La présente thèse s’intéresse à la diversité des pouvoirs locaux en Chine qui se trouvent pris entre une tendance centralisatrice traditionnelle et une évolution autonomiste innovatrice. Les autorités centrales exercent en Chine encore l’essentiel des pouvoirs de l’État et se superposent de manière puissante aux pouvoirs locaux. Toutefois, même si c’est sous le contrôle des autorités centrales, les pouvoirs locaux ont acquis désormais des compétences dans de multiples domaines. Ils représentent ainsi de nos jours de réels centres du pouvoir que le personnel politique convoite lors des compétitions politiques. Mais contrairement à la France, les pouvoirs locaux se présentent en Chine dans un contexte de régime communiste. Cependant, comme en France, les politiques de décentralisation et de déconcentration constituent un défi pour le développement politique de l’État. À cet égard, l’échelon local a changé de statut : il a vocation à devenir une échelle décisive de gouvernement des sociétés. Cette thèse s’adresse aux juristes français et a pour ambition de leur expliquer la Chine décentralisée ainsi que l’évolution juridique et politique qui a mené à la situation actuelle. Notamment depuis une trentaine d’années, les pouvoirs locaux prennent de plus en plus de place dans la vie politique, administrative et juridique de la Chine. La thèse présente le cadre essentiellement constitutionnel de la décentralisation à la chinoise, et expose également la dimension pratique de son fonctionnement. À ce titre sont vus les changements de statut des échelons autonomes, leurs capacités juridiques et politiques et le degré de leur autonomie, tant du point de vue de la décentralisation que de la déconcentration. Le régime local se présente en Chine de manière extrêmement diversifié, à la fois dans une dimension chronologique et diachronique<br>This thesis focuses on the diversity of local authorities in China, who are found between traditional centralizing tendency and autonomist innovative evolution. The central authorities in China still carry most of the powers of the state and overlap powerfully to local authorities. However, even if they are under the control of central authorities, local authorities have now acquired competences in multiple areas, such as economy, social sector, urban planning, culture, environment and sport. Local authorities thus represent today real centers of power that covets politicians during political events. But unlike in France, local authorities are presented in China in the context of the communist regime. However, as in France, the decentralization and deconcentration policy represents a challenge for public policy development. In this regard, the local level has changed status: it aims to become a decisive level of government corporations. This thesis is for French legal professionals and aims to explain the decentralized China also the legal and political developments which led to the current situation. Especially since the latest thirty years, that local authorities become having more and more space in the political, administrative and legal life of China. The thesis not only presents essentially the constitutional framework of decentralization in China, but also exposes the practical dimension of its operation. As are seen changes in the status of autonomous levels, their legal and political capacity and the degree of autonomy, both from the perspective of decentralization as deconcentration. The local regime in China has extremely diverse manner in both a chronological and diachronic dimension. This diversity of local authorities is demonstrated through both parts of the thesis

Cette thèse analyse la réforme de l’administration locale des années 1830 et ses conséquences sur la centralisation, conception en plein essor au premier XIXème siècle, considérée comme l’application du principe hiérarchique au sein d’une pyramide d’exécution administrative unitaire. Elle se concentre dans un premier temps sur l’étude des théories et des parcours des théoriciens du pouvoir et de la science du droit administratif. Il s’agit de comprendre la façon dont ces théoriciens considèrent la centralisation et l’administration locale dans le contexte de la monarchie parlementaire. Elle aborde ensuite l’étude des débats parlementaires sur la réforme, avec les temps des lois de 1831 et 1833 et des lois de 1837 et 1838, mais aussi les débats hésitants des temps intermédiaires de 1833 à 1835. Elle révèle ainsi les positions des groupes politiques sur la réforme, les combinaisons parlementaires définissant la rédaction finale des textes et le sens de ces derniers, à l’aune de la centralisation, objet politique de ces débats. Enfin, cette thèse met en lumière ce qu’elle définit comme étant un écosystème centralisateur faisant de la centralisation un lieu neutre sous la monarchie de Juillet. Ainsi, elle étudie des vecteurs d’accompagnement de la réforme, tel qu’un écrit de vulgarisation critique, les instructions ministérielles qui la mettent en œuvre et une publication périodique philanthropique visant à diffuser les normes aux personnels locaux. Elle analyse la réception et le suivi de la réforme par la grande presse nationale. Elle livre enfin quelques éléments sociologiques sur les parlementaires qui l’ont débattue. Elle montre une progression de la centralisation sous la monarchie de Juillet, dans les normes comme dans les esprits<br>This thesis analyses the reform of local administration in the 1830s and its consequences on centralisation, a concept that was in full swing in the first nineteenth century, considered as the application of the hierarchical principle within a unitary pyramid of administrative execution. It focuses initially on the study of the theories and paths of the theorists of power and of the science of administrative law. The aim is to understand how these theorists view centralisation and local administration in the context of parliamentary monarchy. It then turns to the study of the parliamentary debates on reform, with the times of the laws of 1831 and 1833 and the laws of 1837 and 1838, but also the hesitant debates of the intermediate times from 1833 to 1835. It thus reveals the positions of the political groups on the reform, the parliamentary combinations defining the final drafting of the texts and the meaning of the latter, in the light of centralisation, the political object of these debates. Finally, this thesis highlights what it defines as a centralising ecosystem making centralisation a neutral place under the July Monarchy. Thus, it studies the vectors accompanying the reform, such as a critical popularisation document, the ministerial instructions implementing it, and a philanthropic periodical aimed at disseminating the norms to local personnel. It analyses the reception and follow-up of the reform by the major national press. Finally, it provides some sociological elements on the parliamentarians who debated it. It shows a progression of centralisation under the July monarchy, in norms as well as in minds

Le sujet de cette thèse est l'administration locale civile en Isère de 1800 à 1837. L'organisation administrative établie par la loi du 28 pluviôse an VIII (17 février 1800) est souvent présentée comme très centralisée, et j'ai montré les limites de la centralisation administrative en Isère. J'ai étudié, dans la première partie, le milieu des fonctionnaires et administrateurs locaux, et notamment leur insertion dans le milieu local. J'ai étudié, dans la deuxième partie, la gouvernance territoriale (adaptation au milieu local, au territoire, rôle des collectivités locales, relations entre l'Etat et les citoyens) et les politiques publiques. Dans la troisième partie, j'ai montré que le modèle administratif résistait aux crises, aux difficultés (guerre et occupation en 1814-1815, changements de régimes, insurrection). La centralisation administrative est limitée en Isère au début du XIXe siècle. Les fonctionnaires ne sont pas encore assez nombreux pour prendre en charge toute l'administration locale et ont besoin de la participation des citoyens, de la société civile.

