Full textThis thesis provides a historical, genetic and systematic study of the legal metaphors in the Critique of Pure Reason, which are, implicitly or explicitily, contained in the image of the Tribunal of the Critique as the Tribunal of Reason. The main purpose of this work is to examine how legal terminology and jurisprudence influenced the methodological framework of the Critique of Pure Reason. Furthermore, this study seeks to address how these elements played a role in the emergence of the Critique in the course of the philosophical tradition of modernity and, more specifically, in the development of Kants thought. In order to investigate how the legal metaphors in the Critique of Pure Reason indicate a legal methodological origin of criticism, this work is divided into three parts. Each one of these parts addresses one of the three interpretative aspects mentioned above, namely, the historical, genetic and systematic. The first part deals with a history of the sources and of the concepts which underlie the legal understanding of criticism, namely, the idea of a tribunal and legislation of reason as well as the legal concepts of deduction and antinomy. The second part reconstructs the emergence of the critical philosophy. In this part, the goal is to highlight the genesis of some critical motives which have a bearing on the legal constitution of the Critique and express its methodological concern. More specifically, it addresses both the representation of a judge which reaches an impartial verdict on the pretensions of knowledge and the idea of a nomothetic of pure reason. The third and final part of the work undertakes a systematic analysis of the legal metaphors in the Critique relying on the historical and genetic roots described in the previous parts. It provides an interpretation of the Discipline of Pure Reason as the methodological core of the Critique, of the metaphysical and transcendental deduction as a legal procedure and of the resolution of the antinomy as a precondition for the validity of the legislation of reason. By doing so, this part shows how the systematic investigation of the legal metaphors of the Critique of Pure Reason allows for the understanding of the critical philosophy as the exposition of the negative and positive legislation of reason.

Full textEste trabajo investiga la importancia que tiene la discusión sobre juicios de gusto dentro de la Crítica de la facultad de juzgar de Kant. Se sostiene que buscar acuerdos de facto sobre juicios de gusto es un error y que, más bien, el desacuerdo es deseable. Siguiendo a Kant en la antinomia del gusto, los juicios de gusto no se basan en algún concepto determinado, sino en uno indeterminado. Al no ser determinado, no tenemos intuición sensible de dicho concepto ni podemos emplearlo directamente. No se trata de encontrar un acuerdo de facto para nuestra aspiración de acuerdo universal, sino del descubrimiento de un sentido común, en el que encontramos que los otros pueden sentir como uno ante una representación dada. Este concepto indeterminado se torna en un “ideal regulativo”, inalcanzable, en tanto no se puede determinar, pero al cual se debe apuntar para perfeccionar el gusto. Es en el campo de la discusión y el desacuerdo donde se confrontan los juicios de gusto.

Full textThis work deals with the antinomy of the faculty of knowledge, also known as Zeller\'s paradox, to which Schopenhauer refers in the first book of The world as Will and representation. This question has been much discussed in the history of Schopenhauer\'s thought and still remains today as an unsolved problem. Since the early readers of Schopenhauer, the antinomy of the faculty of knowledge was pointed out as a problem of difficult solution, if not impossible, and explained in different ways. At times, the heterogeneity of the theories on which Schopenhauer\'s thought stands has been pointed out; other times, the antinomy was attributed to errors in the interpretation of Kantian philosophy; for many times referred to a dualism in which collide materialism and idealism, or realism and idealism; and there are still other viewpoints. In this thesis, we propose an alternative interpretation, which takes the difficulties of Schopenhauer\'s philosophy as constitutive, and not pretending to justify or contest it, we search for an understanding from the theoretical questions with which the philosopher faced. As a result, we find that Schopenhauer evidences the inadequacy of both idealism and realism for the complete and correct explanation of the world, as well as the mutual demand between them. The complementarity between the opposing viewpoints of idealism and realism demands they to be articulated, although their combination gives rise to the various problems present in Schopenhauer\'s work, among which is the antinomy of the faculty of knowledge. In addition, we analyzed other issues and difficulties that arose in Schopenhauer\'s thought, some mentioned by the philosopher.

