Abstract:
This study seeks to find an explanation for the two main problems associated with the Criminal Division of the Court of Appeal which are, its problems in identifying and correcting the wrongful convictions of the factually innocent, and its inconsistent, unpredictable and contradictory decision making. This study uses empirical data collected from the judgments of the Court to analyse the decision making process of the Court in relation to the powers given to it in the Criminal Appeal Act 1995. The data collected is used to analyse the Court's powers in four main areas which are appeals where the appellant wishes to adduce fresh evidence, appeals where there is a 'lurking doubt', appeals where the appellant is arguing an error occurred either pre-trial or during the trial and the Court's approach to the issue of ordering a retrial. The research conducted for this thesis is a replication study of previous research carried out for the Royal Commission on Criminal Justice which proposed reforms to the Court's powers and ultimately led to the Criminal Appeal Act 1995. The aim of the research is to analyse whether the Court uses an identifiable approach to its various powers, in order to find an explanation as to why the Court has proved so deficient at identifying and correcting the wrongful convictions of the factually innocent, and why its decision making is so inconsistent and unpredictable.

Abstract:
It was almost 10 years ago that Secretary General of the United Nations, Ban Ki Moon described climate change as the 'defining challenge of our age'. His comments came at a time when international attention centred around the Kyoto Protocol and the United Nations Framework Convention on Climate Change. While important, the failure of Kyoto and the UNFCCC to engage key emitters such as China and the U.S has significantly hindered their perceived credibility. The target sets by these negotiations have also attracted criticism, a result of attempts to balance voluntary participation with unenforceable targets. Such criticisms of international efforts have begged the question as to the role of nation states in efforts to address climate change. Since the time Ban Ki Moon made his comments, Australia has become the first country in the world to implement and repeal an emissions trading scheme. This is indicative of the on-going tensions between an economy dependent on fossil fuels and the growing public concerns with its government's inaction: a similar situation to many emissions intensive economies. In the face of international and domestic shortcomings a new decentralized approach has been advocated. Unlike its predecessors, this approach does not present a single solution, but instead calls upon those concerned to effect change locally. The result of such an approach can be seen in many forms, from litigation in the courts to adaptive approaches in local government. Key to these approaches is an underlying ethos, a movement which focuses not on a destination but direction. This direction is change. As the world accepts the realities of our changing climate, so to must we adapt the manner in which we approach it. Western Australia is no exception. This paper will present the limited right to review government decisions as an existing issue which requires change in order to meet the challenges of climate change. Central to this argument is the need to engage local stakeholders, increase scrutiny of government decisions, develop climate jurisprudence and begin a response to climate change from the bottom up. It is in this way that climate change is the catalyst for reviewing appeal rights in Western Australia.

O presente trabalho destina-se a estudar a função do STJ e STF no âmbito dos recursos especial e extraordinário, especialmente no que se refere à uniformização da interpretação do direito objetivo. Revisitaremos as origens destas cortes e a evolução da legislação e da jurisprudência relacionadas ao tema. Daremos destaque às Súmulas do STJ e do STJ que tratam da admissibilidade destes recursos, na técnica da arguição de relevância e à atual sistemática da repercussão geral. Analisaremos a tendência destes tribunais de desenvolverem a chamada jurisprudência defensiva e as inovações trazidas pelo NCPC no que tange ao desestímulo à utilização deste filtro. Concluiremos pela necessidade de fortalecimento dos precedentes criados por estas Cortes

Abstract:
The question asked by this thesis is when and why, as a matter of principle, should there be judicial scrutiny on the merits of administrative decisions on migration status ('migration status decisions') in the United Kingdom? It argues that this is a moral question, engaging concerns of fair treatment. The first two chapters examine the question theoretically. It is argued that access to justice is not a gift of citizenship and that migration status decision-making should be reviewable on the merits to avoid the appearance and/or occurrence of injustice in the light of the effects of migration control on individual migrants and the nature of migration status decision-making as 'very imperfect procedural justice' (save where a decision is not based on the judgment discretion of an administrator). The latter five chapters apply the normative claims to the United Kingdom constitutional context, including the relevant European regimes (European Convention on Fundamental Rights and European Union). First, as background to the argument, a history of recourse from migration status decision-making in the UK from the initial establishment of a review system in 1905 is sketched out. The history demonstrates the absence of a coherent or principled account of migration status appeals. The history is followed by a three-part critique of the current system of recourse in the UK. First rights of appeal in three case studies (deportation, offshore visitors and students) are examined. Secondly, the three standards of review available under judicial review (rationality, anxious scrutiny and proportionality) are critiqued, and thirdly, the contribution of European and international norms is considered. In general terms the thesis concludes that the current UK system of recourse is deficient in certain respects and suggests reform to the current appeals system.

Abstract:
Advertising has been a common element in the web experience for years. Advertisers can use many strategies to reach their intended consumer, and can appeal to for example rationality, emotion or ethics. Using theories on the composition of ads, their context and the web user, this paper presents a study testing two types of advertising appeals – an ethical appeal and a financial appeal. The experiment tested for the effect of these appeals on outcome measures of attitude, trust and credibility, and attributions. The results show some differences between the attitudes toward the ad between the conditions, where the financial appeal produced more positive attitudes. The results also suggest a relationship between the credibility and trust measures, and the overall positive attitude toward the brand. The results are discussed in terms of credibility and perceived veracity of claims associated with the appeal.

