Abstract:
Why do we use the term ‘corporate governance’ rather than ‘corporate direction’? Early British joint stock companies were normally managed by a single ‘governor’. The ‘court of governors’ or ‘board of directors’ emerged slowly as the ruling body for companies. By the nineteenth century, however, companies were typically run by directors while not-for-profit entities such as hospitals, schools and charitable bodies had governors. The nineteenth century saw steady refinement of the roles of company directors, often in response to corporate scandals, with a gradual change from the notion of the director as a ‘representative shareholder’ to the directors being seen collectively as ‘representatives of the shareholders’. Governors in not-for-profit entities, however, were regarded as having broader responsibilities. The term ‘governance’ itself suggests that corporate boards should be studied as ‘political’ entities rather than merely through economic lenses such as agency theory.

AbstractNHS Foundation Trust (FT) hospitals in England have complex internal governance arrangements. They may be considered to exhibit meta-regulatory characteristics to the extent that governors are able to promote deliberative values and steer internal governance processes towards wider regulatory goals. Yet, while recent studies of NHS FT hospital governance have explored FT governors and examined FT hospital boards to consider executive oversight, there is currently no detailed investigation of interactions between these two groups. Drawing on observational and interview data from four case-study sites, we trace interactions between the actors involved; explore their understandings of events; and consider the extent to which the proposed benefits of meta-regulation were realised in practice. Findings show that while governors provided both a conscience and contribution to internal and external governance arrangements, the meta-regulatory role was largely symbolic and limited to compliance and legitimation of executive actions. Thus while the meta-regulatory ‘architecture’ for governor involvement may be considered effective, the soft intelligence gleaned and operationalised may be obscured by ‘hard’ performance metrics which dominate resource-allocation processes and priority-setting. Governors were involved in practices that symbolised deliberative involvement but resulted in further opportunities for legitimising executive decisions.

Abstract:
Purpose – The purpose of this “viewpoint” is to consider developments in the governance practices in UK public organizations, showing how ideas from the governance of listed companies have translated into public bodies. Design/methodology/approach – It discusses the literature of corporate governance and public service motivation and reflects it against practice evidenced in documentation for the UK Corporate Governance Code, codes for boards of different levels of public organizations, and both formal and informal evaluations of practice. Findings – The use of independent, non-executives directors in public bodies encapsulates the tension in the private sector between the service role of directors and how they control managers. The paper gives a preliminary investigation of three public bodies, comparing how reform of their governance has affected tensions in accountability and director motivation. The changes involve greater emphasis on extrinsic goals, potentially at the cost of the intrinsic ones. Research limitations/implications – The paper suggests avenues for future research, linking notions of the tensions between the service and control functions in corporate governance with the balance between extrinsic and intrinsic motivation. Practical implications – Directors in both public and private bodies face a need to hold at bay forces that push in opposing directions to accommodate demands for greater accountability while sustaining the altruism social mindedness. Originality/value – The area of public sector boards is undergoing considerable change in the UK and this paper, although preliminary, is one of the few to examine the links to motivation.

Abstract:
The number of international schools is growing rapidly and existing data points to great diversity of their governance structure. The nature of hybrid governance, in which a board comprises both elected and appointed governors, was investigated through a case study of an international school in western Europe and triangulated with interviews with nine experts in international schooling. Hybrid governance was found to offer the advantages of both elected and appointed boards: elections foster transparency and representation of stakeholders, while appointments allow the board to be populated with particular skills. A model for governance was presented in which the hybrid structure is underpinned by recruitment and training practices that ensure governors complement the existing skillset of the board, have desirable motivations for serving, and understand their role. This model may be useful for informing international school improvement efforts, although its compatibility with the diverse landscape of international schools remains to be determined.

