Abstract:
O presente trabalho é uma investigação histórica, genética e sistemática sobre as metáforas jurídicas da Crítica da Razão Pura, contidas, implicita ou explicitamente, na imagem do tribunal da crítica como tribunal da razão. O objetivo de fundo é analisar como a terminologia jurídica e a jurisprudência influíram na estrutura metodológica da Crítica da Razão Pura e em seu surgimento no desenrolar da tradição filosófica da modernidade e, de forma mais específica, no desenvolvimento do pensamento do próprio Kant. De modo a investigar como as múltiplas metáforas jurídicas da Crítica da Razão Pura apontam, todas, para uma origem metodológica jurídica do criticismo, o presente trabalho divide-se em três grandes partes, cada uma delas abordando um dos três aspectos interpretativos mencionados, a saber, o histórico, o genético e o sistemático. Na primeira parte é apresentada a história das fontes e dos conceitos determinantes para a compreensão jurídica da Crítica, a saber, a ideia de um tribunal e legislação da razão e os conceitos jurídicos de dedução e de antinomia. Na segunda parte é esboçada uma reconstrução da história de surgimento da filosofia crítica cujo objetivo é ressaltar a gênese de alguns motivos críticos que dizem diretamente respeito à constituição jurídica da Crítica e se ligam à preocupação metodológica nela envolvida, a saber, a representação de um juiz que julga imparcialmente sobre as pretensões de conhecimento e a ideia de uma nomotética da razão pura. Na terceira e última parte do trabalho empreende-se uma análise sistemática da metafórica jurídica da Crítica cujas raízes históricas e genéticas foram reveladas anteriormente. Mediante a interpretação da Disciplina da Razão Pura, da dedução metafísica e transcendental como procedimento jurídico de justificação de pretensões além da resolução da antinomia como pressuposto para a validade da legislação da razão, mostra-se como a investigação sistemática das metáforas jurídicas da Crítica da Razão Pura permite compreender a filosofia crítica como a exposição da legislação negativa e ao mesmo tempo positiva da razão.
This thesis provides a historical, genetic and systematic study of the legal metaphors in the Critique of Pure Reason, which are, implicitly or explicitily, contained in the image of the Tribunal of the Critique as the Tribunal of Reason. The main purpose of this work is to examine how legal terminology and jurisprudence influenced the methodological framework of the Critique of Pure Reason. Furthermore, this study seeks to address how these elements played a role in the emergence of the Critique in the course of the philosophical tradition of modernity and, more specifically, in the development of Kants thought. In order to investigate how the legal metaphors in the Critique of Pure Reason indicate a legal methodological origin of criticism, this work is divided into three parts. Each one of these parts addresses one of the three interpretative aspects mentioned above, namely, the historical, genetic and systematic. The first part deals with a history of the sources and of the concepts which underlie the legal understanding of criticism, namely, the idea of a tribunal and legislation of reason as well as the legal concepts of deduction and antinomy. The second part reconstructs the emergence of the critical philosophy. In this part, the goal is to highlight the genesis of some critical motives which have a bearing on the legal constitution of the Critique and express its methodological concern. More specifically, it addresses both the representation of a judge which reaches an impartial verdict on the pretensions of knowledge and the idea of a nomothetic of pure reason. The third and final part of the work undertakes a systematic analysis of the legal metaphors in the Critique relying on the historical and genetic roots described in the previous parts. It provides an interpretation of the Discipline of Pure Reason as the methodological core of the Critique, of the metaphysical and transcendental deduction as a legal procedure and of the resolution of the antinomy as a precondition for the validity of the legislation of reason. By doing so, this part shows how the systematic investigation of the legal metaphors of the Critique of Pure Reason allows for the understanding of the critical philosophy as the exposition of the negative and positive legislation of reason.

Abstract:
This paper examines the importance that judgements of taste have within Kant’s Critique of Judgement. It claims that looking for de facto agreements about judgements of taste is a mistake and that disagreements, instead, are desirable. Following Kant in the antinomy of taste, judgments of taste are not based on determined concepts, but rather on an undetermined one. Since the concept is not determined one cannot exhibit it in a sensible intuition or make direct reference to it. It is argued that universal agreement does not seek de facto agreement, but rather the discovery of a common sense in which one discovers that others can feel the same as one does with respect to a given representation. This undetermined concept becomes a “regulative ideal”, unobtainable in so far as one cannot determine it, but to which one must aim in order to perfect one’s taste. It is in the sphere of discussion and disagreement that one confronts one’s judgements of taste.
Este trabajo investiga la importancia que tiene la discusión sobre juicios de gusto dentro de la Crítica de la facultad de juzgar de Kant. Se sostiene que buscar acuerdos de facto sobre juicios de gusto es un error y que, más bien, el desacuerdo es deseable. Siguiendo a Kant en la antinomia del gusto, los juicios de gusto no se basan en algún concepto determinado, sino en uno indeterminado. Al no ser determinado, no tenemos intuición sensible de dicho concepto ni podemos emplearlo directamente. No se trata de encontrar un acuerdo de facto para nuestra aspiración de acuerdo universal, sino del descubrimiento de un sentido común, en el que encontramos que los otros pueden sentir como uno ante una representación dada. Este concepto indeterminado se torna en un “ideal regulativo”, inalcanzable, en tanto no se puede determinar, pero al cual se debe apuntar para perfeccionar el gusto. Es en el campo de la discusión y el desacuerdo donde se confrontan los juicios de gusto.

Abstract:
An antinomy is a contradiction between a principle and its opposite, where there is a compelling case for accepting both. This thesis adopts the antinomy of local-state government in Australia as its central conceptual theme, describing it with the following defensible, but contradictory principles that:¶ · Australian local governments are statutory agencies of Australia’s state governments, with no power or authority beyond that which is ascribed to them by the states (the outside-in principle); and¶ · Local governments in Australia are independent agencies whose authority and interests transcend their regulatory powers by nature of their attachment to their local area (the inside-out principle).¶ The central conceptual theme of the antinomy of local-state government shapes the overall thesis, as well as providing the focus for its introduction and conclusion. The thesis induces elements of the antinomy and structures much of its discussion around these key issues. It does not try to prove or resolve the antinomy. Instead the thesis uses the concept to explore and develop its second complex theme - the practical and applied experience of Australian local governments (LGs) as they attempt to deliver beneficial environmental outcomes. The great bulk of the substantive work presented in the thesis focuses on descriptions and analyses of LGs’ environmental work and the contexts within which they do it. The thesis contends that the local-state antinomy underpins many problems facing Australian LGs as they attempt to deliver beneficial environmental outcomes. Four research questions are addressed. They are:¶ · How can Australian LG capacity to deliver beneficial environmental outcomes be understood?¶ · Within this capacity, what are the environmental outcomes now being achieved by Australian LGs?¶ · How can Australian local government extend its capacity to deliver beneficial environmental outcomes? And¶ · What are the implications of the local-state antinomy on Australian LG capacity to deliver beneficial environmental outcomes?¶ This thesis reviews literature on Australian LG, LG environmental work, and the methods that are appropriate in investigating these questions. The overall thesis uses scientific, grounded theory and action research methods and draws on ideas from symbolic interactionism. Parts of the thesis also use environmental risk assessment, gap analysis techniques, case study and comparative analysis. The goal of generating grounded theories led to a strong focus on the development and exploration of analytical categories and the relationships between them. One such category summarises the relationship between LG and state government (SG), whereby LGs are identified as the inside sphere of government, while the SG is one of several outside spheres. Environmental efforts that impact between the spheres are described in relation to their source and impact, using this terminology, so that inside-out initiatives are driven by LGs but impact more broadly, and outside-in initiatives are driven by states but impact on local areas.¶ Two extensive studies are presented, each stemming primarily from one side of the local-state antinomy. The first is a quantitative, statewide study of local (and state) government implementation of the Queensland Environmental Protection Act. That process is considered a predominantly outside-in environmental initiative, in that LG interest and authority for that work stem directly from a SG statute. For simplicity, this is referred to as an outside-in study. That study involved the development and application of the Comparative Environmental Risk Assessment Method, that enabled the assessment of the environmental and other outcomes from the Queensland legislation.¶ The outside-in study is complimented by comparative case studies that mostly reflect inside-out environmental initiatives as they are defined and described by LGs. Again, this required the development of innovative research methods, specifically a comparative case study method. 34 case studies gathered from different types of LGs across Australia are presented, each representing an attempt by LG to deliver beneficial environmental outcomes.¶ In answer to the research questions, LG capacity to deliver environmental outcomes can be understood when the antinomy is examined through the research methods and analytical categories developed and presented here. LGs are delivering significant beneficial environmental outcomes, both as agents of SGs and through their own initiatives. Improving LG capacity to deliver environmental outcomes primarily requires a respect for LG perspectives, and for LG priorities, which inherently include a focus on their own local areas. State governments can build effective partnerships between the spheres and enhance LG environmental capacity by recognising and supporting LG’s own priorities, while assisting their engagement with broader strategic objectives.

