Abstract:
Areva NP Incorporated in France v Eskom Holdings SOC Ltd 2017 6 BCLR 675 (CC) was a dispute over a multi-billion-rand tender. Although the majority of the Constitutional Court recognised the public importance of the case, it adjudicated the dispute entirely on a preliminary point. It found that the applicant did not have legal standing to seek the judicial review of the award of the tender. This case note has three aims. First, I will argue that the Constitutional Court's majority judgment in Areva was generally unpersuasive. Second, I will attempt to show that Areva exposes an unresolved legal question: when should a court consider the merits of a case made by a litigant with questionable standing? Third, I will propose a method for resolving this question by way of substantive judicial reasoning in any given case.

Penelitian ini difokuskan untuk melihat proses terkonstruksinya dimensi interkultural pada pola permainan gendang terhadap pelaku dan para pecinta Dangdut Koplo. Pendekatan yang digunakan mengadopsi dari Ilmu Sosial yakni teori konstruksi sosial Peter L. Berger yang terdiri dari eksternalisasi, objektivasi, dan internalisasi. Penelitian yang dilakukan menggunakan metode fenomenologi dengan melakukan studi lapangan ke sejumlah wilayah pertunjukan Dangdut Koplo di Solo Raya terutama Taman Hiburan Rakyat (THR) Sriwedari dengan objek kelompok musik Areva sebagai bahan studi kasus. Proses konstruksi sosial masyarakat Dangdut Koplo dideskripsikan melalui analisis pada transkrip pola-pola gendang dan dampak musikalnya. Tahap eksternalisasi melibatkan konsep dan kreativitas Areva dalam menghasilkan serta mengembangkan dimensi interkultural pada pola permainan gendang. Kreativitas dalam bentuk pola-pola gendang bermuatan proses interkultural dihadirkan dengan melibatkan interaksi intersubjek sehingga menghasilkan produk interaktif berupa senggakan dan gerak-gerak komunitas joged pada proses objektivasi. Media pentas dan konser menjadi proses sosialisasi yang membuat masyarakat dari satu kolektif ke kolektif lain, melihat Areva Musik sebagai manifestasi dari Dangdut Koplo, pada tahap internalisasi. ABSTRACTThis research focused on the construction process of the intercultural dimension of the drums pattern among Dangdut Koplo’s society. The approach used to adopt from the social sciences, that was social construction theory from Peter l. Berger consist of externalization, internalization, and objectivation. Research conducted using the method of Phenomenology by doing fieldwork to several areas performing Live of Dangdut Koplo in Solo and surroundings especially on Taman Hiburan Rakyat (THR) Sriwedari with Areva Music group as a case study. The process of the social construction of society Dangdut Koplo described through analysis on transcripts of drum patterns and the impact of its. Externalization stage involves the concept of creativity from Areva Music in generating and developing intercultural dimension on the drum pattern of the gendang’s player. Creativity in the form of many drum patterns featured an intercultural process involving the subject to subject interaction to produce interactive products in the form of senggakan and some motion from joged’s community on the process of objectivation. The medium of performances and concerts into a process of socialization that make communities from one another, the collective to collective see that Areva Music group as a manifestation of Dangdut Koplo, at the process of internalization.

Este trabalho buscou identificar fatores que colaboram para tornar eficaz uma auditoria externa, de verificação da gestão, ou operacional, na área pública. Foi utilizada metodologia de pesquisa bibliográfica, que registrou a origem e evolução da atividade de auditoria, além dos aspectos relativos às diversas escolas internacionais contemporâneas. Utilizou-se, também, de estudo de caso na Auditoria da Receita Pública do Estado da Bahia, realizada por equipes de auditores do Tribunal de Contas da Bahia, que procederam exames entre janeiro de 2000 e maio de 2003. A pesquisa identificou itens essenciais para a efetivação deste tipo de auditoria, de caráter operacional: o planejamento e o desenho institucional da organização; a qualidade técnica na execução das fases da auditoria (planejamento, execução, relatório e acompanhamento), além do nível de experiência dos auditores e do treinamento aplicado. Observou-se, entretanto, no caso analisado, que a eficácia da auditoria não é uma razão direta apenas da qualidade da auditoria. Os citados pré-requisitos são indispensáveis para a obtenção da eficácia da auditoria, entretanto, o confronto entre recomendação da auditoria, atitude do gestor e influências do macro ambiente é que vão determinar a possibilidade maior ou menor de uma recomendação de auditoria operacional ser implementada eficazmente.

