Abstract:
Under President Lula (2003–2010), Brazil’s foreign aid program expanded significantly into the area of South-South cooperation. This included the “soft power” fields of social protection, food security, agricultural research, and humanitarian assistance, among others, with a particular emphasis on supporting Sub-Saharan Africa, notably but not exclusively Portuguese-speaking countries. Much of this aid was provided with the support of technical assistance from UN agencies such as UNDP and FAO and bilateral aid bodies, via trilateral agreements, under the coordination of Brazil’s International Cooperation Agency (ABC). South-South collaboration is considered to be morally superior to conventional aid arrangements, being supposedly demand-driven and “non-exploitative,” thus empowering recipients in the process. Brazilian policymakers sought to transfer national anti-poverty initiatives to Africa. This was based initially on the Bolsa Família conditional cash transfer (CCT) program, but other nutritional food security initiatives followed, such as boosting small farmer production as well as supporting agribusiness.

Abstract:
This chapter describes the arbitration process under international investment treaties, in particular under the Washington Convention of 1965. This Convention aimed primarily to create a new arbitral forum for the resolution of disputes between investors and states by means of the inclusion of arbitration clauses in state contracts. The travaux préparatoires of the Convention also made clear that the consent of the state to arbitration could be established through the provisions of an investment law, which prompted many states to develop a programme of bilateral treaties for the promotion and protection of investments, so-called bilateral investment treaties (BITs), which set out protections in favour of foreign investment. The dramatic growth of BITs since the mid-1980s has led to the adoption of similar provisions in the ‘investment chapters’, or collateral agreements, to multilateral economic cooperation treaties, such as the Association of Southeast Asian Nations (ASEAN) Comprehensive Investment Agreement.

This chapter comments on Article 86 of the Rome Statute of the International Criminal Court. Article 86 states the general obligation to ‘cooperate fully’ with the Court. This obligation to cooperate applies only to States Parties. If obligations to cooperate with the Court exist for non-party States, their source must be found elsewhere, for example in bilateral agreements or in Security Council resolutions. Indeed, Security Council resolutions have both confirmed that non-party States do not have any obligations under the Rome Statute and at the same time they have imposed obligations of cooperation on certain non-party States.

Abstract:
Treaties are agreements between sovereign states, and occasionally between states and international organizations. Treaties can include conventions, covenants, charters, and statutes, all of which are legally binding under international law. There are two main types of treaties: bilateral and multilateral. Bilateral agreements are concluded by a limited number of states (usually two), and typically address a narrow set of issues that are unique to specific parties and particular circumstances. Multilateral treaties, on the other hand, establish generalized principles of conduct that apply to a wide range of states without regard to the future particularistic interests of the parties or the strategic exigencies that may exist in a particular occurrence. Treaties can serve a wide variety of functions: ending wars and establishing conditions for peace; creating new international organizations or alliances; generating new rules of coexistence and cooperation; regulating a particular type of behavior; distributing resources; and initiating new rights and obligations for future relations. No single organization or agency has the authority to enforce treaty commitment. Rather, treaties can be enforced in at least two ways. First, states can use diplomatic, economic, and/or military coercion. Second, some treaties establish their own enforcement mechanisms; for example Chapter VII of the United Nations Charter grants enforcement authority to the Security Council.

The legal regime of any given ocean or sea is a composite product, which includes the unilateral acts of States by which they establish maritime zones and regulate the exercise of their power therein; the bilateral agreements for the delimitation of maritime boundaries; and the multilateral legal instruments, which provide uniform substantial regulation and institutionalise cooperation. The chapter examines legal regime of the Mediterranean based on this division, looking first at the jurisdictional framework, then at the delimitation of maritime boundaries, and finally at the multilateral instruments adopted by coastal States in order to regulate a number of activities.

Abstract:
The expansion and deepening of the UK–French defence partnership that came with the signing of the Lancaster House Treaties of November 2010 is of particular importance for European armed forces. The UK–French agreement concerns Europe’s two main defence players and covers both nuclear and conventional matters. This chapter first analyses the incentives that led to the cooperation treaties being signed in November 2010. It argues that it has four drivers: converging defence policies, economic necessity, the waning of traditional bilateral partnerships, and frustration with regional defence cooperation. Then the chapter assesses the progress made in the different areas of defence: training and interoperability, procurement and industrial integration, cooperation in international crises and participation in military interventions, and nuclear cooperation. The chapter concludes with a study of the challenges faced by the two countries, while also underlining the positive effects of institutionalization on their security partnership.
