Abstract:
In South Africa, wage garnishment is achieved through the emolument attachment order (hereafter “EAO”) mechanism. This civil debtcollection instrument plays a significant role in South African society, affecting the lives of potentially millions of people. It is therefore concerning that the mechanism is often criticised for lacking effective measures to prevent, monitor, identify and then correct irregularities in the collection of debt through EAOs. This contribution considers the historical context that directed the development of the South African EAO mechanism and the composition of the current South African framework regulating EAOs. It considers South Africa’s unique legal approach resulting from the development of common-law procedural affordances supporting a predominantly civil-law substantive system. It analyses the role of Roman law, Roman-Dutch law, English common law, and the constitutional dispensation in shaping the contemporary EAO mechanism. In the process, the study identifies challenges that have been present since the mechanism’s earliest origins, which can be traced through its historic development and remain contentious in its contemporary version. The study is significant since the EAO mechanism has not yet been subjected to a comprehensive and critical analysis of this kind. Limited research has been conducted on the South African EAO mechanism and there has not been any detailed analysis of its history and development. It is submitted that such an analysis is a necessary first step to facilitate further in-depth comparative research with the aim of developing an effective and fair EAO mechanism.

Abstract:
The degree of attachment security and the concept of an "ideal child" were investigated by asking 83 mothers to describe the secure-base behaviour of either their own children or of an imagined "ideal child" using a German translation of Waters' (1987) Attachment Q-Set. Additionally, 11 German experts generated a "maximally secure" criterion sort, which was virtually identical with the established US criterion sort. Attachment security is highly desirable, as shown by the similarity between the profiles of the ideal descriptions and the security criterion sort. Two subsamples from Northern and Southern Germany showed similar intercorrelations of Attachment Q-Set subscales. We identified small differences in Northern and Southern mothers' perceptions of an "ideal" child in items relating to activity and independence. However, Northern and Southern mothers' descriptions of their toddlers did not differ in attachment security or dependence.

By particularly stressing the weaker labour market attachment of workers with non-standard contracts, this article contributes to the rather unexplored issue of mainly non-union-related reasons for leaving trade unions. Germany has been selected as a case study because German unions experienced a steady decline in membership, while at the same time non-standard employment arrangements increased considerably and more so than the European average. Using the German Socio-Economic Panel data, the authors construct a labour market attachment variable capturing different degrees of attachment. Their analysis shows the impact of labour market attachment and firm-level characteristics on union leaving and points especially to important differences across gender.

ABSTRACT The rate of recovery of stolen and hidden assets from fraud and other schemes is low. This paper explores two steps of the investigative sequence in pursuing domestic (onshore) asset recovery when the objective is to recover specific assets (or their equivalent value) lost to fraud or hidden for some other purpose: asset identification and location (tracing) and asset freezing. Before pursuing asset tracing and freezing, an attorney, a forensic accountant, and a client must consider various factors, including the cost and likelihood of recovery, as well as whether there are third parties (e.g., banks, lawyers, and accountants) from whom recovery may be sought. It is necessary to obtain certain basic identifying information for any suspect or target, as well as their associates, relatives, and friends. This information can be gleaned from electronic databases, surveillance, covert operations, interviews, and other sources. This article also covers the places where assets can be hidden, as well as the various asset freezing measures available in the U.S., such as attachment, replevin, garnishment, lis pendens, and injunctions. Numerous useful websites and databases are noted throughout the paper (a list is available as a downloadable Word document, see Appendix A). The article concludes with an analysis of the importance of protecting the attorney-client privilege for a non-testifying forensic accountant.

Is there any difference between dyadic and group attachment? Following Bowlby's (1982) beliefs, attachment is important across the lifespan: dependent on the early sensitive caregiving, we seek out for others ( family members, peer groups and lovers) to fulfill our different needs. The refined mental representations also include our experiences of receiving protection and care in groups and influence our perception and action in future situations. Based upon the AAP (George, 1999), which provides a developmental approach to the assessment of the dyadic adult attachment system, this study tries to extend the projective test by measuring patterns of group attachment. The AGAP-Test (Adult Group Attachment Projective Picture Test) contains a series of eight pictures that activate the unconscious "group attachment system" and tries to give via patients narrative insight in secure, insecure or disorganized schemes and defensive processes against anxiety, suffering and pain in repeated former experiences in groups. The AGAP Test is currently in development and used in the measurement of the change of group attachment related mental representations in individuals during long-term psychodynamic group therapy. The second approach tries to give insight into attachment related social unconscious processes such as defense and coherence via guiding the "group as unity" to absolve the projective test. For the "healthy" reference groups, the narratives of eight group analytic trainee groups at the GRAS (Gruppenanalyseseminar e.V.) Institute in Bonn, Germany, have been collected. To illustrate the effectiveness of aspects relevant to group attachment, the test is also frequently used in the supervision and further training of adult student groups.