Abstract:
This work aims to contribute to the reflection of the possible connections between History and Theater. It considers the analysis of Teatro de Arenas utopias during the decade of 1950 in Brazil, with the intent to discuss some moments of our contemporary history. Starting from approaches which blend drama and historical process, two plays produced and staged by the first time for this company will be studied: Eles Não Usam Black-Tie (1958), by Gianfrancesco Guarnieri, and Chapetuba Futebol Clube (1959), by Oduvaldo Vianna Filho. In the first chapter, the Teatro de Arena will be analysed from the point of view of their critical approaches; in the second, relations between those plays and history. In the third, will be done a study over the process of writing and stage, looking for rescue the contemporary and importance of Teatro de Arena and its role on Brazilian drama.
Esta dissertação tem por finalidade contribuir para a reflexão das possíveis conexões existentes entre História e Teatro. Propõe a análise das utopias do Teatro de Arena durante a década de 1950 no Brasil, com o intuito de discutir momentos de nossa história contemporânea. Partindo do pressuposto de que a produção estética e, neste caso específico, a dramaturgia, é um momento constituinte do processo histórico, serão estudadas especificamente duas peças produzidas e encenadas pela primeira vez por essa companhia: Eles Não Usam Black-Tie (1958), de Gianfracesco Guarnieri, e Chapetuba Futebol Clube (1959), de Oduvaldo Vianna Filho. No primeiro capítulo, o Teatro de Arena será analisado por meio das interpretações elaboradas a seu respeito, no segundo, no interior do processo vivenciado e no terceiro, será feito um estudo das peças indicadas acima, no âmbito do processo da escritura e da encenação, com o objetivo de recuperar a contemporaneidade do papel exercido pelo Teatro de Arena na dramaturgia brasileira.

Este documento analiza los principales impactos generados por las actividades mineras, el Puerto de arena estrellas, ubicado en el distrito Uvaia, Ponta Grossa - PR. El objetivo fue identificar los diferentes tipos de impactos ambientales relacionados con la actividad minera; resaltar conflictos ambientales locales y evaluar la calidad del agua de los cuerpos de agua en la industria minera. La metodología para la evaluación de impacto ambiental a las matrices y listas, de acuerdo a las fases de implementación, operación y cierre de la empresa. Los impactos se agruparon en los impactos positivos y negativos, así como actuales y potenciales. Con respecto a las áreas con conflictos ambientales se identificaron mediante las áreas correspondientes en exceso y subutilizadas, con referencia a la legislación del Código Forestal y el Código de Minería. Para el análisis de la calidad del agua, se desarrolló una estrategia de investigación que representa un intento de delinear la situación ambiental actual. En cuanto a los principales resultados se encontró que la mayoría de los efectos sobre el desarrollo se asocia con la fase de la operación: los conflictos son causados por las zonas no-conservación de la APP y de no cumplir con las normas reglamentarias para la minería, que están destinadas a regular la la utilización racional de los yacimientos minerales y, por último. Sobre la calidad del agua a lo largo del proyecto reveló que la mayoría de las irregularidades no se encontraba en los parámetros físicos (turbidez, sólidos suspendidos, pH y conductividad), pero los parámetros sobre las características de agentes bacteriológicos (coliformes totales y Escherichia coli) . Los cambios en esta área están relacionados con el crecimiento del sector minero influenciado por la dinámica social relacionada con el uso y ocupación de la región.
Este trabalho aborda os principais impactos gerados pela atividade mineradora, do Porto de Areia Estrela, localizado no distrito de Uvaia, município de Ponta Grossa - PR. O objetivo foi identificar os diferentes tipos de impactos ambientais, relacionados à atividade mineradora; destacar os conflitos ambientais locais e avaliar a qualidade da água dos corpos hídricos na área de mineração. A metodologia utilizada para avaliação de impacto ambiental foi a de matrizes e listagem, de acordo com as fases de implantação, operação e desativação do empreendimento. Os impactos foram agrupados em impactos positivos e negativos, além de potenciais e efetivos. Com relação aos conflitos ambientais foram identificadas áreas com uso correspondente, áreas sobreutilizadas e áreas subutilizadas, tendo como referência a legislação do Código Florestal e o Código de Mineração. Para análise da qualidade da água, foi elaborada uma estratégia de investigação que representa uma tentativa de delinear o cenário ambiental presente. Com relação aos principais resultados constatou-se que a maior parte dos impactos no empreendimento está associada à fase de Operação: os conflitos são decorrentes da não conservação de áreas de APP’s e também pelo não cumprimento das Normas Reguladoras de mineração, que têm por objetivo disciplinar o aproveitamento racional das jazidas e, finalmente. Sobre a qualidade da água ao longo do empreendimento constatou-se que a maior parte das irregularidades não estava nos parâmetros físicos (turbidez, sólidos em suspensão, pH e condutividade), mas sim nos parâmetros referentes às características bacteriológicas (Coliformes totais e Escherichia coli). As alterações ocorridas nesta área estão ligadas ao crescimento do setor minerário influenciado pelas mudanças sociais relacionadas com a dinâmica no uso e ocupação do solo da região.

