Full textThe thesis deals with the analysis of the role and functions performed by the Transport Regulatory Authority, in light of the liberalization process that has affected the transport sector. First of all, are examined the structural and organizational aspects of the Authority, with particular reference to the functions, powers, and areas of intervention. Furthermore, the subject of the investigation is the regulatory regulation applicable to the Authority. After that, the analysis focuses on the constitutional framework in which the Authority is set up, in particular emphasizing the points of contact between the functions attributed to the Authority and those attributed to the territorial autonomies, to the other independent administrative authorities, and, last but not least, to other institutions operating in the transport sector. Are highlighted the interferences with political power, in consideration of the influence of the Authority's actions with respect to the government policy. The Authority's choices regarding relations with foreign administrations, and with international organizations are also the subject of further study. Finally, the thesis analyzes some of the most significant actions implemented by the Transport Regulatory Authority in the transport sectors, in order to verify concretely the role played by the Authority and ascertain the real impact of transport regulation on the various markets. In particular, is examined the regulatory activity carried out by the Authority in the railway sector, the road sector, the aviation sector, local public transport and maritime transport.

Full textThis research aims to investigate the new limitation of the principle of freedom of contract due to the regulatory activity implemented by market authorities. The analysis starts with the examination of selected acts issued respectively by: Banca d’Italia, with specific reference to the powers conferred by art. 117, 8° co. t.u.b.; IVASS, regarding the reg. n. 40/2012, which has established the “minimal content” the Payment Protection Insurance should comply with; and by AEEGSI, which has shown, due to the specificities of the Italian energy market, an intense regulatory activity towards contracts concluded by the final user. Thereafter the research explores the legal remedies enforceable in the event that the contract does not comply with the “minimal content” established by the market authority. In particular the analysis is focused on art. 1339 c.c., which provides the automatic insertion in the contract of prices and terms set by the law; consequently, the research examines the specific requirements and limits on the implementation of this legal provision. Eventually, the investigation analyses recent rulings issued by the Supreme Court, which have applied the above-mentioned provision to a contract which was found not to be complying with the minimal content provided by AEEGSI.

Full textThis thesis explores the theme of improving, in terms of speed and regularity, the road-operation of public transport systems, through control strategies in real time. Specifically in this work are highlighted intervention strategies that falls in the two categories of "Vehicle Priority" and "Vehicle Holding", potentially conflicting the one with the other. The analysis of scientific literature and best practice has shown that the two intervention strategies, leading the first at maximizing the commercial speed and the second to the maximization of regularity of service, are currently considered one independently from the other, both in the field of practical applications than in the one of theoretical speculation. In this work is presented a new unified approach that reconciles both the strategies of intervention; moreover a method is introduced, implemented into a prototype software, for the calculation of the optimal strategy of the vehicle operating through regulation of fixed control points (eg. Signals road traffic lights) to allow a joint pursuit of speed maximization objectives and regularity of service. The optimization method here formulated and tested is based on the combined use of (meta) heuristics (Genetic Algorythm, PSO and Hill Climbing) and traffic simulation methods able to reproduce and predict the temporal trajectories of individual public transport vehicles. The short-term prediction capabilities inherent in the use of simulation tools allows to generate solutions to the regulation problem which are extended "forward" both in the road space and time, thus allowing an approach to regulation that is both anticipatory and non-local. These characteristics allow in general to achieve road capacity relocation between neighboring intersections thus enabling, where possible, to reduce the competition between different modes of transport in the use of road capacity. In this work are finally presented the results of a series of tests carried out both in the case of realizing the control through a normal signal pattern with ripetitive cycle and phases for each signal, both in the hypothesis less restrictive of red and green times generally variables during time for each signal. The calculation effort of the prototype also suggest the possibility, through further developments, to use this method for real-time applications.
