The monograph presents an approach to solving the problem of increasing the throughput and processing capacity of seaports in conditions of limiting their territorial dislocation and increasing the unevenness of external and internal cargo flows. The basis of the approach is the proposed system of the main parameters of the dry port and the methodology of simulation modeling of the functioning of the system "seaport - dry port". The material is illustrated with examples of the implementation of the developed approach, including model scenarios of multi-agent optimization of the parameters of the system under study. The proposed approach and the developed methodology can be used to justify management decisions on the balanced development of transport and logistics infrastructure of the regions hosting sea and dry ports. It is intended for specialists of transport and logistics companies, engineering and technical workers engaged in solving problems in the field of logistics, supply chain management and transport infrastructure design. This is an edition of all the surviving cantatas with texts by Francesco Buti (1606‒82), and thus one of the first editions of seventeenth-century Italian cantatas organized around a single poet rather than a single composer. It contains ten pieces set to music by the first generation of Roman cantata composers, such as Carlo Caproli, Giacomo Carissimi, Marco Marazzoli, Luigi Rossi, Mario Savioni, and Loreto Vittori, as well as the traveling guitar virtuoso Francesco Corbetta. Most of the pieces belong to the genre of chamber cantata and are scored for solo voice and basso continuo, though also included are a duet and a lengthy, semi-dramatic cantata for four voices and obbligato instruments. The compositions in this volume thus make a significant sampling of the early Italian cantata repertoire available to scholars and performers.

This chapter provides a re-examination of the choice-of-law theory of the foundational father of the discipline, Friedrich Carl von Savigny and shows how Savigny’s theory has been misconceived in choice-of-law literature. First, the chapter introduces Savigny’s three basic interrelated insights on the nature of the subject which serve as a basis for Savigny’s argument development. Secondly, it presents the central contention that the principle of “voluntary submission” lies at the heart of Savigny’s choice –of-law theory rather than the mythical so-called “universal seat” formula. Finally, this chapter demonstrates several of Savigny’s deviations from his own organizing principles and makes some observations about them.

The objective of recording the excavated shipwreck is to provide a basis for reconstructing the ship from the archaeological findings. This article describes two projects, carried out between 1985 and 2009, that demonstrate shallow-water excavation methods and the treatment of shipwrecks, employed in Ma'agan Mikhael ship and the shipwrecks in Dor lagoon. The process of excavating, documenting, analyzing, and reconstructing the original form and construction of a shipwreck is different in each case, although the general principles are common. Proper archaeology—delicate excavation, recording, measuring, and photographing—becomes tricky and complicated and must be done fast, professionally, and efficiently. The shipwreck provides details about construction, trading route, place of wreck, and the cargo gives information on trading of the period.

Classical music has traditionally denied the relationship of technology to the body, something on which it has always uneasily depended. That denial is well-nigh impossible to maintain today, because of the increasing assimilation of music delivery systems with the “posthuman” condition of machine-human interfaces. Bodies are no longer fully separable from machines, if indeed they ever were. The migration of music to digital media collapses the effect of auditory distance that formed the unspoken basis of music’s relationship to the human. This reorientation necessitates far-reaching changes in our conceptions of classical music, the musical work, the listening body, and the act of performance.

Opening a debate about the political dimension of science fiction films, this book uses Carl Schmitt’s thought to provide a new theoretical approach to American cinematic sci-fi since the late 1970s. Drawing on Schmitt’s notion of the state of exception and its basis in the unpredictability of tomorrow, the book looks at the political ramifications when the moment of the future finally arrives. Analyzing films such as Alien, Blade Runner and Minority Report, the book explores how power reconfigures itself to ensure the survival of the state, what ‘society’ means, who ‘we, the people’ are, and whether it will still be possible to retain a sphere of liberal, individual rights after the transformative event of the future.

This article describes the experience of reconstruction of a ship built by a seventeenth century ship builder. The lower hull and partial cargo of La Belle were discovered in 1995 and excavated within a dry cofferdam. The hull was documented, disassembled, and subjected to additional recording and reassembled in order to conserve it as a unit. On the basis of the present remains, the hull was reconstructed and several aspects of design and construction were understood. The discovery of new information, whether in the process of the reconstruction of the archaeological remains or from documentary research, necessitated a reexamination and/or a reworking of earlier recordings, preliminary reconstructions, and working hypotheses. Studying the design of La Belle was to a great extent a circular process—much like a design spiral in modern naval architecture.