Full textThis dissertation investigates the functions of moral and political thought in modern tragedy (16th-18th centuries), focusing on a group of Neo-Latin, French, Italian and English plays which represent the death of the Roman dictator Julius Caesar, as well as on Corneille’s Cinna. In order to provoke the tragic emotions, a fable must represent a character or a group of characters whose fall from happiness into mishap is a consequence of a morally or politically ambiguous “flaw”. This sequence is particularly tragic when the “flaw” is at least partially unintentional and results from a kind of necessity : tragedy thus manifests the importance of “moral luck”. The ambiguity of the tragic “flaw” may arise from different circumstances ; in the plays representing the death of Caesar it consists on the one hand in the antinomies which the characters must face, on the other hand in the fact that their motivations appear in some ways contrary to the arguments they use in order to justify themselves. Modern tragedy is profoundly extraneous to contemporary casuistry (as developed in the rhetorical theory of invention, in moral and political philosophy and in historical writing), in that it leaves moral and political “cases” unsolved. However, Cinna, the first happy-ending tragedy in the French theatre, shows how reconciliation and a morally and politically satisfying ending are possible despite the tragic antinomies

, postulates freedom as a noumenal cause together with the law of causality. Transcendental freedom, in this case, is a problematic concept which transcends the limits of experience, as it seems to destruct the unity of experience. However, Kant gives up neither the law of causality nor the idea of freedom, but rather he insists upon the idea that they can exist together without contradiction by asserting the distinction between phenomena and noumena as different grounds on which these two different types of causalities rest. According to Kant both are indispensable, as the former is necessary for the knowledge and the latter is absolutely needed for morality. In this context this thesis aims to explain the objective validity of natural causality which is proved in Second Analogy and the transcendental ground of the idea of freedom which is established in the solution of Third Antinomy in Kant&rsquo
s Critique of Pure Reason. And it is discussed whether Kant&rsquo
s solution of this issue is satisfactory and legitimate or not.

Full textAntónio Ramos Rosa is a major personality in the panorama of contemporary portuguese poetry. Since the decade of 1950, the remarkable originality of his works has been a contribution to the renovation of the poetical universe, having a theoretical and critical main role of intervention among the artistic movements in Portugal. Our project in this research, was to analyse the relations between poetry and philosophy having modernity as its framework, with the concept of time as our guide in a phenomenological perspective (Cf. Husserl, Heidegger, Derrida and Deleuze). Considering language and aesthetic experience as the privileged challenge of modernity in poetry, we have tried to understand in what way the philosophical discourse is inscribed in the poetic works of this author and to show how the analysis of texts allows us to separate the elements of a reflection with an implication on ontological plan. In that way, and since the very first analysis, the concept of time, besides from being an essential element, was to be confirmed as an important mark in the poetic discourse of António Ramos Rosa, and calls for other referents that contribute to structure an innovating language. Our pragmatic approach allows us to identify the particularity of those points, as also as to relevate the place of language and the subject in his totality. In this context the importance of transformation, transparence and utopia became clear. It is a situation of enunciation approaching poetics and dialectics within a web of images and modes of discourse having in the horizon ontology materialized in the language of the poem

Full textThe present dissertation aims to analyze the form of reception of international tax treaties by the Brazilian domestic order. For this to happen, it is important to verify the form as the international law is related with the domestic law. By presenting the International Tax Law as one of the branches of the Public International Law, it is also relevant to study the international treaties as one of the main sources of the International Law, along with the way how the Executive and the Legislative participate of its ratification. Besides that, the dissertation also points for international tax treaties objectives and methods to avoid the double taxation. After the reception of these international treaties, it can appear conflicts with the internal order. And that is te reason to study the general and specific methods adopted by the doctrine and the Federal Supreme Court to solve the legal antinomies.

