AbstractThe music industry has been made possible through performing rights based on a law introduced by the post-revolutionary French national assembly in 1791. However, it took until the mid-nineteenth century until a system of royalty collection was established in France (and another half a century or more in other countries). In France, this new system for non-dramatic performing rights was preceded by royalty regulations in theatres. This study describes how nineteenth century composers were compensated for their work in the Paris Opera through this performing right for drama, known as the ‘grand right’. The tariff-based compensation method had been put in place by a royalréglementin 1713. It created a classic winner-take-all phenomenon in which composers such as Auber, Meyerbeer, and Halévy thrived in the nineteenth century. A contributing fact was the opera house programming which, contrary to the programming of today, favoured new pieces. ‘Grand opéras’ were à la mode and they contributed to the financial success of their composers. However, these operas eventually lost their attraction. In 1884, the Paris Opera adopted a compensation system based on a percentage of box office revenues. The study is based on primary data for 1810–1866.

Abstract French Revolutionaries shared many of the same beliefs as their American counterparts about the relationship between citizenship and bearing arms. Both nations’ leaders viewed standing armies as a threat to freedom, and both nations required militia participation from a portion of the citizenry. Yet the right to bear arms is a legacy only of the American Revolution. The right to bear arms came up several times in debates in France’s National Assembly. The deputies never approved that right, but they never denied it either. During the first years of the Revolution, the leading politicians were wary of arming poor citizens, a concern that was in tension with the egalitarian language of the Declaration of the Rights of Man. Moreover, militias thrived during the early years of the French Revolution and became instruments—albeit unstable ones—for maintaining a social domination that played out along class lines. In response to the contradictions in their positions, French revolutionary leaders remained silent on the issue. In France as in the United States, the question of whether or not there was a right to bear arms was less important than the question of who had the right to bear arms.

In the decade after 1952 France faced sustained United Nations criticism of its colonial policies in north Africa. As membership of the UN General Assembly expanded, support for the non-aligned states of the Afro-Asian bloc increased. North African nationalist parties established their permanent offices in New York to press their case for independence. Tracing UN consideration of French North Africa from the first major General Assembly discussion of Tunisia in 1952 to the end of the Algerian war in 1962, this article considers the tactics employed on both sides of the colonial/anti-colonial divide to manipulate the UN Charter's ambiguities over the rights of colonial powers and the jurisdiction of the General Assembly in colonial disputes.

Abstract The harmful consequences of female circumcision for women’s health have been demonstrated and are regularly recalled by the World Health Organisation. Whereas in the past, the cultural dimension of the practice was emphasised, which result in impunity or absence of guilt, it is now considered by the United Nations as a violation of human rights, especially of the right to health. In 2012, the General Assembly asked States for a total ban on the practice. Despite the consensus on the punishability of female circumcision, its enforcement diverges, in particular in Western Europe. France is considered as a model in this area, that’s why this study focuses on it. Yet, under French law, there is no special legislation criminalising the practice: female circumcision is punishable on grounds of mutilation. However, the French success is not complete: the prevention of such acts could be improved.

Abstract:
The article analyzes the results of the first Emmanuel Macron’s presidential five-year term. The authors highlight that the period 2017–2022 proved to be a time of ambitious undertakings and difficult trials for France. The young president sensitively caught the French desire for change and set about solving urgent problems. The improvement of public finances and reboot of the economy, modernization of the administration of the Republic with expansion of “social lifts”, the return of France’s leadership in the European Union and strengthening of the EU’s position in the world – these were the main goals of Macron. Nevertheless, these plans ran into serious objections: inside the country – via the mass protests of working classes defending social guarantees and the opposition of parliamentarians facing the strengthening of presidential power, in the international arena – due to the EU problems and the rivalry of France with a number of other powers. The COVID‑19 pandemic has become a real “black swan” for the president, forcing him to adjust the initial settings. However, E. Macron had some achievements on his way – such as the Labor Code reform, political confidence laws, transformation of the ENA, development of the European Union initiatives, especially the Franco-German plan to save the EU economy during the 2020 pandemic. The authors conclude that despite Macron’s re-election, his second term will become very difficult: the loss of an absolute majority in the National Assembly in the June 2022 elections showed that a tripolar system has been formed in France, so the centrist Macron will have to take the positions of the extreme right and left forces into account when building his economic and domestic policy. As for his foreign policy, the main troubles lie in the serious aggravation of the international situation in Europe.

