Full textThe broad argument of atypical instruments of proof is in the centre of an animated debate between doctrine and jurisprudence about the right definition of the category itself for achieving the result of placing before a Trier of fact for consideration all of the evidences non allowed by law. The doctrine, from a side, approaches the matter maintaining a limited use of the new methods of investigation because the rules of evidence could be easily breached. The case law, at the other side, deals with unknown procedures in the light of the extreme effectiveness in criminal prosecution. The application of modern modes of checking events involves a double order of questions. In a first instant, we have to disclose whether the original practice of inquiry is allowable in the regulation of the Code. If the answer is favorable, in a second moment, we have to acquire the most correct way through which the image of fact can be handled in criminal trial. Actually statute law gives only few disposals. But the question whether and how an unexpected form of investigation is allowable in criminal system of law, requires first of all to fix that no mechanism, which is useful for discovery of truth, can be placed before a Trier in breach of the principles of Constitution. The human rights, granted by the constitutional law, provide ascertained bounds against arbitrary management of new methods of inquiry.

Full textINTRODUCTION: The hypothesis that nitric oxide (NO) can exert a pathogenetic role in psychiatric disorders has been supported by several evidence in the literature, but the manner in which attribute value to diagnostic / therapeutic of finding these changes yet been not well clarified. MATERIALS AND METHODS: The naturalistic observational study involved 25 patients with schizophrenia and 25 healthy controls of both sexes. Were administered the Structured Clinical Interview for DSM (SCID-II) for personality assessment and the PANSS (Positive And Negative Syndrome Scale) for assessing the size of positive, negative and general psychopathology of schizophrenia. Since blood sampling was performed the determination of nitrite and nitrate. The patients were all treated at baseline: olanzapine (OLA) 5-15 mg/day (n=9 pz), haloperidol (ALO) 3-10 mg/day(n=8 pz), risperidone (RSP) 2-6 mg/day (n=8 pz). RESULTS: The values of nitrate in schizophrenic patients were 30.92 à ± 6.05 M, while in healthy controls was recorded 26.78 à ± 6.31 M (p = 0.025). In intra-group comparison between patients in treatment: 38.9 à ± 2.77 M (ALO), 31 à à ± 1.08 M (RSP), 25.04 à ± 6.05 M (OLA), with a highly significant difference ( p <0.001). The scores of the PANSS were directly related to the alterations of NO: ALO vs. RSP: p = 0.006; ALO vs OLA: p <0.001 vs OLA RSP: p <0.001. CONCLUSIONS: The hypothesis that the levels of NO were related to presence of schizophrenia was confirmed by our research that shows statistically significant difference (p = 0.025) between patients and healthy controls in circulating levels of nitrates. Some drug treatments seem to normalize these alterations, with increased evidence for second-generation antipsychotics.

In the present essay some particular cases of atypicalness evidence were specifically investigated, which led up to inaccurate legal procedures affecting the fundamental rights of the individual (such as shadowing with gps, videos of non-communicative behaviors or online searches).

Full textThe aim of the present study is to analyze the “giudizio direttissimo” – one of the different forms that criminal trials can take in Italy – from the perspective of the Italian Constitution. In this particular kind of trial, the accused is immediately brought before the Court to be publicly judged, without any kind of preliminary hearing to assess whether the charge is well-founded or not. On one hand, the “giudizio direttissimo” seems to be consistent with the principle – laid down in the Italian Constitution – that a trial must be held within a reasonable time of time. Indeed, the omission of the “preliminaries” – that characterize the “ordinary proceeding” – allows a saving of one year and a half, when compared to the average length of the latter. On the other hand, the course of this kind of trial, in some cases, doesn’t seem to give the accused enough time to prepare an adequate defence. Moreover, its discipline seems to be lacking in some of the most important constitutional rights. A constitutionally consistent interpretation of the “giudizio direttissimo” might help to solve the aforementioned issues, by limiting its application only to the easiest cases. In addition, some case-law which is too rigorous for the defendant should be overridden.

Full textAmong the 45 Recommendations adopted under the WIPO Development Agenda, two indicate the preservation of public domain as a key task for firms, individuals and Member States. This study explores the notion of “public domain” in relation to trademark law, with particular reference to the challenging issue of how safeguarding it, avoiding misappropriation of signs which should remain usable by the public. Some studies have shown that legal instruments provided by trademark law to keep signs and certain forms of use free, risk not being appropriate counterbalances to prevent the misappropriation of public domain. A general exclusion from registration does not exist for many signs which are part of a communal heritage and even if a refusal for registration may be grounded on the lack of distinctiveness, this requirement may still be overcome, showing that the sign has acquired a “secondary meaning”. Furthermore, a look into the registers reveals that trademark right is often used as a vehicle to extend prior patent, design or copyrights, with great public domain’s concerns. At last, the space of public domain is endangered by the expanded protection of new types of marks and by the anti-dilution enhanced protection, which gave the registered trademark’s owner more general control over his sign, making it unavailable for socially and culturally valuable use, such as news reporting, criticism, review and parody. German case law was the first to address the issue of the safeguard of this room for free signs and uses, suggesting that trademark registration should be subject to a prior assessment of the opportunity that a sign remain public available (Freihaltebedürfnis). This interest raises from the observation of the negative impact that granting rights to certain types of trademark may have on market competition and led most countries to refrain from recognising trademark rights to descriptive and generic signs and functional shapes. Otherwise, by choosing these signs, right holders may acquire strategic competitive advantages on competitors whose marketing strategies and communication, deprived of the opportunity to use them, would result much less effective than that allowed to the trademark’s holder. This advantage has nothing to do with the essential function to guarantee the trade mark as an indication of origin and is therefore not justified in the light of the objectives underlying trade mark law. The ECJ, requested to preliminary ruling on whether this “need to keep free” should play any role in the European trademark law, answered contradictorily. Notwithstanding, courts still rely on public policy concerns in order to preclude or limit the trademark protection, such as the “color depletion” and the “functionality” doctrine used by U.S. Courts for granting protection to color or shape marks. This work suggests that public interest should still play a role as a key-factor in order to assess the distinctive character relevant both in registration and infringement proceedings and shares the view that wording should be added in the Trademark Directive and Regulation, that the assessment of distinctive character should take into account the “right to keep free”. This proposal becomes particularly actual in the light of the works in progress for reforming the European trademark legislation, which appear to have ignored the problem of striking the proper balance between trademark right and public domain.
