Le symbole du paradis que l’on voit sur la carte géographique du monde «Kunstmann II» (1502–1506) offre à l’historien un point de départ remarquable pour l’exploration des idées européennes sur un paradis terrestre en Afrique et des perceptions européennes de l’Afrique aux environs de 1500. Une analyse attentive de l’iconographie de cette carte met en lumière son contexte et ses objectifs. Les armoiries présentes sur le grand arbre du paradis appartiennent au cardinal espagnol Bernardino López de Carvajal (1456–1523), ambassadeur de l’Espagne auprès du pape. Carvajal, qui a joué un rôle important dans le cadre du traité de Tordesillas, était un partisan convaincu d’une nouvelle croisade contre l’Islam en Afrique et au Moyen Orient qui visait la reconquête de Jérusalem et l’expansion de la foi chrétienne dans le monde.

El cardenal Carvajal reunió en su residencia de Roma una colección arqueológica como signo del prestigio y poder que había alcanzado en su faceta político- eclesiástica, pero también en su perfil de humanista y mecenas. A través de dos fuentes anticuarias de la época, la llamada Nota d’anticaglie (1499-1501) y los códices de Pietro Sabino (c. 1490-1495), se propone una reconstrucción de la colección arqueológica de Carvajal, incluyendo la identificación de las inscripciones mediante el número de CIL, y se plantean algunas hipótesis sobre su posible participación en las excavaciones de Villa Adriana. Igualmente, se aborda la discusión en torno a la presencia en las fuentes anticuarias de un sarcófago romano perteneciente a un orator Hispaniarum, lo que confirma no solo la tendencia entre las elites hacia el incipiente coleccionismo, sino también la importancia de las antigüedades como medio de autorrepresentación para los cardenales y embajadores españoles afincados en Roma.

Este artículo plantea la veracidad de una serie de noticias relativas a supuestos oficios cortesanos para pintores en la corte de Madrid, oficios sobre los que no existe ninguna referencia clara en la documentación perteneciente a la administración palaciega. No obstante, se conocen otros documentos indirectos que invitan a pensar que tales oficios existieron, al menos, como títulos honoríficos. En cualquier caso, consta que se llegaron a emplear, aunque fuese de forma fraudulenta o abusiva. Estos oficios o títulos honoríficos son los de pintor del Rey, pintor de cámara del Príncipe, pintor de cámara del Infante y un segundo pintor de cámara del Rey. En este trabajo se presentan diversos ejemplos de estos casos relativos a los pintores Francisco Zurbarán, Alonso Cano, Pedro Carvajal, Francisco Ginete, López Polanco, Gómez de la Hermosa, Antonio Rizi, Francisco Rizi e Isidoro Arredondo. En base al análisis de los documentos que dan noticia del empleo de estos títulos, se presenta la hipótesis de que los artistas en cuestión hicieron un uso legítimo de ellos.

