is mainly assigned by two different defaults, phonological assignment is holistic, there is a gender switch depending on the syntax of the noun phrase, controller and target are adjacent, and gender has the function of case marker hosts. Gender in Nalca is only weakly entrenched in the lexicon and predominantly phrasal. It is argued that canonical gender is an attractor (a complex, diachronically stable structure with heterogeneous origins). A model of the gender attractor based on the notion of information transfer chain is developed. The rise of Nalca gender is an instance of system emergence where several diachronic processes, such as grammaticalization, reanalysis, and analogy, interact. Chains of rapid diachronic change are triggered by anomalies that entail other anomalies.

The most widespread type of gender system is exemplified with Spanish, Portuguese, Catalan, French, Italian, and Sardinian data. These languages all have parallel binary systems, with the masculine selected by default (e.g. for gender resolution, non-agreement, or—in most cases—agreement with non-nominal controllers). While dialect variation is covered in the following chapters, here a flavour thereof is conveyed by introducing binary convergent systems, which represent a further development (due to sound change merging agreement targets in the plural) of the mainstream binary system. The chapter then reviews semantic and formal assignment rules. Romance gender systems are never entirely semantic, but they always have a semantic nucleus: names of male/female human beings and sex-differentiable animals are assigned masculine and feminine via semantic rule in all Romance languages. These differ widely in the extent to which formal (morphological and phonological) rules are at work, and in how these look.

In this chapter we present a model for using case studies for the core of an undergraduate theoretical statistics course. These case studies have more depth than most examples found in typical mathematical statistics texts. Each case study provides a real-world question to be addressed as well as background information on the question, data to address the problem, and suggestions for investigating the problem. An important goal is to encourage and develop statistical thinking. This chapter provides both a sample case study on quality control and analysis of variance and a directed project on experimental design that includes a discussion of how we have changed the class to fit these activities into the course. In essence, the case studies become the centerpiece of the course, and as a result, the curriculum, lectures, and assignments are significantly different from a traditional mathematical statistics course.

Color from motion describes the perception of subjective color that spreads over physically achromatic regions that are seen in apparent motion. Multiple frames are shown in quick succession, each frame composed of a random placement of differently colored dots on an achromatic background. From frame to frame, the locations of all dots are fixed, whereas the color assignments of dots in the test region change. Subjective color can be measured by color matches to and cancellation by real lights, can be seen with chromaticity differences alone in test and surround dots, and is independent of contour formation. In stereoscopic view, the perception of depth, as well as color and form, can be recovered in tandem with seeing motion. This chapter suggests that in natural scenes, mechanisms triggered by motion may reconstruct the depth, color, and form of partially obscured objects so they can be seen as if in plain view.

The lack of a precise biochemical definition of acute kidney injury (AKI) resulted in at least 35 definitions in the medical literature, which gave rise to a wide variation in reported incidence and clinical significance of AKI, impeded a meaningful comparison of studies.The first part of this chapter describes and discusses different definitions and classification systems of AKI. Patient outcome and the need for renal replacement therapy are directly related to the severity of AKI, an observation that supports the use of a categorical staging system rather than a simple binary descriptor. The severity of AKI is commonly characterized using the relative changes in serum creatinine and urine output. Recently introduced staging systems including the RIFLE classification and the Acute Kidney Injury Network (AKIN) use these relatively simple and readily available parameters allowing the assignment of individual patients to different AKI stages. More recently, a Kidney Disease: Improving Global Outcomes (KDIGO) workgroup developed a consensus-based AKI staging system drawing elements of both RIFLE and AKIN. The potential pitfalls and limitations of the proposed definitions and classifications are briefly described.The second part of the chapter describes the epidemiology of AKI in different clinical settings; the intensive care unit (ICU), the hospitalized population, and the community. The different spectrum of AKI in the emerging countries is discussed and the most important causes and aetiologies of the major clinical types of AKI, prerenal, renal, and post-renal are summarized in table form. Finally the patient survival and renal functional outcome of AKI are briefly discussed
