AbstractDelving into the nature of the creative process, attention is given in the article to particular kinds of emotions appearing in the course of the work of a creative person. Particular emphasis is given to the emotions the artist is guided by during the act of creation. The reflections presented in the text result not only from theoretical analysis, but also from the author’s experience in the process of creation. In this context they refer closely to the personal emotional sensations accompanying the author when painting pictures.The article distinguishes and analizes the concept of loneliness in artistic creation. Selected visual artists are recalled, who deliberately refer in their work to the experience of loneliness in the process of creation. The significance of artists belonging to creative community groups is also pointed out. Positive and negative aspects of experiencing loneliness by the creator in the act of artistic creation are also stressed.

Abstract:
The issue of composition in the artistic creativity of people suffering from schizophrenia has not been widely taken up by the researchers dealing with schizophrenic artistic expression. Those who wrote about the problems of composition mostly referred to familiar authors with schizophrenic disorders in the context of the course of their disease. The article aims to approach the issue of expression's psychopathology specifically dealing with the analysis of one element of the artistic work. Schizophrenic disorders provoke troubles with process of the arrangement, selection and information integration characteristic to specific thinking disorders of the delusional type. It is particularly visible in the composition of drawings and paintings.Most often one can encounter compositional presentations that have an open configuration based on symmetry which is predominantly figurative in nature, with ornamentation and decorative background. In the literature available in the Clinic of Psychiatry at the Medical Academy and Neuropsychiatric Hospital in Lublin there also prevail open figurative compositions based on symmetry with richer or poorer ornamentation. The issue of the composition's specificity in schizophrenic artistic expression is hard to judge objectively as most of the available works are shallow, schematic, open and without any depth or chiaroscuro. Difficulties in analyzing the compositional rules that are prevalent among people with those disorders are connected with the lack of objective methods, which could be helpful in working on that artistic material.

Abstract The complex nature of industrial design, which combines functional and aesthetic elements, allows for different modes of protection, with cumulative, separate or partially overlapping regimes applicable according to different legal systems. The legal framework is rapidly changing, especially in Europe where the principle of cumulation of a special sui generis regime for protecting industrial design with copyright rules has been established. Over the last decade, the national courts of some Member States construed the “cumulative regime” with a peculiar meaning, while other courts enforced design rights in line with the interpretation given by the Court of Justice of the European Union. The copyright/design interface is presented here to a wider, non-specialist audience, taking as a starting point the notion of industrial design derived from design studies, on the borderline between art and science. Other challenges which will need to be confronted urgently over the coming years are also raised.

The purpose of this contribution is to evaluate the jurisprudence of the European Court of Human Rights (ECtHR) in freedom of artistic expression cases dealing with visual and performance arts. The reasons for this particular evaluation are salient to the fact that the ECtHR has consistently provided a lesser level of protection to artistic expression than to political expression. The aim of this article is to challenge the approach of the Court to the freedom of artistic expression in relation to visual and performance arts. The critical evaluation is based on two different but complementary grounds: contemporary theory of art critique of the ECtHR’s understanding of art and critique based on the ECtHR’s own political freedom of expression cases. The argument of the authors is that the ECtHR approach to visual and performance arts as an exercise in ethics and aesthetics is contradicted by contemporary art theory and practice which invariably assumes the societal role of art, its potential subversive and transformative function within a society at large, and, ultimately, its lato sensu political value. In addition, visual and performance arts are powerful yet fragile instruments for delivering the debate to society at large. Viewed from this perspective, artistic expression has the same beneficial effect on a democratic society as political expression stricto sensu. Therefore, the rationales underpinning protection of political expression are essentially the same as those of artistic expression, therefore the ECtHR should extend the same level of legal protection to arts and artists to keep valuable social dialogue alive.

