Abstract:
Abstract: Differences between contract laws of Member States are often said to impose costs on and deter cross-border trade; and, that in order to increase cross-border trade, these contract laws ought to be harmonized. This article considers whether there is a need for harmonization; and if so, what form it ought to take. The discipline of psychology is relied on to answer two underlying questions: how do actors think about these differences when they decide to contract? How does the form of harmonization influence such decisions? Insights from cognitive and social psychology are identified and applied to find out how actors think and what motivates them to make the decisions they do. These insights lead us to question whether actors think about differences between contract laws. This is a point which, in turn, questions the need for harmonization. Furthermore, if a great many actors prefer the status quo, this strongly suggests that harmonization by way of optional rules may not achieve the desired result. Résumé: Il est souvent dit que les différences entre le droit des contrats des États Membres imposent des coûts supplémentaires et découragent le commerce transfrontalier ; que, afin d’augmenter le commerce transfrontalier, ces droits devraient être harmonisés. Cet article s’interroge sur le besoin d’harmonisation et, dans l’affirmative, sur la forme qu’elle devrait prendre. Une approche comportementale est adoptée pour répondre à deux questions fondamentales : comment est-ce que les acteurs envisagent ces différences quand ils décident de s’engager par voie de contrat ? Comment le mode d’harmonisation influe sur de telles décisions ? Les perspectives de disciplines telles que la psychologie cognitive et sociale sont identifiées et appliquées pour découvrir comment les acteurs pensent et ce qui motive les décisions qu’ils prennent. Ces perspectives de la psychologie nous mènent à douter que les acteurs pensent aux différences entre les droits nationaux des contrats. Une telle conclusion remet, à son tour, en cause la nécessité d’une harmonisation. En outre, si un grand nombre d’acteurs préfèrent le statu quo, cela suggère fortement que l’harmonisation, par le biais de règles facultatives, peut ne pas aboutir au résultat visé.

Abstract:
Résumé L’existence d’un modèle homogène de réforme de l’administration publique basé sur la « nouvelle gestion publique » est de plus en plus remise en question dans la littérature. Les recherches disponibles montrent également que les restructurations dans le secteur public engendrent généralement une détérioration des conditions de travail. Notre étude contribue de manière originale à la littérature en démontrant la variété des pratiques de restructuration au sein de l’administration publique de même que la variété de leurs conséquences pour les employés dans le cadre d’un même projet de réforme. Ces constats se basent sur notre étude de la restructuration de la fonction publique québécoise enclenchée par la mise en oeuvre du Plan de modernisation présenté en 2004 par le gouvernement libéral. Nous avons ainsi ouvert la « boîte noire » du secteur public en examinant les configurations variées de cette restructuration et la diversité de ses conséquences pour les employés dans les unités administratives par le biais d’une enquête par questionnaire menée auprès de délégués syndicaux. Nos résultats montrent tout d’abord que les unités ont fait un usage différent des pratiques de remplacement des départs et d’externalisation alors que nous avons recensé six configurations différentes qui vont d’un quasi statu quo (25 % des unités) à une restructuration en profondeur (23,8 % des unités). La nature des fonctions assumées par les unités, de même que les pressions, les traditions politiques et l’héritage institutionnel sont les explications avancées à cette diversité des configurations. Notre recherche montre aussi que ces diverses configurations conduisent à des résultats différenciés pour les employés du secteur public. Globalement, les conséquences associées à la modernisation sont une intensification du travail, une détérioration du climat social dans les unités, des attentes de performance mitigées ainsi qu’un support au changement – sous la forme de l’accès à la formation – peu perceptible.