Dans l’image traditionnelle, la Chine est un État unitaire typiquement centralisé. Un tel concept, même à l’ère de Mao Zedong, n’est pas très précis, car à l’époque, la Chine a quand-même connu au moins trois cycles de déconcentration/centralisation. Alors, après la réforme d’«ouverture vers l’extérieur» par Deng Xiaoping, la Chine a établi des relations contrastées entre le central et le local. Deng Xiaoping a adopté une décentralisation des compétences par les mesures administratives et transfère les « intérêts » à l’échelon local, ce qui induit une grande latitude pour ce dernier, en particulier, en matière de développement de l’économie. Ainsi, une décentralisation non institutionnalisée a conduit l’échelon local à devenir de facto une entité administrative qui maîtrise les ressources et les compétences au nom de l’État, plutôt qu’obéissant aveuglément au central. Derrière ce changement, on voit l’émergence et la force motrice des intérêts locaux, avec une décentralisation approfondie, les gouvernements locaux ont reçu beaucoup plus de pouvoirs discrétionnaires, surtout pour ce qui concerne les affaires locales, et en même temps, à travers la maîtrise des ressources et des pouvoirs, les gouvernements locaux possèdent les «jetons» dans la négociation avec le gouvernement central, ayant pour objet et effet d’exprimer les intérêts locaux et d’influencer les décisions du central. Pour maintenir sa primauté, le gouvernement central a adopté une centralisation sélective pour faire face à cette décentralisation de facto afin d’arriver à un équilibre entre le central et le local. Cependant, une décentralisation non institutionnalisée, principalement à travers les négociations pour atteindre un équilibre entre les deux précédents, semble une approche qui n’est toujours pas stable, de telle sorte que la recherche d’une normativité des relations entre le central et le local est devenue un objectif à long terme<br>In the traditional image, China is a typically centralized unitary country, such a concept, even in the era of Mao Zedong, is not very precise, because at that time, China has even experienced at least three cycles of decentralisation/centralisation. So, through the reform and open by Deng Xiaoping, China has formed contrasting relations between central and local. Deng Xiaoping has adopted decentralization through administrative measures to decentralize the power and transfer “interests” to the local government, so that, the local government has a major initiative, in particular, in the development of the economy. Thus, the non-institutional decentralization leads the local government to become de facto an administrative entity which controls resources and power in the name of the central government. So the local government is not just obeying the central government like before. Behind this change is the emergence and the driving force of local interests. With a deep decentralization, the local governments have received much more discretionary power, especially in the local affairs and at the same time, through the control of resources and powers, the local governments have the “bargain chip” to negotiate with the central government, so that they could express local interests and influence the decisions of the central government. In order to maintain central authority, the central government has adopted a selective centralization for this de facto centralization, so as to achieve a balance between the central government and the local government. However, the non-institutional decentralization mainly through negotiation to achieve a balance between the two preceding ones, seems to be an approach that is still not stable, so that the search for a normativity of relations between central and local has become a long-term goal

La décentralisation est une base du pays démocratique parce que l'État centralisé ne peut pas répondre les besoins de la population tout seul. Il doit décentraliser les pouvoirs et les missions à l'autorité locale. Cela ne signifie pas que les collectivités territoriales vont répondre les vrais besoins de la population. La participation est une voie de déclarer le vrai besoin. En plus, la participation est également une façon de communiquer entre les habitants et les représentants locaux. En Thaïlande, l'histoire de la décentralisation a commencé à l'époque du Roi Rama V pour le but d'annulation le pouvoir de prince de chaque quartier et pour créer l'État-nation. Après avoir eu la Constitution de 1997, elle dispose le rôle des habitants dans le quartier pour négocier avec les autorités locales. En réalité, le nombre de la participation au niveau local en Thaïlande est faible à cause de la tradition et le mode de vie des thaïlandais. Dans cette étude, elle veut présenter le méthode de la participation et les obstacles de la participation au niveau local en Thaïlande<br>The decentralisation is the basic of democratic country because only the centralised State can not respond the need of population. State must decentralize its powers and duties to the local authorities. But it does not mean that the local authorities can respond the real need of the population. The participation is one of the way to declare the need of population. Moreover, participation is also the method for the communication between people and the local administrators. In Thailand, the history of decentralization began in the reign of the king Rama V with the aim at withdrawing the power of the local princes and constructing the State-nation. After the Constitution of 1997 was promulgated, the role of people in the community was fixed in order to negotiate with the local authorites. In fact, the number of participation is poor because of the tradition and the life style of Thai peoples. La plupart des pays d'Afrique, de la zone subsaharienne notamment, ont engagé une nouvelle « vague» de décentralisation au début des années 1990, au moment où les mouvements de revendication pour la libéralisation de la vie politique charriaient des menaces sur leur unité nationale et sur leur intégrité territoriale. Décidée ou concédée par les gouvernements centraux, la mise en œuvre de la décentralisation dans ces pays ne se traduit pas nécessairement, en droit positif et dans la pratique, par un reflux de la centralisation. La question de la répartition des compétences entre l'Etat central et les collectivités décentralisées prend à ce propos une place particulière, identifiée comme un point quasi commun de « stagnation» de l'évolution de différents processus nationaux de décentralisation. Au Cameroun en particulier, la répartition des compétences, présentée comme une étape de la mise en place de la décentralisation, reflète une centralisation administrative qui persiste. Le poids des autorités administratives de l'Etat demeure important; il pourrait même se renforcer avec l'exercice des nouvelles compétences locales. Par ailleurs la répartition des compétences ne prend pas en compte les réalités locales, à l'exemple de la forte légitimité des chefs traditionnels dans certaines régions. L'effectivité progressive du transfert des compétences de l'Etat vers les collectivités locales n'est donc pas un marqueur fiable, un indicateur pertinent de l'évolution du processus de décentralisation.

