O artigo reconstrói os fatos judiciais relativos a vários pedidos de extradição para a Itália de Cesare Battisti, um caso que interessou os tribunais franceses, a Corte Europeia dos Direitos Humanos e as autoridades brasileiras. Na perspectiva constitucional, foi mostrado o quadro das garantias aplicadas pelos Tribunais Italianos de Justiça em processos que levaram à condenação do extraditando, demonstrando que a Itália manteve todas as características do Estado de Direito, também durante o momento difícil da luta ao terrorismo interno. Os historiadores e críticos de arte Giulio Carlo Argan e Eugenio Battisti, nascidos em Turim no início do século XX, representam a importante corrente teórica da crítica de arte formada por Lionello Venturi. Esse artigo propõe uma análise do cenário da crítica italiana a partir de 1950, quando se estabelecem os embates entre o pensamento venturiano e aquele de Roberto Longhi. Através da recepção dos Macchiaioli florentinos na primeira metade do século XX, abordaremos o conceito de liberdade no âmbito do processo criativo decorrente das experiências impressionistas. Posteriormente, confrontaremos dois textos de Argan e Battisti de 1958 e de 1963, respectivamente, nos quais ambos analisam o cenário da historiografia artística e suas novas diretrizes na Itália de então.

O presente trabalho tem como objeto de estudo o instituto da extradição, que é um instrumento importante de colaboração processual internacional. O estudo se concentrará no conceito de extradição, seus princípios e a aplicação num caso prático: a extradição que a Itália pediuao Brasil do Cesare Battisti. Para fazer isso devemos analisar a disciplina normativa italiana, a disciplina brasileira sobre a extradição e o Tratadobilateral assinado em Roma no ano de 1989. Em seguida será examinado o caso do Battisti, que é um exemplo que vai ser explicado somente pelos aspectos importantes para o desenvolvimento e a conclusão do trabalho. Trata-se de um caso que nos permite sublinhar algumas características da extradição, mas aqui não importadelinear a figura do Cesare Battisti. A conclusão quer evidenciar a natureza dupla da extradição, instituto entre escolhas políticas e avaliações jurídicas no mesmo tempo. A tese que se argumenta é que a decisão legitimamentepolítica não pode ser justificada através de argumentosjurídicos: os âmbitos têm que se manter divididos. Além de uma decisão legal favorável, aspectos políticos podem sugerir a não extradiçao: o importante é manter separadas as motivações: uma decisão política tem motivações políticas, uma decisão jurídica tem motivações jurídicas. Abstract The Battisti Case constitutes a rare high-profile case of decision-making and judicial ruling on the (hardly ever explored) interpretation and implementation of refugee law by political, technical, and judicial actors in Latin America. It concerns an Italian citizen, Cesare Battisti, sentenced twice to life imprisonment who, after escaping from prison, fled to Mexico, France, Brazil, and Bolivia. Even though Italy had twice attempted to have Mr Battisti extradited from both France (1991 and 2003) and Brazil (2007 and 2017), his extradition has never been materialised. In 2019 he was removed from Bolivia to Italy, where he has been serving his sentences. This study analyses the facts prior to the 2007 Italian extradition request, Mr Battisti’s application for refugee status, the Brazilian Supreme Court’s main extradition ruling, the presidential decision on his non-extradition, Mr Battisti’s last years in Brazil and removal from Bolivia, and his confession and the execution of his prison sentence. This piece analyses a case where several parties seem to be in the wrong: the prosecuted criminal and former protecting States have misused the asylum regime, and the country where the prisoner is serving his sentence is seemingly aggravating his situation as a result of his “personal condition”.

O processo de extradição Cesare Battisti no STF suscitou muitas polêmicas sobre os mais diferentes aspectos do regime jurídico aplicável aos estrangeiros no Brasil, de um modo geral, e sobre o processo de extradição, de modo particular. O foco de análise deste artigo é mais circunscrito: os fundamentos invocados pelo STF para justificar a margem de escolha do poder executivo em efetuar ou não a extradição, uma vez autorizado a fazê-lo pelo próprio STF. Em especial, em sua argumentação, o supremo sugere a ideia de que o poder executivo dispõe da mais ampla liberdade na condução da política externa e de que ele não está sujeito a um controle jurisdicional nessa matéria. Procurar-se-á demonstrar que essa linha argumentativa não está de acordo com o texto constitucional. Ademais, outros argumentos poderiam ser utilizados para respaldar a decisão do presidente da república em não extraditar Battisti.