Resumen: Este estudio analiza la jurisprudencia actual (internacional, comparada y española) en interpretación de las normas internacionales y de fuente interna que regulan la eficacia del convenio arbitral. La irrupción en el tráfico de nuevos tipos de convenios arbitrales (cláusulas híbridas y cláusulas escalación), así como la falta de una regulación ad hoc para determinados supuestos (extensión de los efectos del convenio a terceros no firmantes) exigen un estudio comparado de las soluciones dadas a estas cuestiones en las jurisdicciones con mayor tradición arbitral. Por último, se analizan las posibles consecuencias que la reciente jurisprudencia del TS sobre el principio Kompetenz-kompetenz (“tesis débil”) puede tener sobre el efecto positivo del convenio arbitral; así como la posible extensión al ámbito del convenio arbitral de la jurisprudencia del TS sobre responsabilidad por incumplimiento de una cláusula de sumisión a tribunales españoles.Palabras clave: Convenio arbitral. The emergence of new types of arbitration agreements (hybrid clause and escalation clause), as well as the lack of an ad hoc regulation for certain assumptions (extension of the effects of the agreement to non-signatory third parties) require a comparative study of the Solutions given to these issues in jurisdictions with a greater tradition of arbitration. Finally, the possible consequences that the recent Supreme Court case law on the Kompetenz-kompetenz principle (“soft Thesis”) can have on the positive effect of the arbitration agreement are analyzed, as well as the possible extension to the scope of the arbitration agreement of the Supreme Court case law on liability for breach of a clause of submission to Spanish courts.Keywords: Arbitration agreement. Cette thèse de doctorat explore la relation entre la croyance en la méritocratie et la demande de redistribution, en mettant l’accent sur la Chine. Elle remet en question l’hypothèse courante de la littérature selon laquelle les résultats liés à l’effort sont considérés comme justes et ne nécessitent pas de redistribution, tandis que ceux liés aux circonstances et chances sont perçus comme injustes et justifient la redistribution.Dans le premier chapitre, à partir de données d’enquêtes internationales, je constate que de telles préférences se trouvent principalement dans les pays Occidentaux, Éduqués, Industrialisés, Riches et Démocratiques (WEIRD), en particulier les nations anglo-saxonnes et protestantes européennes. Une corrélation positive entre la croyance en le rôle de l’effort dans la réussite et la demande de redistribution est répandue dans les pays en dehors du monde développé occidental, où plus on croit que l’effort paye, plus on désire la redistribution. Le deuxième chapitre, co-écrit avec Yuqian Nora Chen et Zhexun Mo, présente une expérience d’enquête auprès d’un échantillon représentatif de chinois, où les répondants réduisent significativement leur demande de redistribution lorsqu’ils voient des exemples de personnes devenant riches par des moyens non forcément méritocratiques mais représentatifs de la période de transition du marché. Une enquête subsidiaire confirme que les répondants ne considèrent pas ces exemples comme des signes de capacité personnelle extraordinaire ou d’inefficacité gouvernementale. Nous concluons que ces exemples représentant les chanceux de la transition bénéficient d’une grande légitimité parmi les chinois pour deux raisons potentielles : l’équité relative par rapport à l’inégalité politique avant la réforme et l’intérêt personnel pour l’ensemble de la population à justifier le gain dans le processus de transition.Le troisième chapitre, co-écrit avec Margot Belguise et Zhexun Mo, discute l’une des raisons potentielles d’une telle préférence dans le cas de la Chine : une forte conformité au statu quo. Nous revisitons un résultat expérimental récent par Almås et al. (2021) où le peuple chinois semble ne pas faire la différence entre les inégalités basées sur le mérite et la chance. Nous proposons que ce phénomène pourrait être dû à une plus grande adhésion du public chinois au statu quo, ce qui conduit à une préférence apparemment faible pour la redistribution à la fois lorsque l’inégalité est due à l’effort et à la chance. Pour tester cette hypothèse, nous avons mené une expérience de redistribution incitative avec des étudiants d’universités d’élite en Chine et en France, en faisant varier la répartition initiale des gains entre deux travailleurs réels à redistribuer. Nous montrons que les répondants chinois choisissent de manière cohérente et significative plus de non-redistribution (en jouant le statu quo) dans les deux scénarios de statu quo très inégal et relativement égal que nos répondants français ; et que les répondants chinois qui s’éloignent du statu quo font la différence entre les inégalités basées sur le mérite et la chance. Notamment, nos résultats montrent que la conformité des individus chinois au statu quo est particulièrement prononcée chez ceux issus de familles de classe ouvrière et agricole, tandis qu’elle est remarquablement absente chez les individus dont les familles travaillent le secteur privé
This PhD dissertation studies the relationship between belief in meritocracy and demand for redistribution with survey and experimental data and with a particular focus on China. Specifically, the dissertation revisits a commonly used assumption in the literature which equates the differences in results due to effort or personal responsibility with fairness and un-redistributability, and those due to circumstances or luck with unfairness and demand for redistribution.In the first chapter I use cross-national survey data to explore whether the assumption of meritocratic preference hold across the world. I found that that such preferences these preferences are mainly, if not only, found in Western, Educated, Industrialised, Rich, and Democratic (WEIRD) countries, especially Anglo-Saxon and Protestant European natiions. A positive correlation between belief in the role of effort in success and demand for redistribution is widespread in countries outside of the western developed world, where the more one believes that effort pays off, the more he or she desires redistribution.The second chapter, co-authored with Yuqian Nora Chen and Zhexun Mo, is a survey experiment with a representative sample of China citizens which shows that the respondents significantly reduces their demand for redistribution when they see examples of people getting rich via non-meritocratic ways that are representative of the market transition period. A subsidiary survey further confirms that the respondents do not understand these examples as signs of personal ability or governmental inefficiency. We conclude that those examples representing the lucky few in the transition process enjoy a high legitimacy among the Chinese respondents for two potential reasons: relative fairness compared to pre-reform politically manufactured inequality and a self-interest motivation for the whole population to justify the gain in the transition process.The third chapter, co-authored with Margot Belguise and Zhexun Mo, discusses one of the potential reasons of such preference, at least in the case of China: a strong status quo conformity. We revisit a recent experimental result by Almås et al. (2021) where the Chinese people appear to not differentiate between merit- and luck-based inequalities. We propose that this phenomenon might be due to the Chinese public’s greater adherence towards the status quo which lead to a seemingly low preference for redistribution both when inequality is due to effort and due to luck. In order to test this hypothesis, we run an incentivized redistribution experiment with elite university students in China and France, by varying the initial split of payoffs between two real-life workers to redistribute from. We show that Chinese respondents consistently and significantly choose more non- redistribution (playing the status quo) across both highly unequal and relatively equal status quo scenarios than our French respondents; and that the Chinese respondents who move away from status quo do differentiate between merit- and luck-based inequalities. Notably, our findings show that Chinese individuals’ conformity to the status quo is particularly pronounced among those from families of working-class and farming backgrounds, while it is conspicuously absent among individuals whose families have closer ties to the private sector

