Abstract:

It is against the backdrop of the conceptual impairment inherited from the Articles on State Responsibility (hereafter ASR) that this note, rather than zeroing in on what could have been better devised at the micro-level of the Articles on the Responsibility of International Organizations (hereafter ARIO), adopts a holistic view on the approaches to the law of international responsibility. In so doing, the ARIO are not approached in isolation but together with the ASR. This paper argues that, envisaged together with the ASR, the ARIO magnify the structural straits of the law of international responsibility. It more particularly argues that the ARIO reveal that the minor and almost invisible defects at the level of the ASR have enlarged on the occasion of their transposition to the responsibility of international organizations, unveiling the conceptual fissures of the whole law of international responsibility (Section 1). It then formulates a few epistemological considerations on how a normative instrument that so openly lays bare the limits of the current law of international responsibility could nonetheless be usefully received by our professional community (Section 2).

Abstract:

In view of the adoption and future reception of the Articles on the Responsibility of International Organizations (ARIO) on second reading, this contribution seeks to offer some reflections on the ‘copy-paste narrative’ that has characterized the process of drafting the ARIO by the International Law Commission (ILC). On the basis of a brief introduction to the concept of analogies in international law, it is explained that the use of analogies is not to be equated with a mechanical exercise of copy-pasting legal rules; rather, it constitutes a method of legal reasoning based on a principled assessment of relevant similarities and differences. By comparing the ARIO with the ILC’s Articles on State Responsibility (ASR), it will be demonstrated that the ARIO actually do not follow the example of the ASR in many key provisions. Interestingly, much of the critique of the ARIO has been directed against these dissimilar provisions, especially when they concern the relations between an international organization and its member States. Since this critique is mainly driven by considerable uncertainty as to the determination of the responsible actor(s), it will be suggested that the ILC should have used closer analogies with the ASR in order to enhance the overall coherence of the law of international responsibility. This is because, as argued in conclusion, the corporate complexity of international organizations and States may necessitate a unified set of Articles on International Responsibility.

AbstractThis paper discusses the role of the so-called 'rules of the organization' in the draft Articles on the Responsibility of International Organizations (ARIO), as adopted by the International Law Commission (ILC) on second reading in 2011. Although the rules of the organization occupy a central place in the ARIO, the ILC has decided not to take a “clear-cut view” on their legal nature as either international law or internal law of the organization. This paper argues that the ILC's indecision has left the ARIO with a fluctuating scope of application concerning various provisions such as the attribution of conduct, the breach of an international obligation, the obligation to make reparation, and countermeasures against an international organization. The term of art 'rules of the organization' was developed by the ILC in its work on the law of treaties but has rarely been addressed in legal scholarship. Part 1 therefore first examines the legal nature of the different components of the so-called 'rules of the organization': the constituent instruments, the acts, and the established practice of the organization. While the constituent instruments are contracts between States at the moment of the creation of an international organization, it will be contended that they also operate as constitutions during the life of the organization, giving it the autonomy to create internal law in force between the subjects of its legal order, including its member States. In analysing the ARIO on second reading, Part 2 accordingly suggests reconceiving the rules of the organization as 'internal law' of the organization as long as it functions effectively, so as to appropriately reflect its constitutional autonomy for purposes of international responsibility.

En este artículo se traza un primer acercamiento a las características morfológicas y semánticas de los derivados en -ari- y -ario a partir de un corpus de unidades léxicas derivadas presentes en el español mexicano. Tras plantear y justificar la existencia de un sufijo -ari- y un sufijo -ario que conviven en la lengua, se describen los procesos mediante los cuales se generan este tipo de vocablos desde una clasificación minuciosa de sus propiedades morfológicas y semánticas. De esta manera, se atiende a la necesidad de realizar estudios puntuales de los diversos sufijos derivativos de la lengua española apelando a aspectos que competen a distintos niveles gramaticales.