Carl Schmitt cites Søren Kierkegaard in the first chapter of Political Theology to describe the repressed theological basis of sovereign decisionism. Following Jacob Taubes, Agamben blindly accepts Schmitt’s reading of the Kierkegaardian exception, a key existentialist concept that extends well beyond Kierkegaard to the decisionist philosophies of other existentialist thinkers. This volume aims to complicate Agamben’s antagonistic stance toward the Kierkegaardian exception in order to redefine his relationship to the existentialist tradition as a whole. For readers of Agamben, we draw attention in his work to overlooked strains of existentialist thought to better explain the Homo Sacer series as a philosophical worldview. By presenting the “big picture” of Agamben’s project, we also confront scholars of existentialism with a philosopher who has not been previously categorized as “existentialist,” but whose work creatively repackages important existentialist themes in a politico-theological context.

This chapter lays out the measure of peace developed by Erik Melander. As he sees it, peace concerns the conduct of politics with respect for physical integrity rights, using consensual decision making, on the basis of strong equality values. He draws on the work of Carl von Clausewitz for his insights, following Clausewitz’s trinity of dimensions of war but finding parallels in an evaluation of quality peace. To measure the concept, he employs the three dimensions to develop a map of quality peace in countries in the period from 1981 to 2008. Using data from a variety of sources, including CIRI data, his mapping leads to seven insights into the state of quality peace over the long term and around the world. The chapter concludes with discussion of further implications and considerations of the mappings’ limitations, encouraging further study.

Carl Schmitt always presented himself and was above all a jurist. His doctoral dissertation was based on an antiformal theory of law that was also in evidence in his acerbic critics of the League of Nations and the system of control over Germany established in the Treaty of Versailles. This chapter shows that the concrete-order thinking of his later years espoused a more conventional legal realism that has always constituted an important stream of international jurisprudence. Schmitt’s main postwar work, Nomos der Erde, puts forward an influential view of the history of international law as inextricably entangled with the imperial pretensions. This chapter argues that the much-cited book, together with Schmitt’s polemical concept of law and his critiques of the discriminatory concept of war, has proven a fruitful basis for much of today’s postcolonial jurisprudence.

Philosophers of science have long believed that understanding, contrary to explanation, is a philosophically irrelevant notion. On Carl Hempel’s influential view, understanding is psychological and pragmatic, and can therefore be ignored by philosophers. This chapter argues, by contrast, that understanding is not merely a psychological byproduct of explanations but a central aim of science, and that it is accordingly epistemically significant. On the basis of an analysis of the processes of constructing and evaluating scientific explanations, it argues that the production of scientific knowledge and explanations involves skill and judgment, which implies the requirement that scientific theories be intelligible. Intelligibility, defined as the value that scientists attribute to the cluster of qualities that facilitate the use of a theory, is essential for achieving the epistemic aims of science. Finally, it argues that the pragmatic nature of understanding does not undermine the objectivity of scientific explanation and understanding.

Because Carl Schmitt’s work on political theology and representation in politics presuppose a mythic basis for political order, Hamlet or Hecuba is important for providing a theory of the relationship between tragic myth and politics. If much of his work involves an attempt to understand the representational aspect of politics, Schmitt’s foray into Shakespeare criticism rejects a kind of art that is divorced from political concerns. Politics underlies the tragic effect of art by forcing the playwright to alter the plot to avoid politically determined taboos in a kind of self-censorship. In addition, this chapters argues, Schmitt develops a more aesthetic understanding of this political effect that accords better with Walter Benjamin’s idea that art can recapitulate the otherwise unspoken political exigencies of an epoch. In contrast to Benjamin’s argument in his Trauerspiel book, however, Schmitt’s theory of the relation of myth to politics rejects a modernization story in which myth gives way to reason.

Soundscape concepts have been employed for more than 20 years to enrich audiovisual studies. They have also been debated extensively. This chapter addresses soundscape as shifting, processual, historical, and produced in contingent situations. It focuses on a specific aspect of methodology that is useful for considering how to advance research on the audiovisual: methods in motion. Soundscape studies have stressed that researchers sometimes need to leave the “laboratory” and venture into fieldwork. Some of the recent developments in the “marriage” of soundscape and audiovisual studies are described, with three goals: (1) to direct attention to soundscape studies as the art and scholarly study of listening, (2) to introduce the sensory memory walk, and (3) to introduce the listening walk. Sound studies are increasingly employed as a basis for developing multisensory methodologies of studying times, spaces, and materialities to relocate sensate users of space at the center of the researcher’s attention.