Esta tesis utiliza un enfoque experimental para comprender las interacciones dentro de redes y percibir las decisiones causando inversión de preferencia (IP). El Capítulo 1 experimentalmente introduce comunicaciones no vinculantes a un modelo de producción de un bien costoso, que es no excluible entre personas vinculadas en una red. Los resultados muestran que la comunicación de dirección única no mejora coordinación tanto como la comunicación entre conjuntos máximos independientes. El Capítulo 2 analiza experimentalmente un modelo de conflictos bilaterales integrado en redes, donde los oponentes invierten para ganar recursos. Concluye sobre exceso de inversiones comparado a las predicciones de equilibrio. Por último, el Capítulo 3 mira si el efecto dotación inicial resultado de statu quo conduce IP. Esto es analizado por la interrogación de la buena voluntad de cambiar una lotería dotada para otra o pago seguro. En contrario de las predicciones, resultados demuestra que dotaciones son renunciadas con frecuencia.
This thesis uses an experimental approach in understanding group decisions and interactions in networks and perceiving individual decisions causing preference reversal. Chapter 1 experimentally introduces different communication schemes to a production model of a costly good that is non-excludable among individuals linked within a network. Results show that one-way communication is not as efficient as in earlier literature; yet communication among maximal independent sets enhances coordination. Chapter 2 experimentally analyzes a model of multiple bilateral conflicts embedded in networks where opponents invest in conflict technology to win resources. It concludes on tendency to invest in excess of equilibrium predictions. Finally, Chapter 3 looks at whether preference reversal is driven by an endowment effect explanation originating from status quo bias. This is analyzed through questioning individuals' willingness to exchange their endowed lottery for another lottery or sure money. Contrary to the predictions, results show that individuals most often disclaim their endowments.

Abstract:
This thesis consists of three independent papers. They are put in reverse chronological order according to when they were initiated. The first paper, which is a joint work with Özgür Evren, extends the standard rational choice framework with the option to postpone the act of selecting an alternative. In that paper, we propose an axiomatic model of choice over risky prospects that restricts the classical rationality axioms solely to those instances in which the decision maker does not defer. The cardinal approach we follow allows us to identify the preference relation of the decision maker over lotteries, even if the choice data is very scarce due to deferral. Moreover, we also derive the value of deferring choice from a given set of options, which turns out to be an affine utility function over choice sets. At each choice situation, the decision maker compares the utility of each available alternative with that of deferral so as to decide on opting for an alternative immediately. The second paper is a model of status quo bias with choice avoidance. It describes the choice behavior of an otherwise standard decision maker whose choices are affected by the presence of a status quo alternative. The status quo emerges as a temporary choice, which may be reversed upon arrival of new (introspective or objective) information, or upon finding new alternatives. The third paper considers the network formation problem from a matching perspective. In that paper, agents want to link with each other and each has preferences over the subsets of others. We consider various solution concepts regarding the stability of a matching between the agents, establish relations between these concepts under several preference restrictions, and provide sufficient conditions for these solutions to be nonempty.