Este trabalho versa sobre a antinomia da faculdade de conhecimento, também conhecida como paradoxo de Zeller, que Schopenhauer refere no primeiro livro de O mundo como Vontade e representação. Essa questão tem sido bastante discutida na história do pensamento schopenhaueriano e permanece ainda hoje como um problema em aberto. Desde os primeiros leitores de Schopenhauer, a antinomia da faculdade de conhecimento foi apontada como um problema de solução difícil, quando não impossível, e explicada de maneiras diversas. Algumas vezes, apontou-se a heterogeneidade das teorias sobre as quais o pensamento schopenhaueriano se ergue; em outras, a antinomia foi atribuída a erros de interpretação da filosofia kantiana; por vezes, remeteram-na a um dualismo em que se chocam materialismo e idealismo, ou realismo e idealismo, e há ainda outras visões. Nesta tese, propomos uma interpretação alternativa, que toma as dificuldades da filosofia schopenhaueriana como constitutivas, e, sem pretender justificá-la nem impugná-la, busca sua compreensão a partir das questões teóricas com as quais o filósofo se defrontou. Como resultado, encontramos que Schopenhauer evidencia a insuficiência tanto do idealismo quanto do realismo para a explicação completa e correta do mundo, bem como a mútua exigência entre ambos. A complementaridade entre os pontos de vista opostos do idealismo e do realismo impõe que sejam articulados, embora sua combinação origine os diversos problemas presentes na obra schopenhaueriana, entre os quais está a antinomia da faculdade de conhecimento. Adicionalmente, analisamos outras questões e dificuldades que surgiram no pensamento de Schopenhauer, algumas mencionadas pelo filósofo, outras não.
This work deals with the antinomy of the faculty of knowledge, also known as Zeller\'s paradox, to which Schopenhauer refers in the first book of The world as Will and representation. This question has been much discussed in the history of Schopenhauer\'s thought and still remains today as an unsolved problem. Since the early readers of Schopenhauer, the antinomy of the faculty of knowledge was pointed out as a problem of difficult solution, if not impossible, and explained in different ways. At times, the heterogeneity of the theories on which Schopenhauer\'s thought stands has been pointed out; other times, the antinomy was attributed to errors in the interpretation of Kantian philosophy; for many times referred to a dualism in which collide materialism and idealism, or realism and idealism; and there are still other viewpoints. In this thesis, we propose an alternative interpretation, which takes the difficulties of Schopenhauer\'s philosophy as constitutive, and not pretending to justify or contest it, we search for an understanding from the theoretical questions with which the philosopher faced. As a result, we find that Schopenhauer evidences the inadequacy of both idealism and realism for the complete and correct explanation of the world, as well as the mutual demand between them. The complementarity between the opposing viewpoints of idealism and realism demands they to be articulated, although their combination gives rise to the various problems present in Schopenhauer\'s work, among which is the antinomy of the faculty of knowledge. In addition, we analyzed other issues and difficulties that arose in Schopenhauer\'s thought, some mentioned by the philosopher.

Abstract:
I interpret and defend Kant's criticism of traditional metaphysics and his indirect proof of transcendental idealism in the first Critique's Antinomy of Pure Reason. Throughout my thesis, I focus on the role of the principle "P2" in the Antinomy ("If the conditioned is given, then the whole sum of conditions, and hence the absolutely unconditioned, is given"). I first defend Kant's use of the principle to motivate the proofs of the Thesis and Antithesis arguments in the second antinomy, which concerns composition, and the third antinomy, which concerns causality. I then explain how the role of P2 in the proofs exposes Kant's indirect proof of transcendental idealism to a significant challenge, to which I develop a response. Finally, I pose the question of whether Kant ultimately argues that the unconditioned exists, or whether he argues that it is merely possible that the unconditioned exists. I explore both options and outline avenues for further consideration of this question, which I argue is crucial to understanding Kant's critical project.

Cette thèse étudie le rôle de la pensée morale et politique dans la tragédie moderne (XVIe-XVIIIe siècles), en se concentrant sur un ensemble de pièces néo-latines, françaises, italiennes et anglaises qui représentent la mort du dictateur romain Jules César, auxquelles on a joint Cinna de Corneille. Pour susciter les passions tragiques, la fable doit représenter un personnage, ou un groupe de personnages, qui passe du bonheur au malheur à la suite d’une « faute » moralement ou politiquement ambiguë. Cet enchaînement est particulièrement tragique lorsque la « faute » est au moins partiellement involontaire et résulte d’une forme de nécessité : la tragédie manifeste alors le poids de la « fortune morale ». L’ambiguïté de la « faute » tragique peut revêtir diverses formes ; dans les Mort(s) de César, elle réside d’une part dans le fait que les personnages sont contraints d’agir dans une situation caractérisée par plusieurs antinomies, d’autre part dans le fait que leurs motivations paraissent à certains égards contraires aux justifications qu’ils avancent. La tragédie moderne est profondément réfractaire à la pensée casuiste contemporaine – sous les diverses formes qu’elle prend dans la théorie de l’invention rhétorique, la philosophie morale et politique et l’historiographie –, car elle laisse irrésolus les « cas » moraux et politiques qu’elle expose. This dissertation investigates the functions of moral and political thought in modern tragedy (16th-18th centuries), focusing on a group of Neo-Latin, French, Italian and English plays which represent the death of the Roman dictator Julius Caesar, as well as on Corneille’s Cinna. In order to provoke the tragic emotions, a fable must represent a character or a group of characters whose fall from happiness into mishap is a consequence of a morally or politically ambiguous “flaw”. This sequence is particularly tragic when the “flaw” is at least partially unintentional and results from a kind of necessity : tragedy thus manifests the importance of “moral luck”. The ambiguity of the tragic “flaw” may arise from different circumstances ; in the plays representing the death of Caesar it consists on the one hand in the antinomies which the characters must face, on the other hand in the fact that their motivations appear in some ways contrary to the arguments they use in order to justify themselves. Modern tragedy is profoundly extraneous to contemporary casuistry (as developed in the rhetorical theory of invention, in moral and political philosophy and in historical writing), in that it leaves moral and political “cases” unsolved. However, Cinna, the first happy-ending tragedy in the French theatre, shows how reconciliation and a morally and politically satisfying ending are possible despite the tragic antinomies

The main concern of the thesis is the problem of reconciliation of freedom and natural causality and to investigate how Kant makes a room for freedom. Kant, firstly, in &ldquo
Analytic&rdquo
, constitutes the conditions of knowledge upon which the objective validity of the law of causality entirely rests. This process of constitution also determines the limits of experience. On the other hand, Kant, in &ldquo
Dialectic&rdquo
, postulates freedom as a noumenal cause together with the law of causality. Transcendental freedom, in this case, is a problematic concept which transcends the limits of experience, as it seems to destruct the unity of experience. However, Kant gives up neither the law of causality nor the idea of freedom, but rather he insists upon the idea that they can exist together without contradiction by asserting the distinction between phenomena and noumena as different grounds on which these two different types of causalities rest. According to Kant both are indispensable, as the former is necessary for the knowledge and the latter is absolutely needed for morality. In this context this thesis aims to explain the objective validity of natural causality which is proved in Second Analogy and the transcendental ground of the idea of freedom which is established in the solution of Third Antinomy in Kant&rsquo
s Critique of Pure Reason. And it is discussed whether Kant&rsquo
s solution of this issue is satisfactory and legitimate or not.

