Abstract:

Abstract:

Abstract:

Abstract:
Elian Gonzalez’s case is an intriguing example of how a small-scale dispute over the custody of a boy escalated to the point at which it became an important element in a much larger conflict involving the U.S. and Cuban governments and the Cuban American exile community. Looking at this case from the standpoint of the field of dispute resolution, understanding both the interests and positions that drove the dispute for Elian’s custody and how the conflict dynamics played out during this conflict will help shed light on Elian’s impact on both the United States and the Cuban American exile community. The purpose of this study is to understand the interests, positions, and conflict dynamics in the Elian Gonzalez’s custody dispute and its impact on the U.S. government and public opinion and on the Cuban American community, using case study documents and qualitative and quantitative studies. Using an interest-based approach (Fisher, Ury, & Patton, 1991), this study attempts to separate the respective parties’ interests from their positions during this conflict. Further, using the conflict analysis escalation dynamics model (Mitchell, 2006) and the conflict dimensions model (LeBaron & Pillay, 2006), this study demonstrates how the dispute over Elian’s custody escalated from a small-scale, interpersonal dispute into a major international struggle involving communities, countries, and U.S. public opinion at large.

Full text
Abstract:
In Gonzalez et al. v. Mexico, a case decided by the Inter-American Court of Human Rights in 2009, a context of discrimination and violence against women was known to target particular subgroups of women, of which the claimants were constituent, distinguished inter alia by their age, socioeconomic and, in some cases, migrant status. Despite this, the judgment of the Inter-American Court focused almost exclusively on sex discrimination and violence against women as a broader social phenomenon. With this judgment forming the background for the critique, the author will develop an anti-essentialist framework for the analysis of discrimination and violence against women claims where the discrimination was compounded by various identity factors. Intended to assist the Inter-American Court with its articulation of norms and standards in such cases, the ultimate value of this framework should be measured in terms of the assistance it can offer the Court at the reparations stage.

Abstract:
AbstractThe research on digital inequalities today not only focuses on inequalities related to access, but also on digital skills and outcomes of digital media use (van Deursen AJ, Helsper EJ, The third-level digital divide: Who benefits most from being online? In: Communication and information technologies annual, Emerald Group Publishing Limited, 2015; Ragnedda M, The third digital divide: A Weberian approach to digital inequalities. Routledge, 2016). However, the access inequalities are still an issue that needs to be scrutinized even in the context of the developed countries especially in relation to quality and quantity of technology access and maintenance issues (Gonzales A, Inf Commun Soc 19:234–248, 2016; van Deursen AJ, Van Dijk JA, New Media & Society 21:354–375, 2019). Focusing on the case of the distribution of iPads for all students in primary and secondary schools in the state of Bremen during the Covid19 pandemic, this chapter discusses if and how hardware distribution projects can be successful for mitigating the digital inequalities among the young people. The presented analysis is based on a participatory action research project that was conducted in a secondary school that is based in a socioeconomically disadvantaged and culturally diverse school in Bremen. The empirical data that will be discussed here consists of participatory observations from January 2020 to April 2021 and three rounds of focus groups with the students. The chapter discusses how the iPad project was perceived by the students before and after the distribution of the iPads and how they were used for distance education during school closures. The chapter will argue that the project was successful for mitigating the immediate effects of school closures by helping the students to interact more with their teachers and structure their days better by following the school’s online classes. However, the students also raised serious concerns about the maintenance of the devices as well as the risks of surveillance by the teachers and the school administration.

Abstract:
In 2005, the Supreme Court found in Castle Rock v. Gonzales that a domestic violence victim had no constitutional right to the enforcement of her restraining order. The Court’s decision precipitated a legal crisis for advocates and a personal crisis for Jessica Gonzales (Lenahan). This chapter explores the strategy decisions that went into pursuing her case at the Inter-American Commission on Human Rights (IAHCR) and an assessment of the outcome/results. It also explores the Community Oriented and United Responses to Address Gender Violence and Equality (COURAGE) in Policing Project, an outgrowth of Lenahan v. United States. Finally, it explores the ways in which these and other issues such as international human rights, police response, and gender bias play out today: the election of President Donald Trump, coupled with the rise of the #MeToo movement, have put these crises in sharp relief, particularly for domestic violence survivors who are women of color, immigrant women, and LGBTQ individuals.

Abstract:
This chapter provides several examples of how Dominican women articulate their own racial identities in relation to dominant narratives that intersect with gender in a patriarchal society. Ethnographic research in this chapter reveals the ways that Dominican women constantly navigate hierarchies of color and how narratives of class, as in the case of transnational Dominican celebrity Martha Heredia, frequently inform shifting racial meanings within and outside of the country. In this chapter Santo Domingo artists Yaneris Gonzalez Gomez and Michelle Ricardo each describe experiences of overlapping and sometimes disparate negotiations with anti-blackness. Dominican terms such as indio, negra, and morena that emerge in these and other conversations take on different meanings based on user and context.

nformation systems solving knowledge problems are made available to knowledge workers and knowledge seekers. Artificial intelligence is applied in these systems. Expert systems, decision support systems, document management systems, intelligent search engines, and relational database tools represent some of the technologies and techniques developed to support Stage 4. Officer-to-application systems will only be successful if they are built on a thorough understanding of law enforcement. Therefore, this chapter concentrates on presenting two important knowledge application tasks in police investigations: profiling and “cross+check.” Offender profiling and cross+check in police investigations are examples of law enforcement work that can benefit from technologies such as artificial intelligence, knowledge-based systems, and case-based reasoning systems (Becerra-Fernandez, Gonzalez, & Sabherwal, 2004).

