Abstract:
When one quickly glances at the new 1990 Oriental Code, one gets the impression that the marriage legislation is substantially the same as that found in the 1983 Latin Code. This cannot be surprising since the canon law on Christian marriage concerns a sacrament of the Church and therefore one would expect that it should be much the same throughout the Catholic Church, in the Western and in the Eastern Churches. However, because of the diversity of traditions, there are differences in theological approach and matters of discipline in respect of marriage. One such difference concerns the description of the nature of marriage in each Code. This comparative study addresses a number of questions regarding the nature of marriage as proposed in the two legislations. What are the common elements in both Codes' descriptions of marriage's nature? Do both legislations fully reflect the teaching of Vatican II's Gaudium et spes? What precisely are the differences between the two Codes? What is the origin and significance of these differences? Is the Oriental legislation faithful to the tradition of the Eastern Churches? The dissertation begins by attempting a synthesis of the historical and theological background of the Church's thinking on marriage in East and West, which will help explain the different approaches found in the two Codes, and which will also assist in assessing to what extent the new Oriental Code is indeed faithful to authentic Eastern traditions. The thesis goes to thoroughly elucidate the contribution of the Second Vatican Council and to survey the post-conciliar magisterial documents and the jurisprudence of the Roman Rota. This is essential in order to evaluate the ways that the two new legislations reflect the teaching of the Council. There is then a detailed examination of the two Code Commissions' work in drafting the Church's new legislations on marriage, to try to ascertain the reasoning behind their choices of formulations. All of this enables the final part of the work to investigate the common and different approaches by the two Codes in describing marriage's nature; this involves an in-depth comparison and analysis of the relevant canons.

A travers cette thèse, on met en relief l'originalité de la notion de personne juridique privée dans l'ordonnancement canonique, en partant du code de 1917 jusqu'au code de 1983. Délimitation qui ne doit rien au hasard, car elle correspond à l'émergence, au développement et à la systématisation de cette notion. Sur la base des prémisses à la fois théologiques, juridiques et historiques, il s'agit pour nous de mieux situer le processus qui a abouti à l'introduction des personnes juridiques privées dans le code de droit canonique de 1983 ; processus dont on s'attache à montrer les points saillants, par l'agencement d'une série d'éléments disparates et hétérogènes en un ensemble plus cohérent. Toute notion juridique n'ayant pas seulement une utilité conceptuelle, mais également pratique, il importe d'en évaluer la portée en vue d'une meilleure efficience de celle-ci ; ce à quoi on s'attelle en nous appuyant sur l'exemple des associations canoniques privées dans le contexte français. Cette optique nous conduit à une confrontation du droit canonique et du droit étatique français en matière associative, non sans procéder parallèlement à une mise au point sur l'application de la législation canonique sur les associations privées dans les diocèses français. De tout ceci découle le fait qu'il est possible de préserver la spécificité canonique à travers certains mécanismes civils, dans les associations civiles qui servent de support juridique aux associations canoniques privées. Et ce en respectant le principe de laïcité. D'où l'esquisse de certaines perspectives liées aux associations privées, quand on les aborde à l'aune d'un droit spécifique dans un contexte tout aussi spécifique que celui de la France. Ainsi, se dégagent les deux pôles essentiels de notre thèse