The purpose of this thesis is to study if there are any relations between the perceptions of a fear appeal message in relation to the individual experiences of the area. Furthermore to give a general view over research made on fear appeals. The research is made in a qualitative approach were the case study is used. Interviews were used to get relevant information from the chosen respondents. The results if the thesis indicates that there is a relation depending on individual experiences during the perception of a fear appeal message. Those who had considerable experiences from their past, expressed a reaction on the message bud did not act after the recommendation in the message. Those respondents who hadn’t any emotional experiences to relate too were mainly focused on the information in the message.

Abstract:
This study advances a theoretical model of appeal, the framework readers’ advisory (RA) librarians use to make book suggestions. Taking an interdisciplinary approach, it combines elements of media studies, literary theory, and library science to posit new elements of appeal and new models for understanding its dynamics. This dissertation argues that, because appeal as currently practiced relies heavily on reductive binaries, it fails to account for a number of features that play a crucial role in a reader’s experience of a work. Through a historically informed explication of the existing appeal framework, it posits a new formulation: appeal is a tripartite construct involving the sensibility of a text, the content of a work, and the interest of a reader, where reader is understood in its broadest sense. The new framework demonstrates explicitly that appeal is both textual and readerly and advances a number of additional concepts that are possible only in a more nuanced, tripartite structure. The dissertation illustrates its findings through three application chapters, considering in depth Jane Austen’s Persuasion, Charlotte Brontë’s Jane Eyre, and Mary Shelley’s Frankenstein. The study further provides a new theory/practice model of appeal, strongly urging that, if RA service is to continue to advance, its provision and an understanding of its critical concepts be undertaken with depth and rigor.

L’appel devant l’ordre des juridictions administratives françaises a connu une évolution majeure à compter du 1er janvier 1989 du fait de sa dévolution principale à de nouvelles juridictions, les cours administratives d’appel. La thèse vise à évaluer le succès de cette réforme une vingtaine d’années après et à s’interroger sur les évolutions qu’elle a pu induire concernant le régime de l’appel. Ces questions se sont en outre renouvelées du fait de la problématique de l’encombrement des cours à compter de la fin des années 1990. La gestion des flux contentieux a une influence importante sur les évolutions récentes de l’appel. Le sujet amène à réfléchir au rôle de l’appel et à sa place au sein du contentieux administratif. Une comparaison avec la procédure civile permet d’en dégager les caractéristiques propres. L’appel en contentieux administratif apparaît comme l’expression du double degré de juridiction. Il en est l’expression des limites qui lui ont été apportées pour faire face à l’encombrement. Il en est l’expression des limites qu’il induit quant aux deux fonctions du juge d’appel, la fonction de contrôle de la régularité des jugements au travers de l’évocation et la fonction de réformation au travers de l’effet dévolutif
The appeal procedures before the administrative dispute courts has radically evolved since the 1st of January 1989, date of the creation of a new jurisdiction: the administrative appeal courts. The purpose of this thesis is to evaluate the success of this judicial reform twenty years after its beginning and to reflect upon the evolution of the appeal in administrative disputes. Furthermore, at the end of the 90’s, the congestion of the administrative appeal courts renewed the issues related to the organisation of administrative courts: the management of the congestion of the administrative courts influencing significantly the recent evolution of the appeal procedures. This subject calls us to reflect on the place and role in the administrative dispute matter of the appeal procedure. A comparison with the civil procedure will help to identify its very own characteristics. The appeal in administrative procedure appears as an emanation of the right to a second hearing, yet it has been shaped as well by the problem of the congestion of the appeal jurisdictions. Finally, this procedure is the expression of the limits inferred to both functions of the judge of appeal: the control of the regularity of decisions and the role of reformation through the devolution effect leading to the thorough reexamination of the case

За допомогою теоретико-методологічних аналізів визначено основнi поняття тa принципи організації роботи зі зверненнями громадян в оргaнах виконaвчої влaди. З використанням статистичних методів аналізу проаналізовано організацію роботи зі зверненнями громадян у Сумській обласній державній адміністрації, у тому числі у Державній установі «Сумський обласний контактний центр» та виявлено проблеми, які виникають в ході роботи зі зверненнями громадян в органах державної влади. Запропоновано шляхи вдосконалення системи роботи зі зверненнями громадян в органах державної влади.
В работе исследованы отношения, возникающие в системе работы местных органов власти с обращениями граждан, в частности, на уровне Сумской областной государственной администрации. С помощью теоретико-методологических анализов определены основные понятия тa принципы организации работы с обращениями граждан в органа исполнительной власти. С использованием статистических методов анализа проанализированы организацию работы с обращениями граждан в Сумской областной государственной администрации, в том числе в Государственном учреждении «Сумской областной контактный центр» и выявлены проблемы, которые возникают в ходе работы с обращениями граждан в органах государственной власти. Предложены пути совершенствования системы работы с обращениями граждан в органах государственной власти.
The paper examines the relations that arise in the system of local government with citizens' appeals, in particular, at the level of Sumy Regional State Administration. With the help of theoretical and methodological analyzes the basic concepts and principles of organization of work with citizens' appeals in the executive bodies are determined. Using statistical methods of analysis, the organization of work with citizens 'appeals in the Sumy Regional State Administration, including the State Institution "Sumy Regional Contact Center" was analyzed and the problems that arise during the work with citizens' appeals in public authorities were identified. Ways to improve the system of work with citizens' appeals in public authorities are proposed.