Abstract:
The article examines the problems faced during the presidential and parliamentary election campaigns of 2022 by the largest party of the right camp in France – the «Republicans» party. The paper emphasizes that the «Republicans» faced the tasks of both ideological equipment and the search for a recognized leader by all. A study of the actions of the «Republicans» candidate for president V. Pekress allows us to conclude that under the influence of a combination of structural and conjunctural factors, she could not become a figure capable of mobilizing right-wing voters and going beyond her political camp. She lost the battle for the center-right and right electorate to her competitors – President E. Macron and the leader of the right-wing populists M. Le Pen. Analysis of the results of the parliamentary elections showed that although the «Republicans» halved their presence in the National Assembly, thanks to the new alignment of political forces, characterized by the absence of an absolute majority in the pro-presidential bloc, a group of «Republicans»” found themselves in parliament as an arbitrator and gained new opportunities to influence the lawmaking process, which was deprived in the previous legislature. The author comes to the conclusion that the project of the «independent right center» suffered a crushing defeat in these elections, and the «Republicans» in the course of parliamentary practice can follow the path of actually turning into the right wing of the pro-presidential coalition.

Abstract:
This article discusses the results of French presidential election held on 10 and 24 April 2022. It is noted that electoral campaign has developed against the background of further fragmentation of the society, its transformation into a kind of «archipelago» with numerous internal confrontations. Yet, despite the series of crises during his presidency, Emmanuel Macron managed to maintain the support of high classes, which, along with a well-elaborated election strategy, allows him to be re-elected for the second term. At the same time, the expansion of the positions of Marine Le Pen, who consolidates her status as a main political force on the right flank and struggles for the electorate in so-called «popular» classes outside of large cities, is explored. Also, Jean-Luc Mélenchon’s result proving a certain popularity of far left agenda in France is noted, as well as the failure of mainstream parties. The author concludes that at this stage French political spectrum corresponds to a three-pole model, which for a number of reasons, however, may not be reproduced at the upcoming elections to the National Assembly in June. In any case, Macron’s second term will be difficult both in home and foreign policy terms. But for Russia, his re-election, even with some ambivalence in presidential approach to bilateral relations with Moscow, is likely to be a quite good scenario.

The movement on behalf of a new international economic order emerged in the early 1970’s and achieved an early, signal success with three great ventures in international lawmaking by the United Nations General Assembly in 1974 and 1975. These were the Declaration on the Establishment of a New International Economic Order, the Programme of Action on the Establishment of a New International Economic Order, and the Charter of Economic Rights and Duties of States. All three acts were adopted in the form of General Assembly resolutions, the first two by consensus and without formal vote, at the Sixth Special Session of the General Assembly. The Resolution on the Charter of Economic Rights and Duties of States, being pushed to a vote at the succeeding regular Annual Session, was adopted by 120 to 6, with 10 abstentions (with the United States, Great Britain, and West Germany among the negative votes, and France, Italy, Japan, and Canada among the abstentions).

Abstract:
The article analyzes the results of the presidential and parliamentary elections in France in 2022, which took place in specific conditions caused by the increase in energy and socio-economic problems in the country against the background of military operations in Ukraine. Despite the re-election of President E. Macron for a second term, the loss of an absolute pro-government majority in the National Assembly (the lower house of the French Parliament) following the parliamentary elections significantly complicated the implementation of his election program. In particular, the inability, as before, to constantly use article 49-3 of the Constitution of the country to adopt laws, in fact contrary to the opinion of deputies, required the President and the government to start searching for compromises and possible allies, as well as adjusting the political course. However, the significant strengthening of non-systemic political forces in the lower house of Parliament – the far-left «Unconquered France» and, especially, the far-right «National Association», the reluctance of the «Republicans» to enter into a coalition with the presidential majority complicates the plans of the Head of State. The prospects of further evolution of the country’s party-political system, as well as the preparation of the main political forces of the country for the next electoral cycle of 2027 are considered.