Abstract:
Corporate governance (CG) is a corporate governance system for large companies which includes policies and procedures for corporate social responsibility (CSR). The present study examines the relationships between CG and CSR, and analyzes the studies that separate or combine the explanation of the two concepts.CG can be interpreted as the relationship between governors and stakeholders. Angyal (2009) and Auer (2017) agree that the two phenomena coexist and are connected at several points. The goals of the two phenomena are intertwined, compliance with other important requirements (environmental, labor law) besides the primary corporate goal. CG is a system based on the sharing of power and roles between owners, management and boards (board, supervisory board). The roles of ownership, supervision, and control are separated. The division of power means that the boards keep the management under strict control and the owners can account for the boards (Tasi, 2012). According to Tasi (2012), responsible CG involves careful management; financial planning and implementation; control mechanisms for the operation of the company; company transparency and business ethicsissues; publicizing corporate information and corporate social responsibility policies and practices. Angyal (2009) sees that CG and CSR are intertwined “neither intersection, nor intersection, nor parallelism, but coexistence”. (Angel,2009: 14). It does not agree with the incompatibility of corporate governance or corporate governance and social responsibility, in practice the former two are more common. Corporate governance encompasses corporate social responsibility policies, procedures, and can be interpreted as the relationship between governors and stakeholders. The authors of the studies analyzed agree that the two phenomena coexist and are connected at several points. The goals of the two phenomena are intertwined with compliance with other important requirements (environmental, labor law) besides the primary corporate goal. JEL Classification: G30; G39, M14

BackgroundRecent high-profile reports into serious failings in the quality of hospital care in the NHS raise concerns over the ability of trust boards to discharge their duties effectively.ObjectivesOur study aimed to generate theoretically grounded empirical evidence on the associations between board governance, patient safety processes and patient-centred outcomes. The specific aims were as follows: (1) to identify the types of governance activities undertaken by hospital trust boards in the English NHS with regard to ensuring safe care in their organisation; (2) in foundation trusts, to explore the role of boards and boards of governors with regards to the oversight of patient safety in their organisation; (3) to assess the association between particular hospital trust board oversight activities and patient safety processes and clinical outcomes; (4) to identify the facilitators and barriers to developing effective hospital trust board governance of safe care; and (5) to assess the impact of external commissioning arrangements and incentives on hospital trust board oversight of patient safety.MethodsThe study comprised three distinct but interlocking strands: (1) a narrative systematic review in order to describe, interpret and synthesise key findings and debates concerning board oversight of patient safety; (2) in-depth mixed-methods case studies in four organisations to assess the impact of hospital board governance and external incentives on patient safety processes and outcomes; and (3) two national surveys exploring board management in NHS acute and specialist hospital trusts in England, and relating board characteristics to whole-organisation outcomes.ResultsA very high proportion of trust boards reported the kinds of desirable characteristics and board-related processes that research says may be associated with higher performance. Our analysis of the symbolic aspects of board activities highlights the role and differences in local processes of organising the governance of patient safety. Most boards do allocate a considerable amount of time to discussing patient safety and quality-related issues and were using a wide range of hard performance metrics and soft intelligence to monitor its organisation with regard to patient safety. Although the board of governors is generally perceived to be well-meaning, they were also considered to be being largely ineffective in helping to promote and deliver safer care for their organisations. We did not find any statistically significant relationship between board attributes (self-reported) and processes and any patient safety outcome measures. However, we did find a significant relationship between two dimensions of the Board Self-Assessment Questionnaire and two specific-and-related national staff survey organisational ‘process’ measures: (1) staff feeling safe to raise concerns about errors, near-misses and incidents and (2) staff feeling confident that their organisation would address their concerns, if raised. We also found that contracting and external financial incentives appeared to play only a relatively minor role in incentivising quality and safety improvement.ConclusionsOur research is the first large-scale mixed-methods study of hospital board activity and behaviour related to the oversight of patient safety in the English NHS and the key findings should be used to influence the design of future governance arrangements as well as the training and support of board. Our finding that board governance/competencies appear to be linked to staff feeling safe to raise concerns about patient safety issues, and also their confidence that their organisation would address their concern, is worthy of further and more sustained exploration, particularly in the context of the current focus on improving whistleblowing policies in the NHS.FundingThe National Institute for Health Research Health Services and Delivery Research programme.

