Abstract:
In William & Glyn's Bank v Boland Mr Boland, the sole resgistered proprietor of a house, mortgaged it to a bank. On his inability to meet the repayments, the bank sought possession as a prelude to the exercise of its power of sale. The action of possession failed because Mrs Boland successfully claimed an overriding interest in the property. This claim was founded on her having substantially contributed to the purchase of the house, thereby obtaining an interest in it. This interest was enforceable against the bank because she was in actual occupation of the land at the time it acquired its interest with the result that, because of section 70(1)(g) of the Land Registration Act 1925, she had an overriding interest in the land.

ENGLISH ABSTRACT: South Africa is experiencing major political, economic and social changes and in its policy orientation towards the event of globalisation. These changes are intended for the empowerment of those previously disadvantaged and for the levelling of the playing field for future equality of opportunities. In empowering these individuals it is recognised that agriculture is one of the important sectors that would serve as a vehicle for the development of the country. It is the main source of economic growth and the bedrock of economic development. Agriculture depends strongly on land, which is also an asset that can be used to generate income. For this reason land reform in the form of grants is one of the important tools employed in South Africa to redistribute land to the disadvantaged in order to enable them to improve their income and also to develop rural areas. As this programme is based on a market-assisted approach, its success depends on land markets that function well and are stable enough to carry it. The objective of this study was to determine the state of land redistribution and to analyse the land market in the Boland region of the Western Cape province. The effectiveness of land redistribution was analysed with regard to the number of transactions that took place in the years 1998, 1999 and 2000 in terms of citizenship, race, mode of land acquisition amongst the disadvantaged (government grants, private acquisitions and inheritances), quantity and quality factors. The findings were discussed in terms of their implications for the success of the programme and their influence of the land market. Finally recommendations were made for potential improvements as well as for further research. It was found that land redistribution by means of government grants was rather slow and most of the transactions took place through private purchases, mostly through mortgage loans provided by the Land Bank of South Africa. Although private transactions redistributed more wealth measured in terms of size pf land, the accompanying land was less superior using price per hectare as a proxy for quality compared to land purchased with the assistance of the government. Transactions for the latter were mainly through joint ventures with current owners. The study also revealed that the land market in the Boland is one of the major obstacles to the speedy transfer of land not because of the foreign investment, but due to the nature of the sectors. The two main agricultural sectors are viticulture and deciduous fruit which have experience high growth in income and export. The analysis conducted established that there was no significant difference between properties bought by foreigners, white and Black South Africans. Future trends in land prices could not be predicted but it is expected that agricultural land prices will be well above the capitalisation value of future profits arising from the level of foreign investment as well as economic gain. Based on the finding the areas to be emphasised by the land reform programme in this region are joint venturing and the promotion of subsidies on mortgage loans as well as extending the government's role in the land market. Increased government spending and involvement of the private sector, including financial institutions and established commercial farmers, are some of the things to be encouraged to facilitate the process and ultimately to overcome poverty. The sole reliance on the current regional land market seems incapable of effectively and speedily redistributing land to beneficiaries, whereby equality can be achieved in the long run. However, if all the shortcomings of the land market are recognised and a new policy is adopted, land reform in the Boland and in South Africa will in the future be more likely to promote increased access to land, resulting in higher productivity, growth and a globally competitive agriculture.
AFRIKAANSE OPSOMMING: Suid-Afrika ondervind tans grootskaalse politieke, ekonomiese en sosiale veranderinge en so ook in beleidsoriëntering na aanleiding van globalisasie. Hierdie veranderinge het ten doel om voorheen benadeeldes te bemagtig en om die speelveld gelyk te maak met betrekking tot toekomstige geleenthede. Tydens die bemagtiging van hierdie individue word landbou erken as een van die belangrikste sektore wat kan dien as 'n voertuig vir die ontwikkeling van die land. Landbou is die hoofbron van ekonomiese groei en die hoeksteen van ekonomiese ontwikkeling. Alhoewel landbou grootliks afhanklik is van grond, is grond 'n bate wat gebruik kan word om inkomste te genereer. Om hierdie rede is grondhervorming in die vorm van 'n toekenning of subsidie een van die belangrikste meganismes wat in Suid Afrika gebruik word om grond aan die voorheen benadeeldes te herverdeel. Die doel van grondhervorming is om die voorheen benadeeldes in staat te stelom hul inkomste te verbeter en ook om landelike gebiede te ontwikkel. Hierdie program is gebaseer op 'n markondersteunde benadering en daarom hang die sukses af van die grondmark wat goed funksioneer en stabiel is. Die doelwit van hierdie studie was om die stand van grondhervorming te bepaal en om die grondmark in die Boland-streek van Wes-Kaapse provinsie te ontleed. Die effektiwiteit van grondherverdeling is ontleed met betrekking tot die getal transaksies wat plaasgevind het in die jare 1998, 1999 en 2000 in terme van burgerskap, ras, metode van grond aanskaffing tussen die minder bevoorregte (staatstoekennings, private aanskaffing en erflatings), hoeveelheid en kwaliteit. Die bevindings is bespreek in terme van hul implikasies vir die sukses van die program en hul invloed op die grondmark. Finale aanbevelings is gemaak vir potensiële verbeterings sowel as vir verdere navorsing. Daar is bevind dat grondherverdeling by wyse van staatstoekennings baie stadig was en meeste van die transaksies was deur private aankope, meestal deur verbandlenings verskaf deur die Landbank. Alhoewel privaat grondverkope grootliks rykdom herverdeel, is die waarde in terme van prys per hektaar minder in vergelyking met die waarde van grond aangekoop met die hulp van die staat. Wingerbou- en tuinbouprodukte het die hoogste groei in inkomste en uitvoer ondervind. Dit word egter verwag dat grondpryse ver bo die kapitalisasiewaarde van toekomstige winste sal styg voortspruitend uit onder andere die vlak van buitelandse investerings. Die areas wat beklemtoon moet word deur die grondhervormingsprogram in die streek, is gesamentlike ondernemings en die bevordering van subsidies op verbandlenings. Verhoogde staatsbesteding en betrokkenheid van die private sektor, insluitende finansiële instellings en gevestigde kommersiële boere, moet aangemoedig word om die proses te fasiliteer en om uiteindelik armoede te oorkom. Die huidige streeks-grondmark blyk onbevoeg te wees om herverdeling van grond aan begunstigdes effektief en spoedig op die lange duur te laat geskied. Indien die tekortkominge van die grondmark erken word en 'n nuwe beleid aanvaar word, sal grondhervorming in die Boland en in Suid-Afrika in die toekoms meer geneig wees om toegang tot grond te bevorder. Dit sal aanleiding gee tot hoër produktiwiteit, groei en 'n globaal mededingende landbou.