The central aim of this research is to identify the versions of voluntary abortion present in the legislative process through the analysis of two specific bills, which propose either decriminalization or criminalization of such procedure even in the cases already provided by law: bills number 882/2015 and 478/2007, respectively. To understand the conditions that enable the criminalization of the ending of pregnancy, we will make use of Foucault’s theory concerning biopolitics and the apparatus (“dispositif”) of sexuality, since it allows us to conceive the rise of the process which politicizes maternity from the perspective of the life-imperative. To reach the aforementioned aim, we employ the theoretical-methodological approach from the discursive psychology, developed by the Centre for Studies and Research of Discursive Practices in Quotidian: rights, risks and health” (Núcleo de Estudos e Pesquisas sobre Práticas Discursivas no Cotidiano: direitos, riscos e saúde - NUPRAD), also related to a constructionist attitude. In the first place, we carried out a systematization of legislative bills with regard to abortion proposed between 2007 and 2017. Next, an analysis of the justification of the two selected bills was made, searching for the voluntary abortion versions contained in them. Three versions were then identified: abortion as murder, abortion as a public health problem and abortion as a women’s right, which, in turn, involves the right to reproductive self-determination and the right to life. These versions establish between themselves oppositions, but also combine and complement each other, depending on their use
Esta pesquisa tem como objetivo central identificar as versões de aborto voluntário presentes no processo legislativo por meio da análise de dois projetos de lei específicos que têm por foco a descriminalização ou a criminalização da prática nos casos já previstos por lei: o PL 882/2015 e o PL 478/2007, respectivamente. Para entendermos as condições que possibilitam a criminalização da interrupção da gestação, utilizaremos as teorizações de Michel Foucault acerca da biopolítica e do dispositivo da sexualidade, uma vez que nos permitem compreender a emergência do processo de politização da maternidade a partir do imperativo da vida. Para atingir o objetivo de pesquisa, empregamos a abordagem teórico-metodológica da psicologia discursiva desenvolvida no Núcleo de Estudos sobre Práticas Discursivas no Cotidiano: direitos, riscos e saúde (NUPRAD), que se inscreve no âmbito de uma postura construcionista. Em um primeiro momento, realizamos uma sistematização dos projetos de lei concernentes ao aborto apresentados no período de 2007 a 2017. Em seguida, foi feita uma análise da justificativa dos dois projetos de lei selecionados, buscando as versões de aborto voluntário neles presentes. Três versões foram identificadas: o aborto como assassinato, o aborto como problema de saúde pública e o aborto como direito feminino que, por sua vez, contempla o direito à autodeterminação reprodutiva e o direito à vida. Muchas veces hemos oído hablar de que cierta conducta es irracional o que tal persona está actuando irracionalmente. La racionalidad en el comportamiento es un supuesto en el que se basa la economía para el desarrollo de sus modelos de predicción de la conducta de los individuos o agentes económicos en sus decisiones de consumo e inversión. Si los supuestos de la teoría económica tradicional fueran ciertos en su totalidad, no se deberían observar patrones de desviación desde el punto óptimo del consumo, pero a menudo se puede notar que las personas cometen errores al tomar sus decisiones. Esto se debe a que los individuos toman decisiones basándose en la percepción de la realidad, más que en la realidad misma y en que el modo en el cual se les presente la situación influirá en su comportamiento. La ciencia económica tradicional está siendo innovada, relajando los estrictos supuestos de la conducta racional de los consumidores, reemplazándolos por concepciones más realistas del comportamiento humano, admitiendo que poseen una racionalidad limitada. Los pioneros en desarrollar una teoría alternativa a la clásica1 , fueron los profesores Daniel Kahneman y Amos Tversky(1974), a la cual denominaron Teoría Prospectiva. Las características claves de esta nueva teoría y que la diferencian de la teoría neoclásica son que: la función de utilidad es reemplazada por una función de valor, se introduce el precio de referencia y además se relaja el principio de fungibilidad. Con esta teoría se pueden explicar diferentes anomalías en el comportamiento del consumidor que se observan en la vida cotidiana. Algunos ejemplos son: 1) El señor X, compró tiempo atrás una caja de vinos de buena calidad a $2.000 la botella. Años más tarde, el señor Y le ofrece comprarle a $40.000 cada botella. Sin embargo el señor X, se niega a venderlo, a pesar de que no estaría dispuesto a pagar más de $14.000 por cada botella (Thaler 1980). 2) A un individuo se le entrega un ticket de lotería. Sin embargo, el individuo se rehúsa a cambiar su ticket (Maimaran 2003). 3) Durante un tiempo VTR ofreció la siguiente oferta, quienes opten por la opción banda ancha light ( una versión menos rápida pero más barata que la banda ancha normal) recibirán durante los tres primeros meses el servicio de banda ancha normal por el precio de la light. Al cabo de los tres meses, si el suscriptor no solicita el cambio a su opción original (BAL), la compañía seguirá proveyendo el servicio de banda ancha normal con el respectivo aumento en su cuenta mensual a contar del cuarto mes. Finalmente se vio que la mayoría de los individuos optaban inicialmente por la banda ancha light. Sin embargo, al cabo de los tres meses una gran cantidad de individuos no solicitó el cambio a su opción original (Manzur 2004). Cada una de estas anécdotas ilustran diferentes tipos de comportamiento semi-racional. En el primer ejemplo, podemos ver cómo una persona valora de manera diferente un bien antes y después de poseerlo. A esto se le llama “Endowment Effect”, (Thaler, 1980) y será analizado en profundidad en el capítulo III. En el segundo ejemplo, se observa que el individuo se rehúsa a cambiar su situación por una mejor, este comportamiento opuesto a lo que se propone en la Teoría Económica, muestra una tendencia a mantener el status quo. Samuelson y Zeckhauser (1988) definieron este comportamiento como “Status Quo Bias” y se verá en el capítulo IV. Por último en el tercer ejemplo, podemos ver cómo los consumidores tienden a evitar la toma de decisiones, este comportamiento suele aparecer cuando se le presenta una opción Default, es decir, una opción que el consumidor automáticamente recibirá si no especifica explícitamente otra opción, esto se verá más detalladamente en el capítulo V. Basaremos nuestra tesis en estas tres conductas del comportamiento del consumidor de modo de entender porque se producen y como utilizar sus implicancias en las estrategias de marketing para obtener de este modo mejores resultados. Para comenzar explicaremos la Teoría prospectiva, aquí analizaremos detalladamente el modelo de referencia dependencia y la aversión a la perdida, ya que estas dos características son la base que explica el comportamiento semi-racional de los individuos. Luego se buscarán motivos alternativos para cada una de estas conductas, trataremos de encontrar motivos sicológicos que no han sido considerados por la teoría económica y que nos parecen muy relevantes, ya que generalmente son estos los que modelan el comportamiento de los individuos. Intentaremos explicar cuales son los factores que hacen variar la magnitud de estas anomalías, cómo y porqué se generan. Además en cada capítulo explicaremos cuales son las implicancias que generan estas diferentes conductas para el marketing y para algunas políticas sociales, a fin de poder ser utilizadas para crear estrategias beneficiosas.