Resumo: O presente trabalho organiza uma interpretação histórica da obra de dois importantes nomes da experiência musical brasileira: a saber, Chico Buarque de Hollanda e Paulinho da Viola. O procedimento crítico adotado organiza uma periodização das obras dos cancionistas particulares, reconhecidos num "contexto de obras" mais geral. A partir disso, empreende-se a compreensão do sentido histórico destas obras frente ao contexto de época. Tendo em vista a definição de tal contexto, recorreu-se à crítica da "noção de MPB" (Música Popular Brasileira), chegando-se à conclusão de que esta noção é uma impostura conceitual. Por isso, fez-se necessária a avaliação de referenciais críticos que tratassem da dinâmica histórica da experiência musical brasileira. Para efeitos de análise, trabalhou-se com a avaliação do projeto musical de Mário de Andrade, reconhecendo a bossa nova como um desdobramento contraditório da "utopia do som nacional" do modernista. Em seguida, a fim de consolidar conceitos e categorias sobre a experiência musical brasileira, levando em consideração o pressuposto da análise histórica materialista calcada nas mediações estéticas, organizou-se a interpretação dos métodos críticos de José Ramos Tinhorão e José Miguel Wisnik. Aí, reconheceu-se não apenas o reforço de certo referencial teóricometodológico, mas a ressonância de problemas cuja cristalização inicial está na própria experiência musical estudada. De posse das categorias críticas anteriormente consolidadas, apresenta-se os primeiros anos das obras de Chico Buarque e Paulinho da Viola como um período de maturação de antinomias estéticas que sedimentam em forma... Abstract: This thesis organizes a historical interpretation of the work of two important names of Brazilian musical experience, namely: Chico Buarque de Hollanda and Paulinho da Viola. The critical procedure adopted organizes a periodization of the works of particular musicians, recognized in a more generally "context of works". From this, it undertakes to understand the historical meaning of these works in the epochal context. In view of the definition of such a context, one appealed to the criticism of the "concept of MPB" (Brazilian Popular Music), coming to the conclusion that this notion is a sham conceptual. Therefore, it was necessary to evaluate the critical benchmarks that treat the historical dynamics of Brazilian music experience. To the analysis, one worked with the evaluation of the musical project of Mario de Andrade, recognizing Bossa Nova as a contradictory split of "utopia of national sound" of the modernist. Then, in view of consolidating concepts and categories on the Brazilian musical experience, taking into account the assumption of historical materialist analysis based on aesthetic mediation, one organized the interpretation of critical methods of José Ramos Tinhorão and José Miguel Wisnik. In them, it was recognized not only the strengthening of certain theoretical and methodological references, but the resonance of problems whose initial crystallization is in the very musical experience studied. In possession of critical categories previously consolidated, it shows the early works of Chico Buarque and Paulinho da Viola as a maturation period of antinomies aesthetic that sediment objective elements of Brazilian social and political structure in forms of the song language... Full textDistinguishing between general and specific rules of law is a deeply rooted habit among civilist lawyers, concerning the field of theory as the practice one. The roles of this distinction are very different, but they are threatened by two kinds of phenomenas as well : the increasing degreesof specialization and the development of -horizontal- relationship between general rules of lawon the one hand, and specific rules of law in the other hand. As a genuine, it would work,however, always as a good way to order the priority of different rules of law for both legislature and judges, both in academia and in practice.There is however a singular paradox. The general and specific rules of law can't be defined,their relativity is such an obvious one that they inconceivable if the other doesn't exist. According to this idea, their relationship is usually described in terms of opposition. Yet, the meaning of "relativity" is closer to collaboration rather than opposition.Thus, as regards to the development of the law, positive influences are at work. General and specific rule of law are a model to each other. Their evolution takes place in contemplation ofeach part. This especially helps the application of law to refute the idea that the general andspecific rules of law are mechanically mutually exclusive. A part from the possibilities provided by statute law, no basis justifies exclusiveness. Furthermore, specific rules of law sometimes contain a lot of less-defined rules. The value of the solution advocated by the adage "specialia generalibus derogant " is just a presumption, a simple one. A specific rule of law is supposes to be perfectly adapted to a situation, but it may pragmatically, about some case, be less appropriate than the general rule of law