Abstract:
This thesis investigates the characteristically unitary nature of the children’s hearings system (“CHS”) by reference to legal process and decision-making practice. It argues that it is possible to distil from the system’s constitutional document, the Kilbrandon Report, a general philosophy (herein termed the “Kilbrandon ethos”) which should, in principle, underlie the current practice of the CHS. Broadly, this ethos rests on the unitary nature of the system, which involves dealing with all children “in trouble” alike, procedurally and philosophically, whether it is their own actions or those of others that bring them to the attention of the system’s gatekeepers. The thesis argues that it follows from the Kilbrandon ethos that all children referred to children’s reporters (“reporters”), and by reporters to children’s hearings, ought to be dealt with in a similar manner, irrespective of the reason for which they are referred, and thereby explores whether differences in process and decision-making practice apply to different “types” of referral. Bringing together juvenile justice theory, original archival research, doctrinal analysis, classification theory, and the findings of an empirical study on reporter decision-making, the thesis contends that, while the Kilbrandon ethos has proved remarkably resilient, there are, nevertheless, indications that grounds of referral are not entirely interchangeable as access points to the CHS. In particular, it finds that referrals based on the offence ground and, more broadly, referrals based on grounds relating to the child’s conduct, are dealt with differently from referrals based on care and protection grounds. The thesis considers the implications of such differences in approach and explores possible responses to bolster the Kilbrandon ethos in practice.

António Ramos Rosa est une figure majeure dans le panorama de la poésie portugaise contemporaine, avec une œuvre singulière qui a contribué, dès les années 50, à la rénovation de l’espace poétique, en ayant un rôle d’intervention théorique et critique au sein des mouvements artistiques au Portugal Notre propos, dans cette recherche, a été d’étudier les rapports entre philosophie et poésie dans le cadre de la modernité, à partir du temps comme ligne d’orientation dans une perspective phénoménologique (Cf. Husserl, Heidegger, Derrida et Deleuze, entre autres). Considérant le langage et l’expérience esthétique comme l’enjeu privilégié de la modernité poétique, nous avons cherché à comprendre la façon dont le discours philosophique s’inscrit dans le matériau de l’œuvre poétique, et à montrer comment l’analyse des textes peut nous permettre de dégager des éléments pour une réflexion concernant leur implication sur le plan ontologique. Ainsi, dès les premières analyses, le temps a été confirmé, non seulement comme élément essentiel, mais aussi comme marqueur principal dans ce discours qui, dans cette poétique, convoque d’autres référents d’ordre phénoménologique contribuant à la structuration d’un langage novateur. Notre approche pragmatique a permis d’identifier le caractère prégnant de ces référents, dans son ensemble. C’est dans ce contexte que l’idée de transformation, de transparence et d’utopie surgissent. Il s’agit d’une situation énonciative qui rapproche poétique et dialectique dans un réseau d’images et modes du discours qui ont pour horizon l’ontologie et en matérialisant dans le langage du poème
António Ramos Rosa is a major personality in the panorama of contemporary portuguese poetry. Since the decade of 1950, the remarkable originality of his works has been a contribution to the renovation of the poetical universe, having a theoretical and critical main role of intervention among the artistic movements in Portugal. Our project in this research, was to analyse the relations between poetry and philosophy having modernity as its framework, with the concept of time as our guide in a phenomenological perspective (Cf. Husserl, Heidegger, Derrida and Deleuze). Considering language and aesthetic experience as the privileged challenge of modernity in poetry, we have tried to understand in what way the philosophical discourse is inscribed in the poetic works of this author and to show how the analysis of texts allows us to separate the elements of a reflection with an implication on ontological plan. In that way, and since the very first analysis, the concept of time, besides from being an essential element, was to be confirmed as an important mark in the poetic discourse of António Ramos Rosa, and calls for other referents that contribute to structure an innovating language. Our pragmatic approach allows us to identify the particularity of those points, as also as to relevate the place of language and the subject in his totality. In this context the importance of transformation, transparence and utopia became clear. It is a situation of enunciation approaching poetics and dialectics within a web of images and modes of discourse having in the horizon ontology materialized in the language of the poem

A presente dissertação objetiva analisar a forma de recepção dos tratados internacionais em matéria tributária pelo ordenamento jurídico brasileiro. Para isso, é fundamental verificar a relação entre o direito internacional e o direito interno, por meio da análise das teorias monista e dualista. Apresenta-se o Direito Tributário Internacional como uma das variações do Direito Internacional Público, com o objetivo de introduzir a matéria tributária. Estudam-se os tratados como uma das principais fontes do direito internacional e o modo como o Poder Executivo e o Poder Legislativo participam de sua ratificação. Detalham-se, assim, os objetivos e os métodos dos tratados internacionais em matéria tributária, os quais visam a evitar a ocorrência do fenômeno jurídico da bitributação. Concluída a análise do procedimento de internalização desses tratados pelo ordenamento brasileiro, há a possibilidade de surgirem conflitos entre a norma internacional recepcionada e a lei interna anterior ou superveniente. E, por essa razão, apresentam-se os critérios gerais e específicos adotados pela doutrina e pelo Supremo Tribunal Federal para solucionar antinomias jurídicas.
The present dissertation aims to analyze the form of reception of international tax treaties by the Brazilian domestic order. For this to happen, it is important to verify the form as the international law is related with the domestic law. By presenting the International Tax Law as one of the branches of the Public International Law, it is also relevant to study the international treaties as one of the main sources of the International Law, along with the way how the Executive and the Legislative participate of its ratification. Besides that, the dissertation also points for international tax treaties objectives and methods to avoid the double taxation. After the reception of these international treaties, it can appear conflicts with the internal order. And that is te reason to study the general and specific methods adopted by the doctrine and the Federal Supreme Court to solve the legal antinomies.

Resumo: O presente trabalho organiza uma interpretação histórica da obra de dois importantes nomes da experiência musical brasileira: a saber, Chico Buarque de Hollanda e Paulinho da Viola. O procedimento crítico adotado organiza uma periodização das obras dos cancionistas particulares, reconhecidos num "contexto de obras" mais geral. A partir disso, empreende-se a compreensão do sentido histórico destas obras frente ao contexto de época. Tendo em vista a definição de tal contexto, recorreu-se à crítica da "noção de MPB" (Música Popular Brasileira), chegando-se à conclusão de que esta noção é uma impostura conceitual. Por isso, fez-se necessária a avaliação de referenciais críticos que tratassem da dinâmica histórica da experiência musical brasileira. Para efeitos de análise, trabalhou-se com a avaliação do projeto musical de Mário de Andrade, reconhecendo a bossa nova como um desdobramento contraditório da "utopia do som nacional" do modernista. Em seguida, a fim de consolidar conceitos e categorias sobre a experiência musical brasileira, levando em consideração o pressuposto da análise histórica materialista calcada nas mediações estéticas, organizou-se a interpretação dos métodos críticos de José Ramos Tinhorão e José Miguel Wisnik. The critical procedure adopted organizes a periodization of the works of particular musicians, recognized in a more generally "context of works". From this, it undertakes to understand the historical meaning of these works in the epochal context. In view of the definition of such a context, one appealed to the criticism of the "concept of MPB" (Brazilian Popular Music), coming to the conclusion that this notion is a sham conceptual. Therefore, it was necessary to evaluate the critical benchmarks that treat the historical dynamics of Brazilian music experience. To the analysis, one worked with the evaluation of the musical project of Mario de Andrade, recognizing Bossa Nova as a contradictory split of "utopia of national sound" of the modernist. The empirical theme of the present thesis draws upon the foreign policy decision-making processes, which were implemented by the Greek Socialist Government during its first two consecutive terms in office over the time-period extending from October 1981 until June 1989. Whilst the empirical scope of the thesis covers a particular set of foreign policy decisional sequences. which substantiated politically the pursuit of PASOK's ideological endeavours, the analytical orientations of the thesis involve an examination of similar sequences in the light of a set of specific. methodologically induced hypotheses and reflect a set of elemental philosophical preoccupations. By focusing upon a set of specific aspects of the empirical matter approached. the thesis engages upon an analytical discussion of. and adopts a methodological approach to. a characteristic epistemological dichotomy: that formed between interfaces established by perception-based norms of foreign policy behaviour and the philosophical agency exuded by a set of political semantics. Thus. the thesis discusses the empirical and analytical diversity which may characterise the intersubjectively real and the subjectively described. By emphasising the importance attributed to perceptual states in the framework of foreign policy shaping. the thesis raises empirically tangible questions about the extent to which perceptual formats may actually establish objectifiable patterns of foreign policy behaviour and legitimise their inherent ideological rationaJes. In such terms. the theoretical theme of the thesis revolves around the seminal issue of the behavioural agency exercised by perceptual states. which may inexorably determine the substance of actual foreign policy decision-making.

