The danger of war on the Hochrhein was heightened by a long-standing feud between a Habsburg vassal, Bilgeri von Heudorf, and the Swiss associated member Schaffhausen, Differences emerged between the Swiss cantons over their designs north of the Rhine, but Archduke Sigismund’s mortgaging most of western lands to Burgundy thwarted any expansion. The restoration of the lands in 1474 led to the Perpetual Accord which guaranteed good-neighbourly relations and required that any mutual military aid be on a cash basis only. Nevertheless, this alliance of convenience provided for the four Austrian ‘Forest Towns’ on the Hochrhein be open to the Swiss in any emergency.

Abstract:
Since the mid-2000s, proliferating “land wars” have exposed a contradiction between the land requirements of neoliberal capitalism and the political weight of farmers in India’s democracy. Whether, how, and for whom this contradiction is resolved constitutes India’s “new” land question. But this chapter argues that Marx’s “primitive accumulation” or Harvey’s “accumulation by dispossession” are inadequate to understand this conjuncture; and it advances the concept of “regimes of dispossession” as an alternative. It argues that from the early 1990s, India shifted from a regime that dispossessed land for state-led projects of material expansion to one that dispossesses land for private and decreasingly productive investments. This new regime, in which states have become mere land brokers for private capital, is arguably less “developmental” than its Nehruvian predecessor. The upshot is that India’s “land wars” are unlikely to dissipate any time soon; and the “land question” may be the largest contradiction for Indian capitalism for the foreseeable future.

Concentrates show you what to expect in a law exam, what examiners are looking for, and how to achieve extra marks. This chapter discusses unregistered land. This is land where title has not been registered at the Land Registry. Proof of ownership comes from an examination of title deeds relating to that land. Identification of any third party proprietary interests burdening a piece of unregistered land cannot be discovered by a search of the land register. Rather, an examination of the title documents and various registers is required to discover their existence. The most important is a search of the Land Charges Register which is made against the names of previous owners, not the property address. Legal interests over unregistered land bind the world, with the exception of the puisne mortgage, which requires registration as a land charge to be binding. Interests covered by the Land Charges Act 1972 must be registered as the appropriate land charge to bind a purchaser. Failure to register such an interest appropriately means that the interest will not bind certain types of purchasers of the land.

Abstract:
The sixth chapter of the book presents a historical account of peasants’ resistance to the land-grabs in Kashmir. It describes how people fought the lonely battle to stop land-grabbing, whereby neither the media nor the local administration or the civil society supported them. With resistance against land-grabbing not yielding any positive results, peasants made the transition from resistance against land-grabs to struggle for compensation. Besides discussing about the peasants’ resistance, the chapter also describes the external dimension of resistance to KHEP, whereby the resistance comes from media and civil society groups in Kashmir, based on the ecological and compensational resistance, and not against the dispossession and displacement of the peasantry.