Abstract:
This thesis begins with some old questions about the French conservatism. Why has the French right failed to create a united party on the British model'? Why have conservatives so regularly turned to authoritarianism? More precisely, how is the emergence the Croix de Feu in the 1930s to be accounted for? Was it fascist? Did it pose a threat to the established order? These questions have been addressed by means of a detailed study of the right and the extreme right in one French department, the Rhone. It is argued that from 1870 until the early 1960s the French right was divided by two fundamental problems: the desirability or otherwise of industrialization and the legacy of the French Revolution, especially the historic quarrel over the place of the Catholic Church in French society. Neither of these issues were primary; what is important is the way in which they were related in the minds of conservatives. In the 1930s these problems became acute. The efforts of conservative governments from 1928 to 1932 to stabilize and modernize the Republic initiated, on the contrary, a process of fragmentation. Instability was exacerbated by the world economic crisis. By 1935 coalition politics had become impossible. Government could be carried on only thanks to the grant of special powers. This was the context in which the Croix de Feu emerged. The league represented a mobilization of the rank and file of the right against leaders who were perceived to have failed in domestic and foreign politics. Hence its combination of radicalism and reaction. It is argued that the Croix de Feu (though not its successor, the PSF) was a fascist movement. It is also suggested that in the period which ended with the "fascist riots" of 6 February, 1934, a crisis had been developing out of which a fascist regime might have emerged. But the formation of the Popular Front and its success in manipulating the French Republican tradition, prevented this crisis from developing beyond its early stages. The electoral victory of the Popular Front, the strikes of June 1936 and the dissolution of the leagues put paid to the fascist threat. But the right remained as unstable as ever. So authoritarianism survived in different ways. In the Rhone this crisis took the form of a breakdown of the liberal tradition which had dominated conservative politics since the 1840s, and which was deeply rooted in the silk industry. In the 1920s this liberal conservative tradition was concretized in the Chamber of Commerce and the Federation republicaine. From the end of the decade it was undermined from two directions. On the one hand th~re was a challenge from a coalition of Catholic integrists, merchant-manufacturers and large landowners who were worried by certain aspects of economic and social change. In the early 1930s this group won control of the Federation republicaine. On the other hand there emerged a reformist challenge to the liberal tradition. In the countryside independent peasant proprietors turned to the Jeunnesse agricole chretienne. In Lyon the bureaucratization and feminization of white collar work coincided with the formation of a Catholic trades union movement. The diversification of the economy led to the emergence of a challenge from engineering employers. In the late 1920s these groups were sympathetic to the parties of the centre right. During the crisis of the 1930s they turned to the Croix de Feu and the PSF.

The historiographic struggle over the representation of the Paris Commune, as begun by the daily press in 1871 and continued in the works of many subsequent scholars, is in fact part of a larger ideological battle. This thesis argues that in order to understand the significance of the Commune, it is necessary to return to contemporary writings. It studies the bourgeois reaction to the Paris Commune using as source material diaries, correspondence and monographs of upper class observers of the Commune. Through these writings, the Commune is seen as a socialist threat to bourgeois stability, and a sign of the disintegration of the ideals of the French Revolution.

