Abstract:
We all live in the age of constitutional balancing. Abstracting away differences of nuance and doctrinal detail, balancing is a common feature of the structure of rights analysis across contemporary constitutional systems. Indeed, abstracting just a little further still, balancing is an inherent part of the near-universal general conception of a constitutional right as an important prima facie claim that nonetheless can in principle be limited or overridden by certain non-constitutional rights premised on conflicting public policy objectives.It is not surprising, then, that a significant literature about balancing has developed at both domestic and comparative levels. What is surprising is that so little of this literature has attempted to present the normative case for constitutional balancing or the general structure of rights analysis of which it is an inherent part. Rather, the existing scholarship has mostly focused on five other tasks: (1) describing and comparing first-order practices of balancing; (2) providing second-order conceptual analyses; (3) explaining balancing's rise to dominance; (4) advancing critiques of balancing; and (5) rebutting these critiques.In this article, I attempt to present one particular normative justification of constitutional balancing; namely a democratic justification. I argue that balancing appropriately bolsters the role of majoritarian decision-making about rights within a system of constitutional democracy. It thereby renders entrenched rights enforced by the power of constitutional or judicial review more consistent with certain enduring democratic concerns. I also explain the implications of this justification for how courts should exercise their powers of review.

Abstract:
This paper finds that Pyongyang's nuclear issue is by no means China's "primary contradiction (top priority)" in its international relations. Chinese priority on the Korean peninsula is to keep stability and the status quo of a divided Korea rather than rush to find a resolution to the nuclear issue, which may result in a military imbalance on the Peninsula, or the collapse of the Pyongyang regime and hurt China's interest. To this end, China has adopted the strategy of making a delicate balance between pressuring and sustaining the Pyongyang regime. The paper concludes that from Chinese perspectives, a North Korea at the nuclear threshold contributes to counterbalancing US military presence in the region, maintaining a status quo of divided Koreas and helping China overcome US containment. China aspires to achieve three interconnected objectives with this strategy. This first is to sustain China's economic growth, the second to counterattack US containment, and the third to propel China's rise at the systemic (global) level.

Abstract:
This article analyses the strategic, organisational, and structural conditions for small and medium enterprises (SMEs) to fully exploit the potential of information and communication technology (ICT). The authors build a conceptual framework relating “ICT readiness” (a new construct) to two more common dimensions: “strategic vision of ICT” and “ICT maturity”. Using the framework, the study identifies four distinct groups of SMEs, associated with differing degrees of readiness, before analysing possible evolutionary and regressive development paths among these groups. In discussing the implications of the framework, the authors argue that the framework represents a valid tool of diagnosis and intervention, especially in those circumstances where SMEs cannot fully exploit the potential of ICT. The framework helps identify the underlying causes of limited ICT readiness and supports owner-managers and consultants in choosing and implementing appropriate interventions.

Abstract:
The present study investigated developmental changes in lexical production skills in early sequential bilinguals, in both Spanish (L1) and English (L2), exploring the effects of age, years of experience, and basic-level cognitive processing (specifically the ability to resist interference) within a timed picture-naming task. To assess resistance to interference, naming was compared in low competition (blocked-single language) vs. high competition (mixed-alternating language) conditions. Participants were 100 individuals, 20 at each of 5 different age levels (5–7, 8–10, 11–13, 14–16, & young adults). All had learned Spanish as a first language in the home, with formal English experience beginning at 5 years. Gains were made in both languages across age. However, there was a developmental crossover from Spanish dominance in the youngest children, through a period of relatively balanced Spanish and English skills in middle childhood, culminating in a clear pattern of English dominance among adolescents and young adults. Although all groups experienced a greater slowing of response times in the mixed-language condition relative to the blocked-language condition, developmental changes in the pattern of speed-accuracy trade-offs in the mixed condition can be interpreted to reflect a change in the ability to resist cognitive interference during word production.