The present dissertation aims to provide a full analysis concerning the Arena Rights, under the aspect of the Substantive Law, it will be initially addressed on the current context in which it is rooted in the legal institute debate, which presents itself as a species of image rights, this can be found on the personality rights list. Regarding the broad study of this subject, we will be guided by legislative, doctrinal, jurisprudential and field researches, with the purpose of showing the definition, the history evolution, the ownership, the legal nature, the application of exclusionary and major controversies surrounding the arena right, that emerges like a relevant subject and full of doctrinal and jurisprudential controversy. In the end of the mentioned approach, we dedicate ourselves to develop the comparative study of Portuguese and Spanish law, which are intended to control the marketing of images of the sporting spectacle, proposal that presents valuable to understand the subject in the international context
A presente dissertação almeja proporcionar uma análise plena a respeito do direito de arena, sob o aspecto do direito material, ocasião em que será inicialmente abordado o contexto atual em que se encontra enraizado o instituto jurídico em debate, que figura como uma espécie de direito à imagem, esta que se encontra no rol de direitos da personalidade. No que tange ao vasto estudo da matéria, nos pautaremos em pesquisas legislativas, doutrinárias, jurisprudenciais e de campo, com o propósito de apresentar a definição, a evolução histórica, a titularidade, a natureza jurídica, as excludentes de aplicação e as principais polêmicas que envolvem o direito de arena, que emerge como um tema relevante e abarrotado de controvérsias doutrinárias e jurisprudenciais. Ao final da abordagem mencionada, nos dedicaremos a desenvolver o estudo comparado de leis oriundas de Portugal e Espanha, que se destinam a disciplinar a comercialização de imagens advindas do espetáculo desportivo, proposta que se apresenta valiosa à compreensão do tema na seara internacional

