Abstract:
Retention of title arrangements are common contractual tools to secure the payment of the purchase price in cases where sold goods are delivered to the buyer prior to such payment. In most jurisdictions retention of title arrangements require an agreement between the buyer and the seller. Based on a comparative analysis of German law this article argues that it would be in the best interest of all concerned parties to replace this requirement with statutory retention of title structures. Statutory retention of title structures, that is, rules according to which the payment of the purchase price is an automatic - but rebuttable - precondition for the transfer of title to movable property, would only codify what is common contract practice anyway and thus eliminate the potential for errors and conflicts.

Tim Flannery?s The Future Eaters holistic ecological history invigorated Australians and took ccoiohry to the dinner table and into the pub. It was a monumental achievement. The problem with The Future Eaters for many Australian ecologists was that despite the wonderful prose and apparently beautiful logic of the simple story many of the details did not seem to add up or were presented rhetorically. At the time of reading, I had just finished a survey of the dry rainforests along the eastern seaboard and there were many fcatures of these ecologically tantalizing environments that were incompatible with them as the ?relic? environments central to Flannery?s story (Fensham 1995). The contribution of The Future Eaters as a provocateur of debate was immense, but it had ultimate shortcomings because Flannery could not afford the forensic scrutiny required, in a book that was packaged as a popular best seller.

Abstract:
Purpose The purpose of this paper is to test the impact of manifest conflict on performance outcomes. In particular, this paper aims to examine the moderating effect of the supplier’s customer orientation (CO) as perceived by the buyer on the conflict-performance outcomes relationships in international channel relationships. Design/methodology/approach A survey of 162 Australian importers was conducted to elucidate the associations among manifest conflict, CO and performance outcomes. Findings Manifest conflict was found to be negatively related to the importer’s evaluation of the exporter’s overall performance, which is consistent with previous work. However, CO was found to moderate the negative direct effect of manifest conflict on two outcome measures, “satisfaction with business outcomes” and the “evaluation of the exporter’s overall performance”. Moreover, it actually changed the effect from dysfunctional to functional for “evaluation of the exporter’s overall performance”. That is, CO changes the nature of the manifest conflict–outcome relationship by turning it from negative to positive. Research limitations/implications This research helps answer the appeal for research on the conditions in which conflict causes dysfunctional and functional outcomes. From a practical standpoint, providing the importer views the exporter as being customer-oriented, conflict should not be avoided if it stems from disagreements that arise due to the exporter acting in the best interests of the importer. The power of CO in affecting the functionality of outcomes resulting from conflict should be highlighted. Originality/value Conflict is a fact of life in channel relationships, but little is known about its functional and dysfunctional effects (Frazier, 1999; Skarmeas, 2006). The empirical evidence largely points to conflict being dysfunctional; however, research also indicates that context can play an important role in moderating the functionality of conflict. In this paper the authors ask: what role does CO play as a determinant of the functionality of manifest conflict in channel relationships? They argue that the exporter’s CO changes the context in which the importer and the exporter interact and, thereby, changes the way in which the importer interprets the supplier’s actions.

Although belonging to literatures spatially and traditionally very remote from each other, John Steinbeck, an American Nobel Prize winner, and Frank Hardy, an Australian novelist and story-teller, share a number of common grounds. The fact that by the time Hardy wrote his first novel, in 1950, Steinbeck was already a popular writer with a long list of masterpieces does not justify the assumption that Hardy had Steinbeck at hand when writing his best-sellers, but it does exclude the opposite direction of inheritance. Hardy's creativ impulses and appropriations may have been the unconscious results of his omnivorous reading after he realized that "the transition from short stories [in which he excelled] to the novel was an obstacle not easily surmounted" as he confessed in The Hard Way: The Story Behind "Power Without Glory" (109). Furthermore, since both were highly regarded proletarian writers in communist Russia, Hardy might have become acquainted with Steinbeck's novels on one of his frequent visits to that country between 1951 and 1969.2 Upon closer reading, inter-textual entanglements with Steinbeck's prose can be detected in several of his books, including But the Dead Are Many (1975), the Billy Borker material collected in The Yarns of Billy Barker (1965) and in The Great Australian Lover and Other Stories (1967), and in Power Without Glory (1950). My purpose in this essay is to briefly illuminate the most striking similarities between the two authors' narrative strategies in terms of their writing style, narrative technique, and subject matter, and link these textual affinities to the larger social and cultural milieu of each author. In the second part I will focus on the parallels between their central works, Steinbeck's The Grapes of Wrath and Hardy's Power Without Glory.

The relevance of the research is that in Russia there is a problem of underdevelopment of the system of purchasing wool and its processed products at all levels of the value chain. The purpose of the research is to develop a concept for creating a specialized electronic trading platform that allows organizing inter-industry interaction in the field of wool processing based on the principles of auction trade, excluding unnecessary intermediary links. The paper proposes the creation of a specialized electronic trading platform (exchange), specializing in the purchase and sale of wool and its products by analogy with the world’s leading (Australian, New Zealand and Chinese-countries that are world leaders in the production and processing of wool) wool exchanges. The differences between the author’s recommendations and those that are known and tested in the world practice are that the key participant of the exchange is the state national wool certification body, which creates the main condition for exchange trading — high-quality classification and batch standardization of wool. An electronic exchange that includes trading, settlement (guarantee) and payment systems must be an official trading platform licensed by the state as a professional Institute of the financial market; its main task is to facilitate market transactions between buyers and sellers of wool by overcoming information asymmetry for the parties to transactions. The difference between the proposed concept is that digital technologies and tools are used in exchange trading of wool: QR-coding of wool batches, the use of smart contracts, distributed registries (blockchain). The novelty of the research lies in the fact that for the first time in the Russian market, the concept of organizing electronic exchange trade in wool using innovative digital technologies and tools (QR-coding, smart contracts, blockchain), where, along with buyers-processors of wool and sellers — producers of wool, there is a mandatory participant — the state national certification body, which organizes the certification process of exchange batches of wool. For most people the sale and purchase of a house is a stressful exercise. In fact, a quick internet search reveals that it is rated among the ten most stressful things in life, outranked only by divorce and death of a loved one. This is hardly surprising, since experts have found that moving house is “the most expensive and life-changing financial transaction most people ever undertake”. A wrong decision is not easily rectified, and may have significant financial implications. Fear and uncertainty, not knowing whether the right decision has been made, exacerbate the stress. An informed decision is therefore crucially important, meaning that all relevant information must be gathered and carefully weighed before a final commitment is made. Every seller of immovable property wants to sell at the right price. But what is the right price? The valuation of immovable property is not an exact science, and values change depending on market conditions. Nevertheless, as a point of departure it is safe to say that a property is sold at the correct price if the price offered and accepted matches the property’s market value at the time of sale, the market value being the price a willing buyer would pay to a willing seller on a specific date. It must be properly understood, however, that the market value of a property is not necessarily the price paid by the particular buyer who actually bought the property. The “willing seller” and the “willing buyer” are not the actual persons buying and selling, but a notional willing seller and a notional willing buyer negotiating with each other on an equal footing, assuming that neither party is overly anxious to buy or sell by reason of special or extraordinary reasons: Sher NNO vAdministrator, Transvaal (1990 4 SA 545 (A) 547H). A property can therefore be sold below its true market value, which happens frequently in the case of forced sales and sales between relatives. Many homeowners are not pressed to sell, but are prepared to do so at the right price. For them, discovering that their most valuable investment was sold below its market value may be the worst nightmare come true. Obviously, the best way to avoid this is to be informed about the property’s market value prior to putting it on the market. Here estate agents enter the picture. In practice they handle the vast majority of sales of residential properties, and both sellers and buyers rely heavily on them for advice and assistance. This Note discusses the question to what extent an estate agent is under a legal duty to provide the seller of a house with information about the market value of the property, prior to the marketing and/or sale thereof. More specifically, the focus falls on whether, in the absence of an express instruction or request from the seller, an estate agent is under a legal duty to (a) advise the seller at listing stage that the seller’s asking price for the property is less than its likely market value; (b) market and sell a property at market value; and/or (c) advise the seller, when submitting an offer, that the price offered is below market value. The common law of estate agency in Australia in many respects closely resembles South African law. For that reason the Note commences with a brief discussion of the legal position under Australian law.