Sedert die verandering in wetgewing in 2003, bevind die kleinhandel apteeksektor hulself in ‘n baie turbulente omgeweging, omdat die eksterne omgewing dramaties verander het en nuwe kompetisie gedryf deur sakereuse soos Clicks en Dischem hul voortbestaan bedreig. Die instelling van die enkeleindprys (SEP) en verandering in wetgewing oor die eienaarskap van apteke, het die grootste invloed gehad op die kleinhandelapteek sektor. Verder het die aanwysing van voorkeurdiensverskaffers deur mediesefondse die situasie vererger. In Suid-Afrika word die onafhanklike apteek gesien as ‘n voorbeeld van ‘n kleinsakeonderneming en die sleutel suksesfaktore in hierdie besighede kom dan ook sterk ooreen. Hierdie studie, ‘n gevallestudie, fokus dan op die sleutel suksesfaktore en strategiese banaderings wat kleinhandelapteke volg om mededingend te bly in hierdie hoogs kompeterende mark. Die studie is beperk tot die onafhanklike apteek in die Boland-area en inligting was verkry deur middel van ‘n vraelys. Die data is kwantitatief ontleed en verskeie afleidings aangaande die onafhanklike apteeksektor word gemaak. Die resultate toon dat daar geen eenvormige besigheidsmodel tussen die apteke in ons steekproef bestaan nie en dat die onafhanklike apteke in ‘n groot mate nie strategieë en taktiese benaderings het om met korporatiewe mededingers soos Clicks en Dischem te kan meeding nie.