Abstract:
Decontamination prior to decommissioning and dismantling is an internationally accepted approach. Not only does it provide for minimization of personnel dose exposure but also maximization of the material volume available for free release. Since easier dismantling techniques in lower dose areas can be applied, the licensing process is facilitated and the scheduling and budgeting effort is more reliable. The most internationally accepted approach for decontamination prior to decommissioning projects is the Full System Decontamination (FSD). FSD is defined as the chemical decontamination of the primary cooling circuit, in conjunction with the main auxiliary systems. AREVA has long-term experience with Full System Decontamination for return to service of operating nuclear power plants as well as for decommissioning after shutdown. Since 1976, AREVA has performed over 500 decontamination applications and from 1986 on, decontaminations prior to decommissioning projects which comprise virtually all nuclear power plant (NPP) designs and plant conditions: • NPP designs: HPWR, PWR, and BWR by AREVA, Westinghouse, ABB and GE; • Decontaminations performed shortly after final shutdown or several years later, and even after re-opening safe enclosure; • High alpha inventory and or low gamma/alpha ratio; • Main coolant chemistry (e.g. with and without Zn injection during operation). Fifteen decontaminations prior to decommissioning projects have been performed successfully to date. The lessons learned of each project were consequently implemented for the next project. AREVA NP has developed a fully comprehensive approach for decontamination based on the CORD® (Chemical Oxidation Reduction Decontamination) Family, applied using the in-house designed decontamination equipment AMDA® (Automatic Modular Decontamination Appliance). The Decontamination Concept for Decommissioning (DCD) will be outlined in this paper. Based on highlights of previous FSDs performed prior to decommissioning the AREVA concept for FSD and DCD will be outlined: • Application window; • Decontamination area; • Waste considerations; • Positive results for subsequent decommissioning and dismantling activities.

Abstract:
The Kimberlina Solar Thermal Power Station in Bakersfield, California, is AREVA Solar’s first North American solar thermal energy facility and an important showcase of AREVA’s Compact Linear Fresnel Reflector (CLFR) technology. Construction of a fourth solar steam generator (SSG4) was completed at Kimberlina in August 2010. At the time SSG4 represented AREVA Solar’s most current commercial technology, designed for direct superheat steam generation. SSG4 incorporates technology advancements that significantly enhance the AREVA Solar technology’s controllability, steam temperature and pressure capabilities as well as overall performance. After SSG4 was commissioned, AREVA Solar carried out an extensive performance test program on this advanced technology to formally evaluate and quantify its measured performance and compare that to the model-predicted performance. The performance testing included two specific tests. The first was the Steady State Performance Test (SSPT), which evaluated the technology’s steady-state performance over a two-hour period on multiple days. The second test was the Entire Day Performance Test (EDPT), which evaluated the technology’s performance throughout an entire day, including overnight losses, startup, mid-day performance (including steady-state, quasi steady-state and transients) and shutdown. The third test demonstrated the technology’s response to a simulated direct normal insolation (DNI) transient. AREVA Solar took great care to design and perform this testing in a standardized manner that would stand up to independent, expert observation and was consistent with established ASME performance test codes (PTC), where applicable. AREVA Solar plans to implement this testing methodology in future commercial plants and technology demonstrations. This paper documents in detail the performance testing methodology used to evaluate AREVA Solar’s new technology, including: • Test prerequisites; • Performance (both measured and modeled) calculation equations; • Environmental and optical surface measurement techniques; • Measurement test success criteria; • Uncertainty calculation and implementation. This paper also documents the measured testing results relative to the AREVA Solar internal modeled results including follow-up model validation.

Abstract:
Within the AREVA Fatigue Concept (AFC) a new method for fast fatigue evaluation for highly loaded nuclear power plant components was developed. This method uses FAMOS (FAtigue MOnitoring System) measured data from the outside surface of a pipe and can evaluate a fatigue level for the component for the thermal event plug flow. The measuring location of FAMOS is chosen close to a fatigue relevant component and the points of interest are at the inner surface of the component. The calculated inner wall temperature time history will be transferred to the inner surface of the component. The thermal load cycles are well known after that step and the stress time history and also the strain rates would be calculated with the Green’s function approach. Unit transients will be used to calculate principle stresses and shear stresses in all fatigue relevant locations within the monitored component. Pressure cycles will also be evaluated with the Green’s function approach. After the calculation of the equivalent stresses the mechanical load cycles can be classified by the use of the rainflow algorithm. Comparisons (Miner’s rule) with the fatigue curve results in fatigue levels for all relevant locations within a component. In the current approach, the conservatism will be reduced with this method, and an enveloping fatigue level can still be calculated. In another words, for highly loaded components, using the current methodology can provide a more realistic stress calculation and enveloping fatigue level calculation. Depending on the number of load cycles, the new and more stringent requirements can be complied.