Abstract:
As part of my Doctor of Education program, I was asked to study Dr. Marie Battiste’s (2017) book Decolonizing Education: Nourishing the Learning Spirit. In response to that assignment, I built a WordPress site as a way to experiment with crossing boundaries of physical and digital places, between different Indigenous knowledges and notions of teaching and learning. While building the site, I looked for localized examples of Battiste’s concepts and ideas among the Inuvialuit, the Indigenous group with which I am the most familiar, in what became an exploration of the wonderful work being done in the Inuvialuit Settlement Region to preserve the culture and decolonize ways of thinking. I knew some of these resources existed, but was surprised by the depth and variety of materials available. In this paper, I present that website as an experimental example of digital curation that stitches together the book, a series of digital artefacts found via Internet searches and my own reflections on those artefacts. While building it, I did not seek out answers but instead explored the possibilities of curation as a path to decolonization education. The resulting site design is both personal and incomplete. Through this process, I hope to open generative cracks that provoke new ways of thinking about digital curation as a means of supporting active engagement in the complicated and necessary conversations regarding decolonization.

Arising from the need to employ innovative solutions to safely and efficiently maintain air traffic separation in increasingly denser skyways, the concept of Free Flight involves shifting some air traffic management responsibilities from air traffic control specialists on the ground, to pilots in the cockpit. Such a shift in traffic management responsibilities will be critically dependent upon the development of displays to provide traffic and hazard information to pilots in the cockpit (Wickens, Carbonari, Merwin, Morphew, & O'Brien (1997; Battiste (in progress); Johnson, Battiste, Delzell, Holland, Belcher, & Jordan, 1997). This research examined the effect of different information-varying display aids (predictors and threat vectors) for in-cockpit traffic displays, on pilot performance, workload, attentional demands, and flight safety. Fifteen pilots flew a series of traffic avoidance scenarios in a Free Flight simulation designed to assess the effects of different levels of traffic display information on these pilot variables. Three, 2D-coplanar prototype displays were compared which differed in the level of traffic information provided. Analysis of the data revealed that the traffic display with the most predictive information supported increased safety and decreased workload, without appreciable decrements in flight performance or efficiency.

AbstractWe present CCD multicolor photometry for 172 globular clusters (GCs), taken from the Bologna catalog (Battistini et al. 1987), in the nearby spiral galaxy M31. The observations were performed by using the National Astronomical Observatories 60/90 cm Schmidt Telescope in 13 intermediate-band filters, which covered a range of wavelength from 3800 to 10000 Å. This provides a multicolor map of M31 in pixels of 1.7 × 1.7 arcminutes. By aperture photometry, we obtain the spectral energy distributions (SEDs) for these GCs. Using the relationship between the Beijing-Arizona-Taiwan-Connecticut (BATC) intermediate-band system used for the observations and the UBVRI broad-band system, the magnitudes in the B and V bands are derived. The computed V and B–V are in agreement with the values given by Battistini et al. (1987) and Barmby et al. (2000). Finally, by comparing the photometry of each GC with theoretical stellar population synthesis models of Bruzual & Chariot (1996, hereafter BC96), we estimate ages of the sample GCs for different metallicities. The BC96 models provide the evolution in time of the spectrophotometric properties of simple stellar populations for a wide range of stellar metallicity. The results show that nearly all our sample GCs have ages more than 109 years, and most of them are around 1010 years old. At the same time, we find that GCs fitted by the metal-poor model are generally older than ones fitted by the metal-rich model.

This binary system, according to Semeniuk and Paczynski (1971), is very interesting because it is probably in a phase of rapid evolution through the Hertzsprung gap in the HR diagram and shows apsidal motion (Battistini et al. 1974) .The system was Observed at the Bologna Astronomical Observatory in UBV because the only known light curve (Kron 1935) is insufficient to give appropriate orbital elements (Kopal 1940, Ramella et al. 1980) and it is impossible to fit photometric elements with spectroscopic results (Batten 1962). The observations started in 1970 and ended in 1973; in 1980 the system was reobserved to complete light curve coverage.

Riassunto. Questo articolo indaga la presenza della sirena sull’acquasantiera nel Medioevo. L’esame è stato condotto sui casi conservati e oggi noti, tutti concentrati cronologicamente (XII secolo) e territorialmente (Italia del Nord). Si tratta del pezzo nella pieve romanica di San Giorgio a Ganaceto (non lontano da Modena), dell’acquasantiera nella pieve romanica di Santa Maria Assunta a Rubbiano, nel comune di Montefiorino (nell’Appenino modenese), e della pila lustrale nel battistero del duomo di Cremona. Lo studio, che si avvale dei precedenti e non discute la cronologia e l’attribuzione già oggetto di ampio dibattito da parte di altri studiosi, ha riesaminato invece l’iconografia, giungendo a ipotizzare che non sempre è possibile identificare i soggetti scolpiti con le sirene, come è stato fatto in passato. Appare invece opportuno riconoscervi esseri più mostruosi, come la lamia o l’arpia, forse per valorizzare maggiormente le qualità salvifiche dell’acqua benedetta. Anche sui fonti battesimali la sirena appare personaggio poco sfruttato, ma l’indagine in questo contesto è ancora da svolgere in maniera sistematica.