"In 2001 after the 2000 election in Zanzibar, the Civic United Front (CUF) began planning a series of peaceful demonstrations to protest alleged fraud in the October 2000 presidential elections, calling for a rerun of the elections and constitutional reforms. The CUF notified the police of their intended routes, both the government officials and police immediately responded and announced that the demonstrations were banned. Police were ordered to use all force necessary to break up the demonstrations. The Tanzanian prime minister was recorded as stating that force would be used to break up the demonstration. According to him, "government has prepared itself in every way to confront whatever occurs ... any provocation will be met with all due forces of the state". CUF demonstrations, which were widely supported, took place on 27 January 2001 and as the unarmed demonstrators walked peacefully toward the four designated meeting grounds, security forces intercepted and opened fire without warning. They attacked the civilians, [and]ordered them to disperse [under] firing and beating. ... All these events occurred in the face of the fact that the Constitution of the United Republic of Tanzania (CURT) provides for freedom of assembly. The requirement of permits has been removed and section 40 of the Police Force Ordinance and 11(1) of the Political Parties Act were declared void on grounds that the requirement for a permit to hold an assembly infringed the freedom of peaceful assembly and procession enshrined in article 20(2) of the CURT. However the government limits these rights in practice, police have authority to deny permission to hold an assembly on public safety and security grounds. The relevant provision is section 41 of the Police Force Ordinance which permits any police officer to stop the holding of any assembly. The situation has not improved for opposition parties seeking to hold assemblies because of the way the police apply section 41. Rather than invoking this provision only in extraordinary situations as required, the police, once served with a notice of a planned meeting, issued prohibition orders claiming that they had information that the meeting was likely to cause chaos, but without giving evidence. ... These restrictions on the right to freedom of assembly and the excessive use of force by police officials as depicted in the above recounted incident and others of its kind, violate numerous provisions of international legal istruments to which Tanzania is a party. The Universal Declaration of Human Rights (UDHR) guarantees for the right to freedom of peaceful assembly and association, as does the International Covenant on Civil and Political Rights (ICCPR). The African Charter limits the right to assemble subject to necessary restrictions provided by law, in particular those enacted in the interest of national security and the safety, health, ethics and the rights to freedoms of other. But the African Commission has interpreted these claw back clauses to mean that the limitations must be in accordance with international law and thus the standards developed under the ICCPR, especially, would be relevant in determining when the rights to assemble may be limited. The exercise here is to examine the nature of the Tanzanian laws on the right to peaceful assembly and demonstration in the light of police practice having regards to the nature of the right as guaranteed under international human rights instruments." -- Introduction.

The purpose of this research is to explore the shifts in the rhetoric utilized by the European Far-Right political parties in response to terror attacks. The subjects of study are the National Front and Alternative for Germany within France and Germany respectively with both states having experienced attacks by Muslim terrorists within recent years. This study was conducted through the employment of Image Theory through a content analysis, specifically through the lens of the Barbarian and Enemy Images and if they can be observed in either party’s rhetoric. This shift in rhetoric can be seen expressed by both parties as they acted and reacted through their policy platforms over the years of observation.

La présente thèse porte sur l’effectivité du droit au logement, tel qu’il est conçu en droit français et sous la lumière du droit européen et international. La garantie de l’effectivité du droit au logement émerge en droit français depuis plusieurs décennies, ce qui témoigne le renforcement de sa portée juridique et sa reconnaissance progressive en tant que droit fondamental. L’étude du droit positif démontre que le droit au logement est destiné à être effectif grâce à ses multiples consécrations juridiques ainsi qu'au cadre juridique abondant et pointilleux le mettant en œuvre. Cependant, l’effectivité du droit au logement se heurte à de nombreux obstacles, liés aussi bien à l'identification de ses contours (son contenu et ses bénéficiaires) et ses débiteurs qu'à sa nature sociale dépendant du contexte socio-économique et des moyens matériels et juridiques dédiés. L’effectivité du droit au logement est ainsi souvent compromise ou remise en cause, ce qui révèle un problème en matière de qualité et d’articulation des règles juridiques relatives mais aussi un désengagement de la part des pouvoirs publics au profit d'une logique assistancielle. Afin de garantir le droit au logement, sa consécration juridique unique et solide, son adaptation aux évolutions socio-économiques ainsi que sa garantie par les pouvoirs publics en tant que droit fondamental sont indispensables
This thesis focuses on the effectiveness of the right to housing in French law, in the light of European and international law. The effectiveness of the right to housing has been an important issue in French law since several decades, which has strengthened its legal scope and has shown an acknowledgement of this fundamental right. The study of positive law shows that the right to housing is intended for being effective thanks to its multiple legal consecrations as well as its implementation thanks to an abundant and meticulous legal framework. However, the effectiveness of the right to housing comes up against many obstacles, linked both to the identification of its perimeter (its content and people who are entitled to this right) and its guarantors and its social nature depending on the socio-economic context and the material and legal means. The effectiveness of the right to housing is thus often compromised or reconsidered. That reveals quality and structure problems of the legal framework but also a lac k of engagement on the behalf of the state and local authorities, who limit their responsibility to strict assistance. The unique and solid legal consecration of the right to housing as a fundamental right, the respect of socio-economic developments and the responsibility of the state are necessary in order to fully assure the effectiveness of this right