The objective of the present work is to develop an academic study on appeals against a divergent decision of the labor process, mainly seeking to consider and face the innovations that come with Law n. 11496, of June 22, 2007. So as to obtain an understanding of the peculiarities that involve said appeals of such a complex nature, required for in-depth analyses of the general theory of the appeals, concerning their most important aspects and in parallel with extraordinary appeals. The detailed analysis of the aforementioned issue is justified, not only because it deals with an appeal of undeniable significance within the labor area and that it is difficult to be characterized, but also because after the legislative changes that took place as of June 22, 2007, very few scholars have studied said issue, bequeathing to us very little bibliography, with many outstanding matters, awaiting for an answer from the doctrine and the jurisprudence. After five years of effectiveness of the new wording of Article 894, Item II, of the Consolidation of Labor Laws: What changes have been experienced in the applicability and in the prosecution of the appeals? How has jurisprudence evolved in the face of the legislative changes made to the aforementioned appeal? Does the new wording of the appeals guarantee access to justice? What is still to be decided upon? In the present study the analytic-deductive method was used, by means of bibliographic research, analyses of appellate decisions, jurisprudential precedents and guidelines of the Superior Labor Court, appellate decisions of the Supreme Court and the Superior Court of Appeals, and court reports. The correct handling of the appeals in the labor process requires lawyers, judges and all those who operate the Law to have wide knowledge of their technique and features. Penetrating the mysteries that absorb an appeal of a complex nature, which are the appeals against a divergent decision of the labor process, is an endeavor that excites and leads to Law evolution
O presente trabalho tem por objetivo desenvolver um estudo acadêmico sobre o recurso de embargos de divergência do processo do trabalho, buscando principalmente a reflexão e o enfrentamento das inovações advindas com a Lei 11.496, de 22/06/2007. Para se chegar à compreensão das peculiaridades que envolvem esse recurso de natureza tão sinuosa, necessária a análise aprofundada da teoria geral dos recursos, em seus meandros mais relevantes e em paralelo com os recursos de natureza extraordinária. Justifica-se a detida análise de referido tema, não só porque se trata de recurso de inegável importância na seara laboral e de difícil caracterização, mas também pelo fato de que após a alteração legislativa ocorrida em 22/06/2007, são poucos os estudiosos que se debruçaram sobre o tema, o que nos tem legado uma bibliografia escassa, com muitas questões em aberto, a espera de uma resposta da doutrina e da jurisprudência. Após cinco anos de vigência da nova redação do artigo 894, inciso II, da Consolidação das Leis do Trabalho, quais as alterações sentidas no cabimento e no trâmite do recurso de embargos? Como a jurisprudência tem evoluído diante da alteração legislativa? A nova redação do recurso de embargos garante o acesso à justiça? O que ainda se está para decidir? Nesse estudo foi utilizado o método dedutivo-analítico, por meio de pesquisa bibliográfica, análise de acórdãos, súmulas e orientações jurisprudenciais do Tribunal Superior do Trabalho, súmulas do Supremo Tribunal Federal e do Superior Tribunal de Justiça, assim como revistas especializadas. O manejo correto do recurso de embargos de divergência no processo do trabalho exige do advogado, do magistrado e de todos aqueles que concretizam o Direito amplo conhecimento de sua técnica e de suas singularidades. Abstract:
The primary objective of this research was to investigate whether the principles of Expectancy Violations Theory could be applied to the study of emotional appeals so as to gain an alternative interpretation of the persuasive efficacy of affective messages in the social influence process. Central to this approach is the assumption that certain culturally-based norms guiding the expression of emotion exist at a societal level, and that the violations of these expectancy norms carry implications for the efficacy of persuasive attempts. Specifically, the tenets of EVT suggest that when these violations occur, message recipients will look to the perceived rewardingness of the source of the message, and then interpret the violations as positive or negative. It was posited that these evaluations, in turn, would either facilitate (in the case of positive violations) or inhibit (negative violations) the persuasion process. However, due to a number of methodological confounds in the design of the emotional messages used in this research, this study could not provide a fair test of the predictions suggested by EVT. A significant confederate by actor sex interaction described an experimental situation wherein expectancy violation or confirmation was idiosyncratic to the confederates, which is inconsistent both with the premises of EVT as well as the hypotheses stated in this research. Instead, a series of secondary analyses within confederates was undertaken in an attempt to explore the relationships between source rewardingness and message expectedness on attitude change. However, no significant relationships were found to exist. The discussion section focuses heavily on an analysis of the confounds that existed in this research, and suggestions are made for providing a remedy for similar situations in future research. Finally, directions for future research using expectancy violations theory and emotion are discussed.