Dans le sillage de la réforme de 2014, les métropoles sont devenues des acteurs « affirmés » de l’action publique territoriale française. A Lyon, la collectivité métropolitaine fondée sur l’absorption du département sur son périmètre a doublé son volume en agents et a étendu son champ de compétences. Cette recherche fondée sur une immersion longue au sein de l’administration entend répondre à la question suivante : l’émergence de la métropole, concentrant localement les moyens et les leviers, a-t-elle transformé l’action publique ? Nous examinons concrètement la création de la collectivité et son déploiement institutionnel sur une dizaine d’années, à partir d’une focale sur une direction opérationnelle chargée de mettre en œuvre une politique publique au cœur de la construction métropolitaine : la politique d’insertion économique, rendue possible par la fusion et « étendard » proclamé de l’institution. A partir d’une sociologie de l’administration, nous saisissons cette politique publique au prisme de sa transformation et de son pilotage et sa mise en œuvre partenariaux, associant notamment l’État. En définitive, il s’agit de contribuer par cette monographie à l’étude de la métropolisation de l’action publique en France depuis les années 2010<br>In France, the law has given ‘affirmation’ to the metropolis as a main actor in public policies in 2014. In Lyon, the Greater Lyon Metropolis was founded upon the absorption of the historical département created in the late 18th century by the growing urban community. Although its geographical perimeter stayed the same, the number of agents doubled as the competences increased widely. Built upon a four-years immersion in this metropolitan administration, this research intends to answer the following question: what is the impact of this rise of the metropolis that locally concentrates means and leverages? How was public action therefore transformed in the field of employment and economic development? The answer relies upon the study of the deployment of the new institution on a period of ten years. The focus is put on the administrative division responsible for the employment policy, which was promoted as the spearhead and the main result of the fusion creating the Greater Lyon Metropolis. Through administrative sociology, we analyse the production of the public policy and its transformation in steering and territorial implementation. The interaction between the metropolis and the State is also investigated, to contribute, with this monography, to the understanding of the impacts of the metropolisation of French public action since the 2010’s

Brazzaville est la capitale de la république populaire du Congo ; un état qui a choisi de construire le socialisme en se basant sur le marxisme. Cependant bien qu'ayant opté pour ce modelé de développement, le Congo asseoit organisation administrative sur la décentralisation; reconnaissant par conséquent à Brazzaville la qualité de collectivité locale décentralisée. Or il y a une relation entre l'administration et le pouvoir politique. Comment Brazzaville capitale, concilie-t-elle ses qualités de collectivité locale et de capitale politique ? Brazzaville peut-elle prétendre à une quelconque autonomie ? A-t-elle les moyens de son autonomie ? A l'instar d'autres capitales africaines demeure-t-elle une ville fortement contrôlée par le pouvoir central aussi bien sur le plan politique que sur le plan financier ?<br>Brazzaville is the capital city of the people's republic of the congo; a marxist-leninist orientated country. However, in spite of its political tendencies, the country's administration is based on decentralisation; thus giving Brazzaville a decentralised local community status, now administration is always linked to politics. So, how is possible to bridge the gap between the demands of a revolutionary state, based on political uniqueness democratic centralism and decentralisation which implies a diversity of decision making bodies. How does the city of Brazzaville bridge the gap between its status as a local community and its status as a capital city ? Can the city self-govern in a way ? Can it afford self-government ? Is the city, like many african capitals politically as well as financially run by those in power ?

L’institution du gouverneur, selon son statut moderne, créée en 1956, a survécu à plusieurs contingences de l’histoire du Maroc moderne : l’instabilité des années 1970, l’ouverture d’une nouvelle ère de lois et règlements administratifs visant la stabilisation du système de gouvernance et la reconnaissance d’une autonomie limitée à travers l’adoption de la décentralisation afin de mitiger les inconvénients de la centralisation excessive tout en instaurant les bases d’une déconcentration administrative. L’objectif de cette thèse est d’étudier les éléments de continuité qui caractérisent l’action des gouverneurs. L’institution du gouverneur au Maroc joue un rôle central dans l’administration du pays ; l’étude de sa genèse, de son statut, de sa condition juridique, de ses droits, de ses obligations, de ses responsabilités et de ses attributions, aussi bien traditionnelles que modernes, représente un intérêt certain. Cette thèse se propose d’être une contribution au débat actuel portant sur la réforme des institutions au Maroc<br>The institution of governor, in its modern status, created in 1956, has survived to so many contingencies in the modern Moroccan history: instability in the 1970s, the setting of a new era of administrative laws stabilizing the governing system, and the recognition of a limited autonomy to territorial collectivities through decentralization process in order to mitigate the centralization inconvenients by adopting “administrative deconcentration”. The objective of this thesis is to study the elements of continuity characterizing the action of governors. This contribution is an attempt to identify them in regard to their status and competencies. The institution of Governor in Morocco plays a central role in the local administration of the country, the study of its genesis, its legal status, rights, obligations, responsibilities, and functions, both traditional and modern has an accurate interest. Longtemps consideree comme l'exemple ideal de l'autonomie locale, l'administration locale britannique, ou local government, est pourtant entierement subordonnee au parlement souverain. En fait, ses fonctions, sa structure et son territoire dependent de la volonte gouvernementale, via la majorite parlementaire, comme le montre l'accumulation des reformes dont elle fait l'objet depuis plus d'un siecle. Et depuis la fin de la seconde guerre mondiale, la centralisation des politiques publiques se confirme a travers la multiplication des transferts de competence locale au profit de l'administration centrale et des agences nationales ou regionales et meme a travers le controle de l'etat sur des depenses locales. La " revolution thatcher " n'a fait qu'accentuer ces phenomenes, radicalisant la crise ancienne et latente des relations entre le pouvoir central et les autorites locales. Le local government est devenu un des principaux lieux de conflit de la vie politique et un enjeu de la reforme de l'etat-providence par le biais d'une reduction drastique des finances locales, d'une etatisation ou d'une privatisation, selon les domaines, des services locaux qui constituaient sa raison d'etre. Pour comprendre cette evolution jusqu'au programme travailliste de modernisation institutionnelle et de regionalisation du gouvernement blair elu en 1997, il faut apprehender le systeme politico-administratif britannique dans la diversite de ses quatre nations-regions, avant de voir le fonctionnement des institutions administratives anglaises. En effet l'idee sous-jacente est qu'on ne peut dissocier le systeme politique du systeme administratif. De plus, l'etude des rapports entre les acteurs politiques et administratifs depasse la question de la nature juridique du local government et oblige a s'interroger sur la legitimite et la representativite des elus locaux. Ceci amene a traiter le sujet sous l'angle combine du droit, administratif et constitutionnel, et de la science administrative.