Strike is a temporary action for a mass refusal of employees to work in order to ensure that their demands are met. It is called “Strike” in English (which means to break, to burn, to attack) because the first strike events occurred in England as which involved breaking the machines using brake blocks. Workers used to show their reactions towards their employer as by breaking the machines. The same phenomenon existed also in France. Workers in France used to leave their working places all together and go to the Greve area next to River Seine and seek solution to their problems in the cafes. This is how the concept of going on strike, Aller à la Grève (in French), was adopted by Turkish. Strike is a right for workers. It is to leave a workplace unanimously. It is not considered a reason for annulment of employment contract. It is legal and aims to ameliorate the working conditions. Workers should possess the same conditions as their employer in order to determine working conditions by their own free will. Although the employer seems to possess a stronger position as he/she owns the workplace, the workers may possess the same rights as their employers by becoming members of a trade union. When the workers and the employer are unable to reach an agreement on the working conditions, all the workers leave their workplace and go on strike. They partially or completely hamper the activities of the employer. During the strike the workers do not receive their salaries.

Abstract:
Geometric eccentricity here refers to the radial deviation (radial runout) of pinion or gear geometric center off its rotational center or axis. Such a typical manufacturing or assembly error in gear transmission exhibits inherent effects on the gear dynamic responses. Modeling of eccentricity has rarely been done for high speed right-angle gears such as hypoid or spiral bevel gears. In this paper, two modeling methods are proposed to quantitatively represent the eccentricity in the hypoid/bevel gear dynamic analysis. The first method is based on the loaded tooth contact analysis (LTCA) for a long shaft period. The LTCA results are then used to synthesize the corresponding roll angle dependent varying mesh model parameters. A second simpler method using translational kinematic transmission error (TE) modification is proposed to reduce the computational time. The effects of eccentricity on the gear dynamic responses are then investigated. The eccentricity excited low frequency shaft order dynamics is found to affect not only the overall level of vibration but also the high frequency mesh order responses. The sideband responses are simulated and characterized. This study is expected to improve the right-angle gearing system dynamic analytical capability and assist in guiding the manufacturing or assembly error tolerance specification.

It uses cutting-edge materials to build highly complex, safety-critical structures and parts. However, it still relies largely upon human skill and dexterity during assembly. However, as with any complex issue, the problems are multifactorial. Gene targeting (GT) is a much needed technology as a tool for plant research and for the precise engineering of crop species. Recent advances in this field have shown that the presence of a DNA double-strand break (DSB) in a genomic locus is critical for the integration of an exogenous DNA molecule introduced into this locus. This integration can occur via either non-homologous end joining (NHEJ) into the break or homologous recombination (HR) between the broken genomic DNA and the introduced vector. A bottleneck for DNA integration via HR is the machinery responsible for homology search and strand invasion. Important proteins in this pathway are Rad51, Rad52 and Rad54. We proposed to combine our respective expertise: on the US side, in the design of zincfinger nucleases (ZFNs) for the induction of DNA DSBs at any desired genomic locus and in the integration of DNA molecules via NHEJ; and on the Israeli side in the HR events, downstream of the DSB, that lead to homology search and strand invasion. We sought to test three major pathways of targeted DNA integration: (i) integration by NHEJ into DSBs induced at desired sites by specially designed ZFNs; (ii) integration into DSBs induced at desired sites combined with the use of Rad51, Rad52 and Rad54 proteins to maximize the chances for efficient and precise HR-mediated vector insertion; (iii) stimulation of HR by Rad51, Rad52 and Rad54 in the absence of DSB induction. We also proposed to study the formation of dsT-DNA molecules during the transformation of plant cells. dsT-DNA molecules are an important substrate for HR and NHEJ-mediatedGT, yet the mode of their formation from single stranded T-DNA molecules is still obscure. In addition we sought to develop a system for assembly of multi-transgene binary vectors by using ZFNs. The latter may facilitate the production of binary vectors that may be ready for genome editing in transgenic plants. ZFNs were proposed for the induction of DSBs in genomic targets, namely, the FtsH2 gene whose loss of function can easily be identified in somatic tissues as white sectors, and the Cruciferin locus whose targeting by a GFP or RFP reporter vectors can give rise to fluorescent seeds. ZFNs were also proposed for the induction of DSBs in artificial targets and for assembly of multi-gene vectors. We finally sought to address two important cell types in terms of relevance to plant transformation, namely GT of germinal (egg) cells by floral dipping, and GT in somatic cells by root and leave transformation. To be successful, we made use of novel optimized expression cassettes that enable coexpression of all of the genes of interest (ZFNs and Rad genes) in the right tissues (egg or root cells) at the right time, namely when the GT vector is delivered into the cells. Methods were proposed for investigating the complementation of T-strands to dsDNA molecules in living plant cells. During the course of this research, we (i) designed, assembled and tested, in vitro, a pair of new ZFNs capable of targeting the Cruciferin gene, (ii) produced transgenic plants which expresses for ZFN monomers for targeting of the FtsH2 gene. Expression of these enzymes is controlled by constitutive or heat shock induced promoters, (iii) produced a large population of transgenic Arabidopsis lines in which mutated mGUS gene was incorporated into different genomic locations, (iv) designed a system for egg-cell-specific expression of ZFNs and RAD genes and initiate GT experiments, (v) demonstrated that we can achieve NHEJ-mediated gene replacement in plant cells (vi) developed a system for ZFN and homing endonuclease-mediated assembly of multigene plant transformation vectors and (vii) explored the mechanism of dsTDNA formation in plant cells. This work has substantially advanced our understanding of the mechanisms of DNA integration into plants and furthered the development of important new tools for GT in plants.