Abstract:
Andrzej Wirth, a 20th century Polish essayist, philosopher and theatre critic, is one of the often forgotten theatre and drama scholars in Poland, perhaps due to his long life in exile. A recognized expert in theatre studies and philosophy, he has lectured at many universities around the world, especially in the United States and Europe. He gained particular recognition as the founder and director of the Institute for Applied Theatre Studies at the University of Giessen in Germany. The aim of this article is to introduce Wirth’s personality, outline his life between cultures and highlight his importance for the development of theatre studies in Germany, as well as his great contribution to the promotion of Polish literature in Germany in the mid-20th century. Andrzej Wirth’s life was beyond borders and divisions, although with a particular attachment to the culture of his homeland and Germany; he was rooted in childhood memories and a desire for theatre as a liberated art in an age of evolving media technologies.

Abstract Introduction: The theory of attachment is widely recognized (Ainsworth, Blehar, Waters, & Wall, 1978). This theory is based on four basic types of relationships. The sEMBU questionnaire does not focus on the relationships but parental behavior, however, parental behavior is the presentation of the relationship. Our goal was to determine the types of attachment and to obtain information about secure attachment by using cluster analysis. Methods: sEMBU primarily finds out about three basic patterns used in parental behaviour - rejection, emotional warmth and overprotection. We used the 23-item s(short)-EMBU which previously demonstrated to be satisfactory on the samples of students from Greece, Guatemala, Hungary, Italy, East-Germany, and Sweden (Arrindell et al., 2001). The Slovak translation of the original sEMBU was published in 2007 (Poliaková, Mojžišová, & Hašto, 2007). Since relationships are closely related to rejection, emotional warmth and overprotection, we tried to find behavioral patterns based on Bowlby’s attachment theory. We did not use standard procedures. Using cluster analysis, we also sorted the sample into four groups based on the presupposed attachment styles. Results: Overprotection (father) has the highest share for classification and differentiation in the cluster. Emotional warmth (mother) has the highest share for classification and differentiation in the cluster. We expected to find out that the secure type of attachment prevails over avoidance both in mothers and fathers. Conclusions: Our results surprised us; in the case of mothers, secure attachment did not occur at all. We suggest to continue in the research of the Slovak version of sEMBU focused on the types of attachment, especially on the secure type of attachment.

We investigated romantic relationships in a sample of 380 adolescents who formed 190 heterosexual couples (mean age: females 17 years; males 18 years): 173 intra-ethnic (German) couples and 17 inter-ethnic couples. Factor analyses revealed two types of love experiences: (a) experiences of attraction and a passionate focus on the partner (passionate love) and (b) experiences of affiliation (companionate love). No differences were found between intra-ethnic and inter-ethnic couples in romantic experiences, self-esteem, and conflict resolution skills. Adolescents in intra-ethnic couples had more close relations with parents than adolescents in inter-ethnic couples. Actor—Partner Interdependence Models (APIMs) showed that companionate love was indirectly predicted by the quality of attachment towards parents; this relationship was mediated by self-esteem and conflict resolution skills. Whereas the quality of girlfriends’ attachment to the father (not to the mother) predicted conflict resolution skills in romantic relationships, boyfriends’ conflict resolution skills were predicted by the quality of attachment to the mother (not to the father). Furthermore, cross-partner effects were observed: girlfriends’ experiences of companionate love were not only predicted by attachment to their own mother, but also by the relation between their boyfriend and his mother.