The study explores how brands can differentiate from brand puffery through the use of brand genuinuity appeals to improve consumer perceptions and purchase intention. A scale measuring consumers’ attitudes towards the brand’s genuinuity was developed and validated. The main study involved a 3x2 factorial design, exploring brand genuinuity appeals in a luxury automotive (tangible) and a luxury hotel (intangible) context. Results showed the importance of brand genuinuity and provided important insights for academics and practitioners.

The unprecedented turbulence and uncertainty experienced in global economic and financial markets because of the 'credit crunch' has had a damaging impact on consumer confidence. Trust and credibility have been eroded as many customers feel let down by the banks suggesting the need for banks to rebuild constructive dialogue and long-term, meaningful relationships with their customers again. Though financial service, in this case, is considered a utilitarian service, based on the fact that money is needed to support people‘s daily activities, the present state of financial service has suggested the need for banks to appeal to consumers‘ emotions with the aim of improving their reputation. Also, the competition within the industry also could suggest the need to adopt an emotionally appealing advertisement strategy as emotions are known to play an influential role in building robust brand preference. This study builds on the communication theory, meaning transfer theory and consumer involvement theory, to understand the messages the banks are sending out and to elicit consumers‘ emotional reaction. One thousand, two hundred and seventy-four UK bank advertisements in nine national newspapers were content-analysed to identify the emotional appeals presented by the banks. The perception of these appeals and their associated meanings were sought through semi-structured interviews with 33 participants in London and Luton. The results of the analysis indicated that UK Banks are utilising emotional appeal in their advertisements to reach out to the consumers to convince them to upgrade their account, to open an additional account or switch their account. The most predominantly used appeals were relief and relaxation followed by excitement and happiness or satisfaction with the bank, and finally, security and adventure. However, variations were found in different financial products that employed emotional appeals. It was found that high-involvement products such as mortgages and loans used fewer emotional appeals. Both bank groups - high street banks, including the big four (Barclays, HSBC, Lloyds and RBS) and non-high street banks, such as the new entrants, supermarket brands, and online banks were using emotional appeals. However, it is acknowledged that the communication strategies between these banks could be different as the non-high street banks are more likely to repeat and publish the same messages across many newspapers, instead of publishing different emotionally appealing advertisements. Though consumers acknowledged these emotional appeals in the advertisements, they were more concerned about their relationship with the banks as they don‘t rely on advertisements to make a financial decision. Rather, recommendations from families, friends and associates and also branch location are more important when deciding on which bank to choose. The lack of congruency between financial services and emotional appeals in advertisements is also observed as customers are more likely to be persuaded by rational appeals however this study has not completely ruled out emotional appeals in bank advertisements as the use of both types of appeals is recommended. The study provides important theoretical and managerial contributions to understanding how the consumers understand meaning-embedded advertisements produced by the banks. Managers will be able to consider the implications of advertisements in enhancing their brand equity and building relationships with customers in anticipation that, by word of the mouth and established relationship, their bank‘s reputation will be enhanced. Limitations of the study and opportunities for future research are identified.

Transactional Memory (TM) promises a unique combination of safety, convenience, and scalability for synchronization in parallel programs. Programs are annotated with transactions designating regions of code that must execute atomically, and the TM implementation is responsible for guaranteeing this property. Scalable TM implementations will be speculative, executing transactions concurrently where possible and transparently suppressing those that conflict, while guaranteeing that the history of committed transactions is serializable. Recently, practical language integration issues, e.g., publication and privatization, explicit speculation, and interoperability with traditional synchronization, have threatened to erode much of the simplicity that originally made transactional programming appealing. In this thesis we preserve the appeal of transactional programming in practical language settings through wholesale replacement of the traditional memory consistency model with strict serializability (SS)—a transactional memory consistency model derived from the database semantics of the same name. We develop NOrec, a low overhead and moderately scalable software TM that supports SS. We develop and test a novel hybrid TM strategy that pairs NOrec with “best-effort” hardware TM in order to scalably support SS on limited hardware. Finally, we implement a novel sandboxing system that simplifies existing software TMs and enables TM implementations that were not previously viable. We conclude that it is possible to address the practical concerns with language integration without sacrificing the elegant simplicity of transactional programming.

The housing shortage in the United States at the close of World War II led President Truman and his National Housing Expediter, Wilson W. Wyatt, Sr., to enact the Veteran's Emergency Housing Act. Enacted in the spring of 1946, one goal of the V.E.H.A. was to encourage the production of prefabricated and factory-built housing units.The Lustron Homes Corporation, founded by Carl Strandlund, was a subsidiary of Chicago Vitreous Enamel Products Company which received over $37 million from the Federal Government between 19461950, in order to manufacture standardized all-steel houses.This creative project explores the wartime and postwar housing situation across the country, and specifically, in Louisville, Kentucky. An interview with Wilson W. Wyatt, Sr. is included.The production, assembly, and sales practices of the Lustron Homes Corporation are explored through research, and through an interview with the regional salesman who represented Kentucky. Documentation and photographs of Louisville's Lustrons are included.