This thesis emphasises the originality of the canonical notion of private juridical person drawing on the 1917 and the 1983 Codes of Canon Law. This period was not chosen at random. In fact, it corresponds to the emergence, development and systematisation of the notion of private juridical person. Hence, the objective of this study was firstly to illuminate the process that led to the introduction of private juridical persons in the 1983 Code in the light of its theological, juridical and historical premises, and secondly to illustrate the key aspects of the process by situating a series of disparate and heterogeneous elements within a more coherent framework.In addition to conceptual utility, every juridical notion also has a practical value. It is therefore important to evaluate its significance with a view to promoting greater practical effectiveness. This thesis aims to achieve this by drawing on the example of private canonical associations in the French context. This optic leads us to compare the canon law and French civil law relating to associations, and in parallel with this, to make a study of the application of canonical legislation to private associations in French dioceses. From this, the study concludes that it is possible to preserve canonical specificity within civil associations by means of various civil law mechanisms that serve as a juridical foundation for private canonical associations. It is also possible to achieve this while maintaining respect for the principle of secularism. On the basis of this work, the study sketches out various perspectives for private associations in the light of a specific law in a context as particular as that existing in France. This leads to the emergence of the two major poles of our thesis

Abstract:
Le canon 1752 formule la loi suprême de l'Eglise : le salut des âmes. Dans l'ordre canonique, c'est dire que l'Eglise poursuit une fin spirituelle. Le salut des âmes -les biens spirituels- est l'objet propre de la société parfaite qu'est l'Eglise. Ceci signifie également que la mission de salut de l'Eglise est exercée à travers des actions "spirituelles". Cette organisation transparaît à travers les normes sur le salut. Cependant, on trouve dans des formules liturgiques que la fin spirituelle est aussi atteinte à travers des activités temporelles. "Gaudium et Spes" (34-35 ; 38-39) l'atteste. De même, les "Paroles" autour du Synode pour les Eglises d'Afrique et Madagascar ont clairement souhaité une prédication sur le salut qui ait des incidences sur la vie temporelle des peuples en Afrique. Or, la prise en compte de l'homme concret et historique que l'on peut constater à travers les théologies du salut permet la perception du salut comme une économie : dans son achèvement, le salut est la vie éternelle auprès de Dieu. L'homme temporel le reçoit comme une tâche. Cette vision est possible e. A. Dès lors qu'on accueille tout le Christ des Ecritures comme un tout. En même temps, la ligne temporelle permet de dépasser la perception du salut en pôles isolés. Une manière donc pour l'Eglise de travailler au salut spirituel de l'homme historique est de participer à l'amélioration de sa condition matérielle. Et il n'est pas neutre que les sources de la loi suprême du salut des âmes ne sont pas scripturaires ou s'arrêtent au Moyen-Age. Le code de 1983 s'est étendu sur la vie et le ministère des clercs. Il devrait continuer sur la spécificité de la vie et du ministère des lai͏̈cs : animer l'ordre temporel de l'esprit chrétien. Nous proposons l'institution d'un Droit Canonique Social, qui a déjà des racines dans l'histoire de l'Eglise. Nous en indiquons quelques pistes. C'est une utopie, aboutissement normal de la méthode multirationnelle que nous avons appliquée.

Comme son titre l’indique, la présente thèse porte sur la canonicité de la Conférence des évêques. Elle vise à réfléchir au degré d’autorité decette nouvelle institution spécifiquement latine. La Conférence des évêques est devenue un organe permanent, alors que le Synode desévêques né en 1965 sous le pontificat de Paul VI n’a pas reçu cette caractéristique. La Conférence des évêques est-elle une expression de lacollégialité épiscopale ? Le Concile Vatican II (1962-1965) l’a admise comme l’une des composantes de cette collégialité. Vatican II l’aconsacrée et institutionnalisée (Constitution Lumen Gentium et Décret Christus Dominus), mais sans parvenir à lever toutes les questionsliées à son autorité et à sa juridiction. Le Synode des évêques de 1969, dont le thème annoncé était précisément la collégialité vécue, a aussiabordé la question des Conférences épiscopales. À cette Assemblée synodale, le débat a concerné principalement les moyens à mettre enoeuvre pour réaliser une coopération réelle et efficace entre Rome et les Conférences épiscopales et pour garantir une meilleure autonomie àces Conférences, sans pour autant entraver la liberté du Pape, ni porter atteinte à l’autorité de l’évêque diocésain. Il s’en est