Abstract:
La responsabilità degli organi di governance, nel contesto delle procedure concorsuali, ha visto nel tempo alterne interpretazioni. Il presente contributo propone una razionalizzazione in chiave aziendalistica per evitare il rischio di riconoscere una natura inopportunamente oggettiva alla fattispecie.Nesso di causalità e misurazione del danno vengono riletti con la lente delle teorie manageriali e della creazione di valore, in modo da ottenere una valutazione più oggettiva che funga da giusto equilibrio tra tendenze eccessivamente garantiste e approcci inopportunamente deterministici. Il superamento di tale determinismo si perfeziona con la proposta di un metodo di stima del danno liquidabile, che si sostiene proprio sulla logica decrementale della misurazione del valore distrutto, in luogo di quella meramente contabile del profitto.Nell'attuale contesto di riforma del diritto della crisi, soprattutto alla luce del dovere di agire in prevenzione come disposto dal novellato art. 2086 c.c., non si può prescindere da una valutazione di ciascun atto di gestione, nel contesto specifico dell'azienda in cui esso è compiuto superando approcci pericolosamente generalisti.

Abstract:
L'articolo esamina le implicazioni del dibattito sull'environmental, social, and corporate go-vernance nel diritto societario italiano. Dopo aver dato conto degli approcci tradizionali sul tema dell'interesse sociale, si esamina come il paradigma dello shareholder value abbia in-fluenzato il Codice di autodisciplina delle società quotate del 1999 e la riforma del diritto socie-tario del 2003. Successivamente, a partire dal 2006, si assiste però anche a un progressivo ri-pensamento di questo paradigma, sia a livello normativo, sia a livello di autodisciplina. A que-sto riguardo, particolarmente significativa è stata soprattutto l'evoluzione delle regole di self-regulation relative ai compensi degli amministratori. In questo contesto, il Codice di autodisci-plina del 2020 adotta un nuovo approccio e pone al suo centro il c.d. "successo sostenibile" della società. Il presente lavoro esamina se questa svolta possa considerarsi realmente innova-tiva o se essa miri piuttosto a limitare l'impatto che il dibattito sulla sostenibilità può avere sul diritto societario del nostro paese.

La creazione di valore e stata oggetto di significativa attenzione nel dibattito economico- agrario, nazionale e internazionale, degli ultimi anni, portando allo sviluppo di nuovi approcci teorici che hanno permesso di reinterpretare i processi di riposizionamento funzionale dell'impresa agricola (multifunzionale). In quest'ottica, percio, la multifunzionalita permette all'azienda di rispondere alle nuove istanze sociali, consapevoli e responsabili, produrre benessere collettivo, integrare il reddito, individuare percorsi di creazione di valore socialmente responsabile. In questo senso, si rinnova la tradizionale visione della multifunzionalita, la quale da strumento di giustificazione dell'intervento pubblico in agricoltura assume valore di vero e proprio fattore strategico di vantaggio competitivo. Il paper propone un modello teorico che consente di analizzare come i processi di boundary shift portino alla creazione di un "portafoglio di valori" (PV) (Marotta, Nazzaro, 2010; 2011a, 2011b), e a nuovi modelli di impresa agricola multifunzionale e multi-valore. Sul piano metodologico, l'utilizzo della Value Portfolio and Multifunctional Governance Analysis (VPMGA) (Marotta, Nazzaro, 2010; 2011a, 2011b), ha permesso di validare empiricamente il modello del PV, in specifiche filiere agroalimentari e sistemi rurali della Campania, secondo un approccio che, integrando e completando la value chain analysis e la governance value analysis, si pone come innovativo e meglio rappresentativo delle specificita dell'impresa agricola multifunzionale. I risultati hanno permesso di verificare come il boundary shift e, quindi, il PV, consentono di diversificare il rischio, in situazioni di crisi, rappresentando una strategia competitiva per le imprese multifunzionali rispetto alle imprese che conservano il solo core business tradizionale.

Nell'ultimo decennio, l'informale è diventata una categoria ombrello, un caleidoscopio di pratiche diversissime d'uso ed appropriazione non autorizzati del territorio. Per tentare una fenomenologia delle pratiche informali sono possibili ed ugualmente necessari due approcci: il primo, qui definito istituzionale, è focalizzato sull'analisi dei processi di governance per comprendere le dinamiche strutturali che generano l'informale; il secondo, qui definito territoriale, è focalizzato sui soggetti e sulla loro agency per orientare la valutazione delle pratiche. Di seguito, si propone un esercizio di schematizzazione della fenomenologia delle pratiche informali mediante una lettura territoriale. Facendo riferimento al Sud Italia e particolarmente alla città di Napoli, si sono individuate "tre città informali" ciascuna materialmente prodotta e significata da altrettante categorie di soggetti individuali o collettivi, pubblici o no.

L'articolo approfondisce il tema della resilienza da un punto di vista interdiscipli-nare, psico-socio-economico, secondo il paradigma sistemico. Dopo una prima distinzione fra la resilienza dei sistemi chiusi e aperti, si delineano due approcci alla resilienza: conservativo e trasformativo. Per mettere ordine tra i vari costrutti di resilienza ed evidenziare quali interrelazioni vi siano tra questi processi sono indagate le modalità di intervento adottate in risposta agli shock e i fattori protettivi che favoriscono la resilienza nonostante le vulnerabilità e, in particolare, il "senso di coerenza". Gli autori, quindi, propongono un modello positivo sistemico basato sull'apprendimento in cui sono delineati quattro livelli di resilienza, di cui quella conservativa e trasformativa sono considerate forme di apprendimento distinte. Viene inoltre individuato un livello superiore, e piuttosto raro, di resilienza trasmutativa o evoluzionaria. Questo modello si propone non solo di raccordare, organizzare e dare senso alle diverse declinazioni del concetto in esame, ma prevede an-che la possibilità di accedere a livelli superiori della scala di resilienza. Quanto pro-posto potrebbe rappresentare uno stimolo ad incentivare la rivalutazione e la riorganizzazione, da parte del policy maker, dei vigenti modelli di governance. A que-sto proposito gli autori ritengono necessarie ulteriori ricerche, in particolare: appro-fondire le diverse modalità di accesso dai livelli inferiori a quelli superiori di resi-lienza, nonché le possibili declinazioni del modello proposto in modelli normativi. Dal momento che le sfide odierne si configurano sempre più come minacce di na-tura globale, esse impongono all'umanità un cambiamento epistemico e lo svilup-po di una resilienza che possa favorire un senso di identità comune basato sulla coscienza della comunità di destino umana.