Abstract:

Abstrak. Penelitian dilakukan dengan tujuan untuk mendeskripsikan unsur-unsur intrinsik yang terdapat pada naskah drama Maaf, Maaf, Maaf: Politik Cinta Dasamuka karangan N. Riantiarno berupa tema, fakta cerita, dan sarana cerita. Metode yang digunakan dalam penelitian ini menggunakan metode kualitatif dengan tehnik analisis struktural Robert Stanton dan simbol teatrikal Radhar Panca Dahana. Penelitian dilakukan di Jakarta pada tahun 2013-2014. Simbol teatrikal dalam naskah dapat digunakan sebagai penunjang proses kreatif sebuah pementasan drama. Hasil penelitian ini menunjukkan bahwa: (1) alur cerita pada naskah drama Maaf,Maaf, Maaf: Politik Cinta Dasamuka karangan N. Riantiarno bersifat progresif danberbentuk kronologis. Terdapat satu tokoh utama dengan dua puluh dua tokoh bawahan, dengan latar naskah berada di rumah kediaman keluarga Ario. Tema mayor yang terdapat ialah kekiasaan dengan tema minor yaitu keluarga. (2) Dari hasil ini ditemukan bahwa N. Riantiarno menggunakan simbol teatrikal secara lengkap, yakni ikon spasial, ikon relasional, dan ikon metafora. Hubungan ikon spasial dengan tanda acuannya ialah hubungan yang terjebak di antara ruang realitas dan ruang imajiner, sehingga interaksi dengan tokoh lain harus memunculkan ruang baru. Hal ini ditandai dengan kesadaran ruang tokoh lain selain Ario. Ikon relasional yang terjadi ialah dua jenis hubungan yang terjadi antara Ario dengan tokoh bawahan. Ikon metafora ditandai dengan gaya bahasa metafora yang digunakan untuk mengungkapkan perasaan secara tidak langsung berdasarkan persamaan dan perbandingan antara Ario dan Tokoh lain. (3) Gambaran untuk mempermudah pementasan drama berkaitan dengan ikon spasial akan mempermudah penciptaan setting panggung, tata lampu, kostum, make up, dan dekorasi panggung. Berkaitan dengan ikon relasional akan mempermudah penghayatan antar tokoh, pendalaman karakter, hubungan emosional, dan motivasi gerak, dan berkaitan dengan ikon metafora akan mempermudah pengucapan dan pelafalan sesuai dengan keadaan emosinal tokoh, memberikan panduan gesture,dan memberikan pedoman laku. Abstract:

International organizations may be regarded as international public authorities, since their acts increasingly impinge on individuals, private associations, enterprises, States, or public institutions. However, this development has not been followed by the creation of a corresponding system of international legal responsibility for international organizations. Some are even seen as a risk to fundamental rights. The Articles on Responsibility of International Organizations (ARIO) bring some progress in this regard, but nevertheless leave the victims of human rights violations largely overlooked. The article analyses some of the achievements and gaps of ARIO with respect to human rights protection and explores the possibilities for victims of human rights violations to seek remedies against international organizations.

Abstract:

Refugee camps are often managed by a wide set of actors other than the Host State. The United Nations High Commissioner for Refugees (unhcr), tasked under international law to provide “international protection” to refugees and to seek “permanent solutions for the problem of refugees”, often sub-contracts the daily management of camps to non-governmental organizations (ngo). In 2013, unhcr collaborated with 733 ngos worldwide. Together with unhcr, these “implementing partners” often perform public powers normally exercised by the Host State. But when human rights violations occur following the conduct of a unhcr implementing partner, which actor(s) are responsible under international law? This article focuses on unhcr’s international responsibility for the conduct of ngo implementing partners. By exploring unhcr’s standard sub-contracting agreements through the lens of the International Law Commission’s (ilc) Articles on the Responsibility of International Organizations (ario), it answers questions such as: Which human rights requirements does unhcr place on implementing partners? Under what circumstances may unhcr be held responsible under the ario for the acts of its implementing partners? It finds that an application of the ario would make unhcr internationally responsible for the wrongful conduct of implementing partners, even when sub-contracting agreements include clauses absolving unhcr from any liability.