De som förespråkar en ändring av det rådande läget (status quo), inom exempelvis politik, har visat sig vara mer påverkade av naiv realism än de som vill behålla status quo. Ytterligare studier visar att den politiska tillhörigheten kan vara av betydelse för hur påverkade av naiv realism dessa utmanare är. I två studier har det testats om naiv realism påverkas av positionen till status quo (utmana eller försvara) eller av den politiska tillhörigheten. I båda studier har en tydlig favorisering av den egna gruppen påträffats, samt att personer i utmanarposition gentemot status quo gjorde signifikant större skillnad mellan ingrupp och utgrupp än vad försvarare av status quo gjorde. Den politiska tillhörigheten visade sig inte vara av betydelse. En omarbetad version av enkäten väntas stärka resultaten ytterligare. Fortsatta studier inom området föreslås.

Cette recherche interroge les conditions de structuration et de perduration d’un engagement séparé pour les femmes dans les organisations et au sein de mobilisations agricoles bretonnes. Majoritairement composés d’exploitantes installées en couple et situés à la frontière entre associations de défense de l’égalité, cercles de sociabilités professionnelles et groupes de parole, les espaces d’encadrement agricole féminins offrent une occasion idoine de questionner non seulement l’imbrication des identités professionnelles et conjugales dans l’engagement mais également la labilité des usages rhétoriques de l'égalité et du féminisme dans des espaces professionnels non-mixtes. L’analyse de leur position dans l’espace de la représentation agricole questionne le degré d’autonomie des revendications portées au nom des agricultrices, leur influence sur les agendas organisationnels et leur effet sur la construction des carrières militantes. L’enquête s’appuie sur un dispositif cumulant une observation de quatre années des activités formelles et informelles des groupes féminins, une étude de leur documentation professionnelle, un recensement de leurs tribunes dans la presse agricole, auxquels s’ajoutent la réalisation d’entretiens avec les actrices qui y sont engagées et la constitution de données statistiques relatives aux mandats féminins dans les organisations agricoles bretonnes depuis 1990. Sur la base d’une analyse croisant les études de genre, la sociologie du militantisme et celle de la représentation professionnelle agricole, notre thèse consiste à démontrer que les groupes et mobilisations d’agricultrices forgent les contours d’une « cause de femmes » agricole mise sous tutelle des intérêts catégoriels et chevillée à l’idéal normatif de la complémentarité des sexes. En tant que réceptacles de positions professionnelles, organisationnelles et conjugales entrecroisées, les espaces de l’engagement féminin produisent des politisations ambivalentes de ces appartenances multiples, à la fois porteuses de contestation comme de reproduction des hiérarchies sexuées et de l’ordre social et politique
This research looks into the conditions for the structuring and continuation of a separate female activism within Breton organisations and farmers mobilisations. Mainly made up of professionals living in couples and situated at the intersection between gender equality advocacy groups, professional networks and support groups, farming self-help groups are a case in point to question not only the intertwining of professional and marital identities within activism but also the lability of rhetorical uses of equality and feminism within women-only professional spaces. The analysis of their position within the farmers’ representation spaces makes it compelling to question the degree of autonomy of the claims made in the name of women farmers, their influence upon the setting of professional agendas and their impact on the development of activist careers.Evidence was collected through an apparatus which consisted in the addition of a four-year-long observation of female groups’ formal and informal activities, an analysis of their professional literature, an inventory of their opinion columns inside the farm press, to which can be added semi-structured interviews with women farmers engaged in this activism and the setting up of statistical data about female mandates within Breton farm organisations since the 1990s. Drawing on an analysis which mixes gender studies, sociology of militancy and studies of farming professional representation, this PhD aims to demonstrate that women farmers groups and mobilisations shape the features of a farming “women cause” although it is subordinated to corporatist interests and seen through the lenses of the normative ideal of complementarity between the sexes. Being a repository of interlinked professional, organisational and matrimonial standpoints, female activism spaces lead to the ambivalent politicisation of plural belongings. These multiple affiliations can be a catalyst for protest as well as a way to reproduce sexual hierarchies and social and political order