Based on this analysis, it argues in favor of four specific reforms: clarification of Congressional expectations for the system; enhanced Federal Reserve Board of Governors transparency with respect to its oversight of the Reserve Banks; stripping monetary-policy votes from the President of the Federal Reserve Bank of New York and the Boards of Directors of the Reserve Banks; and the initiation of a public conversation about redesigning the Federal Reserve as a unified public entity. Abstract:

Hans Olof Alsén, born 16 august 1926, is a Swedish Social Democrat politician who served as the County Governor of Uppsala from 1986 to 1992. During the 1960s, -70s and -80s he had several political commissions including Member of Parliament and government Undersecretary. In addition he had numerous Board of Directors assignments in different business corporations as well as in non commercial associations both prior to, during and after the County Governor period.

This paper describes the organizing and cataloguing of Hans Alsén's personal archives. The documents at hand were deposited at the regional state archives (Landsarkivet) in Uppsala in 2008 and 2009 by Alsén himself. The documents almost exclusively cover the County Governor years 1986-1992. At a previous occasion Alsén deposited another set of personal documents at the archival institution Folkrörelsearkivet in Uppsala. The Alsén personal archives at Folkrörelsearkivet cover the years 1955-1989 which chronologically corresponds to his political career and activity prior to the County Governor post. The four years of chronological overlapping by the two archives is worth noting.

This paper addresses some of the principal problems and consequences concerning the mix up of governmental documents in personal archives, for example when it comes to searchability, accountability and secrecy. Furthermore the issue of archives, from one and the same person of origin, split up on several archival institutions is treated as well as some of the more practical problems encountered during the organizing process.

The Hans Alsén archives 1986-1992 was organized and catalogued by Tony Engström as part of the Master Programme in Archival Science at the University of Uppsala.

Abstract:

California established the Board of Governors (BOG) fee waiver in 1984 to maintain educational access after the implementation of the state's first ever unit-based fees for community college attendance. Although it was not designed as an incentive to stimulate higher levels of academic achievement or student success, recent accountability policy enactments have ascribed this purpose to the BOG fee waiver. An example is the Seymour-Campbell Student Success Act of 2012, which established the first-ever academic satisfactory progress requirements for BOG fee waiver recipients. The purpose of this study was to explore the relationships among students' financial aid awards, including the BOG fee waiver, and measures of success for students who were attending Rio Hondo College. Findings showed that students who had the greatest financial need—and therefore the highest financial aid awards—had lower cumulative grade point averages and completed a smaller percentage of units attempted. While the study was unable to control for students' prior academic achievement, it appears that financial aid awards were not sufficient to fully counteract the negative effects of students' need, thus calling to question some of the efficacy of adding academic performance requirements to financial aid awards such as the BOG fee waiver. The paper concludes with a discussion of findings and recommendations for policy, practice, and future research.

A concretização do presente trabalho tem por objectivo estudar se as empresas com melhor governo das sociedades são as que têm melhor desempenho. Visando uma sistematização dos principais contributos teóricos sobre a temática do governo das sociedades e a caracterização do governo das sociedades em Portugal e a nível internacional, procedeu-se a revisão bibliográfica, que também foi útil na constituição da amostra a utilizar no estudo empírico e na definição da métrica para a avaliação de desempenho. Em termos empíricos, o estudo toma como referência o trabalho de 2003, de dois reputados autores norte-americanos nesta área, Paul W. MacAvoy e Ira M. Millstein, tendo incidido sobre o universo das sociedades cotadas no mercado de cotações oficiais da Euronext Lisboa que responderam ao "4° Inquérito da Comissão do Mercado de Valores Mobiliários (CMVM)", com o objectivo de averiguar se seguiam as recomendações publicadas por este organismo sobre o Governo das Sociedades. O horizonte temporal do estudo é de 1998-2003 e recorreu-se a uma avaliação do desempenho baseada no valor. Os resultados obtidos demonstram que as sociedades mais cumpridoras das recomendações da CMVM sobre o governo das sociedades são as que apresentam um melhor desempenho, tendo-se procurado validar estes resultados através de uma regressão linear, mas sem sucesso.
This work aimed to study if the companies with better corporate governance can be associated with better corporate performance. Aiming the systematization of the most important theories concerning corporate governance and the characterization of corporate governance in Portugal and worldwide, a bibliographic review has been made, which was also useful in the creation of the sample to be studied and in the metric definition to evaluate corporate performance. In empirical terms, this study takes as reference the 2003 work of two renowned American authors in this field, Paul W. MacAvoy and Ira M. Millstein, and focus on public traded companies at Euronext Lisbon that have answered to the "4° Inquérito da Comissão do Mercado de Valores Mobiliários (CMVM)", whose purpose was to determine if recommendations issued by CMVM were being followed. The time period covered is 1998-2003 and the metrics used to evaluate corporate performance was based in the economic value added. Obtained results show that the companies that comply more with CMVM's recommendations are the ones with better performance, although it wasn't possible to validate these results through a regression analysis.