Abstract:
The notion of the organism has a somewhat ambiguous status in Kant’s philosophy. On the one hand it belongs to natural science, on the other hand it is based on an analogy with the structure of reason. Biology therefore has a peculiar place among the sciences according to Kant: it is a natural science constituted by the use of a regulative maxim. The present study places Kant’s views on biological teleology in the larger context of transcendental idealism. It consists of five essays. The first one treats the notions of things in themselves and appearances, arguing for an interpretation in terms of two aspects or perspectives rather than two worlds. The importance of the discursivity of our cognitive capacity is stressed, as well as the need to separate Kant’s various reflective perspectives. In the second essay this interpretation is applied to the third section of the Groundwork, arguing that this text does not belong to theoretical metaphysics, but rather to the articulation of a specifically practical perspective. The third essay discusses similarities and differences between Kant’s a priori conditions for cognition and conceptions of innate ideas in the rationalist tradition. Kant’s comparison of the system of categories with the biological theory of epigenesis is considered in connection to eighteenth century theories of generation. The comparison is viewed as an analogy rather than as a naturalistic theory of the a priori. In the fourth essay Kant’s account of functional attribution in biology is explicated in the context of the present day debate of the issue. It is claimed that Kant’s neo-Aristotelian approach avoids some of the difficulties in the dominant naturalistic accounts of today. Kant’s view differs from the Aristotelian in that it involves a distinction of levels, making it possible to take functional attributions on the one hand as objective from the standpoint of biology but on the other hand as having a merely regulative status from a philosophical point of view. In the fifth essay an interpretation of the antinomy of teleological judgment in the Critique of Judgment is offered. The antinomy is taken to consist in the dialectical tendency to treat the regulative maxims of teleology and mechanism as constitutive principles. The difference between the discursivity of the human understanding and the idea of a non-discursive understanding, an important theme in Kant’s solution of the antinomy, puts the question of biological teleology in relation to central tenets of transcendental idealism.

Distinguer entre le droit commun et le droit spécial est une habitude fortement ancrée chez les juristes, dans le domaine de la théorie comme de la pratique. Les rôles attribués à cette distinction sont d’une grande diversité ; mais ils sont aussi sous la menace de deux phénomènes : la multiplication des degrés de spécialité et le développement de rapports -horizontaux - entre droits communs d'une part, et entre droits spéciaux d'autre part. Véritable "summa divisio", elle disposerait cependant toujours d’une vertu ordonnatrice très importante,tant pour le législateur que pour le juge, et tant à l’université que dans la pratique.Il y a pourtant un singulier paradoxe. Le droit commun et le droit spécial sont indéfinissables ; leur relativité est telle qu’ils ne se conçoivent pas abstraction faite l’un de l’autre. Et, toutefois, la relation qu’ils entretiennent est généralement décrite en termes d’opposition. Or, la relativité appelle bien plutôt la collaboration que l’opposition.C’est ainsi que, s’agissant de l’élaboration du droit, des influences positives sont à l’oeuvre. Le droit commun et le droit spécial se servent mutuellement de modèle. Leur évolution se déroule en contemplation l'un de l'autre. Cela permet surtout, concernant l’application du droit, de réfuter l’idée suivant laquelle le droit commun et le droit spécial s’excluraient mécaniquement. En dehors des hypothèses prévues par le droit écrit, aucun fondement ne justifie l’exclusivisme. Ce dernier ne dispose en outre que d’un régime juridique plein d’incertitude. La valeur de la solution préconisée par l’adage "Specialia generalibus derogant" n’est que celle d’une présomption, simple. « Sur-mesure », le droit spécial est supposé mieux adapté à la situation litigieuse, mais il peut concrètement se révéler moins approprié que le droit commun
Distinguishing between general and specific rules of law is a deeply rooted habit among civilist lawyers, concerning the field of theory as the practice one. The roles of this distinction are very different, but they are threatened by two kinds of phenomenas as well : the increasing degreesof specialization and the development of -horizontal- relationship between general rules of lawon the one hand, and specific rules of law in the other hand. As a genuine, it would work,however, always as a good way to order the priority of different rules of law for both legislature and judges, both in academia and in practice.There is however a singular paradox. The general and specific rules of law can't be defined,their relativity is such an obvious one that they inconceivable if the other doesn't exist. According to this idea, their relationship is usually described in terms of opposition. Yet, the meaning of "relativity" is closer to collaboration rather than opposition.Thus, as regards to the development of the law, positive influences are at work. General and specific rule of law are a model to each other. Their evolution takes place in contemplation ofeach part. This especially helps the application of law to refute the idea that the general andspecific rules of law are mechanically mutually exclusive. A part from the possibilities provided by statute law, no basis justifies exclusiveness. Furthermore, specific rules of law sometimes contain a lot of less-defined rules. The value of the solution advocated by the adage "specialia generalibus derogant " is just a presumption, a simple one. A specific rule of law is supposes to be perfectly adapted to a situation, but it may pragmatically, about some case, be less appropriate than the general rule of law

Abstract:
The statues of Antinous, Hadrian’s favourite, are often believed to be primarily products of Hadrian’s philhellenism. The easiest explanation for Antinous’ unusual historical profile is that Hadrian loved Greek culture, Antinous was Greek, and the statues, mimicking Greek art, are an extravagant commemorative effort. Closer examination reveals that this is too simplistic an explanation. By quantifying extant statues of Antinous based on provenance and iconography, summarizing Hadrian’s ideology, examining Hadrian’s own image, and considering the cult of Antinous, we can see that Antinous played an important role in Hadrian’s ideology. His cult was a social and religious unifier and helped bridge the gaps between communities and foster shared pride and community amongst adherents; the statues, often cultic objects, visually conveyed this purpose through various iconographic connections to other cults. All this complemented Hadrian’s agenda of imperial unity and consolidation. Philhellenism cannot be denied entirely, but the primary purpose of Antinous’ statues was ideological.