Abstract:
The governance of waqf is an important aspect and it as an image of the Council of Islamic Religious State (MAIN). Policy of legislation determines that MAIN is the body that responsible for managing, administering and developing all waqf lands. Some scholars have opined that the administration of waqf should be practiced based on Siyāsah Shar’iyyah. But now, the approach has not yet been fully explored. This study aimed to examine and explore the relationship between governance of waqf and Siyāsah Shar’iyyah. This study was conducted through qualitative research. Document exploration is used for analyzing turath book that involved the discussion on Siyāsah Shar’iyyah. It is analyzed by inductive, deductive and comparative methods. The finding of the study found that the Siyāsah Shar’iyyah relationship is important to the governance of waqf. Values of Siyāsah Shar’iyyah is significant when implementing at the governance, finance and legalization of waqf. The values of the Siyāsah Shar’iyyah also are in three main categories i.e first Dustūriyyah, second Dawliyyah and third Māliyyah.

The application of Good Government Governance can be used as part of an effort to implement democratic principles in public services, looking at the current public service situation that needs to be applied regarding good governance in order to achieve good organizational goals. This study aims to determine and analyze the extent to which the application of the concept of good government governance in the quality of divorce certificate services at the South Jakarta City Population and Civil Registration Sub-dept. the quality of divorce certificate services at the South Jakarta City Population and Civil Registration Sub-Department. The research method used is descriptive research method with a qualitative approach. Data collection techniques using the methods of observation, interviews, and documentation. data analysis techniques using data reduction steps, data presentation, and drawing conclusions. The research was conducted in the South Jakarta Administrative City, to be precise at the Population and Civil Registration Sub-Department of the South Jakarta Administrative City. The results showed that the application of the concept of good government governance in the quality of divorce certificate services at the South Jakarta City Population and Civil Registration Sub-department, had implemented good government governance optimally where there were several indicators that had not been implemented in the South Jakarta City Population and Civil Registration Sub-dept. Penerapan Good Government Governace dapat dijadikan sebagai bagian dari upaya untuk melaksanakan asas-asas demokrasi dalam pelayanan publik, melihat dari situasi pelayanan publik yang saat ini perlu di terapkan tentang good governance guna mencapai tujuan organisasi yang baik. Penelitian ini bertujuan Untuk mengetahui dan menganalisis sejauh mana penerapan konsep good government governance dalam kualitas pelayanan akta penceraian di Suku Dinas Kependudukan dan Pencatatan Sipil Kota Jakarta Selatan.Untuk mengetahui kekuatan, kelemahan, tantangan, dan hambatan dan upaya alternatif dalam penerapan konsep good government governance dalam kualitas pelayanan akta penceraian di Suku Dinas Kependudukan dan Pencatatan Sipil Kota Jakarta Selatan. Metode penelitian yang digunakan adalah metode penelitian deskriptif dengan pendekatan kualitatif. Teknik pengumpulan data menggunakan metode observasi, wawancara, dan dokumentasi. teknik analisis data dengan menggunakan langkah reduksi data, penyajian data, dan penarikan kesimpulan. Penelitian dilakukan di Kota Administrasi Jakarta Selatan, tepatnya pada Suku Dinas Kependudukan dan Pencatatan sipil Kota Administrasi Jakarta Selatan. Hasil penelitian menunjukkan bahwa penerapan penerapan konsep good government governance dalam kualitas pelayanan akta penceraian di Suku Dinas Kependudukan dan Pencatatan Sipil Kota Jakarta Selatan, sudah menerapkan good government governance secara maksimal dimana terdapat beberapa indikator yang belum diterpakan di Suku Dinas Kependudukan dan Pencatatan Sipil Kota Jakarta Selatan.

Abstract:
The purpose of this study was to examine and analyze the influence of company characteristics on corporate Cooroorate Governance in the banking industry in Indonesia. Where the company's characteristics include the structure of bank ownership, asset structure, company size and company age. This study uses a quantitative approach with panel data observations. The object under study is the company's performance. Data collection techniques were carried out using annual reports with a total sample of 266 banks registered at Bank Indonesia and selected based on the purposive sampling method. The analytical method used is linear regression analysis which is processed using SPSS version 21. The results showed that the structure of bank ownership has a significant effect on Coorpoorate Governance, bank company size has a significant effect on Coorpoorate Governance, the age of the company has a significant effect on Coorpoorate Governance. Tangible assets banks do not have a significant effect on Coorpoorate Governance. This is because creditors do not want to take risks on large projects because tangible assets owned by banks are relatively small. Tujuan Penelitian ini untuk menguji dan menganalisis pengaruh karakteristik perusahaan terhadap Coorpoorate Governance perusahaan pada industri perbankan di indonesia. Dimana karakteristik perusahaan meliputi struktur kepemilikan bank, Struktur asset, ukuran perusahaan dan umur perusahaan. Penelitian ini menggunakan pendekatan kuantitatif dengan pengamatan bersifat data panel. Objek yang diteliti adalah kinerja perusahaan. Teknik pengumpulan data dilakukan menggunakan laporan tahunan dengan jumlah sampel penelitian sebanyak 266 bank yang terdaftar di bank Indonesia dan dipilih berdasarkan metode purposive sampling. Metode analisis yang digunakan adalah analisis regression linear yang diolah menggunakan program SPSS versi 21. Hasil penelitian menunjukkan bahwa struktur kepemilikan bank berpengaruh signfikan terhadap Coorpoorate Governance, ukuran perusahaan bank berpengaruh signifikan terhadap Coorpoorate Governance, umur perusahaan berpengaruh signifikan terhadap Coorpoorate Governance.sedangkan struktur asset (asset tangible) bank tidak berpengaruh signifikan terhadap Coorpoorate Governance. Hal ini dikarenakan kreditur tidak ingin mengambil resiko terhadap proyek yang besar dikarenakan asset tangible yang dimiliki oleh bank adalah relative kecil.