Visioni di riforma, or visions of reform, is my Ph.D. research project. Its focus are the religious discussions that took place during the period of the Italian political crises (1495-1535), and, in this context, the relationship between Milanese society and Bernardino López de Carvajal (1456-1523). Carvajal, a native of Plasencia, in Estremadura, became cardinal of Santa Croce in Gerusalemme in 1495. He sojourned in Milan for the first time in 1496-97, as papal legate to the Sforza court. Subsequently, he returned to the Lombard capital for the schismatic council sponsored by the King of France, Luis XII, in 1510-11. Carvajal assumed a leading role in the organization that preceded the council itself. In both 1496-97 and 1510-11 the cardinal established a close relationship with some milanesi; especially with people that were deeply involved with the promotion of the Amadeites and Jesuati congregations. His two stays in Milan offered Carvajal also the opportunity to come into contact with with some local artists: the wood carvers de’ Donati, and the painters Bernardino de’ Conti and Bartolomeo Suardi, called Bramantino. In 1496, Carvajal probably met Bramante, and it is possible that was involved with architect's moving to Rome. As the protector of the Amadeites, the Spanish cardinal commissioned Bramante to work in their Roman church of San Pietro in Montorio on behalf of the king of Spain. My dissertation is structured into four sections. I will start with, an overview of the situation before the schismatic council. The first chapter will be dedicated to the cultural circle centered around Gaspare Ambrogio Visconti, poet and main patron of Bramante in Milan. Documents connect him to the trial for heresy of a Balkan friar that was preaching in Milan during the Lent of 1492. Anti-friars discussions, calls for reform of the Roman court, interest for the ancient languages ​​of the Bible, appeals to translate of sacred texts in vernacular languages to facilitate the understanding of the lay, eschatological anxiety for an imminent end of the world, are all element of this cultural context. As some writings composed just after the death of Visconti reveal, between the discussion's topics was the discovery of the New World and the condition of its inhabitants in relation to the redemption bought by Christ. If Visconti and his circle are mostly known for their relationship with Bramante, and for the famous Uomini d’armi painted in the former's house, it is necessary to connect to this social word 'popular' religious imagines (for exemple of the Antichrist and of the Apocalypse) that were printed in the printing press sponsored by Visconti. Expanding the material discussed in the first section, the second will be aimed at reconstructing sacred spaces (often unfortunately destroyed) built by observant friars, and will focus on the social relationship between Milanese people and mendicant reformed friars. Most of this part is based on a new archival research on Lombard last wills and testaments from the fifteenth and sixteenth centuries. I will then move to the pre-council works and the actual counciliar sessions of the ecclesiastics that met with the support of King Louis XII of France and Emperor Maximilian I to reform the Church. The council originally assembled in Pisa, but was forced to relocate, first to Milan, then to Asti, and finally to Lyons, because of the reaction of Pope Julius II. The main protagonist of the third section of my dissertation will be of course Cardinal Bernardino Lopez de Carvajal. A large part of this chapter will be dedicated to his persona and the role he played during the council Pisa-Milan. His partecipation culminated in his election as Antipope Martin VI, the ideal successor of Martin V, the pope elected by the Council of Constance in 1417. Carvajal felt the need of reforming the church, an eschatological anxiety and was supportive of the reconquest of the Holy Land. All themes were discussed by some of Milanese that participated in meetings at home Visconti, by ex ducal secretaries, and Amadeites supporters. I will therefore discuss how these interest interlaced and overlapped. Carvajal patronage in Milan will be then taken into consideration. He was involved in decoration of the Amadeites and Jesuati churches in Milan and Pavia, and also in the renovation of the monastery of Chiaravalle. In particular Carvajal ordered a depiction of the Last Judgment in San Girolamo in Milan that probably completed by an altarpiece, the Crucifixion of Bramantino now in Brera. The same painter realized a Lamentation over the Dead Christ for the Hierusalem’s chapel in Santa Croce in Rome. Considering these works of art in an overview of Carvajal's patronage reveals the political intent and religious ideas of the cardinal. As a conclusion, I will examine post-counciliar events, and will focus on the second French domination of Milan (1515-21). I will argue that the experience of the council left a deep impression on Lombard society, especially on the Dominicans observant of Santa Maria delle Grazie, the Jesuati, the brotherhood of Santa Corona, and the Augustinian nuns of Santa Marta and San Lazzaro. The reading of the Apocalypsis Nova, probably left in Milan by Carvajal, characterizes this group that titled its meetings to the Divina Sapientia, and the personification of the godly wisdom that was an emblem of the Spanish cardinal. The deep mark left by the prospect of ecclesiastical reform promised in the council is visually revealed in some of work Bernardo Zenale, Bernardino Luini (who was especially connected with this group) and Bramantino. But also the later reuse of blocks for printing the images that decorated the acts of the council is a strong testimony of shared ideals and intent of this part of the Milan society with the councilar’s fathers. A review of the contemporary work of Isidoro Isolani and Matteo Bandello (that were published years later) allows to create a lively environment. The conclusive symbolic event of this period is the Milanese edition (the only Italian edition) of the Iulius exlusus e coelis by Erasmus that traces in the satiric tone of the council events. The leader of the publishing operation is Andrea Calvi, who was soon to be involved in the dissemination of Lutheran texts.
Il progetto di ricerca si incentra sulle discussioni religiose lombarde tra la fine del XV e i primi anni del XVI secolo, in un periodo che corrisponde all’ultima fase del governo sforzesco e alle due dominazioni francesi del ducato di Milano. Ampio spazio è riservato all’analisi delle relazione culturali e delle devozioni personali di aristocratici letterati, editori mercanti, cancellieri e segretari ducali milanesi. Ne emerge un quadro di anticlericalismo marcato, di attese escatologiche, di una forte tensione alla riforma della chiesa mediata dalle osservanze degli ordini mendicanti, in parte simile a quello di altre realtà europee contemporanee che sembrava del tutto estraneo alla realtà lombarda. In questo contesto uno spazio particolare è riservata alla figura del cardinale castigliano Bernardino Carvajal. L’alto prelato fu più volte presente sulla scena milanese come legato pontificio prima (1496-1497) e come animatore del concilio promosso da Luigi XII per destituire Giulio II (1510-1512). Divenuto inviso al re d’Aragona, ma favorito dal re di Francia dopo la morte di Georges d’Amboise per una possibile successione pontificia, il cardinale fu al centro di ambienti velati di un certo grado di eterodossia e promotore di una serie di controverse iniziative. Il suo nome è legato alla diffusione dell’Apocalypsis Nova e può essere ora messo in relazione con il cenacolo spirituale della Divina Sapienza legato al monastero milanese di Santa Marta. Il forte legame stretto con una parte dell’élite culturale lombarda può essere letto come il detonatore della vivace situazione religiosa della Milano della seconda dominazione francese. Le fonti utilizzate per la ricerca includono una disamina dei legati devozionali dei testamenti milanesi, un’analisi delle committenze artistiche del cardinal Carvajal (da Roma, a Milano, alla nativa Plasencia) della congregazione dei gesuati di San Girolamo, nonché dell’intero etourage lombardo del cardinale.