Includes bibliographical references (leaves 80-94).<br>Democratic decentralisation in South Africa was undertaken as part of post-apartheid restructuring. This signified a shift on local government's status from being a tier to being a sphere with its own and powers functions. The empowerment of local government is evident in five tested indicators, which are the areas that are empowered to lift local government's autonomy as stipulated in the constitution and in supporting legislations. These areas include legal, financial, functional, human resources and public participation. However, these areas are facing challenges which lead to scholars and government to view local government as inefficient and ineffective. As a result, central government is intervening in local government's affairs claiming to ensure the intended constitutional objectives.This dissertation examines the evidence of centralisation by testing five areas that are constitutionally empowered to ensure democratic decentralisation. In South Africa, these indicators are evident in empowering of local government based on the national legislations and supporting local government policies. However, the central government's interference has undermined these powers and function.

Le but de cette these est d'etudier l'administration du territoire en france metropolitaine. L'hypothese centrale de ce travail est que l'administration du territoire est, fondamentalement, le produit des forces conjuguees d'unite et de diversite qui caracterisent toutes constructions etatiques. Au dela, nous souhaitons montrer comment, contrairement a ce que postule le modele classique d'administration du territoire "a la francaise", le territoire doit etre pense comme l'instrument tant symbolique que pratique de reconnaissance de la diversite de la republique. Une premiere partie est, tout d'abord, consacree a l'administration du territoire par l'etat. Dans un premier titre nous montrons comment le modele traditionnel d'analyse du territoire etatique fait celui-ci l'instrument d'une unite imposee, tant a la communaute nationale qu'a l'appareil administratif etatique. Dans un deuxieme titre nous tentons d'elaborer un nouveau modele d'analyse du territoire de l'etat, faisant de celui-ci l'instrument d'une unite recomposee. Un troisieme titre est consacre a l'administration effective du territoire par l'etat. Elle met en evidence les processus de territorialisation et de diversification fonctionnelle de l'adminisration etatique. Une deuxieme partie est, ensuite, consacree a l'administration du territoire par les collectivites territoriales. Dans un premier titre nous montrons comment le modele classique d'analyse du territoire fait de celui-ci un instrument permettant de contenir la diversite des collectivites locales. Dans un second titre nous proposons un schema de pensee sensiblement different faisant du territoire un instrument de reconnaissance de la diversite<br>The purpose of the present thesis is to study the principles governing the administration of territory within metropolitan france. The central assumption on which this work is based is that territory administration is, fundamentally, the result of the combined forces of both unity and diversity which characterize all state-created entities. Beyond this, the author wishes to demonstrate that, unlike what was the case with the classical pattern of territory administration "a la francaise", the territory must now be viewed as the instrument, both practical and symbolical, of a recognition of the diversity of the "republique". The first part of the thesis is devoted to territory administration as exercised by the state itself. In the first section, the author endeavours to show how the traditional pattern of analysis applied to territory administration turned the latter into the instrument of a unity which has been forced upon the national community as well as upon the state machinery. In the second section, she suggests a new vision of the state territory, according to which it becomes the instrument of a recreated unity. A third section deals with territory administration as it is, in practice, implemented by the state. This study of the practise reveals the process of "territorialisation" and of functional diversification undergone by the state administration. The second part of this work is devoted to territory administration as exercised by the "collectivites territoriales". Comment l’Etat haïtien est-il passé du statut d’Etat centralisé à celui d’Etat unitaire et décentralisé ? Ce travail de recherche a pour objet de comprendre du point de vue du droit et de l’histoire, le comportement du pouvoir central par rapport au pouvoir local en mettant en relief leurs relations institutionnelles. Pour ce faire, un échantillon de 5 collectivités municipales est étudié. Le socle juridique des collectivités locales haïtiennes a été défini par la Constitution de 1816 avec la création des communes comme circonscriptions administratives de l’Etat pour se substituer aux anciennes paroisses héritées des structures coloniales françaises du XIXe siècle. De 1816 à nos jours, l’histoire montre des périodes d’avancées, de silence voire de recul dans la construction des collectivités locales, selon que les priorités des régimes politiques étaient centralisatrices ou décentralisatrices. Si la Constitution de 1843 a tenté d’instituer des instances locales, celles qui lui ont succédé, dans leur grande majorité, ont fait marche arrière. On doit attendre la Constitution de 1987 pour voir la naissance de trois niveaux de collectivités décentralisées ayant des prérogatives et obligations pour qualifier le système haïtien de système décentralisé. L’Etat est donc devenu unitaire et progressivement décentralisé. Toutefois, il fallait aussi s'interroger sur la réalité du fonctionnement desdites collectivités en raison de leurs faiblesses, notamment financières. L’étude de ces administrations décentralisées permet d’appréhender leurs compétences techniques, administratives et financières par rapport aux compensations de l’Etat, lesquelles restent très maigres et n’aboutissent qu’à un système peu ou faiblement décentralisé<br>How did the Haitian State go from the status of Centralized state to that of unitary and decentralized one ? The purpose of this paper is to understand, from the point of view of laws and history, the behavior of the central government in relation to the local one by highlighting their institutional relations. To do this, we studied a sample of 5 municipal communities. The legal base of the local authorities of Haiti was defined by the Constitution of 1816 with the creation of the communes as administrative districts of the State to replace the old parishes inherited from the French colonial structures of the nineteenth century. From 1816 to the present days, history of Haiti shows periods of progress, of silence and even of decline in the construction of local communities, according to whether the priorities of the political regimes were centralizing or decentralizing. Although the 1843 Constitution attempted to establish local bodies, the vast majority of them followed suit. We had to wait until the 1987 Constitution to see the birth of three levels of decentralized communities with prerogatives and obligations to recognize he system of Haiti as a decentralized one. The state has become unitary and progressively decentralized. However, it was also necessary to put in question the reality of the functioning of the said communities because of their weaknesses, more specifically financial ones. The study of these decentralized administrations makes it possible to understand heir technical, administrative and financial competences in relation to the compensations of the State, which remain very inadequate and result in a weekly decentralized system

