Full textThis study investigates the role of value proposition in building an oppositional market category, the strategic interplay of platform owner and complementors, and category dynamics in digital platform emergence. Abductive qualitative research is led through an embedded case study that explores the emergence of Not Just A Label, a digital platform for emerging fashion designers aiming to be a “black sheep”. Interviews, newspaper articles, web-archive and web-scrapping were used to collect data about the management of the value proposition by the platform and the perceptions of internal and external audiences over time. The case is one of a platform with a dual approach of the value proposition, multifaceted that spans categories, yet with a coherent identity used as a covert prototype that gathers heterogeneous complementors. Intrinsic value and social externalities, as well as the resonance of the platform value proposition are key for the formation of an oppositional market category. The study motivates further research to refine our understanding of digital platform strategies and market category emergence and contributes to the development of more effective management of value propositions and complementors

Full textBy studying fashion market, this research aims to analyze legitimacy issues existing between two market categories: the primary market of mainstream fashion and the secondary market of plus size fashion. Through the lens of the Consumer Culture Theory (CCT), we observe dynamics based on practices and material devices which create symbolic, physical and social (in)visibility of market categories. Our doctoral work examines new approaches to market dynamics. The first contribution highlights four types of dynamics (attractiveness, opposition, circular and systemic dynamics), which allow to reinforce the mainstream fashion market category legitimacy at the expense of the plus size fashion market category. The second contribution explains that categorization is not a question of social representations, discourses or interactions only, but involves material devices too. Materiality appears as a visibility and invisibility device. Finally, we bring forward the social visibility issues. Behind physical invisibility (not to be seen, to be hidden…) there is social invisibility (not to socially exist). Plus size women feel then illegitimate and excluded from the fashion market

Full textMy research is devoted to the emergence of the "barter issue" in the 1990's in Russia. This issue has been at the center of a large scientific debate at the end of the 1990's among economists and politists. But neither scholars or reformers had foreseen the rapid and constant growth of this phenomenon in the Russian economy of the 1990's. On the contrary, the transition reforms were supposed to eradicate soviet barter from the economy. From an unknown phenomenon, inexistent in the Russian language, it became within a few years a statistical indicator, an economic problem and a political task. This object of public debate was portrayed as a negative phenomenon of the Russian economy, inconsistent with transition to Market economy. On the contrary, my work based on a field study in firm transactions in the Urals shows that the moral values of barter are plural and sometimes contradictory

Full textThis thesis presents a analysis of the transformations occurring within the range of local public employment. It endorses 4 European countries since 1980's (France, Germany, Poland and United Kingdom) and is linked to the European research program "Employment in the public sector: a transnational and European analysis" (EFPE / HPSE-CT-2002-50032). It is investigating the national and transnational features defining the way public employees are mobilized by local authorities within employment system. The thesis is offering a critical overview of actual analysis on public employment and intends to promote a methodology based on cross-national comparison and employment market segmentation, which try to deal with statistical deficiency by adding case-studies and interviews. Local public employment systems are then to be considered as nationally and transnationally determined, revealing local authorities employees are divided in specific markets. Using the market segmentation approach allows rendering the actual categorical diversity. Moreover, it brings to light specific insertion process towards outsiders

Full textThe « small professional » is not so well identified in current contract law. Whether it concerns general laws of contract or special contract laws, neither really have a vocation to specifically appreciate this economic stakeholder. However, if positive law is not attentive to this contracting party, its emergence at the heart of legal relations is not disputed, and as pointed out in European law, it places itself as witness to this outcome. In consequence, it is proposed to study the expression of the « small professional », on the one hand, through the already-known notions of consumer, non-professional and professional, and on the other hand, through related notions of trader and business company. Many areas are affected by the advent of the « small professional » including contract law, competition law and consumer law. The aim is therefore to emphasize the lack of attention to this party. Within the scope of its contractual relationships, the « small professional » is generally considered as a common professional, despite its special status. The purpose is also to present an adaptation of the rules related to its activities. The content of its rights and duties should be strictly analyzed in order to understand, and make them more appropriate
Tehrani, Adrien. "Les investisseurs protégés en droit financier." Thesis, Paris 2, 2013. http://www.theses.fr/2013PA020039.
Full textIn financial law, the conception of “protected investors” appears to reveal many uncertainties while at the same time, investor protection measures are numerous. This raises a number of questions. The first part of this research shows that there is a need to clarify this conception. Such a need results mainly from the detailed description of existing uncertainties and their negative consequences on investor protection objective and measures. These difficulties, which are about the concept of investor, the logic of the protection and its criteria, are a source of legal uncertainty. As a result, the quality of the protection is undermined in many different ways. The second part of this research is an attempt to clarify these points. It focuses on the legal concept of investor and on investor protection policy. The idea is to amend the legislative part of the French Monetary and Financial Code to introduce a definition of the word « investor », which relies on the suggestion that an investor should have legal personality and that there should be an act of investment. The legal definition suggested for the concept of “act of investment” also helps to draw distinctions between the legal concept of investor on the one hand, and those of shareholder, client and consumer, on the other hand. The investor protection policy which is then described lies on grounds that may look familiar, but to state them more precisely appears to be useful. For this policy to be fully implemented, and taking into account the definitions or amendments brought to the categories of “investor” and of “qualified investor”, a new legal category of actors in the financial markets needs to be elaborated