suivi une plusgrande détermination des principes qui régissent d’une part les relations entre les Conférences épiscopales et Siège apostolique, et d’autrepart les liens des Conférences épiscopales entre elles.Mais ce débat n’a toujours pas été tout à fait dirimé, surtout quant à l’autorité magistérielle de la Conférence des évêques. La qualificationjuridique en 1983 par les soins de la codification latine semble n’avoir pas suffi. Témoigne de ce malaise persistant le Synode des évêques de1985. Celui-ci a formellement demandé une réévaluation de l’institution de la Conférence des évêques : « Puisque les Conférencesépiscopales sont particulièrement utiles, voire nécessaires dans le travail pastoral actuel de l’Église, on souhaite l’étude de leur « status »théologique pour qu’en particulier la question de leur autorité doctrinale soit plus clairement et plus profondément explicitée, compte tenude ce qui est écrit dans le décret conciliaire Christus Dominus n° 38 et dans le Code de droit canonique, can. 447 et 753 ». Cela aoccasionné deux efforts institutionnels, l’un consultatif (L’Instrumentum laboris de 1987 de la Congrégation pour les évêques), l’autre décisionnel (le Motu proprio Apostolos suos de 1998). Dans cette dernière norme de requalification théologique et juridique, le Pape Jean-Paul II réaffirme de manière plus décisive la spécificité de la Conférence des évêques. Ce vaste dossier peut sembler redondant et lancinant. Les chercheurs peuvent constater que le problème de l’autorité de la Conférence des évêques s’avère encore difficile à trancher. En effet, les principaux paramètres de l’édifice ecclésial ne sont-ils pas profondément interrogés ?
As it is suggested within the title, the present thesis focuses on the canonicity of the Conference of bishops. It aims to reflect the degree ofauthority of this new specifically Latin Institution. The bishops Conference has become a permanent body, while the Synod of bishops whichwas born in 1965, under Pope Paul VI did not receive this feature. Is the Conference of bishops an expression of episcopal collegiality? TheSecond Vatican Council (1962-1965) was admitted as a component of this collegiality. Vatican II was consecrated and institutionalized(Constitution Lumen Gentium and Decree Christus Dominus), but failed to raise any issue relating to its authority and jurisdiction. The 1969Synod of bishops, whose theme was announced, more precisely lived collegiality, also addressed the question of episcopal conferences. Atthe Synod Assembly, the debate has mainly concerned the means to implement in order to achieve a real and effective cooperation betweenRome and the bishops' conferences, and to ensure greater autonomy to these conferences, without impeding the freedom of the Pope, orundermining the authority of the diocesan bishop. There ensued a greater commitment to the principles which govern, on the one hand, therelationship between the Episcopal Conferences and the Apostolic See, and on the other hand, the links between the different episcopalConferences.But that debate has still not been completely invalidated, especially as it refers to the teaching authority of the Conference of bishops. Thejuridical qualification, in 1983, through the efforts of the latin codification seems to have been insufficient.The Synod of Bishops, in 1985, demonstrates this persistent discomfort. It has formally requested a reassessment of the institution of theConference of bishops: « Since the Episcopal Conferences are particularly useful, even necessary in the current pastoral work of theChurch, we want to study their theological " status " so that in particular the issue of their doctrinal authority would be more clearly anddeeply explained, taking into account what is written in the conciliar Decree Christus Dominus, item N° 38 and in the Code of Canon Law,can. 447 and 753 ». This situation derived to two institutional efforts: an advisory one (The Instrumentum laboris of 1987 of theCongregation for bishops), then another one, a decision (the Motu proprio Apostolos suos 1998). In this last theological standard and juridicalrequalification, Pope John Paul II reaffirms, more decisively, the specificity of the Conference of bishops. This extensive file may seem to beredundant and haunting. Researchers can notice that the problem of authority of the Conference of bishops remains difficult to determine. Infact, are the main parameters of the ecclesial structure not deeply questioned ?