Abstract:

Il presente elaborato ha come obbiettivo l'implementazione di un codice numerico per la simulazione dell'arco elettrico in aria. Il software utilizzato per la risoluzione del problema è il toolbox open source OpenFOAM. Il modello utilizzato tiene conto dei complessi meccanismi che governano la scarica in aria, come l'interazione magnetofluidodinamica e lo scambio termico radiativo. La prima parte del lavoro di tesi è stata incentrata sulla realizzazione di un codice Matlab, che utilizza il metodo agli elementi finiti per risolvere i problemi elettrodinamico e magnetostatico, con lo scopo di controllare i risultati forniti da OpenFOAM. Nella seconda parte, si è proceduto alla modifica di un solver preesistente, chiamato icoFoam, per renderlo adatto alla risoluzione del caso in esame. Vengono infine discussi i risultati ottenuti e le prospettive future del lavoro svolto.

On the first stage the seeds were evaluated in regard to the physiological and sanitary quality at different substrates and temperatures, as well as to the the process of imbibition and hydric restrition. A three-phase pattern of seed imbibition, was observed, germination decreased from the osmotic potential of -0,6 MPa and increased in sand at the temperature alternating from 20 to 30? C in both species. However, sanitary quality was greatest in fungicide treated seeds with removed aril. The results have pointed out that the seeds from both species presented highest percentage of germination upon aril removal, regardless the seed extremity cutting-off. On the second stage seed extracts were obtained with organic solvents of different polarities. These extracts were identified by classes and a sensibility test was performed with Lactuca sativa L. seeds. Steroids and triglicerides were detected in the dichloromethane extract, carbohydrates were detected in methanol extract. Lettuce seeds germination was inhibited by the dichlorinemethanol extract and increased the members of abnormal seedlings and hard seeds.<br>O presente trabalho foi realizado na UFRRJ, em Serop?dica, RJ, com a finalidade de estudar a influ?ncia do tegumento e do arilo na germina??o de sementes de duas esp?cies de Passifloraceas, Passiflora edulis f. flavicarpa Deg. e Passiflora alata Curtis., obtidas de frutos oriundos de lotes comerciais, adquiridos no CEASA RJ. Na primeira etapa, as sementes foram avaliadas quanto ? qualidade fisiol?gica e sanit?ria, em diferentes substratos e temperaturas, bem como o processo de embebi??o e de restri??o h?drica, nos quais se constatou o modelo trif?sico de embebi??o das sementes, redu??o da germina??o a partir do potencial 0,6 MPa, melhoria da germina??o em substrato areia e na temperatura alternada de 20-30?C, em ambas as esp?cies. Contudo, a qualidade sanit?ria foi maior nas sementes onde foi aplicado fungicida e onde o arilo havia sido removido. Os resultados indicaram que sementes de ambas as esp?cies apresentaram maior porcentagem de germina??o na aus?ncia do arilo, independente do desponte. Na segunda etapa foram obtidos extratos com solventes org?nicos de diferentes polaridades, identificadas ?s classes de subst?ncias presentes e realizado teste de sensibilidade dos mesmos com sementes de Lactuca sativa L. Foram detectados no extrato obtido com diclorometano triglicer?deos e ester?ides; e carboidratos no extrato metan?lico. O extrato diclorometano inibiu a germina??o de sementes de alface, aumentando o n?mero de pl?ntulas anormais e sementes duras, indicando que as subst?ncias contidas nesse extrato influenciaram o processo germinativo.

Abstract:

The aim of this thesis has been to develop a proposition for a new type of snail barrier, whose function is not based on the use of toxic chemicals or electric current. We have mainly used Fredy Olsson´s methods described in the compendium "Princip- och primärkonstruktion" After a thorough review of previous research and the accompanying definition of criteria, we sketched out six different propositions. By weighting the criteria in a Kesselring matrix, we selected one of the proposals for further development. The main criteria we had to take into account were; the weight of the product, the ability to recycle the material, the price and that it would be modular. The work has resulted in the development of a product that meets all the criteria, and is ready for manufacturing, though field conditions tests that can confirm the effectiveness remains to be done.

