Abstract:
The aim of the AES Awards for Excellence in Evaluation is to encourage the development of evaluation and high-quality evaluation practice in Australasia. In 2007, seven awards were offered by the Australasian Evaluation Society, which included two new awards, the Emerging New Talent Award and the Indigenous Evaluation Award. Two of the awards recognise individual evaluators nominated by their peers: the Outstanding Contribution to Evaluation (ET&S) Award and the Emerging New Talent Award. Five awards recognise organisations, project teams, specific evaluation projects, programs or systems nominated by the evaluators and/or the organisations involved: the Best Evaluation Publication Award (the Caulley Tulloch Award), the Best Evaluation Study Award, the Best Evaluation Policy and Systems Award, the Community Development Evaluation Award and the Indigenous Evaluation Award. The following awards were presented at the 2007 AES International Conference dinner in Melbourne in September. Dr Zita Unger announced the award winners as Acting Chair of the AES Awards for Excellence in Evaluation Committee at the presentation.

This paper enquires into the standards employed by Pakistani courts to review arbitral award. Although, domestic and foreign awards are administrated by two discrete legal regimes, the question is how the nationality of award is determined. This differentiation in the nationality of arbitral award, in turn, calls forth the application of distinct rules for domestic and foreign awards in case the award debtor wants to impeach the validity or enforceability of award when award creditor has not yet committed the award for enforcement. Similarly, different limitation periods bear on domestic and foreign award to delve if their enforcement is time bared. But this divergence in treatment based on the foreign and domestic nature of award does not lead to a differentiation in judicial review of award since Pakistani courts review both kinds of awards with same intensity.

Arbitral award is final and binding. A concept of “binding” is fundamental in International arbitral award. Nevertheless, the focus commonly concerns about the annulment and/or deferment of International arbitral award so that it could not be implemented. However, the New York Convention does not govern this issue. In addition, international arbitral awards must meet the following requirements: the award is made in the territory other than conflicting countries, and/ or it is not considered a domestic awards in the State where recognition and enforcement is sought. This is important because the enforcement proceedings between foreign and domestic awards are different. This article elaborates the principles of the recognition and enforcement of a foreign award and the grounds or criteria for refusing to enforce an award are limited to the specific defenses i.e. public policy. The party opposing enforcement bears the burden of proofin the existence of the enumerated defenses.Keywords: binding, annullment, deferment, acknowledgement and enforcement of arbitral award.

Abstract:
The paper investigates the practice of awarding law enforcement bodies after the establishment of the Soviet Union in 1922. It is stated here that the unification of the republics necessitated the creation of an all-union award system. At the same time, the award systems in the union and autonomous republics of the USSR continued to exist. This study is based on the principles of historicism, objectivity and systematic approach. Using statistical analysis, the author quantified the award data obtained by continuous sampling. Archival materials, published sources and memoirs demonstrate that the all-union and republican award systems were largely similar and were based on the award principles that had been developed during the Civil War. At the same time, despite the need, no special awards for law enforcement bodies were ever established at the state (all-union) level. The award practice indicates that the highest awards – orders – were given extremely rarely due to the lack of provisions in the statutes for rewarding specific activities of law enforcement officers. The most common types of awards were departmental: decorations as well as material (valuable gifts and bonuses) and moral rewards (certificates of acknowledgement, certificates of merit, banners). The awards could be both individual and collective. The author concludes that 1922–1933 was a transition period from the republican award systems to the all-union system. The award dualism was caused by a difficult crime situation and, as a result, the need to distinguish law enforcement officers, as well as by the inability of the state leadership to promptly establish an effective award system. As soon as the USSR award system was created, the republican awards were abolished.

We propose that there exists a positive relationship between winning industrial design awards and the corporate performance of the award‐winner, and that this relationship is moderated by, first, the type of products involved, and second, by the reputation of the award. The subject of the research is the establishment and application of official awards at the municipal level of government, including award legislation and the practice of its application. The purpose of the article is to confirm or disprove the hypothesis of an existence of an award policy and system of awards for the municipal level of government in Russia. The methodological basis of the research is the general scientific dialectical method of cognition (such as methods of analysis and synthesis, abstraction and concretization, induction, deduction and analogy), as well as the method of monitoring of legal acts, historical and legal method, system analysis. The main results of the research. A comprehensive analysis of existing regulations and description the general contours of the award policy for the municipal level of government were made. The following classification of awards applicable to municipal authorities can be distinguished. By type of award: honorary titles, medals, distinctions and incentives, as well as grants and prizes. Depending on the subject that establishes the award: state, municipal or public awards; moreover, you should distinguish between awards established by a public legal entity (award of the Russian Federation, of the constituent entity of the Russian Federation, a municipality) or a separate public authority. Depending on the subject receiving the award (the awarding subject): awards that are established both for the municipality as a whole, and for individual officials or other employees of local self-government bodies; a separate category consists of awards provided for the territorial bodies or their representatives. Currently, there is no single document outlining the system of awards of the Russian Federation. Conclusions. Monitoring of normative legal acts of local self-government bodies has shown that it is quite rare to find documents that regulate the award policy of a municipality. There is practically no award policy for local government bodies or their officials, as well as awards for contributions to the development of local self-government.