This work illustrates the institution of the authentic interpretations of the universal laws of the Church, currently under the responsability of the Pontifical Council for Legislative Texts. After analysis of the function of the interpretative law, the elaborate ranks the twenty-nine authentic interpretation dates following the promulgation of the Code of Canon Law of 1983 within the specified category mentioned in can. 16, § 2 (declaratio, explicatio, coarctatio and extensio legis). The method that inspires the attempt to classify the responses is that of the so-called "legal realism", which leads to overcoming the positivist view of canon law and sees in the solution of an doubt of law the ideal remedy to protect, rediscover and strenghten the "rationabilitas" of the law interpreted.

Abstract:
Given the breath-taking pace at which the amount of data being generated on a daily basis is growing, and the keen desire to extract information from this data, there is strong interest within the storage industry, at finding means to efficiently and reliably store this data. Given that individual storage units are prone to failure, data pertaining to a single _le is distributed across storage nodes. Such storage of `Big Data' across a spatially distributed network of nodes, calls for codes than can efficiently handle the issue of node repair. The need for node repair could arise on account of device failure, need for a maintenance reboot, or simply because the node is busy serving other demands. A new branch of coding theory has sprung up in response. Regenerating codes minimize data download during a repair operation, while codes with locality ensure that local operations suffice for node repair. The present thesis makes contributions to both regenerating codes as well as codes with locality. While the reliable storage of data in disks with minimum storage overhead is a well-studied problem, the problem of node repair is relatively new. From the viewpoint of the storage industry, the cost to repair a failed node can be measured in two distinct ways: firstly, in terms of the number of surviving nodes accessed, and secondly, in terms of the amount of data transmitted over the network to ensure repair of the failed node. In a regenerating code having parameter set (n; k; d; (_; _);B), and over a _finite _field Fq, a file consisting of B symbols from Fq is encoded into n_ symbols, and the coded symbols are stored in n distinct nodes, each node storing _ symbols. The parameter _ is referred to as sub-packetization level. The entire _le can be recovered from downloading k_ symbols from any set of k nodes. Under the exact-repair (ER) setting that is of interest here, the contents of a failed node are repaired exactly from a total of d_ symbols downloaded from any d helper nodes, each helper node transmitting _ symbols. In the alternative setting of functional repair (FR), the contents of the replacement node can be different from that of the failed node, however, following node repair, the new configuration is still required to satisfy the data-recovery and node repair properties of a regenerating code. Under the FR setting, there is a trade-off known as storage-repair-bandwidth (S-RB) trade-off between the values of _ and d_, that optimize the size of the _le being stored. The two extreme points of the trade-off, one corresponding to the minimum possible value of _ and the other, to the minimum possible value of d_, are known as the minimum-storage-regenerating (MSR) and minimum-bandwidth-regenerating (MBR) points respectively. It has been shown that the extreme points of the ER trade-off coincide with those of the FR trade-off. However, the characterization of trade-off in the case of ER remains an open and challenging problem. High-rate MSR code constructions the _first problem reported in the thesis, is one of designing exact-repair MSR codes that possess certain additional desirable properties, namely, high rate (i.e., rate greater than half) and a small value of sub-packetization level _. In the present thesis, we construct a family of MSR codes for d = (n 􀀀 1) having a fixed rational rate R = (t 􀀀 1)=t and a sub-packetization that is polynomial in k for a fixed rate. In the construction, _ varies with k as _ = O(kt). This was the first high-rate MSR code construction to have such small value of sub-packetization. Canonical codes: Regenerating codes for the interior points of the S-RB trade-off the next pair of results relate to the construction of interior-point regenerating codes. For the parameter set (n; k; d = k), we first construct as our second result, a class of codes referred to as canonical codes, having an auxiliary parameter w, with w in the range n􀀀k < w < k, these codes operate in the region between the MSR point and the MBR point, and perform significantly better than operating points obtained through space-sharing. The canonical code constructed for the case (n; k = n 􀀀 1; d = n 􀀀 1), turn out to achieve an interior