Davidsson, Louise, and Sara Thulin. "The Legal Status of Domain Names : A Business Context." Thesis, Jönköping University, JIBS, Commercial Law, 2008. http://urn.kb.se/resolve?urn=urn:nbn:se:hj:diva-1089.
Full textDomain names are still a relatively unknown occurrence and despite being a natural part in
most people’s every-day life, there are few who reflect over their importance. The original
function of domain names was merely to serve as technical addresses and to facilitate the
locating of websites on the Internet. Today domain names are much more than this. In
addition to the address function, domain names may also serve as indications of goods,
services, businesses or information. The domain name is usually the first contact one gets
with a website and it has become crucial for businesses to have their company name or
trade marks registered as domain names. The issue of the legal status of domain names has
mainly been discussed from an American point of view and in Sweden this discussion has
almost entirely fallen under the radar. If the legal status of a domain name were clear, it
would be easier for businesses to avail themselves of the value of that domain name. It
would possibly even contribute to strengthening the legal protection for the domain name
holder, in for example insolvency or bankruptcy procedures.
Intellectual property exists in many different forms, the main being patents, trade marks,
copyright and design rights. Although there are many differences between them, they all
have in common that they establish property protection over intangibles such as ideas,
inventions, signs and information. As a domain name is not a physical object, there can be
no doubt that it is an intangible. The question is whether it is property. Intellectual
property is not a static area and it can, in line with societal and technological development,
be expanded to include new types.
The legal status of domain names is generally discussed in the light of the close connection
they have with trade marks. Except from their original function, the trade mark function of
domain names can probably be considered as one of the most commonly accepted. It is
indicated in this thesis that that function contributes to that a domain name can be
considered as a distinctive sign and thereby obtain protection, in the same way as an
unregistered trade mark.
According to current accounting rules, businesses may, to some extent, avail themselves of
the value of a domain name. Domain names are under certain circumstances identified as
intangible assets and even as ‘similar rights’ to for example trade marks and patents in
accounting and taxation situations.
At this time it is not possible to legislate on the area of the legal status of a domain name
on a Community level, as this most likely would have to include a consideration of the
existence of property rights and consequently fall outside the legislative powers of the
Community.
Both the legal development and the legal discussions on the topic of the legal status of
domain names in Sweden have been relatively sparse. Nonetheless, there have been some
interesting opinions.
By investigating what positions the different authorities, academics and practitioners have
taken on the legal status of domain names it can be concluded that the prevailing opinion
in Sweden is that domain names are not considered as property. The reason for this seems
to be that domain names as such, are in fact no more than technical constructions and that
by registering a domain name the registrant only becomes the holder of a contractual right.
However, there are some diverging opinions which could suggest that the legal status of
domain names in Sweden is not yet settled. The aspects which are then taken into
consideration include that domain names have developed to become important and
valuable assets for an increasing number of businesses. A domain name is a precondition
for the creation of a website and therefore of crucial importance for, in particular, online
based businesses. However, they are of increasing importance for all businesses to reach
out to and compete over the same customers.
It is advocated that the fact that domain names are freely traded with indicates that domain
names are property. It has also been questioned whether an asset with a true economic
value, such as a domain name, can exist without being considered as an item of property.
The steps taken in other jurisdictions have shown that the legal status of domain names is
not even clear in some of the countries with the greatest experience of domain names.
Nonetheless, the legal status is given attention in those countries and the discussion has
been initiated. In general, it can be concluded that the development seems to go toward
higher awareness of the value of domain names.

Full textThe first timeshare resorts were created in the 1960s. Since then, the concept of vacation timesharing has spread around the world. Despite significant growth in the last 30 years, little academic research exists concerning the competencies required to manage timeshare resorts. This study provides new perspective on competency domain clusters within the timeshare industry. Three hundred thirty one property-level timeshare managers were asked to rate the importance and frequency of use of each competency domain cluster. The data gathered from the survey reveals a relationship between the types of resort a manager manages and the importance and frequency ratings of each competency's domain cluster. Further, a surprising result was the discovery of a lack of industry certification among the respondents. These results may be useful in training and development strategies for timeshare resort managers.