Full textThe incorporation of the Treaty of Rome, through Decree No. 4388/02, at the Brazilian legal system, represented the acquiescence of Brazilian State to the creation of a permanent International Criminal Court, able to judge the severe crimes with international reach. However, despite the tremendous advance for the protection of human rights, since the incorporation, a situation of conflict has iniciated: the Treaty of Rome has human rights precepts in legal antinomy with fundamental rights precepts established in the 1988 Federal Constitutionº It discusses, so, if the internal sovereignty is placed in check by international sovereignty. In addition, there are doubts about the own conflicts itself: would these conflicts be real or merely apparent? This dissertation wished to resolve the tension between the precepts, which are: prescrition of crimes vs. non-applicability of statute of limitations; nonextradition vs. delivery; imprisonment for a specific number of years versus a tearm of life imprisonment, less onerous way possible
A incorporação do Tratado de Roma, por meio do Decreto nº 4388/02, ao ordenamento jurídico brasileiro, representou o assentimento do Estado brasileiro à criação de um Tribunal Penal Internacional permanente, apto para julgar os crimes de maior gravidade com alcance internacional. Contudo, apesar do enorme avanço à proteção dos direitos humanos, a partir de tal incorporação, instaurou-se uma situação conflituosa: o Tratado de Roma possui normas de direitos humanos em antinomia jurídica com as normas de direitos fundamentais previstas na Constituição Federal de 1988. Discute-se, assim se a soberania interna é colocada em xeque pela soberania internacional. Além disso, surgem dúvidas acerca dos próprios conflitos em si: seriam os conflitos reais ou meramente aparentes? These are the questions we proposed to examine through five novels: La Maison du Peuple by Louis Guilloux, L’Espoir (“Man’s Hope") by André Malraux, La Conspiration (“The Conspiracy”) by Paul Nizan, Les Mandarins (“The Mandarins”) by Simone de Beauvoir, and Le Premier Homme (“The First Man”) by Albert Camus. We found that, beyond their friendship and their shared battles, these authors also shared similar views on how to reconcile their personal experiences and the causes of their time — with, here and there, their own particularities, which we examined. The confrontation of these works, which range from the 1920s to the late 1950s, with the literary theories that emerged starting in the 1970s attests to the pertinence of questions raised by this socially-conscious literature (and not only on the formal level). Using this corpus for analysis, but without restricting ourselves to it, we examined the questions of poetics and genre raised by the term “autobiographical novel”, techniques of representation and transposition, and the subjectivity inherent to engaged writing. This will lead us to understand how a personal experience can be transformed into an aesthetic exercise and result in an ethics of praxis

Full textThe socialist tradition was marked by the antinomy revolution versus reform of capitalism. However, as much as the revolutionary orientation, the reformists also pursued the utopie of labor society, and grounded its concept of emancipation in a paradigm of production. This paradigm was responsable for covering the articulation between emancipation and radical democracy and reducing the normative core of the autonomy to the model of action based on labor as in the case of the revolutionary orientation or weakning the political selfdetermination and domesticating the democracy trough interventions of the administrative power as in the case of the reformist orientation. We intend to show that, beyond facing against the determinations imposed by the paradigm of production, the emergency of new social conflicts and struggles for recognition can not be explained from only one sense of emancipation. The reconstruction of the political selfunderstanding of modern societies from a project of radical democracy allow us to understand the diferent senses of emancipation articulated in political processes of opinion and will formation. The utopie of labor society gives place to the struggles for the integrity and autonomy of forms of life, spheres of selfrealization, conquests of rights, and political selfdetermination.