We are living in an era of vast inequality. Income and wealth gaps between ‘the haves’ and ‘have-nots’ have reached epidemic proportions. The top 1 per cent of earners in the United States pulled in a whopping 19.3 per cent of household income in 2012, their biggest slice of total income in more than 100 years. In 2014, the World Economic Forum listed severe income inequality as the number one global risk and Tom Piketty’s unlikely best seller, Capital in the 21st Century, documented the rising ratio of wealth to income and the growth of a ‘rentier class’. Even in Australia, where the mining industry continues to power economic growth, the income and wealth gap between the lowest and highest quintile of earners is stark. According to recent data, the top 20 per cent of Australians earn five times the income of the bottom 20 per cent, while holding 71 times more wealth. The question for mediation scholars and practitioners is whether this growing gap is affecting the way in which society’s ‘haves’ and ‘have-nots’ access and experience mediation. At the low end of the socio-economic totem pole, government cuts in legal services – combined with mediation practitioners’ obsession with neutrality – potentiate uninformed decision-making by unrepresented parties. At the high end, models of practice catering to legal professionals’ preferences threaten to rob mediation of its transformative, therapeutic potential. This paper will explore these troubling developments and query whether growing social inequality should precipitate shifts in our thinking about mediation ethics and the way we educate the next generation of lawyers.

Photograph by Gonzalo Echeverria (2010)We need to get some broad-based support, to capture the public’s imagination … so we have to offer up scary scenarios, make simplified, dramatic statements and make little mention of any doubts … each of us has to decide what the right balance is between being effective and being honest (Hulme 347). Acclaimed climate scientist, the late Stephen Schneider, made this comment in 1988. Later he regretted it and said that there are ways of using metaphors that can “convey both urgency and uncertainty” (Hulme 347). What Schneider encapsulates here is the great conundrum for those attempting to communicate climate change to the everyday public. How do scientists capture the public’s imagination and convey the desperation they feel about climate change, but do it ethically? If scientific findings are presented carefully, in boring technical jargon that few can understand, then they are unlikely to attract audiences or provide an impetus for behavioural change. “What can move someone to act?” asks communication theorists Susan Moser and Lisa Dilling (37). “If a red light blinks on in a cockpit” asks Donella Meadows, “should the pilot ignore it until in speaks in an unexcited tone? … Is there any way to say [it] sweetly? Patiently? If one did, would anyone pay attention?” (Moser and Dilling 37). In 2010 Tim Flannery was appointed Panasonic Chair in Environmental Sustainability at Macquarie University. His main teaching role remains within the new science communication programme. One of the first things Flannery was emphatic about was acquainting students with Karl Popper and the origin of the scientific method. “There is no truth in science”, he proclaimed in his first lecture to students “only theories, hypotheses and falsifiabilities”. In other words, science’s epistemological limits are framed such that, as Michael Lemonick argues, “a statement that cannot be proven false is generally not considered to be scientific” (n.p., my emphasis). The impetus for the following paper emanates precisely from this issue of scientific uncertainty — more specifically from teaching a course with Tim Flannery called Communicating climate change to a highly motivated group of undergraduate science communication students. I attempt to illuminate how uncertainty is constructed differently by different groups and that the “public” does not necessarily interpret uncertainty in the same way the sciences do. This paper also analyses how doubt has been politicised and operates polemically in media coverage of climate change. As Andrew Gorman-Murray and Gordon Waitt highlight in an earlier issue of M/C Journal that focused on the climate-culture nexus, an understanding of the science alone is not adequate to deal with the cultural change necessary to address the challenges climate change brings (n.p). Far from being redundant in debates around climate change, the humanities have much to offer. Erosion of Trust in Science The objectives of Macquarie’s science communication program are far more ambitious than it can ever hope to achieve. But this is not necessarily a bad thing. The initiative is a response to declining student numbers in maths and science programmes around the country and is designed to address the perceived lack of communication skills in science graduates that the Australian Council of Deans of Science identified in their 2001 report. According to Macquarie Vice Chancellor Steven Schwartz’s blog, a broader, and much more ambitious aim of the program is to “restore public trust in science and scientists in the face of widespread cynicism” (n.p.). In recent times the erosion of public trust in science was exacerbated through the theft of e-mails from East Anglia University’s Climate Research Unit and the so-called “climategate scandal” which ensued. With the illegal publication of the e-mails came claims against the Research Unit that climate experts had been manipulating scientific data to suit a pro-global warming agenda. Three inquiries later, all the scientists involved were cleared of any wrongdoing, however the damage had already been done. To the public, what this scandal revealed was a certain level of scientific hubris around the uncertainties of the science and an unwillingness to explain the nature of these uncertainties. The prevailing notion remained that the experts were keeping information from public scrutiny and not being totally honest with them, which at least in the short term, damaged the scientists’s credibility. Many argued that this signalled a shift in public opinion and media portrayal on the issue of climate change in late 2009. University of Sydney academic, Rod Tiffen, claimed in the Sydney Morning Herald that the climategate scandal was “one of the pivotal moments in changing the politics of climate change” (n.p). In Australia this had profound implications and meant that the bipartisan agreement on an emissions trading scheme (ETS) that had almost been reached, subsequently collapsed with (climate sceptic) Tony Abbott's defeat of (ETS advocate) Malcolm Turnbull to become opposition leader (Tiffen). Not long after the reputation of science received this almighty blow, albeit unfairly, the federal government released a report in February 2010, Inspiring Australia – A national strategy for engagement with the sciences as part of the country’s innovation agenda. The report outlines a commitment from the Australian government and universities around the country to address the challenges of not only communicating science to the broader community but, in the process, renewing public trust and engagement in science. The report states that: in order to achieve a scientifically engaged Australia, it will be necessary to develop a culture where the sciences are recognized as relevant to everyday life … Our science institutions will be expected to share their knowledge and to help realize full social, economic, health and environmental benefits of scientific research and in return win ongoing public support. (xiv-xv) After launching the report, Innovation Minister Kim Carr went so far as to conflate “hope” with “science” and in the process elevate a discourse of technological determinism: “it’s time for all true friends of science to step up and defend its values and achievements” adding that, "when you denigrate science, you destroy hope” (n.p.). Forever gone is our naïve post-war world when scientists were held in such high esteem that they could virtually use humans as guinea pigs to test out new wonder chemicals; such as organochlorines, of which DDT is the most widely known (Carson). Thanks to government-sponsored nuclear testing programs, if you were born in the 1950s, 1960s or early 1970s, your brain carries a permanent nuclear legacy (Flannery, Here On Earth 158). So surely, for the most part, questioning the authority and hubristic tendencies of science is a good thing. And I might add, it’s not just scientists who bear this critical burden, the same scepticism is directed towards journalists, politicians and academics alike – something that many cultural theorists have noted is characteristic of our contemporary postmodern world (Lyotard). So far from destroying hope, as the former