The incorporation of the Treaty of Rome, through Decree No. 4388/02, at the Brazilian legal system, represented the acquiescence of Brazilian State to the creation of a permanent International Criminal Court, able to judge the severe crimes with international reach. However, despite the tremendous advance for the protection of human rights, since the incorporation, a situation of conflict has iniciated: the Treaty of Rome has human rights precepts in legal antinomy with fundamental rights precepts established in the 1988 Federal Constitutionº It discusses, so, if the internal sovereignty is placed in check by international sovereignty. In addition, there are doubts about the own conflicts itself: would these conflicts be real or merely apparent? This dissertation wished to resolve the tension between the precepts, which are: prescrition of crimes vs. non-applicability of statute of limitations; nonextradition vs. delivery; imprisonment for a specific number of years versus a tearm of life imprisonment, less onerous way possible
A incorporação do Tratado de Roma, por meio do Decreto nº 4388/02, ao ordenamento jurídico brasileiro, representou o assentimento do Estado brasileiro à criação de um Tribunal Penal Internacional permanente, apto para julgar os crimes de maior gravidade com alcance internacional. Contudo, apesar do enorme avanço à proteção dos direitos humanos, a partir de tal incorporação, instaurou-se uma situação conflituosa: o Tratado de Roma possui normas de direitos humanos em antinomia jurídica com as normas de direitos fundamentais previstas na Constituição Federal de 1988. Discute-se, assim se a soberania interna é colocada em xeque pela soberania internacional. Tomando como punto de partida el proceso revisión de los fundamentos matemáticos llevado a cabo durante el siglo XIX, este estudio se centra en uno de los conceptos matemáticos más importantes: el infinito. Es innegable la importancia de este concepto en el avance de las Matemáticas y es fácil encontrar ejemplos matemáticos en los que interviene (definición de límite, definición de derivada, definición de integral de Riemann, entre otras). Debido a que algunas de las paradojas y contradicciones originadas por la falta de rigor en las Matemáticas están relacionadas con este concepto, se comienza con el estudio epistemológico del concepto matemático del infinito revisando la bipolaridad que presentan algunos conceptos semánticos, definidos de forma inseparable y conjunta, constituyendo un único concepto como si representaran los polos de un imán. En este estudio se concluye que la bipolaridad revela que una lógica conceptual que puede asumir la comprensión de la negación, debe ser una lógica dialéctica, es decir que admite como verdaderas algunas contradicciones. En el caso del concepto matemático de lo finito-infinito, nos encontramos de nuevo con una bipolaridad lógica. Por todo lo expuesto se presenta una teoría no cantoriana para el infinito potencial y actual, basada en la imprecisión lingüística del concepto de infinito, y utilizando el concepto de conjunto homógono, formado por una sucesión convergente y su límite, previamente introducido por Leibniz, que permite aunar los dos polos del concepto de infinito en un único conjunto. Esta nueva teoría de conjuntos permitirá presentar en lenguaje homogónico, algunos de los conceptos fundamentales del análisis tales como, la diferencial y la integral, así como algunas aplicaciones a la Óptica y a la Mecánica Cuántica. Posteriormente se presenta la categoría lógica de la oposición cualitativa a través de diferentes ejemplos de diversas áreas de la ciencia, y se define, a través de tres reglas o normas básicas, el paso de la lógica aristotélica o analítica a la lógica sintética, que incluye al neutro como parte de la oposición cualitativa. Con la aplicación de estas normas a la oposición cualitativa y, en particular, a su neutro, se demuestra que la lógica sintética permite la verdad de algunas contradicciones. Esta lógica sintética es dialéctica y multivaluada y da a cada proposición un valor de verdad en el intervalo [0,1], que coincide con el cuadrado del módulo de un número complejo. Esto marca una notable novedad respecto de la lógica aristotélica o analítica que otorga valores de verdad reales, o incluso a la lógica difusa que, a pesar de ser una lógica multivaluada otorga valores de verdad reales en el intervalo [0,1]. En esta lógica dialéctica, las contradicciones del neutro de una oposición pueden ser verdaderas. Finalmente se plantea la aplicación de la lógica dialéctica, a la Mecánica Cuántica, cuyo carácter es no determinista y en la que es posible encontrar ejemplos de situaciones contradictorias debido a la dualidad onda-corpúsculo. Para ello se establece un isomorfismo entre la lógica dialéctica y la teoría de la probabilidad, a la que se añade el concepto de fortuidad, precisamente para reflejar el carácter no determinista.

Comment concilier le récit d’une expérience personnelle qui met le “moi” écrivain au coeur de l’entreprise auctoriale avec le désir d’intervenir dans la chose publique et politique ? Et comment réunir ces deux dimensions dans l’espace poétique de la fiction afin que ni la biographie ni l’idée ne prennent le pas sur le romanesque ? C’est ce que nous nous sommes proposé d’étudier à travers les exemples de cinq oeuvres : La Maison du peuple de Louis Guilloux, L’Espoir d'André Malraux, La Conspiration de Paul Nizan, Les Mandarins de Simone de Beauvoir et Le Premier Homme d’Albert Camus. Il est apparu que nos auteurs n’ont pas seulement leur amitié ou leurs conflits en commun, mais également une vision convergente sur la manière de conjuguer leur vécu et les causes de leur temps, avec çà et là, les particularités propres à chacun, que nous avons tenté de mettre en lumière. La période que couvre le corpus allant de la fin des années 1920 jusqu’à la fin des années 1950, sa confrontation avec des théories littéraires qui ont fleuri à partir des années 1970 manifeste la pertinence des questions que continue à soulever une littérature engagée dont on a sonné le glas, et pas seulement sur le plan formel. Prenant ce corpus pour matériau d’analyse sans nous y restreindre, nous détaillons les questions de poétique et de genres littéraires que soulève la désignation “roman autobiographique”, les techniques de représentation et de transposition ainsi que la part de subjectivité qui préside à une écriture en situation, afin de déterminer comment une expérience personnelle se transforme en exercice esthétique pour aboutir à une éthique de l’action
How do authors reconcile the desire to share their personal experience — where the “I” is the heart of the work — with the desire to participate in public and political life ? And how can they bring together these two dimensions in the poetic space of fiction, so that neither their biography nor their main thesis end up of overshadowing the work’s novelistic qualities? These are the questions we proposed to examine through five novels: La Maison du Peuple by Louis Guilloux, L’Espoir (“Man’s Hope") by André Malraux, La Conspiration (“The Conspiracy”) by Paul Nizan, Les Mandarins (“The Mandarins”) by Simone de Beauvoir, and Le Premier Homme (“The First Man”) by Albert Camus. We found that, beyond their friendship and their shared battles, these authors also shared similar views on how to reconcile their personal experiences and the causes of their time — with, here and there, their own particularities, which we examined. The confrontation of these works, which range from the 1920s to the late 1950s, with the literary theories that emerged starting in the 1970s attests to the pertinence of questions raised by this socially-conscious literature (and not only on the formal level). Using this corpus for analysis, but without restricting ourselves to it, we examined the questions of poetics and genre raised by the term “autobiographical novel”, techniques of representation and transposition, and the subjectivity inherent to engaged writing. This will lead us to understand how a personal experience can be transformed into an aesthetic exercise and result in an ethics of praxis

Abstract:
This thesis explores the historiography of the images of Antinoös, drawing the most evidence from the Delphi Antinoös, which shows the youth in the guise of Apollo. Building upon the discourse of Hadrian’s “Greekness” and sexuality in connection to the amount of images of Antinoös he had commissioned, this paper instead argues that the images of Antinoös were created in order to further a public and religious programme by Hadrian. I found support in both Mary Boatwright and Paul Zanker as they proposed those images for a public, civic, and religious audience as opposed to private patrons more inclined to luxury. The Delphi Antinoös is a well-documented example of numerous portraits of the youth, and it is this paper’s intention to depict the Pheidian inspiration sought after in the second century CE, at the time of Hadrian’s reign and Antinoös’s death, which illustrate the purpose of the images of Antinoös as religious and not as sexy. Hadrian’s public and religious policies, his tours across the empire, and the far-reaching distribution of images of Antinoös also contribute to the conclusion of the religious audience for the images of Antinoös.