This thesis examines the effects of archetypal-mythological junction - constituting the imaginary communist and the imagery of Christian Doctrine - in the search for Paradise Lost, as presented in the trajectory of the characters of the Assunção de Salviano by Antonio Callado. In this way, through a multidisciplinary approach through the main indications: Mircea Eliade, Raoul Girardet, Carl Gustav Jung, Gaston Bachelard, Northrop Frye, Gilbert Durand, Karl Marx and Friedrich Engels, in addition to the imagery of the Christian Bible, it is possible to notice there is this plot an intense antagonism between the ideology of the Communist Party and the Christian Doctrine. However, both are under the heritage of the sacred, the nostalgia of a glorious past, the dream of a bright future and appeal to the archetype of the Redeemer. Thus, the communist revolutionary intent of Salgado character under the shadow archetype motivates the emergence of four major political myths: Unity, the Golden Age, the Plot Demonic and Salvador with an effervescence oneiric impetus on Redemptory’s role by Manuel Salviano. Through the contact with this character that presents some forms of expression based on Christian doctrine and biblical imagery in his role as "miracle worker". Also, it is possible to verify the influence of the following archetypes: the Redeemer, the Prophet and the Archetype Christian cooperating the way, to the Christian conversion process. Thus, the crossing of the characters is permeated by the antinomy Communism / Christianity, Earthly Paradise / Heavenly Jerusalem, that are problematized by the composition of a system of oppositions: atheism / devotion, materialism / spirituality, anger / resignation, revolutionary / miracle worker, Hell / Heaven all of these culminating in a kind of final confrontation between good and evil, Christ and Antichrist, antagonistic forces from the myth of Apocalyptic Conflict present in the fictional confrontation between Salviano and Salgado. Consequently, this mythical-archetypical reading reveals is a typical evolutionary effect on Salviano’s character that we call archetypal-mythological mimicry, resulting in an evaluative reversal of opposites.
Esta tese versa compreender os efeitos da junção arquetípico-mitológica – constitutiva no imaginário comunista e no imaginário da Doutrina cristã – na busca pelo Paraíso Perdido, assim como se apresentam na trajetória das personagens da obra Assunção de Salviano, de Antônio Callado. Por meio de um enfoque multidisciplinar, entre as principais indicações: Mircea Eliade, Raoul Girardet, Carl Gustav Jung, Gaston Bachelard, Northrop Frye, Gilbert Durand, Karl Marx e Friedrich Engels, além da imagística da Bíblia cristã, nota-se nessa trama um intenso antagonismo entre o ideário do Partido Comunista e a Doutrina cristã. No entanto, ambos estão sob a herança do sagrado, da nostalgia de um passado glorioso, do sonho de um futuro radiante e do apelo ao arquétipo do Redentor. Assim, no intento revolucionário comunista da personagem Salgado, sob o domínio do arquétipo da Sombra, surgem quatro grandes mitos políticos: a Unidade, a Idade de Ouro, o Complô Demoníaco e o Salvador; com ímpetos de efervescência onírica no papel “redentorístico” de Manuel Salviano. Do contato dessa personagem com as formas de expressão da Doutrina cristã e da imagética bíblica em seu papel de “taumaturgo”, percebe-se a influência dos arquétipos: o Redentor, o Profeta e o Arquétipo Cristão; resultando num processo de conversão cristã. Assim, a travessia das personagens se encontra permeada pela antinomia Comunismo/Cristianismo, Paraíso Terrestre/ Jerusalém Celeste, problematizada pela composição de um sistema de oposições: ateísmo/ devoção, materialismo/espiritualidade, indignação/resignação, revolucionário/taumaturgo, Inferno/Céu; que culmina com uma espécie de confronto final entre o Bem e o Mal, o Cristo e o Anticristo, forças antagônicas provenientes do mito do Conflito Apocalíptico presentes no embate ficcional entre Salviano e Salgado. A partir dessa leitura míticoarquetípica, desvenda-se um efeito tipicamente evolutivo na personagem Salviano que denominamos mimetismo arquetípico-mitológico, resultando numa inversão valorativa dos opostos.