Abstract:

Abstract:

Abstract:
Abstract No amount of statements about the work of a poet can substitute for the work of reading, as propaganda can for thinking or advertisements for the enjoyment of things or pornography—easily enough—for the art of love. Do you then read in a closed room, where no such interferences can enter, in an atmosphere of high seriousness? Substitution is to do with making models, and training the receiver to relate to them and not to the things themselves, and in the case of literature its smell is familiar enough to any student with an examination coming up. The problem is the models become the currency of what can be said—or what gets heard, which is the same thing.

Abstract:
In the highly competitive nowadays markets, many companies actions assume the project form. In special, Information Technology (IT) projects assume great importance, enabling the dynamic actions that organisations need (Porter, 2001; Tapscott, 2001). However, IT applications assume different roles, from operational support to strategic, according to companies’ strategies and operations, besides the peculiarities of the industry in which they compete (McFarlan, 1984; Porter & Millar, 1985). According to this role (appraised by McFarlan’s Strategic Grid), ex-ante evaluation practices for selecting IT projects to be implemented can vary (Jiang & Klein, 1999). The objective of this paper is to analyse practices for selecting IT projects in Brazilian companies classified in different quadrants of the Strategic Grid and to observe any differences in ex-ante evaluation practices among them. The adopted methodological approach was qualitative research, more specifically case study (Claver, Gonzalez & Llopis, 2000; Yin, 1991) performed in four companies.

This paper compares transportation mockup cask impact test results onto real surfaces with FEA numerical simulation results. The impact test results are from a series of cask impact tests that were conducted by Sandia National Laboratories (Gonzales 1987). The Sandia tests were conducted with a half-scale instrumented cask mockup impacting an essentially unyielding surface, in-situ soil, concrete runways, and concrete highways. The cask numerical simulations with these same surfaces are conducted with ABAQUS/Explicit, Version 5.8, The results are then compared and evaluated to access the viability of using numerical simulation to predict the impact behavior of transportation casks under hypothetical accident conditions.

Abstract:
ABSTRACT It is known that when fluids are injected into an offshore well, the temperature of the injected fluid is typically cooler than the in-situ reservoir temperature. A region of cooled rock forms around the well and this cooled region contracts, leading to a decrease in horizontal in situ stresses near the well. Such effect is always related with waterflooding or other secondary or tertiary recovery processes in long period of time, such as days or months of injection. This article will show field evidence that thermal effects can happen in a few minutes or in a couple of hours, in formations that combine high Young Modulus and high reduction in temperature during injection. This article will also present a few analyses using CFD simulation and an analytical simplified solution of the cooling effect of the reservoir during fluid injection. This will give sensibility of the orders of magnitude of the stress reduction in this condition and the fracture geometry that is being created. INTRODUCTION It is known that when fluids are injected into an offshore well, the temperature of the injected fluid is typically cooler than the in situ reservoir temperature. A region of cooled rock forms around the well and this cooled region contracts, leading to a decrease in horizontal in situ stresses near the well. Such effect is usually related with waterflooding or other secondary or tertiary recovery processes in long period of time, such as days or months of injection. Settari and Walters (2007) note that a hydraulic fracture is induced in a well when the bottomhole injection pressure exceeds the fracture propagation pressure, which is a function of the smallest in situ principal stresses, usually a horizontal stress. In this sense, Perkins and Gonzalez (1984) attest that when cold fluid is injected into a warmer reservoir, there is a tendency for the rock around the well to contract, which leads to the emergence of a region affected by thermoelastic stresses, which can reduce horizontal stresses locally. The authors claim that in cases of water injection in reservoirs, even moderately buried, the thermal effect can reduce the original stresses by hundreds of psi. A consequence of the stress reduction is the reduction of the bottomhole pressure necessary to induce hydraulic fracturing of the formation, which in this case is considered a thermally induced fracturing. Charlez et al (1996) associate the increase of the II (injectivity index) of a water injection well with the occurrence of thermal fracture. The authors state that an indication of the occurrence of thermal fracturing is the sudden increase in the injectivity of the wells after some time of cold fluid injection, even when the bottomhole pressure do not exceed the estimated or measured original fracture propagation pressure for the region.

Abstract:
The US Supreme Court is considering the fate of Section 230, a law that protects content platforms from liability for user-generated content. The case, Gonzalez v. Google, challenges the intermediary liability protection of Section 230. If the challenge succeeds, it could undermine the foundation of Web 2.0 and the internet's future. The case focuses on whether platforms like Google, Twitter, and TikTok should be held liable for third-party content from their recommendation engines. Challenging Section 230 could have severe consequences for freedom of expression and lead to restrictions on recommendation engines or higher restrictions on publishing or sharing. Section 230 has been settled law for over two decades and protects content platforms, even if they encourage users to post content.