Con la presente ricerca si propone quindi uno studio sulle immagini di Antinoo, con lo scopo di ricostruirne la storia, cercando di risolvere le questioni finora lasciate aperte e approfondendo aspetti fino ad oggi rimasti inesplorati o non sufficientemente indagati. La prima parte della tesi è dunque dedicata alla formazione di tali immagini, soffermandosi sulle forme delle rappresentazioni e sulla loro creazione. Poiché si ritiene che la comprensione delle immagini non possa prescindere dai contesti nei quali e per i quali esse furono realizzate, la seconda sezione è incentrata sulla diffusione delle raffigurazioni di Antinoo e, in particolare, sul rapporto tra queste ultime e i loro contesti di destinazione. Infine, nella terza e ultima parte del lavoro viene trattata la fortuna delle immagini del favorito di Adriano, intendendo per quest’ultima non la fortuna moderna, sulla quale gli studiosi si sono già soffermati, ma piuttosto la trascurata fortuna antica, prendendo in esame la riproduzione e la fruizione di raffigurazioni di Antinoo sia durante che dopo il regno di Adriano, nonché l’influenza esercitata dal ritratto del giovane sulla ritrattistica privata di epoca adrianea e postadrianea. A tradição socialista foi marcada pela antinomia revolução versus reforma do capitalismo. Contudo, tanto a orientação revolucionária quanto a reformista perseguiram a utopia da sociedade do trabalho, fundamentando seu conceito de emancipação a partir de um paradigma produtivista. Este paradigma foi responsável por encobrir a articulação entre emancipação e democracia radical ao reduzir o núcleo normativo da autonomia ao modelo de ação baseado no trabalho como ocorreu com a orientação revolucionária ou engessando a autodeterminação política ao domesticar a democracia com as intervenções do poder administrativo tal como ocorreu no caso da orientação reformista. Pretendemos mostrar que, além de se voltar contra as determinações impostas pelo paradigma da produção, a emergência de novos conflitos sociais e de lutas por reconhecimento não podem mais ser explicadas a partir de um único sentido de emancipação. A reconstrução da autocomprensão política de sociedades modernas a partir do projeto de uma democracia radical nos permite entender os diferentes sentidos da emancipação articulados em processos de formação política da opinião e da vontade. A utopia da sociedade do trabalho dá lugar às lutas em torno da integridade e autonomia das formas de vida, espaços de autorealização, conquistas de direitos e autodeterminação política.
The socialist tradition was marked by the antinomy revolution versus reform of capitalism. However, as much as the revolutionary orientation, the reformists also pursued the utopie of labor society, and grounded its concept of emancipation in a paradigm of production. This paradigm was responsable for covering the articulation between emancipation and radical democracy and reducing the normative core of the autonomy to the model of action based on labor as in the case of the revolutionary orientation or weakning the political selfdetermination and domesticating the democracy trough interventions of the administrative power as in the case of the reformist orientation. We intend to show that, beyond facing against the determinations imposed by the paradigm of production, the emergency of new social conflicts and struggles for recognition can not be explained from only one sense of emancipation. The reconstruction of the political selfunderstanding of modern societies from a project of radical democracy allow us to understand the diferent senses of emancipation articulated in political processes of opinion and will formation. The utopie of labor society gives place to the struggles for the integrity and autonomy of forms of life, spheres of selfrealization, conquests of rights, and political selfdetermination.

A formação do Brasil republicano e da Saúde Pública são eventos contíguos e contingentes. Este campo de pensamentos e práticas não ficou indiferente ao impacto da raça na nossa formação social, pelo contrário: participou ativamente do processo que fez a raça e, sobretudo, o racismo, um axioma de nosso Estado e instituições. Instigada pelo movimento histórico e suas rupturas e permanências, perguntei neste trabalho de que forma a raça opera na saúde nos dias de hoje. Ciente de todos indicadores que apontam a população aquela com as condições de saúde mais precárias (entre os grupos raciais), e de que esses dados têm lastro na sociedade, me propus e pensar nos mecanismos dentro desse sistema que reiteram o lugar subalterno do negro. Com ênfase na relação profissional de saúde-usuário no espaço na Atenção Básica, certa de que essa relação particular daria pistas das relações raciais em esfera mais abrangente, analisamos o discurso dos profissionais de saúde em relação a seus pacientes negros. Nos relatos desses sujeitos, faz um percurso que vai desde a escravidão, passa pelo racialismo, pelo racismo estrutural e institucional, pelas múltiplas tentativas de negação e ocultação desse sistema e pela branquitude. Muitas vozes compõem os discursos sobre a raça, o racismo e a saúde da população negra, discursos marcados pelas contradições inerentes à raça e a todo sujeito social.

As it pursues a course of self-enquiry, Barres' egotism has initiated him to a social sense and led him from the most jealous desire of liberty to the feeling of his roots. This thesis examines the effects of archetypal-mythological junction - constituting the imaginary communist and the imagery of Christian Doctrine - in the search for Paradise Lost, as presented in the trajectory of the characters of the Assunção de Salviano by Antonio Callado. In this way, through a multidisciplinary approach through the main indications: Mircea Eliade, Raoul Girardet, Carl Gustav Jung, Gaston Bachelard, Northrop Frye, Gilbert Durand, Karl Marx and Friedrich Engels, in addition to the imagery of the Christian Bible, it is possible to notice there is this plot an intense antagonism between the ideology of the Communist Party and the Christian Doctrine. However, both are under the heritage of the sacred, the nostalgia of a glorious past, the dream of a bright future and appeal to the archetype of the Redeemer. Thus, the communist revolutionary intent of Salgado character under the shadow archetype motivates the emergence of four major political myths: Unity, the Golden Age, the Plot Demonic and Salvador with an effervescence oneiric impetus on Redemptory’s role by Manuel Salviano. Through the contact with this character that presents some forms of expression based on Christian doctrine and biblical imagery in his role as "miracle worker". Also, it is possible to verify the influence of the following archetypes: the Redeemer, the Prophet and the Archetype Christian cooperating the way, to the Christian conversion process. Thus, the crossing of the characters is permeated by the antinomy Communism / Christianity, Earthly Paradise / Heavenly Jerusalem, that are problematized by the composition of a system of oppositions: atheism / devotion, materialism / spirituality, anger / resignation, revolutionary / miracle worker, Hell / Heaven all of these culminating in a kind of final confrontation between good and evil, Christ and Antichrist, antagonistic forces from the myth of Apocalyptic Conflict present in the fictional confrontation between Salviano and Salgado. Consequently, this mythical-archetypical reading reveals is a typical evolutionary effect on Salviano’s character that we call archetypal-mythological mimicry, resulting in an evaluative reversal of opposites.
Esta tese versa compreender os efeitos da junção arquetípico-mitológica – constitutiva no imaginário comunista e no imaginário da Doutrina cristã – na busca pelo Paraíso Perdido, assim como se apresentam na trajetória das personagens da obra Assunção de Salviano, de Antônio Callado. Por meio de um enfoque multidisciplinar, entre as principais indicações: Mircea Eliade, Raoul Girardet, Carl Gustav Jung, Gaston Bachelard, Northrop Frye, Gilbert Durand, Karl Marx e Friedrich Engels, além da imagística da Bíblia cristã, nota-se nessa trama um intenso antagonismo entre o ideário do Partido Comunista e a Doutrina cristã. No entanto, ambos estão sob a herança do sagrado, da nostalgia de um passado glorioso, do sonho de um futuro radiante e do apelo ao arquétipo do Redentor. Assim, no intento revolucionário comunista da personagem Salgado, sob o domínio do arquétipo da Sombra, surgem quatro grandes mitos políticos: a Unidade, a Idade de Ouro, o Complô Demoníaco e o Salvador; com ímpetos de efervescência onírica no papel “redentorístico” de Manuel Salviano. Do contato dessa personagem com as formas de expressão da Doutrina cristã e da imagética bíblica em seu papel de “taumaturgo”, percebe-se a influência dos arquétipos: o Redentor, o Profeta e o Arquétipo Cristão; resultando num processo de conversão cristã. Assim, a travessia das personagens se encontra permeada pela antinomia Comunismo/Cristianismo, Paraíso Terrestre/ Jerusalém Celeste, problematizada pela composição de um sistema de oposições: ateísmo/ devoção, materialismo/espiritualidade, indignação/resignação, revolucionário/taumaturgo, Inferno/Céu; que culmina com uma espécie de confronto final entre o Bem e o Mal, o Cristo e o Anticristo, forças antagônicas provenientes do mito do Conflito Apocalíptico presentes no embate ficcional entre Salviano e Salgado. A partir dessa leitura míticoarquetípica, desvenda-se um efeito tipicamente evolutivo na personagem Salviano que denominamos mimetismo arquetípico-mitológico, resultando numa inversão valorativa dos opostos.