This article recounts a five-year journey connecting Acadian and Mi’kmaw schools in Nova Scotia, Canada. We trace the unfolding of relationships between minority school students and administrators through both natural and semi-structured dialogues. We believe this work contributes to the emerging field of research called for by the Truth and Reconciliation Commission of Canada, TRC (2015) “to advance understanding of reconciliation” (p. 331). Drawing upon Battiste (2000), our research design represents a journey in the four directions of the Medicine Wheel. This journey is superimposed on an action research cycle. Three primary recommendations are offered for future research, whether it is collaborative, community-based, or for independent academic requirements.

Este trabalho inspira-se em Coetzee (2016) para realizar análise fonológica da palatalização regressiva de /t, d/ numa variedade de português brasileiro (rotina~ro[ʧ]ina, medida~me[ʤ]ida, parte~par[ʧi], onde~on[ʤi]) de contato com falares dialetais italianos. Como Coetzee (2016), assume-se que fatores linguísticos e não linguísticos atuam na variação fonológica: os primeiros são implementados como restrições gramaticais e os segundos têm efeito sobre os pesos das restrições. Objetiva-se (a) aplicar os fundamentos de Coetzee (2016) ao exame de um padrão variável captado por análise de regra variável (LABOV, 1972), e (b) analisá-lo com o ORTO - Ajuste Paramétrico (DORNELLES FILHO, 2014), algoritmo que processa a gramática com variação. Os dados vêm de Battisti et. al. (2007) e os padrões de aplicação da regra variável, de Battisti e Dornelles Filho (2009, 2010). Neste estudo, controla-se o efeito do fator social Local de Residência (zona rural ou zona urbana) sobre o peso das restrições gramaticais. Mostra-se que, nos indivíduos cuja fala conforma-se ao padrão 1, sem palatalização em qualquer contexto, Local de Residência tem efeito sobre a restrição *t[i], satisfeita com a palatalização da oclusiva alveolar desvozeada por vogal anterior alta derivada (parte~par[ʧi]). Já na fala dos indivíduos que seguem o padrão 3 (palatalização apenas por vogal alta não derivada), o fator afeta os pesos de ambas as restrições referentes ao contexto de palatalização por vogal anterior alta derivada, *t[i] e *d[i]. A análise consegue esclarecer não só o papel de Local de Residência na gramática da palatalização em Antônio Prado, como explicitar o efeito da elevação variável da vogal média átona anterior, que alimenta o processo, num padrão de variação na mudança linguística em progresso.

AbstractThis essay reads the 1880 Battiste Good Wintercount as a textual conflict zone that brings Indigenous oral and pictographic literatures into dialogue with settler-colonial forms like alphabetic script and books to imagine Native futures after militant resistance. With a timeline that goes back to 901 AD, Good issues a dramatic challenge to Western scholarship on the book, writing, and literary history. He rejects requests for simulations of what Gerald Vizenor calls “tragic victimry” with literary innovation and a narrative vision of survivance. Foregrounding the authority of women, Good invokes new and ancient treaties to insist on Indigenous sovereignty. The essay explores how the literary history of Indigenous pictography informs contemporary Native writers, like N. Scott Momaday, and decolonizing struggles like those identified with the hashtags #NoDAPL and #landback. It concludes with a call to interrogate deep structures of coloniality that organize literary studies through ethnocentric conceptions of literacy, genre, period, and time.

Using a life writing research methodology in this article, I seek to understand the complexities implicated in reading silenced narratives as a way towards reconciling internations relationships. To do so, I weave in the poetical territories of Josephine Bacon, Innu poet from Pessiamit, Quebec. From 2006 to 2009, Indigenous Elders and scholars shared their insights in the Comprehending and Nourishing the Learning Spirit Animation Theme Bundle of the Aboriginal Learning Knowledge Centre (ABLKC). The ABLKC was an applied research, knowledge exchange, and monitoring program with a mandate to advance Aboriginal education in Canada. One of the six bundles, Nourishing the Learning Spirit, was led by Mi’kmaw education scholar and Academic Director of the Aboriginal Education Research Centre at the University of Saskatchewan, Dr. Marie Battiste. In this paper, the authors discuss how they applied knowledge gained in the Nourishing the Learning Spirit Animation Theme Bundle to their post-secondary classroom practice. The authors argue that teachers are better able to nourish the learning spirit of students when they understand themselves as lifelong learners, validate and learn from their students, and use holistic teaching pedagogies.