Purpose: This study investigated the priorities of twelve commnunity college constituent groups in order to determine if their priorities were consistent with function statements established by the California Ccmnunity College Board of Governors in 1983. The mission function statenents were: Associate Degrees, Certificate Programs, Conmunity Services, Continuing and Corrmunity Education, General Education, Joint Programs, Remediation and Basic Skills Education, Student Services, and Transfer Education. It was hypothesized that the twelve groups would respond differently based upon the conditions under which they were ranking the function statements, that there would be differences among the districts depending upon the size of the district, and that there would be differences among the respondents on the basis of community college attendance.

Visando uma sistematização dos principais contributos teóricos sobre a temática do governo das sociedades e a caracterização do governo das sociedades em Portugal, procedeu-se à revisão bibliográfica, e à caracterização do governo das sociedades anónimas Portuguesas. As variáveis relativas ao conselho de administração analisadas foram: o tamanho do conselho de administração, a independência, a composição e mandato do conselho, a caracterização dos membros do conselho tendo em conta a idade, habilitações literárias e sexo.
The present study aims to characterize the corporate governance model of Portuguese Companies listed on Euronext in 2009. This topic is of great relevance given that the governance of enterprises are important for the economies of the countries. Hence, it deserves proper attention and the risks of not considering it should be taken into consideration properly. Aiming a summary of the main theoretic al contributions on the subject of corporate governance and its characterization in Portugal, we provide a literature review and a characterization of the corporate governance of Portuguese listed companies. We analyzed variables concerning the board of directors: the size of the board, the independence of the structure, composition and mandate of the board, and characterization the board analyzing age, qualifications and gender.

In South Africa today those who lead sport are facing increasing scrutiny which has inevitably resulted in questioning governance practices. The transition of many sports from
predominantly volunteer administered organizations anchored in an amateur ethos, to professionally managed entities catering to a more sophisticated market place has created
unique challenges for the governance of sport sponsorship. This evolution gives rise to possible conceptual linkage between sport sponsorship and corporate governance or none
thereof. This study focuses on the ABSA-Premier Soccer League (PSL) sponsorship transaction as a case study to explore this linkage. The research is aimed at finding the nexus
between sport sponsorship and corporate governance principles, namely accountability and transparency in the conclusion of this transaction.


The research consists of four phases
literature review which provides a detailed analysis of all primary and secondary material available on this topic. The second phase is a qualitative
case study research methodology which comprises of in-depth interviews with targeted stakeholders. The third part presents the research findings and discussion section, and lastly
the way forward through reflections and recommendations including highlighting potential future research areas.


This work is timely when there has been generally a heightened evolution in sport sponsorship and its focus was to explore the nexus and compliance to the founding principles
of the organizations (laws of governance). Factually, good corporate governance aims at ensuring a higher degree of transparency in an organization by encouraging full disclosure of
transactions in the company accounts as well as accountability. Academics have been exploring the notion of sports sponsorship and corporate governance with much of the
debates grounded on understanding its commercial value.