Avec l'institution des préfets, la centralisation prenait une autre dimension. Pour les auteurs de la loi du 28 pluviôse an VIII, la centralisation paraissait être un système parfait, les consignes partant de Paris et arrivant dans le plus petit village avec l'efficacité du "fluide électrique", et ce grâce aux préfets, sous-préfets et maires. Seulement la réalité était un peu différente de la théorie. Tout d'abord parce que les administrateurs n'étaient pas toujours choisis pour leurs compétences, ils pouvaient l'être par défaut de candidats ou par relations. Ensuite, ils ne furent pas seulement des instruments au service de l'état. Il leur arriva d'interpréter ou d'ignorer les ordres. Et enfin, les préfets pouvaient difficilement se conduire en maitre absolu dans le département car il leur fallait composer avec les notables et les autres fonctionnaires. Les administrateurs étaient donc eux-mêmes des limites au fonctionnement parfait du système. Les corréziens s'opposèrent à l'emprise de l'état. Ils refusèrent de partir à la guerre ou d'adopter les progrès prônés par Paris. Toutefois, si l'état ne parvenait pas à être aussi efficace qu'il l'eut souhaité, il imprimait sa marque dans l'évolution du département : c'était sous son impulsion que l'enseignement progressait et que la Corrèze s'équipait d'un bon réseau routier. Le système de la centralisation, dotant tous les départements des mêmes outils, ne favorisait pas la Corrèze. En effet, l'état avait tendance à favoriser les départements riches en y envoyant les meilleurs administrateurs et en accordant des budgets de fonctionnements proportionnels à la richesse du département. Aussi, même si elle avait enregistré des progrès, la Corrèze restait en 1848 le département pauvre qu'elle était en 1800, parce qu'elle n'avait pas eu les moyens de rattraper son retard et parce que ses habitants opposaient de la résistance au "progrès"<br>With the new institution of prefets, the centralization in France took on a new dimension. Theoretically speaking, for the authors of the 28 pluviôse an VIII law, centralization was a perfect system through which the state's orders could reach the smallest of villages, via the prefets, sous-prefets and maires. But reality was sometimes more complex. First of all, the administrators were not always appointed for their particular skills: they could be nominated simply by lack of other candidates, or because they knew the right people. Secondly, they were rarely the reliable instruments the state wanted them to be. They often interpreted or even ignored the orders sent them by their hierarchy. And last, the prefets could hardly behave as masters of their department, for they had to compromise with the notables and all the other civil servants. Through their own human and social limits, the administrators did not always allow for the success of centralization. The people of Correze were against the state's influence in their department. They often refused to go to war and opposed the innovations advocated by Paris. However, the centralized state did have an influence on the departements evolution. Through its impulse, education made substantial progress, and the road network in Correze improved considerably. The centralized system of government was supposed to give each department the same tools. But it did not favor Correze. As a matter of fact, the state was more generous with the richer departments, sending them the best administrators and granting them higher budgets. In 1848, despite a few improvements, Correze remained as poor as it was in 1800, because it was not given enough means to catch up with the other departments, and because its inhabitants were opposed to a certain idea of “progress”

Le gouverneur civil portugais ne cesse d’être, pour les juristes, les politistes et les historiens, une sourceconstante d’interrogations. Établi en 1832 par José Xavier MOUZINHO da SILVEIRA avec le titre de prefeito, puisen 1835 avec celui de gouverneur civil, en même temps que la création du district en tant que division administrativedu territoire, il a été, dès ses origines, fortement inspiré du préfet français. L’institution a été instaurée dans laperspective de créer une séparation entre les fonctions juridictionnelles et administratives, lesquelles relevaient descomarcas. De même, il s’agissait de doter le pouvoir royal d’une réelle structure politique à l’échelon local. Par lasuite, les Codes administratifs successifs, révisés ou adoptés quasiment à chaque alternance politique, avantl’avènement de l’État Nouveau et la Constitution Politique de 1933, n’ont pas bouleversé fondamentalement lesattributions de l’institution en tant que représentation locale du pouvoir central, et il a fallu attendre le Codeadministratif de 1940 pour faire du gouverneur civil un acteur essentiel de la vie administrative et politique locale.Après la transition démocratique, qui a fait suite à la Révolution des OEillets du 25 avril 1974, et l’adoption de laConstitution de la République Portugaise de 1976, le gouverneur civil, toujours nommé par le pouvoir central, a étémaintenu à titre transitoire… durant quatre décennies. It was established in 1832 by José Xavier MOUZINHO da SILVEIRA, under the title ofPrefeito then in 1835 at the time of the creation of the district as an administrative division of the territory, the titlebecame the “Civil Governor”. It was initially inspired by the French Prefect. The institution was founded in anattempt to separate the jurisdictional and administrative functions within the districts. Similarly, the goal was toprovide the royal power with a real political structure at local level. Accordingly, before the advent of the New Stateand the Political Constitution of 1933, the revised and adopted administrative codes, resulting from any politicalchange, did not fundamentally alter the powers of the institution as a local representation of the central power. TheCivil Governor only became a key player in the administration and local politics following the Administrative Codeof 1940. After the democratic transition following the Carnation Revolution (April 25, 1974) and the adoption of theConstitution of the Portuguese Republic in 1976, the Civil Governor, who was always appointed by the centralgovernment, has remained in a transitory state for four decades, more than a third of a century. Since the referendumof November 8th 1998 relating to the administrative regionalization of the territory failed, the complex relationshipsbetween the political class and the central institution of the district have always wavered between the prospect ofsuppression, the desire for reform and indecisiveness. As such these relations revealed the prevarications andparadoxes of the political class which wanted an in depth reform of the Civil Governor’s role while maintaining theinstitution in an ambiguous situation. The organic law n° 1/2011 of November 30th 2011 states that the CivilGovernor is abolished. Bibliography: p. 512-557.<br>This thesis is an examination of the National Party's policy of decentralisation of powers to local authorities in the 1980s. The thesis concentrates primarily on urban local government and its objectives are: 1. To trace the evolution of the south African state's policy of devolution of powers to local authorities in the 1980s; 2. To examine critically the main features of new local government legislation in this period, with particular reference to the devolution of powers policy; 3. To apply a normative framework for analysis, which can help serve as a heuristic device, in determining the extent of decentralisation that has occurred, to selected local authorities in the western Cape. The primary sources of research material that were consulted were Hansard, Acts of parliament, government commissions and gazettes, year books, provincial debates, ordinances, gazettes, circulars and local authorities' minutes and publications. Approximately 50 qualitative interviews were also conducted. The framework of analysis utilised certain indices, namely personnel, access, functions, party politics, finance and hierarchical relations, to measure the extent of decentralisation that has occurred in three local authorities in the Western Cape. This framework helped determine that limited devolution of powers had occurred. There were four major reasons for the reluctance of the National Party to devolve extensive powers to local authorities. First and foremost, reform policy was made in an elitist, top-down manner by a small group of reformers in order to ensure that the government could share power without losing control. The corollary of this centralised policy-making was the tendency of centr.al and provincial authorities not to devolve extensive powers to local authorities. Secondly, there was the viewpoint of the central government that the local government development process had to be controlled from the top because of the lack of sufficient skills, experience and finance at local level. Thirdly, the need for macro-economic financial control was· also a brake on the devolution process. Fourthly, the government believed that, in a unitary state, central government should always have a relative degree of control over local authorities' activities.