The traditional model of medicine involves recognizing symptoms, undergoing diagnostic tests to find the cause of the symptoms, and provide treatment to relieve or cure the underlying disease. However, with the advent of genetic testing and the ability to diagnose asymptomatic individuals, the traditional model of diagnostic testing and treatment no longer applies. By employing the Extended Parallel Processing Model, EPPM, and utilizing messages similar to fear appeals, this study examined participants' perceptions of testing and treatment efficacy, behavioral intentions to undergo testing, and attitudes towards traditional and genetically-based diagnostic testing. Results indicated that the type of diagnostic test and the temporal proximity of the treatment with respect to the diagnostic test is important in determining the perceived efficacy of testing, treatment, and intent to undergo testing. Practical as well as theoretical implications are discussed as well as directions for future research.

Unappealing websites are rejected quickly upon visiting them, while visitors spend more time on visually appealing websites before judging its reliability; but to what extent can visual appeal alone carry the success of a website, and is it so powerful that good usability can be sacrificed? This paper studies the respective importance of visual appeal and usability in e-commerce as factors, in order to determine which factor plays the bigger role in generating trust and credibility for an e-commerce site, as credibility perception is highly correlated with its visual complexity. The relation between these two factors and the likelihood to make a purchase is also discussed. Two prototypes for a fictional consumer electronics e-commerce website were created: one with good design and flawed usability, and another with flawed design and good usability. These prototypes were shown to students aged 20-25 and asked which one they found more trustworthy and which they would rather make a purchase from. With the correlation between trust and purchase intention being apparent, the design of an e-commerce website for consumer electronics should focus mainly on the visual appeal. Usability seems to have some value, however it does not seem to be of the same importance as the visual appeal of the site in regards to generating trust, and consequently customers. The prototypes were constructed in Adobe XD, demonstrated with video recordings, and sent out in a survey to 70 students.

To use sexual messages in advertisements are becoming more common by each day, it is known as a method that can be highly effective to influence consumers’ attitudes. However, it is important to carefully consider how the appeal is used as high levels of sexual appeal can be perceived as unethical or offensive to consumers. Several factors are influential on consumers’ attitudes to sexual appeal in advertising. The focus of this study is laid upon the following five factors when it comes to sexual appeal in advertising: level of nudity, gender of the consumer, gender of the model, culture and personality of the consumer.  This thesis examines how young consumers from Canada, Hong Kong and Sweden in the age span between 18–24 years differ in their attitude toward sexual advertisement, connected to the previous mentioned factors. This was done by concluding semi-structured interviews with male and female students from each nation, where they expressed their opinions about sexual commercials. It was found that female participants had a moral dilemma when it came to high levels of sexual appeal. Some of the male respondents were found to be uncomfortable when being exposed to high levels of male nudity, which could be neutralized by including a female model. Furthermore it was found that the personality of the respondent affected how he or she reacted to the shown advertisement.  The findings of this study could be of good use to marketers and advertisers as they do not need to adapt their advertisements to each geographical market to the same extent as it possibly was believed before, as long the targeted group consists of younger consumers.
Användandet av sexuella meddelanden i reklam blir mer och mer populärt varje dag, denna marknadsföringsmetod är väldigt effektiv när det kommer till att påverka konsumenters attityder. Det är dock väldigt viktigt att ta hänsyn till hur det används då höga nivåer av sexuellt innehåll kan uppfattas som oetiskt eller kränkande bland konsumenter. Ett flertal faktorer påverkar konsumenters attityder till sexuell reklam. Denna studie fokuserar på följande fem faktorer när det kommer till sexuell reklam: nakenhetsnivå konsumentens kön, modellens kön, kultur och konsumentens personlighet. Denna uppsats utvärderar hur unga konsumenter från Kanada, Hong Kong och Sverige i åldersspannet 18–24 år varierar i sina attityder till sexuell reklam, kopplat till tidigare nämnda faktorer. Detta möjliggjordes genom semistrukturerade intervjuer med manliga och kvinnliga studenter från varje land, där de uttryckte sina åsikter om sexuella reklambilder. Studien resulterade i att de kvinnliga respondenterna hade ett moraliskt dilemma när det kom till höga nivåer av sexuell reklam. En del av de manliga respondenterna blev obekväma när de exponerades för höga nivåer av manlig nakenhet, vilket kunde neutraliseras av att inkludera en kvinnlig modell. Studien fann även att respondentens personlighet påverkade hur han eller hon reagerade mot den visade reklamen. Resultaten av denna studie kan komma till god användning för marknadsförare och annonsörer då de som tidigare trott, inte behöver anpassa sina reklamer till varje geografisk marknad, så länge som den tilltänkta kundgruppen består av unga konsumenter.