Com base no modelo de preferência por sequências(Loewenstein & Prelec, 1993) no Double-entry mental accounting model (Prelec & Loewenstein, 1998) e na aversão à dívida, prevê-se atracção por virtues e aversão a vices. Devido à natureza dos virtues e vices(perspectivas mistas) averiguou-se também a existência do status quo bias (Samuelson & Zeckhauser, 1988) na escolha intertemporal neutralizando o efeito de aversão às perdas(Kahneman & Tversky, 1979, 1984). Um estudo com 390 sujeitos confirmou tanto as previsões dos modelos face a virtues e vices como a existência do status quo bias na escolha intertemporal. ------- ABSTRACT -------- The present study objective is to investigate people’s attitudes towards virtues an vices in the monetary domain, although there is extensive literature on the subject, none of it is focused on this domain. Based on the preference for sequences model (Loewenstein & Prelec, 1993), on the Double-entry mental accounting model (Prelec&Loewenstein, 1998) and on debt aversion, it is predicted that people are attracted to virtues and averse to vices. Due to the virtues and vices nature(mixed prospects) it was also investigated the presence of the status quo bias (Samuelson & Zeckhauser, 1988) in intertemporal choice after neutralizing loss aversion (Kahneman & Tversky, 1979, 1984). With 390 participants the study confirmed both the predictions for the virtues and vices and the existence of the status quo bias in intertemporal choice.

Le statu-quo de la mémoire nationale à Taiwan : les dynamiques antagonistes de mise en récits de l’expérience autoritaireresume :Cette thèse a comme origine l’apparente contradiction des politiques de la mémoire dédiées au régime de parti unique mis en place par le Parti nationaliste chinois (KMT) en 1945. Colonie japonaise depuis 1895, Taiwan passe alors sous le contrôle de la République de Chine au lendemain de la Seconde guerre mondiale. L’île sert de refuge aux nationalistes chinois en 1949, lorsqu’est actée la victoire des troupes maoïstes suite à la reprise de la guerre civile chinoise après 1945. En exil, le KMT, refusant de reconnaître sa défaite, gouverne Taiwan à travers un régime pensé pour représenter symboliquement toute la Chine. Les politiques identitaires et mémorielles d’alors valorisent uniquement les expériences historiques d’une communauté minoritaire au sein de la population taiwanaise, celle des insulaires venus de Chine à Taiwan avec le KMT entre 1945 et 1950. Cette fiction politique prend fin avec la démocratisation. Débutant en 1987, celle-ci voit l’affirmation d’un nouveau paradigme identitaire articulé autour des spécificités de Taiwan et son multiculturalisme, la Chine n’étant plus le référent central. Les victimes de la répression policière de l’ère autoritaire sont peu à peu reconnues. S’il perd rapidement sa prééminence, l’ancien récit officiel ne disparaît pas pour autant, une fraction de la population insulaire continuant de se reconnaître en une partie des représentations qui y sont inscrites. De même, le KMT, qui reste un des acteurs dominants la scène politique taiwanaise après la démocratisation, se refuse à tout véritable retour critique sur sa propre histoire pour éviter de mettre en danger sa propre légitimité. Plutôt que marquer une rupture nette avec l’ère autoritaire, les politiques de la mémoire post-1987 aboutissent à l’institutionnalisation de dispositifs reconnaissant les victimes de la dictature et d’autres à la gloire des anciens dirigeants, que ce soit Chiang Kai-shek ou son fils Chiang Ching-kuo. En adoptant une démarche relevant de la sociologie de la mémoire, notre recherche a pour but d’analyser les dynamiques soutenant la mise en place de nouveaux récits publics sur la période autoritaire après la démocratisation. L’objet de notre travail est d’expliquer les principales luttes mémorielles actuelles engageant la place qu’occuperait dans l’histoire taiwanaise le régime autoritaire du KMT, ce tout en interrogeant la notion de mémoire nationale
The key focus of this thesis is the exploration of the contradictory nature of the politics of memory dedicated to the Party-State system implemented by the Chinese Nationalist party (KMT) in 1945.In the aftermath of World War II, Taiwan – a Japanese colony since 1895 – sees its sovereignty transferred to the Republic of China.The country becomes the home to Chinese nationalist refugees and the last stronghold of the Kuomintang (KMT), after the party’s defeat against the communist forces during the Chinese civil war of 1949. Refusing to recognize its demise, the KMT rules Taiwan through a regime conceived to, symbolically, represent China in its entirety. During this period, the politics of memory and identity take into account the experiences of a minority within the Taiwanese community only – those of the Chinese population that came to Taiwan with the KMT between 1945 and 1950. This ends with the democratization of Taiwan in 1987. From this point onwards, China is no longer the central point of reference; a new identity paradigm arises, articulated around the specificities of Taiwan, and its multiculturalism.While the old official discourse quickly loses its prominence in modern day Taiwan, it doesn’t disappear completely, with a portion of the population still identifying itself with the old KMT narrative. Likewise, the KMT remains one of the key players on the Taiwanese political scene; the party never took an overly critical stance on its own history as it undermines its own legitimacy. Instead of breaking from the authoritarian era, the post 1987 politics of memories result in the contradicting recognition of both the victims of the dictatorship and the glory of the oldr ulers, Chiang Kai-shek and his son ChiangChing-kuo. Through following a sociology of memory approach, this research aims at analysing the dynamics behind the development of the new post-democratisation public narratives. This study investigates the current opposing takes on national memory, looking at the place the KMT’s authoritarian regime occupies in the Taiwanese history, while also redefining the concept of national memory