Innovation Minister Kim Carr (now Minister for Innovation, Industry, Science and Research) suggests, surely we need to use the criticisms of science as a vehicle upon which to initiate hope and humility. Different Ways of Knowing: Bayesian Beliefs and Matters of Concern At best, [science] produces a robust consensus based on a process of inquiry that allows for continued scrutiny, re-examination, and revision. (Oreskes 370) In an attempt to capitalise on the Macquarie Science Faculty’s expertise in climate science, I convened a course in second semester 2010 called SCOM201 Science, Media, Community: Communicating Climate Change, with invaluable assistance from Penny Wilson, Elaine Kelly and Liz Morgan. Mike Hulme’s provocative text, Why we disagree about climate change: Understanding controversy, inaction and opportunity provided an invaluable framework for the course. Hulme’s book brings other types of knowledge, beyond the scientific, to bear on our attitudes towards climate change. Climate change, he claims, has moved from being just a physical, scientific, and measurable phenomenon to becoming a social and cultural phenomenon. In order to understand the contested nature of climate change we need to acknowledge the dynamic and varied meanings climate has played in different cultures throughout history as well as the role that our own subjective attitudes and judgements play. Climate change has become a battleground between different ways of knowing, alternative visions of the future, competing ideas about what’s ethical and what’s not. Hulme makes the point that one of the reasons that we disagree about climate change is because we disagree about the role of science in today’s society. He encourages readers to use climate change as a tool to rigorously question the basis of our beliefs, assumptions and prejudices. Since uncertainty was the course’s raison d’etre, I was fortunate to have an extraordinary cohort of students who readily engaged with a course that forced them to confront their own epistemological limits — both personally and in a disciplinary sense. (See their blog: https://scom201.wordpress.com/). Science is often associated with objective realities. It thus tends to distinguish itself from the post-structuralist vein of critique that dominates much of the contemporary humanities. At the core of post-structuralism is scepticism about everyday, commonly accepted “truths” or what some call “meta-narratives” as well as an acknowledgement of the role that subjectivity plays in the pursuit of knowledge (Lyotard). However if we can’t rely on objective truths or impartial facts then where does this leave us when it comes to generating policy or encouraging behavioural change around the issue of climate change? Controversial philosophy of science scholar Bruno Latour sits squarely in the post-structuralist camp. In his 2004 article, “Why has critique run out of steam? From matters of fact to matters of concern”, he laments the way the right wing has managed to gain ground in the climate change debate through arguing that uncertainty and lack of proof is reason enough to deny demands for action. Or to use his turn-of-phrase, “dangerous extremists are using the very same argument of social construction to destroy hard-won evidence that could save our lives” (Latour n.p). Through co-opting (the Left’s dearly held notion of) scepticism and even calling themselves “climate sceptics”, they exploited doubt as a rationale for why we should do nothing about climate change. Uncertainty is not only an important part of science, but also of the human condition. However, as sociologist Sheila Jasanoff explains in her Nature article, “Technologies of Humility”, uncertainty has become like a disease: Uncertainty has become a threat to collective action, the disease that knowledge must cure. It is the condition that poses cruel dilemmas for decision makers; that must be reduced at all costs; that is tamed with scenarios and assessments; and that feeds the frenzy for new knowledge, much of it scientific. (Jasanoff 33) If we move from talking about climate change as “a matter of fact” to “a matter of concern”, argues Bruno Latour, then we can start talking about useful ways to combat it, rather than talking about whether the science is “in” or not. Facts certainly matter, claims Latour, but they can’t give us the whole story, rather “they assemble with other ingredients to produce a matter of concern” (Potter and Oster 123). Emily Potter and Candice Oster suggest that climate change can’t be understood through either natural or cultural frames alone and, “unlike a matter of fact, matters of concern cannot be explained through a single point of view or discursive frame” (123). This makes a lot of what Hulme argues far more useful because it enables the debate to be taken to another level. Those of us with non-scientific expertise can centre debates around the kinds of societies we want, rather than being caught up in the scientific (un)certainties. If we translate Latour’s concept of climate change being “a matter of concern” into the discourse of environmental management then what we come up with, I think, is the “precautionary principle”. In the YouTube clip, “Stephen Schneider vs Skeptics”, Schneider argues that when in doubt about the potential environmental impacts of climate change, we should always apply the precautionary principle. This principle emerged from the UN conference on Environment and Development in Rio de Janeiro in 1992 and concerns the management of scientific risk. However its origins are evident much earlier in documents such as the “Use of Pesticides” from US President’s Science Advisory Committee in 1962. Unlike in criminal and other types of law where the burden of proof is on the prosecutor to show that the person charged is guilty of a particular offence, in environmental law the onus of proof is on the manufacturers to demonstrate the safety of their product. For instance, a pesticide should be restricted or disproved for use if there is “reasonable doubt” about its safety (Oreskes 374). Principle 15 of the Rio Declaration on Environment and Development in 1992 has its foundations in the precautionary principle: “Where there are threats of serious or irreversible environmental damage, lack of full scientific certainty should not be used as a reason for postponing measures to prevent environmental degradation” (n.p). According to Environmental Law Online, the Rio declaration suggests that, “The precautionary principle applies where there is a ‘lack of full scientific certainty’ – that is, when science cannot say what consequences to expect, how grave they are, or how likely they are to occur” (n.p.). In order to make predictions about the likelihood of an event occurring, scientists employ a level of subjectivity, or need to “reveal their degree of belief that a prediction will turn out to be correct … [S]omething has to substitute for this lack of certainty” otherwise “the only alternative is to admit that absolutely nothing is known” (Hulme 85). These statements of “subjective probabilities or beliefs” are called Bayesian, after eighteenth century English mathematician Sir Thomas Bayes who developed the theory of evidential probability. These “probabilities” are estimates, or in other words, subjective, informed judgements that draw upon evidence and experience about the likelihood of event occurring. The Intergovernmental Panel on Climate Change (IPCC) uses Bayesian beliefs to determine the risk or likelihood of an event occurring. The IPCC provides the largest international scientific assessment of climate change and often adopts a consensus model where viewpoint reached by the majority of scientists is used to establish knowledge amongst an interdisciplinary community of scientists and then communicate it to the public (Hulme 88). According to the IPCC, this consensus is reached amongst more than more than 450 lead authors, more than 800 contributing authors, and 2500 scientific reviewers. While it is an advisory body and is not policy-prescriptive, the IPCC adopts particular linguistic conventions to indicate the probability of a statement being correct. Stephen Schneider convinced the IPCC to use this approach to systemise uncertainty (Lemonick). So for instance, in the IPCC reports, the term “likely” denotes a chance of 66%-90% of the statement being correct, while “very likely” denotes more than a 90% chance. Note the change from the Third Assessment Report (2001), indicating that “most of the observed warming in over the last fifty years is likely to have been due to the increase in greenhouse gas emissions” to the Fourth Assessment (February 2007) which more strongly states: “Most of the observed increase in global average temperatures since the mid twentieth century is very likely due to the observed increase in anthropogenic