Though Aristotle is famous for defining three persuasive appeals in his treatise On Rhetoric, I argue that a fourth appeal exists in the pages of The Poetics. In addition to character (ethos), logic (logos), and emotion (pathos), the fourth appeal is to narrative (mythos), or the substantive body of values contained within the socio-cultural elements of a given culture. Using the works of Joseph Campbell, Kenneth Burke, and Roland Barthes as touchstones, the goal of this dissertation is to offer a systematic analysis of this appeal. Because human beings at once function with attention to the whole of lived experience, the myth appeal touches on social norms (the assumed reality), ideology (the lived and presumed reality), and hyperreality (where symbols become a reality unto themselves). The substance of the myth appeal is narrative, or undercurrents of stories used in the place of argument. Here, I offer four examples to display these tensions; the first is an "action-figure" toy line to illustrate how an existing mythology from comics conveys ideological values; the second is a post 09/11 comic book series which used hyperreality to critique social norms; the third is Alan Sokal's academic hoax , which showed a cultural tension across all three areas; and finally, a survey of U.S. Supreme Court decisions on privacy to discuss the emerging mythology of abortion. I conclude with a systematic approach to myth, and a brief discussion of additional persuasive appeals.

This research attempts to measure the relationship between time and region on appeals with both criminal and civil cases in Nigeria during the period 1956 to 1965. The four regions studied include Lagos, Midwest, East and West by A.B. Kasunmu. Methodologically, this study employed the Univariate Box Jenkins Model, better known as the Auto-Regressive Integrated Moving Average, which is primarily a Univariate Time Series Analysis and the Analysis of Variance, which is the final statistical analysis used in this study. The major findings of this study were that: (a) the number of civil appeals permitted during the military regimes was significantly lower than those permitted during the civilian regimes; (b) the number of criminal appeals permitted during the military regimes was significantly lower than those permitted during the civilian regimes; (c) there were significant regional differences in the number of civil appeals permitted by the Supreme Court during the civilian and military regimes; and (d) there were significant regional differences in the number of criminal appeals permitted by the Supreme Court during the civilian and military regimes.

The present thesis explored the cognitive and affective mechanisms underlying the cues used to make innocence-guilt decisions in the high-stakes situation of television appeals in which people appeal publicly for the return of a loved one. Two aspects of the processes involved in making judgements of veracity were studied. Part 2 examined the interaction between explicit and implicit judgments. The studies in Part 2 experimentally manipulated aspects of 12 appeals to test hypotheses about the heuristics judges used to determine veracity. The hypotheses in these studies were initially based on the central assumption that in the absence of unambiguous information judges will draw on heuristics to make veracity judgments. These cognitive shortcuts were hypothesised to lead to biases in innocence-guilt judgments. The innocence bias was introduced as a potential predisposition that stood to be tested. Results did not reveal a consistent innocence or guilt bias. Rather, while all four experiments in Part 2 indicated the presence of different underlying cognitive processes across all experimental conditions, the results from these studies would appear to challenge the existence of any intrinsic tendency towards biases. In Part 3, the context of the appeals was taken as the basis for the assumption that truthful people would give clearer indications of grief than ones who were lying. Multivariate cues were analysed simultaneously using 39 appeals, with a theoretical basis drawn from the grief literature. Eight previously unidentified aspects consisting of verbal cues drawn from grief literature are found to distinguish honest and deceptive appeals with high accuracy and reliability. The work thus contributed to the initial understanding of the interaction between explicit and implicit decisions in making innocence-guilt judgments. Standing models of cognitive processing and their implications for the present thesis were also discussed. Contingent upon further clarification of cognitive processes involved during innocence and guilt verdict decision-making, the findings are particularly germane to the area of televised press conferences and have implications for police and practice.

In a two-study thesis, the current project compares the effectiveness of various messages aimed at reducing unsafe high-end tanning behaviors. Study 1 used messages focused on either the appearance or health consequences of tanning in an effort to reduce the intention of unsafe high-end tanning behaviors. The results indicated that participants did not differ in their high-end sun tanning frequencies as a result of the message condition, but that there was an interaction effect between message type and gender, such that appearance messages were most effective at reducing unsafe tanning behaviors for females. However, upon further examination of the appearance messages, it was noted that there were two primary aspects of appearance content that were present: aging and blemishes. Therefore, Study 2 examined whether the gender effect that was present in Study 1 was being driven by either the aging or blemish content of the messages. Surprisingly, it was found in Study 2 that aging messages were more effective on male participants than female participants at reducing intention of unsafe high-end tanning behaviors. Additionally, it was found in Study 2 that graphic images effectively decreased intention to perform unsafe high-end tanning behaviors. These findings along with their implications are discussed.

This dissertation critiques the techniques used to market and distribute consumer electronics products in the United States. Using the wireless networking industry as a case study, I argue that the consumer electronics industry is at the cutting edge of the commercial, consumer nature of U.S. culture and that it operates according to the ideological moorings of what the Frankfurt School called "the culture industry." These moorings include the obscuring of contradiction and the politics of production behind a unified product image, the erasure of individual consumer choice in favor of efficient means of product distribution to an infinite consumer base, an exaggerated presentation of cultural values in product packaging that teach consumers what they should believe and how they should act, and a carefully constructed use of statistical data and quantified consumer behavior to maintain a mass, homogenized culture that opposes characterizations of diversity or heterogeneity that do not expand the consumer base or the target demographic. The rhetorical appeals of consumer electronics marketers depend upon recycled consumer values to create desire through a universal product image, through carefully designed product information, and through highly developed language. The dominant appeals in wireless networking products are to mobility, security, and entertainment. I explicate these appeals using a methodology derived from social-epistemic rhetoric, a rhetoric that examines sites of conflict and contradiction as the arbiters of culture. I explore the contradictions in what I call choicing, or the prediction and manipulation of consumer choice through the marketing, distribution, and use of mass-produced goods. These contradictions include several consumer tactics that confront choicing strategies.