Malang economic growth is quite good and gets positive appreciation in the field of economy, arts, sports, science and so forth, so Malang is dubbed as one of the best cities in Indonesia. Therefore, the availability of adequate institutions that directly touch the needs of the people, in this case, zakat, is necessary. Zakat management institutions should be managed by professional, trustworthy, responsible and knowledgeable. This research uses the qualitative approach of phenomenology which aims to: 1) know the governance of Amil Zakat Institute in the perspective of good governance, 2) reveal the unique social reality of how zakat institutional governance is not a trivial issue but must be planned and organized professionally.The utilization of zakat needs to be done with a priority scale approach with the application of consumptive zakah and productive one. By managing zakat well and advanced will be able to suppress poverty even since mustahiqq become muzakkī because the society is aware of zakat. Improving the economy of the city of Malang is balanced with zakat management institutions such as BAZNAS representing the management of zakat from the role of government, YDSF under the guidance of private LAZ, and El-Zawa guided by the university.

Abstract:
The article assesses the role of civil society organisations in the governance framework. It looks at the migrant associations in Milan, their characteristics and their network to interpret the so-called crowding-out effect by autochthonous promigrant organisations in the provision of social services. The general hypothesis, building on the well-known governance literature, is that in the last decades public authorities while shifting towards more open decision making processes in other fields, did not follow the same approach for the migrant policies for specific reasons: both internal (such as political will) and external (migrant associations weaknesses). The article, using a network analysis approach, depicts the societal configuration created by the migrant associations in Milan to show that more factors are at game in the process of political isolation. Indeed, if the political support is completely absent, as typical of non-ethnicised societies, the civil society weakness has to be tracked back to three different aspects: the organisational fragilities, the geographic- based components of migrants associations and the multiple and confounding accesses that public authorities grants to migrant associations. The migrant civil society as a whole is thus isolated from public authorities unable to fully empower its constituency and to promote political activation in a context of small political opportunities structure. Nonetheless the most central actors within the migrant network are those able to actively cooperate with public institutions.

This research was conducted to find out the role of village financial system (Siskeudes) on the performance of village administration with good governance as an intervening variable in Kulon Progo Regency. This research employed quantitative research approach. The data used were primary data. The informants used were village Kaur and Kasi, the village secretaries, the village financial system operators (Siskeudes). The result showed that: (1) village financial system (Siskeudes) influences on the good governance; (2) good governance influences on the performance of the village administration; (3) village financial system (Siskeudes) no effect to performance of village administration; (4) village financial system (Siskeudes) on the performance of village administration with good governance an an intervening variable.

Abstract The research aims to determine the practice of implementing good governance in the context of administrative law. This writing is a legal writing that uses a conceptual approach. The results of the study show that the legislative body in carrying out the regulatory function must base on good / decent regulatory principles / principles by developing knowledge and skills in the field of legislation as mandated by Law Number 12 Year 2011 along with its attachments. In general, there are two main means used to assess good / decent governance, namely Procedure and Facts used in making decisions, in addition to attention to several legal principles as a manifestation of the implementation of the principle of democracy. Judicial control in overseeing government actions against decisions made, including in Judicial Review, which are repressive and prioritize the legality aspect (rechtmatigheid) of a decision. - This paper deals with analytical and methodological problems which are currently at the core of historical studies about European integration. It also reminds that history of European integration went through different periods which fostered various thematic conceptualizations. Indeed, the "essence" of the European construction, as a diachronic and in fieri process, furthered a renew of the object of study, gradually widening its importance, enriching and renewing historiographical interpretations. The definition of research lines about origins and development of EEC/EU policies, in particular those "second generation" policies promoted since the beginning of the Seventies, is placed in a complex historiographical background. The concept of good governance is used as an institutional framework for strengthening the autonomy of village. The reality is practice of good governance in management practices of more funds are directed to central government, not to public. The purpose of this study was to understand the forms and practices of good governance froms and practices in village fund management pricesses that are viewed from the proses of trasnparansi. Accountabillty and responsiveness. This study uses an interpretive paradigm with a phenomenological approach to explore the implementation of good governance in management of village funds. The study found that implementation of the management of village funds in village sewurejo normatively in accordance with good governance mechanisms even though there are still some weaknesses in the application in field. The policy implication of this research can be used to assess implementation of good governance at the village government agencies special in village governance.

ABSTRACTIn managing the Village Fund, it is not easy and needs to be implemented properly in accordance with the principles of Good Governance which must be based on the principles of financial management, namely participation, transparency and accountability. This article aims to examine and analyze the application of the principles of Good Governance (accountability, transparency and participation) starting from the planning, implementation and accountability stages of village fund management carried out by the Sindanghaji Village government, Palasah District, Majalengka Regency in 2019. The method used is a descriptive research method with qualitative approach by means of literature study and field studies which include observation, interviews, and documentation. The results showed that the application of the principles of Good Governance in Sindanghaji Village has not run optimally due to the lack of quality human resources, communication with the community in terms of socialization has not been conveyed evenly, and there is no information media facility in Sindanghaji Village as a form of transparency of activities to the community. The conclusion of this study is that the village government of Sindanghaji in implementing the principles of Good Governance has not fully run optimally. Therefore, the village government of Sindanghaji must make a strategic plan and steps that are even better in the application of the principles of Good Governance in the management of village funds. ABSTRAKDalam pengelolaan Dana Desa tidaklah mudah dan perlu dilaksanakan dengan baik sesuai dengan prinsip Good Governance yang harus didasari sesuai dengan asas-asas pengelolaan keuangan yakni adanya partisipasi, transparansi, serta akuntabilitas. Artikel ini bertujuan untuk mengkaji dan menganalisis penerapan prinsip Good Governance (akuntabilitas, transparansi dan partisipasi) mulai dari tahap perencanaan, pelaksanaan dan pertanggungjawaban pada pengelolaan dana desa yang dilakukan pemerintah Desa Sindanghaji Kecamatan Palasah Kabupaten Majalengka Tahun 2019. Metode yang digunakan adalah metode penelitian deskriptif dengan pendekatan kualitatif dengan cara studi pustaka dan studi lapangan yang meliputi observasi, wawancara, dan dokumentasi. Hasil Penelitian menunjukan bahwa penerapan prinsip Good Governance di Desa Sindanghaji belum berjalan secara optimal dikarenakan kurangnya sumber daya manusia yang berkualitas, komunikasi dengan masyarakat dalam hal sosialisasi belum tersampaikan secara merata, dan tidak ada sarana media informasi di Desa Sindanghaji sebagai bentuk transparansi kegiatan kepada masyarakat. Kesimpulan dari penelitian ini bahwa pemerintah desa Sindanghaji dalam penerapan prinsip Good Governance belum sepenuhnya berjalan secara optimal. Oleh karena itu, pemerintah Desa Sindanghaji harus Membuat rencana strategi dan langkah-langkah yang lebih baik lagi dalam penerapan prinsip Good Governance pada pengelolaan dana desa.

