Full textFormation constitutes a powerful agent to the process of updating professional competences. The evaluation of such training activities becomes more than ever, a major challenge in Human Resources management. Although the importance of the transfer of competences aimed by a specific formation is undisputed, few research exist relating to this complex process, for autonomous professionals exerting a liberal profession. Within this framework, this research analyzes the factors likely to support the transfer of competences of a group of notaries. More precisely, we are investigating notaries from the province of Québec registered in formation suggested by the Room of the notaries of Quebec. We examine the role of: self perceived effectiveness, motivation towards formation and perceived organisational support as predictors of transfer through a model of effectiveness evaluation of the formation. Our results reveal several predictors of the transfer at work. We also reveal three predictors of competences application at work, approximately a year after the formation. Among those, the organisational support during the actualization of the transfer and a feeling of personal effectiveness arise like the best predictors of transfer as well as the effective use of these competences. Intention of transfer, personal effectiveness before the formation and satisfaction with regard to the formation itself are other predictors of the transfer of competences aimed by the training session. Moreover, this research reveals that organisational support after the formation and personal effectiveness are the most reliable predictors of generalization of competences to other situations. Finally, personal effectiveness at the follow-up and organisational support after the formation as well as satisfaction towards received formation arise as predictors to the use of competences acquired in formation at the work place

Full textMany problematic situations can weaken the family functioning. The family situations involving a danger for the safety of the child or one of the parents are among the circumstances that increase the vulnerability of the family members. In these situations, the supervised child visitation services are an option which maintains parent-child contact when the absence of supervision could expose the child to problematic situations. Families can be referred to this type of service under an order from the Youth Division of the Court of Québec (children in care under the Youth Protection Act), an order from the Superior Court of Québec (disputes between separated parents) or under a voluntary agreement. Studies on the subject show that these services have positive effects, especially on the parent-child relationship. However, few studies have compared these two supervision contexts. This research, which is exploratory-descriptive and based on a secondary data analysis, tends to identify similarities and differences in the experience and family functioning of parents using supervised child visitation according to these contexts. Thirty-five interviews with parents involved in these services were analyzed using the McMaster family functioning model (2008). Parents from both supervision contexts emphases the ability of the services to foster the development of the parent-child relationship, in addition to supporting the development of positive parenting skills. Impacts related to the parent lack of attendance are also underlined (e.g. the child’s feeling of security decreases). As for the differences, parents referred by the Superior Court stand out because of their misunderstanding of the role of supervisors and the impact that this entails (e.g. feeling of discomfort in the child). In youth protection, parents experience less confusion about the role of supervisors.

Full textIn the collective imagination, Quebec’s 19th-century electoral campaigns are associated with violence, intimidation and dubious practices by political parties in order to get votes from illiterate and unpoliticized voters. However, is it really the case? The first objective of this thesis is to analyze electoral irregularities through the petitions challenging the legality of some elections tabled in the Legislative Assembly of the Province of Canada and of Quebec between 1871 and 1875. The second one is to study the control of the legitimacy of these disputed elections by parliamentary administration. To do so, the election process during public votes and the contested elections laws are carefully examined. Petitions are analyzed in order to reveal the various reasons raised by the protestors. Then the parliamentary process is examined to demonstrate how members of the Legislative Assembly arbitrate the disputed ballots. Simultaneously, the role of the various actors involved – voters, political parties, protesters and members of parliament – is presented, as well as the evolution of the legislation about controverted elections. Finally, the analysis of the 108 petitions tabled in the House between 1841 and 1875 suggests that this "mythical past" of corruption and electoral violence is real, but deserves to be qualified. The political culture evolves a lot during this short period. Those dubious practices are not only free of consequences during the elections, they also have the endorsement of the members of parliament, who reject petitioners’ grievances in more than 90% of the cases.

Full textSince the creation of the first youth criminal law in 1908, it has been modified several time. Canada’s vision about youth delinquents has evolved a lot between the Juvenile Delinquents Act (1908-1984), the Young Offenders Act (1984-2003) and the Youth Criminal Justice Act (2003 - present). As a result, we can observe a modification in the way the government takes the youth in charge. Seen at first as victim of their environment during most of the XX century, the minor received most of the accountability for their criminal behaviors afterwards. Nowadays, the political speeches are mainly oriented towards the protection of society and the risk management of criminals. This study wants to understand the social representations of the judicial actors about their own role in the justice system, the young criminals and the way they are supported by the system. The purpose of the thesis is also to understand the crime control paradigm present in the social representations of the judicial actors and how the changes in the law have influence or modified the social representations of the people who are in charge of applying the law. The twenty interviews done with the judges and the prosecutors allowed us to note a recurring tandem about the vision of the youth which will affect the way they will be supported. In any case, the protection of society is always the goal. Then, the concept of accountability, from the neoliberal philosophy, influences most of the discourse. Said discourse comes from the accountability of the professionals to the one of the young and their environment about the youth’s reeducation. At last, several elements influence the practice of the judicial actors, but the legislation’s modification is not the main one.
