Abstract:
Chapter 4 discusses the US asylum bureaucracy. The number of asylum petitions increased in the post–Cold war era, creating a backlog of cases. This backlog, as well as growing concerns over the permeability of US borders, led to several reforms of the asylum system in the interest of national security. By the first decade of the twenty-first century, asylum seekers navigated a complex and impersonal bureaucracy that seemed more intent on deterring and deporting than in granting refuge. Today, the majority of asylum seekers navigate this complex bureaucracy without the benefit of legal counsel or even translators, minimizing their chances of a successful outcome. Many asylum seekers fall outside the defined categories of persecution, and their struggles to secure asylum raise important ethical and moral questions about who is deserving of protection.

Given the recent "re-politicization" of forced migration and refugees in Europe and the U.S., this edited collection presents an in-depth, multi-dimensional analysis of the history of policies and laws related to the status of refugees and asylum seekers in the U.S., Canada, and Europe and the challenges and prospects of refugee and asylum seeker assistance and integration in the 21st century. The book provides rich insights on institutional perspectives critical to understanding the politics and practices of refugee resettlement and the asylum process in the U.S., Canada, and Europe, including international human rights and humanitarian law as well as domestic laws and policies related to forced migrants. Issues addressed include social welfare supports for resettled refugees; culturally responsive health and mental health approaches to working with refugees and asylum seekers; systemic failures in the asylum processing systems; and rights-based approaches to working with forced migrant children. The book also examines policy developments and strategies to advance the well-being and social inclusion of refugees in the U.S. and Europe.

Abstract:
Asylum-seekers are those who have applied for international protection. Asylum status is still governed by the 1951 United Nations Convention relating to the Status of Refugees. ‘Refugees and asylum-seekers’ explains the changing geography of refugees and the causes and consequences of refugee movements. Refugees tend not to travel very far, putting strain on the poorest countries, and mostly settle in camps, which suffer from aid misappropriation. There are three durable solutions for refugees: voluntary repatriation, local integration, and third-country settlement. Each can be problematic and none is working well at the moment, as demonstrated by rising numbers of refugees, the increasing proportion of protracted refugee situations, and fewer returns.