Introduction: The urgency to organize the border between Indonesia and Papua New Guinea and border crossers is based on historical reasons that are more complex than the arrangement of Indonesia's borders with other countries.Purposes of the Research: To overcome these problems, the author proposes the idea of an integrated border management.Methods of the Research: This research uses sociological juridical method with the research location in Jayapura City.Results of the Research: The results of the study show that the border governance policies tend to ignore the cultural identity variable, which then encourages the use of cultural identity to challenge the state's version of dominant conceptions and policies in border governance. This is indicated by the phenomenon of "rat trails" and other cross-border interaction networks that are illegal by the state. Cultural approach in border governance policy is the principle that animates security policy, political policy, and economic policy in border governance. The practical consequence of this study is that border governance must move away from the domination of the economic security approach to an integrated approach.

Obiettivi del paper: lo scritto mira ad illustrare come un approccio multidimensionale di performance governance sia in grado di offrire una prospettiva sistemica per l’identificazione degli outcome gestionali, organizzativi e di comunità nonché di evidenziare leve per il miglioramento dei processi di generazione di valore nei musei e a beneficio della comunità. Metodologia: dapprima si è proceduto alla revisione della letteratura sul tema della co-produzione di servizi pubblici. Per analizzare le performance di tali contesti collaborativi si è costruito un framework multidimensionale, poi applicato ad un caso di studio. Infine, si è proceduto al riscontro delle proposizioni avanzate. Risultati: l’articolo evidenza in che modo la co-produzione sia in grado di apportare risorse aggiuntive rispetto a quelle in possesso all’organizzazione istituzionalmente responsabile del servizio. Inoltre, dall’applicazione del modello al caso emergono misure di performance gestionali, organizzative e di comunità. Limiti della ricerca: le limitazioni attengono alla reperibilità di informazioni quantitative per valutare gli effetti della iniziativa. Implicazioni pratiche: l’identificazione di performance driver fa emergere gli effetti della disponibilità di risorse sui diversi livelli di performance, evidenziando le connessioni causali che rivelano il contributo della co-produzione agli outcome. Originalità del paper: l’articolo sviluppa il framework analitico Dynamic Multidimensional Performance Governance ed evidenzia il contributo che la co-produzione offre ai processi di generazione di valore nei piccoli centri.

Abstract This study aims to evaluate Sharia governance infrastructure in Sharia banking in Indonesia, specifically the Sharia review phase by the Sharia Supervisory Board which was disclosed in the Sharia bank annual report. Furthermore, an analysis of the possibility of adopting the Shariah Governance Framework (SGF) of Bank Negara Malaysia (BNM) is based on the perceptions of experts, using 3 research samples, namely Bank Syariah Mandiri, BPD DIY Sharia Business Unit, and BPRS Bhakti Sumekar. The data analysis uses a qualitative descriptive approach. Our results show that the governance processes, procedures and mechanisms in the Sharia review process by the DPS are supported by the bank's internal functions, namely the function of Internal Audit and the Compliance function. Based on these conditions, SGF BNM adoption is considered less suitable when applied to Islamic banking in Indonesia. One of them was caused by a lack of human resources in Indonesia with dual competency (Sharia law and finance). So that it is not possible to separate each unit such as the SGF BNM, namely Shariah Audit, Shariah Review, Shariah Research, and Shariah Risk ManagementAbstrak Penelitian ini bertujuan untuk mengevaluasi infrastruktur tata kelola Syariah pada perbankan Syariah di Indonesia, khususnya tahap Shariah review oleh Dewan Pengawas Syariah yang diungkap pada laporan tahunan bank Syariah. Untuk selanjutnya dilakukan analisis kemungkinan adopsi Shariah Governance Framework (SGF) Bank Negara Malaysia (BNM) yang didasarkan pada persepsi para ahli dengan menggunakan 3 sampel penelitian, yaitu Bank Syariah Mandiri, Unit Usaha Syariah BPD DIY, dan BPRS Bhakti Sumekar. Analisis data menggunakan pendekatan deskriptif kualitatif. Hasil penelitian menunjukkan bahwa proses, prosedur, dan mekanisme tata kelola khususnya pada proses Shariah review oleh DPS didukung oleh fungsi internal bank, yaitu fungsi Audit Internal dan fungsi Kepatuhan. Berdasarkan kondisi tersebut, adopsi SGF BNM dinilai kurang sesuai apabila diterapkan pada perbankan Syariah di Indonesia. Hal tersebut salah satunya disebabkan oleh kurangnya jumlah sumber daya insani di Indonesia dengan dual competency (hukum Syariah dan keuangan). In the last decade post Soeharto, Good Governance (GG) has been often heard like a `mantra'. GG seems easily uttered talkative, formalized, and grew into a dominant political ideals as well as major constitutional and public administration discourse which have rooted in law, policy, and higher education. Like a rooster crowing in the morning, he continued to speak out in the mornings, wide box spawn 'governance, such as 'good forestry governance, 'good financial governance, 'good university governance, and many others. GG, in that context, seems like an appropriate nutrition to overcome the weakness of the Indonesian legal system, corrupt bureaucracy, and the predatoric political leadership. In this regard, it should be viewed more closely, what is actually superiority owned when GG is talked? Obviously, the law is one of the tools to ensure the operation of the mantra in its implementation, and based on master research conducted in 2005-2006, focusing on the issue of the Law Reform by applying a socio-legal approach. As a result, this study gave the fact which is different or even contrary to the ideals of political buildings or formalized or materialized law and policy. For example, one study showed that the GG in the context of legal reform in Indonesia actually very sinister and weakening the guarantee of human rights. Law, especially product of legislation and institutions, as well as its machinery transmission are dominant in advocating free market (free market friendly legal reform). Perhaps, the conclusions is not popular in the middle of the noisy speech spelling of GG and its projects. However, Indonesia today shows the continuation of massive corruption, violation of human rights, impunity and all the non protection situation in the Indonesian legal system.Keywords: Good Governance, Law reform, Sosio Legal approach