L’exécution forcée est une pierre essentielle à l’effectivité d’un système juridique. Ce constat, conjugué à l’omniprésence du compte bancaire dans les différents patrimoines a motivé cette étude sur l’état de la saisie en compte bancaire dans trois principaux modèles juridiques européens : la France, l’Allemagne et l’Angleterre. Un amalgame de convergences et de spécificités nationales en est ressorti, articulé autour d’une balance abstraite pesant les intérêts respectifs du créancier et du débiteur. A la confrontation entre droit à l’exécution du créancier et droit de l’exécution, qui garantit le respect des droits fondamentaux du débiteur, s’est ajoutée la prise en compte de différents intérêts susceptible d’être également présents : intérêt général, créanciers saisissants concurrents, collectivité de créanciers lors d’une procédure collective, etc. De plus, la protection spécifique de l’intérêt du débiteur-personne physique démontre la recherche des droits nationaux à protéger l’individu et sa dignité. Ce partage d’une philosophie de l’exécution interroge avec le phénomène d’européanisation des relations entre créancier et débiteur du au marché intérieur de l’Union européenne. Face au maintien de la fragmentation d’un espace juridique, coordonné par la politique de l’espace de liberté, de sécurité et de justice, l’Union a déjà posé la première pierre grâce à la procédure d’ordonnance européenne de saisie conservatoire. Grâce aux analyses des droits nationaux étudiés et à celle du droit européen, l’élaboration en deux temps d’une saisie d’exécution européenne en compte bancaire fut permise afin de bâtir une procédure européenne d’exécution forcée
Enforcement is essential for the effectiveness of a legal system. This observation, combined with the omnipresence of the bank account in the different patrimonies, motivated this study on the bank account attachment in three main European legal models: France, Germany and England. An amalgam of convergences and national specificities emerged, based on an abstract balance weighing the respective interests of the creditor and the debtor. In addition to the conflict between the creditor's right to performance and the civil enforcement proceedings, which guarantees respect for the debtor's fundamental rights, various interests that may also be present were also taken into account : public interest, competing between creditors, collective creditors in collective proceedings, etc. The balance between the creditor's right to performance and the right to enforcement was also taken into account. Moreover, the specific protection of the debtor's interest as a natural person demonstrates the search for national rights to protect the individual and his dignity. This sharing of a philosophy of enforcement raises questions with the phenomenon of the europeanisation of relations between creditor and debtor due to the internal market of the European Union. Faced with the continuing fragmentation of a legal area coordinated by the area of freedom, security and justice, the Union has already laid the first stone with the European attachment order procedure. Thanks to the analysis of the national laws studied and the analysis of European law, the development in two stages of a European attachment order for bank accounts was made possible in order to build a European enforcement procedure

Dit wil egter voorkom dat statutere regulering in Suid-Afrika ten aansien van sekere ondernemingsvorme ver tekort skiet, aangesien daar geen onafhanklike wetgewing in Suid-Afrika bestaan ten aansien van byvoorbeeld vennootskappe nie, anders as in ander werelddele. Daar kan derhaiwe tereg gese word dat die vennootskapsreg beskou kan word as die "stiefkind" van die Suid-Afrikaanse reg. Alhoewel daar steeds verskeie Ieemtes en anomaliee bestaan ten aansien van statutere gereguleerde ondernemingsvorme en harmonisering van sekere statutere bepalings daarop van toepassing, met bestaande wetgewing, wil dit voorkom asof die bestaande verwysingsbronne ten aansien van die vennootskapsreg en ander wetgewing ernstige anomaliee teweegbring, wat vervolgens selektief bespreek gaan word, met spesifieke verwysing na anomaliee wat bestaan in die toepassing van sekere bepalings van die Insolvensiewet ten aansien van vennootskappe.