Den ökade konsumtionen har en negativ påverkan på miljön där exempelvis livsmedelsbranschen står för ungefärliga 44-57 procent av de totala växthusutsläppen. Då överkonsumtionen har en negativ påverkan på världen har det blivit allt viktigare att konsumenter blir medvetna om deras konsumtion och dess påverkan på miljön. Forskare menar att konsumenter bör ta till sig ett mer miljöanpassat konsumentbeteende där ett alternativ är att börja konsumera ekologiskt. Tidigare forskare har identifierat att det finns ett attitydgap hos konsumenter gällande ekologisk konsumtion. Attitydgapet innebär att konsumenter uppger sig ha en positiv attityd gentemot att konsumera ekologiska produkter men när de väl ska konsumera väljer de i flesta fall att konsumera konventionella produkter. Varför detta attitydgap existerar har blivit diskuterat av ett flertal forskare. Ett flertal faktorer har blivit identifierade och en gemensam faktor som ett flertal forskare identifierat är informationsbrist (kunskapsbrist). Studier visar att konsumenter möjligtvis inte besitter den kunskap som är nödvändig för att få dem att välja att konsumera ekologiska produkter. En anledning till varför dem möjligtvis inte besitter denna kunskap är då informationen angående innebörden av att konsumera ekologiskt är bristfällig samt att den information som företag använder inte är effektiv. Vår studie har studerat vilken kunskap konsumenter faktiskt besitter gällande KRAVmärkta livsmedelsprodukter, vilket är Sveriges största ekologiskt certifierade märke. Vidare har vår studie studerat om konsumenterna uppfattar att det finns en informationsbrist gällande innebörden av att konsumera KRAV samt vilken sorts information som är mest effektiv för livsmedelsföretagen att använda i deras marknadskommunikation. Studiens resultat visar att respondenterna besitter en relativt låg kunskap gällande KRAV och dess innebörd. Majoriteten av respondenterna uppger korrekta svar i enkätfrågorna men samtidigt uppvisar dem att de flesta känner en stor osäkerhet på om deras angivna svar varit korrekt eller inte. Detta resulterar i att vi författare tolkar att dessa respondenter har en måttlig kunskapsbrist då de inte är säkra på att deras svar varit korrekta. Vidare visar resultatet av vår studie att respondenterna uppfattar att företag kommunicerar innebörden av att konsumera KRAV-märkta livsmedelsprodukter i låg grad. Ytterligare visar studien att den mest effektiva metoden företag inom livsmedelsbranschen bör använda i dess kommunikation av KRAV-märkta livsmedelsprodukter är negativ information. Negativ information innebär att företag använder information i dess marknadskommunikation som triggar konsumenternas negativa känslor. Resultatet av studien visar även att den negativa informationen endast är effektiv att använda om den är ”moderat”, det vill säga måttlig. Om information är extrem visar resultatet att den inte är effektiv att använda för att kommunicera KRAVmärkta livsmedelsprodukter.

Perceived usability is influential for consumers when identifying a product as usable and purchasing it. This study concentrates on the relationship between visual appeal and perceived usability especially for consumer products. The influence of visual appeal on perceived usability for consumer products is scrutinized through the findings of an empirical study besides a broad literature review. In the literature, there are many studies -mostly dealing with the HCI products- claiming that visual appeal affects users&rsquo
perceptions of usability. However, the empirical study results indicate that the relationship between visual appeal and perceived usability is not clear for consumer products as the relationship declared in the literature.

Cette thèse entreprend une analyse complète des appels d'offres en prix et en qualité. Au-delà de l'intérêt économique de ces mécanismes de formation de prix, nous présentons un travail économétrique dont l'objectif est d'estimer les coûts et les paramètres de la distribution jointe des caractéristiques privées des participants. La construction de plusieurs modèles d'appels d'offres bidimensionnels et leurs estimations reposent sur les pratiques de consultations d'un des principaux maitre d'œuvre de systèmes spatiaux français pour la désignation de ses sous-traitants. Les règles de choix sont souvent des mécanismes où s'exerce une censure en qualité et la recherche du meilleur prix. Dans certains modèles, la stratégie d'équilibre est obtenue analytiquement, cependant, l'existence de processus de sélection plus sophistiqués empêche le calcul d'une forme explicite de la stratégie. Nous proposons alors une simulation de l'équilibre de Nash du jeu pour approximer l'expression des fonctions de meilleures réponses dans une classe restreinte de stratégies. Plus généralement, cette thèse présente une réflexion globale au sujet des politiques d'achat dans l'industrie spatiale, une explication détaillée de la déclinaison des formes de contrats et des schémas de partage de risque entre les différents acteurs d'un programme et une projection à court terme des modes de consultation des agences et des maitres d'œuvre. Une analyse des phénomènes de renégociations enrichit également ce travail d'économie appliquée
This thesis deals with a complete analysis of competitive biddings in price and quality. Beyond the economic interest of these price mechanisms, we present here an econometric work whose aim is to estimate the players costs as well as the parameters of the joint distribution of their private characteristics. The bidimensionnal auction models and the estimations rely on practices of a major French prime contractor in space industry. Selection rules are often simple mechanisms with a censor in quality and a research in best prices. In some models, the solution of the game can be analytically derived, but more sophisticated specifications have no explicit solution. We propose in this case to simulate the equilibrium of the game in restricted class of strategies. More generally, the thesis presents a global reflection concerning procurement policy in space industry, a detailed explanation with declination of the type of contracts and the risk sharing schemes between the actors of a space program. A renegociation analysis extands this applied economic work