Este trabalho é uma abordagem analítica do monodrama Erwartung Op. 17 – obra do expressionismo musical composta por Schoenberg a partir do texto de Marie Pappenheim – que parte das reflexões estéticas de Theodor Adorno sobre a obra e sobre o expressionismo em geral, principalmente em sua Filosofia da Nova Música. O primeiro capítulo aborda os dois conceitos de expressão que caracterizam, na ótica de Adorno, a música anterior ao expressionismo: a expressão como simulação de paixões e a expressão como organização total da forma. Cada uma delas resultou, não obstante, em um bloqueio da expressão, decorrente da hipóstase quer seja do princípio formal abstrato, quer seja dos momentos particulares isolados do todo. Este bloqueio expressivo é desenvolvido no segundo capítulo, que aborda a dinâmica através da qual, num contexto de comercialização e fetichização da cultura, a música tende a forjar uma aparente reconciliação entre a parte e o todo, entre o universal e o singular. A música expressionista realiza uma crítica dessa aparência de conciliação e dá lugar ao singular não mediatizado pela forma. Toma, como conteúdo, os gestos orgânicos, os conteúdos anímicos não mediatizados pelo conceito e pela forma e estabelece o registro documental de gestos orgânicos como procedimento formal. Em virtude do seu princípio expressivo, Erwartung se assemelha a um sismograma, que registra os abalos sísmicos. This research is an analytical approach of the monodrama Erwartung Op. 17 – work from the musical expressionism composed by Schoenberg from Marie Pappenheim’s text – which starts from Adorno’s aesthetic reflections about the work and the expressionism as a whole, mainly in his Philosophy of New Music. The first chapter approaches the two concepts of expression that characterizes, in Adorno’s view, music before the expressionism: the expression as simulation of affections and the expression as total organization of form. However, each one of these ways of expression resulted in a blockade of expression, due to hypostasis either of abstract formal principle, or of individual moments separated from the whole. This expressive blockade is developed in chapter two, which approaches the dynamics whereby, in contexts of commercialization and fetishization of culture, music trends to forge an apparent reconciliation of the part and the whole, of universal and singular. Expressionist music accomplishes a critic of this appearance of reconciliation and conveys the form nonmediated singularity. It takes, as content, organic gestures, spiritual contents non-mediated through concept and form and establishes documentary record of organic gestures as formal procedure. Due to its expressive principle, Erwartung resembles a seismogram, which records the seismic events. However, as a result of this denial of formal schemas – either thematic-motivic or harmonic – we don’t see a mere refusal of form over content, but a new kind of relation of form and content, which is developed in last chapter, dedicated to musical analysis

Bloch’s ontology suggests different levels in the category of possibility, and, among them, the subjective possibility, which presupposes the human beings’ capacity to accomplish their daydreams and build their utopias that is a fact that triggers an instrumental rationality, determining the domain that men has towards nature. Another level of the possibility identifies, in the natura naturans movement, “nature that produces nature”, the domain that matter has towards man and the consequent degeneration of the matter in this relationship. Thus, our main objective is to present a blochiana solution to the conflict. According to Bloch, the “possible dialectic” is carried out through the organic interaction between the human being’s tendencies as well as latencies of matter. The current study reflects this possibility and verifies that the process of the instrumentation of the world reveals the “possible dialectic”, which can be the solution of the of the impacts, that are trigged by the matter dynamic and the man’s activity, that generates a relevant tension in docta spes, that is, clarified hope. So, we tried to demonstrate that the consequences of this conflict are appropriate for two movements: the first is generated by the human being’s instrumentation, announced by Frankfurt School and was not understood by man in the XXI century; and the second has, as a consequence, the natural evolution of the science, that develops technologies which can build a new face to the world. A ontologia de Bloch propõe vários níveis na categoria da possibilidade, entre elas, uma possibilidade subjetiva, que pressupõe a capacidade de o ser humano em realizar sonhos diurnos e construir suas utopias, fato gerador de uma racionalidade instrumental, determinando o domínio do homem na natureza. Outro nível de possibilidade identifica, no movimento da natura naturans, “natureza que produz natureza”, certa imposição ao ser humano, determinando o domínio da matéria sobre o homem e consequente degeneração da matéria nesta relação. Esta dissertação, portanto, objetiva apresentar a solução blochiana para este confronto. De acordo com Bloch, a “dialética do possível” se realiza através da convivência orgânica entre as tendências do ser humano e as latências da matéria.O estudo reflete esta possibilidade e verifica que o processo de instrumentalização do mundo revela a “dialética do possível” que pode ser solução incompreendida diante dos impactos decorrentes da dinâmica da matéria e da atividade humana, causando, por conseguinte, significativa tensão na docta spes, esperança esclarecida. Procura-se, então, demonstrar que os reflexos desse confronto são apropriados por dois movimentos: o primeiro decorre da instrumentalização do homem, já denunciado pela Escola de Frankfurt e não compreendido pelo homem no século XXI; o segundo tem como causa a evolução natural da ciência, colocando em curso tecnologias capazes de edificar uma nova singularidade no mundo. Neste sentido, o estudo sugere repensar a solução de organicidade, homem-matéria, anunciada por Bloch, introduzindo como pressuposto o elemento ético nesta relação.

Resumo: Este trabalho é uma abordagem analítica do monodrama Erwartung Op. 17 - obra do expressionismo musical composta por Schoenberg a partir do texto de Marie Pappenheim - que parte das reflexões estéticas de Theodor Adorno sobre a obra e sobre o expressionismo em geral, principalmente em sua Filosofia da Nova Música. O primeiro capítulo aborda os dois conceitos de expressão que caracterizam, na ótica de Adorno, a música anterior ao expressionismo: a expressão como simulação de paixões e a expressão como organização total da forma. Cada uma delas resultou, não obstante, em um bloqueio da expressão, decorrente da hipóstase quer seja do princípio formal abstrato, quer seja dos momentos particulares isolados do todo. Este bloqueio expressivo é desenvolvido no segundo capítulo, que aborda a dinâmica através da qual, num contexto de comercialização e fetichização da cultura, a música tende a forjar uma aparente reconciliação entre a parte e o todo, entre o universal e o singular. A música expressionista realiza uma crítica dessa aparência de conciliação e dá lugar ao singular não mediatizado pela forma. Toma, como conteúdo, os gestos orgânicos, os conteúdos anímicos não mediatizados pelo conceito e pela forma e estabelece o registro documental de gestos orgânicos como procedimento formal. Em virtude do seu princípio expressivo, Erwartung se assemelha a um sismograma, que registra os abalos sísmicos. No entanto, o resultado dessa negação dos esquemas formais - tanto temático-motívicos como harmônicos - não é um simples abandono da forma em detrimento do conteúdo, mas um novo tipo de relação entre forma e conteúdo, que é desenvolvido no último capítulo, dedicado à análise musical
Abstract: This research is an analytical approach of the monodrama Erwartung Op. 17 - work from the musical expressionism composed by Schoenberg from Marie Pappenheim's text - which starts from Adorno's aesthetic reflections about the work and the expressionism as a whole, mainly in his Philosophy of New Music. The first chapter approaches the two concepts of expression that characterizes, in Adorno's view, music before the expressionism: the expression as simulation of affections and the expression as total organization of form. However, each one of these ways of expression resulted in a blockade of expression, due to hypostasis either of abstract formal principle, or of individual moments separated from the whole. This expressive blockade is developed in chapter two, which approaches the dynamics whereby, in contexts of commercialization and fetishization of culture, music trends to forge an apparent reconciliation of the part and the whole, of universal and singular. Expressionist music accomplishes a critic of this appearance of reconciliation and conveys the form nonmediated singularity. It takes, as content, organic gestures, spiritual contents non-mediated through concept and form and establishes documentary record of organic gestures as formal procedure. Due to its expressive principle, Erwartung resembles a seismogram, which records the seismic events. However, as a result of this denial of formal schemas - either thematic-motivic or harmonic - we don't see a mere refusal of form over content, but a new kind of relation of form and content, which is developed in last chapter, dedicated to musical analysis