Este trabalho é uma abordagem analítica do monodrama Erwartung Op. 17 – obra do expressionismo musical composta por Schoenberg a partir do texto de Marie Pappenheim – que parte das reflexões estéticas de Theodor Adorno sobre a obra e sobre o expressionismo em geral, principalmente em sua Filosofia da Nova Música. O primeiro capítulo aborda os dois conceitos de expressão que caracterizam, na ótica de Adorno, a música anterior ao expressionismo: a expressão como simulação de paixões e a expressão como organização total da forma. Cada uma delas resultou, não obstante, em um bloqueio da expressão, decorrente da hipóstase quer seja do princípio formal abstrato, quer seja dos momentos particulares isolados do todo. Este bloqueio expressivo é desenvolvido no segundo capítulo, que aborda a dinâmica através da qual, num contexto de comercialização e fetichização da cultura, a música tende a forjar uma aparente reconciliação entre a parte e o todo, entre o universal e o singular. A música expressionista realiza uma crítica dessa aparência de conciliação e dá lugar ao singular não mediatizado pela forma. Toma, como conteúdo, os gestos orgânicos, os conteúdos anímicos não mediatizados pelo conceito e pela forma e estabelece o registro documental de gestos orgânicos como procedimento formal. Em virtude do seu princípio expressivo, Erwartung se assemelha a um sismograma, que registra os abalos sísmicos. Full textBloch’s ontology suggests different levels in the category of possibility, and, among them, the subjective possibility, which presupposes the human beings’ capacity to accomplish their daydreams and build their utopias that is a fact that triggers an instrumental rationality, determining the domain that men has towards nature. Another level of the possibility identifies, in the natura naturans movement, “nature that produces nature”, the domain that matter has towards man and the consequent degeneration of the matter in this relationship. Thus, our main objective is to present a blochiana solution to the conflict. According to Bloch, the “possible dialectic” is carried out through the organic interaction between the human being’s tendencies as well as latencies of matter. The current study reflects this possibility and verifies that the process of the instrumentation of the world reveals the “possible dialectic”, which can be the solution of the of the impacts, that are trigged by the matter dynamic and the man’s activity, that generates a relevant tension in docta spes, that is, clarified hope. So, we tried to demonstrate that the consequences of this conflict are appropriate for two movements: the first is generated by the human being’s instrumentation, announced by Frankfurt School and was not understood by man in the XXI century; and the second has, as a consequence, the natural evolution of the science, that develops technologies which can build a new face to the world. Therefore, this research suggests that is necessary to rethink about the solution of organicity, man-matter, announced by Bloch, who introduced the ethic aspect in this relationship.
A ontologia de Bloch propõe vários níveis na categoria da possibilidade, entre elas, uma possibilidade subjetiva, que pressupõe a capacidade de o ser humano em realizar sonhos diurnos e construir suas utopias, fato gerador de uma racionalidade instrumental, determinando o domínio do homem na natureza. Outro nível de possibilidade identifica, no movimento da natura naturans, “natureza que produz natureza”, certa imposição ao ser humano, determinando o domínio da matéria sobre o homem e consequente degeneração da matéria nesta relação. Esta dissertação, portanto, objetiva apresentar a solução blochiana para este confronto. De acordo com Bloch, a “dialética do possível” se realiza através da convivência orgânica entre as tendências do ser humano e as latências da matéria.O estudo reflete esta possibilidade e verifica que o processo de instrumentalização do mundo revela a “dialética do possível” que pode ser solução incompreendida diante dos impactos decorrentes da dinâmica da matéria e da atividade humana, causando, por conseguinte, significativa tensão na docta spes, esperança esclarecida. Procura-se, então, demonstrar que os reflexos desse confronto são apropriados por dois movimentos: o primeiro decorre da instrumentalização do homem, já denunciado pela Escola de Frankfurt e não compreendido pelo homem no século XXI; o segundo tem como causa a evolução natural da ciência, colocando em curso tecnologias capazes de edificar uma nova singularidade no mundo. Neste sentido, o estudo sugere repensar a solução de organicidade, homem-matéria, anunciada por Bloch, introduzindo como pressuposto o elemento ético nesta relação.