La ricerca si propone di indagare le mutevoli relazioni diplomatiche, politiche e culturali intercorse tra il papato e la monarchia di Isabella di Castiglia e Ferdinando d'Aragona alla fine del XV secolo, eleggendo come prisma interpretativo l’estremeño Bernardino López de Carvajal. Egli, in poco più di un lustro, divenne uno dei principali attori politici presenti a Roma, nonché anello di congiunzione tra diversi circoli intellettuali che contribuirono a creare una nuova e fulgida immagine della monarchia spagnola. L’ipotesi alla base della ricerca è che la traiettoria politica, teologica e letteraria del prelato possa rappresentare un osservatorio privilegiato per leggere più ampie e articolate tematiche, come la declinazione dell’ideale di crociata al principio dell’epoca moderna o la circolazione delle istanze di riforma che animarono la cristianità occidentale, da iscrivere nel panorama millenarista di fine Quattrocento

La Tesi indaga la chiesa di San Pietro in Montorio a Roma, tema di vivo interesse sia per la sua architettura sia per la sua collocazione urbana. Il valore dell'edificio si individua infatti non solo nell'ambito dell'architettura religiosa dell'Italia centrale del secondo Quattrocento ma anche nel rapporto che esso instaura con la città. Le indagini condotte hanno prodotto, rispetto a quanto già noto sull'argomento, un ampliamento della conoscenza storica, stilistica e tipologica dell'edificio, la precisazione della cronologia delle fasi costruttive (anche in relazione al contiguo tempietto di Bramante e all'intero monastero francescano) e una definizione più chiara dell'effettivo ruolo dei committenti. Tutto ciò, unito alla conoscenza dettagliata dell'edificio, attraverso il rilievo architettonico e l'esame delle murature, ha consentito di aggiungere nuove informazioni circa la prima fondazione, sul luogo del presunto martirio di san Pietro, per volontà dei Re Cattolici Ferdinando e Isabella, su probabile disegno di Baccio Pontelli.
The thesis investigates the church of San Pietro in Montorio in Rome, a subject of great interest both for its architecture as for its urban location. The value of the building it identifies not only in the fifteenth century Italian religious architecture but also in the relationship with the city. Outcomes: improved knowledge of the church (historical, stylistic and typological), clarification of the history of the construction phases (including in relation to the adjacent Bramante's Tempietto and the whole Franciscan monastery), clarification of the role of the customer. It has helped to add new information about the first foundation, on the scene of the supposed martyrdom of St. Peter, by the will of the Catholic monarchs Ferdinand and Isabella, probably by Baccio Pontelli.