Abstract Egyptians generally pay attention to the State Awards as the most prestigious awards that Egyptian researchers can receive, including the Nile Award, the State Appreciation Award, the State Award of Excellence, and the State Encouragement Award. The current study is an attempt to investigate the role of national awards in the scientific research system, in order to identify the characteristics of Egyptian State Award laureates in science and technology during 2012–5, to determine their international literature, and to explore the implications of receiving a national award using bibliometric indicators. Scopus database was used to extract data, and the statistical software package SPSS was used to analyze. The study sample was 212 laureates, in addition to the control group of 184 researchers who closely matches the academic profiles of the laureates. The performance of the laureates and the control group was compared before and after the award by using four bibliometric indicators and the Wilcoxon matched-pairs signed-ranks test. The laureates produced 13,598 publications from 1958 to 2018. Most of the laureates’ literature (94.35%) were published with coauthors. The Egyptian State Award laureates often collaborate with their Saudi Arabian and American colleagues, more than others. The average values of publications, citations, and citations per publication have increased after receipt of the award, unlike the h-index. Results indicated that receiving the State Award has a negative impact on the laureates’ performance.

This study examines interactions between pre-award ESOP restrictive conditions and award discounts/premiums that characterized executive stock option awards in Australia from the mid-1980s to 2000. Shareholder wealth effects at award suggest that (i) shareholders generally do not gain from offering discounts because associated value increments do not exceed the cost of the discount, (ii) premium awards coupled with exercise restrictions appear to be used to ameliorate the risk of CEO opportunism associated with irregular awards, and (iii) shareholders suffer a wealth decrement when premium awards are used to ameliorate the disinvestment incentive of inferior CEO dilution protection. The second of these findings implies risk of CEO opportunism. A major implication is that award discounts/premiums are used to modify the conditions of pre-existing ESOPs that presumably are dated and no longer optimal for addressing current incentive problems. Analyses of the optimality of award discounts/premiums should take this into account.

Awards by consent are a common feature of international arbitration. Yet there are no commonly accepted rules defining precisely the elaboration, the effect and the recognition of awards by consent. One of the reasons for this situation is that an award by consent has a dual nature: it is an award but has a contractual origin. The purpose of this article is to look at some of the practical consequences flowing from this dual nature. First, it compares the relative merits, in relation to enforcement, of awards by consent and of the underlying settlement agreements and concludes that although awards by consent are on the whole easier to enforce there are situations where that is not necessarily the case. In particular, awards by consent can pose serious problems if as a result of unclear or incomplete drafting they raise questions of interpretation. A key concept proposed by this article is that an award by consent serves no purpose as an award if it does not have a jurisdictional effect (‘effet juridictionnel’) and thus that there is no point in issuing an award by consent if the underlying settlement agreement has been fully complied with by the parties when the issuance of the award is requested from the arbitral tribunal. Secondly, this article explores the extent to which the annulment of the underlying settlement agreement must cause the award by consent embodying this agreement, or the exequatur judgments declaring that award enforceable, to lapse. The article finds that there are possibly two approaches to this issue, depending on whether the award by consent is seen as a mere instrument created in order to facilitate the settlement agreement or whether it stands as an award on its own. This article considers several factual situations in which the question could arise and concludes that there can be no clear and predictable solution, irrespective of which approach is taken by the various courts or tribunals which may have to rule on the issue. In its conclusion, the article suggests that the problems which occur in relation to the enforcement of awards by consent are best avoided if both the agreement and the award are valid and functional. The arbitrator must therefore take a proactive role in ensuring that the underlying settlement agreement is as free as possible from defects and that it is reflected in the award in a manner which leaves no room for further disputes. The article pleads for the right of the arbitrator to refuse to issue an award by consent if the parties are unable or unwilling to correct perceived deficiencies in the settlement agreement which could later cause the agreement or the award to fall apart.