greenhouse gas concentrations” (Hulme 51, my italics). A fiery attack on Tim Flannery by Andrew Bolt on Steve Price’s talkback radio show in June 2010 illustrates just how misunderstood scientific uncertainty is in the broader community. When Price introduces Flannery as former Australian of the Year, Bolt intercedes, claiming Flannery is “Alarmist of the Year”, then goes on to chastise Flannery for making various forecasts which didn’t eventuate, such as that Perth and Brisbane might run out of water by 2009. “How much are you to blame for the swing in sentiment, the retreat from global warming policy and rise of scepticism?” demands Bolt. In the context of the events of late 2009 and early 2010, the fact that these events didn’t materialise made Flannery, and others, seem unreliable. And what Bolt had to say on talkback radio, I suspect, resonated with a good proportion of its audience. What Bolt was trying to do was discredit Flannery’s scientific credentials and in the process erode trust in the expert. Flannery’s response was to claim that, what he said was that these events might eventuate. In much the same way that the climate sceptics have managed to co-opt scepticism and use it as a rationale for inaction on climate change, Andrew Bolt here either misunderstands basic scientific method or quite consciously misleads and manipulates the public. As Naomi Oreskes argues, “proof does not play the role in science that most people think it does (or should), and therefore it cannot play the role in policy that skeptics demand it should” (Oreskes 370). Doubt and ‘Situated’ Hope Uncertainty and ambiguity then emerge here as resources because they force us to confront those things we really want–not safety in some distant, contested future but justice and self-understanding now. (Sheila Jasanoff, cited in Hulme, back cover) In his last published book before his death in mid-2010, Science as a contact sport, Stephen Schneider’s advice to aspiring science communicators is that they should engage with the media “not at all, or a lot”. Climate scientist Ann Henderson-Sellers adds that there are very few scientists “who have the natural ability, and learn or cultivate the talents, of effective communication with and through the media” (430). In order to attract the public’s attention, it was once commonplace for scientists to write editorials and exploit fear-provoking measures by including a “useful catastrophe or two” (Moser and Dilling 37). But are these tactics effective? Susanne Moser thinks not. She argues that “numerous studies show that … fear may change attitudes … but not necessarily increase active engagement or behaviour change” (Moser 70). Furthermore, risk psychologists argue that danger is always context specific (Hulme 196). If the risk or danger is “situated” and “tangible” (such as lead toxicity levels in children in Mt Isa from the Xstrata mine) then the public will engage with it. However if it is “un-situated” (distant, intangible and diffuse) like climate change, the audience is less likely to. In my SCOM201 class we examined the impact of two climate change-related campaigns. The first one was a short film used to promote the 2010 Copenhagen Climate Change Summit (“Scary”) and the second was the State Government of Victoria’s “You have the power: Save Energy” public awareness campaign (“You”). Using Moser’s article to guide them, students evaluated each campaign’s effectiveness. Their conclusions were that the “You have the power” campaign had far more impact because it a) had very clear objectives (to cut domestic power consumption) b) provided a very clear visualisation of carbon dioxide through the metaphor of black balloons wafting up into the atmosphere, c) gave viewers a sense of empowerment and hope through describing simple measures to cut power consumption and, d) used simple but effective metaphors to convey a world progressed beyond human control, such as household appliances robotically operating themselves in the absence of humans. Despite its high production values, in comparison, the Copenhagen Summit promotion was more than ineffective and bordered on propaganda. It actually turned viewers off with its whining, righteous appeal of, “please help the world”. Its message and objectives were ambiguous, it conveyed environmental catastrophe through hackneyed images, exploited children through a narrative based on fear and gave no real sense of hope or empowerment. In contrast the Victorian Government’s campaign focused on just one aspect of climate change that was made both tangible and situated. Doubt and uncertainty are productive tools in the pursuit of knowledge. Whether it is scientific or otherwise, uncertainty will always be the motivation that “feeds the frenzy for new knowledge” (Jasanoff 33). Articulating the importance of Hulme’s book, Sheila Jasanoff indicates we should make doubt our friend, “Without downplaying its seriousness, Hulme demotes climate change from ultimate threat to constant companion, whose murmurs unlock in us the instinct for justice and equality” (Hulme back cover). The “murmurs” that Jasanoff gestures to here, I think, can also be articulated as hope. And it is in this discussion of climate change that doubt and hope sit side-by-side as bedfellows, mutually entangled. Since the “failed” Copenhagen Summit, there has been a distinct shift in climate change discourse from “experts”. We have moved away from doom and gloom discourses and into the realm of what I shall call “situated” hope. “Situated” hope is not based on blind faith alone, but rather hope grounded in evidence, informed judgements and experience. For instance, in distinct contrast to his cautionary tale The Weather Makers: The History & Future Impact of Climate Change, Tim Flannery’s latest book, Here on Earth is a biography of our Earth; a planet that throughout its history has oscillated between Gaian and Medean impulses. However Flannery’s wonder about the natural world and our potential to mitigate the impacts of climate change is not founded on empty rhetoric but rather tempered by evidence; he presents a series of case studies where humanity has managed to come together for a global good. Whether it’s the 1987 Montreal ban on CFCs (chlorinated fluorocarbons) or the lesser-known 2001 Stockholm Convention on POP (Persistent Organic Pollutants), what Flannery envisions is an emerging global civilisation, a giant, intelligent super-organism glued together through social bonds. He says: If that is ever achieved, the greatest transformation in the history of our planet would have occurred, for Earth would then be able to act as if it were as Francis Bacon put it all those centuries ago, ‘one entire, perfect living creature’. (Here on Earth, 279) While science might give us “our most reliable understanding of the natural world” (Oreskes 370), “situated” hope is the only productive and ethical currency we have. Abstract:
I was born illegitimate. Born on an existential precipice. My unwed mother was 36 years old when she relinquished me. I was the fourth baby she was required to give away. After I emerged blood stained and blue tinged – abject, liminal – not only did the nurses refuse me my mother’s touch, I also lost the sound of her voice. Her smell. Her heart beat. Her taste. Her gaze. The silence was multi-sensory. When they told her I was dead, I also lost, within her memory and imagination, my life. I was adopted soon after but not told for over four decades. It was too shameful for even me to know. Imprinted at birth with a psychological ‘death’, I fell, as a Late Discovery Adoptee (LDA), into a socio-cultural and psychological abyss, frozen at birth at the bottom of a parturitive void from where, invisible within family, society, and self I was unable to form an undamaged sense of being.Throughout the 20th century (and for centuries before) this kind of ‘social abortion’ was the dominant script. An adoptee was regarded as a bastard, born of sin, the mother blamed, the father exonerated, and silence demanded (Lynch 28-74). My adoptive mother also sinned. She was infertile. But, in taking me on, she assumed the role of a womb worthy woman, good wife, and, in her case, reluctant mother (she secretly didn’t want children and was privately overwhelmed by the task). In this way, my mother, my adoptive mother, and myself are all the daughters of bereavement, all of us sacrificed on the altar of prejudice and fear that infertility, sex outside of marriage, and illegitimacy were unspeakable crimes for which a price must be paid and against which redemptive protection must be arranged. If, as Thomas Keneally (5) writes, “original sin is the mother fluid of history” then perhaps all three of us all lie in its abject waters. Grotevant, Dunbar, Kohler and Lash Esau (379) point out that adoption was used to ‘shield’ children from their