Tulisan ini mengkaji mengenai bagaimana pemerintah lokal, dalam hal ini Pemerintah Kota Malang, merespons ancaman terorisme global Islamic State of Iraq and Syria (ISIS). Hasil penelitian lapangan ini menemukan bahwa dalam merespons ancaman ISIS, Pemkot Malang mengintegrasikan pendekatan persuasif dan represif. Pendekatan persuasif dilakukan dengan berbagai bentuk sosialisasi kepada masyarakat. Adapun pendekatan represif dengan melakukan penangkapan terhadap anggota ISIS yang telah terbukti melakukan tindak pidana berupa makar. Selanjutnya, dalam merespons ISIS, aktor publik di berbagai level dan aktor privat saling sinergis yang menunjukkan implementasi dari model hybrid security governance. Hybrid security governance tersebut sejalan dengan konsepsi local governance bahwa ancaman ISIS tidak dapat diselesaikan sendiri oleh pemerintah (aktor publik) sehingga membutuhkan keterlibatan aktor privat. Selain itu, respons tersebut sejalan dengan sikap pemerintah di level lebih tinggi yang menunjukkan the whole-of-government approach dan comprehensive approach dalam merespons ISIS sebagai ancaman bagi perdamaian dan keamanan dunia.

The research results show that: (1) The governance of poverty countermeasure acceleration has not been vertically and horizontally integrated yet; (2) Coordination which will be developed through TKPK formation at the provincial, city/district level has not been realized yet because of procedural conflict; (3) The poverty countermeasure acceleration program has not been oriented yet to production, trading, and investment activities in the free market place; (4) The solution of governance problem is an effective team formation by the Governor oc Central Java Province.

Peruvian Governance Good Corporate Governance is basically an effort to make GCG a rule and guideline for Company managers in carrying out their business activities. The purpose of this study is to find out, analyze and describe the implementation of the principles of Good Corporate Governance at PT Pertamina (Persero). This research uses a qualitative approach with a descriptive method. The method of data collection is carried out by interviews, observations and documentation. The theory used in this study uses the theory of the basic principles of Good Corporate Governance in Hamdani's book (Review of Ethics in Business Practice), namely the principles of transparency, accountability, responsibility, independency and Fairness. The results of this study show that the implementation of the principles of good corporate governance has been implemented by PT Pertamina Persero properly even though it has not been maximized. This is evidenced by transparency with the existence of an official website that can be accessed at any time, as well as clarity in decision making, annual reports, financial reports, and recruitment processes.

Society 5.0 relies heavily on the Internet of Things, Big Data, Artificial Intelligence, and Robotics to address a variety of social concerns and issues. The government, particularly local governments, faces the problem of maximizing the use of digital technology to improve public services and governance. Better governance facilitated by digital transformation will not only have an effect on public services, but will also increase citizen involvement and stimulate economic growth. This study examines the local government of West Java province's digital transition towards a digital province in the era of society 5.0. This study employs a qualitative approach and descriptive methodologies. The findings of the study indicate that digital transformation in local government in Indonesia lags behind other nations, particularly those in Southeast Asia. This is due to various constraining factors, including a lack of implementation uniformity, insufficient human resources, inconsistent infrastructure, a lack of community participation, and a lack of government commitment. The regional government of the province of West Java is undergoing a digital transformation, which includes the implementation of the West Java Digital Service (JDS), which includes a digital village as one of its initiatives.