A cette fin dans une premiere partie, la demarche montre que ces termes visent des techniques d'insertion des actes d'organes centraux ou non centraux dans l'ordre juridique, structurees autour de la distinction des facultes de statuer et d'empecher degagees par montesquieu. For this purpose the proceedings shaw, in the first part, that these terms relate to the insertions technics concerning the acts of the centralized and noncentralized administration in the field of jurisdiction, which are structured so as to distinguish between the power to decree and to ipede, as has been defined by montesquieu. The second part creates a base for the opposition between the tho terms on a different redistribution of the power to decree and to impede so that the centralization, without excluding the existence of the noncentralized judical administration, which will create confusion concerning this power, and this, to the benefi t of the centralized judical administration. Besides that, the decenralization will provoke a division of the power to decree between the centralized administration and noncentralized administration which is guaranteed for them by the mutual authority to impede. The change of this reciprocity characterizes an intermediate situation which is called "deconcentralization". This definition of terms gives tise to fear fo the organization of the normative autority in the entire hierarchical legal system. On one hand, this reasoning is applied to the french legal system in the third part as far as the integration of france into the super national juridical systems is concerned, while, on the other hand, the diversity of her internal nominative organization provides an exemplary frame of concepts

De 1960 jusqu'à la fin des années 1980, le Sénégal organise son Etat sur un modèle fortement centralisé, avec pour caractéristique une forte dépendance des collectivités locales vis-à-vis du pouvoir central. Face à la crise économique et financière qui apparaît au début des années 80, ce modèle trouve rapidement ses limites. La faillite des pouvoirs centraux et les résultats peu probants des PAS, font apparaître la décentralisation (notamment la municipalisation) comme l'alternative permettant de mieux prendre en charge la dynamique du développement.<br />Dans ce contexte, les villes sénégalaises sont soumises à la nécessité de coopérer avec de nouveaux acteurs pour relever les défis posés par leurs dysfonctionnements.<br />Ainsi, depuis 1996, la commune de Kaolack a compris que l'enjeu majeur du développement urbain tournait autour de la construction de nouvelles relations de partenariat. La mise en place du Comité de Développement de Kaolack (CODEKA), réunissant tous les acteurs, traduit concrètement la volonté d'impulser des cadres facilitant un développement local participatif. L'observation de la ville de Kaolack illustre les mécanismes qui sont à la base de cette évolution ; ils mettent notamment en lumière le nouveau type de relations qu'entretient le pouvoir politique avec la société civile

Cette thèse porte sur la gestion des routes du département de la Haute-Garonne de 1790 à 1796. Dans ce département né du nouvel ordre territorial et administratif qui s’impose en France en 1790 et formé d’une partie de deux anciennes provinces hétérogènes, la Guyenne et le Languedoc, l’administration locale se voit confier le rôle de maintenir les infrastructures de transport en bon état. Pour ce faire, elle doit faire face aux nombreuses difficultés qui peuvent empêcher localement l’exécution des travaux routiers. Ses compétences à cet égard dépendant étroitement du degré de centralisation de l’administration centrale des ponts et chaussées, composée du ministre de l’Intérieur et du Corps des Ponts et Chaussées. Au cours de la Révolution française, ce jeu de pouvoir entre Paris et le département subit l’influence des contextes national et local, tels que les crises politiques ou la guerre. Le pouvoir local ne peut prendre les mesures qu’il juge nécessaire pour assurer la bonne gestion de son réseau routier que dans les limites de la politique routière imposée par Paris<br>This thesis is a study of the management of roads in the “département” of Haute-Garonne between 1790 and 1796. This “département” had been created as a part of the new territorial and administrative order in France established in 1790, and it was made from parts of two former different provinces, Guyenne and Languedoc. In Haute-Garonne the local administration was entrusted with the role of maintaining the infrastructures for transport. To this end the “département” had to face various difficulties that could impede the execution of road works in the locality. Its powers in this respect depended closely on the degree of centralization of the national administration of roads and bridges, an administration composed of the Minister of the Interior and the “Corps des Ponts et Chaussées”. During the French Revolution this power relationship between Paris and Haute-Garonne was dictated by a combination of national and local contexts, including political crises and war. The local authorities could take measures they deemed necessary to ensure the proper management of their road networks only when these were within the limits set by the road policy decided on by the national authorities in Paris