The ‘return of religion’ in the public sphere and the emergence of postsecular societies have propelled the discourse of political theology into the centre of contemporary democratic theory. This situation calls forth the question addressed in this book: Is a democratic political theology possible? Carl Schmitt first developed the idea of the Christian theological foundations of modern legal and political concepts in order to criticize the secular basis of liberal democracy. He employed political theology to argue for the continued legitimacy of the absolute sovereignty of the state against the claims raised by pluralist and globalized civil society. This book shows how, after Schmitt, some of the main political theorists of the 20th century, from Jacques Maritain to Jürgen Habermas, sought to establish an affirmative connection between Christian political theology, popular sovereignty, and the legitimacy of democratic government. In so doing, the political representation of God in the world was no longer placed in the hands of hierarchical and sovereign lieutenants (Church, Empire, Nation), but in a series of democratic institutions, practices and conceptions like direct representation, constitutionalism, universal human rights, and public reason that reject the primacy of sovereignty.

How to integrate the MIC into the current system of ISDS? How can the enforcement of its decisions be ensured? On a political level, the MIC project is based on an initiative of the EU. The Public’s Law is a theory and history of democracy in the American administrative state. The book describes how American Progressive thinkers—such as John Dewey, W.E.B. Du Bois, and Woodrow Wilson—developed a democratic understanding of the state from their study of Hegelian political thought. G.W.F. Hegel understood the state as an institution that regulated society in the interest of freedom. This normative account of the state distinguished his view from later German theorists, such as Max Weber, who adopted a technocratic conception of bureaucracy, and others, such as Carl Schmitt, who prioritized the will of the chief executive. The Progressives embraced Hegel’s view of the connection between bureaucracy and freedom, but sought to democratize his concept of the state. They agreed that welfare services, economic regulation, and official discretion were needed to guarantee conditions for self-determination. But they stressed that the people should participate deeply in administrative policymaking. This Progressive ideal influenced administrative programs during the New Deal. It also sheds light on interventions in the War on Poverty and the Second Reconstruction, as well as on the Administrative Procedure Act of 1946. The book develops a normative theory of the state on the basis of this intellectual and institutional history, with implications for deliberative democratic theory, constitutional theory, and administrative law. On this view, the administrative state should provide regulation and social services through deliberative procedures, rather than hinge its legitimacy on presidential authority or economistic reasoning.

Carl von Clausewitz is best known as the paradigmatic thinker of major interstate war. However, as this book demonstrates, Clausewitz developed his theory of war on the basis of his analysis of small war. He lived at a ‘watershed’ moment during which the early modern tradition of partisan warfare morphed into the modern practice of people’s war. Both his lectures on small war and his 1812 confession memorandum are evidence that Clausewitz was a keen analyst of both forms of small war. He integrated his insights in small war and people’s war in particular systematically into his magnum opus, On War. According to Clausewitz, the nationalization of war that had resulted from the French Revolutionary and Napoleonic Wars had irrevocably introduced the option of defensive people’s war into the European strategic context. While people’s war always bore the risk of descending into political upheaval and revolutionary movements, it could also act as a custodian of the balance of power in early nineteenth-century Europe. The book reconstructs Clausewitz’s intellectual development against the backdrop of his contemporary political, philosophical, and cultural context. Understanding Clausewitz’s engagement with German Idealism and Romanticism is vital in order to reconstruct his thought on the role of reason and emotions in war, on military genius, and on the political foundations of war in general and people’s war in particular. However, a contextual interpretation of Clausewitz’s thought also forces us to reconsider to what extent this thought is applicable to strategic problems in the twenty-first century.