Corporate governance is a set of structural process that includes the actions of directing and controlling by the authorized board of directors. In Malaysia, corporate governance is directly under the involvement of the Ministry of Finance, Bursa Malaysia, and Securities Commissions (SC) and Registrar of Company. A good reform of corporate governance in Malaysia is essential to enhance the quality of corporate governance practices after the Asian Financial Crisis 1997. The statistic shows that the low number of Malaysian companies adhered to good corporate governance practices. This poses a question of the extent to what issues and challenges faced by the Malaysian companies reluctantly to adopt a good practice of corporate governance. Hence, the Malaysian government has initiatively introduced Malaysia Code of Corporate Governance (MCCG) as a new code and rules for solving the problems of corporate governance. This study is important to ensure better management of corporate governance of companies in Malaysia, accountability, integrity, and transparency, thereby ensuring the survival of Malaysian corporate governance institutions around the world. The paper uses a qualitative approach. The findings from this study highlight that the introduction of MCCG is tantamount to solve the underpinning problems of the corporate governance system. Pembaharuan tadbir urus korporat yang baik di Malaysia adalah penting untuk meningkatkan kualiti amalan tadbir urus korporat selepas Krisis Kewangan Asia 1997. Statistik menunjukkan bahawa bilangan syarikat Malaysia yang rendah dalam mematuhi amalan tadbir urus korporat yang baik. Poverty is a complex issue in Indonesia. Both the central and regional governments are making various efforts to address the issue of poverty. According to Regional Autonomy Law No. 32 of 2004, the Central Government delegated authority to regional governments to control affairs in the regions in accordance with the conditions of their individual areas. This study focused on Kulon Progo Regency, which had the highest poverty rate in the Special Region of Yogyakarta when compared to other districts. Because Kulon Progo Regency has favorable geographical circumstances in the agricultural and plantation sectors, the majority of the population is employed in these industries. To address the issue of poverty, the Kulon Progo Regency Government employs an alternative development paradigm. The implementation of the alternative development paradigm program necessitates interactive engagement among the parties involved, necessitating the use of a collaborative governance approach. State actors as well as non-state actors are involved. The purpose of this research is to identify the concept of collaborative governance in poverty alleviation in Kulon Progo Regency. According to the findings of this study, the community as a subject and object/actor is critical in the concept of collaborative governance in poverty alleviation. Namun, Kabupaten Lebak kini telah berusaha melepas predikat tersebut. Secara bertahap Kabupaten Lebak Banten sudah dua kali menerima penghargaan dalam Kinerja dan Tata kelola pemerintahan yang baik. Tujuan penelitian ini adalah untuk mengetahui good governance dalam tata kelola pemerintahan Kabupaten Lebak di bawah kepemimpinan Iti Octavia. Temuan dalam penelitian ini bahwa tata kelola pemerintahan kabupaten Lebak dipimpin oleh Iti Octavia sudah berjalan dengan baik. Good governance terdiri dari beberapa prinsip, yaitu: partisipasi, penegakan hukum, transparansi, orientasi konsensus, daya tanggap, keadilan, visi strategis, akuntabilitas, efektifitas dan efesiensi, mampu dipenuhi oleh Pemerintah Kabupaten Lebak. Pemenuhan kesembilan prinsip ini membuktikan bahwa Pemkab Lebak memang berhak mendapatkan penghargaan terkait kinerja dan tata kelola pemerintahan yang baik. Paper ini dapat menjadi model dan bahan evaluasi bagi pemerintah lain dalam penerapan prinsip good governance. Untuk penelitian selanjutnya, kajian ini perlu dilakukan melalui pendekatan perbandingan dengan pemerintah lain untuk mengukur keberhasilan penerapan prinsip good governance di ranah pemerintah lokal. Kata kunci: Good Governance, Pemkab Lebak, dan Kinerja Pemerintah ABSTRACT Tens of villages out of 340 villages in Lebak Regency were still said to be lagging behind. In fact, 50% of the poorest villages in Banten Province are in Lebak Regency. However, Lebak Regency has now tried to release the predicate. Gradually, the Lebak Regency of Banten has twice received awards in Performance and Good Governance. The purpose of this study was to determine good governance in governance in the Lebak Regency under the leadership of Iti Octavia. The findings in this study are that the governance of the Lebak district led by Iti Octavia has been going well. Good governance consists of several principles, namely: participation, law enforcement, transparency, consensus orientation, responsiveness, justice, strategic vision, accountability, effectiveness and efficiency, able to be fulfilled by the Lebak Regency Government. Fulfilling these nine principles proves that the Lebak Regency Government is indeed entitled to receive awards related to performance and good governance. This paper can be a model and evaluation material for other governments in applying the principles of good governance. This study needs to be done through a comparative approach with other governments to measure the success of the application of the principles of good governance in the realm of local government. This study aims to determine the existence of Islamic banking health in Indonesia during 2014-2018 using the RGEC (Risk profile, Good Corporate Governance, Earning, Capital) method. Risk profile with NPF and FDR approach. GCG with 11 management elements. Income with ROA, ROE and BOPO approaches. Capital with CAR approach. The sample taken is 11 Islamic banks that have spin of (separately) from their parent, and successively submit financial reports, GCG reports and risk management reports annually to Bank Indonesia. Data collection was carried out by accessing Islamic bank data which were examined through the official websites of BI, OJK and each Islamic bank website. Data analysis used quantitative descriptive method. The results show that the average condition of Islamic banking during 2014-2018 shows a composite rating of 2 or in a healthy condition but has not reached composite 3. An important research implication for Islamic bank management is that Islamic banks must continue to increase capital and profits then manage risk and run good governance so that the health of the bank is maintained and able to compete with conventional banks.

Balian used to be a Customary Institution that organizes all life of the village community in the Meratus Mountains, including managing the village by upholding the local wisdom. Since the New Order, the paradigm of “the state-enters-the village” governs villages through its set of legislation in the governmentality scheme. Behind the shield of will to improve (KAT empowerment) as a media of discursive power (Li, 2007), the government reshape all social order and local indigenous social governance to “obey” to one formal rule. Unconsciously or intentionally, that governmentality has triggered a shift in local indigenous governance from the basis of local wisdom to the basis of modern governance, with the risk of a shift in the legitimacy of Balian’s power vis-à-vis its community. This study is built on Foucault’ theory of governmentality (1982) and Li’s will to improve (2007). The research method used in this study was a qualitative descriptive method by collecting data, in-depth interviews, and participatory observation. The shift led the role and function of the Balian to be no longer the sole holder of local governance with a local wisdom approach. In the current local governance, it is held by the Village Government, the Sub-District Customary and Balian’s Heads. The shifts that also occurred in the community included the shifting of traditional culture in selling rice which was once considered a taboo to be a commonplace thing and the tendency of the community to resolve conflicts with government institutions rather than the customary or Balian’s Heads.

This research explores the principle of pang on payu as a supporting dimension for the implementation of good governance in the settlement of bad credit disputes at the Village Credit Institution (LPD) Desa “X” in Bali. By using a phenomenological approach, the results of this research show that the principle of pang di payu is effective in supporting the implementation of good governance in LPDs, especially in the case of bad credit disputes. Further findings show that, firstly, the principle of pang di payu is the most appropriate means to build synergy between LPDs and the community, and secondly, this principle is able to increase the credibility of LPDs. The Village Credit Institution requires the application of good governance supported by the principle of pang di payu to protect its sustainability from the "attack" of financial institutions in the current era of globalization.