Ao apresentar criticamente ao público de língua portuguesa a obra da escritora irlandesa contemporânea Eavan Boland, por meio de uma seleção poética traduzida, que privilegia a visualidade e a ekphrase, este trabalho tece uma leitura intermediática (artes visuais e literárias) e verifica os efeitos de sentido da intermedialidade na construção do lirismo poético. Pressupondose a inevitável incomunicabilidade da linguagem, esta tese examina a intermedialidade, presente no processo de escrita entre as fronteiras do nacional e do cosmopolita e, sobretudo, do privado ao público e deste àquele, enquanto um recurso artístico, característico da pluralidade identitária da poesia, capaz de alcançar graus de comunicabilidade mais amplos, ou seja, menos deficitários. Por fim, a seleção de poemas aqui recolhidos traça o percurso íntimo da produção artística de Eavan Boland, momento em que os graus de articulação lingüística (seja por meio visual, verbal ou intermediático) assistem a uma suspensão de sua incomunicabilidade, e conseguem atingir esferas mais densas de sucesso comunicativo, fazendo vir à tona a natureza lírica da escrita: os movimentos concomitantes entre as esferas pública e privada referem-se à busca da interioridade, da subjetividade do eu-lírico, o auto-retrato da poetisa. Portanto, a partir do exercício interpretativo das traduções poéticas, bem como do estudo da intermedialidade, lê-se aqui a ekphrase como recurso poético na obra de Eavan Boland, capaz de metonimizar o transitar da voz poética na tradição irlandesa a partir de onde a poetisa fala, a nação irlandesa e a ruptura com essa tradição, a busca ao encontro do feminino, da voz da mulher e, acima de tudo, da voz poética enunciadora do fluxo comunicativo.
While presenting the work of the Irish, contemporary writer Eavan Boland to the public of Portuguese readers, by means of a poetic selection that privileges visuality and ekphrasis, this thesis establishes an intermediatic reading (visual and literary arts) and verifies intermediality´s effects of meaning in the construction of poetic lyricism. While presupposing language´s inevitable incommunicability, this thesis bears witness to the intermediality present in the process of writing in the frontiers of the national and the cosmopolitan and, above all, of the private and public and vice-versa, as an artistic tool, characteristic of poetry´s plural identity, which is capable of reaching broader, less deficient levels of communicability. Ultimately, the selection of poems here presented heeds to the intimate trajectory of Eavan Boland´s artistic production, which reveals levels of linguistic articulation (being them visual, verbal or intermediatic) that suspend its incommunicability and, then, are able to reach deeper spheres of communicative success, as it brings up the lyric nature of writing. The movements that go from the public to the private spheres of subjectivity refer to the search for interiority, for the self, the self-portrait in poetry. Therefore, from the interpretative exercise of the poetic translations, as well as from the study of intermediality, ekphrasis is here read as a poetic tool in the work of Eavan Boland, metonimic of the poetic voice´s transit within the Irish tradition, from where the poet speaks, the Irish nation and the rupture with such tradition, in search of the encounter with the Female, the woman´s voice and, above all, the poetic voice as enunciator of the communicative flow.

The developed countries of the world utilise 80% of the agricultural chemicals that are used in the agricultural sector. A total of 99% of all agricultural chemical poisoning occurs in developing countries. South Africa is classified as a developing country. During the five-year period from 1996 - 2000, 36.2% (50 cases) of the average number of cases of agricultural chemical poisoning that were reported in South Africa were in the Western Cape. Three out of four (75%) deaths as a result of agricultural chemicals during the same period were in the Western Cape. The agricultural activities that are undertaken in the Western Cape are labour intensive and various agricultural chemicals are applied continuously to meet the quality requirements of the export market. The purposes of this study were: i) to determine which factors contributed to the reported cases of agricultural chemical poisoning in the Winelands, Overberg and Breede River District Councils during the five-year period from 1January 1996 until31 December 2000, ii) to determine what procedure was followed to report these cases of poisoning, iii) to determine whether a biological monitoring programme was in place at the time of the reported poisonings, and iv) to group and to analyse the recommendations that were made during the investigation. The research methodology included a literature study to establish a theoretical framework. A descriptive retrospective quantitative research design was applied.

In an ever-changing business environment, management, and especially strategic management, becomes increasingly crucial. This empirical study attempts to conduct a literature study of strategic management in order to develop a strategic planning model. A simplified model is proposed as a framework on which a practical application can be made. Boland PKS, a division of the Board of Executors, has been elected as the organisation to whose strategic management the model will be applied. Boland PKS will be applied to the model in an effort to accept or reject the following statement of the problem: The author is of the opinion that strategic planning is not being applied in Boland PKS.

