Full textThe main objective of this paper is to critically analyse the solutions that countries are currently implementing in response to the much-debated issue that the conventional investor-state dispute settlement (ISDS) regime limits a host-state's space to make regulations under public policy. Consequently, the paper makes recommendations on viable solutions that countries can implement as solutions to the ISDS problems. In order to conduct the study, this paper uses the solutions to ISDS problems that have been implemented by the Republic of South Africa (RSA) and Australia respectively. The paper also compares the solutions implemented by RSA and Australia with some internationally recognised solutions. Chapters two and three of the paper discuss the backgrounds and also analyse the solutions to ISDS that have been implemented by RSA and Australia respectively. Chapter four contains the main findings and arguments of the paper. It analyses the strengths and weaknesses of the ISDS solutions that have been implemented by RSA and Australia respectively. One of the main findings of the paper is that retaining the conventional ISDS regime is less beneficial to developing and least developed countries and more beneficial to developed countries, largely due to the differing levels of outward investments that are present in these categories of countries. The paper recommends, inter alia, that, unlike developed countries, developing countries and least-developed countries should abrogate the conventional ISDS regime and only retain it in particular circumstances as explained in chapter five. The paper recommends that ISDS should only be utilised where state-state arbitration would unnecessarily politicise an investment dispute. The paper also finds the use of domestic court as undesirable to investment disputes. The paper recommends mediation as a more balanced avenue for resolving investment disputes.

Full textThis thesis is an inquiry into the possibility of Aboriginal autonomy under the regime of a state policy which commands self determination. Debate about policy has been dominated by Western scientific, political and professional knowledge, which is challenged by indigenous paradigms grounded in the Dreaming. A recognition of the role of paradox leads me to an attempt at reconciliation between the old and the new Australian intellectual traditions. The thesis advances the theory of internal colonialism by identifying self-determination as its current phase. During more than 200 years of colonial history the relationship between Aborigines and the state has been increasingly contradictory. The current policy of self-determination is a political paradox. Aboriginal people must either conform to the policy by disobeying it, or reject the policy in obedience to it. Through the policy of self-determination the state constructs a relationship of dependent autonomy with Aboriginal people. In a two-year (1994-95) action research project Kitya Aboriginal Health Action Group was set up to empower a local community to establish an Aboriginal health service despite opposition from the Government Health Service. In collaboration with local general practitioners and volunteers the action group opened a health centre. After the end of formal field work government funding and support for the health service was granted. The project illustrated the paradox of dependent autonomy. What appeared as successful community development was not development, and what appeared as destructive factionalism was empowering. Strategies for change made use of contradictions and paradoxes within the state. As an innovation in the practice of social change, the thesis begins the construction of a model for indigenous community action for self-determination in health.

Det är ofta svårt och / eller smärtsamt att använda dessa enheterna, särskilt för oerfarna användare. Simstream vill bygga en innovativ smart TV som centraliserar funktioner och kontroller så mycket som möjligt. Att använda systemet ska vara intuitivt och enkelt, men mer erfarna användare ska också ha tillgång till mer avancerade funktioner. Detta kräver att förvärva flera indata samt att integrera kommunikationsenheterna som är nödvändiga för att kontrollera de anslutna externa enheter. När det är möjligt vill vi behandla varje indata på ett effektivt sätt oh samtidigt minimera latenser. Det här betyder att en operation som utförs ofta skall vara så snabb och så lätt som möjligt, för att förbättra användarupplevelse även när systemet är hårt belastad. Detta projekt drar fördel av den vidsprädda tillgången till pekskärma mobila enheter för att tillföra användaren en innovativ kontroll över sin TV, direkt från sin bekanta enhet. Slutligen kommer denna plattformen att vara öppen för tredjepartsutvecklare, och som ett resultat har detta examensarbete utvecklat ett software development kit som är gjort för att vara enkelt och välbekant nog för att utvecklare ska kunna använda det och skapa applikationer med det.