The focus for this study is on the conceptual nexus or non-thereof, between sponsorship and corporate governance. Information was collected through in-depth and experience interviews,
documented reviews and analysis (such as the review and analysis of the constitution of the South Africa football Association, PSL, financial/banking sector policy regulations, South
African Sports Act, corporate governance reports, annual reports, scholarly journals, academic books, conference papers and Parliamentary Monitoring Group documents etc. to
mention but a few.

Este trabalho de investigação analisa a relação existente entre a composição do board (mecanismo de Corporate Governance) e o respetivo impacto na performance das organizações no sector do turismo em Portugal no ano de 2011. Para tal, utiliza-se uma amostra de 431 empresas do sector. O objetivo do estudo centra-se na análise do board e na sua influência na performance das organizações através de dados institucionais fornecidos pela D&B Informa Portugal. Os resultados de maior relevância dependeram da mensuração usada (ROA ou ROE). Através do ROE nenhuma das variáveis de Corporate Governance mostra-se significativa para explicar a performance, refutando algumas teorias existentes. Pelo ROA verificam-se resultados diferentes, o ROA mostra um impacto positivo da dimensão da empresa e do número de mulheres no board na performance, sendo a variável dimensão da empresa significativa a 5% e o número de mulheres no board muito perto do nível de significância a 10%.
This study examines the relationship between the composition of the Board (a Corporate Governance mechanism) and the performance related to the sector of tourism in Portugal for the year 2011. I used a sample of 431 companies from tourism sector. The goal of the study is to analyze the board of the organizations and their impact on the performance using some institutional data provided by D&B Informa Portugal. The most relevant results depends on the measurement used (ROA or ROE). For the measurement of ROE none of the variables were significant to the explication of the performance so it is statistically not relevant to the model and refutes the existing literature. In ROA measurement there are different results. One variable the size of the companies is significant in the level of 5% and the variable woman on the board is very near to the significance level of 10%. The result showed a positive impact between the size of the companies and the performance of the companies and also presents the same impact to the variable number of women on the board.

O governo das sociedades e a sua importância para o bom funcionamento e a integridade dos mercados de capitais têm vindo a ser assumidos como uma temática central no mundo dos negócios. A comissão de auditoria constitui uma peça central no governo das sociedades e as suas atribuições e responsabilidades têm-se vindo a ampliar e a aprofundar sucessivamente. Neste estudo, tendo como principal suporte a teoria da agência, investigam-se factores associados à constituição voluntária de comissões de auditoria em Portugal, país inserido num contexto europeu continental - onde essa constituição não é obrigatória. Para as empresas que voluntariamente constituíram comissões de auditoria, analisam-se também a respectiva composição e práticas de actuação. O estudo incidiu sobre as sociedades cotadas na Euronext Lisbon. Utilizando um modelo de regressão logística, verifica-se que a presença da comissão de auditoria está positivamente associada à proporção de administradores independentes no conselho de administração e à dimensão da sociedade, mas não a factores relacionados com custos de agência. No que diz respeito à composição e práticas de trabalho, pode-se concluir que as empresas cotadas portuguesas, de um modo geral, cumprem as normas e recomendações nacionais respeitantes às comissões de auditoria, embora estejam aquém do prescrito em enquadramentos institucionais mais rigorosos nesta matéria, como é o caso dos EUA e RU, ou até nas melhores práticas recomendadas no contexto europeu continental.
Corporate governance and its importance to the integrity of the capital markets has become an essential issue to the business community. Central to corporate governance is the audit committee, and its responsibilities and duties are becoming wider and deeper. Using mainly an agency framework, this dissertation investigates some factors associated with voluntary audit committee formation in Portugal, a country belonging to a continental Europe environment, where that formation is voluntary. For those companies that voluntarily installed an audit committee, it also examines its composition and working practices. The study uses data from Euronext Lisbon listed companies. Making use of a logistic regression model, the study finds that voluntary audit committee formation is positively correlated with the proportion of independent directors on the board of directors and with the size of the company, but it does not find it associated with agency costs. As to its composition and working practices, it finds that Portuguese companies comply with the Portuguese rules regarding audit committees, but not with more demanding and tougher requirements as those from US or UK, or even the best practices recommended in a continental Europe environment.