Based on the proposal by the European Council, more than 25 heads of state and the World Health Organization (WHO) support development of an international treaty on pandemics, that planned to be negotiated under the auspices of WHO, will be presented to the World Health Assembly in May 2021. Given that the treaty alone is not enough to ensure compliance, triggers for a high-level political response is required. To this end, to inform the design of a support system, we explored institutional mechanismsi with a mandate to review compliance with key international agreements in their signatory countries and conduct independent country investigations in a manner that manages sovereign considerations. Based on our review, there is no single global mechanism that could serve as a model in its own right. There is, however, potential to combine aspects of existing mechanisms to support a strong, enforceable treaty. These aspects include: • Periodic review - based on the model of human rights treaties, with independent experts as the authorized monitoring body to ensure the independence. If made obligatory, the review could support compliance with the treaty. • On-site investigations - based on the model by the Committee on Prevention of Torture according to which visits cannot be blocked by state parties. • Non-negotiable design principles - including accountability; independence; transparency and data sharing; speed; emphasis on capabilities; and incentives. • Technical support - WHO can provide countries with technical assistance, tools, monitoring, and assessment to enhance emergency preparedness and response.

The COVID-19 pandemic has created enormous challenges for national economies, livelihoods, and public services, including health systems. In January 2021, the World Health Organization proposed an international treaty on pandemics to strengthen the political commitment towards global pandemic preparedness, control, and response. The plan is to present a draft treaty to the World Health Assembly in May 2021. To inform the design of a support system for this treaty, we explored existing mechanisms for periodic reviews conducted either by peers or an external group as well as mechanisms for in-country investigations, conducted with or without country consent. Based on our review, we summarized key design principles requisite for review and investigation mechanisms and explain how these could be applied to pandemics preparedness, control, and response in global health. While there is no single global mechanism that could serve as a model in its own right, there is potential to combine aspects of existing mechanisms. A Universal Periodic Review design based on the model of human rights treaties with independent experts as the authorized monitoring body, if made obligatory, could support compliance with a new pandemic treaty. In terms of on-site investigations, the model by the Committee on Prevention of Torture could lend itself to treaty monitoring and outbreak investigations on short notice or unannounced. These mechanisms need to be put in place in accordance with several core interlinked design principles: compliance; accountability; independence; transparency and data sharing; speed; emphasis on capabilities; and incentives. The World Health Organization can incentivize and complement these efforts. It has an essential role in providing countries with technical support and tools to strengthen emergency preparedness and response capacities, including technical support for creating surveillance structures, integrating non-traditional data sources, creating data governance and data sharing standards, and conducting regular monitoring and assessment of preparedness and response capacities.