The reform era demands that governments run governance by being based on good governance. This research aims to prove empirically the influence of internal control system implementation and accountability of regional financial management to the efforts to realize good governance in Minahasa district. The type of research used is quantitative research with a descriptive approach. The population in this study was 211 Echelon III in 33 SKPD in Minahasa District as well as sample selection using purposive sampling technique. Data collection is conducted by spreading questionnaires on 65 respondents in 32 SKPD. Data is processed using SPSS program version 25. Data analysis methods use multiple linear regression analyses and t tests to partially test hypotheses. The results showed that 1) the internal control system has a positive and significant effect on the efforts to realize good governance. 2) Accountability of regional financial management has no positive and significant effect on the efforts to realize good governance.

The issue of prohibition of food, beverage and medicinal products has been on the rise several times in Muslim societies, as in the case of 2000, Indonesian Muslims were overwhelmed with Monosodium Glutamate (MSG) products in their production process using a catalyst from Bactosoytone containing pig enzymes, issued a fatwa to revoke the product from circulation and declare haram for consumption.After that, 2016 was raised again the case with the bakery products of famous brands in Indonesia, which before the product has been labeled halal, was circulated on the prohibition of the materials used in the manufacture of some types of their cakes. This creates anxiety for the people of Indonesia, especially Muslims.This study aims to describe about ethical theory and good corporate governance in Islam and describe its implications for violations of ethics and governance in sharia business and offer solutions and ways to overcome them. This research is descriptive research by using library research approach (library research). By describing the theory of ethics and governance then its implications for the impact of the problem of violations of halal business in Indonesia, and formulate solutions in the matter.In this study, the authors also offer the implementation of CSR on certification assessment that must be passed in 3 levels of Halal Product, Responsible Halal Product, Responsible Halal Business. It will motivate business people to fulfill these three levels, so that businesses that have ethics and good corporate governance and achieve the level of Islam, Faith, and Ihsan in business.

The purpose of this study is to prove whether or not there is an effect of the implementation of Good Corporate Governance on financial performance. The type of research used is quantitative with an associative approach and secondary data. Purpose sampling technique is used as a sampling technique. Sources of data taken using secondary data are time series obtained from the company. The data analysis technique in this research uses data analysis in the form of panel data. The study found that only the audit committee board has a significant effect on financial performance. Meanwhile, other results prove that good corporate governance has a significant role in the company's financial performance.

This study used a quantitative approach using secondary data (annual finance report)companies listed on Indeks Saham Syariah Indonesia years 2016- 2018. This study used a significance level of 5%. Based on the regression analysis results, it indicates that institutional ownership and managerial ownership do not have significant effect on Tobin’s Q. On the other hand, indpendent commissioner has significant effect to the Tobin’s Q. Simultaneously, institutional ownership, independent commissioner and managerial ownership have significant effect to Tobin’s Q.

Partnership with private health facilities is BPJS Kesehatan's effort to fulfill its duties and obligations to implement public health services. In public affairs, it is important to implement good governance, including in partnerships. The research objective is to analyze the application of good governance and determine the driving and inhibiting factors in a partnership to provide health services in the city of Semarang. This research is a descriptive study with a qualitative approach. The results showed that the data were collected through interview, observation and documentation techniques which were then analyzed by using the data analysis technique of Miles and Heberman and the source trangulation test used to verify and validate the data. The research results reveal that the implementation of good governance in partnership to provide health services in the city of Semarang has been implemented. However, there are several principles of good governance that have not been implemented optimally, including responsiveness, consensus orientation, and equity. The driving factors for the implementation of good governance are information disclosure and transparency, mutual undestanding and mutual adjustment as well as a strong and binding partnership commitment. Kemitraan dengan Fasilitas Kesehatan Swasta merupakan upaya BPJS Kesehatan dalam memenuhi tugas dan kewajiban melaksanakan pelayanan kesehatan publik. Dalam urusan publik, penting menerapkan good governance, termasuk dalam kemitraan. Tujuan penelitian menganalisis penerapan good governance serta mengetahui faktor pendorong dan penghambat dalam kemitraan guna memberikan pelayanan kesehatan di Kota Semarang. Penelitian ini merupakan penelitian deskriptif dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa data dikumpulkan melalui teknik wawancara, observasi dan dokumentasi yang selanjutnya dianalisis dengan teknis analisis data Miles dan Heberman serta uji trangulasi sumber digunakan untuk memverifikasi dan memvalidasi data. Hasil penelitian mengungkapkan bahwa penerapan good governance dalam kemitraan guna memberikan pelayanan kesehatan di Kota Semarang telah dilaksanakan. Meski demikian, terdapat beberapa prinsip good governance yang belum terlaksana secara optimal, diantaranya daya tanggap (responsiveness), berorientasi konsensus (consensus orientation), dan berkeadilan / keseimbangan (equity). Faktor pendorong penerapan good governance adalah keterbukaan informasi dan transparasi, upaya saling memahami (mutual undestanding) dan saling menyesuaikan (mutual adjustment) serta komitmen kemitraan yang kuat dan mengikat. The waste bank is a container that can solve the problems that the community is currently experiencing through a program by utilizing dry waste to sort and having management like banking but what is stored is waste. The management of the Pancadaya Kuranji Garbage Bank, Padang City, has used many ways to change people's environmental care behavior. The focus of this research is to find an overview of waste bank management efforts, including: knowing the implementation, obstacles, and efforts made in overcoming obstacles to implementing the garbage bank application. in realizing pancadaya good governance in Kuranji, Padang city. This study uses a qualitative approach with data collection techniques of observation, interviews, and documentation studies. The discussion of this research is based on data from interviews with secretaries, coordinators, and members at the Pancadaya Kuranji Garbage Bank, Padang City. The theoretical studies used are Good governance, E-Government, Aspects of Digital Governance, The Role of Digital Governance in realizing good governance, Garbage Bank , and the Garbage Bank Application. The results of this study indicate that the Pancadaya Garbage Bank Application has not been able to provide maximum service. Because the application features are not related to service to the community, and data processing of people who carry out waste transactions. In terms of limited facilities and infrastructure, the solution is in the form of government policy to embrace the private sector in the form of integrated cooperation which certainly benefits both parties