It has been highlighted by the business world that audit quality and corporate governance can play critical roles in various corporate scandals. Understanding how the relationships between effective corporate governance and audit quality is important, requires investigating their components more precisely. So, the present study aims to carry out a comprehensive review and comparative summarizing the results of the published works on the effectiveness of corporate governance mechanisms, as well as audit committee’s influencing factors, in order to investigate their probable effects on audit quality. In this regard, despite audit quality influencing factors and auditor specifications were found to be able to affect the audit quality significantly, audit firm size has been identified as the most important factor affecting audit quality. Moreover, both board of directors and audit committees specifications were identified as critical influencing factors in the effectiveness of corporate governance which interacts with audit quality. As a consequence, changes in effectiveness of the corporate governance should be considered as an important factor, when assessing the audit quality.
Tem sido sublinhado pelo mundo dos negócios que a qualidade da auditoria e o governo das sociedades podem desempenhar funções críticas em vários escândalos empresariais. Compreender a importância das relações entre a eficácia do governo das sociedades e a qualidade da auditoria requer investigar os respetivos componentes. O presente estudo visa, portanto, apresentar uma revisão abrangente e sintetizar de forma comparativa os resultados dos estudos publicados sobre a eficácia dos mecanismos do governo das sociedades, assim como dos fatores que influenciam a comissão de auditoria, com vista a determinar os prováveis efeitos na qualidade da auditoria. Embora diversos fatores que influenciam a qualidade da auditoria e as especificações do auditor tivessem sido identificados como suscetíveis de afetar significativamente a qualidade da auditoria, a dimensão da empresa de auditoria foi identificada como o fator de maior influência. Acresce que tanto o conselho de administração como as especificações da comissão de auditoria foram identificados como fatores críticos influenciadores da eficácia do governo das sociedades, a qual, por seu turno, interage com a qualidade de auditoria. De tudo isto decorre que as alterações na eficácia do governo das sociedades devem ser consideradas como fator importante na qualidade da auditoria.

This chapter draws on primary data that details how school governors in England are being trained and responsibilised in new ways to enhance the integrity of market-based developments in public education. I consider the extent to which corporate strategies are evident in the kinds of everyday work engaged with and produced by agents of school governance, namely school governors. Moreover, I explore whether ‘corporate elitism’ – the capacity and willingness of school governing bodies to reconstitute themselves in the image of corporate boards – is implicit to decisions concerning who and why certain people get to enter governance roles, and consider the implications of these reforms for any robust, democratic system of school governance.

This chapter follows Isaac Mayer Wise into the presidency of Hebrew Union College. He left the second Council of the Union (1875) with his rapturous enthusiasm undimmed. He was showing congregational presidents and boards of trustees how by helping the union they would be helping themselves, as the union would ‘exert its influence to get every Israelite to observe the Sabbath and to be a member of the congregation’, and would supply the congregations with rabbis to whose oratory it would be a feast of reason to listen. After the board of governors resolved formally to appoint Wise president of Hebrew Union College, he performed his services gratuitously, and his only assistant was Solomon Eppinger, who had been on the staff of the Talmud Yelodim Institute. Though there was no ready-made grandeur surrounding the presidency, Wise responded in a tone which suggests that the official appointment affected him deeply.