Full textToday, millions of purchased domain sites names are sitting unused with no real web designs or concrete purpose coupled with them. Why would not owners engage a web-hosting domain-parking hotel so they can earn money through eyeballs advertising or click revenue while their sites sits unused? Parking hotels claim access to passive domain monetization through advertising programs tailored to generate revenue via automatic web page generations containing tailored advertisement. When visitors access these web sites, revenue is generated for domain owners. This study sought to investigate if parking hotels’ advertising claim, that you can make money through them, carries substance. Hence, is it possible to generate sufficient revenue using a parking hotel’s advertising revenue model to pay for the cost of domain ownership and, if possible, generate excess revenue? The study’s epistemological approach, trying to distinguish the truth about the hotels’ claims, stems from a ontological discussion around web hosting hotels’ advertising vehicle existence and its ability to generates revenue. The study challenged a parking hotel’s claim through an inductive quantitative approach by watching advertising revenue for 59 domain names over 105 days. Quantitative data concluded, through a statistical approach, that there were insufficient advertising income, approximately a nickel, to cover the annual cost of approximately $6 USD. Therefore, the study concluded that the advertising claims were misleading and recommends that sites are not purchased, or renew, for the purpose of making money through web hotels’ advertising models.

This study explored the generalizability of citizenship behavior, support, and fit to the occupational domain. In doing so, arguments to include occupation constructs in organizational analyses were offered, reliability and validity testing of the occupation constructs was performed, and relationships among the occupation constructs, their respective organizational counterparts, occupation-related outcomes, and organization-related outcomes were explored. Results of the assessments demonstrated that occupational citizenship behavior, perceived occupational support, and person-occupation fit are distinguishable from their organizational counterparts and that occupation constructs and organization constructs contributed independently to occupational activity and work place behavior. Overall findings from the study suggest inclusion of occupation constructs in organizational analyses can enrich, complement and/or supplement our understanding of organizational behavior.

Full textHusqvarna is a Swedish company producing products for forestry, park and gardens. Due to harder competition they wish to increase efficacy in production. This can be achieved by shorter lead-times in the complex process of making casting molds. Activities within this process have certain relations and dependencies between each other that can be analyzed by using a Dependence Structure Matrix. The Dependence Structure Matrix is a tool that can improve efficiency by rearranging activities according to how they are dependent of each other.
The purpose is to make a Dependence Structure Matrix of activities that Husqvarna can use to analyze dependencies within the process of cast molding. The DSM Matrix will propose restructured activities of the process which can be evaluated to determine if greater efficacy can be reached.
To determine the activities within the process of making cast molds a workshop at Husqvarna for the people involved was conducted. A matrix has been constructed based on the information of activities and their dependencies. This information has then been analyzed by the software Multiplan.
The process of making casting molds could be analyzed by the DSM/DMM approach. A new order of how to carry out activities is the outcome of the analysis. The result can be analyzed by Husqvarna in order to determine if greater efficacy can be reached.

Prior research has demonstrated that feminine appearance is penalized in business contexts. However, a separate body of research, predominantly centered on electoral outcomes, has put forth conflicting results demonstrating that feminine appearance can be beneficial. In a series of experimental studies, I aim to resolve the conflict in the literature by proposing an expectation-matching theory. I propose that, although both domains of politics and business are associated with masculine characteristics, contexts within the political domain are associated with fewer masculine characteristics than contexts within the business domain and, as a result, perceivers expect and prefer less masculine facial appearances for political leaders than for business leaders. The findings of the studies add to the face perception literature and the gender bias literature that examines the impact of circumstances that make gender and professional roles discrepant in their impact on consequential outcomes, such as hiring and electoral outcomes.

Full textNowadays, business processes allow more automation of tasks and complex interconnections within the same system and across different systems, which is particularly facilitated by the emergence of Web services. In this context, the tasks of specifying and checking compliance at runtime become particularly challenging. In this thesis, our goal is twofold: monitoring and security in the context of Service Oriented Architecture (SOA). Thus, we proposed a view-based monitoring approach and a framework that target monitoring of business process compliance at runtime. Our monitoring framework aims to offer an easy way to specify properties to be monitored and to facilitate its integration with SOA based environments. Thus, we have developed a new monitoring language called BPath, which is an XPath-based language that offers among others, the ability to express and to check temporal and hybrid logic properties at runtime, making the execution of business processes visible by expressing and evaluating quantitative indicators, in order to detect any compliance violation at runtime. A specific compliance monitoring concern in SOA based environment is security, which is also an important aspect for companies willing to give access to some of their resources over the Web. Thus, we proposed a domain specific language (DSL) based architecture for ensuring security in SOA environments. We particularly focused on access control by proposing a graphical language to facilitate the specification and generation of access control policies. Our approaches are implemented and integrated within a complete end to end compliance framework developed within the COMPAS project