illegitimacy, women from their ‘sexual indiscretions’, and adoptive parents from their infertility in the belief that “severing ties with birth family members would promote attachment between adopted children and parents”. For the adoptee in the closed record system, the socio/political/economic vortex that orchestrated their illegitimacy is born out of a deeply, self incriminating primal fear that reaches right back into the recesses of survival – the act of procreation is infested with easily transgressed life and death taboos within the ‘troop’ that require silence and the burial of many bodies (see Amanda Gardiner’s “Sex, Death and Desperation: Infanticide, Neonaticide, and Concealment of Birth in Colonial Western Australia” for a palpable, moving, and comprehensive exposition on the links between 'illegitimacy', the unmarried mother and child murder). As Nancy Verrier (24) states in Coming Home to Self, “what has to be understood is that separation trauma is an insidious experience, because, as a society, we fail to see this experience as a trauma”. Indeed, relinquishment/adoption for the baby and subsequent adult can be acutely and chronically painful. While I was never told the truth of my origins, of course, my body knew. It had been there. Sentient, aware, sane, sensually, organically articulate, it messaged me (and anyone who may have been interested) over the decades via the language of trauma, its lexicon and grammar cellular, hormonal, muscular (Howard & Crandall, 1-17; Pert, 72), the truth of my birth, of who I was an “unthought known” (Bollas 4). I have lived out my secret fatality in a miasmic nebula of what I know now to be the sequelae of adoption psychopathology: nausea, physical and psychological pain, agoraphobia, panic attacks, shame, internalised anger, depression, self-harm, genetic bewilderment, and generalised anxiety (Brodzinsky 25-47; Brodzinsky, Smith, & Brodzinsky 74; Kenny, Higgins, Soloff, & Sweid xiv; Levy-Shiff 97-98; Lifton 210-212; Verrier The Primal Wound 42-44; Wierzbicki 447-451) – including an all pervading sense of unreality experienced as dissociation (the experience of depersonalisation – where the self feels unreal – and derealisation – where the world feels unreal), disembodiment, and existential elision – all characteristics of Post Traumatic Stress Disorder (PTSD). In these ways, my body intervened, acted out, groaned in answer to the social overlay, and from beyond “the dermal veil” tried to procure access, as Vicky Kirby (77) writes, to “the body’s opaque ocean depths” through its illnesses, its eloquent, and incessantly aching and silent verbosities deepened and made impossibly fraught because I was not told. The aim of this paper is to discuss one aspect of how my body tried to channel the trauma of my secret fatality and liminality: my pre-disclosure art work (the cellular memory of my trauma also expressed itself, pre-disclosure, through my writings – poetry, journal entries – and also through post-coital glossolalia, all discussed at length in my Honours research “Womb Tongues” and my Doctoral Dissertation “The Womb Artist – A Novel: Translating Pre-verbal Late Discovery Adoption Trauma into Narrative”). From the age of thirty onwards I spent twelve years in therapy where the cause of my childhood and adult psychopathology remained a mystery. During this time, my embodied grief and memories found their way into my art work, a series of 5’ x 3’ acrylic paintings, some of which I offer now for discussion (figures 1-4). These paintings map and express what my body knew but could not verbalise (without language to express my grief, my body found other ways to vent). They are symptom and sign of my pre-verbal adoption trauma, evidence that my body ‘knew’ and laboured ceaselessly and silently to find creative ways to express the incarcerated trauma. Post disclosure, I have used my paintings as artefacts to inform, underpin, and nourish the writing of a collection of poetry “Womb Tongues” and a literary novel/memoir “The Womb Artist” (TWA) in an ongoing autoethnographical, performative, and critical inquiry. My practice-led research as a now conscious and creative witness, fashions the recontextualisation of my ‘self’ into my ‘self’ and society, this time with cognisant and reparative knowledge and facilitates the translation of my body’s psychopathology and memory (explicit and implicit) into a healing testimony that explores the traumatised body as text and politicizes the issues surrounding LDAs (Riley 205). If I use these paintings as a memoirist, I use them second hand, after the fact, after they have served their initial purpose, as the tangible art works of a baby buried beneath a culture’s prejudice, shame, and judgement and the personal cries from the illegitimate body/self. I use them now to explore and explain my subclinical and subterranean life as a LDA.My pre-disclosure paintings (Figures 1-4) – filled with vaginal, fetal, uterine, and umbilical references – provide some kind of ‘evidence’ that my body knew what had happened to me as if, with the tenacity of a poltergeist, my ‘spectral self’ found ways to communicate. Not simply clues, but the body’s translation of the intra-psychic landscape, a pictorial and artistic séance into the world, as if my amygdala – as quasar and signal, homing device and history lesson (a measure, container, and memoir) – knew how to paint a snap shot or an x-ray of the psyche, of my cellular marrow memories (a term formulated from fellow LDA Sandy McCutcheon’s (76) memoir, The Magician’s Son when he says, “What I really wanted was the history of my marrow”). If, as Salveet Talwar suggests, “trauma is processed from the body up”, then for the LDA pre-discovery, non-verbal somatic signage is one’s ‘mother tongue’(25). Talwar writes, “non-verbal expressive therapies such as art, dance, music, poetry and drama all activate the sub-cortical regions of the brain and access pre-verbal memories” (26). In these paintings, eerily divinatory and pointed traumatic, memories are made visible and access, as Gussie Klorer (213) explains in regard to brain function and art therapy, the limbic (emotional) system and the prefrontal cortex in sensorimotor integration. In this way, as Marie Angel and Anna Gibbs (168) suggest, “the visual image may serve as a kind of transitional mode in thought”. Ruth Skilbeck in her paper First Things: Reflections on Single-lens Reflex Digital Photography with a Wide-angled Lens, also discusses (with reference to her photographic record and artistic expression of her mother’s death) what she calls the “dark matter” – what has been overlooked, “left out”, and/or is inexplicable (55) – and the idea of art work as the “transitional object” as “a means that some artists use, conceptually and yet also viscerally, in response to the extreme ‘separation anxiety’ of losing a loved one, to the void of the Unknown” (57). In my case, non-disclosure prevented my literacy and the evolution of the image into language, prevented me from fully understanding the coded messages left for me in my art work. However, each of my paintings is now, with the benefit of full disclosure, a powerful, penetrating, and comprehensible intra and extra sensory cry from the body in kinaesthetic translation (Lusebrink, 125; Klorer, 217). In Figure 1, ‘Embrace’, the reference to the umbilical is palpable, described in my novel “The Womb Artist” (184) this way; “two ropes tightly entwine as one, like a dark and dirty umbilical cord snaking its way across a nether world of smudged umbers”. There is an ‘abject’ void surrounding it. The cord sapped of its colour, its blood, nutrients – the baby starved of oxygen, breath; the LDA starved of words and conscious understanding. It has two parts entwined that may be seen in many ways (without wanting to reduce these to static binaries): mother/baby; conscious/unconscious; first person/third person; child/adult; semiotic/symbolic – numerous dualities could be spun from this embrace – but in terms of my novel and of the adoptive experience, it reeks of need, life and death, a text choking on the poetic while at the same time nourished by it; a text made ‘available’ to the reader while at the same narrowing, limiting, and obscuring the indefinable nature of pre-verbal trauma. Acrylic on canvas.The painting ‘Womb Tongues’ (Figure 2) is perhaps the last (and, obviously, lasting) memory of the infinite inchoate universe within the womb, the umbilical this time wrapped around in a phallic/clitorial embrace as the baby-self emerges into the constrictions of a Foucauldian world, where the adoptive script smothers the ‘body’ encased beneath the ‘coils’ of Judeo-Christian prejudice and centuries old taboo. In this way, the reassigned adoptee is an acute example of power (authority) controlling and defining the self and what knowledge of the self may be allowed. The baby in this painting is now a suffocated clitoris, a bound subject, a phallic representation, a gagged ‘tongue’ in the shape of the personally absent (but socially imposing) omni-present and punitive patriarchy. Acrylic on canvas.