Le Tournaisis, entre le XIVe et le XVIe siècle, n’est qu’une poussière à l’échelle du royaume de France puis, après 1521, des Pays-Bas de Charles Quint. La soixantaine de paroisses rurales qui le composent est, depuis 1383, réunie en un bailliage de Tournai, Tournaisis, Mortagne et Saint-Amand qui constitue le cadre administratif intermédiaire et qui exerce la plupart des prérogatives régaliennes dans la province. Ce bailliage se superpose et concurrence d’anciennes cours féodale et allodiale du Tournaisis ; il est lui-même doublé par des États provinciaux développés au XVIe siècle pour répondre aux besoins de la fiscalité directe gouvernementale. Au niveau local, les pouvoirs sont extrêmement fragmentés en un panel diversifié de seigneuries. L’autorité seigneuriale repose sur des cours féodales et des échevinages à variantes multiples, qui encadrent des communautés villageoises relativement peu organisées.Durant ces deux siècles, l’évolution a sans doute davantage affecté les hommes œuvrant au sein des structures provinciales que les institutions elles-mêmes. Dans les villages, l’imbrication des cadres seigneuriaux, le poids politique et économique de Tournai et l’influence institutionnelle flamande participent à figer dans la diversité les équilibres existants. The roughly sixty rural parishes that it consisted of had been combined together since 1383 into one bailiwick of Tournai, Tournaisis, Mortagne and Saint-Amand, making up the intermediary administrative framework exercising the greatest part of the regalian prerogatives in the province. This bailiwick is superimposed on and rivals more ancient feudal and allodial courts of Tournaisis ; it is in turn overcapped by the Provincial States, evolved in the 16th century to meet the needs of direct government tax system. At local level, powers are extremely fragmented into a variety of seigneuries. Seigneurial authority rests on feudal courts and a multiplicity of échevinages, which enframe rather poorly organized village communities.Over these two centuries, the people at work within the province structures were probably more deeply affected by evolution than the very institutions themselves. In the villages, the interwoven seigneurial frameworks, Tournai's political and economic weight together with the influence of Flemish institutions all partook in the freezing of the diversity of existing power balances. Whereas the development and the administrative improvement of the French and Habsburg monarchies are indisputable, their effects at the intermediary level remain moderate and uneven at local level. De 1914 à 1964, la conservation des monuments historiques d'Alsace est progressivement soumise à la législation et à la pratique administrative françaises. Cependant, les institutions introduites dans le Reichsland d'Alsace-Lorraine avant 1914 sont maintenues en vigueur après 1918 et certaines d'entre-elles sont même étendues aux départements " de l'Intérieur ". Après la centralisation des services d'Alsace et Lorraine en 1925, les monuments historique d'Alsace sont soumis à la même pénurie budgétaire que ceux des autres départements français. Le maintien en Alsace du régime des cultes concordataires permet toutefois aux édifices cultuels protégés au titre des monuments historiques de bénéficier de l'apport du budget des Cultes. En outre, les départements du Bas-Rhin et du Haut-Rhin prennent le relai de l'ancien Land d'Alsace-Lorraine pour subvenir à l'entretien des monuments historiques. La conservation des monuments historiques d'Alsace constitue un véritable enjeu national : le nombre d'édifices protégés ne cesse d'augmenter, les souvenirs et vestiges des deux guerres mondiales et les monuments d'architecture française sont particulièrement mis en valeur, alors que les monuments qui avaient été restaurés par des architectes allemands avant 1914 sont souvent " dérestaurés ". Le champ des protections s'élargit progressivement aux sites pittoresques, aux abords des monuments et aux centres anciens. Enfin, la connaissance du patrimoine alsacien progresse grâce à la réalisation de nouveaux inventaires.

This thesis analyses the processes and content of South African television policymaking between 1990 and 2011 in relation to the regional/local (sub-national) TV question. Analysis is provided of the possible reasons for the gaps between policy intent and policy implementation on regional/local television matters, and the possible impact of these gaps on pursuit and realisation of public interest objectives. The thesis is based on a research case study of a single case: the regional/local question in South African TV policymaking in the early democratic era. Data were extracted from primary South African TV policy documents produced in the period 1990 to 2011 and from semi-structured interviews with stakeholders directly involved in TV policymaking. The collected data were qualitatively analysed across four periods: 1990 to October 1996; November 1996 to 2001; 2002 to 2006; and 2007 to 2011. Two theoretical frameworks were deployed in the data analysis. An adapted form of Kingdon’s (1995) “policy streams” framework – a framework for analysing deliberative public policymaking in democratic states – was used to organise the data collected for each of the four periods of study and to analyse the patterns, and potential causalities, in TV policymaking in each period in relation to the various South African regional/local TV policy matters. A second framework, a social responsibility-oriented, democratic citizenship-focussed public interest media policy framework derived from the work of Feintuck and Varney (2006), was used to evaluate the degree to which public interest objectives were achieved via South African TV policymaking in relation to the regional/local question. The research found that South African television policymaking between 1990 and 2011 failed to adequately answer the regional/local TV question. Via the research project’s application of the adapted Kingdon (1995) framework to the data collected, evidence was found of ruptures in deliberation in the TV policymaking space – instances which steered policymaking activity away from full, multi-stakeholder deliberation, narrowed the scope of consideration of policy options, and led to ad hoc policymaking, policy confusion and policy missteps. Via application to the data of the public interest framework derived from Feintuck and Varney (2006), the research found that sub-national TV delivery on the key public interest objectives of access, diversity and stewardship was not effectively pursued in TV policymaking, and that pursuit of the central public interest principle of democratic citizenship was not adhered to. The research also found that there were apparent causal links between non-deliberative, ad hoc policymaking and failure to effectively pursue the public interest. The value of the research project, and of this thesis, lies to some extent in the application of an innovative political science-oriented framework (adapted from Kingdon, 1995) to uncover the patterns and some of the potential causalities in TV policymaking in relation to a specific subset of TV policy matters (sub-national TV deliverables). Also of value is the application of a second conceptual framework to the data – a social responsibility-oriented public interest framework based on the work of Feintuck and Varney (2006) – to the outcomes of the policymaking. Third, this thesis offers a longitudinal perspective on early-democratic-era South African policymaking on a matter (television) central to the democratic transformation project, thus providing insights into several of the political, socio-cultural and economic discourses/arguments (and the tensions within and among the discourses/arguments) which were prominent in the first two decades of South Africa’s democratisation.