This thesis studies properties and applications of different generalized Appell polynomials in the framework of Clifford analysis. As an example of 3D-quasi-conformal mappings realized by generalized Appell polynomials, an analogue of the complex Joukowski transformation of order two is introduced. The consideration of a Pascal n-simplex with hypercomplex entries allows stressing the combinatorial relevance of hypercomplex Appell polynomials. The concept of totally regular variables and its relation to generalized Appell polynomials leads to the construction of new bases for the space of homogeneous holomorphic polynomials whose elements are all isomorphic to the integer powers of the complex variable. For this reason, such polynomials are called pseudo-complex powers (PCP). Different variants of them are subject of a detailed investigation. Special attention is paid to the numerical aspects of PCP. An efficient algorithm based on complex arithmetic is proposed for their implementation. In this context a brief survey on numerical methods for inverting Vandermonde matrices is presented and a modified algorithm is proposed which illustrates advantages of a special type of PCP. Finally, combinatorial applications of generalized Appell polynomials are emphasized. The explicit expression of the coefficients of a particular type of Appell polynomials and their relation to a Pascal simplex with hypercomplex entries are derived. The comparison of two types of 3D Appell polynomials leads to the detection of new trigonometric summation formulas and combinatorial identities of Riordan-Sofo type characterized by their expression in terms of central binomial coefficients.
Esta tese estuda propriedades e aplicações de diferentes polinómios de Appell generalizados no contexto da análise de Clifford. Exemplificando uma transformação realizada por polinómios de Appell generalizados, é introduzida uma transformação análoga à transformação de Joukowski complexa de ordem dois. A análise de um n- simplex de Pascal com entradas hipercomplexas permite sublinhar a relevância combinatória de polinómios hipercomplexos de Appell. O conceito de variáveis totalmente regulares e a sua relação com polinómios de Appell generalizados conduz à construção de novas bases para o espaço dos polinómios homogéneos holomorfos cujos elementos são todos isomorfos às potências inteiras da variável complexa. Por este motivo, tais polinómios são chamados de potências pseudo-complexas (PCP). Diferentes variantes de PCP são objeto de uma investigação detalhada. É dada especial atenção aos aspectos numéricos de PCP. Um algoritmo eficiente baseado em aritmética complexa é proposto para a sua implementação. Neste contexto, é apresentado um breve resumo de métodos numéricos para inverter matrizes de Vandermonde e é proposto um algoritmo modificado para ilustrar as vantagens de um tipo especial de PCP. Finalmente, são enfatizadas aplicações combinatórias de polinómios de Appell generalizados. A expressão explícita dos coeficientes de um tipo particular de polinómios de Appell e a sua relação com um simplex de Pascal com entradas hipercomplexas são obtidas. A comparação de dois tipos de polinómios de Appell tridimensionais leva à deteção de novas fórmulas envolvendo somas trigonométricas e de identidades combinatórias do tipo de Riordan – Sofo, caracterizadas pela sua expressão em termos de coeficientes binomiais centrais.

Nesta dissertação é apresentada uma abordagem a polinómios de Appell multidimensionais dando-se especial relevância à estrutura da sua função geradora. Esta estrutura, conjugada com uma escolha adequada de ordenação dos monómios que figuram nos polinómios, confere um carácter unificador à abordagem e possibilita uma representação matricial de polinómios de Appell por meio de matrizes particionadas em blocos. Tais matrizes são construídas a partir de uma matriz de estrutura simples, designada matriz de criação, subdiagonal e cujas entradas não nulas são os sucessivos números naturais. A exponencial desta matriz é a conhecida matriz de Pascal, triangular inferior, onde figuram os números binomiais que fazem parte integrante dos coeficientes dos polinómios de Appell. Finalmente, aplica-se a abordagem apresentada a polinómios de Appell definidos no contexto da Análise de Clifford.
In this thesis an approach to multidimensional Appell polynomials is presented with special relevance for the structure of their generating function. This structure, together with an adequate choice of an ordering for the monomials that are present in the polynomials, gives a unifying nature to our approach and allows the representation of Appell polynomials by means of block matrices. Such matrices are constructed from another matrix with simple structure, called creation matrix, which is a sub-diagonal matrices whose nonzero entries are the successive natural numbers. The exponential of this matrix is the well known lower triangular Pascal matrix, lower triangular, where the binomial numbers appear as part of the coefficients of Appell polynomials. Finally, the presented approach is applied to Appell polynomials defined in the context of Clifford Analysis.