This chapter discusses the role of speculation in the financial markets that influences individual and group behavior in the form of bubbles and crashes. The chapter highlights behavioral finance issues associated with bubbles, such as overconfidence, herding, group polarization, groupthink effect, representativeness bias, familiarity issues, grandiosity, excitement, and the overreaction and underreaction to prices. These issues are important for understanding past financial mistakes because history often repeat itself. The chapter also examines the aftermath of the financial crisis of 2007–2008 on investor psychology, including the impact of a severe financial downturn, anchoring effect, recency bias, worry, loss averse behavior, status quo bias, and trust. The aftermath of the financial crisis might have negative long-term effects on investor psychology in which some investors remain overly risk averse, resulting in under-investment in stocks and over-investment in cash and bonds.

Abstract:
This chapter discusses some of Adam Smith’s more important economic and political categories. It argue that it is misleading to understand Smith as a methodologic individualist. In particular, it argues that “society” is a crucial category in Smith’s political philosophy. But unlike the Stoicizing interpretation of Smith, this chapter argues that for Smith a society is not by definition harmonious. In particular, there is inherent class conflict between wage-earning and profit-seeking classes. Smith also diagnoses other sources of faction and pays particular attention to social orders. In addition, this chapter introduces Smith’s the nature of status quo bias when contemplating political change.

En la investigación, se han analizado individualmente los conjuntos pictóricos murales góticos, identificando circunstancias históricas y geográficas, antecedentes y referencias en otras artes, además del estudio del estado de conservación, el modo de factura y la analítica de componentes, con el fin de encontrar trazos comunes que definen el corpus existente. Se ha encontrado una amplia variedad de temas representados, de recursos decorativos y estilísticos, determinando que existen temáticas diversas, elementos ornamentales, estructuras de distribución, y modelos que conforman un rico panorama artístico. Se presenta en este trabajo el análisis comparativo a nivel estilístico y matérico a partir de los rasgos comunes detectados a en los distintos conjuntos pictóricos.En el ámbito estilístico (presentado en este artículo), se estudian la totalidad de los conjuntos identificados, independientemente de que se ubiquen en el periodo gótico inicial o más evolucionado, o de que conformen decoraciones de tipo arquitectónico.http://dx.doi.org/10.4995/ANIAV.2017.5628

Abstract:
We investigate opinion dynamics in multi-agent networks when there exists a bias toward one of two possible opinions; for example, reflecting a status quo vs a superior alternative. Starting with all agents sharing an initial opinion representing the status quo, the system evolves in steps. In each step, one agent selected uniformly at random adopts with some probability a the superior opinion, and with probability 1 - a it follows an underlying update rule to revise its opinion on the basis of those held by its neighbors. We analyze the convergence of the resulting process under two well-known update rules, namely majority and voter. The framework we propose exhibits a rich structure, with a nonobvious interplay between topology and underlying update rule. For example, for the voter rule we show that the speed of convergence bears no significant dependence on the underlying topology, whereas the picture changes completely under the majority rule, where network density negatively affects convergence. We believe that the model we propose is at the same time simple, rich, and modular, affording mathematical characterization of the interplay between bias, underlying opinion dynamics, and social structure in a unified setting.

Abstract:
The current linear economy model extracts resources at a rate that far exceeds the ability of the planet to regenerate them. Climate change, global warming, and the destruction of natural habits are just a few consequences. They highlight the urgent need for a shift towards a more sustainable economic model, such as the circular economy. Such a paradigm shift would offer novel approaches that aim to uncouple economic development from environmental degradation, however, the adoption of circular economy principles by consumers is often hindered by the human behavior which is influenced by so-called cognitive biases. These effects influence human decision-making leading to a systematic deviation from a rational optimum. Exemplarily the status quo bias shows this connection. Thereby, individuals favor existing conditions over potential changes. Research on circular economy as well as on cognitive biases increases, however, the interplay between these areas remains unexplored. Serious games, defined as games with a primary purpose other than pure entertainment, could be a promising approach to mitigate cognitive biases in the context of the circular economy. Serious games are being increasingly recognized as a valuable tool for education, especially in the context of complex systems (such as circular economy) and behavioral change, as they engage players in an interactive, and immersive environment. This paper explores in an exploratory approach possible ways, prerequisites, and obstacles of the use of serious games enabling circular value creation. Utilizing a structured literature review, the authors examine existing work in this area and identify gaps in the literature, underscoring the need for further research in this emerging field. This study, thus, serves as a starting point for future studies on the role of serious games in shaping sustainable practices.