Diese Arbeit untersucht die Relevanz der Herkunftsfamilie und ihre Auswirkung auf eine spätere Paarbeziehung im Blick auf Beziehungszufriedenheit. Dazu ist ihr Einfluss auf deren Mitglieder aufzuzeigen, die theoretischen Faktoren zur ehelichen Zufriedenheit darzustellen und empirisch zu verifizieren oder zu falsifizieren. Dadurch ist veranschaulicht, wie Zufriedenheit einer ehelichen Beziehung durch unterschiedliche familiäre Vorprägungen beeinflusst oder sogar „vorherbestimmt“ ist. Daraus ist weiter ersichtlich, inwieweit Zufriedenheit einer ehelichen Beziehung sich tradiert, oder ob für eine gelungene Beziehung nicht doch zu „arbeiten“ ist. Diese Inspektion zentraler Partnerschaftsmerkmale soll zu Fortschritten in der sozialpsychologischen und seelsorgerlichen Theoriebildung führen. Für eine Arbeit im Bereich christlicher Seelsorge ist auch zu fragen, inwieweit der Zuspruch des Evangeliums in konkreter seelsorgerlicher Beratung hilft, dass Paare trotz negativer familiärer Vorprägung zu ehelicher Zufriedenheit finden. Die eigene Ehe zu pflegen erfordert persönliche Sorgfalt sowohl für den Mann als auch für die Frau und individuelle seelsorgerliche Aufmerksamkeit durch die christliche Gemeinde.
This dissertation examines relevance and impact of family history on marital relationship in regard to partner satisfaction. Firstly, the family’s influence on its members is investigated; secondly, the theoretical factors of marital satisfaction are explained; thirdly, these dimensions are empirically verified or falsified. The study demonstrates the impact or pre-definition of family history on marital satisfaction. Furthermore, it answers if marital satisfaction can be passed on or if it has to be consciously developed. The thorough examination of central marital partnership dimensions is leading to an improvement of theory construction in sociopsychological and pastoral counselling terms. As this paper is concerned with Christian counselling, it considers, how Christian doctrine can be relevant in counselling couples displaying a negative marital pre-disposition, by helping them to achieve marital satisfaction. To care for a marital relationship, the carefulness of both partners, as well as the pastoral attentiveness of the Christian church, is required.

AbstractWhile immigration has played a major role in public debate in the UK over the past twenty years, citizenship and naturalisation have received much less attention. Polling data have suggested that the UK public is broadly supportive of the idea of giving long-term migrants the opportunity to become UK citizens (British Future, 2020). The UK Home Office, in its 2019 Indicators of Integration Framework, described citizenship as an “important bedrock to the integration of any individual in a society” (Ndofor-Tah et al., 2019: 18). Indeed, there is some evidence that becoming a citizen has a positive impact on economic and social integration. For example, the OECD (2011) found that naturalisation was associated with labour market outcomes of many groups of foreign nationals in France, Germany, Sweden and the United States, particularly for the most disadvantaged. Studies from Switzerland and Germany have also shown positive social and economic impacts of naturalisation (Hainmueller et al., 2017; Gathmann & Keller, 2018; but see also Bartram, 2019); and that those who naturalise increase their attachment to British Identity (Bartram, 2021).

Abstract:
Abstract This chapter traces the development from the cosmopolitan decadence of the 1890s to a nationalist poetry negotiated through the inclusion and exclusion of the East, evident in the works of poet Stefan George. It compares unpublished archival material from the Stefan George Archiv in Stuttgart to George’s later poetry symptomatically referred to as ‘aesthetic fascism’ and situates his work in the larger context of international conservative modernism. As evident from his early letters to his London friend, George stylized himself as the cosmopolitan decadent dandy, embracing symbolist and Orientalist trends from France, Italy, Belgium, and England, which he gathered in his publication of his Blätter für die Kunst and his translation of Baudelaire, Ernest Dowson, and D’Annunzio. The chapter reads his early poetic masterwork Algabal (1892), dedicated to and modelled on King Ludwig II, as a companion piece to Wilde’s Salome in which George celebrates attributes of decadent Orientalism in the poem’s Byzantine splendour. Similar to the influence of ancient architecture on Wilde’s Orientalist writing, George imported pieces of ‘exotic’ architecture into his cycle of poetry. At the end of the 1900s, his ideology gravitated towards a purified poetry acting as a self-critique of his own former attachment to decadent literature. Exclusive of foreign influences and expressive of a messianic vision to reform German culture through a Nietzschean vitalist rather than decadent programme, his later poetic cycles are in dialogue with cultural anxieties of a decline of the West as expressed by contemporary authors Theodor Lessing and Oswald Spengler.