Abstract:

This dissertation reports on a study developed at LETRA - Laboratory for Experimentation in Translation, Faculdade de Letras, UFMG. Building on Catford's (1965) foundational work on translation and Matthiessen's (2007) proposal of systemic functional translation studies of multilingual production and translation, it presents three different and complementary approaches to examine equivalence relations between two verbs in the pair English-Portuguese, SAY/DIZER. Equivalence is looked at from an empirical perspective drawing on data gathered from translated and non-translated fiction in both languages and in both translation directions. Using the methodology of corpus linguistics for quantitative data analysis (WordSmith Tools and SPSS - Statistical Package for the Social Sciences) and a combined corpus (comparable and parallel) compiled to that end, equivalence relations are studied from a three dimensional perspective. The first approach analyses the functions of SAY/DIZER in non-translated texts, describing functional meanings realized by these verbs, according to the metafunctional theory in systemic functional linguistics (Halliday and Matthiessen, 2004). Commonalities and differences are considered as the first step in order to look at equivalence relations. The second approach investigates the originals and their translations to search and account for possible equivalents as well as their probabilities of occurrence. Both unconditioned and conditioned probabilities of equivalence, as proposed by Catford (1965), are examined. The third approach analyses the use of SAY/DIZER in translated texts, comparing patterns in translated and non-translated texts in order to examine how the relations among the texts condition the different patterns found. Occurrences in the original texts that were translated as SAY/DIZER are also examined in order to account for possible equivalents. Results point to different patterns of these verbs, relating to their functions and to equivalence relations.<br>Esta tese insere-se nos estudos sistêmico-funcionais da tradução e aborda as relações de tradução de SAY/DIZER em textos ficcionais no par lingüístico inglês-português. Adotando uma perspectiva empírica de observação de dados em corpora paralelos e comparáveis, este trabalho desenvolve três abordagens de análise. A primeira abordagem, a partir da fundamentação teórica da lingüística sistêmico-funcional (Halliday e Matthiessen, 2004), descreve as funções das orações verbais realizadas por SAY/DIZER em textos ficcionais não-traduzidos, isto é, em textos originalmente escritos em inglês e português, respectivamente. A segunda abordagem, a partir da proposta de Catford (1965) de análise das probabilidades condicionadas e incondicionadas de tradução, observa as relações de tradução de SAY/DIZER em corpora paralelos bidirecionais constituídos por textos originais e suas respectivas traduções no par lingüístico inglês-português. A terceira abordagem investiga as relações de tradução de SAY/DIZER sob a perspectiva de análise das propriedades de textos traduzidos, segundo a proposta de Teich (2003). O corpus da pesquisa, composto de três romances originais em inglês e suas traduções para o português e três romances originais em português e suas traduções para o inglês, faz parte do CORDIALL (Corpus Discursivo para Análises Lingüísticas e Literárias) desenvolvido pelos pesquisadores do LETRA (Laboratório Experimental de Tradução) da Faculdade de Letras da UFMG. A metodologia da lingüística de corpus é aplicada na análise deste corpus, denominado corpus combinado, que, devido as suas características, amplia o campo de observação do pesquisador, gerando dados mais abrangentes. Os programas WordSmith Tools e SPSS (Statistical Package for the Social Sciences) são utilizados para a extração de dados quantitativos e estatísticos e para a construção do banco de dados da pesquisa. Os resultados apresentam uma visão abrangente das relações de tradução de SAY/DIZER em textos ficcionais. Verificou-se que as orações verbais com SAY/DIZER realizam funções experienciais e interpessoais na introdução do discurso, apresentando padrões distintos no inglês e no português. Foram apresentados os equivalentes possíveis de SAY/DIZER, segundo as ocorrências do corpus, detectando-se padrões distintos nas relações de tradução, conforme a direção seja do inglês para o português ou do português para o inglês. Por fim, a análise aponta resultados que se mostram produtivos para a descrição sistêmico-funcional do português e para os estudos da tradução.