Architecture today does not respond to memory, the essence of character. As a result, a disengagement exists between people and place. In a world of constant movement a sense of place is not only uncommon but in some instances unknown; we are continuously in a state of motion. We commonly forget why we are here, who settled the land we now inhabit. We forget that life is more than technology bombarding us at every instant; it is more than work and more than financial success. We forget that life can be more. Architecture is also in this state of constant motion, financial success is placed ahead of experience, and as a result places become indifferent, unmemorable, and apathetic. Memory must not be put to the wayside; it is the bond that connects us to our culture. It enables our will to dream. Architecture can be the means of remembering. By cueing memory through emotion and sensory detail, one is able to pause and recall past events. The dilapidation of one’s environment can also cue memory. The act of showing the passage of time makes the past come alive. By responding to these aspects architecture becomes an indication of memory. As a result we will be connected to the land on which we live and have a reason to call that place home. We will have a heightened sense of place. Alienation and placelessness will be no more. The inevitable result of engaging memory in architecture will produce memorable spaces that inspire us, leaving us with a sense of belonging. The intention of this thesis is to illustrate that architecture is capable of unlocking memory, both collective and personal, through materials, form, and experience. This will evoke personal insights and ultimately provide memorable architecture that enhances a sense of place. As a result, we will be brought back to the days of childhood, to imagination, to a life full of meaningful events that imprint memories on the soul.

Abstract:
From a confit tomato and potato tumbleweed with buchu to a cured snoek terrine rolled in wilde kruie and Cape bobotie puff pastry with blatjang, chefs that mix indigenous plants and local cuisine with European inspiration and training have proved popular in Franschhoek’s restaurants. In this boland town, the particular constructions of heritage through food, not only showcases regional flavours, but gestures towards the search for an elusive place-based ‘South African’ cuisine that is seen to be rooted in the land. Harkening back to old culinary practices and drawing from their own heritages, Franschhoek’s chefs are foraging, butchering, gathering, growing, fermenting, pickling and cooking over open fires with renewed vigour as they attempt to ground their cuisine, and indeed, themselves, in the soil around them. This thesis considers how, through the culinary repertoire of chefs in Franschhoek, food is constructed as heritage. Within this I look at what heritages are considered desirable, how food’s sensory and symbolic properties are used to their full potential, and who is behind these constructions of culinary heritage. Following on from this, I explore postcolonial and post-apartheid anxieties of place and belonging, as well as desired and emergent identities that are expressed through this culinary heritage.

Abstract:
This paper examines ‘Enquiry Based Learning’ (EBL) as an engagement strategy for assessment at ‘taught masters’ level 9. The master students in question are adult learners in full time employment and the empirical data was gathered from these students. First, an outline of the key features of EBL is presented and, from there, an investigation of how it is viewed when applied to a specific problem statement by the masters students. EBL creates a memorable atmosphere in the classroom and encourages deep learning (Ramsden, 1992). EBL also encourages active learning, which is more enjoyable for the students (Eison, 2010), especially adults – offering more control (Whowell, 2006). Learning should not be passive or a spectator sport; students learn most effectively by active engagement (Karmas, 2006), with an interesting project, hence, the use of EBL. It is vital that we move beyond a conceptualisation of education as the simple acquisition of knowledge to one which equally emphasises, nurtures and assesses innovation and expertise in the utilisation and application of knowledge, (Boland, 2010). The findings of this research are relevant and important as they inform practice and feed into future programme reviews when considering the inclusion of EBL for assessment.

Abstract:
In general, prediction behavior of bolted joints is very complex due to the uncertainty nature parameters involved in the design. Particularly, bolted Joints under shear load; the coefficient of friction plays a big role in prediction of joint movement. The analytical method of the Extreme Value method is utilized by applying a well-known worst case scenario like VDI 2230 and is sufficient for most of general purpose bolted joint analysis. However, there are cases of bolted joints where this method could leads to a false prediction of bolted joint failures. This paper applies stochastic method in the design of bolted joint modeling. As an example of this method case study of a critical bolted joint to safety presented, the model simulation assumed probabilistic functions for sensitive variables with significant variance like coefficient of friction, preload scatter, and embedment. The simulation presented the prediction of the preload required to sustaining the joint members of no relative movement with a level of 99.97% confidence. Comparisons of extreme value method to stochastic highlighted the cases of benefit to use both methods.
