This book contains the proceedings of the first day of the conference Strumenti alternativi di composizione dei conflitti: la mediazione civile e penale (Alternative instruments for the settlement of disputes: civil and criminal mediation), held in Florence on 20 and 21 October 2010. In recent years criminal mediation has been the subject of acute academic reflection, beginning to open a breach in both legislation and practice. Moreover, mediation has found a consistent and real application within the international perspective. This has opened up new scenarios in which the response to offences expressing a significant illegality is broken down in line with the two paradigms of judicial and "transactional", and within which these paradigms are becoming increasingly integrated.

Abstract:
This chapter analyses the evolution of the Strasbourg case law on the concept of jurisdiction within the meaning of Article 1 of the European Convention on Human Rights by attempting to provide a comprehensive answer to the question of extraterritorial jurisdiction. It ascertains whether there exists any truth in the criticism directed towards the European Court of Human Rights’ case law and, most importantly, any room for its further development. The chapter will first examine the early jurisprudence of the Convention bodies and explain how they dealt with the difficult question of extraterritorial jurisdiction. It will then discuss the two tests developed by the Court when determining extraterritorial jurisdiction in various case scenarios. Finally, the concluding section of the chapter will summarize these discussions and pose a question for future development of the Court’s case law.

Abstract:
This article introduces the linguistic subdiscipline of pragmatics and shows how this is being applied to the development of spoken dialogue systems — currently perhaps the most important applications area for computational pragmatics. It traces the history of pragmatics from its philosophical roots, and outlines some key notions of theoretical pragmatics — speech acts, illocutionary force, the cooperative principle and relevance. It then discusses the application of pragmatics to dialogue modelling, especially the development of spoken dialogue systems intended to interact with human beings in task-oriented scenarios such as providing travel information and shows how and why computational pragmatics differs from ‘linguistic’ pragmatics, and how pragmatics contributes to the computational analysis of dialogues. One major illustration of this is the application of speech act theory in the analysis and synthesis of service interactions in terms of dialogue acts.

• Ischaemic preconditioning is the most powerful endogenous mechanism for limiting myocardial infarct size in the experimental setting. Its clinical application is limited to scenarios in which the index episode of ischaemia and reperfusion can be anticipated such as in the setting of cardiac surgery• Ischaemic postconditioning represents an endogenous cardioprotective strategy which is applied at the onset of myocardial reperfusion, thereby allowing its use as an adjunct to reperfusion in patients presenting with an acute myocardial infarction• Both ischaemic preconditioning and postconditioning recruit a common signal transduction pathway at the time of myocardial reperfusion, which can be targeted by pharmacological agents administered as adjuncts to reperfusion.

This chapter introduces Family Therapy (Systemic Therapy) as a psychotherapeutic approach which explores the patient’s problems in relational terms rather than treating them as if they reside in the patient alone. The focus is upon the dynamic, interactive connections between people and their wider social context and the history of evolving ideas and practices is summarised. The evidence of effectiveness of family therapy in adults is discussed and the implication drawn that there is evidence to support clinical application including older age populations. The chapter illustrates the range of ideas that have been found applicable and helpful in work with older people and illustrates some of these approaches with practice based scenarios from old age psychiatry.

This chapter discusses palliative psychology competencies in the eighth domain of palliative care, which addresses the legal and ethical aspects of palliative care. Firstly, the chapter reviews psychology ethical standards and principles discussing their application and relevance to the palliative care setting. Palliative psychology competencies are presented. Additionally, principles of medical ethics related to decision making are discussed. Complex case scenarios are discussed with the aid of clinical case vignettes. In particular, the discussion focuses on the ethical issues related to disclosure of a terminal prognosis, family conflicts, and intimate partner violence of patients with advanced illness. Psychological approaches and interventions are discussed in the context of the interdisciplinary palliative care tem approach.

Positron emission tomography (PET) is an imaging method that utilizes compounds labeled with positron-emitting radioisotopes as molecular probes to evaluate different neurophysiological processes quantitatively and noninvasively. This chapter provides a background regarding positron emission, radiotracer chemistry, and detector and scanner instrumentation, as well as analytical methods for evaluating basic brain physiology, such as cerebral blood flow and oxygen and glucose metabolism. The methodological aspects of PET imaging, such as patient preparation and optimal scanning parameters, are discussed. Examples of application of blood flow and metabolic imaging in both research and clinical scenarios for the evaluation of normal neurophysiology are provided. Recent advances in PET imaging, including PET-CT and PET-MRI, are also described. Finally, the unique strengths of PET imaging are highlighted.

This chapter proposes palliative psychology competencies in the first domain of palliative care based on the framework of the Clinical Practice Guidelines for Quality Palliative Care. Competencies are conceptualized as comprising knowledge, skills, and attitudes. The role of palliative psychologists is presented through the discussion of clinical case scenarios. These roles for psychologists are discussed in the context of different palliative care settings (inpatient; outpatient, home-based palliative care, hospice). The relevant application of clinical skills is discussed. The difference between palliative care and hospice is also presented. Finally, this chapter approaches the topic of professional self-care, which is conceptualized as a necessary competence for palliative psychologists. The discussion presents risk factors, protective factors, and interventions especially relevant to palliative psychologists.

This chapter contains three groups of ‘general provisions’ of the UNIDROIT Principles of International Commercial Contracts (PICC). The second group of provisions addresses the role and function of mandatory rules and the third group deals with the application of the PICC, focusing on general guidelines for the interpretation of the various articles of the instrument; specific key terms that are used throughout the following Chapters of the PICC such as ‘court’, ‘place of business’, ‘obligor’, ‘obligee’, and ‘writing’; the role of usages and practices established between the parties; and rules for certain scenarios that may arise in various contexts if the PICC apply.

This chapter also looks at issues that typically arise in Energy Charter Treaty (ECT) cases. In particular, it explores those cases in which respondent states have made use of EU law in mounting a jurisdictional or substantive defence under the ECT. First, regarding EU law as a jurisdictional defence, the chapter looks both at intra-European BIT cases and intra-European ECT cases. Regarding the latter, the chapter addresses, among other things, the critical question of whether the ECT is applicable to disputes between an EU member state and a national of another EU member state, or whether such application is precluded by an implicit ‘disconnection clause’ under the ECT, as argued by the EU Commission. Second, regarding EU law as a substantive defence, the chapter analyzes scenarios in which EU law arguably requires conduct, on the part of a member state, that the ECT itself forbids, or vice versa.