Full textEarly requirements analysis in context of project and engineering-based organisations deals with the establishment of the top-level definition of the project’s product. Literature shows that communication and coordination is challenging in conjunction with visualisation and representation of knowledge in a cross-community constellation of business and product development (PD) teams concerned with early requirements analysis. Recently debated formalisms produce (coherent) intentional models that aim at increasing rationalisation and confidence in engineering definitions using the concept of goals. But most goal-oriented approaches fell short in establishing usable intentional structures that are able to provide the respective transparency for supporting continuously business-engineering evolutions within collaboration and knowledge conversions along a PD process. In this sense, this thesis provides a complementing (informal) approach that emphasises on business and engineering collaboration and knowledge conversions. In this context a tripartite knowledge-driven concept is proposed that anchors a value-oriented organisation of intentional structures (i. E. Business needs and expectations) and traces to engineering definitions. In addition, this concept serves the notion of knowledge representation forum and illustrates how to perform valuation and verifications of intentional structures implemented in forms of requirements. This work was developed along a hybrid action research methodology that employs an empirical study and two industrial application cases

Full textOntologies in nowadays are widely used in the process of development of modern information systems, since they are suitable to represent domain knowl-edge. However, the development of domain rules in ontology-based information systems is required to be analysed. In this dissertation, the author proposes a formal method of transforming ontology axioms to domain rules, making an im-portant and integral part of each domain and used to constrain or direct different aspects of a domain. Such rules can be consecutively transformed into executable form and implemented in a software system of an information system. The pro-posed method is formalised using the Z notation and the MDA framework is ap-plied to automate it. The dissertation consists of the introduction, four chapters, the conclusions, references, list of author’s publications and three annexes. The introduction overviews the main problem analysed in the dissertation and its importance. The aim and consequent objectives, scientific novelty and practical value of the research, methodology of the research, hypothesis of the research, scientific approval, contribution of the results and structure of the dis-sertation are formulated and presented in this chapter.

Full textIn a world that is moving faster and faster, a company’s ability to align to market changes is becoming a major competitive factor. Forecasting enables companies to predict what lies ahead, e.g. trend shifts or market turns, and makes it possible to plan for it. But looking into the future is never an easy task.
“Prediction is very difficult, especially if it’s about the future.” (Niels Bohr, 1885-1962)
However, progress in the field of forecasting has shown that it is possible for companies to improve on forecasting practices. This master thesis looks at the sales forecasting practices in MNCs primarily operating in emerging and developing countries. We examine the whole process of sales forecasting, also known as forecasting management, in order to develop a comprehensive model for forecasting in this type of companies. The research is based on a single case study, which is then later generalized into broader conclusions.
The conclusion of this master thesis is that forecasting is a four-step exercise. The four stages we have identified are: Knowledge creation, knowledge transformation, knowledge use and feedback. In the course of these four stages a company’s sales forecast is developed, changed and used. By understanding how each stage works and what to focus on, companies will be able to improve their forecasting practices.

Full textOver the past decades, a new context in favor of sustainable development emerged. New models of consumption and production are developed. This shift from intensive innovation to sustainable innovation leads some companies to rethink their business model. However, this business model evolution requires strategic and organizational changes that some companies fail to overcome. These companies’ situations reveal a double challenge : the need to characterize sustainable innovation on the one hand and defining a strategy for disseminating sustainable innovation on the other hand.To characterize sustainable innovation, three notions are mobilized : the business model, sustainability and functionality. The results of this exploration suggest the use of the business modelas an intermediary object to promote the co-construction and the evolution of business models. The study of sustainable led us to associate functional economy - servicial business model - to eco-design- environmental design - as a declination of sustainable innovation. Functionality concept analysis revealed the complementarity of functional economy and eco-design approaches. This allows us to define new offers from the use-values point of view. The exploration of these three notions also leads to propose a paradigm shift in favor of sustainable paradigm. This paradigm shift is followed by the development and characterization of business models trajectories. These trajectories guide companies in achieving the highest levels of sustainable innovation on the long term. These theoretical results were used to develop a method called Business Model Explorer for Sustainability (BMES). The BMES method allows companies to develop sustainable business models and to define trajectories toward these business models. The method is based on the upgradability concept as operational application of sustainable innovation. The method was developed and tested with the two industrial partners of IDCyclUM project : Neopost and Rowenta. One of the main proposed research perspectives is to continue defining sustainable innovation. This concept remains indeed ambiguous and there is still no consensus about its definition at present