Abstract:
In this chapter, the authors discuss the way culture has been scrutinized and debated in the social science literature especially in the fields of international business and economics. Following a series of classical “deep” descriptions of six focal countries, they explore the many classifications of culture that have emanated from quantitative dimensional analyses including the work of Hofstede, GLOBE, Schwartz, and others. They then turn our attention to eight value dimensions that have been linked specifically to economic performance, including social capital and cooperation, trust, redistributive justice, work centrality, risk-taking, individual achievement, education/training, and the importance of labor force attachment. In both their discussions of deep description and dimensional analyses, the authors point up how these emic (qualitative) and etic (quantitative) analyses have been used to classify Sweden, Germany, Italy, Spain, India, and the United States.

American approaches to Scripture grew even more diverse as other growing communities took their place in public life. Lutherans from Germany honored the Scriptures but continued their loyalty to Martin Luther’s German translation and accommodated only partially to the conventions of British-origin Protestants. Isaac Leeser was among a small but rising number of Jewish American biblical promoters who published many works to advance Jewish knowledge and use of the Hebrew Scriptures, including the first Jewish English-language translation. A number of Native Americans also demonstrated increasingly strong attachment to the Bible but still suffered systematic cultural deprivation. Meanwhile, a small group of ethnologists (George Gliddon, Josiah Nott, and Henry Hotze) broke with Protestant tradition to claim that empirical investigation overthrew the biblical notion of a common humanity in favor of polygenesis (the conclusion that “human kind” actually consisted of multiple separate species, with Africans always the lowest).

Abstract This chapter examines modernist urbanism, which broke the traditional bond between two-dimensional pattern and three-dimensional form. By the late 20th century, the New Urbanists claimed in their Charter of principles that architectural style had nothing to do with the urban pattern. New towns built after World War II in the modernist vein have the unmistakable imprint of functionalism, which, in practical terms, means separation. The street pattern of modernist housing developments was used to separate people by minimizing street connection. Some modernist housing arrangements, like Dammerstock in Karlsruhe, Germany, or the housing complexes of the southern part of Amsterdam, were driven by a formulaic attachment to the principles of maximizing exposure to sun and green space. However, green space did not provide a setting for social connection. The chapter then looks at the Soviet version of modern urbanism, considering mikrorayons (“micro-districts”) and socialist cities.

This introduction briefly places the 1970s into a longer history of homosexual emancipation in Germany, before moving onto the different ways historians have conceptualized gay liberation. The chapter calls into question the significance of the Stonewall Riots in New York City in 1969. For West Germans, the partial decriminalization of male homosexuality that same year was more important. Even so, 1969 was not a clear-cut turning-point. This introduction sets out the book’s central lens of analysis, ambivalence—the simultaneous attachment to conflicting feelings and attitudes. Drawing on queer, sociological, and psychoanalytic theory, the introduction advances three axes of ambivalence: pride/shame, normal/different, and hope/fear. This framework allows us to explore the tensions and complexities of the 1970s, as well as appreciate continuities in homosexual politics. Gay liberation was never simply the result of the more radical or the more confrontational outlook winning out over the forces of respectability and moderation.

Abstract:
Several pressurized water reactors have experienced primary coolant leaks as a result of degradation in the tubes and J-groove welds of reactor vessel head penetrations. Leakage has been attributed to primary water stress corrosion cracking (PWSCC) of the Alloy 600 nozzle material and Alloy 182/82 weld materials. More recently, other Alloy 600 components including reactor vessel bottom mounted instrumentation nozzles, dissimilar metal pipe welds, hot leg instrument penetrations, and pressurizer heater sleeves have exhibited degradation. Westinghouse has been actively involved in the development of a comprehensive Alloy 600 degradation management program including investigation of root cause, establishing a safety position, and developing inspection and repair/replacement strategies to address Alloy 600 degradation issues. Personnel from Germany, Sweden and the United States have cooperatively developed equipment and nondestructive examination technologies for identification and characterization of degradation that might exist in these Alloy 600 components and attachment welds. These developments represent significant enhancements to technologies and equipment previously available in the industry and are driven by the need to meet new inspection applications and industry requirements which have continued to evolve over the last several years. This paper describes the inspection capabilities available to support Alloy 600 degradation management programs, field experience with those inspection technologies, and the status of ongoing NDE development efforts to enhance future Alloy 600 inspection programs.