Background. It is known that the customs, traditions, material and spiritual riches of the Turkic peoples belong to the great poet A. Thanks to Navoi's sharp intellect and artistic thinking; it has become an immortal property of our spirituality. Therefore, the creative heritage of the great poet is important not only as a work of art, but also as a unique historical and ethnographic source of culture of life of the Turkic peoples, including the Uzbek nation. This article examines the works of Alisher Navoi, depicting the way of life, culture, socio-political, theological and mystical worldview of the Turkic peoples, and even the ancient mythological ideas and some of the customs and rituals associated with them. The traditions of the poet's lyrical, lyre-epic works are an important source for studying the history and spiritual world of the Turkic peoples. Methods. In the article A. In order to clarify the place of folk traditions in Navoi's lyrical heritage, comparative-typological, analytical methods were used. Results. In the works of Alisher Navoi, a special place is given to the depiction and interpretation of plates related to the way of life, culture, socio-political, divine and mystical worldview of the Turkic peoples, and even ancient mythological notions and some customs and rituals associated with them. Such works of art, which are recorded as "ethnographic folklorisms", have played an important role in enhancing the national and realistic spirit of the poet's works, their artistic impact. Conclusion. Navoi's works contain valuable artistic details related to the way of life and customs of the people, which can provide important information in the study of the history of life of the people of that period.

While there is no “expressive theory of sport”, there is certainly, according to Hyland (1984, 1990), Osterhoudt (1973), Kerr (1997) and Weis (1969) a pivotal role played by emotions and feelings in sport which amount to a type of expressive theory and in that sense it parallels expressive theories in art. In this article I will first isolate three moments that capture sports performance and parallel art. Then, I will describe sport as an expression of emotional release, which is often how one understands art. Based on such overlaps, I will argue for two philosophical observations that devolve from such a comparison, namely ineffability and the unity of mind-body (in sport). Finally, I will apply a reading of Kant to sport, in order to substantiate the idea that sport, like art draws from a philosophical heritage.Imagine three isolated “steps” in sport: the focus before performance; the performance itself and the fan’s response as they articulate the emotional basis of sport which is familiar, albeit perhaps subconscious. After a brief analysis of these imagined images, I give a simplified historical outline of sport which describes the feeling-basis of play that forms the foundation for modern sport. I then examine what I have termed the “(surplus) expressive-energy theory of sport” which I have gleaned from the above writers, a theory that argues that sport is the expression of inner emotional states. Such states are in need of expiation of both the practitioner as well as the expression of certain basic emotions on the part of the audience. A narrower version of this theory is that sport is the release of aggressiveness, which coheres with its instinctual origins and the “surplus theory”. A critique of sport as expression (of surplus energy, aggression…) follows with a view to highlight some shortcomings in the ideas presented and thus the need for further theories to account for the multi-faceted nature of sport, a similar requirement that is needed for art given the shortcomings of expressive theories as applied to the arts.

Abstract Artistic freedom of expression is guaranteed under the 1995 Constitution of the Republic of Uganda and other international instruments. This paper examines its application in all forms of art including paintings, music, poetry, novels, and plays. The paper examines the different legislation used in the restriction of artistic freedom of expression. It argues that these restrictions are contrary to the guarantees of freedom of expression provided in the Constitution and in various regional and international instruments. Part I of this paper gives a historical background to artistic freedom of expression noting how it has been suppressed since colonial times. Part II examines international protection of artistic freedom of expression while Part III analyses the protection of artistic freedom of expression in Uganda as guaranteed by the Constitution. Part IV analyses the legislation limiting artistic freedom of expression and highlights how these are incompatible with international and local human rights standards. Part V puts forward the case for artistic freedom of expression. Finally, Part VI provides the conclusion.

Abstract:
Courts of different jurisdictions (including the ECtHR) tend to employ the notion of “artistic expression” intuitively. Definitional attempts are rare (see e.g. the ruling of the Canadian Supreme Court in Sharpe). One may postulate that “artistic” is the expression which is rooted in the sphere of sensitiveness of an individual appealing to the same sphere of other individuals. The consequence of such understanding of artistic expression is that it is designed to “offend, shock and disturb” (i.e. to appeal to human feelings) by its definition. A further consequence is that artistic expression should be likely to have impact on the public order. However the case-law of the ECtHR proves that it happens only when artistic expression is contaminated by political elements. Purely artistic expression seems indifferent to the public order.
