Abstract:
Most analyses of the persistent objector doctrine seem to omit the impact that its application has on the general requirement of consent as a cornerstone of the international legal order, and as an unavoidable requisite in the formation of rules of customary international law. The present work holds that the persistent objector rule not only undermines the consensual nature of obligations in international law, but also generates issues of normative authority, dubious attribution of meaning to silence, temporal determination, and with self-determination and equality. It concludes that the doctrine, furthermore, lacks practice and opinio juris, meaning that its validity and existence in the realm of customary international law is highly questionable.

Environmental controls in the United States are often said to be “technology-based” because the polluter’s duties are determined by the available technology for controlling that pollution rather than by the social costs and benefits of doing so. Indeed, this is much of what distinguishes U.S. environmental law post-1970 from that which preceded it. But technology-based standards have in fact weighed the costs of controlling pollution in unique, often obscure ways, yielding an analysis that defies standardization and basic notions of transparency. Often lumped under an umbrella heading called “feasibility” analysis and justified on the grounds that it avoids many of the known pitfalls of cost-benefit analysis, the factoring of cost into technology assessments hands our Environmental Protection Agency a uniquely hard problem of prediction: the inducement of innovation. This Article traces the evolution of the practice to the state of the art today, offers several clarifications upon reflection, and suggests that cost estimation in technology- based standard setting is actually more likely to be a useful decision input than the orthodox cost-benefit balancing procedures. Most importantly, it is more likely to accurately assess the possibilities of inducing innovation—accuracy that is increasingly vital to meeting environmental challenges like climate change.

The McCarran-Ferguson Act (MFA) exempts various aspects of state insurance operations from federal antitrust enforcement. This exemption is a source of longstanding controversy, due in part to its potentially harmful effect on consumers in product pricing. In hurricane insurance, there is a burgeoning debate concerning insurers' use of predictive computer models rather than shared loss data to set premiums for the industry. By using these models in hurricane-prone states, insurers have increased the price of hurricane insurance dramatically. Where these new prediction methods are used, MFA exemption may facilitate supracompetitive pricing in ways its architects could not have foreseen. This Note analyzes MFA's economic effects on model-based pricing in hurricane insurance to argue for judicial revision of the Act. Through an effects test, it proposes conditioning eligibility for antitrust exemption on the economic benefits of a challenged activity exceeding its costs.

Common friend and place recommendation services in Location-based Social Network (LBSN) is based on user’s location tracking. However, since each user can do different activities even in the same place, location data is not enough to provide accurate recommendation for LSBN. To address this problem, Activity-based friend and place Recommendation System (ARS) is proposed. ARS considers two additional factors to improve recommendation accuracy: time and activity. ARS collects the time-related activity and location data from users through the developed scheduler application and then performs the recommendation for users based on the calculated similarity among them. Performance evaluation shows that ARS can provide accurate recommendation between users who have similar activity and location patterns according to time.

While data and/or information based education was built on pedagogic, psychology, philosophy of science and didactic disciplines, the new dimension of knowledge based education will involve new disciplines such as Knowledge Management, Epistemology, Systems Theory, Artificial Knowledge Management Systems, Value Theory and Theory of Measurement. It is often assumed that data, information and knowledge are depicted as a pyramid. The data, the most plentiful type, are at the bottom, information, produced from data, is above it and knowledge, produced from information through the hard work of refining or mining, above it. This schema satisfies specific needs of an organisation of warehouse data systems but it does not explain the role of these objects in the educational process. In education, the distinctions among data, information and knowledge need to be distinguished from the complex pedagogical point of view. Knowledge is the engine asking for more information and more data. Knowledge life cycle produces more information, more information asks for more data – that is: there is “just information”. Data, information and knowledge can be considered as object oriented measures assigned to real objects (entities). The following measures can be assigned to the objects: Measure of the zero order – name. Measure of the first order – data. Measure of the second order – information. Metrics of the third order – knowledge. Knowledge based curriculum involves knowledge into study plans and it considers knowledge as a distinctive part of study. Knowledge becomes the engine starting cycle of new information acquisition, reproduction and integration. The following problems have to be solved in building of knowledge based curriculum: Methodology and organisation of educational process. Technical support for knowledge based education. Evaluation and assessment of the process.

Abstract:
The use of multifunctional nanosystems in medicine and research is of contemporary interest. Aim. The purpose of the work was to summarize publications on the prospects of creating and using nanocontainers based on curcumin (Cur). Cur fluorescence in nanoparticles (NP) makes it possible to investigate the distribution of fluorescent and non-fluorescent components, significantly accelerating the study and implementation of drugs in practice. Particular attention is paid to the use of hydrophobic substances in NP, to penetrate into a living cell. Understanding the interaction of NP with living cells is extremely important when these particles are used to transport and deliver water-insoluble drugs to cells. Cur is one of the drugs with various and very promising pharmaceutical effects, it is poorly soluble in aqueous media, and the use of nanocarriers is an effective way to significantly increase its bioavailability. Cur has its own fluorescence, which enables to use it in multifunctional fluorescent nanosystems, for example, with Pluronic® micelles. The use of the fluorescence method makes it possible to trace the stages of interaction of Cur-loaded NP with cultured cells and their localization in cell organelles. With this approach, nanoscale dynamics of drug distribution and stability is observed over time. Conclusions. The main conclusion is that for unstable in the aquatic environment drugs such as Cur, it is necessary to use the most hydrophobic nanostructures without traces of water, which include the nuclei of Pluronic® micelles. This method makes it possible to use other poorly water-soluble drugs. A promising area of nanomedicine is the creation of complex bio-compatible nanomaterials based on several active drugs that reduce the toxicity of preparations to normal cells.