point of the FR trade-off, thus characterizing for the first time, an interior point of the ER trade-off. Generalized Canonical codes We next build on top of a canonical code having parameters (n; d; d) and construct codes corresponding to a more general parameter set of the form (n; k < d; d) using two different approaches. In the first approach, leading to what we refer to as non-canonical codes, an exponential expansion in field size is needed while the parameters _ and _ remain the same as in the case of the (n; d; d) code. In the second approach, the value of _ is increased from that of the (n; d; d) code, but no expansion in field size is needed. The resultant codes are referred to as improved layered codes. Both approaches lead to codes that perform much better than the space-sharing line. Outer bounds on the storage-repair-bandwidth trade-off the next set of results presented here take on the form of two distinct outer bounds for the S-RB trade-off. The first is referred to here as the repair-matrix bound and the second as the improved Muhajir-Tandon bound. The repair-matrix bound lies strictly away from the FR trade-off for every parameter (n; k; d), and thus proves that the ER trade-off is bounded away from the FR trade-off, even when the _le size grows to infinity. This result solved an open problem in the literature. In conjunction with the improved layered codes constructed in the thesis and described above, these outer bounds characterize the ER trade-off for the case when (n; k = 3; d = n 􀀀 1). This is the first family of parameters for which the ER trade-off is characterized. Furthermore, for the parameter set (n; k = 4; d = n 􀀀 1), the operating point of the improved layered code coincides with the outer bound, characterizing yet another interior point of the S-RB trade-off. Codes with hierarchical locality the final set of results relate to the second class of codes developed for efficient node repair, namely, codes with locality. The aim of this class of codes is to reduce the number of nodes accessed while repairing a failed node. In a code with locality having locality parameter r, every symbol can be repaired by accessing r other symbols, where r is typically, much smaller than the dimension k of the code. We introduce in the thesis the notion of hierarchical locality, where the local codes are of varying locality and possess a hierarchical structure. In the case of two-level hierarchical locality, for instance, every symbol is protected both by an inner, short-block-length local code, as well as a middle code of larger block length. The code symbols in the inner code are a subset of the code symbols in the middle code. We first present the case of codes with two-level hierarchy, derive an upper bound on the minimum distance and provide optimal code constructions for a wide parameter range. The minimum-distance bound, and code construction are then generalized for the case of a hierarchical structure having an arbitrary number of levels.

Abstract:
Oxymonads are a group of heterotrophic flagellates living in low oxygen environment. These protists inhabit mainly the gut of xylophagous insects (cockroaches, termites), with an exception of the genus Monocercomonoides, which was described from the intestinal contents of many vertebrates. On the basis of molecular data, Oxymonadida are classified into the supergroup Excavata (Cavalier-Smith, 2002; Simpson et al., 2006, Hampl et al. 2009). This thesis was focused on the diversity of genus Monocecomonoides from the morphologically simplest family Polymastigidae. The main goal of our work was to gather sequence data from strains isolated from a wide spectrum of hosts. We have obtained 26 partial sequences of the gene for the SSU rDNA in total, of which two belonged to another oxymonad, apparently genus Oxymonas. Our phylogenetic analysis indicated that the representatives of the genus Monocercomonoides form one group, however with a low bootstrap support. On the basis of published data about the presence of non-canonical genetic code in some oxymonads (Keeling and Leander, 2003; de Koning et al., 2008), we decided to explore this rare phenomenon in representatives of the genus Monocercomonoides. The thesis describes fatherhood from the antic age until now. It defines the role play of the father in each historical periods of time and describes sources of influence which formed this role. The study is also focused on the influence in the catholic church and analysis from the church point of view. Subject of the thesis practical part is views of men on their role as fathers in a Prague suburb parish. It attempts to capture their fatherhood experience and to analyse it in relation to the fathers' attitude to the education of their children and material security. It focuses on ways of spending leisure time with their children, their education and comprehension and passing faith on them. It also analyses ways of the fathers' involvement in their households and child care.