O ato de realizar pesquisas na Web tem sido o mesmo por anos. O usu´ario realiza uma consulta composta de termos, e o motor de busca ´e respons´avel por encontrar as melhores respostas `aquela consulta. Frequentemente, existem informa¸c˜oes subjetivas que o usu´ario n˜ao consegue transmitir em sua consulta, mas que ele espera que o motor de busca seja capaz de inferir. Isso leva a resultados que s˜ao relacionados `a sua consulta, mas n˜ao aos seus interesses. Uma forma de mitigar esse problema foi a introdu¸c˜ao da Web Semˆantica, que visa a permitir que os dados dispon´ıveis na Web tenham um sentido, ou seja, uma semˆantica. Diversas abordagens de busca na Web Semˆantica tˆem sido propostas e implementadas nos ´ultimos anos, bem como abordagens para classifica¸c˜ao (ranking) de resultados. Esta revis˜ao sistem´atica da literatura tem por objetivo identificar as tendˆencias na ´area de ranking de relacionamentos na Web Semˆantica. De um total de 1.194 artigos inicialmente retornados em nossa pesquisa, foram selecionados e analisados 10 estudos prim´arios nesse tipo de ranking, dando-se especial aten¸c˜ao `as caracter´ısticas das t´ecnicas adotadas e aos experimentos realizados. Observou-se ent˜ao que novas solu¸c˜oes promissoras envolvem o uso de algoritmos de aprendizado de m´aquina para realizar o ranking dos resultados das consultas.

A rob´otica, como recurso tecnol´ogico para a educa¸c˜ao, propicia a demonstra¸c˜ao pr´atica de conceitos te´oricos que integram diversas ´areas do conhecimento. De forma criativa e l´udica, os robˆos podem ser usados em ambientes formais de aprendizagem e em espa¸cos cient´ıficos interativos para facilitar o aprendizado e despertar o interesse de estudantes de diferentes n´ıveis de educa¸c˜ao. Neste artigo ´e apresentado o desenvolvimento de um robˆo autˆonomo de pequeno porte capaz de navegar em um cen´ario dinˆamico, interpretando alguns elementos da sinaliza¸c˜ao de trˆansito, e de realizar as a¸c˜oes de seguir a pista corretamente, detectar obst´aculos e obedecer a um sem´aforo. O robˆo autˆonomo foi desenvolvido utilizando um computador Raspberry Pi, sensores e outros elementos que possibilitam a execu¸c˜ao das tarefas que o robˆo precisa realizar no cen´ario. Experimentos foram realizados com os m´odulos do robˆo e os resultados indicam o potencial dos algoritmos na busca por um sistema que possibilite demonstra¸c˜oes com um funcionamento adequado e similares a um cen´ario real.

In this paper, the capability of uncertainty propagations of the nuclear-data to the reactor-physics calculations has been implemented in our home-developed code NECP-UNICORN based on the statistical sampling method (SSM). The “two-step” scheme has been applied in NECP-UNICORN to perform the uncertainty analysis for the reactor-physics calculations. For the lattice calculations, the nuclear-data uncertainties are propagated to the few-group constants; then for the core simulations, the uncertainties of the multiplication factor and power distributions introduced by the few-group constants’ uncertainties can be quantified. Applying the NECP-UNICORN code, uncertainty analysis has been performed to the BEAVRS benchmark problem at the Hot Zero Power (HZP) conditions, with situations of All Rod In (ARI) and All Rod Out (ARO). From the numerical results, it can be observed that for the multiplication factors of the core simulations, the relative uncertainties are about 5.1‰ for the ARO situation and 5.0‰ for the ARI situation, which are the same magnitude of the relative uncertainties of the fuel assemblies; for the radial power distributions, the relative uncertainties can up to be 4.27% as the maximum value and 2.08% as the RMS value for the ARO situation, and 6.03% as the maximum value and 2.37% as the RMS value for the ARI situation.