La región asiste a una constante sucesión de reformas procesales, producto de la irrefutable insatisfacción de la sociedad con sus sistemas de enjuiciamiento. De entre las múltiples preocupaciones que vienen aparejadas con esos movimientos reformistas destaca aquella por la independencia judicial, un tópico de indagación multidisciplinar: desde la ciencia política a la ciencia jurídica, desde la teoría del Estado a la teoría constitucional y, por cierto, a la teoría procesal. La propia conceptualización de la independencia judicial no es unívoca y, así, los acentos aparecen en distintos aspectos. Una mirada recurrente y tradicional apunta al marco institucional: la independencia judicial se asocia al “autogobierno”, a la “autonomía” e, incluso, a la “autarquía financiera”. En un sentido casi contraintuitivo, se define la independencia judicial como la “sumisión exclusiva a la ley” y, coherentemente, como la no sumisión a tribunales superiores, a otro poder ni a entidad o persona alguna; en suma, a la ausencia de subordinación jerárquica. Al fin, se pensará el deber de independencia de los jueces como correlato del derecho de los ciudadanos a ser juzgados desde el sistema jurídico y no desde parámetros extrajurídicos del sistema social (moral, política, economía, preferencias sociales, modas, entre otros. Con acierto, el compilador del libro que comentamos instala el tema en un tiempo en el que se pretende abrir los espacios para la solución jurídica de los conflictos más allá de las fronteras del proceso judicial. Desde ese punto de partida se puede valorar que la obra cuenta con investigaciones generales sobre la independencia judicial, pero también se amplían las referencias procesales a cuestiones vinculadas a medios alternativos de solución de conflictos, en particular la conciliación y el arbitraje. Entre los trabajos generales, los profesores Diana Ramírez Carvajal y Michele Taruffo —quienes conciben al derecho como un fenómeno en la cultura— tratan las relaciones entre los principios de independencia e imparcialidad, frente a los desafíos que se presentan a la labor judicial en este tiempo, y en particular en Colombia. Dentro de los diversos tópicos que señalan los autores, merece especial atención el acertado tratamiento del tema sobrelos efectos que la falta de independencia del vértice de la pirámide judicial produce en la función de todos los jueces. Por su parte el magistrado y docente Danilo Rojas Betancourth expone un metódico trabajo para aclarar las connotaciones del concepto de independencia judicial en el derecho. Destaca la necesidad de entenderlo dando prevalencia a su enfoque como derecho humano, “tanto como exigencia de los jueces mismos, como de los ciudadanos en aras de justicia”. Las profesoras Luz Amparo Granada de Espinal y Catalina Merino Martínez se hacen cargo de unos de los temas de mayor impacto en la adjudicación judicial en el derecho continental: los casos en los que la decisión implica asumir una colisión de principios. La profesora María del Socorro Rueda Fonseca, mediante un sugerente título “El proceso entre las cuerdas”, elabora un análisis comparado del sistema oral y del sistema escrito de la jurisdicción ordinaria colombiana, denunciando que las reformas judiciales que han previsto reducir los niveles de congestión no cumplen sus objetivos. Martha Eugenia Lezcano Miranda trata sobre los retos que para la justicia tiene el fortalecimiento de los medios alternativos de solución de conflictos y las jurisdicciones equivalentes, no solo en Colombia sino en otros países latinoamericanos. Entre sus propuestas cabe resaltar la de fomentar una sólida formación de los jueces en ese ámbito. El tema del arbitraje es desarrollado en varios trabajos. Laura Carballo Piñeiro muestra lo que a su entender son las insuficiencias de los arbitrajes colectivos en la experiencia española. Ana Luiza Nery no solo presenta un pormenorizado análisis conceptual del arbitraje colectivo sino que además especifica los impactos institucionales que este puede ocasionar en el sistema jurídico brasileño. A su vez Cindy Charlotte Reyes Sinisterra muestra los retos que tiene el árbitro de inversión en el posconflicto en Colombia: ¿pueden invocarse los acuerdos de paz como eximentes del cumplimiento de las obligaciones asumidas por el Estado en un Tratado Bilateral de Inversión? El tema de los Mecanismos Alternativos de Solución de Conflictos (quizás una de las cuestiones más relevantes para la cultura actual), lo desarrollan Adriana Patricia Arboleda López, Luis Fernando Garcés Giraldo, Eduardo Murillo Bocanegra, Astelio Silvera Sarmiento, Jovany Sepúlveda Aguirre y Dany Esteban Gallego Quiceno en el ámbito de la conciliación extrajudicial, con el marcado objetivo de reconocerlo como un mecanismo gratuito, rápido y eficaz para la solución de conflictos jurídicos. Joan Picó i Junoy elabora algunas reflexiones sobre la independencia de los peritos judiciales, aproximándose a las diferencias entre la independencia y la imparcialidad judicial y el interrogante sobre si estas deben cobijar a los peritos judiciales de la misma manera como lo hacen con los jueces. Por último, Darío Alejandro Rojas Araque describe los avances que para el proceso de nulidad matrimonial trajo aparejada la reforma procesal del Papa Francisco de 2015, recortando no solo el tiempo del proceso, sino sus costos económicos. En suma, desde mi propia perspectiva de magistrado y profesor universitario, preocupado por la indagación acerca de mi tarea como juez, me complace destacar la profundidad, solvencia y variedad de estos aportes que, sin duda, contribuirán a reflexionar sobre varios de sus aspectos sobresalientes: la solución pacífica de los conflictos de los ciudadanos, las condiciones de la adjudicación de los derechos (sobre todo, la “independencia judicial”) y la propuesta de otras vías adecuadas que colaboran a la efectividad del acceso a justicia.

This essay provides an outline of the familial, social, and cultural network of the Milanese Jesuati between the end of the fifteenth century and the first decades of the sixteenth century. Particular attention is given to their interactions with Cardinal Bernardino López de Carvajal, one of the protagonists of the schismatic Council of Pisa-Milan (1510-1512). Starting from the creation of their settlement of San Girolamo, new documentary evidence is employed to show how the surrounding urban area and the physical buildings that should have been erected there actually mirrored the local network of both the Jesuati and Carvajal. The patronage of the cardinal in San Girolamo and the creation of a Last Judgement fresco are then discussed and connected to the eschatological tensions stirring Milan at the time.