L'idée même de philosophie semble impliquer la notion de problème, notion-clef, notion fondamentale. C'est toujours en effet à partir d'un ou de problèmes que philosophent Platon, Descartes ou Kant, pour n'en citer que quelques-uns. Nul ne saurait définir la philosophie sans prendre en compte une telle notion puisque c'est elle qui donne sens à la démarche philosophique. Cependant, n'est-il pas étonnant de remarquer que, s'il n'est pas de philosophie sans problème, rares sont les philosophes qui s'interrogent, préalablement à tout engagement dans la philosophie, sur une telle notion ? Tout se passe en effet comme si nous savions clairement ce qu'est un problème philosophique, alors que nous n'en avons à vrai dire qu'une vague intuition. Or, la définition de la philosophie comme son exercice ne supposent-ils pas l'élucidation de la notion à partir de laquelle semble procéder toute philosophie ? Si la philosophie ne s'affirme et n'existe que par rapport à des problèmes précis et spécifiques, alors il devient urgent et nécessaire de mieux cerner une telle notion. L' enquête que nous avons menée dans ce travail de recherche se propose comme objectif: sinon l'élucidation d'une notion complexe et mal définie (alors que son utilisation intensive aurait tendance à faire croire le contraire), du moins la pensée de la nature même des problèmes philosophiques, d'une part. D'autre part, parce qu'il ne suffit pas de constater qu'il y a des problèmes philosophiques ou que des problèmes philosophiques se posent, notre projet a pour but d'établir que leurs possibilités de résolution résident non seulement dans l' explication des problèmes en question, mais aussi dans l' élucidation de leur statut et de leur origine.

Abstract:
On November 9, 2016, Donald Trump was elected President of the United States. No aspect of the campaign was more remarkable than Trump’s rhetoric, which ranged from the candid and unexpected to the crude and incendiary. Now, two years later, his rhetoric—and the reasons for its widespread appeal—remain largely opaque, even under examination from proto-fascist or populist lenses. I seek for a partial account of Trump’s rhetoric using the concept of antinomic rhetoric coupled with the widespread popular perception of him as similar to an internet troll. In short, I believe it is his violation of the conventional standards (nomoi) of rhetoric—his “trolling”— that best explains his remarkable rhetoric. Antinomic rhetoric, as I characterize it here, aims at disruption instead of persuasion and employs deception and aggression instead of shared values and rational proofs. By examining a series of rhetorical exchanges between Trump and Senator Elizabeth Warren, I find evidence that his use of antinomic rhetoric derails conversations, dissolves the standards of rational civic discourse, and draws his opponents into unforced strategic errors. These effects contribute to a chaotic environment where more “ordinary” persuasion can take place on territory more favorable to Trump. I also draw broader inferences about Trump’s use of antinomic rhetoric in rhetorical exchanges other than the ones analyzed here and inquire into what further questions could be asked to deepen our understanding of Trump’s trollery and of antinomic rhetoric in general.

This thesis attempts to understand the distribution of Antinous worship in the Roman Empire and why he was worshipped. By examining the written sources and material culture available on Antinous, primary sources both pagan and Christian, and material culture such as the sculptures of Antinous, Antinoopolis and temples dedicated to Antinous, I came to the conclusion that Antinous was worshipped primary in the Eastern part of the Roman Empire. The Eastern part of the Roman Empire consisted of people who were of Greek descent. By examining Roman writings against Greek people and culture, I came to the conclusion that there were reasons that people worshipped Antinous. The first was to connect to the imperial center because a Roman emperor established the cult of Antinous. The second was that Antinous was Greek, and because Greeks were seen as inferior by the Roman west, his worship appealed to such people.

La deuxième partie est consacrée à la présentation du terrain et à nos choix épistémologiques et méthodologiques. La troisième partie est consacrée à la présentation de nos résultats, prouvant qu'une gestion stratégique des ressources humaines ainsi qu'une vision partenariale de la banque permet une meilleure création de valeur. GRH et finance sont ainsi complémentaires. Leur combinaison conduit à une meilleure création de valeur sur le long terme.

Little did Hadrian know in 130 A.D. that when he deified his beloved departed Antinous, in order to provide a unifying symbol of worship for his diverse empire, that he was instead creating a lasting symbol of the antique world. This thesis examines the power of nostalgia and its successful use by two formidable men from different eras in Rome: The Emperor Hadrian and the extravagantly wealthy Renaissance merchant Agostino Chigi. Though separated by centuries, each man used the nostalgic allure of the beautiful youthful male figure of Antinous to gain power and influence in his own time and to leave a lasting impact on generations to come. Using the statue known as the Farnese Antinous I will show that these very different men were not so different after all: each understood the human tendency to romanticize the past, and each attempted to evoke a feeling of nostalgia for the past from those they sought to “conquer.” Hadrian used portraits of Antinous to unite an empire and cement his place in history; Agostino used one of those very same portraits in commissioned artworks by Raphael to earn his place among the nobility of his day, and to leave a lasting legacy for his descendants.

Bloch s ontology suggests different levels in the category of possibility, and, among them, the subjective possibility, which presupposes the human beings capacity to accomplish their daydreams and build their utopias that is a fact that triggers an instrumental rationality, determining the domain that men has towards nature. Another level of the possibility identifies, in the natura naturans movement, nature that produces nature , the domain that matter has towards man and the consequent degeneration of the matter in this relationship. Thus, our main objective is to present a blochiana solution to the conflict. According to Bloch, the possible dialectic is carried out through the organic interaction between the human being s tendencies as well as latencies of matter. The current study reflects this possibility and verifies that the process of the instrumentation of the world reveals the possible dialectic , which can be the solution of the of the impacts, that are trigged by the matter dynamic and the man s activity, that generates a relevant tension in docta spes, that is, clarified hope. So, we tried to demonstrate that the consequences of this conflict are appropriate for two movements: the first is generated by the human being s instrumentation, announced by Frankfurt School and was not understood by man in the XXI century; and the second has, as a consequence, the natural evolution of the science, that develops technologies which can build a new face to the world. Therefore, this research suggests that is necessary to rethink about the solution of organicity, man-matter, announced by Bloch, who introduced the ethic aspect in this relationship.

Antinoopolis, fondation de l'empereur Hadrien en 130 de notre ère, apparait comme un site majeur de l'Égypte de l'antiquité tardive par la magnificence de son architecture, image d'un souverain évergète guidé par un ambitieux dessein politique, et par son incontestable aura tant intellectuelle que religieuse. Ses vastes nécropoles, fouillées dès la fin du XIXe siècle par l'archéologue Albert Gayet (1856-1916), ont livré une moisson extraordinaire de documents de tous ordres, d'époques romaine et byzantine, devant laquelle on demeure aujourd'hui déconcerté. Une certaine confusion dans la conduite des fouilles et l'éclatement des collections dans une centaine de musées en France, imposaient d'abord un état des lieux à la lumière de témoignages littéraires anciens ou modernes et à partir d'archives, en grande partie inédites. La reconstitution des faits historiques, archéologiques et muséographiques apporte un éclairage nouveau sur les caractères propres de la cité et sur les priorités données à son exploration. La confrontation entre ces données et le matériel exhume révèle des pièces souvent méconnues et des aspects ignorés, dont l'analyse est fragilisée par les manques et pertes, tant d'informations sur le contexte archéologique que de pièces elles-mêmes (problèmes de conservation et de destruction). Ce matériel reflète à la fois le quotidien des habitants d'Antinoë et leurs croyances à travers les usages funéraires ; le bilan dégagé permet, par comparaison avec d'autres sites, de retenir certaines particularités et singularités qui n'appartiennent qu'à la métropole hadrienne ou n'ont été reconnues qu'ici.