‘Germination’ (Figure 3) depicts an umbilical again, but this time as emerging from a seething underworld and is present in TWA (174) this way, “a colony of night crawlers that writhe and slither on the canvas, moving as one, dozens of them as thin as a finger, as long as a dream”. The rhizomic nature of this painting (and Figure 4), becomes a heaving horde of psychosomatic and psychopathological influences and experiences, a multitude of closely packed, intense, and dendridic compulsions and symptoms, a mass of interconnected (and by nature of the silence and lie) subterranean knowledges that force the germination of a ‘ghost baby/child/adult’ indicated by the pale and ashen seedling that emerges above ground. The umbilical is ghosted, pale and devoid of life. It is in the air now, reaching up, as if in germination to a psychological photosynthesis. There is the knot and swarm within the unconscious; something has, in true alien fashion, been incubated and is now emerging. In some ways, these paintings are hardly cryptic.Figure 3. Germination.1993. Acrylic on canvas.In Figure 4 ‘The Birthing Tree’, the overt symbolism reaches ‘clairvoyant status’. This could be read as the family ‘tree’ with its four faces screaming out of the ‘branches’. Do these represent the four babies relinquished by our mother (the larger of these ‘beings’ as myself, giving birth to the illegitimate, silenced, and abject self)? Are we all depicted in anguish and as wraithlike, grotesquely simplified into pure affect? This illegitimate self is painted as gestating a ‘blue’ baby, near full-term in a meld of tree and ‘self’, a blue umbilical cord, again, devoid of blood, ghosted, lifeless and yet still living, once again suffocated by the representation of the umbilical in the ‘bowels’ of the self, the abject part of the body, where refuse is stored and eliminated: The duodenum of the damned. The Devil may be seen as Christopher Bollas’s “shadow of the object”, or the Jungian archetypal shadow, not simply a Judeo-Christian fear-based spectre and curmudgeon, but a site of unprocessed and, therefore, feared psychological material, material that must be brought to consciousness and integrated. Perhaps the Devil also is the antithesis to ‘God’ as mother. The hell of ‘not mother’, no mother, not the right mother, the reluctant adoptive mother – the Devil as icon for the rich underbelly of the psyche and apophatic to the adopted/artificial/socially scripted self.Figure 4. The Birthing Tree. 1995. Acrylic on canvas.These paintings ache with the trauma of my relinquishment and LDA experience. They ache with my body’s truth, where the cellular and psychological, flesh and blood and feeling, leak from my wounds in unspeakable confluence (the two genital lips as the site of relinquishment, my speaking lips that have been sealed through non-disclosure and shame, the psychological trauma as Verrier’s ‘primal wound’) just as I leaked from my mother (and society) at birth, as blood and muck, and ooze and pus and death (Grosz 195) only to be quickly and silently mopped up and cleansed through adoption and life-long secrecy. Where I, as translator, fluent in both silence and signs, disclose the baby’s trauma, asking for legitimacy. My experience as a LDA sets up an interesting experiment, one that allows an examination of the pre-verbal/pre-disclosure body as a fleshed and breathing Rosetta Stone, as an interface between the language of the body and of the verbalised, painted, and written text. As a constructed body, written upon and invented legally, socially, and psychologically, I am, in Hélène Cixous’s (“To Live the Orange” 83) words, “un-forgetting”, “un-silencing” and “unearthing” my ‘self’ – I am re-writing, re-inventing and, under public scrutiny, legitimising my ‘self’. I am a site of inquiry, discovery, extrapolation, and becoming (Metta 492; Poulus 475) and, as Grosz (vii) suggests, a body with “all the explanatory power” of the mind. I am, as I embroider myself and my LDA experience into literary and critical texts, authoring myself into existence, referencing with particular relevance Peter Carnochan’s (361) suggestion that “analysis...acts as midwife to the birth of being”. I am, as I swim forever amorphous, invisible, and unspoken in my mother’s womb, fashioning a shore, landscaping my mind against the constant wet, my chronic liminality (Rambo 629) providing social landfall for other LDAs and silenced minorities. As Catherine Lynch (3) writes regarding LDAs, “Through the creation of text and theory I can formulate an intimate space for a family of adoptive subjects I might never know via our participation in a new discourse in Australian academia.” I participate through my creative, self-reflexive, process fuelled (Durey 22), practice-led enquiry. I use the intimacy (and also universality and multiplicity) and illegitimacy of my body as an alterative text, as a site of academic and creative augmentation in the understanding of LDA issues. The relinquished and silenced baby and LDA adult needs a voice, a ‘body’, and a ‘tender’ place in the consciousness of society, as Helen Riley (“Confronting the Conspiracy of Silence” 11) suggests, “voice, validation, and vindication”. Judith Herman (3) argues that, “Survivors challenge us to reconnect fragments, to reconstruct history, to make meaning of their present symptoms in the light of past events”. I seek to use the example of my experience – as Judith Durey (31) suggests, in “support of evocative, creative modes of representation as valid forms of research in their own right” – to unfurl the whole, to give impetus and precedence for other researchers into adoption and advocate for future babies who may be bought, sold, arranged, and/or created by various means. The recent controversy over Gammy, the baby boy born with Down Syndrome in Thailand, highlights the urgent and moral need for legislation with regard to surrogacy (see Kajsa Ekis Ekman’s Being and Being Bought: Prostitution, Surrogacy and the Split Self for a comprehensive examination of surrogacy issues). Indeed, Catherine Lynch in her paper Doubting Adoption Legislation links the experiences of LDAs and the children of born of surrogacy, most effectively arguing that, “if the fate that closed record adoptees suffered was a misplaced solution to the question of what to do with children already conceived how can you justify the deliberate conception of a child with the intention even before its creation of cruelly removing that child from their mother?” (6). Cixous (xxii) confesses, “All I want is to illustrate, depict fragments, events of human life and death...each unique and yet at the same time exchangeable. Not the law, the exception”. I, too, am a fragment, an illustration (a painting), and, as every individual always is – paradoxically – a communal and, therefore, deeply recognisable and generally applicable minority and exception. In my illegitimacy, I am some kind of evidence. Evidence of cellular memory. Evidence of embodiment. Evidence that silenced illegitimacies will manifest in symptom and non-verbal narratives, that they will ooze out and await translation, verification, and witness. This paper is offered with reverence and with feminist intention, as a revenant mouthpiece for other LDAs, babies born of surrogacy, and donor assisted offspring (and, indeed, any) who are marginalised, silenced, and obscured. It is also intended to promote discussion in the psychological and psychoanalytic fields and, as Helen Riley (202-207) advocates regarding late discovery offspring, more research within the social sciences and the bio-medical field that may encourage legislators to better understand what the ‘best interests of the child’ are in terms of late discovery of origins and the complexity of adoption/conception practices available today. As I write now (and always) the umbilical from my paintings curve and writhe across my soul, twist and morph into the swollen and throbbing organ of tongues, my throat aching to utter, my hands ready to craft latent affect into language in translation of, and in obedience to, my body’s knowledges. It is the art of mute witness that reverses genesis, that keeps the umbilical fat and supple and full of blood, and allows my conscious conception and creation. Indeed, in the intersection of my theoretical, creative, psychological, and somatic praxis, the heat (read hot and messy, insightful and insistent signage) of my body’s knowledges perhaps intensifies – with a ripe bouquet – the inevitably ongoing odour/aroma of the reproductive world. Abstract:
Over the past quarter-century 'the self' has been transformed from a relatively esoteric concept of principal interest to philosophers and psychologists to a mainstay of popular culture and critical reflection. This paper addresses some of the themes linking this transition and suggests that the driving impetus behind it is the commodification of ideas as a strategy of coping with change (as well as the packaging and consumption of goods and services which bridge the gap between the less-than-perfect present and the shining future just around the corner). I start with a vivid recollection of some weeks in my undergraduate years worrying about the issue 'Is self-deception possible?' The problem to be solved for a tutorial presentation was, 'If the self is deceived by the self, which part of the self is doing the deceiving?' This conundrum could be handily addressed by reference to the various models of the divided self: the mind/brain model; or the conscious/subconscious model; the id/ego/superego model; the Parent/Adult/Child model (for all those Transactional Analysis aficionados) and, had I been dealing with the same query today, the Adult/Inner Child model. In addition to these theoretical constructions, there was evidence from physiological psychology of the 'split brain' phenomenon, where some unfortunate patients had had the crossover pathways between the two hemispheres of the brain surgically cut, usually as a strategy for dealing with epilepsy. Here it seemed to be literally possible for the right hand to not know what the left hand was doing (but only under strict laboratory conditions where certain information was only available to one hand or the other, or one eye or the other). Essentially, psychological theory had gone to considerable trouble to identify the self as a potential battleground for warring elements: internal 'others' with which the self is composed; in addition to the external influences impacting upon the self. All of these approaches offered a metaphor for conflict, which tied in with the subjective impression of 'the self' wanting things a number of ways; in particular wanting to have the cake, wanting to have a different cake and also wanting to eat all possible varieties of cake. The trouble was, this approach didn't really answer the question 'Is self-deception possible?' because I knew when I felt conflicted, and thus was not deceived. To be truly deceived, I rationalised, I wouldn't ever be aware that self-deception had been in operation. In which case, had it ever really happened? Where internal warring was evident, the idea of 'deception' failed to convince me, and was replaced instead by one of opposing impulses. Thus I decided that self-deception is impossible, and that instead we use it as a more-or-less conscious excuse for behaviour that is out of character. (My tutor was concerned that I had elided the concepts of 'I' and 'myself', in this presentation, but that is another story.) Two decades later, in the mid-nineties, I suddenly woke up to the fact that popular psychology had spawned a library of self-help literature of Alexandrian proportions. In fact, the volume of books, articles, magazines and related TV/radio shows (such as Oprah) -- not to mention the mega-millionaire motivationalists such as Wayne Dyer and Tony Robbins, whose website promises 'resources for creating an extraordinary quality of life' and whose influence is now evident in other areas of popular culture (eg, Farrelly and Farrelly's embarrassingly awful Shallow Hal). Robbins' claim: 'Within you is a powerful driving force that, once unleashed, can make your boldest visions, dreams, and desires real. You are about to discover the finest resources and tools available for awakening that force within you -- and transforming your life, instantly and forever', somewhat overstates my own experience of trying to put his theories into practice, but I've only bought the books and thus may be deceiving myself that I've truly committed what it takes to achieve transformation... (For those of you lacking 'disposable time' -- too busy to read the books -- the principles are often available on easy-to-consume cassette-tapes, videos, CDs and interactive websites.) A visit to any popular bookshop (although these sections are generally lacking in the academic ones) indicates that self-help is right up there with business/motivational books, and with new age/spiritual guidance. The popular culture of business practice might arguablely have started with Blanchard and Johnson's The One Minute Manager, but it is increasingly evident in such global best sellers as Covey's The 7 Habits of Highly EffectivePeople, Gardner and Gardner's The Motley Fool Investment Guide and Kiyosaki's Rich Dad, Poor Dad (and associated spin-offs). This interest in business, however, is more than an interest in practice and process: it's an interest in versions of the self. Thus the Motley Fool reader is advised to 'go against' their instincts, because that way they do something different from the average. Rich Dad, Poor Dad is a fable of different ways to view life, success and happiness (one of which is presented as more likely to result in a humungous bank balance). If it only takes a minute to be a manager -- why wouldn't you spend that minute? And all of us would like to be more effective in some area of our lives… The business books that make it into the best seller lists offer help to transform the self into someone … rather more suited to the times than we were before we started to read that particular guru's take on the future perfect. The impetus for the growth in the popular culture of the evolving self seems to me to be (at least partly) explained by our sense of accelerating change. The constant in both the business and the self-help literature is a valuing of the capacity of managing and adapting to change. It is no accident that there has been this burgeoning of self-development material at the same time that we are encouraged: to prepare ourselves for new careers every seven years; to reclassify ourselves as lifelong learners; to assess ourselves as a collection of 'skills', 'attributes' and 'competencies', able to apply to others for 'recognition of prior learning'; and, to accept a governmental diktat that we are all in the business of 'mutual obligation'. Under these circumstances, and in this environment, a willing engagement with the self-help literature indicates a positive desire to manage the transition of the self to some acceptance of a changed future. It implies the resolution of the five stages of grief (Kubler-Ross). Having worked through denial and isolation; anger; bargaining; and depression the active self-developer reaches 'acceptance' and manages the stress of change by helping the self adjust to an anticipated future. Even the sense of having a strategy to cope with new demands can be part of a solution to perceived powerlessness: helpless leads to hopeless (and depressed). Self-help is a strategy to cope with change and move on. The pressures may be new, and the books may be growing in number and in applicability, but the marketing principles fuelling this consumer demand are well established. For example, an Australianised Consumer Behaviour textbook identifies (Schiffman et al, 137) 'four specific kinds of self-image: Actual self-image (ie how consumers in fact see themselves) Ideal self-image (ie how consumers would like to see themselves) Social self-image (ie how consumers feel others see them) Ideal social self-image (ie how consumers would like others to see them) before going on to add, "a fifth type of self-image, expected self-image (ie how consumers expect to see themselves at some specified future time)" (137, bold in original). Marketers use the gap between the perceived self-image and the ideal self-image as an opportunity for product development, and for creating strategies to promote existing goods and services. In essence, consumer societies continuously package and represent images of our future selves as ways of selling us products that help us become more beautiful, clever and effective. They might also 'reverse the visible signs of aging'. (The realage.com website is a wonderful place where an older self becomes younger as the days pass and the life-extending strategies are adopted, minimising an individual's 'real' -- as opposed to chronological -- age.) Although Schiffman et al (137) argue that the expected self-image is somewhere between the actual self-image and the ideal self-image, most well-founded (credible) expectations of the future-self involve a planned programme of change -- such as enrolment in a course of study or diligent application to the contents and suggestions of an appropriate self-help book… Thus the expected self-image might differ qualitatively from the ideal self-image in that the former may have some basis in an achievable future while the latter