As with Chapters 3 and 4, the case study on Malaysia begins with a thorough description of the country’s death penalty laws and practice, and Malaysia’s publicly known clemency practice over the period under analysis (1991–2016). Thereafter, for both the Malaysian (Chapter 5) and Indonesian (Chapter 6) cases, the potential explanatory factors for clemency incidence are more complex than for Thailand and Singapore, given these two jurisdictions’ more moderate rates of capital clemency and fluctuating political policies on capital punishment over time. Available statistics suggest that Malaysia’s clemency rate is moderately high, at between 55 and 63 per cent of finalized capital cases. Malaysia is a federal state where pardons are granted by the hereditary rulers or appointed state governors in state-based cases, or by the Malaysian king (Yang di-Pertuan Agong) in federal and security cases, all on the advice of specially constituted Pardons Boards. Chapter 5 presents the following two explanations for Malaysia’s restrictions on death penalty clemency: prosecutorial/judicial discretion and detention without trial in capital cases, and the Federal Attorney-General’s constitutional role on the State and Federal Pardons Boards. As to why Malaysia’s clemency rate has not then fallen to the miniscule level seen in neighbouring Singapore (with both nations closely comparable, as they were once part of the same Federation of Malaya), Chapter 5 points to the relevant paperwork placed before each Pardons Board, the merciful role played by the Malay monarchy, and the impact of excessively long stays on death row before clemency decisions are reached.

The welcoming environment that New York had provided for Progressive penology turned hostile in the 1920s, when fear of a crime wave led to an all-out attack on discretionary justice. Scathing accounts of the governor’s pardon power and the Parole Board’s release of prisoners serving indeterminate sentences appeared in the press, and in 1926 draconian mandatory sentencing statutes, known as the Baumes laws, clipped the board’s capacity to parole repeat offenders, yet nothing short of constitutional change could remove the chief executive’s powers. This chapter traces how a spate of prison riots in 1929 helped prompt a compromise between the Republican legislature and Democratic governor Franklin D. Roosevelt. This resulted in a revamped board geared to operate with business efficiency. Thus, a measure of sentencing discretion was restored, while the governor retained sole authority to reprieve and commute death sentences.

This chapter explains how executive clemency—the state governor’s power to reduce a death penalty to a lesser sentence—helped make capital punishment function in North Carolina. With mandatory death sentences for four serious crimes (murder, rape, burglary, and arson), judges had no choice but to pronounce a death penalty upon conviction. This left it up to the governor to decide whether or not the convicted person would be executed. Although this power was reserved for the governor, it was soon transferred to a parole board, which reviewed each death sentence and invited community comment. This process most benefitted teenagers and women. Perversely, more African Americans received commutations than whites because of the high rate of error in their trials.

Abstract:
In response to the Paris Agreement and the Sustainable Development Goals (SDGs), the IDB Group Board of Governors endorsed the target of increasing climate-related financing in Latin America and the Caribbean (LAC) from 15% in 2015 to 30% of the IDB Groups combined total approvals by 2020. Currently, the IDB Group is on track to meet this commitment, as in 2018, it financed nearly US$5 billion in climate-change-related activities benefiting LAC, which accounted for 27% of total IDB Groups annual approvals. In 2019, the overall volume and proportion of climate finance in new IDBG approvals have increased to 29%. As the IDB continues to strive towards this goal by using its funds to ramp-up climate action, it also acknowledges that tackling climate change is an objective shared with the rest of the international community. For the past ten years, strategic partnerships have been forged with external sources of finance that are also looking to invest in low-carbon and climate-resilient development. Doing this has contributed to the Banks objective of mobilizing additional resources for climate action while also strengthening its position as a leading partner to accelerate climate innovation in many fields. From climate-smart technologies and resilient infrastructure to institutional reform and financial mechanisms, IDB's use of external sources of finance is helping countries in LAC advance toward meeting their international climate change commitments. This report collects a series of insights and lessons learned by the IDB in the preparation and implementation of projects with climate finance from four external sources: the Climate Investment Funds (CIF), the Forest Carbon Partnership Facility (FCPF), the Green Climate Fund (GCF) and the Global Environment Facility (GEF). It includes a systematic revision of their design and their progress on delivery, an assessment of broader impacts (scale-up, replication, and contributions to transformational change/paradigm shift), and a set of recommendations to optimize the access and use of these funds in future rounds of climate investment. The insights and lessons learned collected in this publication can inform the design of short and medium-term actions that support “green recovery” through the mobilization of investments that promote decarbonization.