Research Doctorate - Doctor of Philosophy (PhD)<br>This research presents a case study of the Super Radio Network, the largest regional radio network in New South Wales (NSW), Australia. Since the 1920s when radio, as a broadcast medium, was introduced to Australia the industry was highly regulated. This regulation extended to licensing, ownership limits, foreign investment and content. However, in 1992 the Keating Labor government further deregulated the radio industry through the <i>Broadcasting Services Act 1992</i> giving licensees more freedom by removing ownership limits. Deregulation was meant to create a more diverse and localised radio industry. However, from 1992 onward, there has been an increase in the number of radio stations networking their programmes to regional Australia resulting in a perceived loss of local content and locally hosted programmes. This research examines the development of networking and the provision of local content and diversity in those networked environments. It examines, through interviews with radio practitioners, in particular programme-makers and managers within the Super Radio Network, how the role of radio practitioners as choice making agents work within the structures of legislation and radio formats to develop programme content for a local audience within a radio station’s licence area. Underlying this research is the focal theory of structuration developed by Anthony Giddens. The features of social systems and social production can be explained, according to Giddens, through the theory of structuration, specifically the notion of the duality of structure, which proposes that social systems, such as radio networks, exist through structural properties that consist of rules and resources that are both allocative (available material such as technology) and authoritative (non-material or human) and expressing the ‘mutual dependence’ of structure and agency. Interviews with radio practitioners show how these agents work within the structures in which the radio industry operates and the analysis shows how programme content is compiled and whether it relates to the local licence area. This analysis considers whether regulating local content and having locally hosted programmes adds to the localness of regional radio. Finally, as the thesis will demonstrate there is some confusion over the term ‘local’ and this confusion occurs not only in its use by programme-makers but also in its lack of definitional precision in broadcasting legislation and government policy statements. This results in problems for both the network operators and the communities they service. This research directly interrogates the question of what constitutes the local and localism by putting forward a definition of these terms to reflect the nature of regional radio as it competes with a burgeoning and fluid set of industry structures that streams audio content over the Internet.

Die probleem is dat die land se apartheidsregering afsonderlike stelsels vir blankes en swartes in aparte woongebiede in stand gehou het, welke beleid vir meeste Suid-Afrikaners onaanvaarbaar was. Swart plaaslike owerhede wat swart plaaslike regering moes bedryf, was nog polities nog ekonomies lewensvatbaar. Die rede hiervoor is dat hul enersyds deur die gemeenskap verwerp is en andersyds nie voldoende inkomstebronne gehad het om plaaslike owerheidsdienste finansieel onafhanklik te lewer nie. Stedelike swart gemeenskappe was aan 'n, vir hulle, onaanvaarbare apartheidsgestruktureerde swart plaaslike regeringstelsel onderworpe. Swart plaaslike owerhede was voorts as gevolg van hul ekonomiese nie-lewensvatbaarheid, gekniehalter in die lewering van plaaslike owerheidsdienste asook die daarstelling en instandhouding van kapitale ontwikkelingsprojekte. Stedelike swartes was dus blootgestel aan gebrekkige dienslewering in aparte, onderontwikkelde "slaapdorpe" waar hulle noodgedwonge moes woon. 'n Vraag waarna gevolglik gekyk word, fokus op die kenmerke van 'n ideeeltipiese model van plaaslike regering wat die gedeeltelik legitieme stelsel behoort te vervang. As gevolg van die onaanvaarbaarheid van die swart plaaslike regeringstelsel was swart plaaslike owerhede sedert die vroee tagtigerjare die teikens van aksioniste teen hierdie apartheidsproduk. Aksioniste het nie-gewelddadige aksie (NGA), geskoei op die Gandhiaanse filosofie en metodiek van Satyagraha, aangewend ten einde swart plaaslike owerhede te vernietig. NGA (wat dikwels ook tot gewelddadigheid gelei het), het tot gevolg gehad dat die owerheid later noodgedwonge 'n nuwe plaaslike regeringstelsel vir die totale Suid-Afrikaanse samelewing, met alle deelvennote moes beding. Onderhandelings het vervolgens meegebring dat 'n oorgangsproses na legitieme (demokratiese) plaaslike regering vir alle Suid-Afrikaners ingevolge die Oorgangswet op Plaaslike Regering, 1993 (Wet No. 209 van 1993) geaktiveer is. In hierdie proefskrif is gevolglik vasgestel: (1) welke invloed die politieke bedeling (apartheidsbedeling) op die ontwikkeling van stedelike swart gemeenskappe en die bedryf van swart plaaslike regering gehad het; (2) wat die aard en effek van NGA op die ontwikkeling van swart plaaslike regering was; en (3) hoe geldig die onderhandelde plaaslike regeringstelsel is, vergeleke met die ideeel-tipiese model wat geidentifiseer is.<br>As a result of apartheid South Africa possessed a partially legitimate local government system for several decades. The problem is that the country's apartheid government maintained separate systems for whites and blacks in separate residential areas, a policy that was unacceptable to the majority of South Africans. Black local authorities who had to maintain black local government were neither politically nor economically viable because they were rejected by the community and lacked sufficient sources of revenue to render financially independent local government services. Urban black communities were subject to what, for them, was an unacceptable apartheid-structured black local government system. Black local authorities were also prevented by their economic nonviability from delivering local government services effectively and from instituting and maintaining capital development projects. Urban blacks were therefore subjected to poor service delivery in separate, underdeveloped "dormitory towns" where they were forced to live. An issue to be considered in this regard concerns the characteristics of an ideal-typical model of local government that should replace this partially legitimate system. As a result of the unacceptability of the black local government system local authorities became the targets of activists who waged a campaign against this product of apartheid since the early eighties. Activists used non-violent action (NV A), based on the Gandhian principle of Satyagraha, to destroy black local authorities. As a result of NVA (which often led to violence) the central government was eventually forced to negotiate a new local government system for the whole of South African society with all stakeholders. Negotiations led to a process of transition to legitimate (democratic) local government for all South Africans as promulgated in the Local Government Transition Act, 1993 (Act No. 209 of I 993). Consequently the following has been established in this thesis: (1) the influence of the political dispensation (apartheid dispensation) on the development of urban black communities and the maintenance of black local government; (2) the nature and the effect of NV A on the development of black local government; and (3) how valid the negotiated local government system is, compared to the identified ideal-typical model.<br>Development Studies<br>D.