Abstract:
<p>The aim of this research is to prove and analyze the effects of knowledge<br />and corporate governance to sharia stocks. Moreover, the background of the<br />research is based on the different philosophy between mainstream corporate<br />governance and Islamic corporate governance. The methodology of this research<br />applies to circular causation approach which the variables are endogeneity and<br />reciprocal effects. The results of the research are; firstly, it indicates that there are<br />significant positive effects of knowledge to sharia stocks, sharia stocks to knowledge,<br />knowledge to corporate governance, and corporate governance to knowledge.<br />Secondly, there are significant negative effects of corporate governance to sharia<br />stocks and sharia stocks to corporate governance. The reciprocal positif effects are<br />the form of interaction which complements among variables which contain manfaah<br />and mashlaha, whereas the reciprocal negative effects are the form of interaction<br />among variables that contain dharar.<br />Keywords : Circular Causation; Endogeneity; manfaah and mashlaha; dharar.</p>

Se l’orientamento europeo appare quantomai centrato sulla persona e sulla sua unicità anche in termini di sviluppo delle competenze e di opportunità formative, di pari passo si stanno sviluppando nuovi e sempre più interconnessi spazi di apprendimento che implicano il coinvolgimento di varie tipologie di attori, diversi livelli di governance, di partnership pubblico/privato e di una rinnovata attenzione al territorio. Interventi co-progettati e multi-attoriali (scuola, famiglia, organizzazioni del Terzo settore, privato sociale, istituzioni pubbliche) sembrano sempre più necessari ma con peculiari caratteristiche di flessibilità e adeguatezza al territorio di riferimento. Inoltre, il miglioramento della qualità della vita nei centri urbani passa quasi obbligatoriamente attraverso la cultura e l'educazione e varie sono le iniziative focalizzate su questi temi a partire dal programma dell’UNESCO Global Network of Learning Cities. In questa prospettiva anche la scuola si rinnova e anela a diventare un learning hub attraverso peculiari accordi denominati “Patti educativi di comunità” che rappresentano un esempio di buona pratica caratterizzato da un approccio orientato alla co-progettazione e alla valorizzazione della dimensione territoriale. If the European orientation appears to be focused on people also from the point of view of skills development and training opportunities, at the same time new and increasingly interconnected learning spaces are being developed with the consequent involvement of various types of actors, different levels of governance, public private partnerships as well as a renewed attention to the territory. Co-designed and multi-actor interventions (school, family, third sector organizations, private social, public institutions) are more and more necessary but with characteristics of flexibility and adequacy to territorial needs. In addition, the improvement of the quality life within urban centres must go through culture and education; there are various initiatives focused on these issues starting from the UNESCO Global Network of Learning Cities program. In this perspective, the school also renews itself and yearns to become a learning hub through specific agreements called "Community agreements for education" which represent an example of good practice characterized by a co-planning approach and the enhancement of the territorial dimension.

This study aims to determine Profitability, Liquidity, Company Size, and Leverage on Islamic Social Reporting (ISR) in Islamic Banking in Indonesia. The research period is 2016-2019. This study uses a quantitative approach. The population is all sharia banking in Indonesia registered with the OJK in 2016-2019. The sample was determined by purposive sampling technique, so that there were 32 financial reports from 8 BUS. Analysis makes use of multiple linear regression. The results concluded that (1) Profitability has no effect on Islamic Social Reporting. (2) Liquidity has no effect on Islamic Social Reporting. (3) Company size has no effect on Islamic Social Reporting. (4) Leverage affects Islamic Social Reporting. (5) Company age has no effect on Islamic Social Reporting. (6) Islamic Governance Score has no effect on Islamic Social Reporting. Abstract:
The purpose of this study is to find out Innovative Governance in Bulo Wattang Village in realizing the principles of Good Governance and sources of innovation organized by the Government in Bulo Wattang Village, Panca Rijang District, Sidenreng Rappang Regency. This study uses a qualitative descriptive approach with data analysis using the Nvivo 12 Plus For Windows application. The results of this study indicate that government governance in the realization of the principles of good governance has not been maximized. The village government does not have a strategic vision and weak enforcement of the rule of law, while the unaccountable BPD has an impact on the low community participation due to weak law enforcement and the lack of The response from the community has resulted in the ineffective and inefficient implementation of the program run by the village government. The village government has not been able to combine the three main elements, namely the government, the village consultative body, and the community in the same commitment. Innovations organized by the village government are limited to instructive innovations and adaptive innovations without independent innovation.

La capacit&agrave; di stimare la probabilit&agrave; di default &egrave; da sempre uno degli obiettivi principali delle istituzioni finanziarie e, nell'imminente futuro, sar&agrave; sicuramente la chiave per far fronte all'aumento delle esposizioni deteriorate dovuto agli impatti dell'emergenza pandemica da Covid-19. Il presente lavoro si propone di indagare le pratiche di governance e gli strumenti di gestione del rischio di credito adottati per rilevare tempestivamente segnali di squilibrio economico e finanziario delle societ&agrave;. Di conseguenza, &egrave; stata prima condotta una revisione approfondita dei modelli di previsione dell'insolvenza per illustrare limiti e punti di forza ampiamente discussi in letteratura. In secondo luogo, si &egrave; fatto ricorso all'analisi di un case study per descrivere sia la metodologia dell'Early Warning System (EWS), sia le pratiche di governance interna adottate per monitorare e gestire tempestivamente i segnali di deterioramento del merito creditizio. I risultati evidenziano la necessit&agrave; di combinare modelli quantitativi con un approccio di tipo judgmental per costruire un processo di monitoraggio in grado di intercettare anomalie ed evitare errate classificazioni. L'analisi del case study mostra inoltre come il coinvolgimento anticipato degli esperti di ristrutturazione del debito sia un elemento chiave nella definizione delle azioni volte a prevenire eventi di default.&nbsp;
