Abstract:
This chapter presents possible approaches in dealing with the problem of the res judicata doctrine in international commercial arbitration, namely the conflict-of-laws approach, comparative law approach, and transnational approach. The conflict-of-laws approach defines clear and generally accepted conflicts-of-law rules allowing arbitrators to determine the law or laws governing res judicata. The determination of conflict-of-laws rules will depend on the characterisation of res judicata as being of substantive or procedural nature. The comparative law approach compares different domestic laws to determine generally accepted res judicata principles common to a majority of states. Lastly, the transnational approach formulates uniform, autonomous res judicata principles that are better adapted to the particularities of international commercial arbitration created for litigation.

This chapter traces the conflicts faced by the aristocratic constituted bodies at the close of the Seven Years' War. Fighting had gone on for a generation interrupted by a few years of truce; governments had accumulated great debts, which they had now to find means to carry or repay. The search by governments for new sources of income met with resistance from magistracies or assemblies in many countries. It therefore produced constitutional crises. “From the need for money, which put into motion the machinery of reforms, arose a great drama: the clash between autonomous entities and the central power, between local governing classes and foreign rule.” The discussions cover the quasi-revolution in France, 1763–1774; the monarchist coup d'etat of 1772 in Sweden; and the Hapsburg Empire.

Abstract:
This chapter focuses on Indian historical writing. The end of colonial rule in 1947 was a turning point in Indian historical writing and culture. History emerged as a professional discipline with the establishment of new state-sponsored institutions of research and teaching. Attached to the institutionalization was the political imperative of a newly independent nation in search of a coherent and comprehensive historical narrative to support its nation-building efforts. At the same time, there was a desire to establish an autonomous Indian perspective, free of colonial constraints and distortions. In this, post-independence historiography owed much to earlier strands of nationalist historiography. During the first two decades after independence, three main trajectories of historical writing emerged: an official and largely secular nationalist historiography, a cultural nationalist historiography with strong religious overtones, and a critical Marxist trajectory based on analyses of social forms.

Abstract:
How do religious, ethnic, and national identities interact in religiously homogenous ethnic conflicts? Is it possible for religion to act as a resolution tool in such conflicts? Why? Why not? In search for answers to these questions, Under the Banner of Islam focuses on the ambivalent role Sunni Islam has played in Turkey’s Kurdish conflict—both as a conflict-resolution tool and as a tool of resistance—in the last two decades. Relying mainly on participant observation in Civil Friday Prayers and 62 interviews conducted in three different cities in Turkey (Istanbul and the majority-Kurdish Diyarbakir and Batman) between June 2012 and June 2013, it demonstrates that Sunni Islam has had a very limited impact as a conflict-resolution tool in Turkey. Blending interview data with a detailed historical institutional analysis that goes back as early as the nineteenth century, it argues that the strength of Turkish and Kurdish nationalisms, the symbiotic relationship between Turkey’s religious and political fields, religious elites’ varying conceptualizations of religious and ethnic identities, and the recent political developments in the region (particularly the establishment of an autonomous Kurdish region, Rojava, in Syria) have all contributed to this outcome. The resulting narrative is not only a record of religion, ethnicity, and nationalism in Turkey’s Kurdish conflict, but also an investigation of how ethnic and religious identities are negotiated in conflict resolution and how symbolic boundaries are drawn in ethnic conflict zones.