L’arrêt Google Android rendu par le Tribunal de l’U.E. le 14 septembre 2022 a confirmé l’essentiel de la décision de la Commission européenne qui avait sanctionné en juillet 2018 des pratiques de verrouillage anticoncurrentiel. Ce cahier de recherche porte sur l’une des dimensions de l’arrêt confirmant l’analyse de la décision quant aux effets d’éviction anticoncurrentielle reliés aux clauses de pré-installations de certaines applications. Celles-ci doivent être envisagée sous l’angle d’une pratique de ventes liées et sous celui de l’exploitation d’un biais de statu quo de la part des utilisateurs. L’analyse de ce cas ouvre une discussion sur les exigences de neutralité des plateformes dans le contexte de la publication des lois européennes sur les marchés et sur les services numériques.

La Agenda 2030 debe retomarse en el marco de una nueva gobernanza de la salud pública global debido al ingreso a una nueva era epidemiológica de carácter pandémico que hace indispensable, no solo superar satisfactoriamente la presente crisis, sino rectificar radicalmente el statu quo, con el fin de impedir grandes epidemias o, al menos, evitar su explosión pandémica. En este Documento de trabajo se abordan los factores propulsores que potencian las enfermedades zoonóticas para evidenciar la interconexión sistémica de la salud. Además, se consideran las restricciones de financiamiento que enfrentan los países latinoamericanos para avanzar hacia una transición que haga frente conjuntamente al cambio climático y los retos pandémicos, y se analiza el potencial que pueden tener los acuerdos ambientales en marcha para incrementar la capacidad de prevención en la nueva era. En segundo lugar, se reflexiona sobre la necesidad de transformar de manera contundente la gobernanza en salud a escala multilateral y se enuncian algunas propuestas que se están contemplando para fortalecer y agilizar la Organización Mundial de la Salud (OMS). Finalmente, se destaca el imperativo de la vacuna universal y equitativa como precondición indispensable para una resolución global de la crisis.

El fomento de la innovación en el sector de agua, saneamiento y residuos sólidos (AyS) en América Latina y el Caribe (ALC) resulta esencial para contribuir de forma rápida y eficiente a la efectiva consecución de los Objetivos de Desarrollo Sostenible vinculados al AyS. Por tal motivo, entre los caminos de acción para impulsar la innovación se incluyen actividades centradas en comunicar la potencialidad y los beneficios que le genera al sector de AyS, así como también en resaltar la importancia de la toma de conciencia por parte de los líderes, encargados de la toma de decisiones de nivel ejecutivo y equipos operativos en el sector de política pública, en el regulador y en el prestador de servicios de AyS, entre otros. El principal reto es promover un círculo virtuoso que se retroalimente en el tiempo, es decir, que la innovación se mantenga asociada estrechamente a la visión del día a día en AyS en ALC. Para ello, es fundamental contar con una cultura sectorial que catalice el correr riesgos más allá de los cotidianos, inhibiendo la tendencia al statu quo. Este documento tiene como principal objetivo proveer elementos clave para abordar de forma pragmática aquellas acciones que podrían promover la cultura de innovación en las entidades de AyS en ALC.

El propósito de este trabajo es analizar la agenda de negociación del Acuerdo de Libre Comercio de las Américas (ALCA), los principales intereses de los participantes, así como los conflictos fundamentales que pudiesen surgir en el camino. Para ello, se hace una revisión de los intereses centrales que los países persiguen en cada una de las nueve mesas de negociación del ALCA. Los intereses se clasifican en "defensivos" y "ofensivos". Los primeros son aquéllos que persiguen mantener el statu quo y que están asociados, generalmente, con la protección del mercado nacional. Los intereses ofensivos, por el contrario, responden al interés de obtener acceso libre a los mercados de los otros participantes. Posteriormente, se repasan los diversos factores que hacen de la negociación del ALCA una iniciativa singular: (1) Lo ambicioso de la agenda de negociación y el plazo relativamente breve para cubrirla; (2) El elevado número de países participantes; (3) La diversidad en el tamaño y la estructura productiva de los países involucrados; (4) La coincidencia de las negociaciones del ALCA, de la ronda Doha y de las negociaciones de acuerdos comerciales que han emprendido un número importante de países de la región; (5) La coexistencia del futuro acuerdo hemisférico con los tratados de libre comercio y los otros acuerdos vigentes en el continente; y, (6) El entorno político en EE.UU.
