Abstract:

Zusammenfassung Gegenstand des vorliegenden Aufsatzes ist das sprachenstatistische und nationalitätenpolitische Werk des preußischen Statistikers Richard Böckh (1824–1907), insbesondere der Aufsatz “Über die statistische Bedeutung der Volksprache” (1866), in dem Böckh die Ansicht vertritt, allein die Sprache definiere die Nationalität, und das Buch Der Deutschen Volkszahl und Sprachgebiet in den europäischen Staaten (1869), das u.a. erstmals einen Katalog von Sprachenrechten für Minderheiten enthält. Der Beitrag verfolgt die Rezeption von Böckhs Werk während des deutsch-französischen Krieges von 1870/71, als Böckhs Konzeptionen in der deutschen Öffentlichkeit als moralische Rechtfertigung der Annexion von Elsass-Lothringen verstanden wurden, sowie im Zusammenhang mit der preußischen Geschäftssprachenfrage der Jahre 1873–1876. Abschließend werden noch einige spätere Positionen und Aktivitäten Böckhs beleuchtet, nämlich sein Engagement für das Auslandsdeutschtum im Rahmen des von ihm 1881 mitbegründeten Allgemeinen Deutschen Schulvereins sowie sein Eintreten gegen den Missbrauch von Statistiken im Berliner Antisemitismusstreit um 1880. Obwohl zweifellos mutig, zeigt Letzteres doch auch, wie sehr der einst so populäre sprachbezogene Nationsbegriff zehn Jahre nach der Reichsgründung schon in die Defensive geraten war.

Abstract:

The present article discusses politically relevant aspects of the work of the Prussian statistician Richard Böckh (1824–1907), a renowned specialist on language statistics, nationality policy and general demographics in his day. Two of his publications are focused on: the article “Über die statistische Bedeutung der Volksprache” (‘On the Statistical Significance of the National Tongue’, 1866), in which Böckh expresses the view that nationality is defined exclusively by virtue of language, and the bookDer Deutschen Volkszahl und Sprachgebiet in den europäischen Staaten(‘The Number and Areal Extension of Germans in the States of Europe’, 1869), in which he proposes a catalogue of linguistic human rights. The purpose of the present article is to analyse the public reception of Böckh’s works in two contexts: the Franco-German war of 1870/71, when the German public interpreted Böckh’s ideas as justifying the annexation of Alsace-Lorraine, and the debates over the Official Language question in Prussia in 1873–1876. Finally, two characteristic aspects of Böckh’s activities in his later years are highlighted: his active support ofAuslandsdeutschtum(German minorities outside the Reich), and his protest at the misuse of statistics for anti-semitic propaganda around 1880. The latter issue in particular, though courageous, proves just how much the formerly popular language-based concept of nationality was already on the defensive ten years after the foundation of the German Reich in 1871.

Abstract:

Zusammenfassung Gegenstand und Ziel: Im Herbst 2007 fielen in Herden, in denen Zuchtböcke die Blauzungenkrankheit überstanden hatten und zum Deckeinsatz kamen, vermehrt Mutterschafe auf, die regelmäßig umbockten. Material und Methoden: Daraufhin wurden 26 Böcke, die im Mittel 9 (6–11) Wochen zuvor unterschiedlich schwer klinisch an Blauzungenkrankheit erkrankt waren, zur Zuchttauglichkeitsuntersuchung vorgestellt. Ergebnisse: Bei meist unauffälligen palpatorischen Untersuchungsbefunden war die Mehrzahl der Böcke aufgrund von spermatologischen Veränderungen nicht zuchttauglich. Um den Verlauf der Hodenregeneration weiter zu verfolgen, wurde 10 Wochen später bei 16 Böcken erneut eine spermatologische Untersuchung durchgeführt. Die Qualität der Ejakulate hatte sich deutlich verbessert und nur noch bei vier Tieren wurde eine Impotentia generandi diagnostiziert. Schlussfolgerung und klinische Relevanz: Nach klinischen Erkrankungen durch Infektion mit dem Blauzungenvirus Serotyp 8 können Böcke eine reversible Impotentia generandi entwickeln. Im Anschluss an eine überstandene Blauzungenkrankheit sollte bei Böcken vor dem Deckeinsatz zur Regeneration des spermienbildenden Gewebes eine Ruhephase von 18–19 Wochen eingehalten werden. Ferner sollte vor der kommenden Decksaison grundsätzlich eine Zuchttauglichkeitsuntersuchung erfolgen.

Abstract:

This article considers Regulation (EC) No. 261/2004 in so far as it deals with delay in the carriage by air of passengers, as interpreted by the European Court of Justice in the cases of R. (on the application of International Air Transport Association and European Low Fares Airline Association) v. Department of Transport and Sturgeon v. Condor Flugdienst GmbH and Böck v. Air France SA. It considers whether these two cases are consistent with each other and with the Montreal Convention (in respect of carriage to which the Convention and Regulation 261 both apply). It concludes that they are irreconcilable with each other and that if the IATA case is consistent with the Montreal Convention, as it purports to be, then Sturgeon is not.

Abstract:

Airlines received an unpleasant Christmas present in 2008, in the form of the Court of Justice’s preliminary ruling in Wallentin-Hermann v. Alitalia, adopting a very strict interpretation of the ‘extraordinary circumstances’ defence to claims for compensation in the event of cancellation of flights under EU Regulation 261/2004. On 19 November 2009, the Court of Justice issued an even more stunning ruling interpreting the Regulation, in the joined cases Sturgeon v. Condor and Böck and Lepuschitz v. Air France, on references from courts in Austria and Germany. After giving some clarification on the distinction between delay and cancellation, the Court held that passengers on flights whose arrival at final destination is delayed by three hours or more are entitled to compensation, even though this is not expressly provided for in the Regulation (unlike in the case of cancellation).

AbstractThe following contribution will demonstrate the differences between Löwen’s theory in his Kurzgefaste Grundsatze von der Beredsamkeit des Leibes and the satirical Fragment eines Schreibens uber den Ton in den Schriften einiger teutschen Gelehrten und Schongeister by August Friedrich Cranz. Löwen’s Kurzgefaste Grundsatze is concerned with the art of physical expression on the stage, provides also information on facets of the contemporary image of the body. These facets should be traced in Fragment eines Schreibens, which became known as Bockiade. August Friedrich Cranz, only ten years younger than Löwen, was an representative of the Berlin Enlightenment. He commented on the social and cultural developments in the last three decades of the 18th century. His satire not only mentioned the great minds of the time. He commented the feud between the Berlin publisher, bookseller and author Friedrich Nicolai and the poet, translator and editor Christoph Martin Wieland in Weimar in his satirical writing.