might be impossibly unlikely. An individual's social identity and their consumption practices are already well linked. For example, Hearn, Mandeville and Anthony (104) estimate that 'consumption now accounts for about 60 per cent of GDP … mass communication, advertising and the consumer economy form a nexus that is centrally implicated in the operation of Western societies.' They go on to argue that the 'central assertion of postmodern views of consumption is that social identity can be interpreted as a function of consumption' (106). Green suggests that it is 'the voluntary nature of consumption -- together with the impossibility of not consuming -- [that] prevents [consumption] from being categorised unambiguously as work'. The implication is that the self-help literature represents a complex communication. Purchase of a self-help book identifies one version of an ideal self-image for that person, and also allies them with those aspects of popular culture including and touching upon that book and that self-help philosophy. (Even more is communicated if the book is purchased for someone else, or received as a gift from someone else!) The presence of the book on a person's shelves can also indicate a strategy to manipulate perceptions of the individual's social self-image and might express to others an element of the individual's ideal social self-image (moderated, perhaps, by throw-away statements such as: 'Of course, theory is one thing, practice another', or 'I think Carmen may have been dropping a heavy hint with this present'). At the same time, the individual may have a clear impression of the expected self-image likely to result from consumption of the book's contents, and thus the act of consumption is likely to represent the adoption of a particularly individual vision for the future self. The popularity of the self-help genre and its generalisation into lifestyle programmes and publications -- the Martha Stewart effect -- is an indication that the 'present self' is generally categorised as a work in progress. Paradoxically, the self may be most evident and fixed in the act of becoming, since the self in the present undergoes continual change (apart from its constant requirement for 'help'). Over the coming hours, then months, the author discovers just how far the stranger will go to complete the terms of this bizarre and brutal new contract. This accompanying exegesis examines a series of 'paratexts' (a logline, a one-pager and a treatment) that the screenplay has given rise to. The thesis argues that the role of the screenwriter does not end with the production of the core text--the screenplay. Instead, in order to support the development and/or the marketing of the script into a feature film, the screenwriter is an ongoing generator of supplemental documents or paratexts. The paper explores the status and function of paratexts (loglines, onepagers, treatments and explanatory development notes). It further argues that developmental paratexts are a necessary evil, providing a sifting or culling mechanism for producers and production executives, and that they are intended to guide a project toward being 'greenlit' but will more often have, at best, benign or, at worst, negative or destructive effects on its development. In this way, developmental paratexts, although ubiquitous and pro forma, are inherently problematic.

That five of the commentaries are positive in their evaluation of Neighbours, two neutral, and only one negative suggests the broad potential acceptability of the program to the US market (only one publication, the Wall Street Journal, has the kind of highbrow readership which might encourage its television critics to sneer at popular material such as soaps). The two textual features of Neighbours which do draw comment – the everyday, and the domestic and suburban – point to a crucial first feature of the US “mediascape,” in particular its “soapscape,” namely the preference for the exceptional, the non-domestic, the non-suburban. In US soaps, it is well known, the pole of melodrama exercises greater attraction than the pole of realism (cf. Geraghty 1991: 25–38) – in contrast to Australian and British soaps. These two textual aspects of Neighbours are a central theme of the US commentaries, combining under the rubric of the non-exceptional, the “realistic.” All the commentaries bar the sole negative one (Kitman 1991: 23) refer positively to Neighbours’ “realism,” often in contradistinction to the perceived artificiality of US soaps. Peter Pinne, the program’s executive producer, is twice quoted to just this effect (Goodspeed 1991: 22; Mann 1991: 28), while USA Today (Roush 1991: 15) applauds “how close the residents of Ramsey Street seem to our own suburban counterparts,” and notes that “its casual gossip and unexceptional lifestyle [are] closer to the early days of Knots Landing than to any current soap.” The redoubtable Wall Street Journal does not sneer, but praises a television version of middle- and lower-class life that is at ease with itself and singularly lacking in . . . the self-consciousness and discomfort that attends American television’s efforts to portray uneducated white working-class types . . . . [Its] characters . . . ought to be more recognisable to Americans than the peculiar beings that inhabit the worlds of our home-grown TV dramas . . . . [They] actually converse with one another in the way that people do – without declaiming or the rat-a-tat of one-liners, or recitals of a position on the latest hot social theme. If the beat of their daily lives is unhysterical – quiet, in fact – it is also eventful. (Rabinowitz 1991: 17) The Wall Street Journal takes a refreshing distance from the infamous “Greed is good” dictum voiced in Oliver Stone’s film, Wall Street! Given Neighbours’s atypicality in the realm of US soaps, its American reference points are either Knots Landing – which one British journalist described as “the nearest the Americans can bear to get to a soap about ordinary people” (Kingsley 1989: 226) – or US sitcoms (Kelleher 1991: 36; Rabinowitz 1991: 17). Buyer and seller agreed that its non-exceptional “realism” was one reason for Neighbours’s failure in the US “soapscape.” KCOP described it as “less raunchy than US soap operas, too wholesome” (Moran 1992). "operations following the 1986 deregulation of the French television market. Since the buyers declined to comment, it might be fair to let the selling agent have the last word: “Viewers have been bluffed by vandals . . . . They were not passionate enough” (Cousin 1992). It’s inescapable. Every channel needs to create a regular and loyal audience without spending too much on doing so. There aren’t a thousand different solutions. I’ll bet you that in ten years every channel will run one or two soaps. The question is: will they be French or bought in from other countries? (Cousin, quoted by Pélégrin 1989: 37) Conclusions The major conclusion will already be clear, namely that importing countries’ cultural and televisual norms, especially the contours of their “soapscapes,” constitute the crucial determinant of the success or otherwise of an imported soap. Massive success is predicated, as for Neighbours in Britain, upon the recognizability/acceptability of the textual features described above; upon such favorable – and sometimes fortuitous – cultural and institutional features as Kylie Minogue’s singing career and the expansion of British tabloids; and upon the acceptability of difference across such axes as weather, accent, and home-ownership. Culturally and televisually, Britain is far closer to Australia than are the other two territories. In the USA and France, given the time taken to build a soap audience, Neighbours barely achieved the threshold of visibility which would have enabled its potentially attractive textual features to come into play with viewers. In both countries, executive decisions to cut the program arose from the challenging, deregulationary ethos of the late 1980s. A second conclusion concerns the conceptualization of audiences. In writing of audiences as defined by various nation states I have, of necessity, homogenized hugely diverse audience responses. As I have argued elsewhere, to hypostatize the national is to deny both the subnational and the supranational (Crofts 1993). What is entailed in this essay, on this topic, is the necessity to work at a certain level of abstraction. There is no contradiction between such work and that of Marie Gillespie in this collection (Chapter 18). Methodologically, journalistic commentary and interviews with buyers and sellers are as appropriate to the former as are surveys of, participant and non-participant observation of, and interviews with viewers to Gillespie’s ethnographic research into the social use-value of Neighbours for Punjabi youth in the outer London suburb of Southall.