Purpose – Quality awards, commonly, have basic criteria and sub-criteria to evaluate applicants based on the quality management principles and philosophies. The purpose of this paper is to examine the method of selecting award winners and its consequences. Design/methodology/approach – Award winners’ and non-award winners’ performances of the Ethiopian Quality Award are the study groups. The criteria and sub-criteria evaluation results of the award were collected and analysed by the Mahalanobis-Taguchi System. Findings – The research assumed that award winners’ performances are exceptionally outstanding. However, the result does not justify the assumption. Hence, the drawback of aggregating multivariate performance measures in a quality award is proven. Mahalanobis distance is proposed as alternative approach to evaluate and select organizations. Practical implications – The outcome of this research will help award givers, evaluators and participants to understand the real difficulty to select very few organizations among applicants. Furthermore, it helps to consider the possible error when aggregating individual performance. Abstract:
Purpose: The arbitral awards are enforceable internationally under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, 1958. The Convention provides the discretion to the courts in enforcing State either to enforce or reject the international arbitral awards. The award set aside at the seat of arbitration is not enforceable, however the courts in some jurisdictions enforced such awards. In this context the paper examines how the courts in different jurisdictions justified while enforcing the annulled awards. Theoretical framework: Arbitration mechanism is frequently used for settlement of international commercial disputes. It enables party autonomy in drafting arbitration agreements, choosing the applicable law and determining the arbitration seat. According to Article V (1)(e) of the New York Convention the national courts may refuse to recognize or enforce the foreign award if it was set aside or annulled at the seat of arbitration or under law of which such award was given. In some jurisdictions the enforcing courts considered the annulment procedure followed by the courts and if such procedure was unfair, the courts in enforcing country have agreed to enforce the set aside awards. Design/methodology/approach: The author followed the legal analysis method to examine the approach of the courts from different jurisdictions that have enforced the annulled foreign arbitral awards and the legal comparative method observed to study the judicial decisions from various jurisdictions. Findings: The study concludes that Article V (1) of the New York Convention gives discretionary power to the enforcing courts regarding enforcement of foreign arbitral award. Hence, the courts in some jurisdictions enforced the annulled award if the set aside procedure was unfair, based on local grounds, biased, violated basic norms of justice, against the parties’ agreement or applied domestic law instead of the New York Convention. To secure the enforcement of award, the parties to the arbitration may agree that the arbitral award is not subject to challenge in any court at the arbitration seat or in the state in which the award is enforced and prefer a pro-arbitration State as a seat of arbitration. Research, Practical & Social implications: The study provides practical guidance to the arbitrating parties in drafting arbitration agreements to ensure the enforcement of an arbitration award internationally. Originality/value: The research on enforcement of annulled award under the New York Convention immensely helpful in guiding the arbitration parties in drafting the arbitration agreement, choosing arbitration procedure and seat of arbitration.

Abstract:
Objective: to assess the state of legal regulation of award relations in theRussian Federation subjects and to develop measures for its systematization and improvement.Methods: the main methods of the conducted research are general scientific methods of cognition: analysis, synthesis, comparison, extrapolation, and specific-legal methods of cognition of award relations based on them, used in the Russian theory of law and the state.Results: an analysis of more than 500 regulatory legal acts of the constituent entities of the Russian Federation has shown that in some regions special laws were adopted in addition to the existing comprehensive laws on awards, which regulate the establishment of regional parliamentary awards, as well as awards of regional state authorities; that in most of the Russian Federation subjects, state (republican, regional, district, municipal) awards are regulated outside the comprehensive award legislation, but within the framework of incentive law, by their own legislation on regional awards and/or by-laws of the regional state authorities; that in some Russian regions there are special laws establishing simultaneously not only state awards of the Russian Federation subject, but also state scholarships.The territorial scope of the study is limited to the Russian Federation as of September 30, 2022, before the Donetsk People’s Republic, Luhansk People’s Republic, Zaporozhye and Kherson regions, which established their regional awards, became part of it. The time frames of the monitoring study are limited to the period from 1991 to February 10, 2023.Scientific novelty: for the first time in Russian legal science, a monitoring study of the award law of all subjects of the Russian Federation was conducted, which allows assessing the quality of legal regulation of award relations in the Russian regions and, if necessary, improving the system of regional awards and other incentives for positive lawful behavior.Practical significance: the results obtained can be used in the law-making activities of state authorities of the Russian Federation subjects in improving regional award legislation, establishing official regional awards and systematizing the legal regulation of award relations. The conclusions of the conducted research enable to eliminate contradictions between the norms of award law and the norms of other regulatory legal acts.