Abstract:
Hard coal mining is characterised by features that pose numerous challenges to its current operations and cause strategic and operational problems in planning its development. The most important of these include the high capital intensity of mining investment projects and the dynamically changing environment in which the sector operates, while the long-term role of the sector is dependent on factors originating at both national and international level. At the same time, the conditions for coal mining are deteriorating, the resources more readily available in active mines are being exhausted, mining depths are increasing, temperature levels in pits are rising, transport routes for staff and materials are getting longer, effective working time is decreasing, natural hazards are increasing, and seams with an increasing content of waste rock are being mined. The mining industry is currently in a very difficult situation, both in technical (mining) and economic terms. It cannot be ignored, however, that the difficult financial situation of Polish mining companies is largely exacerbated by their high operating costs. The cost of obtaining coal and its price are two key elements that determine the level of efficiency of Polish mines. This situation could be improved by streamlining the planning processes. This would involve striving for production planning that is as predictable as possible and, on the other hand, economically efficient. In this respect, it is helpful to plan the production from operating longwalls with full awareness of the complexity of geological and mining conditions and the resulting economic consequences. The constraints on increasing the efficiency of the mining process are due to the technical potential of the mining process, organisational factors and, above all, geological and mining conditions. The main objective of the monograph is to identify relations between geological and mining parameters and the level of longwall mining costs, and their daily output. In view of the above, it was assumed that it was possible to present the relationship between the costs of longwall mining and the daily coal output from a longwall as a function of onerous geological and mining factors. The monograph presents two models of onerous geological and mining conditions, including natural hazards, deposit (seam) parameters, mining (technical) parameters and environmental factors. The models were used to calculate two onerousness indicators, Wue and WUt, which synthetically define the level of impact of onerous geological and mining conditions on the mining process in relation to: —— operating costs at longwall faces – indicator WUe, —— daily longwall mining output – indicator WUt. In the next research step, the analysis of direct relationships of selected geological and mining factors with longwall costs and the mining output level was conducted. For this purpose, two statistical models were built for the following dependent variables: unit operating cost (Model 1) and daily longwall mining output (Model 2). The models served two additional sub-objectives: interpretation of the influence of independent variables on dependent variables and point forecasting. The models were also used for forecasting purposes. Statistical models were built on the basis of historical production results of selected seven Polish mines. On the basis of variability of geological and mining conditions at 120 longwalls, the influence of individual parameters on longwall mining between 2010 and 2019 was determined. The identified relationships made it possible to formulate numerical forecast of unit production cost and daily longwall mining output in relation to the level of expected onerousness. The projection period was assumed to be 2020–2030. On this basis, an opinion was formulated on the forecast of the expected unit production costs and the output of the 259 longwalls planned to be mined at these mines. A procedure scheme was developed using the following methods: 1) Analytic Hierarchy Process (AHP) – mathematical multi-criteria decision-making method, 2) comparative multivariate analysis, 3) regression analysis, 4) Monte Carlo simulation. The utilitarian purpose of the monograph is to provide the research community with the concept of building models that can be used to solve real decision-making problems during longwall planning in hard coal mines. The layout of the monograph, consisting of an introduction, eight main sections and a conclusion, follows the objectives set out above. Section One presents the methodology used to assess the impact of onerous geological and mining conditions on the mining process. Multi-Criteria Decision Analysis (MCDA) is reviewed and basic definitions used in the following part of the paper are introduced. The section includes a description of AHP which was used in the presented analysis. Individual factors resulting from natural hazards, from the geological structure of the deposit (seam), from limitations caused by technical requirements, from the impact of mining on the environment, which affect the mining process, are described exhaustively in Section Two. Sections Three and Four present the construction of two hierarchical models of geological and mining conditions onerousness: the first in the context of extraction costs and the second in relation to daily longwall mining. The procedure for valuing the importance of their components by a group of experts (pairwise comparison of criteria and sub-criteria on the basis of Saaty’s 9-point comparison scale) is presented. The AHP method is very sensitive to even small changes in the value of the comparison matrix. In order to determine the stability of the valuation of both onerousness models, a sensitivity analysis was carried out, which is described in detail in Section Five. Section Six is devoted to the issue of constructing aggregate indices, WUe and WUt, which synthetically measure the impact of onerous geological and mining conditions on the mining process in individual longwalls and allow for a linear ordering of longwalls according to increasing levels of onerousness. Section Seven opens the research part of the work, which analyses the results of the developed models and indicators in individual mines. A detailed analysis is presented of the assessment of the impact of onerous mining conditions on mining costs in selected seams of the analysed mines, and in the case of the impact of onerous mining on daily longwall mining output, the variability of this process in individual fields (lots) of the mines is characterised. Section Eight presents the regression equations for the dependence of the costs and level of extraction on the aggregated onerousness indicators, WUe and WUt. The regression models f(KJC_N) and f(W) developed in this way are used to forecast the unit mining costs and daily output of the designed longwalls in the context of diversified geological and mining conditions. The use of regression models is of great practical importance. It makes it possible to approximate unit costs and daily output for newly designed longwall workings. The use of this knowledge may significantly improve the quality of planning processes and the effectiveness of the mining process.
